the_o time_n of_o his_o conviction_n and_o the_o popish_a recusant_n who_o have_v no_o certain_a place_n of_o abode_n within_o this_o realm_n be_v within_o this_o statute_n although_o he_o be_v never_o convict_v so_o that_o either_o of_o these_o sort_n of_o popish_a recusant_n who_o have_v a_o estate_n under_o value_n viz._n he_o who_o have_v no_o certain_a place_n of_o abode_n and_o he_o who_o have_v a_o certain_a place_n of_o abode_n be_v convict_v when_o a_o popish_a recusant_n and_o in_o england_n and_o no_o other_o be_v liable_a by_o this_o act_n to_o abjuration_n of_o the_o clear_a yearly_a value_n value_n clear_a yearly_a value_n of_o twenty_o mark_n above_o all_o charge_n a_o rent-charge_n of_o 40_o l._n per_fw-la annum_fw-la be_v issue_v out_o of_o land_n worth_a 100_o l._n per_fw-la annum_fw-la a_o popish_a recusant_n liable_a to_o be_v confine_v by_o this_o statute_n purchase_v for_o his_o life_n or_o in_o fee_n parcel_n of_o the_o land_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n over_z and_o above_o what_o his_o proportion_n of_o the_o say_a rent-charge_n come_v to_o this_o be_v a_o estate_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n within_o the_o meaning_n of_o this_o act_n and_o shall_v free_v he_o from_o abjuration_n for_o although_o in_o strictness_n of_o law_n his_o estate_n be_v not_o clear_o so_o much_o above_o all_o charge_n for_o that_o it_o be_v chargeable_a with_o a_o yearly_a rent_n of_o forty_o pound_n yet_o in_o equity_n he_o shall_v pay_v no_o more_o than_o his_o proportion_n of_o it_o which_o the_o land_n he_o purchase_v will_v discharge_v and_o yet_o yield_v twenty_o mark_n per_fw-la annum_fw-la clear_o beside_o or_o good_n and_o chattel_n this_o statute_n be_v in_o the_o disjunctive_a land_n or_o good_n a_o estate_n partly_o of_o land_n together_o good_n and_o land_n not_o to_o be_v value_v together_o and_o partly_o of_o good_n will_v not_o satisfy_v the_o intent_n thereof_o and_o therefore_o if_o a_o popish_a recusant_n who_o offend_v against_o this_o act_n have_v fifteen_o mark_n per_fw-la annum_fw-la clear_o in_o land_n and_o be_v worth_a thirty_o pound_n in_o good_n although_o this_o take_v together_o be_v in_o truth_n a_o estate_n of_o more_o value_n than_o be_v here_o require_v yet_o it_o shall_v not_o free_v he_o from_o abjuration_n for_o the_o statute_n do_v not_o warrant_v any_o valuation_n of_o the_o land_n and_o good_n together_o so_o as_o to_o supply_v the_o defect_n of_o the_o yearly_a value_n of_o the_o land_n by_o the_o good_n or_o the_o defect_n of_o the_o value_n of_o the_o good_n by_o the_o land_n and_o therefore_o the_o recusant_n must_v have_v such_o a_o estate_n in_o the_o one_o or_o the_o other_o as_o will_v answer_v the_o statute_n and_o this_o be_v not_o like_o the_o case_n of_o juror_n upon_o the_o statute_n of_o 2_o h._n 5._o 3._o stat._n 2_o h._n 5._o 3._o cap._n 3._o where_o it_o be_v say_v that_o the_o juror_n shall_v have_v land_n of_o the_o clear_a yearly_a value_n of_o forty_o shilling_n if_o the_o debt_n or_o damage_n declare_v amount_v to_o forty_o mark_n in_o which_o case_n although_o it_o be_v in_o the_o disjunctive_a debt_n or_o damage_n yet_o it_o have_v be_v adjudge_v that_o where_o the_o debt_n and_o damage_n both_o amount_v to_o forty_o mark_n it_o be_v sufficient_a and_o the_o juror_n must_v have_v forty_o shilling_n per_fw-la annum_fw-la co._n 1._o inst_z 272._o for_o in_o that_o case_n the_o word_n or_o be_v cumulative_a and_o debt_n or_o damage_n both_v amount_v to_o different_a nature_n one_o real_a the_o other_o personal_a and_o can_v be_v regular_o reduce_v under_o one_o and_o the_o same_o head_n and_o therefore_o shall_v not_o be_v value_v together_o unless_o the_o act_n have_v express_o appoint_v such_o a_o valuation_n