sacrament_n during_o her_o marriage_n nor_o that_o any_o woman_n shall_v be_v charge_v or_o chargeable_a with_o any_o penalty_n or_o forfeiture_n by_o force_n of_o this_o act_n for_o any_o such_o offence_n of_o not_o receive_v which_o shall_v happen_v during_o her_o marriage_n with_o any_o penalty_n or_o forfeiture_n by_o force_n of_o this_o act._n sacrament_n feme_fw-fr covert_n not_o receive_v the_o sacrament_n but_o yet_o a_o marry_a woman_n may_v be_v punish_v by_o force_n of_o any_o other_o act_n for_o not_o receive_v the_o sacrament_n during_o her_o marriage_n co._n 11.64_o their_o place_n of_o usual_a dwell_n and_o abode_n or_o not_o have_v any_o certain_a place_n of_o dwell_v or_o abode_n within_o this_o realm_n shall_v likewise_o within_o the_o time_n limit_v by_o the_o say_a statute_n repair_v to_o the_o place_n where_o such_o person_n be_v bear_v or_o where_o the_o father_n or_o mother_n of_o such_o person_n shall_v be_v dwell_v and_o not_o at_o any_o time_n licence_n unto_o the_o say_a recusant_n to_o go_v and_o travel_v from_o or_o out_o of_o the_o compass_n of_o the_o say_v five_o mile_n shall_v be_v from_o and_o after_o the_o end_n of_o this_o present_a session_n of_o parliament_n utter_o repeal_v and_o void_a any_o thing_n in_o the_o say_a statute_n to_o the_o contrary_a notwithstanding_o then_o or_o after_o convict_v vide_fw-la sect._n the_o justice_n of_o peace_n and_o not_o of_o the_o other_o licence_n give_v by_o 35._o in_o several_a other_o case_n so_o that_o the_o proviso_n there_o permit_v the_o popish_a recusant_n to_o travel_v in_o case_n of_o process_n or_o commandment_n by_o privy_a counsellor_n or_o the_o queen_n commissioner_n or_o proclamation_n to_o render_v his_o body_n to_o the_o sheriff_n remain_z still_o or_o liberty_n under_o their_o hand_n and_o seal_n in_o every_o of_o which_o licence_n or_o licence_n in_o write_v so_o to_o be_v have_v and_o make_v shall_v be_v specify_v and_o contain_v both_o the_o particular_a cause_n of_o the_o say_a licence_n and_o the_o time_n how_o long_o the_o say_a party_n license_v shall_v be_v absent_a in_o travel_v attend_v and_o return_v it_o shall_v and_o may_v thereupon_o be_v lawful_a for_o every_o such_o person_n so_o licence_v to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n person_n to_o be_v licence_v by_o the_o king_n or_o privy_a counsellor_n and_o the_o person_n to_o be_v license_v by_o the_o justice_n of_o peace_n the_o only_a difference_n be_v in_o the_o manner_n of_o grant_v the_o licence_n the_o power_n give_v to_o the_o king_n or_o privy_a counsellor_n be_v more_o absolute_a and_o not_o under_o such_o precaution_n as_o be_v that_o which_o be_v give_v to_o the_o justice_n of_o peace_n for_o the_o king_n or_o privy_a counsellor_n may_v grant_v a_o licence_n to_o the_o recusant_n to_o travel_v without_o any_o particular_a cause_n show_v in_o the_o licence_n or_o the_o assent_n of_o any_o other_o person_n and_o without_o any_o oath_n to_o be_v make_v by_o the_o recusant_n which_o the_o justice_n of_o peace_n can_v do_v and_o there_o be_v no_o reason_n to_o think_v that_o the_o power_n here_o give_v to_o the_o king_n or_o privy_a counsellor_n which_o in_o all_o other_o particular_n be_v so_o much_o more_o absolute_a and_o extensive_a then_o that_o give_v to_o the_o justice_n of_o peace_n shall_v be_v yet_o less_o extensive_a as_o to_o the_o person_n to_o be_v license_v second_o it_o be_v absurd_a to_o think_v that_o the_o maker_n of_o the_o law_n intend_v to_o confer_v a_o great_a privilege_n upon_o the_o recusant_n convict_v who_o offence_n appear_v upon_o record_n then_o to_o such_o as_o be_v not_o convict_v et_fw-la ealis_fw-la and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z corporal_z sergeant_z ancient-bearer_n or_o other_o office_n in_o camp_n troup_n band_n or_o