apportion_v or_o payment_n thereof_o which_o concern_v any_o of_o the_o commissioner_n by_o this_o act_n appoint_v that_o the_o commissioner_n so_o concern_v in_o the_o say_a controversy_n shall_v have_v no_o voice_n but_o shall_v withdraw_v at_o the_o time_n of_o the_o debate_n of_o any_o such_o controversy_n until_o it_o be_v determine_v by_o the_o rest_n of_o the_o commissioner_n rent_n no_o exemption_n of_o any_o privilege_a place_n or_o person_n fee-farm_n rent_n and_o be_v it_o hereby_o enact_v and_o declare_v that_o no_o privilege_a place_n or_o person_n body_n politic_a or_o and_o appoint_v under_o their_o hand_n and_o seal_n a_o honest_a able_a and_o responsible_a person_n to_o be_v head-collector_n unto_o who_o the_o money_n receive_v by_o the_o sub-collector_n shall_v such_o notice_n as_o aforesaid_a or_o in_o compare_v the_o account_n with_o two_o substantial_a inhabitant_n as_o aforesaid_a shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n high-constable_n high-constable_n provide_v also_o that_o if_o any_o high-constable_n or_o other_o like_a officer_n as_o aforesaid_a shall_v neglect_v to_o compare_v the_o say_v original_a account_n and_o the_o say_a book_n or_o roll_n or_o to_o transmit_v the_o same_o in_o manner_n and_o time_n aforesaid_a he_o shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o pound_n all_o which_o before_o mention_v forfeiture_n and_o penalty_n shall_v be_v recover_v by_o action_n of_o debt_n bill_n plaint_n or_o information_n in_o any_o of_o his_o majesty_n court_n of_o record_n the_o one_o half_a to_o the_o use_n of_o his_o majesty_n the_o other_o half_o to_o the_o use_n of_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o remedy_v prejudice_n by_o charge_n of_o annual_a officer_n remedy_v and_o whereas_o his_o majesty_n say_v revenue_n settle_v by_o the_o aforesaid_a act_n have_v be_v much_o prejudice_v by_o annual_a change_n of_o petty_a constable_n headborough_n tythingman_n high-constable_n and_o sheriff_n to_o who_o the_o collect_v and_o receipt_n of_o his_o majesty_n say_v revenue_n be_v thereby_o entrust_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o the_o change_n of_o such_o annual_a officer_n or_o leave_v of_o their_o say_a office_n shall_v not_o excuse_v or_o disable_v any_o person_n who_o shall_v be_v constable_n headborough_z tythingman_n high-constable_n or_o sheriff_n at_o the_o time_n that_o any_o revenue_n or_o duty_n shall_v grow_v due_a or_o payable_a by_o the_o say_a act_n from_o collect_v distrain_v and_o receive_v respective_o such_o revenue_n or_o duty_n so_o grow_v due_a but_o that_o every_o such_o person_n in_o such_o case_n be_v hereby_o enable_v and_o require_v to_o do_v all_o thing_n respective_o as_o to_o such_o revenue_n or_o duty_n so_o grow_v due_a as_o if_o he_o have_v continue_v constable_n headborough_z tythingman_n high-constable_n or_o sheriff_n any_o thing_n in_o the_o say_a act_n to_o the_o contrary_a notwithstanding_o duty_n penalty_n for_o neglect_v to_o distrain_v receive_v or_o pay_v over_o the_o say_a duty_n provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n who_o by_o the_o say_v or_o this_o act_n aught_o to_o collect_v distrain_v for_o receive_v or_o pay_v over_o any_o the_o say_a revenue_n shall_v neglect_v or_o refuse_v to_o do_v his_o duty_n therein_o for_o every_o wéek_v he_o shall_v neglect_v or_o refuse_v he_o shall_v forfeit_v the_o sum_n of_o twenty_o shilling_n to_o be_v recover_v in_o manner_n and_o by_o such_o person_n or_o person_n as_o the_o aforesaid_a forfeiture_n by_o this_o act_n be_v to_o be_v recover_v distrain_v all_o person_n may_v be_v call_v in_o aid_n to_o distrain_v provide_v also_o and_o be_v it_o declare_v and_o enact_v by_o the_o authority_n aforesaid_a that_o in_o all_o case_n which_o by_o this_o or_o the_o aforesaid_a act_n any_o petty_a constable_n headborough_z