such_o affair_n of_o this_o jurisdiction_n as_o shall_v be_v within_o their_o cognizance_n trust_v and_o power_n adjourn_v to_o dissolve_v or_o adjourn_v until_o they_o shall_v see_v cause_n to_o dissolve_v or_o adjourn_v the_o say_a court_n unto_o another_o time_n 3._o it_o be_v also_o order_v that_o beside_o the_o say_v fix_v court_n the_o governor_n or_o in_o his_o absence_n the_o deputy_n governor_n and_o in_o their_o absence_n occasion_n power_n to_o sum_n mon_fw-fr a_o general_n court_n on_o special_a occasion_n the_o great_a part_n of_o the_o magistrate_n of_o this_o jurisdiction_n shall_v have_v power_n to_o summon_v a_o general_n court_n either_o the_o whole_a body_n of_o freeman_n or_o their_o representative_n at_o any_o time_n as_o the_o urgent_a and_o extraordinary_a occasion_n of_o this_o jurisdiction_n or_o any_o part_n thereof_o may_v require_v and_o if_o any_o of_o the_o aforesaid_a magistrate_n or_o deputy_n shall_v without_o just_a cause_n either_o be_v absent_a at_o the_o first_o sit_v of_o any_o of_o the_o say_a general_n court_n whether_o ordinary_a or_o extraordinary_a licence_n fine_a for_o non-appearance_n or_o departure_n without_o licence_n or_o without_o leave_n depart_v or_o disorderly_o absent_v he_o or_o themselves_o from_o the_o service_n thereof_o before_o the_o court_n be_v finish_v he_o or_o they_o shall_v each_o of_o they_o neglect_n the_o fine_a shall_v be_v increase_v as_o the_o court_n upon_o due_a consideration_n of_o the_o offence_n contempt_n increase_v by_o contempt_n with_o the_o aggravation_n shall_v judge_v meet_a 4._o prory_n freeman_n liberty_n to_o send_v vote_n by_o prory_n and_o in_o regard_n that_o through_o age_n inability_n of_o body_n or_o urgency_n of_o occasion_n many_o of_o the_o freeman_n they_o when_o they_o be_v call_v and_o that_o whosoever_o of_o the_o freeman_n do_v not_o appear_v at_o election_n in_o parson_n or_o by_o proxy_n person_n and_o for_o non-free-man_n vote_v and_o free_a man_n put_v in_o more_o vote_n than_o one_o for_o one_o person_n he_o shall_v be_v for_o such_o neglect_n amerce_v to_o the_o treasury_n ten_o shilling_n and_o every_o freeman_n to_o put_v in_o his_o vote_n for_o the_o six_o assistant_n in_o one_o paper_n if_o any_o man_n put_v in_o a_o vote_n that_o be_v not_o a_o freeman_n or_o any_o freeman_n put_v in_o at_o one_o time_n more_o than_o qualification_n for_o deputy_n and_o other_o place_n of_o trust_n the_o like_a qualification_n be_v require_v in_o all_o such_o as_o be_v to_o be_v choose_v to_o be_v deputy_n or_o any_o other_o place_n of_o trust_n 6._o and_o forasmuch_o as_o some_o corrupt_a member_n may_v creep_v into_o the_o best_a and_o pure_a society_n who_o cause_n of_o disfranchise_v freeman_n and_o by_o who_o if_o any_o freeman_n of_o this_o corporation_n shall_v be_v discover_v to_o be_v notorious_o vicious_a or_o scandalous_a as_o common_a liar_n drunkard_n swearer_n apostate_n from_o the_o fundamental_o of_o religion_n or_o the_o like_a or_o do_v manifest_o appear_v to_o be_v disaffect_v to_o this_o government_n upon_o legal_a and_o due_a conviction_n of_o all_o or_o any_o of_o these_o it_o shall_v be_v the_o other_o half_a to_o the_o use_n of_o the_o colony_n this_o court_n take_v into_o their_o serious_a consideration_n the_o great_a damage_n that_o this_o colony_n and_o our_o neighbour_n be_v likely_a to_o sustain_v by_o the_o catch_n of_o mackerel_n with_o net_n and_o sanes_n at_o cape_n cod_n or_o elsewhere_o near_o any_o shoar_n in_o this_o colony_n to_o the_o great_a destruction_n of_o fish_n and_o to_o the_o discouragement_n of_o divers_a fisherman_n as_o be_v allege_v the_o court_n do_v therefore_o enact_v and_o be_v it_o hereby_o enact_v by_o the_o authority_n thereof_o that_o