that_o shall_v exceed_v a_o teirce_a â—â—all_v be_v account_v for_o a_o hogshead_n and_o every_o cask_n that_o shall_v exceed_v a_o hogshead_n shall_v be_v account_v for_o a_o puncheon_n and_o every_o cask_n that_o exceed_v a_o puncheon_n shall_v be_v account_v a_o but_o or_o pipe_n without_o any_o allowance_n of_o vndergage_n whatsoever_o that_o all_o common_a brewer_n of_o beer_n and_o ale-maker_n and_o distiller_n of_o aquavitae_n and_o strong-water_n to_o sell_v again_o in_o their_o shop_n who_o by_o this_o present_a act_n be_v charge_v with_o excize_n and_o liable_a to_o payment_n thereof_o upon_o the_o brew_n or_o make_v of_o their_o beer_n and_o ale_n aquavitae_a and_o strong-water_n shall_v under_o their_o own_o hand_n or_o the_o hand_n of_o such_o for_o who_o they_o shall_v be_v responsible_a weekly_a that_o be_v to_o say_v on_o the_o monday_n of_o every_o week_n make_v true_a entry_n at_o the_o office_n of_o excize_n under_o which_o they_o live_v of_o the_o quality_n and_o quantity_n of_o all_o beer_n and_o ale_n aquavitae_a and_o strong-water_n by_o they_o brew_v make_v and_o distil_v the_o week_n forego_v and_o at_o the_o same_o time_n pay_v and_o clear_v the_o excize_n upon_o pain_n of_o forfeit_v twenty_o pound_n for_o the_o first_o forty_o pound_n for_o the_o second_o and_o sixty_o pound_n for_o the_o three_o week_n they_o or_o any_o of_o they_o or_o any_o other_o for_o they_o as_o aforesaid_a shall_v neglect_v refuse_v or_o omit_v to_o make_v such_o entry_n and_o payment_n as_o aforesaid_a and_o further_o to_o forfeit_v double_a the_o value_n of_o the_o beer_n ale_n aquavitae_a and_o strong-water_n by_o they_o make_v and_o brew_v in_o those_o or_o any_o of_o those_o week_n and_o before_o such_o entry_n and_o payment_n of_o excize_a as_o aforesaid_a the_o same_o to_o be_v levy_v by_o distress_n and_o in_o default_n thereof_o the_o party_n offend_v to_o be_v proceed_v against_o as_o be_v hereafter_o mention_v and_o express_v and_o in_o case_n any_o common_a brewer_n of_o beer_n and_o ale-maker_n or_o distiller_n of_o aquavitae_a or_o strong-water_n shall_v for_o more_o than_o three_o several_a week_n neglect_v or_o refuse_v to_o enter_v and_o pay_v weekly_a his_o excize_n as_o aforesaid_a every_o such_o brewer_n maker_n or_o distiller_n of_o aquavitae_a or_o strong-water_n i_o shall_v for_o ever_o after_o be_v disable_v and_o make_v uncapable_a of_o exercise_v the_o trade_n of_o a_o common_a brewer_n maker_n or_o distiller_n of_o aquavitae_a or_o strong-water_n unless_o and_z until_o he_o shall_v pay_v one_o hundred_o pound_n and_o give_v bond_n unto_o our_o sovereign_a lord_n the_o king_n with_o sufficient_a surety_n for_o his_o due_a and_o constant_a enter_v and_o pay_v weekly_o in_o the_o future_a as_o aforesaid_a that_o all_o common_a brewer_n in_o pay_v and_o clear_v their_o excize_n shall_v from_o time_n to_o time_n and_o at_o all_o time_n be_v allow_v sixty_o four_o gallon_n in_o every_o seven_o hundred_o and_o four_o gallon_n of_o beer_n and_o thirty_o two_o gallon_n in_o every_o six_o hundred_o seventy_o two_o gallon_n of_o ale_n and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n by_o they_o brew_v free_a of_o duty_n to_o be_v deduct_v and_o defaulk_v from_o their_o