xxxv_o that_o where_o any_o party_n may_v take_v forth_o sub-poena's_a of_o course_n to_o bring_v in_o a_o deed_n the_o register_n shall_v grant_v a_o order_n of_o course_n under_o his_o hand_n and_o like_o order_n where_o the_o court_n do_v direct_v it_o and_o the_o sub-poena's_a ducens_fw-la tecum_fw-la to_o be_v forbear_v and_o the_o register_n shall_v take_v for_o such_o order_n and_o enter_v it_o 12.d_o and_o no_o more_o observation_n 35._o this_o be_v already_o provide_v for_o by_o the_o late_a rule_n make_v by_o the_o present_a lord_n commissioner_n more_o expeditious_a and_o at_o less_o charge_n than_o be_v propose_v in_o this_o section_n viz._n that_o the_o party_n may_v of_o course_n without_o order_n or_o motion_n take_v out_o a_o writ_n of_o ducens_fw-la tecum_fw-la to_o bring_v in_o any_o writing_n confess_v in_o the_o defendant_n answer_v but_o in_o case_n the_o party_n on_o his_o examination_n and_o consideration_n have_v to_o the_o title_n set_v forth_o in_o his_o answer_n do_v make_v good_a claim_n to_o the_o write_n the_o plaintiff_n in_o such_o case_n be_v to_o pay_v cost_n which_o order_n be_v conceive_v to_o be_v a_o more_o wholesome_a and_o safe_a course_n than_o what_o be_v prescribe_v in_o this_o section_n sect_n xxxvi_o that_o the_o time_n of_o redemption_n of_o land_n mortgage_v before_o or_o at_o the_o pass_n of_o this_o law_n where_o no_o suit_n be_v depend_v for_o the_o same_o shall_v not_o exceed_v two_o year_n from_o the_o pass_v this_o act_n and_o the_o time_n of_o redemption_n upon_o any_o mortgage_n after_o to_o be_v make_v shall_v not_o exceed_v one_o year_n from_o the_o entry_n of_o the_o mortgage_n after_o the_o condition_n break_v and_o from_o the_o time_n of_o entry_n within_o the_o year_n and_o until_o redemption_n the_o morgagee_n shall_v receive_v double_a damage_n if_o it_o be_v redeem_v unless_o where_o a_o infant_n be_v the_o heir_n of_o a_o morgager_n and_o to_o redeem_v shall_v have_v two_o year_n and_o not_o above_o from_o the_o time_n of_o the_o entry_n of_o the_o morgagee_n after_o the_o condition_n break_v pay_v single_a damage_n and_o that_o in_o all_o case_n where_o the_o morgager_n die_v have_v a_o heir_n within_o age_n and_o the_o morgagee_n redeemable_a such_o heir_n upon_o satisfaction_n of_o cost_n and_o damage_n may_v join_v with_o his_o guardian_n to_o make_v re-conveyance_n of_o the_o land_n mortgage_v and_o the_o same_o shall_v be_v good_a against_o such_o infant_n and_o all_o claim_n under_o he_o observation_n 36._o the_o time_n limit_v for_o redemption_n of_o land_n mortgage_v seem_v very_o short_a and_o too_o strict_a and_o tend_v to_o the_o forreit_n of_o many_o man_n estate_n when_o morgager_n can_v raise_v money_n within_o the_o time_n prescribe_v by_o this_o section_n for_o redemption_n and_o in_o case_n money-monger_n combine_v together_o in_o such_o case_n morgager_n must_v either_o forfeit_v their_o land_n at_o half_a the_o value_n or_o else_o sell_v it_o at_o a_o extraordinary_a undervalue_n and_o by_o this_o mean_v no_o money_n can_v be_v raise_v by_o person_n indebt_v but_o on_o unconscionable_a disadvantageous_a term_n which_o can_v but_o occasion_v a_o decay_n of_o trade_n and_o commerce_n in_o the_o nation_n and_o either_o disable_v creditor_n to_o pay_v their_o debt_n or_o else_o expose_v they_o to_o ruin_v by_o forfeiture_n of_o their_o estate_n at_o great_a undervalue_v but_o on_o the_o other_o side_n it_o seem_v unreasonable_a that_o a_o morgagee_n shall_v be_v subject_a to_o a_o bill_n in_o equity_n for_o redemption_n after_o 20._o or_o 30._o year_n forfeiture_n and_o sometime_o long_o and_o after_o alienation_n of_o the_o estate_n which_o occasion_v many_o unnecessary_a troublesome_a and_o chargeable_a suit_n so_o that_o a_o reasonable_a certain_a time_n be_v limit_v beyond_o which_o there_o shall_v be_v no_o redemption_n seem_v just_a and_o convenient_a which_o be_v leave_v to_o the_o