reply_v for_o alexander_n monro_n of_o bearcrofts_n to_o the_o answer_v make_v to_o the_o petition_n and_o information_n present_v by_o he_o to_o the_o commissiom_a his_o grace_n and_o estate_n of_o parliament_n whereas_o the_o answerer_n in_o his_o preface_n crave_v leave_v to_o represent_v the_o point_n of_o fact_n thereby_o profess_v to_o clear_v the_o parliament_n how_o far_o alexander_n monro_n desire_n in_o the_o foresay_a petition_n be_v contrare_fw-la to_o the_o rule_n of_o justice_n and_o in_o order_n to_o which_o clear_v state_n the_o matter_n of_o fact_n so_o as_o thereby_o and_o in_o the_o answerers_n intention_n to_o demonstrate_v that_o there_o can_v be_v but_o three_o clerk_n of_o session_n viz._n one_o for_o each_o office_n and_o that_o particular_o in_o the_o year_n 1594_o and_o 1621._o act_n of_o sederunt_fw-la be_v make_v appoint_v only_o three_o principal_a clerk_n and_o that_o no_o other_o clerk_n shall_v be_v join_v but_o of_o consent_n of_o these_o principal_n for_o the_o future_a and_o that_o the_o say_a act_n of_o sederunt_fw-la be_v ratify_v in_o parliament_n and_o that_o there_o be_v no_o legal_a title_n for_o appoint_v two_o clerk_n in_o each_o office_n till_o tarbat_n procure_v the_o same_o by_o a_o letter_n from_o the_o king_n ratify_v in_o parliament_n anno_fw-la 1685_o and_o upon_o all_o this_o insinuate_a that_o the_o petitioner_n right_a to_o one_o of_o the_o office_n of_o clerkship_n in_o conjunction_n with_o mr_n john_n hay_n in_o the_o year_n 1669_o be_v illegal_a and_o therefore_o that_o the_o thrust_v of_o he_o out_o by_o a_o impetrate_v letter_n from_o the_o king_n be_v no_o act_n of_o wrong_n especial_o see_v that_o any_o colour_n of_o right_a sir_n archibald_n primrose_n then_o register_n have_v by_o his_o gift_n to_o present_v the_o petitioner_n be_v a_o surrepticious_o insert_v clause_n into_o the_o say_a sir_n archibald_n his_o gift_n relative_a unto_o his_o name_n of_o depute_v one_o or_o more_o in_o each_o of_o the_o office_n after_o that_o sir_n archibald_n have_v abstract_v the_o record_n of_o the_o year_n 1621._o which_o do_v bear_v the_o act_n of_o sederunt_fw-la anent_o three_o clerk_n only_o record_v therein_o and_o also_o that_o the_o petitioner_n become_v troublesome_a to_o the_o lord_n in_o the_o year_n 1674_o which_o occasion_v the_o procure_v the_o king_n letter_n for_o turn_v he_o out_o and_o consequent_o that_o the_o petitioner_n can_v in_o justice_n be_v repon_v to_o the_o office_n of_o clerkship_n especial_o see_v he_o accept_v 7000_o mark_n as_o a_o adequate_a price_n modify_v therefore_o and_o thereupon_o renunce_v the_o office_n reply_v that_o the_o anwerer_n consider_v the_o mistake_n alsewell_n as_o the_o irrevolancie_n of_o these_o point_n of_o fact_n accumulate_v by_o he_o have_v good_a reason_n to_o crave_v leave_n for_o his_o adventure_n by_o such_o a_o ingenious_a contexture_n of_o word_n to_o impose_v upon_o the_o world_n in_o stead_n of_o clear_v the_o parliament_n of_o the_o truth_n and_o that_o all_o the_o abovementioned_a story_n ought_v to_o derogate_v nothing_o from_o the_o sufficiency_n of_o alexander_n monro_n title_n to_o the_o clerkship_n in_o point_n of_o right_n nor_o yet_o hinder_v he_o from_o be_v restore_v in_o justice_n to_o his_o say_a office_n notwithstanding_o of_o his_o recept_n of_o the_o 7000_o mark_n and_o discharge_v his_o office_n thereupon_o be_v clear_o evident_a from_o the_o unanswerable_a ground_n follow_v viz._n 1mo_fw-la that_o as_o to_o the_o pretend_a act_n of_o sederunt_fw-la in_o the_o year_n 1621._o the_o answerer_n confess_v there_o be_v no_o such_o act_n and_o therefore_o he_o ought_v not_o to_o sound_v thereupon_o nor_o consequent_o upon_o the_o in_o the_o custody_n of_o the_o clerk_n of_o session_n but_o which_o total_o take_v off_o the_o say_a reflection_n sir_n archibald_n have_v no_o temptation_n thereto_o for_o the_o whole_a six_o clerk_n come_v in_o uniform_o upon_o recommendation_n to_o he_o so_o that_o there_o be_v no_o use_n for_o any_o indirect_a method_n 2do_fw-la that_o the_o pretend_a act_n of_o sederunt_fw-la in_o
