maintenance_n of_o any_o child_n or_o other_o person_n already_o go_v or_o send_v or_o to_o go_v or_o to_o be_v send_v and_o train_v and_o instruct_v as_o be_v aforesaid_a or_o under_o the_o name_n or_o colour_n of_o any_o charity_n benevolence_n or_o alm_n towards_o the_o relief_n of_o any_o priory_n abbey_n nunnery_n college_n school_n or_o any_o religious_a house_n whatsoever_o every_o person_n so_o send_v convey_v or_o cause_v to_o be_v send_v and_o convey_v as_o well_o any_o such_o child_n or_o other_o person_n as_o any_o sum_n or_o sum_n of_o money_n or_o other_o thing_n and_o every_o person_n pass_v or_o be_v send_v beyond_o the_o sea_n be_v thereof_o lawful_o convict_v in_o or_o upon_o any_o information_n presentment_n or_o indictment_n as_o be_v aforesaid_a shall_v be_v disable_v from_o thenceforth_o to_o sue_v or_o use_v any_o action_n bill_n plaint_n or_o information_n in_o course_n of_o law_n or_o to_o prosecute_v any_o suit_n in_o any_o court_n of_o equity_n or_o town-corporate_a where_o his_o she_o or_o their_o estate_n lie_v have_v respect_n unto_o and_o not_o exceed_a the_o limitation_n and_o proportion_n hereafter_o mention_v that_o be_v to_o say_v no_o person_n shall_v be_v charge_v with_o find_v a_o horse_n horseman_n and_o arm_n unless_o such_o person_n or_o person_n have_v a_o revenue_n of_o five_o hundred_o pound_n by_o the_o year_n in_o possession_n or_o have_v a_o estate_n of_o six_o thousand_o pound_n in_o good_n or_o money_n beside_o the_o furniture_n of_o he_o or_o their_o house_n and_o so_o proportionable_o for_o a_o great_a estate_n in_o land_n in_o possession_n or_o good_n as_o the_o respective_a lieutenant_n and_o their_o deputy_n as_o aforesaid_a in_o their_o discretion_n shall_v see_v cause_n and_o think_v reasonable_a and_o they_o be_v not_o to_o charge_v any_o person_n with_o find_v a_o foot-souldier_n and_o arm_n that_o have_v not_o a_o yearly_a revenue_n of_o fifty_o pound_n in_o possession_n or_o a_o personal_a estate_n of_o six_o hundred_o pound_n in_o good_n or_o money_n other_o than_o the_o stock_n upon_o the_o ground_n and_o after_o the_o aforesaid_a rate_n proportionable_o for_o a_o great_a or_o lesser_a revenue_n or_o estate_n nor_o shall_v they_o charge_v any_o person_n with_o the_o find_v both_o of_o horse_n and_o foot_n in_o the_o same_o county_n provide_v that_o no_o person_n chargeable_a by_o this_o act_n to_o find_v a_o horse_n and_o horseman_n with_o arm_n foot-arm_n no_o person_n charge_v with_o or_o towards_o a_o horse_n may_v be_v charge_v also_o towards_o foot-arm_n or_o to_o be_v contributory_a towards_o find_v a_o horse_n and_o horseman_n with_o arm_n shall_v for_o the_o same_o estate_n be_v chargeable_a towards_o find_v a_o foot-souldier_n with_o arm_n or_o contributory_a thereunto_o and_o it_o shall_v be_v lawful_a to_o and_o for_o the_o respective_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a to_o impose_v the_o find_n and_o provide_v of_o horse_n horseman_n and_o arm_n as_o aforesaid_a by_o join_v two_o or_o three_o or_o more_o person_n together_o in_o the_o charge_n as_o to_o their_o judgement_n shall_v appear_v most_o conducible_a to_o the_o service_n of_o this_o kingdom_n provide_v that_o no_o person_n that_o have_v not_o one_o hundred_o pound_n per_fw-la annum_fw-la in_o possession_n in_o land_n act._n what_o person_n and_o estate_n only_o chargeable_a towards_o find_v horse-arm_n lieutenant_n and_o deputy_n may_v hear_v and_o determine_v matter_n relate_v to_o this_o act._n tenement_n or_o hereditament_n lease-hold_a or_o copyhold_n or_o twelve_o hundred_o pound_n personal_a estate_n shall_v be_v compellable_n to_o contribute_v in_o find_v any_o horse_n and_o horseman_n with_o arm_n and_o the_o say_v respective_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o shall_v have_v power_n to_o hear_v complaint_n and_o examine_v witness_n upon_o oath_n which_o oath_n they_o have_v hereby_o power_n to_o administer_v and_o to_o give_v redress_n according_a to_o the_o merit_n of_o the_o cause_n in_o matter_n relate_v to_o the_o execution_n of_o this_o act._n be_v it_o further_o enact_v that_o the_o say_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o in_o their_o several_a county_n and_o place_n respective_o shall_v