no_o person_n or_o person_n whatsoever_o after_o the_o publication_n hereof_o shall_v catch_v or_o draw_v on_o shore_n any_o mackerel_n with_o net_n or_o net_n net_n none_o to_o draw_v ashore_o mackrel_n with_o net_n sane_n or_o sanes_n in_o any_o part_n of_o this_o colony_n and_o if_o any_o person_n or_o person_n hereafter_o shall_v presume_v to_o catch_v any_o mackerel_n by_o set_v or_o shoot_v any_o net_n or_o sane_n such_o person_n so_o offend_v as_o aforesaid_a shall_v forfeit_v for_o he_o or_o their_o say_a offence_n all_o such_o net_n or_o sanes_n as_o shall_v be_v improve_v and_o all_o such_o mackerel_n as_o shall_v be_v catch_v by_o he_o or_o they_o and_o shall_v also_o forfeit_v every_o such_o vessel_n and_o all_o such_o vessel_n or_o boat_n as_o shall_v be_v employ_v therein_o whether_o catch_n sloop_n or_o boat_n as_o shall_v be_v employ_v in_o take_v or_o carry_v away_o any_o such_o fish_n if_o at_o any_o time_n the_o person_n so_o offend_v be_v take_v within_o this_o government_n or_o the_o value_n thereof_o one_o moiety_n to_o the_o colony_n and_o the_o other_o moiety_n to_o the_o informer_n that_o shall_v prosecute_v the_o same_o and_o for_o the_o better_a execution_n of_o the_o say_a law_n power_n shall_v be_v give_v by_o some_o one_o or_o more_o of_o the_o magistrate_n by_o warrant_n to_o some_o fit_a man_n to_o act_v as_o a_o water-bayliff_n to_o make_v seizure_n of_o all_o such_o forfeiture_n as_o aforesaid_a this_o act_n to_o stand_v till_o the_o court_n on_o some_o trial_n thereof_o shall_v see_v cause_n otherwise_o to_o order_n chap._n x._o highway_n 1._o order_v by_o this_o court_n and_o the_o authority_n thereof_o that_o where_o country_n roads_n be_v want_v through_o any_o township_n of_o this_o government_n or_o where_o there_o be_v way_n lay_v out_o and_o return_v to_o be_v record_v court_n highway_n in_o case_n to_o be_v lay_v out_o by_o indifferent_a man_n choose_v by_o the_o county_n court_n that_o be_v not_o to_o the_o satisfaction_n of_o the_o county_n court_n or_o where_o the_o two_o next_o town_n can_v agree_v about_o the_o same_o or_o where_o any_o town_n or_o particular_a person_n complain_v to_o the_o county_n court_n and_o have_v a_o pretence_n of_o great_a damage_n thereby_o in_o such_o case_n the_o county_n court_n shall_v appoint_v a_o committee_n of_o indifferent_a man_n or_o jury_n out_o of_o such_o town_n and_o the_o neighbour_n town_n who_o shall_v be_v upon_o oath_n to_o view_v say_v way_n and_o approve_v or_o disapprove_v thereof_o and_o lay_v out_o such_o way_n in_o such_o place_n and_o in_o such_o manner_n as_o may_v be_v most_o beneficial_a to_o the_o public_a and_o least_o prejudicial_a to_o particular_a person_n and_o make_v return_n of_o their_o do_n to_o the_o county_n court_n and_o the_o charge_n to_o be_v bear_v as_o the_o county_n court_n shall_v determine_v out_o town_n highway_n between_o neighbourhood_n how_o to_o be_v lay_v out_o 2._o ordered_n to_o give_v three_o day_n warn_v or_o their_o team_n when_o they_o be_v to_o work_v at_o the_o highway_n as_o often_o as_o need_v shall_v require_v not_o exceed_v six_o day_n in_o a_o year_n and_o every_o person_n orderly_o warn_v that_o neglect_v to_o appear_v or_o send_v a_o sufficient_a hand_n in_o his_o room_n shall_v pay_v two_o shilling_n six_o penny_n per_fw-la day_n each_o day_n they_o neglect_v and_o each_o day_n for_o a_o team_n five_o shilling_n for_o the_o town_n use_v to_o be_v levy_v by_o distress_n on_o the_o good_n of_o such_o as_o be_v delinquent_n by_o a_o warrant_n to_o the_o constable_n from_o any_o of_o the_o magistrate_n or_o selectmen_n where_o there_o be_v no_o magistrate_n near_o appearance_n penalty_n for_o non_fw-fr appearance_n to_o who_o the_o name_n of_o such_o