wéek_v and_o all_o inn-kéepers_a alehouse-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n entry_n the_o penalty_n for_o not_o make_v entry_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v ten_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o that_o it_o may_v be_v enact_v by_o your_o majesty_n and_o it_o be_v hereby_o enact_v by_o the_o king_n most_o excellent_a majesty_n and_o the_o lord_n and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o authority_n of_o the_o same_o tobacco_n no_o person_n after_o the_o 1._o january_n 1660._o shall_v set_v or_o plant_v any_o tobacco_n that_o no_o person_n or_o and_o the_o other_o moiety_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o to_o be_v recover_v by_o bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n wherein_o no_o essoigne_n protection_n or_o wager_n in_o law_n shall_v be_v allow_v act._n all_o sheriff_n and_o other_o officer_n may_v destroy_v any_o tobacco_n plant_v contrary_a to_o this_o act._n and_o it_o be_v hereby_o further_o enact_v that_o all_o sheriff_n justice_n of_o the_o peace_n mayor_n bailiff_n constable_n and_o every_o of_o they_o upon_o information_n or_o complaint_n make_v unto_o they_o or_o any_o of_o they_o by_o any_o the_o officer_n of_o the_o custom_n or_o by_o any_o other_o person_n or_o person_n whatsoever_o that_o there_o be_v any_o tobacco_n set_v sow_v plant_v or_o grow_v within_o their_o jurisdiction_n or_o precinct_n contrary_a to_o this_o act_n shall_v within_o ten_o day_n after_o such_o information_n or_o complaint_n cause_n to_o be_v burn_v pluck_v up_o consume_v or_o utter_o destroy_v all_o such_o tobacco_n so_o set_v sow_v plant_v or_o grow_v act_n the_o penalty_n of_o any_o person_n resist_v this_o act_n and_o it_o be_v hereby_o further_o enact_v that_o in_o case_n any_o person_n or_o person_n shall_v resist_v or_o make_v forcible_a opposition_n against_o any_o person_n or_o person_n in_o the_o due_a and_o through_o execution_n of_o this_o act_n that_o every_o such_o person_n or_o person_n for_o every_o such_o offence_n shall_v forfeit_v the_o sum_n of_o five_o pound_n to_o be_v divide_v and_o recover_v in_o manner_n aforesaid_a and_o in_o case_n any_o person_n or_o person_n shall_v not_o pay_v the_o sum_n of_o money_n by_o they_o to_o be_v pay_v by_o virtue_n of_o this_o act_n that_o in_o every_o such_o case_n distress_n shall_v be_v have_v a_o benefit_n therefrom_o such_o sum_n or_o sum_n of_o money_n as_o they_o shall_v see_v fit_a and_o convenient_a for_o the_o speedy_a effect_n of_o the_o say_v repair_v before_o mention_v which_o say_v sum_n and_o sum_n so_o to_o be_v rate_v as_o aforesaid_a shall_v be_v pay_v to_o the_o surveyor_n for_o the_o respective_a county_n where_o such_o rate_n be_v make_v or_o to_o their_o receiver_n or_o collector_n to_o be_v employ_v for_o the_o repair_n of_o the_o say_a way_n and_o place_n aforementioned_a and_o not_o otherwise_o and_o in_o case_n any_o person_n shall_v refuse_v to_o pay_v such_o rate_n so_o to_o be_v make_v that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a surveyor_n or_o their_o say_a receiver_n and_o collector_n to_o distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o the_o distress_n to_o sell_v render_v the_o overplus_n to_o the_o owner_n provide_v always_o and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o advance_v by_o the_o say_v several_a town_n in_o the_o say_v respective_a county_n shall_v again_o be_v repay_v with_o interest_n by_o the_o several_a surveyor_n for_o the_o several_a county_n as_o it_o do_v arise_v out_o of_o the_o say_a toll_n every_o county_n pay_v for_o what_o be_v so_o borrow_a within_o its_o own_o county_n and_o no_o further_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n not_o have_v any_o lawful_a cause_n to_o be_v allow_v as_o aforesaid_a surveyor_n the_o penalty_n for_o refuse_v to_o take_v the_o office_n of_o surveyor_n shall_v neglect_v or_o refuse_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n be_v thereunto_o nominate_v and_o choose_v according_a as_o by_o this_o act_n be_v appoint_v or_o to_o do_v or_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_a justice_n of_o the_o peace_n for_o the_o several_a and_o respective_a county_n where_o such_o surveyor_n or_o surveyor_n dwell_v at_o their_o quarter-session_n