more_o of_o they_o have_v hereby_o power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v their_o duty_n such_o fine_a or_o fine_n as_o to_o they_o shall_v be_v think_v fit_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o and_o their_o good_n provide_v that_o no_o fine_a to_o be_v impose_v by_o any_o of_o the_o say_a commissioner_n shall_v for_o any_o one_o offence_n exceed_v the_o sum_n of_o twenty_o pound_n and_o that_o all_o fine_n that_o shall_v be_v impose_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o respective_a receivers-general_n and_o by_o they_o to_o the_o receipt_n of_o his_o majesty_n exchequer_n same_o collector_n and_o subcollector_n receive_v money_n and_o not_o pay_v the_o same_o and_o it_o be_v further_o enact_v and_o declare_v that_o if_o any_o collector_n or_o sub-collector_n that_o shall_v by_o virtue_n of_o this_o act_n be_v appoint_v for_o the_o receipt_n of_o any_o sum_n or_o sum_n of_o money_n thereby_o to_o be_v assess_v shall_v neglect_v or_o refuse_v to_o pay_v any_o sum_n or_o sum_n of_o money_n which_o shall_v by_o he_o be_v receive_v as_o aforesaid_a and_o not_o pay_v the_o same_o as_o in_o and_o by_o this_o act_n be_v direct_v and_o shall_v detain_v in_o his_o or_o their_o hand_n any_o money_n receive_v by_o they_o or_o any_o of_o they_o and_o not_o pay_v the_o same_o as_o by_o this_o act_n be_v direct_v the_o commissioner_n of_o each_o county_n city_n or_o town_n respective_o or_o any_o two_o or_o more_o of_o they_o in_o their_o respective_a division_n be_v hereby_o authorize_v and_o empower_v to_o imprison_v the_o person_n and_o seize_v and_o secure_v the_o estate_n both_o real_a and_o personal_a of_o such_o collector_n or_o sub-collector_n to_o they_o respective_o belong_v or_o which_o shall_v descend_v or_o come_v into_o the_o hand_n or_o possession_n of_o their_o heir_n executor_n or_o administrator_n wherever_o the_o same_o can_v be_v discover_v and_o find_v and_o the_o say_a commissioner_n who_o shall_v so_o seize_v and_o secure_v the_o estate_n of_o any_o collector_n or_o sub-collector_n shall_v be_v and_o be_v hereby_o empower_v to_o appoint_v a_o time_n for_o the_o general_a meeting_n of_o the_o commissioner_n of_o such_o county_n city_n or_o town_n and_o there_o to_o cause_v public_a cause_n aforesaid_a seize_v and_o secure_v or_o any_o part_n of_o they_o and_o satisfy_v and_o pay_v such_o county_n and_o place_n the_o sum_n that_o shall_v be_v so_o detain_v in_o the_o hand_n of_o such_o collector_n or_o sub-collector_n and_o return_v the_o overplus_n deduct_v necessary_a charge_n to_o such_o collector_n or_o sub-collector_n their_o heir_n executor_n and_o administrator_n respective_o act._n collector_n and_o subcollector_n to_o be_v call_v to_o give_v a_o account_n to_o the_o commissioner_n at_o the_o expiration_n of_o this_o act._n and_o it_o be_v hereby_o further_o enact_v and_o declare_v that_o at_o the_o expiration_n of_o the_o respective_a time_n in_o this_o act_n prescribe_v for_o the_o full_a payment_n of_o the_o say_v quarterly_a assessment_n the_o several_a and_o respective_a commissioner_n or_o any_o two_o of_o they_o within_o their_o division_n and_o hundred_o shall_v and_o be_v hereby_o require_v to_o call_v before_o they_o the_o chief_a collector_n and_o subcollector_n within_o each_o respective_a division_n and_o hundred_o to_o examine_v and_o assure_v themselves_o of_o the_o full_a and_o whole_a payment_n of_o the_o particular_a sum_n and_o sum_n of_o money_n charge_v upon_o the_o say_a division_n hundred_o and_o every_o parish_n and_o place_n therein_o and_o of_o the_o due_a return_n of_o the_o same_o into_o the_o hand_n of_o the_o receivers-general_n of_o the_o say_a county_n city_n town_n and_o place_n respective_o and_o by_o such_o receiver-general_n to_o the_o receipt_n of_o his_o majesty_n exchequer_n to_o the_o end_n there_o may_v be_v no_o failer_z in_o the_o payment_n of_o any_o part_n of_o the_o assessment_n by_o virtue_n of_o this_o act_n to_o be_v assess_v and_o pay_v nor_o any_o arrears_n remain_v chargeable_a upon_o any_o the_o say_a county_n city_n town_n or_o place_n respective_o and_o in_o case_n of_o any_o faileriâ—n_n the_o premise_n the_o say_a commissioner_n or_o any_o two_o of_o they_o be_v hereby_o to_o cause_v the_o same_o to_o be_v forthwith_o levy_v and_o pay_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n vote_n commissioner_n concern_v in_o any_o controversy_n to_o withdraw_v and_o not_o vote_n and_o it_o be_v hereby_o enact_v and_o declare_v that_o in_o case_n any_o controversy_n arise_v concern_v the_o say_a assessment_n or_o the_o divide_n apportion_v or_o payment_n thereof_o which_o concern_v any_o of_o the_o commissioner_n by_o this_o act_n appoint_v that_o