grave_a consideration_n of_o those_o who_o be_v to_o enact_v the_o same_o sect_n xxxvii_o that_o from_o the_o time_n of_o hear_v of_o suit_n now_o depend_v in_o court_n of_o equity_n upon_o mortgage_n there_o shall_v not_o be_v in_o any_o case_n above_o six_o month_n allow_v for_o time_n of_o redemption_n from_o the_o hear_n of_o the_o cause_n and_o there_o shall_v be_v no_o stay_n of_o any_o legal_a proceed_n upon_o any_o mortgage_n unless_o equity_n be_v in_o the_o defendant_n answer_v confess_v or_o adjudge_v of_o the_o court_n upon_o hear_v of_o the_o cause_n observation_n 37._o this_o seem_v reasonable_a sect_n xxxviii_o that_o a_o morgagee_n enter_v and_o a_o morgager_n redeem_v land_n mortgage_v the_o morgagee_n shall_v not_o be_v responsable_a for_o more_o than_o the_o profit_v he_o have_v clear_o make_v of_o the_o land_n while_o he_o have_v the_o same_o in_o mortgage_n deduct_v his_o necessary_a charge_n which_o shall_v be_v determine_v by_o the_o oath_n of_o the_o morgager_n his_o heir_n and_o assign_v and_o no_o other_o profit_n shall_v be_v require_v or_o admit_v sect_n thirty-nine_o that_o the_o form_n of_o the_o oath_n shall_v be_v that_o neither_o the_o morgagee_n nor_o any_o other_o derive_v title_n under_o he_o to_o his_o use_n have_v make_v other_o or_o more_o profit_n of_o the_o land_n than_o be_v give_v in_o upon_o such_o oath_n as_o far_o as_o he_o know_v believe_v or_o can_v possible_o discover_v and_o that_o there_o have_v not_o be_v any_o fraud_n nor_o wilful_a neglect_n so_o far_o as_o he_o know_v or_o believe_v in_o the_o management_n thereof_o whereby_o the_o profit_n be_v not_o make_v to_o his_o use_n of_o the_o land_n or_o tenement_n mortgage_v observation_n 38._o and_o 39_o against_o which_o the_o author_n offer_v this_o to_o consideration_n that_o in_o case_n the_o morgagee_n will_v let_v the_o land_n to_o a_o friend_n of_o he_o at_o a_o extreme_a undervalue_n this_o can_v be_v term_v proper_o a_o fraud_n for_o any_o man_n may_v let_v out_o his_o own_o land_n or_o what_o he_o be_v just_o possess_v of_o and_o have_v power_n to_o let_v and_o set_v at_o what_o rate_n he_o please_v but_o in_o case_n the_o morgager_n or_o any_o other_o for_o he_o or_o any_o other_o person_n offer_v the_o morgagee_n a_o far_o more_o considerable_a rent_n and_o as_o good_a term_n and_o security_n as_o he_o be_v to_o have_v from_o another_o tenant_n who_o be_v to_o have_v it_o at_o a_o undervalue_n this_o will_v render_v it_o a_o fraud_n otherwise_o not_o and_o as_o to_o the_o provision_n make_v in_o this_o section_n touch_v the_o oath_n to_o be_v take_v by_o the_o morgagee_n the_o morgagee_n may_v great_o damnify_v the_o morgager_n in_o point_n of_o redemption_n and_o yet_o take_v the_o oath_n herein_o before_o direct_v and_o it_o be_v well_o if_o course_n be_v take_v to_o avoid_v the_o take_n of_o oath_n which_o be_v sacred_a unless_o in_o case_n of_o necessity_n and_o therefore_o it_o be_v
opinion_n of_o we_o because_o king_n be_v fit_a to_o inform_v king_n and_o judge_n to_o teach_v judge_n jurisdiction_n but_o further_a out_o of_o our_o science_n and_o profession_n we_o have_v think_v fit_a these_o further_a reason_n and_o proof_n very_o brief_o to_o offer_v because_o in_o case_n of_o so_o ancient_a a_o possession_n of_o jurisdiction_n we_o hold_v it_o not_o fit_a to_o amplify_v praemunire_n the_o say_v statute_n upon_o which_o this_o question_n grow_v be_v principal_o one_o whereof_o be_v a_o statute_n of_o praemunire_n and_o the_o other_o be_v a_o statute_n of_o simple_a prohibition_n that_o of_o the_o praemunire_n be_v the_o statute_n of_o 27._o e._n 3._o car._n 1._o and_o the_o statute_n of_o simple_a prohibition_n 4._o h._n 4._o car._n 23._o there_o be_v divers_a other_o statute_n of_o both_o kind_n but_o the_o question_n will_v rest_v on_o these_o two_o as_o we_o conceive_v it_o for_o that_o the_o statute_n of_o 27._o e._n 3._o it_o can_v in_o our_o opinion_n