dispose_n of_o they_o that_o no_o chancellor_n commissary_n or_o official_a shall_v have_v power_n to_o commute_v any_o penance_n in_o whole_a or_o in_o part_n but_o either_o together_o with_o the_o bishop_n in_o person_n or_o with_o his_o privity_n in_o writing_n or_o if_o by_o himself_o there_o he_o shall_v give_v up_o a_o full_a and_o just_a account_n of_o all_o such_o commutation_n once_o every_o year_n at_o michaelmas_n to_o the_o bishop_n who_o shall_v with_o his_o chancellor_n see_v that_o all_o such_o money_n be_v dispose_v of_o to_o charitable_a and_o public_a use_n according_a to_o law_n and_o if_o any_o chancellor_n or_o other_o have_v jurisdiction_n as_o aforesaid_a shall_v not_o make_v such_o a_o just_a account_n to_o the_o bishop_n and_o be_v find_v guilty_a of_o it_o he_o shall_v be_v suspend_v from_o all_o exercise_n of_o his_o jurisdiction_n for_o the_o space_n of_o one_o whole_a year_n always_o provide_v that_o if_o the_o crime_n be_v public_o complain_v of_o and_o do_v appear_v notorious_a that_o then_o the_o office_n shall_v signify_v to_o the_o place_n from_o whence_o the_o complaint_n come_v that_o the_o delinquent_n have_v satisfy_v the_o church_n for_o his_o offence_n and_o the_o minister_n shall_v signify_v it_o as_o he_o shall_v be_v direct_v save_v always_o to_o all_o chancellor_n and_o other_o ecclesiastical_a officer_n their_o due_a and_o accustomable_a fee_n if_o he_o or_o they_o be_v not_o so_o suspend_v as_o aforesaid_a xv_o touch_v concurrent_a jurisdiction_n that_o in_o such_o place_n whereinâ—_z there_o be_v concurrent_a jurisdiction_n no_o executor_n be_v cite_v into_o any_o court_n or_o office_n for_o the_o space_n of_o ten_o day_n after_o the_o death_n of_o the_o testator_n and_o that_o aswell_o every_o apparitor_n herein_o as_o every_o register_n or_o clerk_n that_o give_v or_o carry_v out_o any_o citation_n or_o process_n to_o such_o intent_n before_o that_o the_o say_a ten_o day_n be_v expire_v shall_v for_o the_o first_o offence_n herein_o be_v suspend_v from_o the_o execution_n of_o his_o office_n for_o the_o space_n of_o three_o month_n and_o for_o the_o second_o offence_n in_o this_o kind_n be_v and_o in_o their_o own_o parish_n undeâ—_z pain_n of_o suspension_n for_o sâ—â—_z month_n and_o likewise_o we_o straight_o enjoin_v all_o churchwarden_n and_o the_o like_a swear_a officer_n whatsoever_o â—hat_o by_o virtue_n oâ—_z their_o oâ—thes_n they_o shall_v present_v at_o the_o say_a visitation_n the_o name_n of_o such_o person_n who_o they_o know_v or_o hear_v of_o or_o just_o suspect_v to_o in_o the_o several_a parish_n where_o such_o recusant_n live_v and_o every_o three_o month_n they_o shall_v be_v again_o public_o repeat_v in_o the_o place_n aforesaid_a that_o all_o may_v take_v notice_n of_o those_o sentencâ—s_n and_o because_o there_o be_v place_n which_o either_o have_v or_o pretend_v to_o have_v exemption_n in_o which_o such_o delinquent_n do_v usual_o affect_v to_o make_v their_o abode_n therefore_o we_o enjoin_v that_o all_o bishop_n shall_v within_o their_o several_a diocese_n send_v unto_o such_o place_n one_o or_o more_o of_o their_o chaplain_n or_o some_o of_o their_o officer_n who_o they_o may_v rely_v on_o to_o make_v strict_a inquiry_n after_o officer_n in_o those_o kind_n who_o diligent_o return_v their_o information_n according_o the_o say_a bishop_n shall_v certify_v such_o information_n to_o his_o metropolitan_a that_o the_o aforesaid_a proceed_n may_v forthwith_o issue_v from_o some_o high_a court_n in_o these_o case_n whereof_o by_o reason_n of_o the_o say_a exemption_n the_o infâ—riour_a court_n can_v take_v no_o cognisanceâ—_z buâ—_z if_o neithâ—r_v confâ—rring_v nor_o censure_n will_v prevail_v with_o such_o person_n the_o church_n have_v no_o way_n leave_v but_o complaint_n to_o the_o secular_a power_n and_o for_o they_o we_o sâ—â—aitly_o enjoin_v that_o all_o dean_n and_o arch-deacon_n and_o all_o have_v inferior_a or_o exempt_a jurisdiction_n shall_v every_o year_n within_o six_o month_n after_o any_o visitation_n by_o they_o hold_v make_v certificate_n unto_o their_o several_a bishop_n or_o archbishop_n