the_o commissioner_n so_o concern_v in_o the_o say_a controversy_n shall_v have_v no_o voice_n but_o shall_v withdraw_v at_o the_o time_n of_o the_o debate_n of_o any_o such_o controversy_n until_o it_o be_v determine_v by_o the_o rest_n of_o the_o commissioner_n rent_n no_o exemption_n of_o any_o privilege_a place_n or_o person_n fee-farm_n rent_n and_o be_v it_o hereby_o enact_v and_o declare_v that_o no_o privilege_a place_n or_o person_n body_n politic_a or_o corporate_a within_o the_o county_n city_n and_o town_n aforesaid_a shall_v be_v exempt_v from_o the_o say_a assessment_n and_o tax_n and_o that_o they_o and_o every_o of_o they_o and_o also_o all_o fée-farm_n rent_n and_o all_o other_o manner_n of_o rent_n payment_n sum_n of_o money_n and_o annuity_n issue_v out_o of_o any_o land_n within_o city_n or_o county_n shall_v be_v liable_a towards_o the_o payment_n of_o every_o sum_n by_o this_o act_n to_o be_v tax_v and_o levy_v and_o all_o the_o tenant_n of_o every_o fée-farm_n rent_n other_o rent_n sum_n of_o money_n or_o annuity_n aforesaid_a be_v hereby_o direct_v and_o authorise_v to_o pay_v they_o proportionable_o according_a to_o the_o rate_n and_o assessment_n by_o this_o act_n appoint_v and_o direct_v and_o all_o such_o tenant_n or_o westminster_n or_o any_o hospital_n for_o or_o in_o respect_n of_o the_o scites_n of_o the_o say_a college_n or_o hall_n or_o hospital_n nor_o any_o master_n fellow_n or_o scholar_n of_o any_o such_o college_n or_o hall_n or_o in_o any_o other_o free-schoole_n or_o any_o reader_n officer_n or_o minister_n of_o the_o say_a university_n college_n or_o school_n or_o of_o any_o hospital_n or_o almshouse_n for_o or_o in_o respect_n of_o any_o stipend_n wage_n or_o profit_n whatsoever_o arise_v or_o grow_v due_a to_o they_o in_o respect_n of_o the_o say_v several_a place_n and_o employment_n in_o the_o say_a university_n college_n school_n hospital_n or_o almshouse_n nor_o to_o charge_v any_o of_o the_o house_n or_o land_n belong_v to_o christ_n hospital_n saint_n bartholomewes_n bridewell_n saint_n thomas_n and_o bethlehem_n hospital_n
into_o and_o forth_o of_o the_o say_a fen_n and_o every_o of_o they_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a trustée_n undertaker_n the_o power_n of_o the_o say_a trustee_n and_o undertaker_n their_o heir_n and_o assign_v or_o the_o survivor_n of_o they_o for_o the_o better_a dreyn_v and_o keep_v dry_a of_o the_o aforesaid_a fen_n shall_v and_o may_v at_o their_o will_n and_o pleasure_n desert_n or_o maintain_v and_o continue_v all_o such_o dreyn_n as_o now_o be_v in_o the_o say_a fen_n or_o any_o of_o they_o at_o the_o old_a or_o accustomable_a wideness_n and_o breadth_n or_o otherwise_o enlarge_v the_o same_o at_o their_o will_n and_o pleasure_n within_o the_o say_a fen_n and_o likewise_o may_v at_o their_o will_n and_o at_o such_o time_n or_o time_n as_o two_o commissioner_n of_o sewer_n for_o the_o part_n of_o holland_n shall_v judge_v seasonable_a and_o necessary_a for_o the_o dreyn_v of_o their_o in-ground_n to_o be_v make_v within_o the_o say_a fen_n for_o the_o defence_n and_o preservation_n of_o the_o same_o other_o than_o the_o bank_n call_v the_o dozen_o and_o the_o bank_n call_v hawthorne-bank_n to_o the_o surround_v or_o annoyance_n of_o the_o say_a fen_n or_o any_o part_n of_o they_o within_o their_o charge_n as_o aforesaid_a and_o the_o same_o be_v not_o amend_v by_o the_o say_a trustee_n their_o heir_n and_o assign_v or_o the_o survivor_n of_o they_o within_o ten_o day_n after_o such_o breach_n goole_n or_o overflow_a that_o then_o it_o shall_v and_o may_v be_v lawful_a to_o and_o that_o then_o every_o such_o person_n so_o offend_v and_o thereof_o lawful_o convict_v or_o condemn_v by_o any_o sufficient_a testimony_n witness_n or_o proof_n shall_v yield_v and_o pay_v for_o recompense_v thereof_o to_o the_o party_n so_o grieve_v or_o offend_v thereby_o his_o or_o their_o treble_a damage_n beside_o all_o cost_n of_o the_o suit_n and_o shall_v also_o forfeit_v and_o lose_v to_o the_o king_n majesty_n for_o every_o such_o default_n ten_o pound_n and_o nevertheless_o all_o and_o singular_a such_o writ_n process_n and_o precept_n so_o to_o be_v make_v for_o or_o upon_o aforesaid_a and_o also_o except_v the_o detestable_a and_o abominable_a vice_n of_o buggery_n commit_v with_o mankind_n or_o beast_n and_o also_o except_v all_o rape_n and_o carnal_a ravishment_n of_o pave_v the_o way_n and_o street_n to_o be_v levy_v by_o distress_n by_o warrant_n under_o the_o hand_n and_o seal_n of_o five_o or_o more_o of_o the_o other_o commissioner_n that_o shall_v be_v appoint_v for_o the_o pave_v and_o mend_v of_o the_o street_n and_o highway_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o