allurement_n of_o any_o other_o willing_o join_v in_o or_o be_v present_a at_o any_o such_o assembly_n conventicle_n or_o meeting_n under_o colour_n or_o pretence_n of_o any_o such_o exercise_n of_o other_o of_o the_o offence_n here_o enumerate_v or_o he_o be_v not_o punishable_a by_o this_o act_n and_o as_o for_o the_o deny_v or_o impugn_v the_o king_n authority_n in_o cause_n ecclesiastical_a it_o be_v no_o offence_n within_o this_o statute_n unless_o the_o party_n move_v or_o

shall_v forfeit_v nothing_o for_o keep_v or_o harbour_v he_o a_o sergeant_n at_o arm_n pursuivant_n messenger_n gaoler_n sergeant_n at_o arm_n pursuivant_n gaoler_n etc._n etc._n who_o keep_v his_o prisoner_n in_o his_o house_n or_o a_o gaoler_n if_o he_o keep_v his_o prisoner_n in_o his_o own_o house_n which_o be_v no_o part_n of_o the_o prison_n shall_v not_o forfeit_v any_o thing_n by_o force_n of_o this_o act_n although_o he_o suffer_v he_o to_o go_v abroad_o in_o the_o day_n time_n at_o his_o pleasure_n and_o he_o forbear_v to_o come_v to_o church_n for_o that_o such_o prisoner_n be_v commit_v by_o authority_n to_o his_o custody_n and_o be_v it_o further_o enact_v by_o authority_n of_o this_o present_a parliament_n that_o upon_o any_o lawful_a writ_n warrant_v or_o process_n excommunicate_a stat._n sect._n 27._o break_v a_o house_n to_o take_v a_o recusant_n excommunicate_a award_v to_o any_o sheriff_n or_o other_o officer_n for_o the_o take_n or_o apprehend_v of_o any_o say_v she_o be_v not_o punishable_a by_o this_o statute_n offence_n stat._n sect._n 11._o the_o forfeiture_n of_o he_o that_o abjure_v or_o refuse_v to_o abjure_v the_o wise_a shall_v lose_v no_o dower_n nor_o the_o heir_n any_o land_n for_o these_o offence_n provide_v also_o that_o every_o person_n that_o shall_v abjure_v by_o force_n of_o this_o act_n or_o refuse_v to_o abjure_v be_v be_v to_o be_v one_o shall_v have_v full_a power_n and_o authority_n by_o force_n of_o this_o act_n at_o any_o time_n or_o time_n to_o require_v and_o take_v the_o say_a oath_n before_o mention_v of_o any_o nobleman_n or_o noblewoman_n then_o be_v above_o the_o age_n of_o eighteén_n year_n and_o if_o any_o such_o nobleman_n or_o noblewoman_n other_o than_o woman_n marry_v shall_v refuse_v to_o any_o subject_a either_o in_o or_o out_o of_o session_n or_o only_o in_o such_o case_n where_o they_o may_v require_v it_o out_o of_o session_n seem_v to_o be_v a_o question_n for_o if_o the_o power_n here_o give_v to_o the_o six_o privy_a counsellor_n be_v the_o same_o with_o that_o of_o the_o justice_n of_o peace_n in_o their_o session_n they_o may_v by_o force_n of_o this_o act_n tender_v it_o to_o any_o nobleman_n or_o unmarried_a noblewoman_n whatsoever_o above_o eighteen_o year_n old_a for_o the_o justice_n of_o peace_n in_o their_o session_n may_v tender_v it_o there_o to_o any_o other_o person_n whatsoever_o but_o if_o it_o be_v mean_v of_o the_o power_n give_v the_o justice_n of_o peace_n out_o of_o session_n than_o the_o six_o privy_a counsellor_n can_v tender_v it_o by_o force_n of_o this_o act_n to_o such_o nobleman_n or_o unmarried_a noblewoman_n only_o who_o stand_v convict_v or_o indict_v of_o recusancy_n for_o not_o come_v to_o church_n or_o who_o have_v not_o receive_v the_o sacrament_n twice_o within_o the_o year_n next_o before_o or_o who_o pass_v through_o the_o country_n unknown_a shall_v upon_o examination_n confess_v