protection_n of_o the_o king_n de_fw-fr facto_fw-la and_o in_o return_n for_o they_o be_v bind_v to_o pay_v he_o their_o allegiance_n by_o the_o law_n of_o gratitude_n or_o 2_o lie_v because_o the_o king_n de_fw-fr facto_fw-la have_v the_o life_n and_o fortune_n of_o the_o subject_n at_o his_o mercy_n and_o therefore_o it_o be_v at_o least_o lawful_a for_o they_o when_o their_o rightful_a king_n can_v rescue_v they_o out_o of_o his_o hand_n to_o swear_v a_o new_a allegiance_n to_o he_o 1._o the_o subject_n enjoy_v all_o the_o common_a benefit_n of_o civil_a government_n from_o this_o protection_n of_o the_o king_n de_fw-fr facto_fw-la and_o therefore_o in_o return_n for_o they_o be_v oblige_v to_o pay_v he_o their_o allegiance_n by_o the_o law_n of_o gratitude_n to_o this_o i_o protect_v they_o be_v not_o his_o own_o but_o the_o lawful_a king_n and_o he_o first_o deprive_v the_o subject_n of_o the_o lawful_a king_n protection_n before_o he_o tender_v they_o his_o own_o and_o therefore_o in_o effect_n take_v away_o from_o they_o as_o much_o as_o he_o give_v and_o beside_o invade_v the_o subject_n right_n who_o be_v not_o oblige_v to_o be_v subject_a to_o any_o but_o their_o lawful_a prince_n and_o his_o not_o deprive_v they_o of_o protection_n be_v only_o forbear_v do_v they_o a_o far_a injury_n so_o that_o though_o they_o reap_v some_o benefit_n from_o his_o protection_n and_o aught_o in_o prudence_n to_o comply_v with_o he_o as_o far_o as_o it_o be_v lawful_a yet_o it_o do_v not_o seem_v that_o they_o be_v oblige_v to_o it_o upon_o the_o score_n of_o lawful_o transfer_v their_o allegiance_n to_o he_o for_o that_o be_v not_o their_o own_o to_o give_v but_o there_o be_v still_o a_o reserve_n of_o it_o due_a to_o the_o rightful_a king_n when_o it_o can_v be_v exert_v for_o his_o service_n 2._o but_o second_o the_o king_n de_fw-fr facto_fw-la have_v their_o life_n and_o fortune_n at_o his_o mercy_n and_o therefore_o it_o be_v at_o least_o lawful_a for_o they_o when_o the_o king_n de_fw-fr jure_fw-la can_v rescue_v they_o out_o of_o his_o hand_n to_o save_v their_o life_n and_o mean_n of_o subsistence_n by_o swear_v allegiance_n to_o that_o person_n who_o have_v they_o in_o his_o power_n to_o this_o i_o answer_v that_o swear_v allegiance_n '_o imply_v two_o thing_n 1._o a_o full_a and_o entire_a submission_n so_o as_o never_o to_o because_o their_o death_n deprive_v the_o king_n of_o so_o many_o of_o his_o subject_n and_o their_o engage_v never_o to_o act_n for_o he_o do_v no_o more_o and_o be_v but_o the_o same_o as_o if_o they_o shall_v take_v quarter_n of_o a_o enemy_n in_o war_n that_o have_v they_o at_o his_o mercy_n and_o this_o may_v be_v true_a where_o there_o be_v so_o service_n to_o be_v do_v to_o their_o king_n cause_n and_o the_o true_a profession_n of_o the_o principle_n of_o loyalty_n by_o their_o suffer_a death_n and_o sacrifice_v their_o own_o life_n towards_o the_o recovery_n of_o a_o nation_n from_o a_o principle_n of_o rebellion_n to_o a_o true_a sense_n of_o their_o allegiance_n but_o in_o most_o usurpation_n there_o be_v first_o a_o rebellion_n of_o the_o subject_n and_o a_o apostasy_n from_o he_o principle_n of_o loyalty_n and_o in_o this_o case_n it_o may_v be_v consider_v whether_o any_o who_o example_n may_v have_v influence_n upon_o the_o 〈◊〉_d of_o the_o nation_n may_v not_o be_v oblige_v even_o to_o loose_v their_o life_n for_o the_o king_n de_fw-fr jure_fw-la because_o here_o their_o death_n may_v do_v some_o service_n to_o religion_n and_o the_o king_n cause_n whereas_o in_o war_n their_o die_v rather_o then_o to_o take_v quarter_n and_o make_v themselves_o captive_n to_o a_o enemy_n that_o have_v their_o life_n at_o his_o mercy_n will_v do_v their_o king_n so_o service_n at_o all_o 2._o allegiance_n import_v a_o engagement_n of_o the_o subject_n to_o stand_v by_o and_o maintain_v the_o king_n in_o possession_n against_o the_o king_n de_fw-fr jure_fw-la and_o this_o if_o any_o of_o they_o engage_v to_o do_v the_o king_n de_fw-fr jure_fw-la do_v more_o than_o than_o lose_v a_o subject_a for_o he_o get_v a_o enemy_n who_o if_o he_o act_n according_a to_o his_o new_a engagement_n be_v oblige_v even_o to_o oppose_v he_o to_o the_o death_n if_o he_o endeavour_v to_o recover_v his_o crown_n but_o why_o may_v not_o this_o be_v do_v since_o the_o end_n for_o which_o man_n be_v place_v under_o a_o government_n be_v the_o preservation_n of_o their_o life_n and_o property_n and_o therefore_o when_o that_o protection_n fail_v they_o whereby_o they_o shall_v be_v preserve_v without_o any_o fault_n of_o their_o own_o their_o rightful_a king_n be_v depose_v or_o exclude_v and_o unable_a at_o present_a to_o recover_v his_o right_n and_o they_o at_o the_o subject_n be_v due_a to_o the_o king_n for_o the_o time_n be_v but_o only_o oblique_o suppose_v and_o insinuate_v it_o the_o king_n be_v say_v to_o call_v to_o his_o remembrance_n his_o subject_n duty_n of_o allegiance_n and_o that_o they_o by_o virtue_n of_o it_o be_v bind_v to_o fight_v for_o the_o king_n for_o the_o time_n be_v etc._n etc._n this_o be_v not_o to_o declare_v it_o facto_fw-la be_v do_v their_o true_a duty_n and_o service_n of_o allegiance_n and_o if_o this_o be_v only_o suppose_v and_o that_o supposition_n have_v no_o ground_n neither_o in_o the_o fundamental_a constitution_n of_o the_o realm_n nor_o in_o any_o former_a statute_n or_o custom_n but_o these_o all_o do_v all_o of_o they_o clear_o demonstrate_v the_o contrary_a as_o be_v show_v above_o then_o i_o think_v the_o preamble_n of_o this_o statute_n can_v be_v urge_v upon_o the_o conscience_n of_o the_o subject_n as_o a_o law_n oblige_v they_o to_o transfer_v their_o allegiance_n from_o their_o