payment_n to_o be_v for_o and_o in_o respect_n of_o fill_v waste_v leakage_n return_v or_o at_o any_o other_o accident_n or_o consideration_n whatsoever_o that_o no_o vintner_n innkeeper_n victualler_n alehouse-keeper_n or_o other_o person_n whatsoever_o that_o use_v common_a sell_v of_o beer_n ale_n aquavitae_a or_o strong-water_n shall_v be_v permit_v to_o brew_v make_v or_o distil_v he_o or_o their_o own_o beer_n ale_n aquavitae_a or_o strong-water_n unless_o such_o vintner_n innkeeper_n victualler_n alehouse-keeper_n and_o other_o person_n whatsoever_o brew_v make_v and_o vend_v by_o retail_n in_o their_o house_n as_o aforesaid_a do_v forthwith_o enter_v into_o bond_n to_o our_o sovereign_a lord_n the_o king_n with_o sufficient_a surety_n in_o such_o sum_n or_o sum_n of_o money_n as_o the_o commissioner_n or_o sub-commissioner_n of_o excize_n shall_v judge_v reasonable_a for_o the_o true_a enter_v and_o pay_v weekly_o at_o the_o office_n of_o excize_n under_o which_o he_o or_o they_o live_v of_o the_o excize_n of_o all_o their_o beer_n ale_n aquavitae_a or_o strong-water_n in_o case_n he_o or_o they_o live_v not_o above_o three_o mile_n from_o the_o say_a office_n or_o else_o every_o fourteen_o day_n in_o case_n they_o live_v further_o off_o from_o the_o same_o upon_o pain_n that_o every_o vintner_n alehousekeeper_n or_o other_o person_n brew_v make_v or_o distil_v his_o or_o their_o beer_n ale_n aquavitae_a or_o strongwater_n without_o bond_n give_v as_o aforesaid_a shall_v upon_o due_a proof_n thereof_o make_v before_o the_o commissioner_n of_o excize_n or_o their_o sub-commissioner_n respective_o forfeit_v for_o every_o such_o offence_n the_o sum_n of_o twenty_o shilling_n and_o if_o the_o say_a person_n shall_v offend_v the_o second_o time_n then_o to_o forfeit_v the_o sum_n of_o forty_o shilling_n to_o be_v levy_v by_o distress_n or_o otherwise_o as_o hereafter_o by_o this_o act_n be_v appoint_v and_o if_o the_o say_a person_n shall_v notwithstanding_o commit_v the_o like_a offence_n the_o three_o time_n than_o such_o person_n or_o person_n so_o offend_v shall_v not_o only_o forfeit_v three_o pound_n to_o be_v levy_v as_o aforesaid_a but_o shall_v and_o may_v be_v commit_v to_o some_o common_a gaol_n by_o the_o say_a commissioner_n or_o sub-commissioner_n till_o he_o or_o they_o do_v enter_v into_o bond_n with_o a_o good_a surety_n to_o his_o majesty_n use_n in_o the_o penal_a sum_n of_o twenty_o pound_n sterling_a that_o he_o shall_v not_o and_o will_v not_o brew_v make_v distil_v and_o vend_fw-mi by_o retail_n or_o otherwise_o beer_n ale_n aquavitae_a or_o strongwater_n any_o more_o or_o at_o any_o time_n afterward_o that_o for_o the_o better_a account_v with_o thâ—_n common_a brewer_n vintner_n innkeeper_n victualer_n alehousekeeper_n and_o other_o brew_v make_v and_o retayl_v beer_n ale_n the_o rule_n and_o government_n of_o the_o say_v office_n that_o the_o like_a office_n and_o office_n and_o so_o many_o of_o they_o and_o in_o they_o such_o or_o so_o many_o subordinate_a commissioner_n sub-commissioner_n or_o collector_n or_o subordinate_a commissioner_n sub-commissioner_n or_o collector_n from_o time_n to_o time_n shall_v be_v nominate_v and_o appoint_v in_o all_o or_o any_o of_o