or_o tythingman_n may_v enter_v into_o the_o house_n of_o any_o person_n or_o he_o may_v distrain_v the_o good_n of_o any_o person_n he_o may_v call_v to_o his_o aid_n any_o two_o sufficient_a inhabitant_n of_o the_o respective_a township_n or_o precinct_n who_o be_v hereby_o enjoin_v to_o assist_v he_o therein_o deputy_n sheriff_n appoint_a collector_n may_v make_v warrant_n from_o the_o respective_a justice_n of_o the_o peace_n and_o that_o every_o occupier_n of_o any_o house_n edifice_n lodging_n or_o chamber_n within_o any_o the_o respective_a inn_n of_o court_n inn_n of_o chancery_n college_n and_o society_n aforesaid_a shall_v do_v all_o thing_n and_o under_o the_o like_a penalty_n as_o be_v require_v by_o this_o act_n of_o any_o occupier_n of_o any_o house_n edifice_n lodging_n or_o chamber_n elsewhere_o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a westminster_n westminster_n that_o the_o high_a bailiff_n of_o westminster_n for_o the_o time_n be_v or_o his_o or_o their_o deputy_n or_o deputy_n may_v within_o the_o city_n and_o liberty_n of_o westminster_n from_o and_o after_o the_o eight_o and_o twenty_o day_n of_o september_n next_o collect_v and_o levy_v the_o say_a duty_n and_o put_v in_o execution_n all_o the_o power_n of_o the_o say_v former_a act_n and_o this_o present_a act_n as_o upon_o tweed_n at_o which_o conventicle_n meet_v or_o assembly_n there_o shall_v be_v five_o person_n or_o more_o assemble_v together_o over_z and_o above_o those_o of_o the_o same_o household_n then_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o two_o justice_n of_o the_o peace_n of_o the_o county_n offence_n the_o punishment_n and_o manner_n of_o proceed_v against_o they_o for_o the_o first_o offence_n limit_v division_n or_o liberty_n wherein_o the_o offence_n aforesaid_a shall_v be_v commit_v or_o for_o the_o chief_a magistrate_n of_o the_o place_n where_o such_o offence_n aforesaid_a shall_v be_v commit_v if_o it_o be_v within_o a_o corporation_n where_o there_o be_v not_o two_o justice_n of_o the_o peace_n and_o they_o be_v hereby_o require_v and_o enjoin_v upon_o proof_n to_o they_o or_o he_o respective_o make_v of_o such_o offence_n either_o by_o confession_n of_o the_o party_n or_o oath_n of_o witness_n or_o notorious_a evidence_n of_o the_o fact_n which_o oath_n the_o say_a justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o be_v hereby_o empower_v and_o require_v to_o administer_v to_o make_v a_o record_n of_o every_o such_o offence_n and_o offence_n under_o their_o hand_n and_o seal_n respective_o which_o record_n so_o make_v as_o aforesaid_a shall_v to_o all_o intent_n and_o purpose_n be_v in_o law_n take_v and_o adjudge_v to_o be_v a_o full_a and_o perfect_a conviction_n of_o every_o such_o offender_n for_o such_o offence_n and_o thereupon_o the_o say_a justice_n and_o chief_a magistrate_n respective_o shall_v commit_v every_o such_o offender_n so_o convict_v as_o aforesaid_a to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n for_o any_o time_n not_o exceed_a the_o space_n of_o three_o month_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_a five_o pound_n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v shall_v fine_a the_o say_a offender_n at_o for_o his_o or_o her_o say_a offence_n which_o money_n shall_v be_v pay_v to_o the_o churchwarden_n for_o the_o relief_n of_o the_o poor_a of_o the_o parish_n where_o such_o offender_n do_v last_o inhabit_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a offence_n the_o second_o offence_n that_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n contrary_a to_o this_o act_n and_o be_v thereof_o in_o manner_n aforesaid_a convict_v then_o such_o offender_n so_o convict_v of_o such_o second_o offence_n shall_v incur_v the_o penalty_n of_o imprisonment_n in_o the_o gaol_n or_o house_n of_o correction_n for_o