hackney_n coachman_n so_o license_v coach_n the_o several_a rate_n allow_v for_o hackney_n coach_n shall_v presume_v to_o take_v for_o his_o hire_n in_o or_o about_o the_o city_n of_o london_n and_o westminster_n above_o the_o rate_n of_o ten_o shilling_n for_o a_o day_n reckon_v twelve_o hour_n to_o the_o day_n and_o by_o the_o hour_n not_o above_o eighteen_o penny_n for_o the_o first_o hour_n and_o twelve_o penny_n for_o every_o hour_n after_o and_o that_o no_o gentleman_n or_o other_o person_n shall_v pay_v from_o any_o of_o the_o inn_n of_o court_n or_o thereabouts_o to_o any_o part_n of_o st._n james_n or_o city_n of_o westminster_n except_o beyond_o tuttle-street_n above_o twelve_o penny_n and_o the_o same_o prize_n from_o the_o same_o place_n to_o the_o inn_n of_o court_n or_o place_n thereabouts_o and_o from_o any_o of_o the_o say_a inn_n of_o court_n or_o thereabouts_o to_o the_o royal-exchange_n twelve_o penny_n and_o if_o to_o the_o tower_n of_o london_n or_o to_o bishops-gate-stréet_n or_o aldgate_n pound_n and_o no_o more_o whereof_o fifty_o shilling_n shall_v be_v pay_v at_o or_o before_o the_o twenty_o six_o day_n of_o may_n one_o thousand_o six_o hundred_o sixty_o and_o two_o and_o the_o sum_n of_o five_o and_o twenty_o shilling_n at_o or_o upon_o the_o feast_n day_n of_o st._n michael_n the_o archangel_n next_o come_v and_o twenty_o five_o shilling_n at_o the_o feast_n of_o the_o nativity_n of_o our_o lord_n christ_n and_o from_o henceforward_o to_o be_v pay_v quarterly_o at_o the_o four_o most_o usual_a feast_n of_o the_o year_n by_o equal_a portion_n that_o be_v to_o say_v at_o the_o annunciation_n of_o the_o bless_a virgin_n st._n john_n the_o baptist_n st._n michael_n the_o archangel_n and_o the_o nativity_n of_o our_o lord_n christ_n which_o say_v sum_n and_o sum_n of_o money_n the_o say_a commissioner_n for_o the_o hackney-coache_n shall_v from_o time_n to_o time_n pay_v or_o cause_n to_o be_v pay_v to_o the_o commissioner_n appoint_v for_o the_o pave_v and_o amend_v of_o the_o street_n and_o highway_n within_o this_o bill_n contain_v or_o to_o such_o treasurer_n or_o receiver_n as_o they_o shall_v appoint_v and_o the_o say_a commissioner_n for_o hackney-coache_n shall_v likewise_o from_o time_n to_o time_n certify_v to_o the_o commissioner_n appoint_v for_o the_o pave_v of_o the_o street_n and_o highway_n the_o name_n and_o dwelling_n of_o all_o such_o person_n as_o they_o shall_v license_v to_o drive_v or_o keep_v hackney-coache_n together_o with_o the_o several_a figure_n or_o mark_v of_o distinction_n which_o be_v appoint_v to_o belong_v and_o be_v affix_v to_o the_o several_a coach_n to_o the_o intent_n that_o discovery_n may_v the_o better_o be_v make_v of_o any_o abuse_n that_o shall_v be_v commit_v if_o any_o shall_v presume_v to_o affix_v the_o figure_n or_o mark_n of_o distinction_n to_o any_o coach_n which_o belong_v of_o right_a to_o another_o and_o whereby_o the_o commissioner_n for_o the_o pave_v and_o amend_v the_o street_n and_o highway_n shall_v be_v enable_v to_o call_v the_o say_a commissioner_n for_o the_o hackney-coache_n to_o a_o true_a and_o due_a account_n and_o in_o case_n any_o overplus_n shall_v be_v of_o the_o money_n appoint_v by_o this_o act_n to_o be_v raise_v for_o the_o pave_v and_o mend_v the_o way_n and_o street_n as_o aforesaid_a than_o such_o overplus_n shall_v be_v employ_v towards_o the_o enlargement_n of_o such_o street_n or_o place_n as_o be_v to_o be_v enlarge_v by_o virtue_n of_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o load_n of_o hay_n street_n every_o load_n of_o hay_n and_o straw_n rate_v towards_o mend_v the_o street_n which_o from_o the_o first_o day_n of_o may_n one_o thousand_o six_o hundred_o sixty_o and_o two_o shall_v be_v bring_v and_o stand_v to_o be_v sell_v upon_o any_o the_o way_n hereby_o in_o this_o act_n express_v and_o adjudge_v fit_a to_o be_v new_o pave_v shall_v pay_v six_o penny_n for_o every_o load_n and_o likewise_o every_o cart_n of_o straw_n to_o be_v sell_v in_o the_o say_a place_n shall_v after_o the_o say_a day_n pay_v two_o penny_n which_o say_v sum_n shall_v be_v pay_v to_o the_o commissioner_n which_o shall_v be_v appoint_v for_o the_o pave_v and_o amend_v the_o highway_n and_o street_n or_o such_o as_o they_o shall_v appoint_v for_o and_o towards_o the_o pave_n of_o the_o street_n and_o highway_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o fine_n rent_n levy_v how_o the_o penalty_n upon_o this_o act_n may_v be_v levy_v forfeiture_n and_o penalty_n as_o shall_v grow_v due_a and_o payable_a to_o the_o say_a commissioner_n by_o this_o act_n shall_v be_v levy_v by_o distress_n upon_o the_o good_n and_o chattel_n of_o the_o offender_n or_o offender_n by_o