convocation_n any_o thing_n in_o this_o act_n contain_v to_o the_o contrary_a notwithstanding_o witness_n none_o shall_v be_v indict_v or_o arraign_v but_o by_o witness_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n shall_v be_v hereafter_o indict_v or_o arraign_v for_o any_o of_o the_o offence_n make_v ordain_v revive_v or_o adjudge_v by_o this_o act_n unless_o there_o be_v two_o sufficient_a witness_n or_o more_o to_o testify_v and_o declare_v the_o say_v offence_n whereof_o he_o shall_v be_v indict_v or_o arraign_v and_o that_o the_o say_v witness_n or_o so_o many_o of_o they_o as_o shall_v be_v live_v and_o within_o this_o realm_n at_o the_o time_n of_o arraignment_n of_o such_o person_n so_o indict_v shall_v be_v bring_v esq_n and_o agnes_n his_o wife_n rome_n chetwoods_n appeal_n to_o the_o court_n of_o rome_n by_o the_o name_n of_o agnes_n woodhull_n at_o the_o suit_n of_o charles_n tyrrel_n gent._n in_o a_o cause_n of_o matrimony_n solemnize_v betweén_n the_o say_v richard_n and_o agnes_n as_o by_o the_o same_o pretend_a sentence_n more_o plain_o do_v appear_v from_o which_o sentence_n the_o say_a richard_n be_v occasion_v by_o a_o opinion_n there_o hold_v in_o the_o say_a case_n of_o dr._n foster_n that_o the_o informer_n qui_fw-fr tam_fw-la etc._n etc._n be_v restrain_v by_o 29._o to_o those_o court_n case_n than_o the_o queen_n for_o he_o may_v charge_v the_o husband_n and_o wife_n both_o for_o the_o recusancy_n of_o the_o wife_n and_o shall_v recover_v the_o forfeiture_n of_o he_o by_o force_n wingate_n tit_n crown_n n._n 77._o lead_v his_o reader_n into_o a_o great_a mistake_n for_o he_o mention_n only_o a_o feme_fw-fr covert_n leave_v out_o the_o popish_a recusant_n case_n feme_fw-fr covert_n not_o here_o except_v in_o all_o case_n or_o feme_fw-fr covert_n in_o the_o late_a addition_n to_o dalton_n cap._n 81._o tit_n recusant_n sect._n 7._o it_o be_v say_v that_o no_o marry_a excommunicate_a stat._n sect._n 27._o break_v a_o house_n to_o take_v a_o recusant_n excommunicate_a award_v to_o any_o sheriff_n or_o other_o officer_n for_o the_o take_n or_o apprehend_v of_o any_o from_o whence_o he_o go_v or_o pass_v over_o for_o a_o statute_n be_v to_o be_v so_o expound_v ut_fw-la verba_fw-la accipiuntur_fw-la cum_fw-la effectu_fw-la co._n 3._o inst._n 80._o provide_v sacrament_n during_o her_o marriage_n nor_o that_o any_o woman_n shall_v be_v charge_v or_o chargeable_a with_o any_o penalty_n or_o forfeiture_n by_o force_n of_o this_o act_n for_o any_o such_o offence_n of_o not_o receive_v which_o shall_v happen_v during_o her_o marriage_n with_o any_o penalty_n or_o forfeiture_n by_o force_n of_o this_o act._n sacrament_n feme_fw-fr covert_n not_o receive_v the_o sacrament_n but_o yet_o a_o marry_a woman_n may_v be_v punish_v by_o force_n of_o any_o other_o act_n for_o not_o receive_v the_o sacrament_n during_o her_o marriage_n co._n 11.64_o repeal_n be_v the_o giving_z of_o sundry_a licence_n to_o recusant_n under_o colour_n of_o a_o proviso_n in_o 35._o which_o can_v be_v construe_v only_o of_o those_o which_o be_v to_o be_v give_v by_o the_o justice_n of_o peace_n and_o not_o of_o the_o other_o licence_n give_v by_o 35._o in_o several_a other_o case_n so_o that_o the_o proviso_n there_o permit_v the_o popish_a recusant_n to_o travel_v in_o case_n of_o process_n or_o commandment_n by_o privy_a counsellor_n or_o the_o queen_n commissioner_n or_o proclamation_n to_o render_v his_o body_n to_o the_o sheriff_n remain_z still_o in_o