to_o the_o ordinary_a of_o that_o diocese_n or_o a_o justice_n of_o peace_n of_o that_o county_n where_o the_o person_n to_o who_o the_o offer_n be_v make_v be_v resident_a and_o that_o within_o aforesaid_a seminary_n stat._n sect._n 5._o send_v relief_n to_o any_o jesuit_n priest_n or_o other_o person_n abide_v in_o a_o seminary_n if_o any_o person_n under_o her_o majesty_n subjection_n or_o obedience_n shall_v at_o any_o time_n after_o the_o end_n of_o the_o say_v forty_o day_n by_o way_n of_o exchange_n or_o by_o any_o other_o shift_n way_n or_o mean_n whatsoever_o witting_o and_o willing_o either_o direct_o or_o indirect_o convey_v deliver_v or_o send_v or_o cause_n or_o procure_v to_o be_v convey_v or_o deliver_v to_o be_v send_v over_o the_o sea_n or_o out_o of_o this_o realm_n or_o out_o of_o any_o other_o her_o majesty_n dominion_n or_o territory_n into_o any_o foreign_a part_n or_o shall_v otherwise_o witting_o and_o willing_o yield_v give_v or_o contribute_v any_o money_n or_o other_o relief_n to_o or_o for_o any_o jesuit_n seminary_n priest_n or_o such_o other_o priest_n deacon_n or_o religious_a or_o ecclesiastical_a person_n as_o be_v aforesaid_a or_o to_o or_o for_o the_o maintenance_n or_o relief_n of_o any_o college_n of_o jesuit_n or_o seminary_n already_o erect_v or_o ordain_v or_o hereafter_o to_o be_v erect_v or_o ordain_v in_o any_o the_o part_n beyond_o the_o sea_n or_o out_o of_o this_o realm_n in_o any_o foreign_a part_n or_o of_o any_o person_n then_o be_v of_o or_o in_o any_o the_o same_o college_n or_o seminary_n and_o not_o return_v into_o this_o realm_n with_o submission_n as_o in_o this_o act_n be_v express_v and_o tontinue_v in_o the_o same_o realm_n that_o then_o every_o such_o person_n so_o offend_v for_o the_o same_o offence_n shall_v incur_v the_o danger_n and_o penalty_n of_o praemunire_n mention_v in_o the_o statute_n of_o praemunire_n make_v in_o the_o sixteenth_o year_n of_o the_o reign_n of_o king_n richard_n the_o second_o convey_v deliver_v etc._n convey_v or_o deliver_v relief_n to_o a_o jesuit_n etc._n etc._n so_o that_o he_o who_o be_v bare_o a_o messenger_n or_o instrument_n to_o convey_v or_o deliver_v such_o money_n or_o other_o relief_n be_v within_o the_o danger_n of_o this_o law_n as_o well_o as_o the_o sender_n or_o giver_n then_o be_v of_o or_o in_o the_o same_o college_n or_o seminary_n not_o to_o what_o person_n this_o extend_v to_o what_o not_o this_o clause_n extend_v not_o to_o every_o person_n bring_v up_o in_o such_o college_n or_o seminary_n as_o wingate_n tit_n crown_n n._n 54._o mistake_n for_o if_o such_o person_n afterward_o quit_v his_o college_n or_o seminary_n and_o have_v no_o long_a any_o relation_n thereunto_o but_o abide_v elsewhere_o beyond_o the_o sea_n he_o who_o give_v or_o convey_v relief_n or_o maintenance_n to_o he_o be_v not_o within_o this_o branch_n of_o the_o statute_n because_o the_o person_n relieve_v or_o maintain_v be_v not_o then_o of_o or_o in_o any_o college_n or_o seminary_n and_o yet_o perhaps_o this_o may_v be_v a_o offence_n within_o the_o statute_n of_o 3_o car._n 1._o 2_o stat._n 3_o car._n 1._o 2_o cap._n 2._o quod_fw-la vide_fw-la postea_fw-la licence_n stat._n sect._n 6._o none_o shall_v send_v his_o child_n or_o other_o beyond_o