warrant_n under_o the_o hand_n and_o seal_n of_o the_o commissioner_n or_o any_o five_o or_o more_o of_o they_o which_o shall_v be_v appoint_v by_o his_o majesty_n which_o shall_v be_v sell_v within_o fourtéen_a day_n and_o the_o overplus_n return_v to_o the_o owner_n and_o in_o default_n of_o distress_n or_o not_o payment_n the_o person_n or_o person_n so_o offend_v or_o neglect_v to_o pay_v shall_v lie_v in_o prison_n without_o bail_n or_o mainprize_n till_o he_o or_o they_o have_v pay_v such_o rent_n fine_a forfeiture_n and_o penalty_n as_o be_v due_a from_o he_o or_o they_o and_o the_o say_a commissioner_n for_o the_o street_n and_o way_n service_n the_o commissioner_n may_v appoint_v a_o treasurer_n clerk_n &_o other_o officer_n for_o the_o service_n or_o any_o five_o or_o more_o of_o they_o so_o meet_v as_o aforesaid_a be_v hereby_o empower_v to_o appoint_v a_o treasurer_n or_o collector_n and_o clerk_n to_o attend_v they_o or_o such_o other_o officer_n or_o officer_n as_o they_o shall_v find_v necessary_a for_o the_o carry_v on_o of_o the_o say_a service_n with_o such_o moderate_a allowance_n as_o shall_v be_v fit_a and_o in_o case_n any_o person_n shall_v propose_v to_o carry_v away_o the_o ash_n dirt_n and_o other_o filth_n for_o all_o or_o any_o the_o place_n aforesaid_a at_o less_o rate_n then_o the_o yearly_a raker_n or_o undertaker_n can_v or_o will_v perform_v the_o same_o the_o say_a commissioner_n shall_v have_v power_n and_o be_v hereby_o authorize_v to_o contract_v with_o such_o person_n and_o for_o such_o term_n as_o they_o shall_v think_v fit_a and_o they_o be_v also_o to_o require_v a_o account_n from_o time_n to_o time_n of_o all_o scavenger_n within_o the_o say_a place_n and_o all_o other_o person_n or_o person_n that_o shall_v receive_v or_o disburse_v any_o money_n for_o the_o purpose_n in_o this_o bill_n contain_v street_n and_o may_v hear_v and_o determine_v all_o difference_n about_o pave_v and_o cleanse_v the_o street_n as_o often_o as_o they_o or_o any_o five_o or_o more_o of_o they_o so_o meet_v as_o aforesaid_a shall_v think_v fit_v and_o necessary_a and_o shall_v hear_v and_o determine_v all_o dispute_n and_o difference_n concern_v the_o right_a and_o duty_n of_o pave_v and_o keep_v clean_o any_o of_o the_o street_n lane_n or_o ally_n or_o public_a yard_n within_o the_o place_n aforesaid_a raker_n the_o power_n &_o duty_n of_o scavenger_n and_o raker_n provide_v always_o that_o the_o respective_a scavenger_n raker_n or_o other_o undertaker_n shall_v have_v liberty_n by_o the_o approbation_n of_o the_o say_a commissioner_n or_o any_o five_o or_o more_o of_o they_o so_o meet_v as_o aforesaid_a to_o lodge_v their_o ash_n dust_n dirt_n or_o other_o filth_n in_o such_o vacant_a public_a place_n in_o or_o near_o the_o street_n or_o highway_n as_o shall_v be_v think_v convenient_a by_o the_o say_a
of_o the_o peace_n that_o the_o say_a justice_n of_o peace_n shall_v cause_v all_o the_o say_a account_n of_o the_o several_a hearth_n and_o stove_n within_o the_o respective_a county_n to_o be_v enrol_v by_o the_o clerk_n of_o the_o peace_n of_o the_o say_v respective_a county_n riding_n in_o yorkshire_n and_o division_n in_o lincolnshire_n and_o also_o a_o duplicate_v thereof_o in_o parchment_n under_o the_o hand_n and_o seal_n of_o three_o or_o more_o of_o the_o justice_n of_o peace_n of_o the_o respective_a county_n and_o place_n aforesaid_a who_o be_v hereby_o require_v to_o sign_n the_o same_o to_o be_v return_v into_o his_o majesty_n court_n of_o exchequer_n within_o one_o month_n next_o after_o such_o account_n deliver_v unto_o they_o at_o their_o respective_a quarter-session_n aforesaid_a upon_o pain_n that_o the_o clerk_n of_o the_o peace_n of_o every_o such_o county_n ride_v or_o division_n respective_o offend_v therein_o shall_v forfeit_v to_o his_o majesty_n his_o heir_n and_o successor_n the_o sum_n of_o two_o hundred_o pound_n for_o the_o first_o month_n and_o for_o the_o second_o month_n he_o shall_v so_o neglect_v every_o such_o clerk_n of_o the_o peace_n shall_v forfeit_v and_o lose_v his_o or_o their_o place_n and_o office_n and_o the_o same_o shall_v become_v void_a according_o which_o forfeiture_n and_o penalty_n shall_v be_v recover_v and_o levy_v as_o this_o act_n direct_v and_o to_o the_o intent_n that_o the_o revenue_n hereby_o arise_v to_o his_o majesty_n exchequer_n how_o the_o money_n arise_v shall_v be_v collect_v receive_v and_o pay_v into_o the_o exchequer_n may_v from_o time_n to_o time_n be_v pay_v into_o his_o exchequer_n with_o as_o little_a charge_n as_o may_v be_v be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a treasurer_n and_o other_o officer_n of_o the_o inn_n of_o court_n inn_n of_o chancery_n college_n