by_o the_o common_a brewer_n or_o by_o such_o other_o person_n or_o person_n respective_o and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n one_o shilling_n three_o penny_n xv._o excise_n upon_o foreign_a liquor_n import_v to_o be_v pay_v in_o money_n before_o land_v duty_n and_o charge_n of_o excise_n or_o new_a impost_n above_o mention_v hereby_o set_v or_o impose_v upon_o all_o and_o every_o the_o say_v foreign_a liquor_n which_o shall_v be_v import_v or_o bring_v into_o all_o or_o any_o the_o port_n of_o this_o kingdom_n and_o dominion_n thereof_o aforesaid_a from_o and_o after_o the_o five_o and_o twenty_o day_n of_o december_n next_o shall_v be_v from_o time_n to_o time_n satisfy_v and_o pay_v by_o the_o merchant_n or_o merchant_n importer_n or_o importer_n of_o the_o same_o in_o ready_a money_n upon_o his_o or_o their_o entry_n or_o entry_n make_v and_o before_o the_o land_n thereof_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a etc._n entry_n to_o be_v make_v at_o the_o office_n of_o excise_n by_o common_a brewer_n innkeeper_n etc._n etc._n that_o all_o common_a brewer_n of_o béer_n and_o ale_n shall_v once_o in_o every_o wéek_v and_o all_o inn-kéepers_a alehouse-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n entry_n the_o penalty_n for_o not_o make_v entry_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v ten_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a and_o particular_a entry_n shall_v forfeit_v twenty_o shilling_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o common_a brewer_n pay_v the_o penalty_n for_o not_o pay_v who_o shall_v not_o pay_v and_o clear_v off_o

in_o all_o thing_n in_o the_o execution_n of_o the_o say_a commission_n as_o before_o by_o the_o say_a act_n any_o five_o may_v have_v do_v and_o that_o the_o say_v commissioner_n or_o any_o such_o three_o of_o they_o as_o aforesaid_a be_v and_o hereby_o be_v empower_v to_o summon_v party_n and_o witness_n to_o appear_v and_o in_o case_n of_o contempt_n or_o wilful_a delay_n in_o the_o witness_n upon_o the_o first_o summons_n and_o tender_a of_o reasonable_a charge_n and_o in_o the_o party_n upon_o their_o second_o summons_n cost_v cost_v to_o punish_v the_o offender_n by_o imprisonment_n or_o cost_v for_o such_o time_n and_o in_o such_o manner_n as_o shall_v be_v reasonable_a and_o according_a to_o the_o nature_n and_o quality_n of_o their_o offence_n and_o that_o it_o shall_v and_o aforesaid_a shall_v find_v cause_n to_o examine_v witness_n beyond_o the_o sea_n or_o any_o remote_a part_n of_o his_o majesty_n dominion_n for_o the_o clear_n of_o any_o doubt_n or_o matter_n before_o they_o depend_v that_o in_o such_o case_n by_o direction_n of_o the_o say_a commissioner_n or_o any_o such_o three_o of_o they_o like_o commission_n or_o process_n shall_v issue_v out_o of_o the_o court_n of_o admiralty_n as_o have_v former_o be_v for_o the_o purpose_n aforesaid_a returnable_a before_o the_o say_a commissioner_n and_o that_o the_o say_v commissioner_n or_o any_o such_o three_o of_o they_o shall_v have_v also_o power_n to_o give_v and_o pass_v their_o final_a sentence_n decree_n and_o execution_n as_o well_o against_o the_o body_n of_o the_o party_n evict_v or_o his_o good_n as_o also_o against_o the_o executor_n and_o administrator_n of_o such_o party_n so_o evict_v and_o to_o assess_v cost_v of_o suit_n upon_o such_o person_n or_o person_n as_o shall_v be_v condemn_v by_o the_o decree_n of_o the_o say_a court_n as_o to_o they_o shall_v seem_v just_o and_o forasmuch_o as_o many_o witness_n as_o seaman_n and_o other_o come_v and_o speedy_o go_v again_o to_o sea_n before_o witness_n go_v to_o see_v how_o to_o be_v examine_v before_o before_o a_o court_n can_v be_v summon_v by_o which_o mean_v the_o assure_a and_o assurer_n