force_n and_o unrepealed_a and_o the_o recusant_n may_v take_v the_o benefit_n thereof_o at_o this_o day_n 8._o stat._n sect._n 8._o provide_v nevertheless_o and_o be_v it_o further_o enact_v by_o this_o present_a parliament_n and_o by_o the_o authority_n of_o the_o same_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o king_n most_o excellent_a majesty_n his_o heir_n and_o successor_n or_o for_o three_o or_o more_o of_o his_o majesty_n most_o honourable_a privy_a council_n or_o for_o threé_o or_o more_o of_o the_o privy_a council_n of_o his_o heir_n or_o successor_n in_o write_v under_o the_o hand_n of_o the_o say_v privy_a counsellor_n confine_v licence_n to_o a_o popish_a recusant_n confine_v to_o give_v licence_n to_o every_o such_o recusant_n to_o go_v and_o travel_v out_o of_o the_o compass_n of_o the_o say_v five_o mile_n for_o such_o time_n as_o in_o the_o say_a licence_n shall_v be_v contain_v for_o their_o travel_n attend_v and_o return_v and_o without_o any_o other_o cause_n to_o be_v express_v within_o the_o say_a licence_n and_o if_o any_o of_o the_o person_n which_o be_v so_o confine_v by_o virtue_n of_o the_o say_a statute_n as_o be_v aforesaid_a shall_v have_v necessary_a occasion_n or_o business_n to_o go_v and_o travel_v out_o of_o the_o compass_n of_o the_o say_v five_o mile_n that_o then_o and_o in_o every_o such_o case_n upon_o licence_n in_o write_v in_o that_o behalf_n to_o be_v get_v under_o the_o hand_n and_o seal_n of_o four_o of_o the_o justice_n of_o peace_n of_o the_o same_o county_n limit_v division_n or_o place_n next_o adjoin_v to_o the_o place_n of_o abode_n of_o such_o recusant_n with_o the_o privity_n and_o assent_n in_o write_v of_o the_o bishop_n of_o the_o diocese_n peace_n the_o effect_n of_o a_o licence_n to_o be_v grant_v by_o four_o justice_n of_o peace_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n reside_v within_o the_o say_a county_n or_o liberty_n under_o their_o hand_n and_o seal_n in_o every_o of_o which_o licence_n or_o licence_n in_o write_v so_o to_o be_v have_v and_o make_v shall_v be_v specify_v and_o contain_v both_o the_o particular_a cause_n of_o the_o say_a licence_n and_o the_o time_n how_o long_o the_o say_a party_n license_v shall_v be_v absent_a in_o travel_v attend_v and_o return_v it_o shall_v and_o may_v thereupon_o be_v lawful_a for_o every_o such_o person_n so_o licence_v to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n attend_v and_o return_v as_o shall_v be_v comprise_v in_o the_o say_a licence_n the_o say_a party_n so_o licence_v first_o take_v his_o corporal_a oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o that_o he_o have_v true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n and_o that_o he_o shall_v not_o make_v any_o causeless_a stay_n and_o that_o all_o and_o every_o licence_n hereafter_o to_o be_v make_v in_o this_o behalf_n contrary_a to_o the_o tenor_n effect_n and_o true_a meaning_n of_o this_o statute_n shall_v be_v utter_o void_a frustrate_a and_o of_o none_o effect_n any_o thing_n in_o the_o say_v former_a act_n or_o in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o every_o person_n so_o confine_v which_o shall_v depart_v or_o go_v above_o five_o mile_n from_o the_o place_n whereunto_o he_o be_v or_o shall_v be_v confine_v not_o have_v such_o licence_n and_o not_o have_v take_v such_o oath_n as_o aforesaid_a shall_v incur_v the_o pain_n and_o penalty_n and_o forfeit_a as_o a_o recusant_n convict_v and_o pass_v assent_n in_o