the_o sea_n without_o licence_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v not_o be_v lawful_a for_o any_o person_n of_o or_o under_o her_o highness_n obedience_n at_o any_o time_n after_o the_o say_v forty_o day_n during_o her_o unto_o the_o mayor_n or_o other_o chief_a officer_n of_o the_o town_n port_n or_o place_n where_o he_o shall_v be_v take_v in_o to_o be_v transport_v his_o name_n and_o in_o what_o place_n he_o receive_v such_o order_n and_o how_o long_o he_o have_v remain_v in_o this_o realm_n or_o in_o any_o other_o her_o highness_n dominion_n be_v under_o her_o obedience_n law_n stat._n sect._n 7._o a_o jesuit_n or_o priest_n submit_v himself_o &_o take_v the_o oath_n and_o obey_v the_o law_n provide_v also_o that_o this_o act_n or_o any_o thing_n therein_o contain_v shall_v not_o in_o any_o wise_a extend_v to_o any_o such_o jesuit_n seminary_n priest_n or_o other_o such_o priest_n deacon_n or_o religious_a or_o ecclesiastical_a person_n as_o be_v before_o mention_v as_o shall_v at_o any_o time_n within_o the_o say_v forty_o day_n or_o within_o threé_o day_n after_o that_o he_o shall_v hereafter_o come_v into_o this_o realm_n or_o any_o other_o her_o highness_n dominion_n submit_v himself_o to_o some_o archbishop_n or_o bishop_n of_o this_o realm_n or_o to_o some_o justice_n of_o peace_n within_o the_o county_n where_o he_o shall_v arrive_v or_o land_n and_o do_v thereupon_o true_o and_o sincere_o before_o the_o same_o archbishop_n bishop_n or_o such_o justice_n of_o peace_n take_v the_o say_a oath_n set_v forth_o in_o anno_fw-la primo_fw-la and_o by_o write_v under_o recusancy_n or_o that_o they_o have_v not_o so_o receive_v the_o sacrament_n oath_n to_o who_o they_o may_v tender_v this_o oath_n for_o the_o solving_a of_o which_o doubt_n it_o be_v to_o be_v consider_v 1._o that_o the_o bishop_n and_o not_o the_o justice_n of_o assize_n be_v here_o join_v with_o the_o justice_n of_o peace_n and_o these_o word_n where_o any_o bishop_n or_o justice_n of_o peace_n seem_v to_o bear_v this_o construction_n viz._n where_o any_o bishop_n or_o justice_n of_o peace_n either_o the_o one_o or_o the_o other_o indifferent_o may_v require_v the_o oath_n and_o that_o can_v be_v intend_v only_o of_o the_o power_n give_v out_o of_o session_n for_o in_o session_n the_o bishop_n have_v nothing_o to_o do_v but_o have_v the_o justice_n of_o assize_n be_v here_o add_v scilicet_fw-la in_o all_o cause_n where_o the_o bishop_n justices_z of_o assize_n or_o justice_n of_o peace_n may_v require_v this_o oath_n it_o have_v be_v clear_a that_o the_o power_n here_o and_o distinct_a by_o itself_o cro._n jac._n supra_fw-la but_o to_o this_o the_o court_n make_v no_o answer_n and_o it_o seem_v that_o such_o a_o assent_n be_v well_o enough_o though_o in_o the_o same_o write_n with_o the_o licence_n if_o it_o be_v express_v that_o the_o four_o justice_n do_v licence_n and_o the_o deputy_n lieutenant_n do_v assent_v and_o such_o write_n be_v under_o the_o hand_n and_o seal_n of_o all_o five_o reside_v within_o the_o say_a county_n or_o liberty_n county_n residence_n in_o the_o county_n these_o word_n seem_v to_o refer_v as_o well_o to_o the_o bishop_n and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o the_o deputy_n lieutenant_n