be_v many_o time_n much_o damnify_v for_o the_o prevent_n of_o which_o mischief_n be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o one_o of_o the_o say_a commissioner_n to_o administer_v a_o oath_n to_o any_o witness_v legal_o summon_v to_o give_v testimony_n timely_a notice_n be_v thereof_o give_v to_o the_o adverse_a party_n and_o set_v up_o in_o the_o office_n before_o such_o examination_n to_o the_o end_n such_o witness_n or_o witness_n may_v be_v cross-examined_n provide_v always_o that_o the_o say_a commissioner_n shall_v in_o no_o case_n procee_v both_o against_o person_n and_o good_n for_o one_o and_o the_o same_o debt_n and_o provide_v also_o chancery_n appeal_v to_o the_o chancery_n that_o any_o thing_n in_o this_o act_n contain_v shall_v not_o in_o any_o wise_a extend_v to_o prejudice_v the_o appeal_n to_o the_o high_a court_n of_o chancery_n give_v or_o allow_v in_o the_o say_v former_a act_n of_o parliament_n cap._n xxiv_o a_o act_n declaratory_a concern_v bankrupt_n whereas_o divers_a nobleman_n gentleman_n and_o person_n of_o quality_n no_o way_n breed_v up_o to_o trade_n or_o merchandise_n do_v oftentimes_o put_v in_o great_a stock_n of_o money_n into_o the_o east-india_n company_n or_o guiney_n company_n and_o the_o fish_n trade_n and_o such_o other_o public_a society_n and_o receive_v such_o rate_n be_v make_v whereby_o they_o shall_v have_v power_n for_o their_o several_a county_n to_o raise_v upon_o the_o parish_n that_o lie_v in_o or_o near_o the_o say_a road_n and_o so_o will_v have_v a_o benefit_n therefrom_o such_o sum_n or_o sum_n of_o money_n as_o they_o shall_v see_v fit_a and_o convenient_a for_o the_o speedy_a effect_n of_o the_o say_v repair_v before_o mention_v which_o say_v sum_n and_o sum_n so_o to_o be_v rate_v as_o aforesaid_a shall_v be_v pay_v to_o the_o surveyor_n for_o the_o respective_a county_n where_o such_o rate_n be_v make_v or_o to_o their_o receiver_n or_o collector_n to_o be_v employ_v for_o the_o repair_n of_o the_o say_a way_n and_o place_n aforementioned_a and_o not_o otherwise_o and_o in_o case_n any_o person_n shall_v refuse_v to_o pay_v such_o rate_n so_o to_o be_v make_v that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a surveyor_n or_o their_o say_a receiver_n and_o collector_n to_o distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o the_o distress_n to_o sell_v render_v the_o overplus_n to_o the_o owner_n provide_v always_o and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o advance_v by_o the_o say_v several_a town_n in_o the_o say_v respective_a county_n shall_v again_o be_v repay_v with_o interest_n by_o the_o several_a surveyor_n for_o the_o several_a county_n as_o it_o do_v arise_v out_o of_o the_o say_a toll_n every_o county_n pay_v for_o what_o be_v so_o borrow_a within_o its_o own_o county_n and_o no_o further_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n not_o have_v any_o lawful_a cause_n to_o be_v allow_v as_o aforesaid_a surveyor_n the_o penalty_n for_o refuse_v to_o take_v the_o office_n of_o surveyor_n shall_v neglect_v or_o refuse_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n be_v thereunto_o nominate_v and_o choose_v according_a as_o by_o this_o act_n be_v appoint_v or_o to_o do_v or_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_a justice_n of_o the_o peace_n for_o the_o several_a and_o respective_a county_n where_o such_o surveyor_n or_o surveyor_n dwell_v at_o their_o quarter-session_n shall_v and_o may_v hereby_o have_v power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v such_o fine_a or_o fine_n not_o exceed_a ten_n pound_n upon_o each_o person_n so_o refuse_v or_o neglect_v as_o to_o they_o shall_v seem_v meet_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o or_o their_o good_n render_v to_o