extend_v unto_o the_o chancery_n for_o these_o reason_n 1._o out_o of_o the_o mischief_n which_o the_o statute_n provide_v for_o and_o recite_v viz._n that_o such_o suit_n and_o plea_n against_o which_o the_o statute_n be_v provide_v be_v in_o prejudice_n and_o disherison_n of_o the_o king_n and_o his_o crown_n which_o can_v be_v apply_v to_o the_o chancery_n for_o the_o king_n can_v be_v disinherited_a of_o jurisdiction_n but_o either_o by_o the_o foreigner_n or_o by_o the_o subject_a but_o never_o by_o his_o own_o court_n 2._o out_o of_o the_o remedy_n which_o the_o statute_n appoint_v viz._n that_o the_o offender_n shall_v be_v warn_v within_o two_o month_n to_o be_v before_o the_o king_n and_o his_o council_n or_o in_o his_o chancery_n or_o before_o the_o king_n justice_n of_o the_o one_o bench_n or_o the_o other_o etc._n etc._n by_o which_o word_n it_o be_v oppose_v in_o itself_o that_o the_o chancery_n shall_v give_v both_o the_o offence_n and_o the_o remedy_n 3._o out_o of_o the_o penalty_n which_o be_v not_o only_o severe_a but_o hostile_a namely_o that_o the_o offender_n shall_v be_v put_v out_o of_o the_o king_n protection_n which_o penalty_n altogether_o savour_v of_o adhere_v to_o foreign_a jurisdiction_n and_o will_v never_o have_v be_v inflict_v upon_o excess_n only_o of_o jurisdiction_n in_o any_o of_o the_o king_n court_n as_o the_o court_n of_o chancery_n be_v 4._o out_o of_o the_o statute_n precedent_n and_o subsequent_a of_o 25._o e._n 3._o car._n 1._o and_o 16._o r._n 2._o car._n 5._o which_o be_v of_o the_o same_o nature_n and_o can_v be_v apply_v but_o to_o foreign_a court_n for_o the_o word_n alibi_fw-la or_o elsewhere_o be_v never_o use_v but_o where_o rome_n be_v name_v especial_o before_o 5._o the_o dis-junctive_a in_o this_o statute_n which_o only_o give_v the_o colour_n viz._n that_o they_o which_o draw_v out_o of_o the_o realm_n in_o plea_n whereof_o the_o cognizance_n pertain_v to_o the_o king_n court_n or_o of_o thing_n whereof_o judgement_n be_v give_v in_o the_o king_n court_n or_o which_o do_v sue_v in_o any_o other_o court_n to_o defeat_v or_o impeach_v the_o judgement_n give_v in_o the_o king_n court_n this_o last_o disjunctive_a we_o say_v which_o must_v go_v further_a than_o court_v out_o of_o the_o realm_n which_o be_v full_o provide_v for_o by_o the_o former_a branch_n have_v sufficient_a matter_n and_o effect_n to_o work_v upon_o in_o respect_n of_o such_o court_n which_o though_o they_o be_v local_o within_o the_o realm_n yet_o in_o jurisdiction_n be_v subordinate_a to_o the_o foreigner_n such_o as_o be_v the_o legate_n court_n and_o deligate_v court_n and_o in_o general_a all_o the_o ecclesiastical_a court_n within_o the_o realm_n at_o that_o time_n as_o it_o be_v express_o construe_v by_o the_o judge_n in_o 5._o e._n 4._o foe_n 6._o 6._o in_o this_o the_o sight_n of_o the_o record_n of_o the_o petition_n do_v clear_v the_o doubt_n where_o the_o subject_a supplicate_v to_o the_o king_n to_o ordain_v remedy_n against_o those_o which_o pursue_v in_o other_o court_n then_o his_o own_o against_o judgement_n give_v in_o his_o court_n which_o explain_v the_o word_n other_o to_o be_v other_o than_o the_o king_n court._n 7._o with_o this_o agree_v notable_o the_o book_n of_o entry_n which_o translate_v the_o word_n in_o other_o court_n not_o in_o alia_fw-la curia_fw-la but_o aliena_fw-la curia_fw-la this_o statute_n of_o 27._o of_o ed._n 3._o be_v in_o corroboration_n of_o the_o common_a law_n as_o itself_o recite_v we_o do_v not_o find_v in_o the_o register_n any_o precedent_n of_o the_o writ_n of_o ad_fw-la jura_fw-la regius_fw-la which_o be_v frame_v upon_o these_o case_n that_o be_v afterward_o make_v penal_a by_o praemunire_n but_o only_o against_o the_o ecclesiastical_a court_n last_o we_o have_v not_o find_v any_o precedent_n at_o all_o of_o any_o condition_n of_o the_o statute_n of_o praemunire_n of_o this_o nature_n of_o