among_o other_o thing_n ordain_v and_o enact_v that_o every_o popish_a recusant_n then_o or_o after_o convict_a for_o not_o repair_v to_o church_n chappel_n or_o usual_a place_n of_o common_a prayer_n confine_v a_o recusant_n confine_v have_v any_o certain_a place_n of_o dwell_v and_o abode_n within_o this_o realm_n shall_v within_o the_o time_n limit_v by_o the_o say_a statute_n repair_v to_o their_o place_n of_o usual_a dwell_n and_o abode_n or_o not_o have_v any_o certain_a place_n of_o dwell_v or_o abode_n within_o this_o realm_n shall_v likewise_o within_o the_o time_n limit_v by_o the_o say_a statute_n repair_v to_o the_o place_n where_o such_o person_n be_v bear_v or_o where_o the_o father_n or_o mother_n of_o such_o person_n shall_v be_v dwell_v and_o not_o at_o any_o time_n remove_v or_o pass_v above_o five_o mile_n from_o thence_o under_o the_o pain_n in_o the_o say_a statute_n limit_v and_o provide_v which_o statute_n by_o reason_n of_o sundry_a licence_n give_v unto_o present_a session_n of_o parliament_n utter_o repeal_v and_o void_a any_o thing_n in_o the_o say_a statute_n to_o the_o contrary_a notwithstanding_o then_o or_o after_o convict_v vide_fw-la sect._n that_o which_o there_o empower_v the_o justice_n of_o peace_n for_o that_o be_v the_o only_a proviso_n which_o give_v power_n to_o grant_v licence_n and_o the_o cause_n here_o allege_v for_o the_o repeal_n be_v the_o giving_z of_o sundry_a licence_n to_o recusant_n under_o colour_n of_o a_o proviso_n in_o 35._o which_o can_v be_v construe_v only_o of_o those_o which_o be_v to_o be_v give_v by_o the_o justice_n of_o peace_n and_o not_o of_o the_o other_o licence_n give_v by_o 35._o in_o several_a other_o case_n so_o that_o the_o proviso_n there_o permit_v the_o popish_a recusant_n to_o travel_v in_o case_n of_o process_n or_o commandment_n by_o privy_a counsellor_n or_o the_o queen_n commissioner_n or_o proclamation_n to_o render_v his_o body_n to_o the_o sheriff_n remain_z still_o in_o force_n and_o unrepealed_a and_o the_o recusant_n may_v take_v the_o benefit_n thereof_o at_o this_o day_n 8._o stat._n sect._n 8._o provide_v nevertheless_o and_o be_v it_o further_o enact_v by_o this_o present_a parliament_n and_o by_o the_o authority_n of_o the_o same_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o king_n most_o excellent_a majesty_n his_o heir_n and_o successor_n or_o for_o three_o or_o more_o of_o his_o majesty_n most_o honourable_a privy_a council_n or_o for_o threé_o or_o more_o of_o the_o privy_a council_n of_o his_o heir_n or_o successor_n in_o write_v under_o the_o hand_n of_o the_o say_v privy_a counsellor_n confine_v licence_n to_o a_o popish_a recusant_n confine_v to_o give_v licence_n to_o every_o such_o recusant_n to_o go_v and_o travel_v out_o of_o the_o compass_n of_o the_o say_v five_o mile_n for_o such_o time_n as_o in_o the_o say_a licence_n shall_v be_v contain_v for_o their_o travel_n attend_v and_o return_v and_o without_o any_o other_o cause_n to_o be_v express_v within_o the_o say_a licence_n and_o if_o any_o of_o the_o person_n which_o be_v so_o confine_v by_o virtue_n of_o the_o say_a statute_n as_o be_v aforesaid_a shall_v have_v necessary_a occasion_n or_o business_n to_o go_v and_o travel_v out_o of_o the_o compass_n of_o the_o say_v five_o mile_n that_o then_o and_o in_o every_o such_o case_n upon_o licence_n in_o write_v in_o that_o behalf_n to_o be_v get_v under_o the_o hand_n and_o seal_n of_o four_o of_o the_o