and_o other_o society_n aforesaid_a within_o their_o respective_a jurisdiction_n and_o the_o several_a petty-constable_n tithing-man_n head-borough_n and_o such_o other_o officer_n within_o the_o respective_a limit_n liberty_n and_o jurisdiction_n shall_v every_o half_a year_n within_o six_o day_n after_o the_o say_a duty_n shall_v grow_v due_a as_o aforesaid_a collect_v gather_v and_o receive_v the_o same_o from_o the_o several_a occupier_n of_o the_o say_a hearth_n and_o stove_n and_o upon_o payment_n thereof_o shall_v give_v several_a acquittance_n without_o take_v any_o thing_n for_o such_o acquittance_n unto_o the_o several_a person_n who_o shall_v pay_v the_o same_o and_o that_o such_o acquittance_n shall_v be_v a_o full_a and_o perfect_a discharge_n to_o every_o such_o person_n who_o shall_v pay_v the_o same_o against_o his_o majesty_n his_o heir_n and_o successor_n so_o that_o no_o person_n who_o shall_v have_v such_o acquittance_n shall_v be_v molest_v sue_v or_o vex_v or_o put_v to_o any_o charge_n in_o his_o majesty_n court_n of_o exchequer_n or_o else_o where_o payment_n distress_n and_o sale_n of_o good_n in_o default_n of_o payment_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n any_o person_n who_o be_v hereby_o charge_v or_o intend_v to_o be_v charge_v to_o pay_v any_o sum_n or_o sum_n of_o money_n as_o aforesaid_a shall_v refuse_v or_o neglect_v to_o pay_v the_o same_o that_o then_o every_o person_n or_o person_n who_o be_v hereby_o authorize_v to_o collect_v the_o same_o shall_v and_o may_v levy_v the_o same_o by_o distress_n and_o sale_n of_o the_o good_n of_o the_o person_n and_o person_n so_o refuse_v or_o neglect_v render_v unto_o the_o say_a person_n and_o person_n the_o overplus_n of_o such_o money_n as_o shall_v remain_v in_o their_o hand_n by_o the_o say_a sale_n after_o the_o say_a duty_n and_o necessary_a charge_n of_o levy_v the_o same_o be_v discharge_v as_o aforesaid_a duty_n the_o duty_n of_o constable_n treasurer_n and_o officer_n impower_v to_o collect_v the_o say_a duty_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o aforesaid_a constable_n treasurer_n and_o other_o officer_n who_o be_v hereby_o authorize_v to_o collect_v the_o aforesaid_a duty_n shall_v within_o twenty_o day_n next_o after_o the_o aforesaid_a time_n at_o which_o the_o say_a duty_n shall_v be_v due_a to_o his_o majesty_n as_o aforesaid_a pay_v unto_o the_o high_a constable_n of_o the_o several_a hundred_o and_o respective_a limit_n all_o such_o money_n as_o they_o shall_v receive_v for_o the_o aforesaid_a duty_n receive_v a_o acquittance_n without_o pay_v any_o thing_n for_o the_o same_o collect_v the_o allowance_n for_o collect_v and_o deduct_v two_o penny_n in_o the_o pound_n for_o their_o pain_n in_o collect_v the_o same_o and_o shall_v also_o then_o in_o write_v under_o his_o hand_n deliver_v unto_o the_o say_v high_a constable_n the_o name_n of_o the_o person_n of_o who_o they_o receive_v the_o same_o and_o also_o the_o name_n of_o such_o person_n who_o ought_v to_o have_v pay_v the_o respective_a duty_n yearly_o charge_v upon_o they_o and_o have_v not_o pay_v the_o same_o where_o no_o distress_n can_v be_v have_v sheriff_n within_o what_o time_n the_o money_n ought_v to_o be_v pay_v to_o the_o high_a sheriff_n and_o be_v it_o further_o enact_v that_o the_o high_a constable_n of_o the_o several_a hundred_o and_o respective_a limit_n shall_v within_o ten_o day_n next_o after_o their_o several_a receipt_n from_o the_o say_a constable_n headborough_n tithingman_n and_o other_o officer_n pay_v unto_o the_o high_a sheriff_n of_o every_o county_n all_o such_o money_n as_o they_o shall_v so_o receive_v deduct_v a_o penny_n in_o the_o pound_n for_o their_o pain_n and_o shall_v also_o then_o deliver_v or_o cause_n to_o be_v deliver_v unto_o the_o say_v high_a sheriff_n the_o several_a return_n which_o they_o receive_v from_o the_o constable_n and_o other_o officer_n aforesaid_a exchequer_n and_o when_o the_o high_a sheriff_n ought_v to_o pay_v the_o same_o into_o the_o exchequer_n and_o the_o respective_a sheriff_n shall_v within_o thirty_o day_n after_o he_o or_o they_o shall_v receive_v the_o say_a money_n from_o the_o respective_a collector_n return_v the_o same_o together_o with_o the_o name_n of_o such_o person_n who_o be_v defaulter_n and_o have_v no_o distress_n to_o be_v find_v into_o his_o majesty_n court_n of_o exchequer_n deduct_v four_o penny_n out_o of_o every_o twenty_o shilling_n and_o so_o after_o that_o rate_n whereof_o three_o penny_n to_o be_v for_o the_o sheriff_n own_o use_n as_o a_o reward_n of_o his_o pain_n in_o receive_v and_o return_v the_o same_o and_o one_o penny_n to_o be_v pay_v by_o the_o sheriff_n to_o the_o clerk_n of_o the_o peace_n