suit_n in_o chancery_n but_o only_o two_o or_o three_o bill_n of_o indictment_n prefer_v sed_fw-la nihil_fw-la inde_fw-la venit_fw-la for_o aught_o appear_v to_o we_o for_o the_o statute_n of_o hen._n 4._o that_o no_o doubt_n be_v make_v against_o proceed_n within_o the_o realm_n and_o not_o against_o forraign_n and_o therefore_o have_v no_o penalty_n annex_v nevertheless_o we_o conceive_v that_o it_o extend_v not_o to_o the_o chancery_n in_o the_o case_n deliver_v for_o these_o reason_n 1._o the_o statute_n recite_v where_o the_o party_n be_v make_v to_o come_v upon_o grievous_a pain_n sometime_o before_o the_o king_n himself_o sometime_o before_o the_o king_n council_n and_o sometime_o in_o parliament_n to_o answer_v thereof_o anew_o etc._n etc._n where_o it_o appear_v that_o the_o chancery_n be_v not_o name_v which_o can_v not_o have_v be_v forget_v but_o be_v leave_v out_o upon_o great_a reason_n because_o the_o chancery_n be_v a_o court_n of_o ordinary_a justice_n for_o matter_n of_o equity_n and_o the_o statute_n mean_v only_o to_o restrain_v extraordinary_a commission_n and_o such_o like_a proceed_n 2._o this_o appear_v full_o in_o view_v and_o compare_v the_o two_o petition_n which_o be_v make_v the_o same_o parliament_n of_o 4._o h._n 4._o place_v immediate_o by_o the_o one_o before_o the_o other_o the_o first_o of_o which_o be_v recite_v by_o the_o king_n and_o the_o second_o whereupon_o the_o statute_n be_v make_v whereof_o the_o first_o be_v to_o restrain_v three_o ordinary_a proceed_n of_o justice_n that_o be_v to_o say_v in_o chancery_n by_o name_n in_o the_o exchequer_n and_o before_o the_o king_n council_n by_o process_n of_o privy_a seal_n unto_o which_o the_o king_n make_v a_o royal_a prudent_a answer_n in_o these_o word_n the_o king_n will_v charge_v his_o officer_n to_o be_v more_o spare_v to_o send_v for_o his_o subject_n by_o such_o process_n than_o they_o have_v heretofore_o be_v but_o notwithstanding_o it_o be_v not_o his_o mind_n that_o the_o officer_n shall_v so_o far_o abstain_v but_o they_o may_v call_v his_o subject_n before_o they_o in_o matter_n and_o cause_n necessary_a as_o it_o have_v be_v do_v in_o the_o time_n of_o his_o good_a progenitor_n and_o then_o immediate_o follow_v the_o petition_n whereupon_o this_o act_n now_o in_o question_n be_v make_v unto_o which_o the_o king_n give_v his_o assent_n and_o wherein_o no_o mention_n be_v make_v at_o all_o of_o the_o chancery_n or_o exchequer_n 3._o if_o the_o chancery_n shall_v be_v understand_v to_o be_v within_o the_o statute_n yet_o the_o statute_n extend_v not_o to_o this_o case_n for_o the_o word_n be_v that_o the_o king_n subject_n after_o judgement_n be_v draw_v thereof_o anew_o which_o must_v be_v understand_v when_o the_o same_o matter_n former_o judge_v be_v put_v in_o issue_n or_o question_v again_o but_o when_o the_o case_n be_v call_v into_o chancery_n only_o upon_o point_n of_o equity_n there_o as_o the_o point_n of_o equity_n be_v never_o in_o question_n in_o the_o common_a law_n so_o the_o point_n of_o law_n be_v of_o fact_n as_o it_o concern_v the_o law_n be_v never_o in_o question_n in_o the_o chancery_n so_o the_o same_o thing_n be_v not_o twice_o in_o question_n or_o answer_v anew_o for_o the_o chancery_n do_v supply_v the_o law_n and_o not_o cross_v it_o 4._o it_o appear_v to_o our_o understanding_n by_o the_o clause_n of_o error_n and_o attaint_n in_o the_o same_o statute_n what_o jurisdiction_n it_o be_v that_o the_o statute_n mean_v to_o restrain_v viz._n such_o jurisdiction_n as_o do_v assume_v to_o reverse_v and_o undo_v the_o judgement_n as_o error_n or_o attaint_n do_v which_o the_o chancery_n never_o do_v but_o leave_v the_o judgement_n in_o peace_n and_o only_o meddle_v with_o the_o corrupt_a conscience_n of_o the_o party_n for_o if_o the_o chancery_n do_v assume_v to_o reverse_v the_o judgement_n in_o the_o point_n adjudge_v it_o be_v void_a as_o appear_v 39_o e