justice_n of_o peace_n of_o the_o same_o county_n limit_v division_n or_o place_n next_o adjoin_v to_o the_o place_n of_o abode_n of_o such_o recusant_n with_o the_o privity_n and_o assent_n in_o write_v of_o the_o bishop_n of_o the_o diocese_n peace_n the_o effect_n of_o a_o licence_n to_o be_v grant_v by_o four_o justice_n of_o peace_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n reside_v within_o the_o say_a county_n or_o liberty_n under_o their_o hand_n and_o seal_n in_o every_o of_o which_o licence_n or_o licence_n in_o write_v so_o to_o be_v have_v and_o make_v shall_v be_v specify_v and_o contain_v both_o the_o particular_a cause_n of_o the_o say_a licence_n and_o the_o time_n how_o long_o the_o say_a party_n license_v shall_v be_v absent_a in_o travel_v attend_v and_o return_v it_o shall_v and_o may_v thereupon_o be_v lawful_a for_o every_o such_o person_n so_o licence_v to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n attend_v and_o return_v as_o shall_v be_v comprise_v in_o the_o say_a licence_n the_o say_a party_n so_o licence_v first_o take_v his_o corporal_a oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o that_o he_o have_v true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n and_o that_o he_o shall_v not_o make_v any_o causeless_a stay_n and_o that_o all_o and_o every_o licence_n hereafter_o to_o be_v make_v in_o this_o behalf_n contrary_a to_o the_o tenor_n effect_n and_o true_a meaning_n of_o this_o statute_n shall_v be_v utter_o void_a frustrate_a and_o of_o none_o effect_n any_o thing_n in_o the_o say_v former_a act_n or_o in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o every_o person_n so_o confine_v which_o shall_v depart_v or_o go_v above_o five_o mile_n from_o the_o place_n whereunto_o he_o be_v or_o shall_v be_v college_n that_o now_o be_v or_o hereafter_o shall_v be_v receive_v into_o the_o same_o be_v under_o the_o degree_n of_o a_o baron_n before_o the_o precedent_n master_n provost_z warden_n or_o other_o head_n or_o chief_a governor_n of_o that_o college_n hall_n or_o house_n whereinto_o he_o shall_v be_v receive_v and_o in_o the_o open_a hall_n and_o all_o doctor_n of_o physic_n physic_n doctor_n enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n shall_v be_v hereafter_o indict_v or_o arraign_v for_o any_o of_o the_o offence_n make_v ordain_v revive_v or_o adjudge_v by_o this_o act_n unless_o there_o be_v two_o sufficient_a witness_n or_o more_o to_o testify_v and_o declare_v the_o say_v offence_n whereof_o he_o shall_v be_v indict_v or_o arraign_v and_o that_o intent_n of_o the_o party_n who_o receive_v or_o be_v offer_v they_o provide_v nevertheless_o name_n stat._n sect._n 7._o apprehend_v a_o offender_n or_o disclose_v his_o name_n and_o be_v it_o hold_v in_o the_o five_o and_o six_o year_n of_o our_o say_a late_o sovereign_a lord_n king_n edward_n the_o six_o entitle_v a_o act_n for_o the_o uniformity_n of_o common_a prayer_n and_o administration_n of_o the_o sacrament_n the_o which_o be_v repeal_v and_o take_v away_o by_o act_n of_o parliament_n in_o the_o first_o year_n of_o the_o reign_n of_o our_o late_a sovereign_a lady_n queen_n mary_n to_o the_o great_a decay_n of_o the_o due_a honour_n of_o god_n and_o discomfort_v to_o the_o professor_n of_o the_o truth_n of_o christ_n religion_n be_v it_o therefore_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n that_o the_o say_a estatute_n of_o repeal_n force_n a_o repeal_n of_o the_o