one_o write_v that_o the_o assent_n of_o the_o deputy_n lieutenant_n be_v contain_v in_o the_o licence_n grant_v by_o the_o four_o justice_n of_o peace_n and_o be_v not_o separate_v and_o distinct_a by_o itself_o cro._n jac._n supra_fw-la but_o to_o this_o the_o court_n make_v no_o answer_n and_o it_o seem_v that_o such_o a_o assent_n be_v well_o enough_o though_o in_o the_o same_o write_n with_o the_o licence_n if_o it_o be_v express_v that_o the_o four_o justice_n do_v licence_n and_o the_o deputy_n lieutenant_n do_v assent_v and_o such_o write_n be_v under_o the_o hand_n and_o seal_n of_o all_o five_o reside_v within_o the_o say_a county_n or_o liberty_n county_n residence_n in_o the_o county_n these_o word_n seem_v to_o refer_v as_o well_o to_o the_o bishop_n and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o the_o deputy_n lieutenant_n and_o by_o consequence_n so_o must_v the_o word_n immediate_o subsequent_a viz._n reside_v and_o as_o to_o the_o bishop_n the_o inconvenience_n be_v the_o same_o as_o in_o the_o case_n of_o the_o lieutenant_n for_o by_o their_o remoteness_n they_o be_v disable_v to_o judge_v of_o the_o condition_n and_o behaviour_n of_o the_o recusant_n to_o be_v license_v and_o of_o the_o circumstance_n wherein_o he_o stand_v and_o whether_o such_o licence_n may_v be_v grant_v to_o he_o without_o hazard_n of_o the_o public_a safety_n which_o seem_v to_o be_v the_o reason_n of_o this_o restriction_n to_o the_o county_n or_o liberty_n where_o the_o party_n who_o be_v to_o assent_n reside_v and_o hold_v as_o well_o in_o the_o case_n of_o the_o bishop_n or_o lieutenant_n as_o of_o any_o deputy_n lieutenant_n reside_v out_o of_o the_o county_n licence_n particular_a cause_n of_o the_o licence_n the_o particular_a cause_n of_o the_o say_a licence_n in_o maxfields_n case_n licence_n he_o if_o he_o have_v necessary_a occasion_n or_o business_n to_o travel_v out_o of_o the_o compass_n of_o five_o mile_n but_o withal_o it_o ought_v to_o be_v mention_v in_o the_o licence_n particular_o what_o that_o occasion_n or_o business_n be_v which_o be_v the_o cause_n of_o the_o licence_n for_o so_o this_o act_n here_o express_o appoint_v and_o therefore_o that_o form_n of_o a_o mistake_n and_o that_o such_o a_o exception_n may_v be_v move_v but_o the_o plea_n not_o disallow_v for_o that_o reason_n oath_n one_o justice_n may_v give_v the_o recusant_n his_o oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o mr._n shepherd_n think_v that_o no_o less_o than_o two_o of_o the_o four_o justice_n of_o peace_n can_v minister_v this_o oath_n to_o the_o recusant_n sure_a guide_n cap._n 14._o sect._n 5._o but_o i_o take_v it_o to_o be_v clear_a that_o any_o one_o of_o the_o four_o justice_n may_v minister_v the_o oath_n in_o this_o case_n and_o there_o be_v a_o great_a difference_n between_o any_o justice_n for_o that_o denote_v the_o plural_a number_n as_o in_o the_o subsequent_a clause_n about_o armour_n where_o any_o justice_n may_v imprison_v the_o offender_n that_o be_v any_o two_o justice_n or_o more_o and_o any_o of_o the_o justice_n as_o here_o which_o denote_v the_o singular_a number_n and_o the_o follow_a word_n who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o may_v be_v well_o enough_o apply_v to_o any_o one_o justice_n of_o peace_n that_o he_o have_v true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n true_a averment_n that_o the_o cause_n be_v true_a if_o a_o information_n be_v bring_v against_o a_o popish_a recusant_n