shall_v and_o may_v hereby_o have_v power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v such_o fine_a or_o fine_n not_o exceed_a ten_n pound_n upon_o each_o person_n so_o refuse_v or_o neglect_v as_o to_o they_o shall_v seem_v meet_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o or_o their_o good_n render_v to_o the_o party_n so_o distrain_v the_o overplus_n if_o fine_n or_o forfeiture_n to_o be_v impose_v or_o incur_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o surveyor_n for_o the_o time_n be_v or_o any_o three_o of_o they_o or_o the_o treasurer_n of_o the_o say_a surveyor_n for_o the_o say_v respective_a county_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a and_o in_o case_n of_o refusal_n or_o if_o any_o person_n or_o person_n so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n shall_v happen_v to_o die_v or_o shall_v for_o any_o lawful_a impediment_n be_v discharge_v from_o the_o say_a office_n that_o then_o some_o other_o fit_a person_n or_o person_n within_o that_o county_n shall_v be_v appoint_v by_o two_o or_o more_o justice_n in_o the_o say_a county_n live_v near_o the_o say_a highway_n and_o place_n aforesaid_a in_o the_o place_n of_o he_o or_o they_o that_o shall_v so_o refuse_v die_v or_o be_v discharge_v and_o the_o person_n or_o and_o payable_a for_o the_o same_o be_v full_o satisfy_v and_o pay_v and_o that_o every_o warrant_n for_o the_o land_n or_o deliver_v of_o any_o such_o foreign_a liquor_n shall_v be_v sign_v by_o the_o hand_n of_o the_o say_a officer_n or_o collector_n of_o the_o excise_n in_o the_o say_a port_n or_o place_n respective_o upon_o pain_n that_o all_o such_o foreign_a liquor_n as_o shall_v be_v land_v put_v on_o shore_n or_o deliver_v contrary_a to_o the_o true_a intent_n and_o meaning_n hereof_o or_o without_o the_o presence_n of_o a_o officer_n or_o waiter_n for_o the_o excise_n or_o the_o appeal_n and_o complaint_n that_o shall_v happen_v and_o arise_v between_o party_n and_o party_n county_n complaint_n to_o be_v determine_v in_o the_o proper_a county_n in_o order_n to_o the_o payment_n of_o the_o duty_n of_o excise_n shall_v be_v hear_v and_o determine_v in_o the_o proper_a county_n or_o in_o the_o several_a riding_n and_o division_n of_o yorkshire_n and_o lincolnshire_n where_o they_o shall_v arise_v and_o not_o elsewhere_o fe_n commissioner_n or_o farmer_n may_v take_v no_o fe_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o farmer_n commissioner_n sub-commissioner_n or_o other_o officer_n of_o excise_n shall_v direct_o or_o indirect_o take_v or_o receive_v any_o money_n fee_n or_o reward_n for_o or_o concern_v the_o take_n of_o any_o bond_n or_o give_v any_o receipt_n or_o note_n in_o write_v relate_v to_o the_o excise_n to_o or_o from_o any_o person_n or_o person_n whatsoever_o upon_o pain_n that_o every_o such_o person_n so_o offend_v shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o shilling_n act._n who_o may_v hear_v and_o determine_v matter_n upon_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n of_o the_o peace_n or_o any_o two_o or_o more_o of_o they_o or_o chief_a magistrate_n in_o the_o several_a county_n city_n division_n and_o place_n within_o england_n and_o wales_n respective_o shall_v meet_v once_o in_o every_o month_n in_o their_o respective_a division_n or_o often_o if_o there_o shall_v be_v occasion_n to_o hear_v determine_v and_o to_o adjudge_v all_o matter_n and_o offence_n against_o this_o or_o the_o aforesaid_a acts._n recover_v how_o the_o penalty_n upon_o this_o act_n shall_v be_v dispose_v and_o recover_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o one_o three_o part_n of_o all_o fine_n penalty_n and_o forfeiture_n not_o herein_o otherwise_o dispose_v shall_v be_v to_o the_o king_n majesty_n his_o heir_n and_o successor_n &_o one_o other_o three_o part_n to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v &_o the_o other_o three_o part_n to_o he_o that_o shall_v inform_v and_o sue_v for_o the_o same_o and_o that_o all_o fine_n penalty_n and_o forfeiture_n for_o which_o no_o remedy_n be_v ordain_v for_o recovery_n thereof_o by_o this_o act_n shall_v be_v recover_v by_o action_n of_o debt_n bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n within_o such_o county_n city_n or_o corporation_n where_o the_o offence_n shall_v