statute_n of_o 1_o m._n 2._o and_o the_o book_n of_o common_a prayer_n shall_v be_v in_o force_n and_o every_o thing_n therein_o contain_v only_o concern_v the_o say_a book_n and_o the_o service_n administration_n of_o the_o sacrament_n rite_n and_o ceremony_n contain_v or_o appoint_v in_o or_o by_o the_o say_a book_n shall_v be_v void_a and_o of_o none_o effect_n from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v and_o that_o the_o say_a book_n with_o the_o order_n of_o service_n and_o of_o the_o administration_n of_o sacrament_n rite_n and_o ceremony_n with_o the_o alteration_n and_o addition_n therein_o add_v and_o appoint_v by_o this_o estatute_n shall_v stand_v and_o be_v from_o and_o after_o the_o say_a feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n in_o full_a force_n and_o effect_n according_a to_o the_o tenor_n and_o effect_n of_o this_o estatute_n any_o thing_n in_o the_o aforesaid_a estatute_n of_o repeal_n to_o the_o contrary_a notwithstanding_o use_v stat._n sect._n 2._o realm_n of_o england_n wales_n and_o the_o march_n of_o the_o same_o or_o other_o the_o queen_n dominion_n shall_v from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v be_v bind_v to_o say_v and_o use_v the_o matin_n evensong_n celebration_n of_o the_o lord_n supper_n and_o administration_n of_o each_o of_o the_o sacrament_n and_o all_o the_o common_a and_o open_a prayer_n 6._o the_o alteration_n of_o the_o book_n set_v forth_o 5_o &_o 6_o ed._n 6._o in_o such_o order_n and_o form_n as_o be_v mention_v in_o the_o say_a book_n so_o authorize_v by_o parliament_n in_o the_o say_v five_o and_o six_o year_n of_o the_o reign_n of_o king_n edward_n the_o six_o with_o one_o alteration_n or_o addition_n of_o certain_a lesson_n to_o be_v use_v on_o every_o sunday_n in_o the_o year_n and_o the_o form_n of_o the_o litany_n alter_v and_o correct_v and_o two_o sentence_n only_o add_v in_o the_o delivery_n of_o the_o sacrament_n to_o the_o communicant_n and_o none_o other_o or_o otherwise_o prayer_n the_o forfeiture_n of_o those_o which_o use_v any_o other_o service_n than_o the_o book_n of_o common_a prayer_n and_o that_o if_o any_o manner_n of_o parson_n vicar_n or_o other_o whatsoever_o minister_n that_o ought_v or_o shall_v sing_v or_o say_v common_a prayer_n mention_v in_o the_o say_a book_n or_o minister_v the_o sacrament_n from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v refuse_v to_o use_v the_o say_v common_a prayer_n or_o to_o administer_v the_o sacrament_n in_o such_o cathedral_n or_o parish_n church_n or_o other_o place_n as_o he_o shall_v use_v to_o minister_v the_o same_o in_o such_o order_n and_o form_n as_o they_o be_v mention_v and_o set_v forth_o in_o the_o say_a book_n or_o shall_v wilful_o or_o obstinate_o stand_v in_o the_o same_o use_v any_o other_o rite_n ceremony_n order_n form_n or_o manner_n of_o celebrate_v the_o lord_n supper_n open_o or_o privy_o or_o matin_n evensong_n administration_n of_o the_o sacrament_n or_o other_o open_a prayer_n then_o be_v mention_v and_o set_v forth_o in_o the_o say_a book_n open_a prayer_n in_o and_o throughout_o this_o act_n be_v mean_v that_o prayer_n which_o be_v for_o other_o to_o come_v unto_o or_o hear_v either_o in_o common_a church_n prayer_n the_o penalty_n for_o deprave_v the_o book_n of_o common_a prayer_n or_o private_a chapel_n or_o oratory_n common_o call_v the_o service_n of_o the_o church_n or_o shall_v preach_v declare_v or_o speak_v any_o thing_n