for_o travel_v out_o of_o his_o compass_n of_o five_o mile_n and_o he_o plead_v a_o a_o licence_n from_o four_o justice_n of_o peace_n it_o seem_v necessary_a that_o he_o aver_v in_o his_o plea_n that_o the_o cause_v contain_v in_o his_o licence_n be_v true_a and_o real_a vide_fw-la moor_n 836._o c._n 1127._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a function_n stat._n sect._n 9_o a_o recusant_n disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z corporal_z sergeant_z ancient-bearer_n or_o other_o office_n in_o camp_n troup_n band_n or_o company_n of_o soldier_n nor_o shall_v be_v captain_n master_n governor_z or_o bear_v any_o office_n or_o charge_n of_o or_o in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n but_o be_v utter_o dissable_v for_o the_o same_o and_o every_o person_n bro._n freshsuite_n 3._o so_o that_o as_o it_o seem_v in_o this_o case_n the_o party_n who_o keep_v such_o arm_n can_v be_v imprison_v by_o this_o act_n but_o this_o likewise_o be_v casus_fw-la omissus_fw-la and_o not_o here_o provide_v for_o and_o yet_o nevertheless_o be_v it_o enact_v by_o the_o authority_n aforesaid_a armour_n stat._n sect._n 25._o a_o popish_a recusant_n shall_v maintain_v his_o armour_n that_o notwithstanding_o the_o take_v away_o of_o such_o armour_n gunpowder_n and_o munition_n the_o say_v popish_a recusant_n shall_v and_o may_v be_v charge_v with_o the_o maintain_n of_o the_o same_o and_o with_o the_o buy_n provide_v and_o maintain_v of_o horse_n and_o other_o armour_n and_o munition_n in_o such_o sort_n as_o other_o his_o majesty_n subject_n from_o time_n to_o time_n shall_v be_v appoint_v and_o command_v according_a to_o their_o several_a ability_n and_o quality_n and_o that_o the_o say_a armour_n and_o munition_n at_o the_o charge_n of_o such_o popish_a recusant_n for_o they_o and_o as_o their_o own_o provision_n of_o armour_n and_o munition_n shall_v be_v show_v at_o every_o muster_n show_v or_o use_v of_o armour_n to_o be_v have_v majesty_n that_o the_o same_o oath_n may_v be_v administer_v to_o all_o your_o subject_n to_o which_o end_n we_o do_v with_o all_o humbleness_n beseech_v your_o highness_n that_o it_o may_v be_v every_o ecclesiastical_a judge_n officer_n and_o minister_n of_o what_o estate_n dignity_n pre-eminence_n or_o degree_n soever_o he_o or_o they_o be_v or_o shall_v be_v before_o the_o archbishop_n of_o the_o province_n or_o bishop_n or_o other_o ordinary_a of_o the_o diocese_n for_o the_o time_n be_v wherein_o such_o ecclesiastical_a judge_n officer_n or_o minister_n ought_v to_o exercise_v his_o say_a office_n place_n or_o function_n precedent_n a_o baron_n or_o baroness_n or_o above_o that_o degree_n privy_a counsellor_n precedent_n and_o all_o and_o every_o person_n and_o person_n of_o or_o above_o the_o degree_n of_o a_o baron_n of_o parliament_n or_o baroness_n of_o this_o your_o highness_n realm_n of_o england_n and_o all_o of_o your_o highness_n privy_a counsel_n reside_v in_o london_n or_o westminster_n or_o within_o thirty_o mile_n thereof_o and_o the_o precedent_n of_o wales_n and_o the_o north_n part_n before_o any_o four_o of_o your_o highness_n privy_a counsel_n whereof_o the_o lord_n chancellor_n lord_n treasurer_n lord_n privy_a seal_n