be_v commit_v or_o by_o such_o other_o way_n and_o mean_n and_o in_o such_o manner_n as_o by_o the_o say_v former_a act_n be_v direct_v and_o appoint_v thereof_o appeal_v for_o matter_n in_o london_n and_o the_o limit_n thereof_o provide_v always_o that_o after_o the_o say_v three_o day_n of_o september_n no_o appeal_n in_o any_o matter_n or_o cause_n of_o excise_n within_o the_o immediate_a limit_n of_o the_o chief_a office_n of_o london_n nor_o within_o the_o limit_n of_o the_o present_a farm_n of_o london_n during_o the_o continuance_n of_o such_o farm_n shall_v be_v admit_v unless_o the_o same_o be_v bring_v within_o two_o month_n next_o after_o the_o first_o judgement_n and_o notice_n thereof_o give_v or_o leave_v at_o the_o dwellinghouse_n of_o the_o party_n or_o party_n concern_v therein_o nor_o shall_v any_o appeal_n in_o any_o matter_n or_o cause_n of_o excise_n in_o any_o other_o county_n city_n town_n or_o place_n be_v admit_v unless_o the_o same_o be_v bring_v within_o four_o month_n after_o the_o first_o judgement_n and_o notice_n give_v as_o aforesaid_a any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o provide_v nevertheless_o and_o it_o be_v hereby_o enact_v that_o no_o
this_o act_n in_o the_o exercise_n of_o religion_n differ_v from_o the_o rite_n of_o the_o church_n of_o england_n then_o every_o such_o keeper_n of_o a_o gaol_n or_o house_n of_o correction_n shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o pound_n to_o be_v levy_v raise_v and_o dispose_a by_o such_o person_n penalty_n the_o penalty_n and_o in_o such_o manner_n as_o the_o with_o what_o aid_n force_n and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v and_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v provide_v that_o no_o dwellinghouse_n of_o any_o péer_n of_o this_o realm_n peer_n the_o house_n of_o peer_n whilst_o he_o or_o his_o wife_n shall_v be_v there_o resident_a shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o of_o the_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v nor_o shall_v any_o other_o dwellinghouse_n of_o any_o péer_n or_o other_o person_n whatsoever_o be_v enter_v into_o with_o force_n by_o justice_n of_o the_o peace_n or_o chief_a magistrate_n respective_o that_o he_o or_o she_o and_o in_o case_n of_o a_o feme-covert_a that_o her_o husband_n have_v a_o estate_n of_o frée-hold_a or_o copyhold_n to_o the_o value_n of_o five_o pound_n per_fw-la annum_fw-la or_o personal_a estate_n to_o the_o value_n of_o fifty_o pound_n any_o thing_n in_o this_o act_n to_o the_o contrary_a of_o any_o jury_n or_o order_v to_o be_v examine_v upon_o interrogatory_n or_o be_v present_a in_o court_n shall_v refuse_v to_o take_v any_o judicial_a oath_n legal_o tender_v to_o he_o by_o the_o judge_n or_o judge_n of_o the_o same_o court_n have_v no_o legal_a plea_n to_o justify_v or_o excuse_v the_o refusal_n of_o the_o same_o oath_n or_o if_o any_o person_n or_o person_n be_v due_o assistance_n the_o constable_n tythingman_n and_o headborough_n within_o the_o county_n city_n town_n or_o place_n where_o any_o refusal_n neglect_n or_o resistance_n shall_v be_v make_v which_o say_v realm_n and_o he_o and_o they_o in_o prison_n to_o detain_v and_o keep_v until_o the_o money_n so_o assess_v and_o the_o charge_n for_o the_o bring_n in_o the_o same_o be_v pay_v and_o satisfy_v and_o commissioner_n or_o any_o two_o or_o more_o of_o they_o in_o their_o several_a division_n shall_v and_o have_v hereby_o power_n to_o settle_v the_o same_o as_o they_o shall_v think_v fit_a and_o if_o any_o person_n or_o person_n shall_v find_v he_o or_o themselves_o aggrieve_v in_o that_o the_o assessor_n have_v overrate_v he_o or_o they_o and_o shall_v within_o six_o day_n after_o demand_v make_v of_o the_o sum_n of_o money_n assess_v on_o he_o or_o they_o complain_v to_o two_o or_o more_o commissioner_n whereof_o one_o of_o the_o commissioner_n who_o sign_v or_o allow_v he_o or_o their_o assessment_n to_o be_v one_o the_o say_v commissioner_n or_o any_o two_o or_o more_o of_o they_o shall_v have_v and_o have_v hereby_o power_n within_o twelve_o day_n after_o the_o demand_n of_o the_o through_o any_o wilfulness_n negligence_n or_o mistake_n or_o accident_n the_o say_a assessment_n charge_v upon_o each_o county_n city_n town_n or_o place_n by_o virtue_n of_o this_o