in_o the_o derogation_n or_o deprave_v of_o the_o say_a book_n or_o any_o thing_n therein_o contain_v or_o of_o any_o part_n thereof_o and_o shall_v be_v thereof_o lawful_o convict_v according_a to_o the_o law_n of_o this_o within_o any_o other_o the_o queen_n dominion_n signory_n or_o country_n or_o in_o the_o march_n of_o the_o same_o or_o elsewhere_o within_o or_o under_o her_o obeisance_n and_o power_n of_o what_o estate_n dignity_n pre-eminence_n order_n or_o condition_n soever_o he_o or_o they_o be_v after_o the_o first_o day_n of_o april_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n god_n one_o thousand_o five_o hundred_o sixty_o three_o shall_v by_o write_v typher_v print_v preach_v or_o teach_v deed_n or_o act_n advise_o and_o witting_o hold_v or_o stand_v with_o to_o extol_v set_v forth_o any_o dominion_n or_o country_n be_v of_o within_z or_o under_o the_o queéns_n power_n or_o obeisance_n or_o by_o any_o speech_n open_a deed_n or_o act_n advise_o and_o witting_o attribute_v any_o such_o manner_n of_o jurisdiction_n authority_n or_o pre-eminence_n to_o the_o say_v see_v of_o rome_n or_o to_o any_o bishop_n of_o the_o same_o see_v for_o the_o time_n be_v within_o this_o realm_n or_o in_o any_o the_o queen_n dominion_n or_o country_n that_o then_o every_o such_o person_n or_o person_n so_o do_v or_o offend_v their_o abettor_n procurer_n and_o counsellor_n and_o also_o their_o aider_n assistant_n and_o comforter_n upon_o purpose_n and_o to_o the_o intent_n to_o set_v forth_o further_o and_o extol_v the_o say_v usurp_a power_n authority_n or_o jurisdiction_n of_o any_o of_o the_o say_a bishop_n or_o bishop_n of_o rome_n and_o every_o of_o they_o be_v thereof_o lawful_o indict_v or_o present_v within_o one_o year_n next_o after_o any_o such_o offence_n by_o he_o or_o they_o commit_v and_o be_v lawful_o convict_v or_o attaint_v at_o any_o time_n after_o according_a to_o the_o law_n of_o this_o realm_n for_o every_o such_o default_n and_o offence_n shall_v incur_v within_o the_o danger_n of_o this_o law_n and_o if_o any_o man_n bring_v over_o such_o book_n write_v beyond_o the_o sea_n know_v the_o
person_n which_o shall_v be_v so_o suspect_v shall_v refuse_v to_o answer_v direct_o and_o true_o whether_o he_o be_v a_o jesuit_n or_o a_o seminary_n or_o massing_n priest_n as_o be_v aforesaid_a every_o such_o person_n so_o refuse_v to_o answer_n shall_v for_o his_o disobedience_n and_o contempt_n in_o that_o behalf_n be_v commit_v to_o prison_n by_o such_o as_o shall_v examine_v he_o as_o be_v aforesaid_a and_o thereupon_o shall_v remain_v and_o continue_v in_o prison_n without_o bail_n or_o mainprize_n until_o he_o shall_v make_v direct_a and_o true_a answer_n to_o the_o say_a say_v that_o the_o justice_n of_o peace_n or_o other_o high_a officer_n shall_v examine_v the_o priest_n or_o jesuit_n so_o discover_v yet_o inasmuch_o as_o it_o give_v he_o power_n to_o take_v cognizance_n of_o the_o matter_n it_o seem_v implicit_o to_o empower_v he_o to_o inform_v himself_o of_o the_o truth_n whether_o the_o party_n be_v a_o priest_n or_o jesuit_n or_o not_o as_o well_o by_o examination_n of_o the_o party_n as_o otherwise_o that_o he_o may_v be_v the_o better_o enable_v to_o give_v information_n thereof_o to_o some_o of_o the_o privy_a council_n etc._n etc._n and_o one_o justice_n of_o peace_n have_v by_o 27._o lawful_a authority_n to_o examine_v he_o he_o have_v authority_n likewise_o by_o this_o statute_n of_o 