but_o yet_o if_o a_o popish_a recusant_n have_v a_o lease_n for_o year_n may_v but_o lease_n for_o year_n and_o personal_a good_n may_v and_o personal_a good_n and_o both_o do_v amount_v in_o value_n to_o above_o forty_o pound_n he_o shall_v be_v out_o of_o the_o danger_n of_o abjuration_n for_o although_o the_o lease_n be_v in_o the_o realty_n and_o the_o good_n be_v personal_a yet_o they_o shall_v in_o this_o case_n be_v value_v together_o for_o that_o by_o this_o copulative_a and_o the_o statute_n express_o so_o appoint_v without_o distinguish_v between_o the_o value_v of_o either_o but_o make_v it_o sufficient_a if_o both_o of_o they_o be_v of_o that_o value_n money_o secure_v upon_o a_o mortgage_n mortgage_n mortgage_n of_o land_n be_v within_o the_o meaning_n of_o these_o word_n good_n and_o chattel_n and_o if_o the_o popish_a recusant_n have_v above_o forty_o pound_n owe_v to_o he_o upon_o such_o mortgage_n he_o can_v be_v require_v to_o abjure_v within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v or_o take_v wingate_n in_o abridge_n this_o clause_n tit_n crown_n numb_a 80._o clear_o mistake_v the_o meaning_n of_o it_o for_o he_o say_v that_o a_o popish_a recusant_n who_o estate_n be_v under_o value_n must_v make_v the_o submission_n prescribe_v by_o this_o one_o as_o conceal_v his_o true_a name_n or_o quality_n or_o can_v give_v a_o good_a account_n what_o he_o be_v for_o so_o it_o must_v be_v reasonable_o intend_v and_o not_o of_o all_o traveller_n here_o give_v to_o the_o six_o privy_a counsellor_n be_v the_o same_o with_o that_o of_o the_o justice_n of_o peace_n in_o their_o session_n they_o may_v by_o force_n of_o this_o act_n tender_v it_o to_o any_o nobleman_n or_o unmarried_a noblewoman_n whatsoever_o above_o eighteen_o year_n old_a for_o the_o justice_n of_o peace_n in_o their_o session_n may_v tender_v it_o there_o to_o any_o other_o person_n whatsoever_o but_o if_o it_o be_v mean_v of_o the_o power_n give_v the_o justice_n of_o peace_n out_o of_o session_n than_o the_o six_o privy_a counsellor_n can_v tender_v it_o by_o peace_n seem_v to_o bear_v this_o construction_n viz._n where_o any_o bishop_n or_o justice_n of_o peace_n either_o the_o one_o or_o the_o other_o indifferent_o may_v require_v the_o oath_n and_o that_o can_v be_v intend_v only_o of_o the_o power_n give_v out_o of_o session_n for_o in_o session_n the_o bishop_n have_v nothing_o to_o do_v but_o have_v the_o justice_n of_o assize_n be_v here_o add_v scilicet_fw-la in_o all_o cause_n where_o the_o bishop_n justices_z of_o assize_n or_o justice_n of_o peace_n may_v require_v this_o oath_n it_o have_v be_v clear_a that_o the_o power_n here_o give_v the_o six_o privy_a counsellor_n be_v as_o extensive_a as_o that_o which_o be_v give_v the_o justice_n of_o assize_n or_o justice_n of_o peace_n in_o their_o session_n and_o they_o may_v have_v require_v the_o oath_n of_o any_o nobleman_n or_o unmarried_a noblewoman_n whatsoever_o of_o competent_a age_n so_o if_o the_o justice_n of_o peace_n only_o have_v be_v here_o name_v it_o have_v be_v clear_o intend_v of_o the_o justice_n of_o peace_n in_o either_o capacity_n either_o in_o or_o out_o of_o session_n but_o bishop_n seem_v here_o to_o be_v a_o restrictive_a word_n and_o to_o give_v the_o privy_a counsellor_n no_o more_o power_n in_o respect_n of_o the_o nobility_n than_o the_o bishop_n have_v in_o reference_n to_o any_o other_o subject_a 2._o these_o word_n in_o all_o cause_n where_o &c._n &c._n seem_v to_o be_v restrictive_a likewise_o and_o exclusive_a of_o some_o cause_n but_o the_o power_n of_o the_o justice_n of_o peace_n in_o session_n extend_v to_o all_o cause_n and_o person_n under_o the_o degree_n of_o nobility_n whatsoever_o which_o therefore_o can_v be_v here_o