or_o not_o deny_v their_o recusancy_n or_o that_o they_o have_v not_o so_o receive_v the_o sacrament_n oath_n to_o who_o they_o may_v tender_v this_o oath_n for_o the_o solving_a of_o which_o doubt_n it_o be_v to_o be_v consider_v 1._o that_o the_o bishop_n and_o not_o the_o justice_n of_o assize_n be_v here_o join_v with_o the_o justice_n of_o peace_n and_o these_o word_n where_o any_o bishop_n or_o justice_n of_o peace_n seem_v to_o bear_v this_o construction_n viz._n where_o any_o bishop_n or_o justice_n of_o peace_n either_o the_o one_o or_o the_o other_o indifferent_o may_v require_v the_o oath_n and_o that_o can_v be_v intend_v only_o of_o the_o power_n give_v out_o of_o session_n for_o in_o session_n the_o bishop_n have_v nothing_o to_o do_v but_o have_v the_o justice_n of_o assize_n be_v here_o add_v scilicet_fw-la in_o all_o cause_n where_o the_o bishop_n justices_z of_o assize_n or_o justice_n of_o peace_n may_v require_v this_o oath_n it_o have_v be_v clear_a that_o the_o power_n here_o give_v the_o six_o privy_a counsellor_n be_v as_o extensive_a as_o that_o which_o be_v give_v the_o justice_n of_o assize_n or_o justice_n of_o peace_n in_o their_o session_n and_o they_o may_v have_v require_v the_o oath_n of_o any_o nobleman_n or_o unmarried_a noblewoman_n whatsoever_o of_o competent_a age_n so_o if_o the_o justice_n of_o peace_n only_o have_v be_v here_o name_v it_o have_v be_v clear_o intend_v of_o the_o justice_n of_o peace_n in_o either_o capacity_n either_o in_o or_o out_o of_o session_n but_o bishop_n seem_v here_o to_o be_v a_o restrictive_a word_n and_o to_o give_v the_o privy_a counsellor_n no_o more_o power_n in_o respect_n of_o the_o nobility_n than_o the_o bishop_n have_v in_o reference_n to_o any_o other_o subject_a 2._o these_o word_n in_o all_o cause_n where_o &c._n &c._n seem_v to_o be_v restrictive_a likewise_o and_o exclusive_a of_o some_o cause_n but_o the_o power_n of_o the_o justice_n of_o peace_n in_o session_n extend_v to_o all_o cause_n and_o person_n under_o the_o degree_n of_o nobility_n whatsoever_o which_o therefore_o can_v be_v here_o intend_v but_o only_o some_o particular_a cause_n ejusdem_fw-la generis_fw-la which_o can_v be_v no_o other_o than_o the_o cause_n before_o mention_v wherein_o the_o bishop_n or_o two_o justice_n out_o of_o session_n may_v deal_v viz._n where_o the_o party_n be_v before_o convict_v or_o indict_v or_o have_v not_o receive_v the_o sacrament_n or_o pass_v unknown_a and_o confess_v etc._n etc._n and_o yet_o as_o it_o be_v report_v in_o bulstrode_n 1._o 197._o the_o case_n of_o the_o a_o far_a distance_n although_o they_o inhabit_v in_o that_o which_o be_v within_o london_n or_o ten_o mile_n for_o three_o month_n next_o before_o that_o session_n of_o parliament_n yet_o if_o they_o be_v not_o tradesman_n at_o the_o time_n of_o make_v of_o this_o act_n they_o shall_v have_v have_v no_o benefit_n by_o this_o proviso_n but_o aught_o within_o ten_o day_n after_o such_o indictment_n or_o conviction_n for_o recusancy_n to_o have_v remove_v out_o of_o the_o compass_n of_o ten_o mile_n 7._o stat._n sect._n 7._o and_o whereas_o by_o a_o statute_n make_v at_o westminster_n in_o the_o five_o and_o thirty_o year_n of_o the_o reign_n of_o queén_n elizabeth_n entitle_v a_o act_n for_o the_o restrain_v of_o popish_a recusant_n to_o some_o certain_a place_n of_o abode_n it_o be_v among_o other_o thing_n