35._o to_o commit_v he_o he_o and_o commit_v he_o if_o he_o be_v suspect_v to_o be_v a_o priest_n or_o jesuit_n and_o refuse_v to_o answer_v whether_o he_o be_v such_o or_o no._n as_o for_o mr._n shepherd_n opinion_n in_o his_o sure_a guide_n cap._n 14._o sect._n 5._o that_o there_o must_v be_v two_o justice_n of_o peace_n to_o commit_v a_o man_n by_o force_n of_o this_o statute_n who_o be_v suspect_v to_o be_v a_o jesuit_n or_o priest_n till_o he_o answer_v direct_o i_o see_v no_o ground_n at_o all_o for_o it_o answer_v to_o the_o say_a question_n that_o be_v examine_v to_o what_o point_n he_o may_v be_v examine_v whether_o he_o be_v a_o jesuit_n seminary_n or_o massing_n priest_n for_o he_o be_v not_o bind_v to_o answer_v to_o any_o other_o question_n nor_o can_v be_v commit_v by_o force_n of_o this_o act_n for_o his_o refusal_n provide_v nevertheless_o 5._o stat._n sect._n 9_o licence_n to_o travel_v above_o five_o mile_n alt._n 3_o jac._n 5._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o person_n which_o be_v hereby_o limit_v and_o appoint_v to_o continue_v and_o abide_v within_o five_o mile_n of_o their_o usual_a dwell_a place_n or_o of_o such_o place_n where_o they_o be_v bear_v or_o where_o their_o father_n and_o mother_n shall_v be_v dwell_v as_o be_v aforesaid_a shall_v have_v necessary_a occasion_n or_o business_n to_o go_v and_o travel_v out_o of_o the_o compass_n of_o the_o say_v five_o mile_n that_o then_o and_o in_o every_o such_o case_n upon_o licence_n in_o that_o behalf_n to_o be_v get_v under_o the_o hand_n of_o two_o of_o the_o justice_n of_o peace_n of_o the_o same_o county_n with_o the_o privity_n and_o assent_n in_o write_v of_o the_o bishop_n of_o the_o diocese_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n under_o their_o hand_n it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o person_n to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n attend_v and_o return_v as_o shall_v be_v comprise_v in_o the_o same_o licence_n any_o thing_n before_o in_o this_o act_n to_o the_o contrary_a notwithstanding_o this_o clause_n be_v repeal_v 5._o repeal_n stat._n 3_o jac._n 5._o and_o a_o new_a form_n of_o licence_n appoint_v by_o the_o statute_n of_o 3_o jac._n cap._n 5._o which_o see_v there_o sect._n 8._o provide_v also_o appear_v stat._n sect._n 10._o person_n urge_v by_o process_n or_o command_v to_o appear_v that_o if_o any_o such_o person_n so_o restrain_v as_o be_v aforesaid_a shall_v be_v urge_v by_o process_n without_o fraud_n or_o covin_z or_o be_v bind_v without_o fraud_n or_o covin_z to_o make_v appearance_n in_o any_o her_o majesty_n court_n or_o shall_v be_v send_v for_o command_v or_o require_v by_o any_o three_o or_o more_o of_o her_o majesty_n privy_a council_n or_o by_o any_o four_o or_o more_o of_o any_o commissioner_n to_o be_v in_o that_o behalf_n nominate_v and_o assign_v by_o her_o majesty_n to_o make_v appearance_n before_o her_o majesty_n say_a counsel_n or_o commissioner_n that_o in_o every_o such_o case_n every_o such_o person_n so_o bind_v urge_v command_v or_o require_v to_o make_v such_o appearance_n shall_v not_o incur_v any_o pain_n forfeiture_n or_o loss_n for_o travel_v to_o make_v appearance_n according_o nor_o for_o his_o abode_n concern_v the_o same_o nor_o for_o convenient_a time_n for_o his_o return_n back_o again_o upon_o the_o same_o urge_v by_o process_n if_o a_o popish_a recusant_n restrain_v by_o this_o act_n be_v summon_v by_o warrant_n