and_o by_o consequence_n so_o must_v the_o word_n immediate_o subsequent_a viz._n reside_v and_o as_o to_o the_o bishop_n the_o inconvenience_n be_v the_o same_o as_o in_o this_o restriction_n to_o the_o county_n or_o liberty_n where_o the_o party_n who_o be_v to_o assent_n reside_v and_o hold_v as_o well_o in_o the_o case_n of_o the_o bishop_n or_o lieutenant_n as_o of_o any_o deputy_n lieutenant_n reside_v out_o of_o the_o county_n licence_n particular_a cause_n of_o the_o licence_n the_o particular_a cause_n of_o the_o say_a licence_n in_o maxfields_n case_n b._n r._n another_o exception_n to_o the_o licence_n grant_v by_o the_o four_o justice_n be_v that_o it_o be_v say_v to_o be_v grant_v for_o certain_a urgent_a cause_n but_o no_o particular_a cause_n for_o the_o recusants_n travel_n be_v express_v in_o the_o licence_n cro._n jac._n supra_fw-la and_o this_o seem_v to_o be_v a_o good_a exception_n for_o the_o insert_v into_o the_o licence_n that_o the_o popish_a recusant_n have_v urgent_a or_o necessary_a occasion_n or_o business_n answer_v only_o the_o former_a part_n of_o this_o proviso_n which_o give_v the_o four_o justice_n power_n to_o licence_n he_o if_o he_o have_v necessary_a occasion_n or_o business_n to_o travel_v out_o of_o the_o compass_n of_o five_o mile_n but_o withal_o it_o ought_v to_o be_v mention_v in_o the_o licence_n particular_o what_o that_o occasion_n or_o business_n be_v which_o be_v the_o cause_n of_o the_o licence_n for_o so_o this_o act_n here_o express_o appoint_v and_o therefore_o that_o form_n of_o a_o mistake_n and_o that_o such_o a_o exception_n may_v be_v move_v but_o the_o plea_n not_o disallow_v for_o that_o reason_n oath_n one_o justice_n may_v give_v the_o recusant_n his_o oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o mr._n shepherd_n think_v that_o no_o less_o than_o two_o of_o the_o four_o justice_n of_o peace_n can_v minister_v this_o oath_n to_o the_o recusant_n sure_a guide_n cap._n 14._o sect._n 5._o but_o i_o take_v it_o to_o be_v clear_a that_o any_o one_o of_o the_o four_o justice_n may_v minister_v the_o oath_n in_o this_o case_n they_o of_o the_o cause_n of_o his_o journey_n true_a averment_n that_o the_o cause_n be_v true_a if_o a_o information_n be_v bring_v against_o a_o popish_a recusant_n for_o travel_v out_o of_o his_o his_o licence_n be_v true_a and_o real_a vide_fw-la moor_n 836._o c._n 1127._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a function_n stat._n sect._n 9_o a_o recusant_n disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z corporal_z sergeant_z ancient-bearer_n or_o other_o office_n in_o camp_n troup_n band_n or_o company_n of_o soldier_n nor_o shall_v be_v captain_n master_n governor_z or_o bear_v any_o office_n or_o hobart_n 135._o pie_n against_o thrill_v note_v if_o the_o defendant_n be_v sue_v in_o the_o common_a plea_n or_o any_o other_o of_o the_o principal_a court_n at_o westminster_n and_o he_o plead_v a_o conviction_n of_o recusancy_n before_o justice_n of_o gaol_n delivery_n or_o justice_n of_o peace_n he_o need_v not_o take_v his_o certiorari_fw-la court_n certiorari_fw-la out_o of_o what_o court_n out_o of_o the_o chancery_n and_o so_o bring_v it_o by_o mittimus_fw-la but_o the_o court_n may_v send_v a_o certiorari_fw-la