of_o the_o peace_n that_o the_o say_a justice_n of_o peace_n shall_v cause_v all_o the_o say_a account_n of_o the_o several_a hearth_n and_o stove_n within_o the_o respective_a county_n to_o be_v enrol_v by_o the_o clerk_n of_o the_o peace_n of_o the_o say_v respective_a county_n riding_n in_o yorkshire_n and_o division_n in_o lincolnshire_n and_o also_o a_o duplicate_v thereof_o in_o parchment_n under_o the_o hand_n and_o seal_n of_o three_o or_o more_o of_o the_o justice_n of_o peace_n of_o the_o respective_a county_n and_o place_n aforesaid_a who_o be_v hereby_o require_v to_o sign_n the_o same_o to_o be_v return_v into_o his_o majesty_n court_n of_o exchequer_n within_o one_o month_n next_o after_o such_o account_n deliver_v unto_o they_o at_o their_o respective_a quarter-session_n aforesaid_a upon_o pain_n that_o the_o clerk_n of_o the_o peace_n of_o every_o such_o county_n ride_v or_o division_n respective_o offend_v therein_o shall_v forfeit_v to_o his_o majesty_n his_o heir_n and_o successor_n the_o sum_n of_o two_o hundred_o pound_n for_o the_o first_o month_n and_o for_o the_o second_o month_n he_o shall_v so_o neglect_v every_o such_o clerk_n of_o the_o peace_n shall_v forfeit_v and_o lose_v his_o or_o their_o place_n and_o office_n and_o the_o same_o shall_v become_v void_a according_o which_o forfeiture_n and_o penalty_n shall_v be_v recover_v and_o levy_v as_o this_o act_n direct_v and_o to_o the_o intent_n that_o the_o revenue_n hereby_o arise_v to_o his_o majesty_n exchequer_n how_o the_o money_n arise_v shall_v be_v collect_v receive_v and_o pay_v into_o the_o exchequer_n may_v from_o time_n to_o time_n be_v pay_v into_o his_o exchequer_n with_o as_o little_a charge_n as_o may_v be_v be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a treasurer_n and_o other_o officer_n of_o the_o inn_n of_o court_n inn_n of_o chancery_n college_n and_o other_o society_n aforesaid_a within_o their_o respective_a jurisdiction_n and_o the_o several_a petty-constable_n tithing-man_n head-borough_n and_o such_o other_o officer_n within_o the_o respective_a limit_n liberty_n and_o jurisdiction_n shall_v every_o half_a year_n within_o six_o day_n after_o the_o say_a duty_n shall_v grow_v due_a as_o aforesaid_a collect_v gather_v and_o receive_v the_o same_o from_o the_o several_a occupier_n of_o the_o say_a hearth_n and_o stove_n and_o upon_o payment_n thereof_o shall_v give_v several_a acquittance_n without_o take_v any_o thing_n for_o such_o acquittance_n unto_o the_o several_a person_n who_o shall_v pay_v the_o same_o and_o that_o such_o acquittance_n shall_v be_v a_o full_a and_o perfect_a discharge_n to_o every_o such_o person_n who_o shall_v pay_v the_o same_o against_o his_o majesty_n his_o heir_n and_o successor_n so_o that_o no_o person_n who_o shall_v have_v such_o acquittance_n shall_v be_v molest_v sue_v or_o vex_v or_o put_v to_o any_o charge_n in_o his_o majesty_n court_n of_o exchequer_n or_o else_o where_o payment_n distress_n and_o sale_n of_o good_n in_o default_n of_o payment_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n any_o person_n who_o be_v hereby_o charge_v or_o intend_v to_o be_v charge_v to_o pay_v any_o sum_n or_o sum_n of_o money_n as_o aforesaid_a shall_v refuse_v or_o neglect_v to_o pay_v the_o same_o that_o then_o every_o person_n or_o person_n who_o be_v hereby_o authorize_v to_o collect_v the_o same_o shall_v and_o may_v levy_v the_o same_o by_o distress_n and_o sale_n of_o the_o good_n of_o the_o person_n and_o person_n so_o refuse_v or_o neglect_v render_v unto_o the_o say_a person_n and_o person_n the_o overplus_n of_o such_o money_n as_o shall_v remain_v in_o their_o hand_n by_o the_o say_a sale_n after_o the_o say_a duty_n and_o necessary_a charge_n of_o levy_v the_o same_o be_v discharge_v as_o aforesaid_a duty_n the_o duty_n of_o constable_n treasurer_n and_o officer_n impower_v to_o