for_o his_o pain_n to_o be_v recover_v by_o the_o say_a clerk_n of_o the_o peace_n by_o action_n of_o debt_n middlesex_n london_n middlesex_n provide_v always_o and_o be_v it_o enact_v that_o the_o high_a sheriff_n of_o london_n and_o middlesex_n for_o the_o time_n be_v for_o london_n and_o so_o much_o of_o the_o county_n of_o middelsex_n as_o lie_v within_o the_o bill_n of_o mortality_n other_o than_o the_o inn_n of_o court_n and_o chancery_n and_o the_o high_a sheriff_n of_o surrey_n for_o the_o time_n be_v for_o the_o burrow_n of_o southwark_n southwark_n surrey_n southwark_n and_o all_o other_o sheriff_n of_o any_o other_o city_n or_o town_n be_v a_o county_n of_o itself_o for_o such_o city_n and_o town_n respective_o shall_v be_v and_o be_v hereby_o make_v collector_n of_o and_o for_o the_o several_a duty_n arise_v within_o their_o several_a and_o respective_a limit_n for_o which_o end_n and_o purpose_n and_o in_o those_o place_n only_o the_o constable_n tithingman_n headborough_n and_o other_o officer_n shall_v deliver_v unto_o the_o sheriff_n of_o the_o city_n and_o place_n aforesaid_a duplicate_v of_o the_o same_o account_n of_o hearth_n and_o stove_n which_o the_o say_v constable_n headborough_n tithingman_n and_o other_o officer_n be_v appoint_v by_o this_o act_n to_o take_v from_o time_n to_o time_n and_o to_o deliver_v to_o the_o justice_n of_o peace_n to_o be_v enrol_v as_o aforesaid_a and_o the_o say_a sheriff_n of_o the_o city_n and_o place_n last_v before_o mention_v be_v hereby_o enable_v to_o levy_v the_o say_a duty_n and_o require_v to_o give_v acquittance_n without_o any_o fee_n as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n as_o in_o this_o act_n be_v appoint_v to_o be_v do_v by_o any_o other_o collector_n and_o the_o say_a sheriff_n shall_v from_o time_n to_o time_n within_o forty_o day_n after_o the_o say_a duty_n shall_v be_v payable_a by_o virtue_n of_o this_o to_o the_o end_n the_o same_o shall_v and_o may_v be_v by_o they_o employ_v and_o lay_v out_o bank_n south-dozens_a and_o hawthorn_n bank_n in_o and_o about_o the_o necessary_a maintenance_n and_o reparation_n of_o the_o bank_n above_o mention_v call_v the_o south_n dozen_o and_o hawthorne_n bank_n and_o so_o from_o time_n to_o time_n and_o at_o all_o time_n as_o the_o say_v one_o hundred_o pound_n or_o any_o part_n thereof_o shall_v be_v as_o abovesaid_a expend_v in_o and_o about_o the_o say_a bank_n as_o aforesaid_a if_o the_o same_o be_v not_o again_o supply_v by_o the_o say_a trustee_n their_o heir_n or_o assign_v or_o the_o survivor_n of_o they_o within_o six_o month_n then_o next_o follow_v than_o it_o shall_v be_v in_o the_o power_n of_o the_o say_a commissioner_n of_o sewer_n out_o of_o the_o rent_n issue_n and_o profit_n aforesaid_a to_o raise_v the_o same_o or_o so_o much_o thereof_o as_o shall_v not_o be_v supply_v as_o abovesaid_a from_o time_n to_o time_n and_o at_o all_o time_n as_o occasion_n shall_v require_v dreyn_v how_o meeting_n and_o by-law_n may_v be_v make_v for_o management_n of_o the_o dreyn_v provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o person_n and_o person_n their_o heir_n and_o assign_v or_o any_o three_o or_o more_o of_o they_o not_o have_v a_o reasonable_a excuse_n for_o such_o his_o default_n every_o person_n so_o make_v default_n shall_v pay_v unto_o his_o majesty_n double_v the_o sum_n of_o the_o rate_n he_o shall_v or_o ought_v to_o have_v be_v set_v at_o and_o moreover_o the_o say_a commissioner_n or_o any_o three_o or_o more_o of_o they_o shall_v have_v power_n by_o all_o lawful_a way_n and_o mean_n without_o oath_n to_o examine_v and_o inquire_v into_o the_o value_n and_o substance_n of_o such_o person_n chargeable_a by_o this_o act_n and_o to_o such_o rate_n or_o rate_n upon_o every_o such_o person_n or_o person_n as_o shall_v be_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n division_n head-collectors_a to_o be_v appoint_v in_o the_o several_a division_n and_o be_v it_o enact_v that_o the_o say_a commissioner_n or_o any_o three_o or_o more_o of_o they_o in_o their_o respective_a division_n or_o hundred_o shall_v and_o be_v hereby_o empower_v to_o nominate_v and_o appoint_v under_o their_o hand_n and_o seal_n a_o honest_a able_a and_o responsible_a person_n to_o be_v head-collector_n unto_o who_o the_o money_n receive_v by_o the_o sub-collector_n shall_v be_v due_o pay_v as_o aforesaid_a who_o receipt_n shall_v be_v a_o sufficient_a discharge_n unto_o every_o such_o sub-collector_n which_o sub-collector_n for_o gather_v the_o say_v particular_a sum_n receipt_n and_o the_o say_a receiver-general_n acquittance_n shall_v be_v a_o sufficient_a discharge_n unto_o every_o such_o head-collector_n who_o shall_v retain_v in_o his_o