the_o county_n of_o this_o realm_n and_o in_o all_o other_o city_n town_n port_n and_o place_n thereof_o as_o the_o say_a commissioner_n or_o the_o major_a part_n of_o they_o shall_v from_o time_n to_o time_n think_v fit_v to_o be_v approve_v of_o by_o the_o lord_n lieutenant_n lord_n deputy_n or_o other_o chief_a governor_n or_o governor_n and_o privy_a council_n of_o ireland_n for_o the_o time_n be_v which_o say_v subordinate_a commissioner_n sub-commissioner_n or_o collector_n shall_v take_v the_o like_a oath_n as_o aforesaid_a respective_o before_o the_o lord_n chief_a for_o the_o receive_v all_o money_n which_o shall_v be_v due_a and_o payable_a by_o all_o or_o any_o of_o they_o and_o for_o other_o thing_n necessary_a to_o be_v do_v touch_v the_o business_n of_o excize_n and_o affair_n relate_v thereunto_o that_o the_o several_a surveyor_n searcher_n waiter_n and_o all_o other_o officer_n which_o shall_v from_o time_n to_o time_n be_v depute_v or_o appoint_v thereunto_o by_o the_o say_v chief_a commissioner_n under_o the_o hand_n and_o seal_n of_o they_o or_o the_o major_a part_n of_o they_o in_o the_o several_a port_n creek_n havens_n and_o other_o member_n of_o the_o same_o within_o this_o realm_n shall_v have_v full_a power_n and_o authority_n to_o go_v on_o board_n and_o enter_v into_o any_o ship_n or_o other_o vessel_n whatsoever_o as_o well_o by_o night_n as_o by_o day_n arrive_v and_o come_v into_o any_o the_o several_a port_n havens_n creek_n or_o other_o place_n and_o not_o only_o to_o continue_v there_o on_o board_n until_o into_o safe_a custody_n by_o bring_v or_o cause_v they_o to_o be_v bring_v to_o the_o office_n for_o excize_n next_o adjoin_v to_o the_o place_n when_o such_o good_n shall_v be_v so_o seize_v there_o to_o be_v deâ—â—ined_v and_o keep_v and_o in_o case_n the_o say_v good_n and_o merchandize_n so_o seize_v shall_v not_o be_v claim_v by_o the_o true_a and_o lawful_a owner_n or_o proprietor_n thereof_o or_o by_o one_o depute_v under_o his_o or_o their_o â—ands_n within_o one_o and_o twenty_o day_n after_o â—eizure_n the_o say_a good_n shall_v be_v absolute_o forfeit_v and_o confiscate_v tender_v and_o allow_v they_o for_o their_o pain_n therein_o every_o such_o person_n shall_v for_o every_o such_o offence_n forfeit_v ten_o pound_n to_o be_v levy_v by_o distress_n or_o in_o default_n shall_v be_v remain_v in_o his_o or_o their_o hand_n at_z or_o upon_o the_o five_o and_o twenty_o day_n of_o december_n one_o thousand_o six_o hundred_o sixty_o one_o as_o be_v before_o mention_v and_o with_o the_o several_a entry_n of_o good_n which_o he_o or_o they_o shall_v make_v for_o any_o good_n or_o merchandize_n inward_o from_o beyond_o the_o sea_n or_o from_o the_o coast_n and_o again_o exonerate_v and_o discharge_v by_o what_o shall_v appear_v in_o the_o excize_a book_n to_o have_v be_v pay_v upon_o the_o sale_n and_o delivery_n of_o all_o or_o any_o of_o the_o say_a good_n or_o merchandize_n and_o by_o the_o several_a quantity_n of_o all_o or_o any_o of_o they_o which_o shall_v be_v ship_v out_o and_o land_v beyond_o the_o sea_n or_o else_o in_o any_o other_o port_n or_o haven_n of_o this_o realm_n and_o there_o enter_v of_o which_o he_o or_o they_o shall_v make_v oath_n and_o