that_o will_v preserve_v the_o conscience_n of_o good_a christian_n be_v to_o do_v or_o to_o avoid_v in_o maintain_v the_o society_n and_o communion_n of_o the_o church_n put_v the_o case_n that_o a_o ecclesiastical_a power_n be_v claim_v and_o use_v upon_o some_o persuasion_n contrary_a to_o the_o substance_n of_o true_a christianity_n and_o pretend_v thereby_o to_o govern_v those_o that_o adhere_v to_o the_o same_o persuasion_n in_o the_o communion_n of_o those_o ordinance_n which_o god_n require_v to_o be_v serve_v with_o by_o his_o church_n according_a to_o the_o same_o persuasion_n foundation_n of_o faith_n and_o all_o that_o belong_v to_o it_o be_v but_o upon_o a_o persuasion_n contrary_n to_o something_o necessary_a to_o the_o society_n of_o the_o whole_a church_n as_o do_v in_o it_o and_o therefore_o to_o be_v avoid_v by_o all_o that_o will_v not_o communicate_v in_o a_o act_n of_o schism_n i_o do_v not_o deny_v that_o presbyter_n have_v a_o interest_n in_o the_o power_n of_o the_o key_n and_o by_o consequence_n in_o all_o part_n of_o ecclesiastical_a power_n be_v all_o the_o production_n thereof_o but_o i_o have_v show_v that_o their_o interest_n be_v in_o be_v the_o ordinance_n of_o our_o lord_n &_o his_o apostle_n and_o this_o not_o to_o manage_v the_o interest_n of_o the_o people_n that_o nothing_o pass_v contrary_a to_o the_o law_n give_v the_o church_n by_o god_n which_o be_v their_o inheritance_n as_o well_o as_o the_o clergy_n but_o in_o a_o number_n double_a to_o that_o of_o the_o presbyter_n in_o all_o consistory_n and_o in_o a_o right_n equal_a to_o they_o man_n for_o man_n so_o that_o it_o may_v true_o be_v say_v that_o the_o whole_a power_n of_o clergy_n and_o people_n be_v vest_v in_o these_o lay_v elder_n that_o one_o quality_n consent_v be_v able_a to_o conclude_v the_o whole_a when_o as_o the_o determination_n who_o shall_v or_o shall_v not_o be_v admit_v to_o communion_n return_v at_o last_o to_o a_o number_n of_o secular_a person_n make_v they_o thereby_o judge_n of_o the_o law_n of_o christianity_n and_o enable_v they_o thereby_o to_o give_v and_o take_v away_o the_o ecclesiastical_a be_v of_o any_o member_n of_o the_o church_n in_o those_o case_n to_o which_o that_o power_n extend_v and_o invest_v a_o civil_a court_n with_o the_o power_n of_o the_o key_n in_o the_o same_o all_o these_o point_n be_v member_n of_o the_o ordinance_n for_o the_o establishment_n of_o the_o presbytery_n i_o say_v then_o that_o by_o that_o ordinance_n a_o ecclesiastical_a power_n be_v erect_v upon_o so_o many_o persuasion_n of_o thing_n concern_v the_o public_a order_n of_o the_o society_n of_o the_o church_n contrary_a to_o the_o law_n give_v the_o church_n by_o our_o lord_n and_o his_o apostle_n by_o a_o the_o church_n establish_v upon_o these_o law_n whereof_o the_o succession_n of_o bishop_n be_v one_o as_o for_o the_o design_n of_o the_o congregation_n it_o be_v easy_o perceive_v to_o come_v to_o this_o effect_n that_o to_o the_o intent_n that_o christian_a people_n may_v be_v tie_v to_o no_o law_n but_o such_o as_o the_o spirit_n of_o god_n which_o be_v in_o they_o convince_v they_o to_o be_v establish_v upon_o the_o church_n by_o the_o scripture_n and_o that_o thereupon_o the_o order_n of_o all_o matter_n concern_v the_o society_n of_o the_o church_n may_v proceed_v upon_o conviction_n of_o every_o man_n judgement_n therefore_o every_o congregation_n of_o christian_n assemble_v to_o the_o service_n of_o god_n to_o be_v absolute_a and_o independent_a on_o any_o other_o part_n or_o the_o whole_a church_n the_o power_n be_v vest_v in_o the_o member_n of_o the_o say_a congregation_n under_o the_o authority_n of_o the_o pastor_n and_o elder_n as_o aforesaid_a and_o that_o therefore_o every_o congregation_n constitute_v itself_o a_o church_n constitute_v by_o consequence_n and_o destitute_n pastor_n elder_n and_o member_n so_o that_o by_o this_o design_n a_o ecclesiastical_a power_n be_v erect_v upon_o so_o many_o persuasion_n contrary_a to_o the_o law_n give_v the_o church_n by_o our_o lord_n and_o his_o apostle_n the_o act_n of_o schism_n be_v more_o visible_a though_o for_o the_o claim_n and_o title_n by_o which_o this_o ecclesiastical_a power_n be_v erect_v in_o both_o way_n that_o of_o the_o congregation_n be_v more_o suitable_a to_o christianity_n because_o that_o of_o the_o presbytery_n more_o forcible_a both_o equal_o destructive_a to_o the_o right_n of_o the_o church_n for_o that_o a_o parliament_n by_o which_o power_n the_o sphere_n of_o any_o power_n which_o stand_v not_o by_o the_o constitution_n of_o the_o church_n for_o if_o the_o church_n subsist_v before_o any_o secular_a power_n be_v christian_n by_o a_o power_n vest_v by_o our_o lord_n in_o
