of_o english_a parent_n but_o now_o a_o inhabitant_n of_o suratt_n in_o the_o east_n indies_n be_v at_o fourteen_o year_n of_o age_n marry_v on_o the_o 16_o of_o november_n 1680._o according_a to_o the_o rite_n and_o ceremony_n of_o the_o church_n of_o england_n to_o henry_n smith_n accountant_a to_o the_o honourable_a the_o east_n india_n company_n in_o the_o island_n of_o bombay_n where_o she_o than_o live_v and_o afterward_o cohabit_v with_o he_o as_o his_o wife_n till_o the_o 27_o of_o april_n 1684._o at_o which_o time_n the_o aforesaid_a henry_n be_v send_v over_o into_o england_n by_o precedent_n child_n for_o some_o ill_a practice_n there_o and_o leave_v the_o say_v susannah_n his_o wife_n big_a with_o child_n which_o die_v quick_o after_o its_o birth_n at_o the_o time_n of_o his_o departure_n from_o india_n the_o say_a henry_n take_v not_o the_o least_o care_n for_o the_o maintenance_n of_o his_o say_a wife_n nor_o have_v he_o ever_o since_o send_v for_o she_o over_o into_o england_n to_o he_o or_o return_v she_o any_o money_n for_o she_o support_v and_o since_o the_o year_n 1687._o have_v neither_o write_v to_o she_o or_o give_v she_o the_o least_o information_n of_o himself_o or_o he_o concern_v in_o the_o year_n 1690._o the_o aforesaid_a henry_n smith_n do_v in_o the_o church_n of_o dukes-place_n london_n join_v himself_o in_o a_o pretend_a marriage_n with_o one_o susannah_n wycher_n by_o who_o he_o have_v have_v several_a child_n and_o with_o who_o he_o still_o cohabit_v as_o his_o wife_n susannah_n smith_n have_v certain_a information_n of_o the_o say_v pretend_a marriage_n do_v on_o the_o 19_o day_n of_o february_n last_o pass_v institute_v by_o her_o proxy_n a_o cause_n of_o divorce_n by_o reason_n of_o adultery_n against_o the_o say_a henry_n smith_n in_o the_o court_n of_o the_o right_n reverend_a father_n in_o god_n henry_n lord_n bishop_n of_o london_n in_o which_o court_n upon_o full_a proof_n of_o the_o premise_n she_o do_v on_o the_o 18_o day_n of_o june_n follow_v obtain_v a_o sentence_n of_o divorce_n from_o the_o aforesaid_a henry_n smith_n and_z according_o now_o remain_v divorce_v without_o any_o appeal_n by_o he_o interpose_v whereupon_o the_o aforesaid_a susannah_n smith_n do_v most_o humble_o request_v that_o a_o bill_n may_v pass_v this_o most_o honourable_a house_n for_o the_o secure_n and_o indempnify_v she_o from_o all_o pain_n penalty_n etc._n etc._n which_o she_o or_o her_o issue_n may_v incur_v in_o case_n she_o shall_v happen_v to_o contract_n marriage_n with_o any_o person_n not_o otherwise_o by_o law_n prohibit_v during_o the_o life-time_n of_o the_o aforesaid_a henry_n smith_n reason_n humble_o offer_v for_o the_o pass_v the_o say_a bill_n i._o have_v consult_v several_a very_o eminent_a and_o learned_a divine_n she_o have_v be_v assure_v by_o they_o that_o there_o be_v nothing_o in_o the_o law_n of_o god_n prohibit_v a_o second_o marriage_n the_o lawfulness_n whereof_o as_o they_o inform_v she_o have_v be_v universal_o allow_v by_o all_o foreign_a protestant_n since_o the_o reformation_n ii_o she_o have_v be_v inform_v by_o her_o council_n learned_a in_o the_o law_n of_o this_o realm_n that_o the_o statute_n primo_n jacohi_n prohibit_v second_a marriage_n during_o each_o other_o life_n have_v a_o particular_a exception_n as_o to_o person_n legal_o divorce_v and_o likewise_o that_o the_o high_a court_n of_o parliament_n have_v pass_v act_n in_o favour_n of_o such_o second_o marriage_n iii_o have_v advise_v with_o person_n skilled_a in_o the_o civil_a law_n they_o tell_v she_o that_o such_o marriage_n have_v be_v all_o along_o allow_v by_o that_o law_n under_o emperor_n that_o be_v christian_n iv_o as_o to_o the_o canon_n law_n she_o have_v likewise_o be_v inform_v that_o till_o the_o council_n of_o trent_n which_o be_v never_o receive_v even_o by_o papist_n themselves_o on_o this_o side_n the_o alps_o those_o canon_n which_o have_v be_v make_v against_o such_o marriage_n have_v be_v general_o advice_n and_o counsel_n rather_o than_o express_v prohibition_n and_o that_o the_o canon_n of_o the_o church_n of_o england_n be_v not_o declaratory_a of_o any_o unlawfulness_n in_o such_o second_o marriage_n but_o only_o prohibit_v they_o upon_o penalty_n of_o a_o bond_n give_v at_o the_o time_n of_o pass_v the_o sentence_n of_o divorce_n and_o likewise_o desertion_n leave_v she_o among_o infidel_n big_a with_o child_n without_o money_n and_o take_v no_o care_n for_o her_o relief_n afterward_o his_o second_o marriage_n by_o which_o his_o life_n be_v forfeit_v to_o the_o law_n his_o have_v several_a child_n by_o that_o second_o marriage_n the_o impossibility_n of_o any_o reconciliation_n to_o be_v make_v between_o he_o and_o she_o not_o only_o on_o account_n of_o cruelty_n desertion_n and_o adultery_n but_o of_o his_o present_a wife_n and_o child_n which_o he_o ought_v to_o maintain_v her_o have_v no_o issue_n by_o he_o who_o may_v otherwise_o be_v prejudice_v by_o her_o re-marriage_n and_o last_o there_o be_v no_o alimony_n assign_v she_o by_o the_o sentence_n of_o divorce_n so_o that_o she_o can_v have_v no_o prospect_n of_o any_o maintenance_n from_o he_o for_o ever_o wherefore_o she_o humble_o hope_n that_o in_o consideration_n of_o the_o premise_n which_o be_v such_o in_o this_o case_n as_o may_v never_o probable_o happen_v in_o another_o this_o most_o honourable_a house_n will_v be_v please_v to_o relieve_v she_o by_o pass_v the_o bill_n she_o now_o most_o humble_o offer_v to_o their_o lordship_n