any_o time_n not_o exceed_a six_o month_n without_o bail_n or_o mainprize_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_a ten_n pound_n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v thereunto_o authorize_v and_o require_v as_o aforesaid_a shall_v fine_a the_o say_a offender_n at_o for_o his_o or_o her_o say_v second_o offence_n the_o say_v fine_a to_o be_v dispose_v in_o manner_n aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a offence_n the_o three_o offence_n that_o if_o any_o such_o offender_n so_o convict_v of_o a_o second_o offence_n contrary_a to_o this_o act_n in_o manner_n aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n contrary_a to_o this_o act_n then_o any_o two_o justice_n of_o the_o peace_n and_o chief_a magistrate_n as_o aforesaid_a respective_o shall_v commit_v every_o such_o offender_n to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o the_o next_o general_n quarter_n session_n assizes_n gaol-delivery_n great_a session_n or_o sit_v of_o any_o commission_n of_o oyer_n and_o terminer_n in_o the_o respective_a county_n limit_v division_n or_o liberty_n which_o shall_v first_o happen_v when_o and_o where_o every_o such_o offender_n shall_v be_v proceed_v against_o by_o indictment_n for_o such_o offence_n and_o shall_v forthwith_o be_v arraign_v upon_o such_o indictment_n and_o shall_v then_o plead_v the_o general_n issue_n of_o not_o guilty_a and_o give_v any_o special_a matter_n in_o evidence_n or_o confess_v the_o indictment_n and_o if_o such_o offender_n proceed_v against_o shall_v be_v lawful_o convict_v of_o such_o offence_n either_o by_o confession_n or_o verdict_n or_o if_o such_o offender_n shall_v refuse_v to_o plead_v the_o general_n issue_n or_o to_o confess_v the_o indictment_n than_o the_o respective_a justice_n of_o the_o peace_n at_o their_o general_n quarter-session_n judge_n of_o assize_n and_o gaol-delivery_n at_o the_o assize_n and_o gaol-delivery_n justice_n of_o the_o great_a session_n at_o the_o great_a session_n and_o commissioner_n of_o oyer_n and_o terminer_n at_o their_o sit_v be_v hereby_o enable_v and_o require_v to_o cause_n judgement_n to_o be_v enter_v against_o such_o offender_n that_o such_o offender_n shall_v be_v transport_v beyond_o the_o sea_n to_o any_o of_o his_o majesty_n foreign_a plantation_n virginia_n and_o new-england_n only_o except_v there_o to_o remain_v seven_o year_n and_o shall_v forthwith_o under_o their_o hand_n and_o seal_n make_v out_o warrant_v to_o the_o sheriff_n or_o sheriff_n of_o the_o same_o county_n where_o such_o conviction_n or_o refusal_n to_o plead_v or_o to_o confess_v as_o aforesaid_a shall_v be_v safe_o to_o convey_v such_o offender_n to_o some_o port_n or_o haven_n near_a or_o most_o commodious_a to_o be_v appoint_v by_o they_o respective_o and_o from_o thence_o to_o embark_v such_o offender_n to_o be_v safe_o transport_v to_o any_o of_o his_o majesty_n plantation_n beyond_o the_o sea_n as_o shall_v be_v also_o by_o they_o respective_o appoint_v virginia_n and_o new-england_n only_o except_v whereupon_o the_o say_a sheriff_n shall_v safe_o convey_v and_o embark_v or_o cause_n to_o be_v convey_v and_o embark_v such_o offender_n to_o be_v transport_v as_o aforesaid_a under_o pain_n of_o forfeit_v for_o default_n of_o so_o transport_v every_o such_o offender_n the_o sum_n of_o forty_o pound_n of_o lawful_a money_n the_o one_o moiety_n thereof_o to_o the_o king_n &_o the_o other_o moiety_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o in_o any_o of_o the_o king_n court_n of_o record_n by_o bill_n plaint_n action_n of_o debt_n or_o information_n in_o any_o of_o which_o no_o wager_n of_o law_n essoign_n or_o protection_n shall_v be_v admit_v and_o the_o say_v respective_a court_n shall_v then_o also_o make_v out_o warrant_v to_o the_o several_a constable_n headborough_n or_o tythingman_n