intend_v but_o only_o some_o particular_a cause_n ejusdem_fw-la generis_fw-la which_o can_v be_v no_o other_o than_o the_o cause_n before_o mention_v wherein_o the_o bishop_n or_o two_o justice_n out_o of_o session_n may_v deal_v viz._n where_o the_o party_n be_v before_o convict_v or_o indict_v or_o have_v not_o receive_v the_o sacrament_n or_o pass_v unknown_a and_o confess_v etc._n etc._n and_o yet_o as_o it_o be_v report_v in_o bulstrode_n 1._o 197._o the_o case_n of_o the_o lord_n vaux_n pasch_fw-mi 10._o car._n 1._o be_v to_o the_o contrary_a for_o it_o be_v say_v there_o he_o be_v commit_v to_o the_o fleet_n by_o the_o privy_a council_n for_o refuse_v this_o oath_n shall_v not_o be_v tender_v she_o by_o privy_a counsellor_n but_o the_o bishop_n or_o two_o justice_n of_o peace_n quorum_fw-la unus_fw-la etc._n etc._n may_v by_o force_n of_o this_o act_n require_v she_o to_o take_v it_o and_o upon_o her_o refusal_n may_v proceed_v against_o she_o as_o be_v above_o direct_v in_o the_o case_n of_o a_o common_a person_n see_v more_o of_o this_o matter_n stat._n 7_o jac._n cap._n 6._o sect._n 4._o age._n age._n then_o be_v above_o the_o age_n of_o eighteen_o year_n in_o this_o case_n that_o day_n eighteen_o year_n on_o which_o the_o party_n be_v bear_v must_v and_o distinct_a by_o itself_o cro._n jac._n supra_fw-la but_o to_o this_o the_o court_n make_v no_o answer_n and_o it_o seem_v that_o such_o a_o assent_n be_v well_o enough_o though_o in_o the_o same_o write_n with_o the_o licence_n if_o it_o be_v express_v that_o the_o four_o justice_n do_v licence_n and_o the_o deputy_n lieutenant_n do_v assent_v and_o such_o write_n be_v under_o the_o hand_n and_o seal_n of_o all_o five_o reside_v within_o the_o say_a county_n or_o liberty_n county_n residence_n in_o the_o county_n these_o word_n seem_v to_o refer_v as_o well_o to_o the_o bishop_n and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o the_o deputy_n lieutenant_n and_o by_o consequence_n so_o must_v the_o word_n immediate_o subsequent_a viz._n reside_v and_o as_o to_o the_o bishop_n the_o inconvenience_n be_v the_o same_o as_o in_o the_o case_n of_o the_o lieutenant_n for_o by_o their_o remoteness_n they_o be_v disable_v to_o judge_v of_o the_o condition_n and_o behaviour_n of_o the_o recusant_n to_o be_v license_v and_o of_o the_o circumstance_n wherein_o he_o stand_v and_o whether_o such_o licence_n may_v be_v grant_v to_o he_o without_o hazard_n of_o the_o public_a safety_n which_o seem_v to_o be_v the_o reason_n of_o this_o restriction_n to_o the_o county_n or_o liberty_n where_o the_o party_n who_o be_v to_o assent_n reside_v and_o hold_v as_o well_o in_o the_o case_n of_o the_o bishop_n or_o lieutenant_n as_o of_o any_o deputy_n lieutenant_n reside_v out_o of_o the_o county_n licence_n particular_a cause_n of_o the_o licence_n the_o particular_a cause_n of_o the_o say_a licence_n in_o maxfields_n case_n b._n r._n another_o exception_n to_o the_o licence_n grant_v by_o the_o four_o justice_n be_v that_o it_o be_v say_v to_o be_v grant_v for_o certain_a urgent_a cause_n but_o no_o particular_a cause_n for_o the_o recusants_n travel_n be_v express_v in_o the_o licence_n cro._n jac._n supra_fw-la and_o this_o seem_v to_o be_v a_o good_a exception_n for_o the_o insert_v into_o the_o licence_n that_o the_o popish_a recusant_n have_v urgent_a or_o necessary_a occasion_n or_o business_n answer_v only_o the_o former_a part_n of_o this_o proviso_n which_o give_v the_o four_o justice_n power_n to_o licence_n he_o if_o he_o have_v necessary_a occasion_n or_o business_n to_o travel_v out_o of_o the_o compass_n of_o five_o mile_n but_o withal_o it_o ought_v to_o be_v mention_v in_o the_o licence_n particular_o what_o that_o occasion_n or_o business_n be_v which_o