all_o thing_n else_o appear_v by_o certificate_n or_o otherwise_o to_o be_v do_v with_o the_o sub-commissioner_n or_o collector_n there_o as_o be_v by_o this_o act_n direct_v and_o appoint_v to_o be_v do_v upon_o the_o importation_n of_o all_o good_n and_o merchandize_n excizeable_a from_o any_o part_n beyond_o the_o sea_n provide_v always_o and_o it_o be_v hereby_o declare_v intend_a and_o enact_v that_o for_o all_o good_n that_o shall_v be_v send_v by_o land_n carriage_n or_o otherwise_o by_o any_o such_o as_o merchant_n aforesaid_a into_o the_o county_n or_o unto_o any_o city_n town_n burrough_n or_o place_n whatsoever_o other_o than_o the_o port_n and_o member_n thereof_o in_o this_o realm_n and_o there_o enter_v as_o aforesaid_a every_o such_o merchant_n upon_o his_o account_v with_o the_o say_a commissioner_n sub-commissioner_n or_o collector_n shall_v buyer_n in_o the_o price_n of_o his_o commodity_n any_o thing_n before_o in_o this_o present_a act_n in_o any_o manner_n of_o wise_a to_o the_o contrary_a notwithstanding_o that_o the_o commissioner_n of_o the_o excize_n and_o their_o sub-commissioner_n or_o collector_n respective_o in_o their_o several_a and_o respective_a office_n once_o every_o three_o month_n without_o fail_n or_o often_o if_o they_o shall_v see_v cause_n shall_v take_v care_n for_o the_o balance_a and_o adjust_v of_o the_o merchant_n their_o import_n account_n by_o call_v and_o require_v they_o and_o every_o of_o they_o to_o bring_v and_o deliver_v to_o they_o respective_o a_o particular_a account_n of_o all_o good_n and_o merchandize_n excizeable_a which_o shall_v be_v remain_v then_o on_o his_o or_o their_o hand_n at_o the_o time_n he_o or_o they_o shall_v be_v so_o call_v upon_o or_o require_v and_o if_o any_o such_o merchant_n importer_n or_o other_o person_n shall_v upon_o notice_n give_v he_o or_o they_o or_o upon_o notice_n or_o summons_n leave_v at_o his_o or_o their_o usual_a place_n of_o abode_n or_o habitation_n warn_v he_o or_o they_o thereunto_o refuse_v or_o neglect_v to_o give_v in_o such_o account_n for_o the_o space_n of_o four_o day_n after_o such_o notice_n warning_n or_o summons_n as_o aforesaid_a every_o such_o merchant_n or_o importer_n shall_v be_v present_o liable_a to_o payment_n of_o the_o full_a excize_n of_o all_o good_n that_o shall_v be_v find_v to_o stand_v charge_v in_o the_o excize_a book_n on_o his_o or_o their_o import_n account_n by_o his_o and_o their_o rest_n and_o remainder_n as_o aforesaid_a and_o his_o or_o their_o entry_n of_o good_n upon_o importation_n which_o have_v not_o be_v discharge_v or_o clear_v by_o payment_n of_o excize_n or_o ship_v out_o of_o such_o good_n and_o according_o adjudge_v and_o warn_v by_o summons_n as_o aforesaid_a or_o otherwise_o to_o pay_v the_o same_o within_o six_o day_n next_o after_o follow_v at_o further_a or_o in_o default_n thereof_o every_o such_o merchant_n importer_n shall_v not_o only_o forfeit_v double_a the_o value_n of_o all_o such_o good_n as_o shall_v be_v find_v want_v rest_a or_o remain_v on_o his_o import_n account_n to_o be_v levy_v as_o hereafter_o be_v mention_v but_o shall_v ever_o after_o be_v uncapable_a of_o take_v up_o any_o good_n or_o commodity_n excizeable_a in_o any_o