ordain_v and_o enact_v that_o every_o popish_a recusant_n then_o or_o after_o convict_a for_o not_o repair_v to_o church_n chappel_n or_o usual_a place_n of_o common_a prayer_n confine_v a_o recusant_n confine_v have_v any_o certain_a place_n of_o dwell_v and_o abode_n within_o this_o realm_n shall_v within_o the_o time_n limit_v by_o the_o say_a statute_n repair_v to_o their_o place_n of_o usual_a dwell_n and_o abode_n or_o not_o have_v any_o certain_a place_n of_o dwell_v or_o abode_n within_o this_o realm_n shall_v likewise_o within_o the_o time_n limit_v by_o the_o say_a statute_n repair_v to_o the_o place_n where_o such_o person_n be_v bear_v or_o where_o the_o father_n or_o mother_n of_o such_o person_n shall_v be_v dwell_v and_o not_o at_o any_o time_n licence_n unto_o the_o say_a recusant_n to_o go_v and_o travel_v from_o or_o out_o of_o the_o compass_n of_o the_o say_v five_o mile_n shall_v be_v from_o and_o after_o the_o end_n of_o this_o present_a session_n of_o parliament_n utter_o repeal_v and_o void_a any_o thing_n in_o the_o say_a statute_n to_o the_o contrary_a notwithstanding_o then_o or_o after_o convict_v vide_fw-la sect._n 8._o infra_fw-la give_v power_n to_o grant_v licence_n or_o licence_n unto_o the_o say_a recusant_n the_o proviso_n in_o the_o statute_n of_o 35_o eliz._n cap._n 2._o here_o repeal_v be_v only_o that_o which_o there_o empower_v the_o justice_n of_o peace_n for_o that_o be_v the_o only_a proviso_n which_o give_v power_n to_o grant_v licence_n and_o the_o cause_n here_o allege_v for_o the_o repeal_n be_v the_o giving_z of_o sundry_a licence_n to_o recusant_n under_o colour_n of_o a_o proviso_n in_o 35._o which_o can_v be_v construe_v only_o of_o those_o which_o be_v to_o be_v give_v by_o the_o justice_n of_o peace_n and_o not_o of_o the_o other_o licence_n give_v by_o 35._o in_o several_a other_o case_n so_o that_o the_o proviso_n there_o permit_v the_o popish_a recusant_n to_o travel_v in_o case_n of_o process_n or_o commandment_n by_o privy_a counsellor_n or_o the_o queen_n commissioner_n or_o proclamation_n to_o render_v his_o body_n to_o the_o sheriff_n remain_z still_o in_o force_n and_o unrepealed_a and_o the_o recusant_n may_v take_v the_o benefit_n thereof_o at_o this_o day_n 8._o stat._n sect._n 8._o provide_v nevertheless_o and_o be_v it_o further_o enact_v by_o this_o present_a parliament_n and_o by_o the_o authority_n of_o the_o same_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o king_n most_o excellent_a majesty_n his_o heir_n and_o successor_n or_o for_o three_o or_o more_o of_o his_o majesty_n most_o honourable_a privy_a council_n or_o for_o threé_o or_o more_o of_o the_o privy_a council_n of_o his_o heir_n or_o successor_n a_o licence_n to_o be_v grant_v by_o four_o justice_n of_o peace_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n reside_v within_o the_o say_a county_n or_o liberty_n under_o their_o hand_n and_o seal_n in_o every_o of_o which_o licence_n or_o licence_n in_o write_v so_o to_o be_v have_v and_o make_v shall_v be_v specify_v and_o contain_v both_o the_o particular_a cause_n of_o the_o say_a licence_n and_o the_o time_n how_o long_o the_o say_a party_n license_v shall_v be_v absent_a in_o travel_v attend_v and_o return_v it_o shall_v and_o may_v thereupon_o be_v lawful_a for_o every_o such_o person_n so_o licence_v to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n