their_o right_n for_o in_o this_o quality_n do_v those_o elder_n of_o the_o people_n of_o which_o justellus_n write_v act_n in_o ecclesiastical_a matter_n as_o you_o may_v see_v by_o that_o which_o elder_n in_o the_o proceed_n of_o all_o church_n matter_n as_o the_o ordinance_n for_o establish_v the_o presbytery_n appoint_v which_o be_v to_o make_v the_o clergy_n true_o minister_n not_o of_o god_n but_o of_o the_o people_n but_o to_o grant_v they_o a_o right_n of_o intercession_n in_o behalf_n of_o the_o people_n when_o as_o the_o proceed_n may_v be_v argue_v to_o be_v contrary_a to_o god_n law_n ground_v upon_o the_o practice_n record_v in_o the_o scripture_n and_o continue_v under_o the_o primitive_a church_n by_o which_o the_o people_n be_v satisfy_v even_o of_o the_o proceed_n of_o the_o apostle_n themselves_o in_o church_n matter_n for_o by_o this_o right_a and_o interest_n the_o act_n of_o the_o church_n shall_v not_o be_v do_v by_o any_o vote_n of_o the_o people_n but_z the_o rule_n of_o christianity_n and_o the_o constitution_n of_o the_o church_n according_a to_o god_n law_n shall_v be_v preserve_v which_o be_v the_o inheritance_n of_o christian_a people_n the_o second_o be_v concern_v the_o different_a interest_n of_o clergy_n and_o people_n in_o judge_v the_o cause_n of_o christian_n before_o any_o state_n profess_v christianity_n suppose_v that_o which_o have_v be_v prove_v in_o the_o first_o chapter_n that_o our_o lord_n and_o his_o apostle_n ordain_v that_o they_o go_v not_o forth_o of_o the_o church_n to_o be_v judge_v in_o heathen_a court_n upon_o pain_n of_o excommunication_n to_o they_o that_o carry_v they_o forth_o for_o s._n paul_n seem_v to_o appoint_v that_o the_o least_o esteem_v of_o the_o church_n be_v constitute_v judge_n in_o those_o cause_n 1_o cor._n vi_o 4._o and_o therefore_o not_o bishop_n nor_o presbyter_n nor_o deacon_n which_o must_v needs_o be_v of_o most_o esteem_n in_o the_o society_n of_o the_o church_n but_o the_o simple_a of_o the_o people_n which_o though_o it_o must_v needs_o be_v say_v by_o way_n of_o concession_n or_o supposition_n that_o be_v that_o they_o shall_v rather_o appoint_v such_o man_n then_o carry_v their_o cause_n to_o secular_a court_n otherwise_o it_o be_v too_o gross_a a_o inconvenience_n to_o imagine_v that_o the_o apostle_n command_v they_o to_o appoint_v the_o simple_a to_o be_v their_o judge_n yet_o see_v the_o truth_n of_o his_o word_n require_v that_o the_o supposition_n be_v possible_a so_o that_o it_o may_v in_o some_o case_n come_v to_o effect_n it_o seem_v that_o his_o injunction_n come_v to_o this_o that_o in_o case_n the_o chief_a of_o the_o church_n the_o clergy_n be_v so_o employ_v that_o they_o can_v not_o attend_v to_o judge_v their_o controversy_n within_o themselves_o they_o shall_v make_v judge_n out_o of_o the_o people_n which_o seem_v not_o suitable_a to_o the_o rest_n of_o the_o interest_n of_o the_o clergy_n hitherto_o challenge_v this_o difficulty_n be_v to_o be_v answer_v by_o distinguish_v as_o the_o roman_a law_n distinguish_v between_o jurisdiction_n and_o judge_v though_o in_o far_o less_o matter_n for_o jurisdiction_n be_v sometime_o describe_v in_o the_o roman_a law_n to_o be_v the_o power_n of_o appoint_v a_o judge_n because_o it_o be_v never_o intend_v that_o the_o magistrate_n which_o be_v endow_v with_o jurisdiction_n shall_v judge_v all_o in_o person_n but_o shall_v give_v execution_n and_o force_n to_o the_o sentence_n of_o such_o judge_n as_o himself_o shall_v appoint_v so_o that_o the_o advice_n of_o the_o apostle_n suppose_v indeed_o that_o some_o of_o the_o people_n may_v be_v appoint_v to_o judge_v the_o cause_n of_o christian_n within_o the_o church_n but_o leave_v the_o jurisdiction_n