be_v the_o cause_n of_o the_o licence_n for_o so_o this_o act_n here_o express_o appoint_v and_o therefore_o that_o form_n of_o a_o licence_n for_o the_o recusant_n to_o travel_v which_o dalton_n v._o cap._n 124._o tit_n licence_n have_v set_v down_o wherein_o no_o other_o cause_o be_v mention_v but_o urgent_a and_o necessary_a business_n seem_v too_o short_a and_o general_a and_o be_v not_o to_o be_v rely_v on_o which_o defect_n the_o author_n of_o the_o late_a addition_n to_o dalton_n will_v have_v do_v well_o to_o have_v rectify_v allegiance_n oath_n of_o allegiance_n first_o take_v his_o corporal_a oath_n in_o mansfield_n case_n moor_n 836._o c._n 1127._o there_o be_v another_o oath_n mention_v for_o the_o popish_a recusant_n to_o take_v before_o he_o can_v be_v license_v to_o travel_v and_o that_o be_v the_o oath_n of_o allegiance_n prescribe_v by_o the_o stat._n of_o 3_o jac._n cap._n 4._o 4._o stat._n 3_o jac._n 4._o for_o it_o be_v there_o say_v that_o in_o a_o information_n bring_v against_o the_o recusant_n for_o travel_v out_o of_o the_o compass_n of_o five_o mile_n the_o defendant_n plead_v a_o licence_n from_o four_o justice_n of_o peace_n and_o his_o plea_n be_v disallow_v because_o among_o other_o thing_n he_o do_v not_o show_v that_o before_o the_o licence_n he_o have_v take_v the_o oath_n of_o allegiance_n yet_o quaere_fw-la of_o this_o and_o by_o what_o law_n the_o omit_v to_o take_v that_o oath_n make_v the_o licence_n void_a but_o i_o rather_o think_v it_o to_o be_v a_o mistake_n and_o that_o such_o a_o exception_n may_v be_v move_v but_o the_o plea_n not_o disallow_v for_o that_o reason_n oath_n one_o justice_n may_v give_v the_o recusant_n his_o oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o mr._n shepherd_n think_v that_o no_o less_o than_o two_o of_o the_o four_o justice_n of_o peace_n can_v minister_v this_o oath_n to_o the_o recusant_n sure_a guide_n cap._n 14._o sect._n 5._o but_o i_o take_v it_o to_o be_v clear_a that_o any_o one_o of_o the_o four_o justice_n may_v minister_v the_o oath_n in_o this_o case_n and_o there_o be_v a_o great_a difference_n between_o any_o justice_n for_o that_o denote_v the_o plural_a number_n as_o in_o the_o subsequent_a clause_n about_o armour_n where_o any_o justice_n may_v imprison_v the_o offender_n that_o be_v any_o two_o justice_n or_o more_o and_o any_o of_o the_o justice_n as_o here_o which_o denote_v the_o singular_a number_n and_o the_o follow_a word_n who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o may_v be_v well_o enough_o apply_v to_o any_o one_o justice_n of_o peace_n that_o he_o have_v true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n true_a averment_n that_o the_o cause_n be_v true_a if_o a_o information_n be_v bring_v against_o a_o popish_a recusant_n for_o travel_v out_o of_o his_o compass_n of_o five_o mile_n and_o he_o plead_v a_o a_o licence_n from_o four_o justice_n of_o peace_n it_o seem_v necessary_a that_o he_o aver_v in_o his_o plea_n that_o the_o cause_v contain_v in_o his_o licence_n be_v true_a and_o real_a vide_fw-la moor_n 836._o c._n 1127._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a function_n stat._n sect._n 9_o a_o recusant_n disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z corporal_z sergeant_z ancient-bearer_n or_o other_o office_n in_o camp_n troup_n band_n or_o company_n of_o soldier_n nor_o shall_v be_v captain_n master_n governor_z or_o bear_v any_o office_n or_o charge_n of_o or_o in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n but_o be_v utter_o dissable_v for_o the_o same_o and_o every_o person_n 3_o jac._n 4._o that_o the_o king_n can_v bring_v a_o action_n of_o debt_n or_o the_o informer_n any_o popular_a suit_n against_o the_o husband_n and_o wife_n for_o