act_n happen_v not_o to_o be_v pay_v to_o the_o receiver-general_n of_o the_o respective_a county_n as_o in_o this_o act_n be_v direct_v that_o then_o in_o all_o and_o every_o such_o case_n the_o several_a and_o respective_a commissioner_n assessor_n and_o collector_n aforesaid_a and_o every_o of_o they_o respective_o be_v hereby_o authorise_v and_o require_v to_o assess_v or_o re-assess_a or_o cause_n to_o be_v assess_v or_o re-assessed_n levy_v and_o pay_v all_o and_o every_o such_o sum_n or_o sum_n of_o money_n upon_o the_o respective_a county_n city_n town_n and_o place_n or_o upon_o any_o of_o the_o division_n hundred_o and_o parish_n therein_o as_o to_o the_o say_a commissioner_n or_o such_o number_n of_o they_o as_o by_o this_o act_n be_v authorise_v to_o cause_v the_o first_o assessment_n hereby_o require_v to_o be_v make_v shall_v seem_v most_o agreeable_a to_o equity_n and_o justice_n the_o say_v new_a assessment_n to_o be_v make_v collect_v and_o pay_v in_o such_o manner_n and_o by_o such_o mean_n as_o in_o this_o act_n for_o this_o assessment_n be_v delare_v and_o direct_v act._n the_o punishment_n of_o person_n neglect_v to_o perform_v
except_v but_o shall_v wilful_o and_o negligent_o suffer_v the_o say_v fen_n and_o waste_v or_o the_o most_o part_n of_o the_o same_o to_o be_v again_o drown_v and_o overflow_v by_o the_o space_n of_o and_o at_o all_o time_n as_o occasion_n shall_v require_v dreyn_v how_o meeting_n and_o by-law_n may_v be_v make_v for_o management_n of_o the_o dreyn_v provide_v always_o and_o be_v it_o enact_v by_o bench_n or_o any_o two_o or_o more_o of_o they_o upon_o the_o complaint_n of_o the_o say_a mayor_n and_o court_n of_o alderman_n to_o call_v before_o they_o such_o a_o number_n of_o brick-maker_n labourer_n wage_n and_o to_o the_o intent_n no_o brick-maker_n tile-maker_n lime-burner_n carpenter_n bricklay_a mason_n plasterer_n joiner_n plumber_n or_o other_o artificer_n workman_n or_o labourer_n may_v make_v the_o common_a calamity_n a_o pretence_n to_o extort_v unreasonable_a or_o excessive_a wage_n be_v it_o likewise_o enact_v that_o in_o case_n of_o combination_n or_o exaction_n of_o unreasonable_a wage_n by_o the_o say_a artificer_n workman_n or_o labourer_n or_o any_o of_o they_o the_o say_a justice_n of_o the_o court_n of_o kings-bench_n or_o any_o two_o or_o more_o of_o they_o upon_o the_o like_a complaint_n of_o the_o say_a lord_n mayor_n and_o court_n of_o alderman_n shall_v and_o may_v from_o time_n to_o time_n limit_n rate_n and_o appoint_v the_o wage_n of_o the_o say_a artificer_n workman_n and_o labourer_n by_o the_o day_n wéek_v or_o otherwise_o and_o what_o wage_n every_o of_o the_o say_a workman_n shall_v have_v by_o the_o great_a by_o the_o foot_n of_o the_o say_a artificer_n refuse_v to_o sell_v the_o say_v material_n for_o the_o price_n so_o assess_v or_o any_o of_o the_o say_a carpenter_n bricklayer_n mason_n plasterer_n joiner_n plumber_n or_o other_o workman_n or_o labourer_n shall_v either_o refuse_v to_o work_v for_o the_o wage_n so_o assess_v or_o shall_v depart_v from_o his_o say_a work_n after_o he_o have_v undertake_v to_o do_v the_o same_o without_o licence_n of_o such_o person_n or_o person_n as_o employ_v he_o and_o before_o it_o be_v finish_v unless_o it_o be_v for_o nonpayment_n of_o his_o hire_n or_o other_o just_a cause_n to_o be_v allow_v before_o one_o justice_n of_o the_o peace_n of_o such_o place_n where_o the_o offence_n shall_v be_v commit_v or_o if_o any_o person_n or_o person_n whatsoever_o shall_v by_o any_o secret_a way_n or_o mean_v give_v covenant_n article_n or_o agree_v to_o give_v direct_o or_o indirect_o by_o himself_o or_o any_o other_o for_o he_o any_o other_o or_o great_a wage_n price_n the_o say_a building_n shall_v be_v full_o finish_v have_v and_o enjoy_v such_o and_o the_o same_o liberty_n of_o work_v and_o be_v set_v to_o work_v in_o the_o say_a building_n as_o the_o fréeman_n of_o the_o city_n of_o the_o same_o trade_n and_o profession_n have_v and_o aught_o to_o enjoy_v any_o usage_n or_o custom_n of_o the_o city_n to_o the_o contrary_a notwithstanding_o and_o that_o the_o ward_n where_o the_o cause_n of_o any_o such_o difference_n shall_v arise_v and_o his_o deputy_n and_o if_o either_o the_o say_a alderman_n or_o his_o deputy_n be_v concern_v as_o party_n in_o