of_o a_o justice_n of_o peace_n to_o appear_v before_o he_o the_o recusant_n ought_v not_o to_o travel_v to_o such_o justice_n out_o of_o his_o compass_n of_o 5_o mile_n for_o although_o a_o justice_n of_o peace_n his_o warrant_n be_v the_o king_n process_n mean_v whaâ—_n process_n be_v here_o mean_v yet_o it_o be_v not_o intend_v here_o for_o these_o word_n urge_v by_o process_n be_v restrain_v by_o the_o subsequent_a word_n to_o such_o process_n as_o require_v the_o recusants_n appearance_n in_o some_o one_o of_o the_o king_n court_n and_o extend_v not_o to_o all_o case_n of_o summons_n and_o process_n as_o wingate_n tit_n crown_n numb_a 83._o mistake_n but_o if_o in_o the_o case_n aforesaid_a the_o warrant_n be_v to_o arrest_v the_o recusant_n and_o by_o force_n thereof_o he_o be_v carry_v by_o the_o constable_n etc._n etc._n out_o of_o the_o compass_n of_o five_o mile_n there_o he_o be_v excuse_v and_o shall_v forfeit_v nothing_o for_o that_o it_o be_v do_v by_o compulsion_n and_o yet_o if_o there_o be_v any_o covin_z between_o the_o recusant_n and_o the_o justice_n of_o peace_n or_o officer_n it_o may_v be_v otherwise_o court_n the_o king_n court_n in_o any_o her_o majesty_n court_n all_o court_n wherein_o the_o proceed_n be_v direct_v by_o the_o king_n law_n be_v the_o king_n court_n and_o therefore_o a_o court_n leet_n leet_n court_n leet_n though_o of_o a_o inferior_a nature_n and_o keep_v in_o the_o lord_n name_n yet_o be_v the_o king_n court_n co._n 5._o 39_o cawdry_n case_n hetley_n 18._o court_n ecclesiastical_a court_n if_o a_o popish_a recusant_n restrain_v by_o this_o act_n be_v cite_v into_o the_o ecclesiastical_a court_n he_o may_v by_o force_n of_o this_o proviso_n travel_v out_o of_o the_o compass_n of_o five_o mile_n to_o appear_v there_o for_o all_o ecclesiastical_a court_n be_v the_o king_n court_n and_o the_o law_n by_o which_o they_o proceed_v there_o be_v the_o king_n law_n vide_fw-la cawdry_n case_n supra_fw-la vide_fw-la stat._n 3_o jac._n cap._n 5._o sect._n 7._o sheriff_n stat._n sect._n 11._o person_n which_o be_v to_o yield_v their_o body_n to_o the_o sheriff_n and_o be_v it_o further_o provide_v and_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o person_n or_o person_n so_o restrain_v as_o be_v aforesaid_a shall_v be_v bind_v or_o aught_o to_o yield_v and_o render_v their_o body_n to_o the_o sheriff_n of_o the_o county_n where_o they_o shall_v happen_v to_o be_v upon_o proclamation_n in_o that_o behalf_n without_o fraud_n or_o covin_z to_o be_v make_v that_o then_o in_o every_o such_o case_n every_o such_o person_n which_o shall_v be_v so_o bind_v or_o ought_v to_o yield_v and_o render_v their_o body_n as_o aforesaid_a shall_v not_o incur_v any_o lie_v against_o the_o husband_n and_o wife_n for_o after_o the_o husband_n death_n she_o will_v be_v liable_a to_o pay_v into_o the_o exchequer_n all_o the_o arrear_n after_o the_o rate_n of_o twenty_o pound_n per_fw-la month_n from_o the_o time_n of_o her_o conviction_n and_o her_o good_n and_o two_o part_n of_o her_o land_n may_v be_v then_o seize_v for_o nonpayment_n thereof_o and_o if_o the_o husband_n and_o wife_n shall_v in_o the_o mean_a time_n at_o the_o suit_n of_o the_o informer_n pay_v twenty_o pound_n per_fw-la month_n for_o part_n of_o the_o same_o time_n for_o which_o the_o wife_n be_v liable_a to_o pay_v after_o the_o husband_n death_n this_o will_v be_v a_o double_a punishment_n for_o one_o and_o the_o same_o offence_n and_o