any_o offence_n of_o recusancy_n part_n of_o his_o land_n imprison_v by_o process_n of_o law_n or_o for_o some_o other_o cause_v not_o relate_v to_o such_o conviction_n and_o afterward_o be_v set_v at_o liberty_n it_o seem_v that_o the_o husband_n shall_v not_o pay_v the_o ten_o pound_n per_fw-la month_n for_o the_o time_n she_o be_v in_o prison_n for_o the_o act_n speak_v only_o of_o the_o time_n during_o which_o she_o continue_v out_o of_o prison_n and_o although_o she_o be_v not_o imprison_v for_o her_o recusancy_n yet_o see_v she_o have_v not_o during_o such_o her_o imprisonment_n the_o benefit_n intend_v to_o she_o in_o consideration_n of_o the_o ten_o pound_n per_fw-la month_n or_o three_o part_n viz._n her_o liberty_n the_o husband_n shall_v not_o for_o that_o time_n pay_v the_o penalty_n here_o appoint_v to_o save_v her_o imprisonment_n but_o if_o he_o pay_v it_o for_o the_o time_n after_o she_o be_v set_v at_o liberty_n that_o be_v sufficient_a to_o satisfy_v the_o intent_n of_o this_o act._n but_o if_o after_o such_o conviction_n imprisonment_n covinous_a imprisonment_n the_o wife_n be_v imprison_v by_o covin_z upon_o some_o pretence_n not_o relate_v to_o such_o conviction_n that_o shall_v not_o save_v the_o husband_n payment_n of_o the_o ten_o pound_n per_fw-la month_n for_o the_o time_n she_o be_v imprison_v but_o after_o she_o be_v set_v at_o liberty_n she_o may_v be_v again_o imprison_v by_o force_n of_o this_o act_n unless_o the_o husband_n pay_v the_o ten_o pound_n per_fw-la month_n or_o satisfy_v to_o the_o king_n the_o three_o part_n of_o the_o profit_n of_o his_o land_n as_o well_o for_o the_o time_n of_o such_o covinous_a imprisonment_n as_o for_o the_o future_a for_o the_o covinous_a imprisonment_n be_v upon_o the_o matter_n she_o own_o act_n and_o no_o person_n shall_v take_v advantage_n of_o a_o imprisonment_n covinous_o cause_v by_o he_o or_o herself_o 16_o e._n 4._o 5._o and_o here_o she_o continue_v out_o of_o prison_n in_o the_o sense_n of_o this_o act_n because_o her_o imprisonment_n be_v not_o by_o process_n of_o law_n in_o invitam_fw-la covin_z outlawry_n by_o covin_z and_o so_o if_o a_o man_n be_v outlaw_v while_o he_o be_v in_o prison_n yet_o the_o outlawry_n shall_v not_o be_v avoid_v for_o that_o cause_n if_o the_o imprisonment_n be_v by_o covin_z or_o consent_n of_o the_o party_n outlaw_v co._n 1._o inst._n 259._o 38._o any_o priory_n abbey_n nunnery_n popish_a university_n college_n or_o school_n or_o house_n of_o jesuite_n priest_n or_o in_o any_o private_a popish_a family_n and_o shall_v be_v there_o by_o any_o jesuite_n seminary_n priest_n friar_z monk_n or_o other_o popish_a person_n instruct_v persuade_v or_o strengthen_v in_o the_o popish_a religion_n in_o any_o sort_n to_o profess_v the_o same_o or_o shall_v convey_v or_o send_v or_o cause_n to_o be_v convey_v or_o send_v by_o the_o hand_n or_o mean_n of_o any_o person_n whatsoever_o any_o sum_n or_o sum_n of_o money_n or_o other_o thing_n for_o or_o towards_o the_o maintenance_n of_o any_o child_n or_o other_o person_n already_o go_v or_o send_v or_o to_o go_v or_o to_o be_v send_v and_o train_v and_o instruct_v as_o be_v aforesaid_a or_o under_o the_o the_o name_n or_o colour_n of_o any_o charity_n benevolence_n or_o alm_n towards_o the_o relief_n of_o any_o priory_n abbey_n nunnery_n college_n school_n or_o any_o religious_a house_n whatsoever_o every_o person_n so_o send_v convey_v or_o cause_v to_o be_v send_v and_o convey_v as_o well_o any_o such_o child_n or_o other_o person_n as_o any_o sum_n or_o sum_n of_o money_n or_o other_o thing_n and_o every_o person_n pass_v or_o be_v send_v beyond_o the_o sea_n be_v thereof_o lawful_o convict_v in_o or_o upon_o any_o information_n presentment_n or_o indictment_n as_o be_v
