reply_v that_o though_o alderman_n brown_n be_v a_o justice_n of_o the_o peace_n yet_o in_o the_o capacity_n of_o major_a general_n of_o the_o city_n regiment_n he_o send_v his_o officer_n and_o soldier_n to_o take_v friend_n at_o their_o meeting_n and_o not_o in_o the_o place_n as_o he_o be_v a_o civil_a magistrate_n for_o than_o he_o may_v and_o shall_v have_v send_v his_o constable_n or_o peremptory_a and_o such_o like_a but_o after_o a_o little_a stop_n the_o prisoner_n begin_v to_o speak_v to_o the_o matter_n again_o still_o urge_v the_o court_n and_o jury_n that_o the_o witness_n be_v altogether_o insufficient_a person_n and_o tell_v they_o he_o will_v once_o more_o lay_v it_o before_o they_o and_o then_o leave_v it_o to_o their_o consideration_n then_o the_o judge_n interrupt_v and_o say_v on_o this_o wise_a tell_v the_o prisoner_n that_o he_o have_v nothing_o to_o say_v but_o to_o these_o two_o thing_n first_o whether_o he_o can_v prove_v by_o witness_n upon_o therefore_o he_o desire_v their_o patience_n to_o hear_v but_o while_o go_v on_o in_o this_o discourse_n to_o moderate_v the_o court_n and_o to_o prepare_v their_o mind_n for_o audience_n and_o that_o he_o may_v come_v discreet_o to_o the_o matter_n the_o judge_n of_o the_o court_n stop_v he_o and_o interrupt_v his_o speech_n and_o tell_v the_o prisoner_n that_o he_o must_v be_v pertinent_a and_o brief_a for_o they_o have_v much_o to_o do_v and_o can_v not_o be_v hold_v in_o long_a discourse_n to_o which_o the_o prisoner_n reply_v his_o cause_n be_v weighty_a and_o desire_a time_n of_o know_v not_o the_o law_n of_o england_n and_o therefore_o can_v not_o tell_v whether_o he_o be_v a_o english_a man_n for_o every_o english_a man_n must_v needs_o know_v the_o law_n of_o the_o land_n to_o which_o e._n burrough_n reply_v he_o only_o say_v he_o know_v not_o the_o particular_a point_n or_o every_o particular_a point_n of_o the_o law_n and_o not_o that_o he_o know_v nothing_o at_o may_v be_v permit_v to_o go_v on_o in_o his_o defence_n of_o his_o cause_n and_o to_o show_v his_o exception_n against_o the_o witness_n which_o the_o court_n give_v he_o leave_v to_o do_v and_o then_o he_o do_v assert_v that_o the_o say_v person_n be_v not_o competent_a witness_n in_o this_o case_n and_o therefore_o their_o evidence_n ought_v not_o to_o be_v take_v against_o he_o for_o they_o be_v a_o party_n against_o he_o and_o not_o indifferent_a man_n and_o they_o can_v not_o just_o and_o according_a to_o right_n be_v both_o party_n prosecutor_n and_o witness_n against_o he_o that_o they_o be_v a_o party_n it_o be_v manifest_a by_o their_o own_o word_n in_o as_o much_o as_o they_o have_v testify_v they_o take_v he_o so_o and_o so_o in_o the_o capacity_n of_o soldier_n by_o force_n of_o arm_n which_o be_v not_o by_o due_a prosecution_n of_o the_o law_n of_o the_o land_n by_o civil_a officer_n by_o warrant_n from_o some_o civil_a magistrate_n or_o by_o constable_n etc._n etc._n and_o the_o prisoner_n further_o testify_v in_o these_o word_n that_o these_o man_n who_o now_o appear_v against_o he_o as_o witness_n have_v themselves_o violate_v the_o law_n of_o the_o land_n and_o do_v violence_n unto_o the_o law_n and_o government_n of_o england_n in_o that_o by_o force_n of_o arm_n and_o not_o by_o due_a process_n at_o law_n they_o have_v seize_v upon_o his_o