immediate_o to_o that_o inferior_a court_n where_o the_o plaintiff_n be_v convict_v as_o be_v hold_v in_o that_o case_n of_o pie_n and_o thrill_v vide_fw-la 19_o h._n 6._o 19_o and_o the_o justice_n themselves_o who_o and_o by_o who_o before_o who_o the_o conviction_n be_v have_v must_v certify_v and_o therefore_o if_o the_o conviction_n be_v before_o justice_n of_o peace_n the_o certificate_n can_v be_v by_o the_o custos_fw-la rotulorum_fw-la rotulorum_fw-la custos_fw-la rotulorum_fw-la alone_a though_o he_o keep_v the_o record_n for_o the_o certiorari_fw-la be_v in_o such_o case_n direct_v to_o the_o justice_n of_o peace_n hobart_n 135._o a_o popish_a recusant_n be_v convict_v of_o recusancy_n in_o a_o popular_a suit_n and_o after_o such_o conviction_n sue_v the_o informer_n qui_fw-fr tam_fw-la etc._n etc._n informer_n who_o may_v take_v advantage_n of_o this_o disability_n informer_n upon_o some_o other_o matter_n or_o cause_n of_o action_n arise_v between_o they_o quaere_fw-la whether_o the_o defendant_n may_v plead_v such_o conviction_n in_o disability_n of_o the_o recusant_n for_o this_o conviction_n disable_v the_o recusant_n to_o sue_v as_o if_o he_o be_v excommunicate_v and_o no_o otherwise_o now_o if_o a_o bishop_n excommunicate_v any_o one_o and_o the_o bishop_n bishop_n bishop_n be_v afterward_o sue_v at_o law_n for_o any_o other_o matter_n or_o cause_n by_o the_o person_n so_o excommunicate_v the_o bishop_n can_v plead_v this_o excommunication_n in_o disability_n of_o the_o plaintiff_n who_o sue_v he_o co._n 1._o inst_z 134._o swinborne_a part_n 5._o sect._n 6._o p._n 305._o and_o the_o reason_n give_v for_o this_o in_o trollop_n case_n co._n 8._o 68_o be_v because_o the_o bishop_n be_v a_o party_n to_o the_o excommunication_n and_o therefore_o shall_v take_v no_o advantage_n by_o it_o which_o reason_n seem_v to_o hold_v likewise_o in_o the_o case_n of_o a_o informer_n qui_fw-fr tam_fw-la etc._n etc._n who_o be_v a_o party_n to_o the_o conviction_n of_o the_o recusant_n upon_o the_o popular_a suit_n which_o conviction_n render_v the_o recusant_n disable_v to_o all_o intent_n as_o a_o excommunicant_a person_n and_o therefore_o he_o be_v a_o party_n to_o it_o by_o the_o same_o rule_n shall_v not_o take_v advantage_n of_o it_o in_o disability_n of_o the_o recusant_n in_o any_o action_n bring_v by_o the_o recusant_n against_o he_o but_o yet_o notwithstanding_o i_o conceive_v the_o informer_n qui_fw-fr tam_fw-la etc._n etc._n at_o who_o suit_n the_o recusant_n be_v convict_v may_v well_o take_v advantage_n of_o this_o conviction_n and_o plead_v it_o in_o disability_n of_o the_o person_n of_o the_o recusant_n and_o that_o the_o true_a reason_n why_o the_o bishop_n shall_v not_o be_v admit_v to_o plead_v a_o excommunication_n pronounce_v by_o himself_o in_o disability_n of_o the_o person_n excommunicate_v be_v not_o because_o he_o be_v a_o party_n to_o the_o excommunication_n but_o because_o in_o matter_n of_o excommunication_n the_o bishop_n act_v as_o a_o judge_n and_o it_o be_v by_o his_o sentence_n and_o authority_n that_o the_o party_n be_v excommunicate_v and_o he_o shall_v not_o take_v advantage_n in_o another_o suit_n of_o a_o sentence_n give_v by_o himself_o judicial_o and_o this_o will_v not_o hold_v in_o the_o