of_o the_o respective_a place_n where_o the_o estate_n real_a or_o personal_a of_o such_o offender_n so_o to_o be_v transport_v shall_v happen_v to_o be_v command_v they_o thereby_o to_o sequester_n into_o their_o hand_n the_o profit_n of_o the_o land_n and_o to_o distrain_v and_o sell_v the_o good_n of_o the_o offender_n so_o to_o be_v transport_v for_o the_o reimburse_n of_o the_o say_a sheriff_n all_o such_o reasonable_a charge_n as_o he_o shall_v be_v at_o and_o shall_v be_v allow_v he_o by_o the_o say_v respective_a court_n for_o such_o convey_v and_o embarque_a of_o such_o offender_n so_o to_o be_v transport_v render_v to_o the_o party_n or_o he_o or_o her_o assign_v the_o overplus_n of_o the_o same_o if_o any_o be_v unless_o such_o offender_n or_o some_o other_o on_o the_o behalf_n of_o such_o offender_n so_o to_o be_v transport_v shall_v give_v the_o sheriff_n such_o security_n as_o he_o shall_v approve_v of_o for_o the_o pay_v all_o the_o say_a charge_n unto_o he_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a transport_v how_o seditious_a sectary_n convict_v may_v be_v transport_v that_o in_o default_n of_o defray_v such_o charge_n by_o the_o party_n so_o to_o be_v transport_v or_o some_o other_o in_o their_o behalf_n or_o in_o default_n of_o security_n give_v to_o the_o sheriff_n as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o sheriff_n to_o contract_n with_o any_o master_n of_o a_o ship_n merchant_n or_o other_o person_n for_o the_o transport_v of_o such_o offender_n at_o the_o best_a rate_n he_o can_v and_o that_o in_o every_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o such_o person_n so_o contract_n with_o any_o sheriff_n for_o transport_v such_o offender_n as_o aforesaid_a to_o detain_v and_o employ_v every_o such_o offender_n so_o by_o they_o transport_v as_o a_o labourer_n to_o they_o or_o their_o assign_v for_o the_o space_n of_o five_o year_n to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o she_o be_v bind_v by_o indenture_n to_o such_o person_n for_o
subcollector_n of_o each_o parish_n or_o place_n which_o shall_v be_v appoint_v by_o virtue_n of_o this_o act_n shall_v upon_o the_o collection_n of_o the_o whole_a sum_n appoint_v to_o be_v collect_v by_o they_o and_o payment_n thereof_o as_o be_v hereby_o and_o before_o appoint_v have_v and_o receive_v for_o their_o pain_n in_o collect_v and_o pay_v the_o money_n one_o penny_n in_o the_o pound_n which_o the_o say_v several_a head-collector_n be_v hereby_o authorize_v to_o pay_v unto_o they_o and_o the_o several_a head-collector_n which_o shall_v be_v appoint_v by_o virtue_n of_o this_o act_n shall_v upon_o the_o payment_n of_o the_o whole_a sum_n due_a from_o their_o hundred_o or_o division_n to_o the_o receiver-general_n of_o each_o county_n have_v and_o receive_v for_o their_o pain_n in_o receive_v and_o pay_v the_o say_a money_n one_o penny_n in_o the_o pound_n which_o each_o receiver-general_n be_v hereby_o authorise_v to_o pay_v and_o allow_v unto_o they_o according_o and_o also_o upon_o the_o receipt_n of_o the_o whole_a assessment_n of_o the_o county_n city_n or_o town_n for_o which_o he_o be_v appoint_v receiver-general_n in_o case_n he_o have_v receive_v the_o several_a duplicate_v of_o each_o parish_n or_o place_n therein_o and_o not_o otherwise_o to_o allow_v and_o pay_v according_a to_o such_o warrant_n as_o shall_v be_v in_o that_o behalf_n give_v by_o the_o say_a commissioner_n or_o any_o three_o of_o they_o one_o penny_n in_o the_o pound_n for_o the_o commissioner_n clerk_n for_o their_o pain_n in_o fair_a write_v the_o assessment_n duplicate_v and_o copy_n provide_v that_o no_o head-collector_n shall_v be_v appoint_v for_o any_o city_n or_o town_n which_o be_v by_o this_o act_n particular_o charge_v with_o the_o payment_n of_o any_o sum_n towards_o the_o assessment_n hereby_o to_o be_v