collect_v the_o say_a duty_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o aforesaid_a constable_n treasurer_n and_o other_o officer_n who_o be_v hereby_o authorize_v to_o collect_v the_o aforesaid_a duty_n shall_v within_o twenty_o day_n next_o after_o the_o aforesaid_a time_n at_o which_o the_o say_a duty_n shall_v be_v due_a to_o his_o majesty_n as_o aforesaid_a pay_v unto_o the_o high_a constable_n of_o the_o several_a hundred_o and_o respective_a limit_n all_o such_o money_n as_o they_o shall_v receive_v for_o the_o aforesaid_a duty_n receive_v a_o acquittance_n without_o pay_v any_o thing_n for_o the_o same_o collect_v the_o allowance_n for_o collect_v and_o deduct_v two_o penny_n in_o the_o pound_n for_o their_o pain_n in_o collect_v the_o same_o and_o shall_v also_o then_o in_o write_v under_o his_o hand_n deliver_v unto_o the_o say_v high_a constable_n the_o name_n of_o the_o person_n of_o who_o high_a constable_n of_o the_o several_a hundred_o and_o respective_a limit_n shall_v within_o ten_o day_n next_o after_o their_o several_a receipt_n from_o the_o say_a constable_n headborough_n tithingman_n and_o other_o officer_n pay_v unto_o the_o high_a sheriff_n of_o every_o county_n all_o such_o money_n as_o they_o shall_v so_o receive_v deduct_v a_o penny_n in_o the_o pound_n for_o their_o pain_n and_o shall_v also_o then_o deliver_v or_o cause_n to_o be_v deliver_v unto_o the_o say_v high_a sheriff_n the_o several_a return_n which_o they_o receive_v from_o the_o constable_n for_o the_o first_o offence_n limit_v division_n or_o liberty_n wherein_o the_o offence_n aforesaid_a shall_v be_v commit_v or_o for_o the_o chief_a magistrate_n of_o the_o place_n where_o such_o offence_n aforesaid_a shall_v be_v commit_v if_o it_o be_v within_o a_o corporation_n where_o there_o be_v not_o two_o justice_n of_o the_o peace_n and_o they_o be_v hereby_o require_v and_o enjoin_v upon_o proof_n to_o they_o or_o he_o respective_o make_v of_o such_o offence_n either_o by_o confession_n of_o the_o party_n or_o oath_n of_o witness_n or_o notorious_a evidence_n of_o the_o fact_n which_o oath_n the_o say_a justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o be_v hereby_o empower_v and_o require_v to_o administer_v to_o make_v a_o record_n of_o every_o such_o offence_n and_o offence_n under_o their_o hand_n and_o seal_n respective_o which_o record_n so_o make_v as_o aforesaid_a shall_v to_o all_o intent_n and_o purpose_n be_v in_o law_n take_v and_o adjudge_v to_o be_v a_o full_a and_o perfect_a conviction_n of_o every_o such_o offender_n for_o such_o offence_n and_o thereupon_o the_o say_a justice_n and_o chief_a magistrate_n respective_o shall_v commit_v every_o such_o offender_n so_o convict_v as_o aforesaid_a to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n for_o any_o time_n not_o exceed_a the_o space_n of_o three_o month_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_a five_o pound_n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v shall_v fine_a the_o say_a offender_n at_o for_o his_o or_o her_o say_a offence_n which_o money_n shall_v be_v pay_v to_o the_o churchwarden_n for_o the_o relief_n of_o the_o poor_a of_o the_o parish_n where_o such_o offender_n do_v last_o inhabit_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a offence_n the_o second_o offence_n that_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n contrary_a to_o this_o act_n and_o be_v thereof_o in_o manner_n aforesaid_a convict_v then_o such_o offender_n so_o convict_v of_o such_o second_o offence_n shall_v incur_v the_o penalty_n of_o imprisonment_n in_o the_o gaol_n or_o house_n of_o correction_n for_o any_o time_n not_o exceed_a six_o month_n without_o bail_n or_o mainprize_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_a ten_n pound_n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v thereunto_o authorize_v and_o require_v as_o aforesaid_a shall_v fine_a the_o say_a offender_n at_o for_o his_o or_o her_o say_v second_o offence_n the_o say_v fine_a to_o be_v dispose_v in_o manner_n aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a offence_n the_o three_o offence_n that_o if_o any_o such_o offender_n so_o convict_v of_o a_o second_o offence_n contrary_a to_o this_o act_n in_o manner_n aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n contrary_a to_o this_o act_n then_o any_o two_o justice_n of_o the_o peace_n and_o chief_a magistrate_n as_o aforesaid_a respective_o shall_v commit_v every_o such_o offender_n to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o the_o next_o general_n quarter_n session_n assizes_n gaol-delivery_n great_a session_n or_o sit_v of_o any_o commission_n of_o oyer_n and_o terminer_n in_o the_o respective_a county_n limit_v division_n or_o liberty_n which_o shall_v first_o happen_v when_o and_o where_o every_o such_o offender_n shall_v be_v proceed_v against_o by_o indictment_n for_o such_o offence_n and_o shall_v forthwith_o be_v arraign_v upon_o such_o indictment_n and_o shall_v then_o plead_v the_o general_n issue_n of_o not_o guilty_a and_o give_v any_o special_a matter_n in_o evidence_n or_o confess_v the_o indictment_n and_o if_o such_o offender_n proceed_v against_o shall_v be_v lawful_o convict_v of_o such_o offence_n either_o by_o confession_n or_o verdict_n or_o if_o such_o offender_n shall_v refuse_v to_o plead_v the_o general_n issue_n or_o to_o confess_v the_o indictment_n than_o the_o respective_a justice_n of_o the_o peace_n at_o their_o general_n quarter-session_n judge_n of_o assize_n and_o gaol-delivery_n at_o the_o assize_n and_o gaol-delivery_n justice_n of_o the_o great_a session_n at_o the_o great_a session_n and_o commissioner_n of_o oyer_n and_o terminer_n at_o their_o sit_v be_v hereby_o enable_v and_o require_v to_o cause_n judgement_n to_o be_v enter_v against_o such_o offender_n that_o such_o offender_n shall_v be_v transport_v beyond_o the_o sea_n to_o any_o of_o his_o majesty_n foreign_a plantation_n virginia_n and_o new-england_n only_o except_v there_o to_o remain_v seven_o year_n and_o shall_v forthwith_o under_o their_o hand_n and_o seal_n make_v out_o warrant_v to_o the_o sheriff_n or_o sheriff_n of_o the_o same_o county_n where_o such_o conviction_n or_o refusal_n to_o plead_v or_o to_o confess_v as_o aforesaid_a shall_v be_v safe_o to_o convey_v such_o offender_n to_o some_o port_n or_o haven_n near_a or_o most_o commodious_a to_o be_v appoint_v by_o they_o respective_o and_o from_o thence_o to_o embark_v such_o offender_n to_o be_v safe_o transport_v to_o any_o of_o his_o majesty_n plantation_n beyond_o the_o sea_n as_o shall_v be_v also_o by_o they_o respective_o appoint_v virginia_n and_o new-england_n only_o except_v whereupon_o the_o say_a sheriff_n shall_v safe_o convey_v and_o embark_v or_o cause_n to_o be_v convey_v and_o embark_v such_o offender_n to_o be_v transport_v as_o aforesaid_a under_o pain_n of_o forfeit_v for_o default_n of_o so_o transport_v every_o such_o offender_n the_o sum_n of_o forty_o pound_n of_o lawful_a money_n the_o one_o moiety_n thereof_o to_o the_o king_n &_o the_o other_o moiety_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o in_o any_o of_o the_o king_n court_n of_o record_n by_o bill_n plaint_n action_n of_o debt_n or_o information_n in_o any_o of_o which_o no_o wager_n of_o law_n essoign_n or_o protection_n shall_v be_v admit_v and_o the_o say_v respective_a court_n shall_v then_o also_o make_v out_o warrant_v to_o the_o several_a constable_n headborough_n or_o tythingman_n of_o the_o respective_a place_n where_o the_o estate_n real_a or_o personal_a of_o such_o offender_n so_o to_o be_v transport_v shall_v happen_v to_o be_v command_v they_o thereby_o to_o sequester_n into_o their_o hand_n the_o profit_n of_o the_o land_n and_o to_o distrain_v and_o sell_v the_o good_n of_o the_o offender_n so_o to_o be_v transport_v for_o the_o reimburse_n of_o the_o say_a sheriff_n all_o such_o reasonable_a charge_n as_o he_o shall_v be_v at_o and_o shall_v be_v allow_v he_o by_o the_o say_v respective_a court_n for_o such_o convey_v and_o embarque_a of_o such_o offender_n so_o to_o be_v transport_v render_v to_o