if_o they_o certify_v under_o their_o episcopal_a seal_n in_o parchment_n unto_o the_o justice_n of_o assize_n of_o every_o county_n in_o the_o circuit_n and_o within_o their_o diocese_n respective_o the_o name_n and_o surname_n not_o only_o of_o those_o who_o have_v be_v present_v unto_o they_o from_o the_o say_a dean_n archdeacon_n etc._n etc._n but_o of_o those_o also_o who_o upon_o the_o oath_n of_o churchwarden_n and_o other_o swear_a man_n at_o their_o visitation_n or_o upon_o the_o information_n of_o minister_n employ_v in_o the_o say_a conference_n have_v be_v present_v unto_o they_o that_o so_o the_o say_a intend_a proceed_n may_v have_v the_o more_o speedy_a and_o the_o more_o general_a success_n in_o particular_a it_o shall_v be_v careful_o inquire_v into_o at_o all_o visitation_n under_o the_o oath_n of_o the_o churchwarden_n and_o other_o swear_a man_n what_o recusant_n or_o popish_a person_n have_v be_v either_o marry_v or_o bury_v or_o have_v have_v their_o child_n baptise_v otherwise_o then_o according_a unto_o the_o rule_n and_o form_n establish_v in_o the_o church_n of_o england_n and_o the_o name_n of_o such_o delinquent_n if_o they_o can_v learn_v they_o or_o otherwise_o such_o name_n as_o for_o the_o time_n they_o carry_v shall_v be_v as_o aforesaid_a give_v up_o to_o the_o bishop_n who_o shall_v present_v they_o to_o the_o justice_n of_o assize_n to_o be_v punish_v according_a to_o the_o statute_n and_o for_o the_o education_n of_o recusant_n child_n since_o by_o canon_n already_o establish_v no_o man_n can_v teach_v school_n no_o not_o in_o any_o private_a house_n except_o he_o be_v allow_v by_o the_o ordinary_a of_o the_o place_n and_o withal_o have_v subscribe_v to_o the_o article_n of_o religion_n establish_v in_o the_o church_n of_o england_n we_o therefore_o straight_o enjoin_v that_o forthwith_o at_o all_o visitation_n there_o be_v diligent_a enquiry_n make_v by_o the_o churchwarden_n or_o other_o swear_a ecclesiastical_a officer_n of_o each_o parish_n under_o their_o oath_n who_o be_v employ_v as_o schoolmaster_n to_o the_o child_n of_o recusant_n and_o that_o their_o several_a name_n be_v present_v to_o the_o bishop_n of_o the_o diocese_n who_o cite_v the_o say_a schoolmaster_n shall_v make_v diligent_a search_n whether_o they_o have_v subscribe_v or_o no_o and_o if_o they_o or_o any_o of_o they_o be_v find_v to_o refuse_v subscription_n they_o shall_v be_v forbid_v to_o teach_v hereafter_o and_o censure_v for_o their_o former_a presumption_n and_o withal_o the_o name_n of_o he_o or_o they_o that_o entertain_v such_o a_o schoolmaster_n shall_v be_v certify_v to_o the_o bishop_n of_o the_o diocese_n who_o shall_v at_o the_o next_o assize_n present_v they_o to_o the_o judge_n to_o be_v proceed_v against_o according_a to_o the_o statute_n and_o if_o they_o subscribe_v enquiry_n shall_v be_v make_v what_o care_n they_o take_v for_o the_o instruction_n of_o the_o say_a child_n in_o the_o catechism_n establish_v in_o the_o book_n of_o common_a prayer_n and_o all_o ordinary_n shall_v censure_v those_o who_o they_o find_v negligent_a in_o the_o say_a instruction_n and_o if_o it_o shall_v appear_v that_o the_o parent_n of_o the_o say_a child_n do_v forbid_v such_o schoolmaster_n to_o bring_v they_o up_o in_o the_o doctrine_n of_o the_o church_n of_o england_n they_o shall_v notwithstanding_o do_v their_o duty_n and_o if_o thereupon_o the_o say_a parent_n shall_v take_v away_o their_o child_n the_o say_a schoolmaster_n shall_v forthwith_o give_v up_o their_o name_n unto_o the_o bishop_n of_o the_o diocese_n who_o shall_v take_v care_n to_o return_v they_o to_o the_o justice_n of_o assize_n in_o manner_n and_o form_n aforesaid_a and_o because_o some_o may_v cunning_o elude_v this_o decree_n by_o send_v their_o child_n to_o be_v breed_v beyond_o the_o sea_n therefore_o we_o ordain_v that_o the_o churchwarden_n and_o other_o swear_v ecclesiastical_a officer_n shall_v likewise_o make_v careful_a enquiry_n and_o give_v in_o upon_o their_o oath_n at_o all_o visitation_n the_o name_n of_o such_o recusant_n child_n who_o be_v so_o send_v beyond_o the_o sea_n