case_n of_o a_o informer_n who_o though_o he_o be_v a_o party_n to_o the_o suit_n in_o which_o the_o recusant_n be_v disable_v as_o a_o excommunicate_a person_n yet_o be_v no_o judge_n in_o the_o case_n whether_o the_o party_n sue_v shall_v be_v disable_v or_o no_o as_o the_o bishop_n be_v in_o the_o other_o case_n where_o the_o party_n be_v actual_o excommunicate_v by_o he_o and_o if_o the_o bishop_n shall_v be_v bar_v to_o plead_v and_o take_v advantage_n of_o such_o excommunication_n because_o he_o be_v a_o party_n thereunto_o it_o will_v follow_v that_o the_o person_n who_o sue_v in_o the_o spiritual_a court_n and_o at_o who_o instance_n the_o person_n sue_v be_v excommunicate_v shall_v be_v bar_v likewise_o to_o take_v advantage_n of_o such_o disability_n in_o the_o plaintiff_n at_o law_n for_o he_o be_v a_o party_n to_o the_o excommunication_n for_o that_o he_o be_v a_o party_n to_o the_o suit_n upon_o which_o the_o excommunication_n be_v original_o found_v but_o the_o contrary_a to_o this_o be_v strong_o imply_v in_o 14_o h._n 4._o 14._o where_o the_o case_n be_v a._n be_v excommunicate_v in_o a_o suit_n depend_v between_o he_o and_o b._n and_o afterward_o a._n sue_v b._n upon_o the_o statute_n of_o praemunire_n who_o plead_v this_o excommunication_n in_o disability_n of_o the_o plaintiff_n here_o the_o plea_n be_v disallow_v because_o the_o principal_a suit_n on_o which_o the_o excommunication_n depend_v be_v bring_v before_o the_o pope_n but_o in_o the_o debate_n of_o the_o case_n there_o be_v not_o the_o least_o word_n of_o exception_n to_o the_o plea_n upon_o this_o ground_n because_o the_o excommunication_n be_v at_o the_o instance_n of_o the_o defendant_n or_o that_o the_o defendant_n shall_v not_o take_v advantage_n of_o the_o plaintiff_n disability_n for_o that_o he_o be_v a_o party_n to_o the_o excommunication_n which_o disable_v he_o disable_v executor_n or_o administrator_n disable_v if_o a_o executor_n or_o administrator_n become_v a_o popish_a recusant_n convict_v it_o seem_v he_o be_v disable_v by_o this_o act_n to_o sue_v in_o either_o of_o those_o capacity_n for_o the_o act_n say_v he_o shall_v be_v disable_v to_o all_o intent_n as_o a_o excommunicate_a person_n now_o a_o person_n actual_o excommunicate_v can_v sue_v as_o executor_n or_o administrator_n as_o be_v hold_v in_o 21_o e._n 4._o 49._o 21_o h._n 6._o 30._o 14_o h._n 6._o 15._o co._n 1._o inst_z 134._o although_o there_o be_v some_o opinion_n to_o the_o contrary_n vide_fw-la finch_n 27._o prosecute_v stat._n sect._n 13._o what_o suit_v a_o popish_a recusant_n may_v prosecute_v provide_v nevertheless_o that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o person_n so_o disable_v for_o and_o notwithstanding_o any_o thing_n in_o this_o law_n contain_v to_o sue_v or_o prosecute_v a_o action_n or_o suit_n for_o or_o concern_v only_o such_o of_o he_o or_o her_o land_n tenement_n lease_n rent_n annuity_n and_o hereditament_n or_o for_o the_o issue_n and_o profit_n thereof_o which_o be_v not_o to_o be_v seize_v or_o take_v into_o the_o king_n hand_n his_o heir_n or_o successor_n by_o force_n of_o any_o law_n for_o or_o concern_v his_o or_o her_o recusancy_n or_o any_o part_n thereof_o which_o be_v not_o to_o be_v seize_v or_o take_v into_o the_o