the_o party_n so_o distrain_v the_o overplus_n if_o any_o shall_v be_v dispose_v fine_n and_o forfeiture_n upon_o this_o act_n how_o to_o be_v pay_v and_o dispose_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o fine_n or_o forfeiture_n to_o be_v impose_v or_o incur_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o surveyor_n for_o the_o time_n be_v or_o any_o three_o of_o they_o or_o the_o treasurer_n of_o the_o say_a surveyor_n for_o the_o say_v respective_a county_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a and_o in_o case_n of_o refusal_n or_o if_o any_o person_n or_o person_n so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n shall_v happen_v to_o die_v or_o shall_v for_o any_o lawful_a impediment_n be_v discharge_v from_o the_o say_a office_n that_o then_o some_o other_o fit_a person_n or_o person_n within_o that_o county_n shall_v be_v appoint_v by_o two_o or_o more_o justice_n in_o the_o say_a county_n live_v near_o the_o say_a highway_n and_o place_n aforesaid_a in_o the_o place_n of_o he_o or_o they_o that_o shall_v so_o refuse_v die_v or_o be_v discharge_v and_o the_o person_n or_o person_n so_o choose_v shall_v and_o be_v hereby_o require_v upon_o notice_n thereof_o to_o he_o or_o they_o give_v under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n by_o who_o he_o or_o they_o shall_v be_v so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n and_o to_o execute_v the_o same_o in_o such_o manner_n and_o under_o such_o and_o the_o like_a penalty_n as_o if_o he_o or_o they_o have_v be_v choose_v by_o the_o justice_n at_o their_o session_n of_o the_o peace_n in_o manner_n as_o aforesaid_a issue_n suit_n upon_o this_o act_n shall_v be_v lay_v in_o the_o proper_a county_n and_o the_o defendant_n may_v plead_v the_o general_a issue_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o suit_n shall_v be_v commence_v against_o any_o person_n for_o any_o thing_n do_v in_o pursuance_n of_o this_o present_a act_n that_o in_o every_o such_o case_n the_o action_n shall_v be_v lay_v in_o the_o say_v respective_a county_n where_o the_o cause_n do_v arise_v and_o not_o elsewhere_o and_o the_o defendant_n in_o such_o action_n so_o to_o be_v bring_v may_v plead_v the_o general_a issue_n and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n at_o any_o trial_n to_o be_v have_v thereupon_o and_o that_o the_o same_o be_v do_v in_o pursuance_n and_o by_o authority_n of_o the_o say_a act_n and_o if_o it_o shall_v so_o appear_v to_o be_v do_v and_o that_o such_o action_n shall_v be_v bring_v in_o any_o other_o county_n that_o then_o the_o jury_n shall_v find_v for_o the_o defendant_n and_o upon_o such_o verdict_n or_o if_o the_o plaintiff_n shall_v be_v nonsuit_v or_o discontinue_v his_o action_n after_o the_o defendant_n shall_v have_v appear_v or_o if_o upon_o demurrer_n judgement_n shall_v be_v give_v against_o the_o plaintiff_n the_o say_a defendant_n shall_v have_v and_o recover_v his_o double_a cost_v cost_v double_o cost_v and_o have_v the_o like_a remedy_n for_o the_o same_o as_o any_o defendant_n have_v in_o any_o other_o case_n by_o law_n day_n toll_n not_o to_o be_v pay_v twice_o in_o the_o same_o day_n provide_v always_o that_o no_o person_n or_o person_n have_v occasion_n to_o pass_v any_o place_n where_o the_o toll_n be_v take_v and_o return_v the_o same_o day_n with_o the_o same_o horse_n coach_n wagon_n or_o other_o carriage_n or_o with_o cattle_n shall_v be_v compel_v in_o the_o same_o day_n to_o pay_v the_o say_a toll_n a_o second_o time_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o such_o order_n shall_v be_v appoint_v item_n that_o the_o say_a house_n with_o the_o ground_n therewith_o enclose_v be_v have_v and_o use_v as_o a_o common_a gaol_n and_o workhouse_n for_o the_o say_a