all_o cause_n where_o any_o bishop_n or_o justice_n of_o the_o peace_n may_v by_o force_n of_o this_o act_n require_v and_o take_v of_o any_o subject_n the_o oath_n above_o mention_v that_o the_o lord_n of_o the_o privy_a counsel_n for_o the_o time_n be_v or_o any_o six_o of_o they_o whereof_o the_o lord_n chancellor_n lord_n treasurer_n or_o the_o principal_a secretary_n for_o the_o time_n be_v to_o be_v one_o shall_v have_v full_a power_n and_o authority_n by_o force_n of_o this_o act_n at_o any_o time_n or_o time_n to_o require_v and_o take_v the_o say_a oath_n before_o mention_v of_o any_o subject_a either_o in_o or_o out_o of_o session_n or_o only_o in_o such_o case_n where_o they_o may_v require_v it_o out_o of_o session_n seem_v to_o be_v a_o question_n for_o if_o the_o power_n here_o give_v to_o the_o six_o privy_a counsellor_n be_v the_o same_o with_o that_o of_o the_o justice_n of_o peace_n in_o their_o session_n they_o may_v by_o force_n of_o this_o act_n tender_v it_o to_o any_o nobleman_n or_o unmarried_a noblewoman_n whatsoever_o above_o eighteen_o year_n old_a for_o the_o justice_n of_o peace_n in_o their_o session_n may_v tender_v it_o there_o to_o any_o other_o person_n whatsoever_o but_o if_o it_o be_v mean_v of_o the_o power_n give_v the_o justice_n of_o peace_n out_o of_o session_n than_o the_o six_o privy_a counsellor_n can_v tender_v it_o by_o force_n of_o this_o act_n to_o such_o nobleman_n or_o unmarried_a noblewoman_n only_o who_o stand_v convict_v or_o indict_v of_o recusancy_n for_o not_o come_v to_o church_n or_o who_o have_v not_o receive_v the_o sacrament_n twice_o within_o the_o year_n next_o before_o or_o who_o pass_v through_o the_o country_n unknown_a shall_v upon_o examination_n confess_v or_o not_o deny_v their_o consider_v 1._o that_o the_o bishop_n and_o not_o the_o justice_n of_o assize_n be_v here_o join_v with_o the_o justice_n of_o peace_n and_o these_o word_n where_o any_o bishop_n or_o justice_n of_o peace_n seem_v to_o bear_v this_o construction_n viz._n where_o any_o bishop_n or_o justice_n of_o peace_n either_o the_o one_o or_o the_o other_o indifferent_o may_v require_v the_o oath_n and_o that_o can_v be_v intend_v only_o of_o the_o power_n give_v out_o of_o session_n for_o in_o session_n the_o bishop_n have_v nothing_o to_o do_v but_o have_v the_o justice_n of_o assize_n be_v here_o add_v scilicet_fw-la in_o all_o cause_n where_o the_o bishop_n justices_z of_o assize_n or_o justice_n of_o peace_n may_v require_v this_o oath_n it_o have_v be_v clear_a that_o the_o power_n here_o give_v the_o six_o privy_a counsellor_n be_v as_o extensive_a as_o that_o which_o be_v give_v the_o justice_n of_o assize_n or_o justice_n of_o peace_n in_o their_o session_n and_o they_o may_v have_v require_v the_o oath_n of_o any_o nobleman_n or_o unmarried_a noblewoman_n whatsoever_o of_o competent_a age_n so_o if_o the_o justice_n of_o peace_n only_o have_v be_v here_o name_v it_o have_v be_v clear_o intend_v of_o the_o justice_n of_o peace_n in_o either_o capacity_n either_o in_o or_o out_o of_o session_n but_o bishop_n seem_v here_o to_o be_v a_o restrictive_a word_n and_o to_o give_v the_o privy_a counsellor_n no_o more_o power_n in_o respect_n of_o the_o nobility_n than_o the_o bishop_n have_v in_o reference_n to_o any_o other_o subject_a 2._o these_o word_n in_o all_o cause_n where_o &c._n &c._n seem_v to_o be_v restrictive_a likewise_o and_o exclusive_a of_o some_o cause_n but_o the_o power_n of_o the_o justice_n of_o peace_n in_o session_n extend_v to_o all_o cause_n and_o person_n under_o the_o degree_n of_o nobility_n whatsoever_o which_o therefore_o can_v be_v here_o intend_v but_o only_o some_o particular_a cause_n ejusdem_fw-la generis_fw-la which_o can_v