recusant_n not_o convict_v who_o have_v no_o certain_a place_n of_o abode_n as_o of_o the_o popish_a recusant_n convict_v and_o the_o benefit_n of_o have_v licence_n from_o the_o king_n or_o three_o privy_a counsellor_n by_o force_n of_o this_o act_n be_v intend_v as_o well_o to_o the_o one_o as_o the_o other_o although_o the_o convict_a only_o be_v mention_v in_o the_o recital_n and_o this_o will_v plain_o appear_v first_o by_o the_o follow_a word_n here_o which_o empower_v the_o justice_n of_o peace_n to_o grant_v licence_n and_o express_o extend_v to_o all_o person_n confine_v by_o virtue_n of_o the_o say_a statute_n that_o be_v the_o statute_n of_o 35_o eliz._n now_o it_o can_v be_v presume_v that_o the_o maker_n of_o the_o law_n intend_v any_o difference_n between_o the_o person_n to_o be_v licence_v by_o the_o king_n or_o privy_a counsellor_n and_o the_o person_n to_o be_v license_v by_o the_o justice_n of_o peace_n the_o only_a difference_n be_v in_o the_o manner_n of_o grant_v the_o licence_n the_o power_n give_v to_o the_o king_n or_o privy_a counsellor_n be_v more_o absolute_a and_o not_o under_o such_o precaution_n as_o be_v that_o which_o be_v give_v to_o the_o justice_n of_o peace_n for_o the_o king_n or_o privy_a counsellor_n may_v grant_v a_o licence_n to_o the_o recusant_n to_o travel_v without_o any_o particular_a cause_n show_v in_o the_o licence_n or_o the_o assent_n of_o any_o other_o person_n and_o without_o any_o oath_n to_o be_v make_v by_o the_o recusant_n which_o the_o justice_n of_o peace_n can_v do_v and_o there_o be_v no_o reason_n to_o think_v that_o the_o power_n here_o give_v to_o the_o king_n or_o privy_a counsellor_n which_o in_o all_o other_o particular_n be_v so_o much_o more_o absolute_a and_o extensive_a then_o that_o give_v to_o the_o justice_n of_o peace_n shall_v be_v yet_o less_o extensive_a as_o to_o the_o person_n to_o be_v license_v second_o it_o be_v absurd_a to_o think_v that_o the_o maker_n of_o the_o law_n intend_v to_o confer_v a_o great_a privilege_n upon_o the_o recusant_n convict_v who_o offence_n appear_v upon_o record_n then_o to_o such_o as_o be_v not_o convict_v et_fw-la ealis_fw-la interpretatio_fw-la in_o ambiguis_fw-la semper_fw-la fienda_fw-la est_fw-la ut_fw-la evitetur_fw-la inconveniens_fw-la &_o absurdum_fw-la but_o if_o by_o such_o recusant_n shall_v be_v mean_v only_o hand_n and_o seal_n of_o all_o five_o reside_v within_o the_o say_a county_n or_o liberty_n county_n residence_n in_o the_o county_n these_o word_n seem_v to_o refer_v as_o well_o to_o the_o bishop_n and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o compass_n of_o five_o mile_n and_o he_o plead_v a_o a_o licence_n from_o four_o justice_n of_o peace_n it_o seem_v necessary_a that_o he_o aver_v in_o his_o plea_n that_o the_o cause_v contain_v in_o his_o licence_n be_v true_a and_o real_a vide_fw-la moor_n 836._o c._n 1127._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a function_n stat._n sect._n 9_o a_o recusant_n disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z corporal_z sergeant_z ancient-bearer_n or_o other_o office_n in_o camp_n troup_n band_n or_o company_n of_o soldier_n nor_o shall_v be_v captain_n master_n governor_z or_o bear_v any_o office_n or_o charge_n of_o or_o in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n but_o be_v utter_o dissable_v for_o the_o same_o and_o every_o person_n