levy_v and_o for_o which_o a_o receiver-general_n be_v to_o be_v appoint_v except_v within_o the_o city_n of_o london_n and_o be_v it_o enact_v and_o declare_v pay_v how_o the_o money_n may_v be_v levy_v upon_o person_n refuse_v to_o pay_v that_o if_o any_o person_n shall_v refuse_v or_o neglect_v to_o pay_v any_o sum_n of_o money_n whereat_o he_o shall_v be_v rate_v and_o assess_v that_o then_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a collector_n subcollector_n or_o any_o of_o they_o who_o be_v hereby_o authorize_v and_o require_v thereunto_o to_o levy_v the_o sum_n assess_v by_o distress_n and_o sale_n of_o the_o good_n of_o such_o person_n so_o refuse_v or_o neglect_v to_o pay_v deduct_v the_o sum_n assess_v and_o reasonable_a charge_n of_o distrain_v and_o restore_v the_o overplus_n to_o the_o owner_n thereof_o and_o to_o break_v open_a in_o the_o daytime_n any_o house_n and_o upon_o warrant_n under_o the_o hand_n and_o seal_n of_o two_o or_o more_o of_o the_o say_a commissioner_n any_o chest_n trunk_n or_o box_n or_o other_o thing_n where_o any_o such_o good_n be_v and_o to_o call_v to_o their_o assistance_n the_o constable_n tythingman_n and_o headborough_n within_o the_o county_n city_n town_n or_o place_n where_o any_o refusal_n neglect_n or_o resistance_n shall_v be_v make_v which_o say_v officer_n and_o force_n be_v hereby_o require_v to_o be_v aid_v and_o assist_v in_o the_o premise_n as_o they_o will_v answer_v the_o contrary_a at_o their_o peril_n and_o if_o any_o question_n or_o difference_n happen_v upon_o take_v of_o such_o distress_n between_o the_o party_n distress_v or_o distrain_v the_o same_o shall_v be_v end_v and_o determine_v by_o the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o and_o if_o any_o person_n or_o person_n shall_v refuse_v or_o neglect_v to_o pay_v his_o or_o their_o assessment_n distress_n in_o what_o case_n imprisonment_n may_v be_v for_o lack_v of_o distress_n and_o convey_v his_o or_o their_o good_n or_o other_o personal_a estate_n whereby_o the_o sum_n of_o money_n so_o assess_v can_v be_v levy_v according_a to_o this_o act_n than_o the_o respective_a commissioner_n or_o any_o two_o or_o more_o of_o they_o be_v hereby_o authorise_v to_o imprison_v the_o person_n except_o a_o péer_n or_o péer_v of_o this_o of_o the_o sum_n of_o money_n assess_v on_o he_o or_o they_o complain_v to_o two_o or_o more_o commissioner_n whereof_o one_o of_o the_o commissioner_n who_o sign_v or_o allow_v he_o or_o their_o not_o to_o be_v pay_v to_o the_o receiver-general_n of_o the_o respective_a county_n as_o in_o this_o act_n be_v direct_v that_o then_o in_o all_o and_o every_o such_o case_n the_o several_a and_o respective_a commissioner_n assessor_n and_o collector_n aforesaid_a and_o every_o of_o they_o respective_o be_v hereby_o authorise_v and_o require_v to_o assess_v or_o re-assess_a or_o cause_n to_o be_v assess_v or_o re-assessed_n levy_v and_o pay_v all_o and_o every_o such_o sum_n or_o sum_n of_o money_n upon_o the_o respective_a county_n city_n town_n and_o place_n or_o upon_o any_o of_o the_o substantial_a oaken_a timber_n in_o stead_n of_o brick_n or_o stone_n for_o conveniency_n of_o shop_n and_o that_o the_o say_v door_n breast_n summer_n and_o window-frames_a be_v sufficient_o discharge_v of_o the_o burden_n of_o the_o fabric_n by_o arch-work_n of_o brick_n or_o stone_n either_o straight_o or_o circular_a supervisor_n the_o duty_n of_o the_o surveyor_n and_o supervisor_n and_o be_v it_o enact_v that_o the_o say_a surveyor_n or_o supervisor_n so_o to_o be_v appoint_v as_o aforesaid_a and_o every_o of_o they_o within_o their_o several_a precinct_n shall_v take_v care_n that_o in_o building_n of_o all_o house_n within_o the_o say_a city_n and_o liberty_n thereof_o there_o be_v and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o there_o shall_v
