abridge_v this_o high_a privilege_n namely_o in_o this_o that_o any_o member_n offend_v shall_v be_v subject_a to_o the_o censure_n of_o that_o great_a court_n in_o a_o ordinary_a course_n of_o justice_n which_o before_o he_o be_v not_o but_o in_o a_o extraordinary_a way_n by_o petition_n or_o the_o like_a in_o which_o condition_n he_o now_o stand_v as_o to_o civil_a action_n to_o this_o i_o can_v give_v no_o positive_a answer_n but_o i_o rather_o incline_v to_o think_v that_o this_o law_n be_v rather_o parcel_n of_o the_o privilege_n itself_o or_o contemporary_a with_o it_o and_o no_o criminal_a matter_n communicate_v to_o no_o other_o court_n of_o justice_n matter_n the_o privilege_n of_o parliament_n parallel_v with_o the_o privilege_n of_o inferior_a court_n in_o civil_a matter_n but_o in_o civil_a action_n there_o be_v some_o footstep_n of_o this_o great_a privilege_n in_o inferior_a court_n in_o the_o common_a plea_n a_o write_v of_o privilege_n or_o supercedeas_fw-la to_o stay_v proceed_n against_o any_o member_n of_o that_o court_n and_o if_o the_o parry_n have_v cause_n of_o action_n he_o ought_v to_o sue_v in_o the_o common_a plea_n parallel_n this_o case_n with_o the_o privilege_n of_o parliament_n in_o civil_a action_n you_o will_v find_v it_o almost_o the_o same_o the_o supersedeas_fw-la or_o write_v of_o privilege_n remove_v not_o the_o cause_n no_o more_o be_v the_o cause_n remove_v by_o claim_v the_o privilege_n of_o parliament_n but_o a_o cesset_fw-la processus_fw-la legis_fw-la quousq_fw-la etc._n etc._n if_o the_o party_n have_v high_a court_n this_o and_o many_o other_o privilege_n be_v for_o the_o public_a good_a to_o the_o end_n that_o parliament_n which_o be_v to_o the_o state_n tanquam_fw-la medice_fw-la aegro_fw-la like_o the_o physician_n to_o a_o sick_a person_n shall_v not_o be_v elude_v or_o frustrate_v by_o suggestion_n of_o crime_n against_o any_o member_n thereof_o by_o the_o king_n or_o any_o person_n word_n and_o then_o judge_v it_o be_v plain_a by_o their_o sense_n and_o meaning_n that_o in_o civil_a action_n they_o can_v be_v proceed_v against_o without_o sentence_n and_o order_n of_o parliament_n no_o ordinary_a course_n of_o justice_n the_o order_n of_o parliament_n upon_o petition_n or_o the_o like_a be_v a_o extraordinary_a and_o arbitrary_a course_n of_o justice_n but_o in_o criminal_a matter_n they_o may_v be_v censure_v without_o sentence_n and_o order_n of_o the_o house_n that_o be_v in_o a_o ordinary_a and_o positive_a way_n of_o justice_n but_o this_o must_v be_v in_o the_o hâ—gh_a court_n of_o parliament_n itself_o and_o not_o elsewhere_o without_o their_o leave_n and_o so_o be_v the_o sense_n of_o these_o word_n to_o any_o rational_a man_n well_o observe_v there_o be_v no_o power_n give_v to_o inferior_a court_n by_o these_o word_n either_o express_v or_o employ_v nota._n nota._n but_o the_o privilege_n continue_v the_o same_o it_o be_v nothing_o diminish_v by_o the_o word_n of_o this_o petition_n further_o postea_fw-la the_o positive_a law_n in_o inferior_a court_n and_o the_o law_n of_o
not_o ground_v always_o upon_o the_o positive_a law_n but_o upon_o intervenient_a accident_n arise_v upon_o material_a circumstance_n of_o time_n place_n or_o other_o emergent_a cause_n which_o order_n be_v hold_v by_o the_o sage_n of_o the_o law_n agreeable_a unto_o equity_n and_o justice_n although_o no_o express_a law_n to_o warrant_v the_o same_o in_o chancery_n many_o cross_a order_n proceed_v unto_o final_a judgement_n in_o case_n of_o wilful_a absence_n of_o any_o the_o judge_n of_o this_o court_n parallele_v with_o this_o power_n in_o inferior_a court_n the_o court_n full_a in_o judgement_n of_o the_o law_n without_o those_o judge_n which_o be_v wilful_o absent_a if_o any_o member_n of_o the_o house_n who_o be_v by_o law_n judge_n of_o this_o high_a court_n shall_v refuse_v to_o discharge_v the_o trust_n commit_v unto_o they_o as_o the_o case_n now_o be_v and_o wilful_o by_o absence_n or_o delinquency_n make_v themselves_o uncapable_a and_o unworthy_a of_o