it_o be_v further_o say_v that_o it_o be_v usual_a where_o the_o wife_n be_v indict_v and_o convict_v for_o recusancy_n lease_n seizure_n of_o the_o wife_n land_n and_o lease_n to_o seize_v by_o exchequer_n process_n the_o land_n and_o lease_n which_o the_o husband_n have_v in_o her_o right_n and_o one_o wood_n case_n be_v cite_v to_o this_o purpose_n which_o prove_v that_o a_o feme_fw-fr covert_n be_v within_o the_o meaning_n of_o the_o act_n and_o therefore_o after_o she_o be_v once_o convict_a upon_o indictment_n shall_v be_v no_o more_o subject_a to_o the_o informer_n popular_a suit_n than_o a_o feme_fw-fr sole_a cro._n pasch_fw-mi 16_o jac._n 481.482_o but_o this_o last_o point_n be_v much_o to_o be_v question_v for_o the_o land_n and_o lease_n of_o the_o wife_n be_v the_o husband_n during_o the_o coverture_n and_o it_o be_v a_o general_a rule_n that_o his_o good_n or_o land_n can_v be_v seize_v for_o the_o forfeiture_n or_o penalty_n where_o the_o wife_n only_o be_v indict_v and_o convict_v of_o the_o offence_n see_v more_o of_o this_o matter_n antea_fw-la stat._n 23_o eliz._n cap._n 1._o 1_o stat._n 23_o eliz_n 1_o sect._n 9_o a_o recusant_n be_v indict_v for_o absent_v himself_o from_o church_n for_o 12_o month_n and_o afterward_o be_v convict_v upon_o that_o indictment_n indictment_n where_o a_o informer_n may_v sue_v after_o conviction_n upon_o indictment_n quaere_fw-la whether_o nevertheless_o the_o informer_n qui_fw-fr tam_fw-la etc._n etc._n may_v not_o sue_v he_o for_o his_o absence_n for_o the_o month_n intervening_a between_o the_o time_n lay_v in_o the_o indictment_n and_o the_o time_n of_o his_o conviction_n for_o these_o word_n here_o viz._n after_o such_o conviction_n seem_v to_o relate_v to_o the_o proximum_fw-la antecedens_fw-la every_o month_n and_o to_o imply_v that_o the_o penalty_n here_o appropriate_v to_o the_o king_n be_v only_o the_o penalty_n due_a for_o the_o month_n which_o incur_v after_o such_o conviction_n upon_o indictment_n at_o the_o king_n suit_n but_o not_o to_o hinder_v the_o informer_n after_o conviction_n from_o sue_v for_o the_o month_n incur_v before_o conviction_n except_o in_o such_o case_n where_o the_o king_n shall_v &c._n &c._n refuse_v the_o same_o conviction_n the_o king_n may_v seize_v two_o part_n present_o after_o conviction_n if_o a_o man_n be_v indict_v and_o convict_v of_o recusancy_n the_o king_n be_v not_o bind_v to_o stay_v till_o the_o next_o easter_n or_o michaelmas_n term_n to_o see_v whether_o the_o recusant_n will_v tender_v twenty_o pound_n for_o every_o month_n contain_v in_o the_o indictment_n and_o incur_v after_o such_o conviction_n for_o the_o king_n have_v his_o election_n whether_o he_o will_v accept_v thereof_o or_o seize_v two_o part_n of_o the_o recusants_n land_n a_o commission_n for_o seizure_n of_o the_o land_n may_v issue_v out_o present_o if_o the_o king_n will_v wave_v the_o twenty_o pound_n per_fw-la month_n for_o he_o may_v take_v his_o election_n as_o soon_o as_o he_o will_v after_o conviction_n by_o jones_n justice_n in_o the_o case_n of_o standen_n and_o the_o university_n of_o oxford_n jones_n 24._o exchequer_n stat._n sect._n 7._o every_o conviction_n shall_v be_v certify_v into_o the_o exchequer_n and_o that_o every_o conviction_n record_v for_o any_o offence_n beforementioned_a shall_v from_o the_o justice_n before_o who_o the_o record_n of_o such_o conviction_n shall_v be_v remain_v be_v certify_v into_o the_o king_n majesty_n