delinquent_n shall_v be_v return_v by_o any_o of_o the_o surveior_n all_o allow_a inhabitant_n and_o person_n rateable_a to_o be_v warn_v and_o such_o householder_n that_o have_v not_o team_n and_o several_a in_o their_o family_n capable_a to_o work_v though_o not_o rateable_a highway_n how_o to_o work_v at_o highway_n such_o by_o approbation_n of_o the_o selectmen_n may_v be_v warn_v to_o send_v two_o ordered_n that_o the_o surveior_n if_o he_o see_v cause_n shall_v hire_v either_o man_n or_o team_n as_o occasion_n require_v for_o the_o say_a work_n and_o to_o be_v pay_v out_o of_o the_o fine_n aforesaid_a and_o that_o the_o surveior_n warn_v not_o any_o man_n or_o team_n twice_o to_o work_v on_o the_o highway_n before_o they_o have_v first_o go_v over_o all_o the_o person_n and_o team_n in_o the_o town_n once_o none_o to_o be_v warn_v to_o work_v twice_o till_o all_o have_v go_v over_o once_o as_o aforesaid_a and_o that_o each_o surveior_n give_v a_o account_n thereof_o to_o the_o surveior_n which_o shall_v succeed_v he_o for_o the_o next_o year_n who_o shall_v begin_v to_o warn_v where_o the_o other_o leave_v off_o neglect_n penalty_n of_o surveyor_n neglect_n 5._o ordered_n that_o every_o surveior_n that_o neglect_v his_o duty_n in_o repair_v the_o highway_n shall_v forfeit_v five_o pound_n to_o the_o county_n use_v work_v those_o warn_v when_o to_o appear_v and_o what_o time_n to_o work_v 6._o ordered_n that_o those_o warn_v to_o work_v on_o the_o highway_n as_o aforesaid_a shall_v appear_v at_o the_o place_n appoint_v according_a to_o the_o surveiors_n order_n with_o their_o cart_n and_o themselves_o fit_v with_o tool_n and_o instrument_n suitable_a to_o the_o work_n by_o the_o hour_n of_o nine_o in_o the_o morning_n and_o work_v till_o four_o at_o evening_n allow_v the_o space_n of_o one_o hour_n at_o noon_n for_o refreshment_n man_n surveior_n to_o give_v a_o account_n to_o the_o select_a man_n 7._o ordered_n that_o the_o surveior_n do_v at_o the_o end_n of_o their_o year_n give_v a_o account_n of_o their_o act_n and_o what_o money_n of_o the_o town_n may_v be_v in_o their_o hand_n unto_o the_o selectmen_n of_o the_o respective_a town_n or_o such_o other_o as_o the_o town_n shall_v appoint_v for_o that_o affair_n or_o be_v liable_a to_o a_o suit_n to_o be_v prosecute_v against_o they_o by_o the_o selectmen_n on_o the_o town_n account_v 8._o the_o court_n take_v into_o consideration_n the_o inconvenience_n likely_a to_o ensure_v jury_n country-high_a way_n to_o be_v lay_v out_o by_o a_o jury_n by_o person_n erect_v fence_n gate_n or_o bar_n athwart_o county_n highway_n to_o the_o annoyance_n of_o traveller_n do_v therefore_o enact_v and_o be_v it_o hereby_o enact_v that_o all_o necessary_a county_n highway_n within_o this_o colony_n shall_v between_o this_o time_n and_o the_o next_o october_n court_n be_v lay_v out_o by_o a_o jury_n where_o it_o be_v not_o already_o so_o do_v penalty_n and_o a_o account_n thereof_o with_o the_o bound_n present_v to_o the_o town_n clerk_n on_o penalty_n at_o the_o charge_n of_o the_o respective_a town_n through_o who_o land_n on_o township_n such_o way_n may_v lead_v colony_n meet_v together_o to_o walk_v about_o in_o the_o night_n to_o drink_v revel_v or_o pilfer_n the_o same_o tend_v to_o the_o corrupt_a and_o debauch_v of_o the_o youth_n and_o many_o offend_v and_o prejudice_v the_o peaceable_a inhabitant_n of_o the_o several_a town_n for_o prevention_n whereof_o nightwalker_n of_o nightwalker_n it_o be_v order_v by_o this_o court_n and_o the_o authority_n thereof_o that_o all_o person_n walk_v in_o the_o field_n or_o street_n after_o nine_o or_o ten_o a_o clock_n at_o night_n unless_o know_v peaceable_a and_o orderly_a inhabitant_n shall_v be_v