hand_n for_o every_o time_n prefix_v one_o penny_n in_o the_o pound_n and_o no_o more_o duplicate_v allowance_n for_o transcribe_v warrant_n and_o duplicate_v and_o for_o the_o careful_a writing_n and_o transcribe_v the_o say_a warrant_n estreat_n and_o duplicate_v in_o due_a time_n be_v it_o further_o enact_v that_o the_o commissioner_n clerk_n who_o shall_v respective_o perform_v the_o same_o shall_v by_o warrant_n under_o two_o or_o more_o of_o the_o commissioner_n hand_n have_v and_o receive_v from_o the_o respective_a head-collectors_a two_o penny_n in_o the_o pound_n of_o all_o such_o money_n as_o he_o shall_v have_v receive_v by_o virtue_n of_o such_o warrant_n and_o estreat_v who_o be_v hereby_o appoint_v and_o allow_v to_o pay_v the_o same_o according_o general_a payment_n by_o the_o head-collectors_a to_o the_o receiver_n general_a and_o be_v it_o further_o enact_v that_o if_o any_o head-collector_n shall_v not_o pay_v in_o to_o the_o receiver-general_a within_o the_o time_n limit_v by_o this_o act_n all_o sum_n of_o money_n by_o he_o receive_v by_o virtue_n of_o this_o act_n that_o then_o the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o be_v inform_v thereof_o be_v hereby_o empower_v and_o require_v to_o imprison_v every_o such_o head-collector_n and_o also_o to_o seize_v and_o secure_v the_o estate_n both_o real_a and_o personal_a of_o such_o head-collector_n or_o which_o shall_v from_o he_o descend_v or_o come_v into_o the_o hand_n or_o possession_n of_o his_o heir_n executor_n or_o administrator_n wherever_o the_o same_o can_v be_v discover_v or_o find_v and_o the_o say_a commissioner_n who_o shall_v so_o seize_v and_o secure_v the_o estate_n of_o any_o head-collector_n shall_v be_v and_o be_v hereby_o empower_v to_o appoint_v a_o time_n for_o the_o general_a meeting_n of_o the_o commissioner_n of_o such_o county_n city_n or_o town_n and_o there_o to_o cause_v public_a notice_n to_o be_v give_v at_o the_o place_n where_o such_o meeting_n shall_v be_v appoint_v ten_o day_n at_o least_o before_o such_o general_a meeting_n and_o the_o commissioner_n present_v at_o such_o general_a meeting_n or_o the_o major_a part_n of_o they_o in_o case_n the_o money_n detain_v by_o such_o head-collector_n be_v not_o pay_v or_o satisfy_v as_o aught_o to_o be_v according_a to_o the_o direction_n of_o this_o act_n shall_v and_o be_v hereby_o empower_v and_o require_v to_o sell_v and_o dispose_v of_o all_o such_o estate_n or_o any_o part_n of_o they_o which_o shall_v be_v for_o the_o cause_n aforesaid_a seize_v and_o thereby_o to_o secure_v and_o pay_v all_o the_o money_n in_o arrear_n in_o such_o head-collector_n hand_n for_o his_o majesty_n use_n and_o return_v the_o overplus_n deduct_v necessary_a charge_n to_o such_o head-collector_n his_o executor_n and_o administrator_n respective_o â—enalty_n â—enalty_n and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o pay_v the_o several_a sum_n and_o sum_n and_o proportion_n appoint_v by_o this_o act_n for_o such_o person_n to_o pay_v upon_o demand_n make_v by_o the_o officer_n or_o collector_n of_o the_o place_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v by_o the_o say_a commissioner_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o officer_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v for_o nonpayment_n thereof_o to_o distrain_v the_o person_n or_o person_n so_o refuse_v by_o his_o or_o their_o good_n or_o chattel_n and_o the_o distress_n so_o take_v to_o keep_v by_o the_o space_n of_o four_o day_n at_o the_o cost_n and_o charge_n of_o the_o owner_n thereof_o and_o if_o the_o say_a owner_n do_v not_o pay_v the_o sum_n of_o money_n due_a by_o this_o act_n within_o the_o say_v four_o day_n than_o the_o say_a distress_n to_o be_v apprize_v by_o three_o or_o two_o of_o the_o inhabitant_n where_o the_o say_a distress_n be_v take_v and_o there_o to_o be_v sell_v by_o the_o say_a officer_n for_o payment_n of_o the_o say_a money_n and_o the_o overplus_n come_v by_o the_o say_a sale_n if_o any_o be_v over_o and_o above_o the_o charge_n of_o take_v and_o keep_v the_o say_a distress_n to_o be_v immediate_o restore_v to_o the_o owner_n thereof_o and_o if_o any_o person_n or_o person_n assess_v by_o this_o act_n shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o twenty_o day_n after_o demand_n as_o aforesaid_a where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o same_o may_v be_v levy_v in_o every_o such_o case_n three_o or_o more_o of_o the_o commissioner_n by_o this_o act_n appoint_v for_o any_o such_o city_n county_n or_o place_n be_v hereby_o authorize_v by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o person_n or_o person_n to_o the_o common_a goal_n there_o to_o be_v keep_v without_o