court_n of_o exchequer_n before_o the_o end_n of_o the_o term_n follow_v such_o conviction_n in_o such_o convenient_a certainty_n for_o the_o time_n and_o other_o circumstance_n as_o the_o court_n of_o exchequer_n may_v thereupon_o award_v out_o process_n for_o the_o seizure_n of_o the_o land_n and_o good_n of_o every_o such_o offender_n as_o the_o cause_n shall_v require_v and_o if_o default_n shall_v be_v make_v in_o any_o part_n of_o any_o payment_n aforesaid_a contrary_n to_o the_o form_n herein_o before_o limit_v that_o then_o and_o so_o often_o the_o king_n majesty_n his_o heir_n and_o successor_n shall_v and_o may_v by_o process_n out_o of_o the_o say_a exchequer_n take_v seize_v and_o enjoy_v all_o the_o good_n and_o two_o part_n as_o well_o of_o all_o the_o land_n tenement_n and_o hereditament_n lease_n and_o farm_n of_o such_o offender_n as_o of_o all_o other_o the_o land_n this_o lease_n and_o the_o reason_n give_v in_o lane_n 39_o why_o the_o king_n shall_v have_v the_o term_n be_v because_o the_o recusant_n after_o she_o be_v convict_v be_v not_o capable_a of_o any_o the_o stat._n of_o 23_o eliz._n 1._o touch_v a_o recusant_n monthly_a forfeiture_n a_o act_n to_o retain_v the_o subject_n of_o the_o say_v late_a queen_n in_o their_o due_a obedience_n it_o be_v hand_n and_o seal_n of_o all_o five_o reside_v within_o the_o say_a county_n or_o liberty_n county_n residence_n in_o the_o county_n these_o word_n seem_v to_o refer_v as_o well_o to_o the_o bishop_n and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o this_o restriction_n to_o the_o county_n or_o liberty_n where_o the_o party_n who_o be_v to_o assent_n reside_v and_o hold_v as_o well_o in_o the_o case_n of_o the_o bishop_n or_o lieutenant_n as_o of_o any_o deputy_n lieutenant_n reside_v out_o of_o the_o county_n licence_n particular_a cause_n of_o the_o licence_n the_o particular_a cause_n of_o the_o say_a licence_n in_o maxfields_n case_n mistake_n and_o that_o such_o a_o exception_n may_v be_v move_v but_o the_o plea_n not_o disallow_v for_o that_o reason_n oath_n one_o justice_n may_v give_v the_o recusant_n his_o oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o mr._n shepherd_n think_v that_o no_o less_o than_o two_o of_o the_o four_o justice_n of_o peace_n can_v minister_v this_o oath_n to_o the_o recusant_n sure_a guide_n cap._n 14._o sect._n 5._o but_o i_o take_v it_o to_o be_v clear_a that_o any_o one_o of_o the_o four_o justice_n may_v minister_v the_o oath_n in_o this_o case_n and_o there_o be_v a_o great_a difference_n between_o any_o justice_n for_o that_o denote_v the_o plural_a number_n as_o in_o the_o subsequent_a clause_n about_o armour_n where_o any_o justice_n may_v imprison_v the_o offender_n that_o be_v any_o two_o justice_n or_o more_o and_o any_o of_o the_o justice_n as_o here_o which_o denote_v the_o singular_a number_n and_o the_o follow_a word_n who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o may_v be_v well_o enough_o apply_v to_o any_o one_o justice_n of_o peace_n that_o he_o have_v true_o inform_v disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z corporal_z sergeant_z ancient-bearer_n or_o other_o office_n in_o camp_n troup_n band_n or_o company_n of_o soldier_n nor_o shall_v be_v captain_n master_n governor_z or_o bear_v any_o office_n or_o charge_n of_o or_o in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n but_o be_v utter_o dissable_v for_o the_o same_o and_o every_o person_n