company_n of_o soldier_n nor_o shall_v be_v captain_n master_n governor_z or_o bear_v any_o office_n or_o part_n of_o his_o land_n imprison_v by_o process_n of_o law_n or_o for_o some_o other_o cause_v not_o relate_v to_o such_o conviction_n and_o afterward_o be_v set_v at_o liberty_n it_o seem_v that_o the_o husband_n shall_v not_o pay_v the_o ten_o pound_n per_fw-la month_n for_o the_o time_n she_o be_v in_o prison_n for_o the_o act_n speak_v only_o of_o the_o time_n during_o which_o she_o continue_v out_o of_o prison_n and_o although_o she_o be_v not_o imprison_v for_o her_o recusancy_n yet_o see_v she_o have_v not_o during_o such_o her_o imprisonment_n the_o benefit_n intend_v to_o she_o in_o consideration_n of_o the_o ten_o pound_n per_fw-la month_n or_o three_o part_n viz._n her_o liberty_n the_o husband_n shall_v not_o for_o that_o time_n pay_v the_o penalty_n here_o appoint_v to_o save_v her_o imprisonment_n but_o if_o he_o pay_v it_o for_o the_o time_n after_o she_o be_v set_v at_o liberty_n that_o be_v sufficient_a to_o satisfy_v the_o intent_n of_o this_o act._n but_o if_o after_o such_o conviction_n imprisonment_n covinous_a imprisonment_n the_o wife_n be_v imprison_v by_o covin_z upon_o some_o pretence_n not_o relate_v to_o such_o conviction_n that_o shall_v not_o save_v the_o husband_n payment_n of_o the_o ten_o pound_n per_fw-la month_n for_o the_o time_n she_o be_v imprison_v but_o after_o she_o be_v set_v at_o liberty_n she_o may_v be_v again_o imprison_v by_o force_n of_o this_o act_n unless_o the_o husband_n pay_v the_o ten_o pound_n per_fw-la month_n or_o satisfy_v to_o the_o king_n the_o three_o part_n of_o the_o profit_n of_o his_o land_n as_o well_o for_o the_o time_n of_o such_o covinous_a imprisonment_n as_o for_o the_o future_a for_o the_o covinous_a imprisonment_n be_v upon_o the_o matter_n she_o own_o act_n and_o no_o person_n shall_v take_v advantage_n of_o a_o imprisonment_n covinous_o cause_v by_o he_o or_o herself_o 16_o e._n 4._o 5._o and_o here_o she_o continue_v out_o of_o prison_n in_o the_o sense_n of_o this_o act_n because_o her_o imprisonment_n be_v not_o by_o process_n of_o law_n in_o invitam_fw-la covin_z outlawry_n by_o covin_z and_o so_o if_o a_o man_n be_v outlaw_v while_o he_o be_v in_o prison_n yet_o the_o outlawry_n shall_v not_o be_v avoid_v for_o that_o cause_n if_o the_o imprisonment_n be_v by_o covin_z or_o consent_n of_o the_o party_n outlaw_v co._n 1._o inst._n 259._o 38._o assiz_n pl._n 17._o stat._n three_o car._n i_o cap._n two_o a_o act_n to_o restrain_v the_o pass_a or_o send_v of_o any_o to_o be_v popish_o breed_v beyond_o the_o sea_n forasmuch_o as_o divers_a ill_n affect_v person_n to_o the_o true_a religion_n establish_v within_o this_o realm_n 1_o stat._n sect._n 1_o have_v send_v their_o child_n into_o foreign_a part_n to_o be_v breed_v up_o in_o obedience_n of_o the_o king_n his_o heir_n and_o successor_n life_n he_o that_o go_v himself_o or_o send_v any_o other_o beyond_o the_o sea_n to_o be_v train_v up_o in_o popery_n etc._n etc._n shall_v be_v disable_v to_o sue_v etc._n etc._n and_o shall_v lose_v all_o his_o good_n and_o shall_v forfeit_v all_o his_o land_n etc._n etc._n for_o life_n at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n shall_v pass_v or_o go_v or_o shall_v convey_v or_o send_v or_o cause_n to_o be_v send_v or_o convey_v any_o child_n or_o other_o person_n out_o of_o any_o of_o the_o king_n dominion_n into_o any_o the_o part_n beyond_o the_o sea_n out_o of_o the_o king_n obedience_n to_o the_o intent_n and_o purpose_n to_o enter_v into_o or_o be_v resident_a or_o train_v up_o in_o any_o priory_n abbey_n nunnery_n popish_a university_n college_n or_o school_n or_o house_n of_o jesuite_n priest_n or_o in_o any_o private_a popish_a family_n and_o shall_v be_v there_o by_o any_o