the_o party_n or_o he_o or_o her_o assign_v the_o overplus_n of_o the_o same_o if_o any_o be_v unless_o such_o offender_n or_o some_o other_o on_o the_o behalf_n of_o such_o offender_n so_o to_o be_v transport_v shall_v give_v the_o sheriff_n such_o security_n as_o he_o shall_v approve_v of_o for_o the_o pay_v all_o the_o say_a charge_n unto_o he_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a transport_v how_o seditious_a sectary_n convict_v may_v be_v transport_v that_o in_o default_n of_o defray_v such_o charge_n by_o the_o party_n so_o to_o be_v transport_v or_o some_o other_o in_o their_o behalf_n or_o in_o default_n of_o security_n give_v to_o the_o sheriff_n as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o sheriff_n to_o contract_n with_o any_o master_n of_o a_o ship_n merchant_n or_o other_o person_n for_o the_o transport_v of_o such_o offender_n at_o the_o best_a rate_n he_o can_v and_o that_o in_o every_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o such_o person_n so_o contract_n with_o any_o sheriff_n for_o transport_v such_o offender_n as_o aforesaid_a to_o detain_v and_o employ_v every_o such_o offender_n so_o by_o they_o transport_v as_o a_o labourer_n to_o they_o or_o their_o assign_v for_o the_o space_n of_o five_o year_n to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o she_o be_v bind_v by_o indenture_n to_o such_o person_n for_o
and_o pay_v in_o to_o the_o receiver-general_n of_o the_o say_v several_a county_n who_o shall_v be_v appoint_v by_o his_o majesty_n and_o who_o be_v hereby_o require_v to_o transmit_v or_o cause_v responsible_a person_n to_o be_v head-collector_n unto_o who_o the_o money_n receive_v by_o the_o subcollector_n within_o the_o division_n or_o hundred_o shall_v from_o time_n to_o time_n be_v due_o or_o cause_n to_o be_v pay_v the_o money_n by_o they_o receive_v into_o the_o receipt_n of_o his_o majesty_n exchequer_n and_o the_o say_a lord_n treasurer_n be_v hereby_o authorize_v to_o allow_v the_o say_a receiver-general_n of_o each_o county_n city_n and_o town_n respective_o general_n allowance_n to_o the_o receiver_n general_n in_o case_n he_o have_v return_v up_o as_o aforesaid_a a_o duplicate_v of_o the_o assessment_n of_o each_o parish_n or_o place_n in_o the_o county_n city_n or_o town_n for_o which_o he_o be_v appoint_v receiver-general_n a_o salary_n for_o his_o pain_n not_o exceed_v one_o penny_n in_o the_o pound_n upon_o the_o cléer_n of_o his_o account_n which_o duplicate_v so_o to_o be_v return_v into_o the_o king_n remembrancer_n office_n in_o the_o exchequer_n be_v intend_v to_o contain_v no_o more_o than_o the_o sum_n in_o gross_a to_o be_v collect_v by_o each_o sub-collector_n and_o the_o several_a name_n of_o the_o say_v subcollector_n and_o it_o be_v hereby_o further_o enact_v and_o declare_v subcollector_n allowance_n to_o subcollector_n that_o the_o
subcollector_n of_o each_o parish_n or_o place_n which_o shall_v be_v appoint_v by_o virtue_n of_o this_o act_n shall_v upon_o the_o collection_n of_o the_o whole_a sum_n appoint_v to_o be_v collect_v by_o they_o and_o payment_n thereof_o as_o be_v hereby_o and_o before_o appoint_v have_v and_o receive_v for_o their_o pain_n in_o collect_v and_o pay_v the_o money_n one_o penny_n in_o the_o pound_n which_o the_o say_v several_a head-collector_n be_v hereby_o authorize_v to_o pay_v unto_o they_o and_o the_o several_a head-collector_n which_o shall_v be_v appoint_v by_o virtue_n of_o this_o act_n assistance_n the_o constable_n tythingman_n and_o headborough_n within_o the_o county_n city_n town_n or_o place_n where_o any_o refusal_n neglect_n or_o resistance_n shall_v be_v make_v which_o say_v of_o the_o sum_n of_o money_n assess_v on_o he_o or_o they_o complain_v to_o two_o or_o more_o commissioner_n whereof_o one_o of_o the_o commissioner_n who_o sign_v or_o allow_v he_o or_o their_o aforesaid_a shall_v be_v employ_v for_o and_o towards_o the_o expense_n waste_n and_o charge_n of_o assay_v melt_v down_o and_o coinage_n and_o buy_v in_o of_o gold_n and_o silver_n to_o coin_n act._n