bail_n or_o mainprize_n until_o payment_n shall_v be_v make_v and_o if_o any_o person_n certify_v assess_v or_o rate_v find_v he_o or_o herself_o aggrieve_v with_o such_o assess_n or_o rate_v and_o do_v within_o ten_o day_n after_o demand_v to_o be_v employ_v in_o and_o towards_o the_o repair_n of_o the_o public_a building_n of_o the_o say_a city_n provide_v always_o that_o where_o any_o such_o offence_n shall_v be_v commit_v by_o any_o person_n or_o person_n of_o low_a and_o mean_a condition_n who_o the_o say_a justice_n or_o justice_n of_o the_o peace_n shall_v in_o his_o conscience_n believe_v to_o be_v unable_a to_o satisfy_v the_o say_a penalty_n that_o then_o and_o in_o such_o case_n the_o say_a justice_n or_o justice_n of_o the_o peace_n shall_v and_o may_v by_o order_n and_o warrant_v under_o he_o or_o their_o hand_n and_o seal_n cause_n such_o offender_n to_o be_v open_o whip_v near_o unto_o the_o place_n where_o the_o offence_n shall_v be_v commit_v till_o his_o body_n be_v bloody_a and_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a justice_n or_o justice_n of_o the_o peace_n to_o reward_v the_o say_a informer_n out_o of_o the_o pecuniary_a penalty_n to_o be_v incur_v according_a to_o the_o breast_n summer_n and_o other_o part_n of_o the_o first_o story_n to_o the_o front_n between_o the_o péer_v which_o be_v to_o be_v leave_v to_o the_o discretion_n of_o the_o builder_n to_o use_v substantial_a oaken_a timber_n in_o stead_n of_o brick_n or_o stone_n for_o conveniency_n of_o shop_n and_o that_o the_o say_v door_n breast_n summer_n and_o window-frames_a be_v sufficient_o discharge_v of_o the_o burden_n of_o the_o fabric_n by_o arch-work_n of_o brick_n or_o stone_n either_o straight_o or_o circular_a supervisor_n the_o duty_n of_o the_o surveyor_n and_o supervisor_n and_o be_v it_o enact_v that_o the_o say_a surveyor_n or_o supervisor_n so_o to_o be_v appoint_v as_o aforesaid_a and_o every_o of_o they_o within_o their_o several_a precinct_n shall_v take_v care_n that_o in_o building_n of_o all_o house_n within_o the_o say_a city_n and_o liberty_n thereof_o there_o be_v and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o there_o shall_v be_v party-wall_n and_o party-péers_a set_v out_o equal_o on_o each_o bvilder_n ground_n to_o be_v build_v up_o by_o the_o first_o beginner_n of_o such_o building_n and_o that_o convenient_a tothe_n be_v leave_v in_o the_o front-wall_n by_o the_o say_v first_o builder_n for_o the_o better_a join_v of_o the_o next_o house_n that_o shall_v be_v build_v to_o the_o same_o and_o that_o no_o man_n be_v permit_v by_o the_o say_a surveyor_n to_o build_v on_o the_o say_a party-wall_n or_o on_o his_o own_o contiguous_a ground_n until_o he_o have_v full_o reimburse_v the_o say_v first_o builder_n the_o full_a moiety_n of_o the_o charge_n of_o the_o say_a party-wall_n and_o péer_v together_o with_o interest_n for_o the_o same_o after_o the_o rate_n of_o six_o pound_n per_fw-la cent._n per_fw-la annum_fw-la for_o forbearance_n thereof_o to_o be_v account_v from_o the_o begin_n of_o the_o say_v first_o building_n bvilder_n who_o may_v determine_v difference_n between_o first_o and_o late_a bvilder_n and_o in_o case_n any_o difference_n shall_v arise_v between_o the_o first_o and_o late_a builder_n concern_v the_o true_a value_n of_o the_o say_a charge_n that_o then_o the_o same_o be_v refer_v to_o the_o alderman_n of_o that_o ward_n where_o such_o building_n shall_v be_v and_o to_o his_o deputy_n to_o mediate_v a_o agreement_n of_o such_o difference_n and_o where_o the_o say_a alderman_n and_o his_o deputy_n or_o one_o of_o they_o shall_v be_v party_n or_o where_o they_o can_v compose_v such_o difference_n as_o aforesaid_a that_o the_o matter_n be_v refer_v to_o the_o examination_n of_o the_o lord_n mayor_n and_o court_n of_o alderman_n who_o shall_v hear_v and_o final_o determine_v the_o same_o without_o any_o appeal_n to_o be_v have_v building_n house_n of_o the_o first_o and_o last_o sort_n of_o building_n and_o be_v it_o further_o enact_v that_o the_o say_a house_n of_o the_o first_o and_o least_o sort_n of_o building_n front_v by-stréet_n or_o lane_n as_o aforesaid_a shall_v be_v of_o two_o story_n high_a beside_o cellar_n and_o garret_n that_o the_o cellar_n thereof_o be_v six_o foot_n and_o a_o half_a high_a if_o the_o spring_n of_o water_n hinder_v not_o that_o the_o first_o story_n be_v nine_o foot_n high_a from_o the_o floor_n to_o the_o ceiling_n and_o the_o second_o story_n nine_o foot_n high_a from_o the_o floor_n to_o the_o first_o and_o less_o sort_n of_o building_n be_v one_o brick_n and_o a_o half_a as_o high_a as_o the_o say_a garret_n and_o that_o the_o thickness_n of_o the_o party-wall_n in_o the_o garret_n be_v