port_n of_o this_o realm_n either_o for_o his_o own_o or_o any_o other_o use_v without_o payment_n down_o of_o the_o excize_n of_o such_o good_n as_o if_o he_o be_v a_o shopkeeper_n retailer_n or_o consumptioner_n of_o the_o same_o but_o if_o such_o importer_n shall_v upon_o demand_n or_o within_o four_o day_n after_o give_v in_o such_o account_n as_o aforesaid_a than_o the_o say_a commissioner_n of_o excize_n their_o sub-commissioner_n and_o collector_n shall_v forthwith_o appoint_v one_o or_o more_o officer_n or_o officer_n to_o enter_v into_o all_o the_o cellar_n warehouse_n storehouse_n storecellar_n and_o oâ—her_n place_n whatsoever_o belong_v unto_o such_o importer_n to_o search_v see_v and_o try_v by_o take_v a_o account_n of_o the_o quality_n and_o quantity_n of_o the_o good_n and_o merchandize_n therein_o remain_v whether_o such_o importer_n remainder_n do_v agree_v with_o his_o account_n or_o no_o and_o to_o make_v report_n thereof_o unto_o the_o say_a commissioner_n sub-commissioner_n or_o collector_n respective_o which_o report_n of_o such_o officer_n or_o officer_n in_o case_n of_o difference_n betwixt_o the_o remainder_n and_o account_n of_o such_o merchant_n shall_v be_v repute_v take_v and_o esteem_v for_o the_o true_a and_o just_a remainder_n according_a to_o which_o the_o say_a commissioner_n sub-commissioner_n or_o collector_n shall_v proceed_v in_o make_v up_o his_o account_n and_o then_o such_o merchant_n make_v oath_n before_o the_o saiâ—_n commissioner_n sub-commissioner_n or_o collector_n respective_o that_o the_o good_n and_o merchandize_n remain_v view_v and_o see_v by_o the_o officer_n or_o officer_n aforesaid_a and_o all_o other_o good_n ship_v out_o by_o he_o by_o which_o his_o account_n be_v to_o be_v discharge_v be_v all_o and_o every_o part_n and_o parcel_n of_o they_o such_o good_n and_o merchandize_n as_o have_v be_v bona_fw-la fide_fw-la formerly_z import_v by_o himself_o and_o enter_v in_o the_o excize_a office_n and_o there_o charge_v on_o his_o proper_a import_n account_n and_o that_o the_o say_v good_n and_o merchandize_n founâ—_n so_o remain_v have_v not_o be_v sell_v or_o alter_v either_o direct_o or_o indirect_o in_o their_o property_n since_o their_o first_o importation_n and_o bring_v iâ—_n of_o the_o same_o into_o this_o realm_n the_o say_a commissioner_n sub-commissioner_n and_o collector_n respective_o allow_v upon_o the_o account_n such_o remainder_n and_o also_o such_o other_o good_n and_o merchandize_n which_o such_o merchant_n shall_v at_o any_o time_n betwixt_o the_o timeâ—_n of_o his_o account_v have_v ship_v out_o and_o land_v in_o any_o part_n beyond_o the_o sea_n or_o ship_v out_o land_v and_o enter_v in_o any_o other_o port_n or_o member_n thereof_o in_o this_o realm_n shaâ—â—_n have_v power_n to_o adjust_a his_o account_n to_o thâ—_n day_n and_o to_o receive_v excize_a present_o of_o hiâ—_n for_o so_o much_o good_n and_o merchandize_n aâ—_n shall_v be_v find_v want_v on_o his_o account_n without_o any_o further_a penalty_n any_o thing_n before_o in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o so_o go_v on_o to_o the_o frame_n of_o â—_o new_a import_n account_n with_o he_o from_o thâ—_n whole_a remainder_n state_v and_o agree_v on_o
