power_n save_v the_o king_n sovereign_a power_n i_o shall_v endeavour_v to_o give_v some_o answer_n to_o the_o reason_n give_v by_o the_o lord_n the_o first_o be_v that_o it_o be_v the_o intention_n that_o he_o will_v assign_v the_o particular_a that_o we_o may_v give_v a_o answer_n thereunto_o by_o our_o petition_n we_o only_o desire_v our_o particular_a right_n and_o liberty_n to_o be_v confirm_v to_o we_o and_o therefore_o it_o be_v not_o proper_a for_o we_o in_o it_o to_o mention_v sovereign_a power_n in_o general_n be_v altogether_o impertinent_a to_o the_o matter_n in_o the_o petition_n there_o be_v a_o great_a difference_n between_o the_o word_n of_o the_o addition_n and_o the_o word_n propose_v therein_o for_o reason_n viz._n between_o just_a power_n which_o may_v be_v conceive_v to_o be_v limit_v by_o law_n and_o sovereign_a power_n which_o be_v suppose_v to_o be_v transcendent_a and_o boundless_a the_o second_o reason_n deliver_v by_o their_o lordship_n be_v that_o the_o king_n be_v sovereign_a that_o as_o he_o be_v sovereign_a he_o have_v power_n and_o that_o that_o sovereign_a power_n be_v to_o leave_v for_o my_o part_n i_o will_v leave_v it_o so_o as_o not_o to_o mention_v it_o but_o if_o it_o shall_v be_v express_v to_o be_v leave_v in_o this_o petition_n as_o it_o be_v propose_v it_o must_v admit_v something_o to_o be_v leave_v in_o the_o king_n of_o what_o we_o pray_v or_o at_o least_o admit_v some_o sovereign_a power_n in_o his_o majesty_n in_o these_o privilege_n which_o we_o claim_v to_o be_v our_o right_n which_o will_v frustrate_v our_o petition_n and_o destroy_v our_o right_n as_o i_o have_v former_o show_v the_o three_o reason_n give_v from_o this_o addition_n be_v that_o in_o the_o statute_n articuli_fw-la super_fw-la chartas_n there_o be_v a_o save_n of_o the_o right_n and_o seignory_n of_o the_o crown_n to_o which_o i_o give_v these_o answer_n that_o magna_fw-la charta_fw-la be_v confirm_v above_o 30_o time_n and_o a_o all_o those_o case_n the_o king_n do_v will_n and_o all_o those_o that_o be_v at_o the_o make_n of_o that_o ordinance_n do_v intend_v that_o the_o right_n and_o seignory_n of_o the_o crown_n shall_v be_v save_v by_o which_o it_o appear_v that_o the_o save_n be_v not_o in_o the_o petition_n of_o the_o commons_o but_o add_v by_o the_o king_n for_o in_o the_o petition_n the_o king_n will_v be_v no_o but_o yet_o our_o eden_n in_o this_o garden_n of_o the_o commonwealth_n as_o there_o be_v the_o flower_n of_o the_o sun_n which_o be_v so_o glorious_a that_o they_o be_v to_o be_v handle_v only_o by_o royal_a majesty_n so_o be_v there_o also_o some_o daisy_n and_o wholesome_a herb_n which_o every_o common_a hand_n that_o live_v and_o labour_n in_o this_o garden_n may_v pick_v and_o gather_v up_o and_o take_v comfort_n and_o repose_v in_o they_o among_o all_o which_o this_o oculus_fw-la diei_fw-la this_o bona_fw-la libertas_fw-la be_v one_o and_o the_o chief_n one_o thus_o much_o in_o all_o humbleness_n i_o presume_v to_o speak_v for_o the_o occasion_n i_o will_v now_o descend_v to_o the_o question_n wherein_o i_o hold_v with_o all_o dutiful_a submission_n to_o better_a judgement_n that_o these_o act_n of_o power_n in_o imprison_a and_o confine_v of_o his_o majesty_n subject_n in_o such_o manner_n without_o any_o declaration_n of_o the_o cause_n be_v against_o the_o fundamental_a law_n and_o liberty_n of_o this_o kingdom_n and_o for_o these_o reason_n thus_o brief_o draw_v i_o conclude_v 1._o the_o first_o from_o the_o great_a favour_n which_o the_o law_n do_v so_o much_o favour_v the_o subject_n liberty_n of_o his_o person_n that_o the_o body_n of_o a_o man_n be_v not_o liable_a to_o be_v arrest_v or_o imprison_v for_o any_o other_o cause_n at_o the_o common_a law_n but_o for_o force_n and_o thing_n do_v against_o the_o peace_n for_o the_o common_a law_n be_v the_o preserver_n of_o the_o land_n so_o abhor_v force_n that_o those_o that_o commit_v it_o she_o account_n her_o capital_a enemy_n &_o therefore_o do_v subject_a their_o body_n to_o imprisonment_n but_o by_o the_o statute_n of_o marlebridge_n cap._n 24._o which_o be_v make_v 35._o hen._n 3._o who_o be_v the_o eight_o king_n from_o the_o conquest_n because_o bailiff_n will_v not_o render_v account_n to_o their_o lord_n it_o be_v enact_v that_o their_o body_n shall_v be_v commitment_n or_o upon_o the_o return_n of_o the_o habeas_fw-la corpus_fw-la before_o i_o speak_v to_o the_o question_n itself_o i_o shall_v propose_v some_o observation_n in_o my_o conceit_n necessary_o conduce_v to_o the_o debate_n of_o the_o matter_n 1._o that_o we_o ought_v to_o take_v care_n and_o to_o provide_v for_o posterity_n as_o our_o predecessor_n have_v do_v for_o we_o and_o of_o explanation_n we_o shall_v provide_v only_o that_o the_o cause_n ought_v to_o be_v express_v upon_o the_o return_n of_o the_o habeas_fw-la corpus_fw-la then_o out_o of_o the_o word_n of_o the_o the_o end_n no_o cause_n be_v return_v the_o party_n may_v be_v discharge_v but_o in_o the_o mean_a time_n he_o shall_v have_v imprisonment_n he_o shall_v never_o know_v the_o cause_n he_o shall_v have_v no_o remedy_n for_o it_o nor_o be_v able_a to_o question_v any_o for_o injustice_n which_o have_v not_o a_o justification_n or_o excuse_v by_o this_o law_n 4._o the_o party_n may_v be_v imprison_v during_o his_o life_n and_o yet_o there_o shall_v be_v no_o cause_n ever_o show_v i_o will_v instance_n in_o the_o manner_n a_o man_n may_v be_v commit_v to_o the_o further_a part_n of_o the_o kingdom_n westward_o he_o obtain_v a_o habeas_fw-la corpus_fw-la before_o the_o gaoler_n receive_v the_o habeas_fw-la corpus_fw-la or_o before_o the_o return_v it_o the_o prisoner_n by_o by_o this_o bill_n 5._o if_o the_o prisoner_n be_v bring_v into_o the_o court_n by_o habeas_fw-la corpus_fw-la and_o no_o cause_n express_v and_o thereupon_o he_o be_v enlarge_v he_o may_v be_v partly_o commit_v again_o and_o then_o his_o enlargement_n shall_v only_o make_v way_n for_o his_o commitment_n and_o this_o may_v continue_v during_o his_o life_n and_o he_o shall_v never_o know_v his_o fee_n to_o the_o gaoler_n his_o cost_n in_o obtain_v and_o prosecute_n a_o habeas_fw-la corpus_fw-la and_o his_o charge_n in_o remove_v himself_o attend_v with_o such_o as_o have_v the_o charge_n of_o his_o conduct_n and_o
that_o the_o prisoner_n must_v sustain_v all_o without_o satisfaction_n or_o know_v the_o cause_n the_o only_a reason_n give_v by_o those_o of_o the_o other_o opinion_n that_o it_o be_v requisite_a the_o king_n and_o council_n shall_v have_v power_n to_o command_v the_o detainer_n of_o a_o man_n in_o prison_n for_o sometime_o without_o express_v the_o cause_n be_v because_o it_o be_v suppose_v that_o the_o manifestation_n of_o the_o cause_n at_o first_o may_v prevent_v the_o discovery_n of_o a_o treason_n the_o reason_n be_v answer_v by_o the_o remedy_n propose_v by_o this_o act_n it_o be_v propose_v that_o it_o shall_v be_v provide_v by_o this_o bill_n that_o upon_o our_o commitment_n we_o may_v have_v instant_o recourse_n to_o the_o chancery_n for_o a_o habeas_fw-la corpus_fw-la retornable_a in_o that_o court_n which_o be_v always_o open_a that_o partly_o upon_o the_o receipt_n thereof_o the_o writ_n must_v be_v return_v and_o the_o cause_n thereupon_o express_v if_o then_o this_o remedy_n be_v real_o the_o cause_n of_o commitment_n must_v partly_o appear_v which_o contradict_v the_o former_a reason_n of_o state_n and_o in_o my_o own_o opinion_n we_o ought_v not_o only_o
