of_o felony_n shall_v suffer_v pain_n of_o death_n without_o benefit_n of_o the_o clergy_n provide_v nevertheless_o that_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o any_o person_n or_o person_n which_o now_o be_v or_o have_v be_v in_o the_o service_n or_o employment_n of_o any_o foreign_a prince_n state_n or_o potentate_n whatsoever_o that_o shall_v return_v to_o jurisdiction_n shall_v be_v inquire_v try_v hear_v determine_a and_o judge_v within_o this_o island_n in_o such_o like_a form_n as_o if_o such_o offence_n have_v be_v commit_v in_o and_o upon_o the_o it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o commission-officer_n in_o their_o several_a precinct_n within_o this_o island_n be_v hereby_o require_v and_o empower_v upon_o his_o or_o their_o knowledge_n or_o notice_n give_v that_o any_o privateer_n pirate_n or_o other_o person_n suspect_v to_o be_v upon_o any_o unlawful_a design_n be_v in_o any_o place_n within_o their_o respective_a precinct_n to_o raise_v and_o levy_v such_o a_o number_n of_o well_o arm_a man_n as_o he_o or_o they_o shall_v think_v needful_a for_o the_o seize_v apprehend_v and_o carry_v to_o channel_n through_o the_o same_o or_o any_o other_o thing_n do_v by_o the_o authority_n of_o this_o act_n the_o defendant_n in_o any_o such_o action_n or_o suit_n shall_v plead_v the_o general_n issue_n &_o give_v this_o act_n in_o evidence_n whereupon_o issue_n shall_v be_v join_v and_o the_o jury_n shall_v find_v for_o the_o defendant_n and_o assess_v treble_a damage_n for_o his_o they_o and_o satisfaction_n shall_v be_v make_v to_o the_o owner_n of_o such_o land_n out_o of_o the_o money_n so_o to_o be_v assess_v and_o levy_v as_o aforesaid_a and_o whatsoever_o land_n shall_v be_v recover_v by_o mean_n of_o draining_n what_o now_o be_v overslown_n shall_v belong_v to_o the_o first_o proprietor_n and_o that_o this_o act_n continue_v in_o force_n for_o the_o term_n of_o five_o year_n and_o no_o long_o any_o thing_n in_o this_o act_n or_o any_o other_o seem_v to_o the_o contrary_a notwithstanding_o a_o act_n for_o regulate_v building_n and_o prevent_a fire_n be_v it_o enact_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n of_o the_o same_o that_o no_o person_n whatsoever_o presume_v to_o build_v any_o house_n at_o port-royal_a within_o thirty_o foot_n of_o the_o high-water_n mark_n and_o that_o when_o any_o house_n or_o house_n be_v already_o build_v or_o hereafter_o shall_v be_v build_v on_o the_o harbour_n side_n near_o than_o thirty_o foot_n of_o the_o high-water_n mark_n the_o wherry_n place_v only_o accept_v such_o house_n or_o house_n so_o build_v or_o to_o be_v build_v shall_v and_o be_v hereby_o adjudge_v deem_v and_o take_v to_o be_v public_a nuisance_n and_o the_o proprietor_n or_o proprietor_n of_o the_o same_o shall_v cause_v such_o house_n or_o house_n build_v thereon_o to_o be_v take_v down_o and_o remove_v within_o six_o month_n after_o conviction_n thereof_o or_o otherwise_o build_v or_o cause_n to_o be_v build_v within_o six_o month_n a_o strong_a substantial_a wharf_n so_o as_o the_o same_o may_v make_v a_o firm_a passage_n or_o way_n of_o thirty_o foot_n from_o high-water_n mark._n provide_v that_o no_o house_n shall_v be_v build_v further_a northward_o on_o the_o harbour_n than_o major_a samuel_n bach_n and_o captain_n anthony_n swimmer_n on_o any_o land_n wharf_v or_o to_o be_v wharf_v out_o between_o fort_n james_n and_o fort_n carlisle_n but_o that_o all_o land_n so_o make_v out_o of_o the_o harbour_n or_o to_o be_v make_v shall_v remain_v unbuilt_a on_o and_o be_v it_o further_o enact_v and_o declare_v by_o the_o aforesaid_a authority_n that_o when_o any_o fire_n shall_v happen_v to_o break_v out_o either_o at_o port-royal_a or_o at_o any_o other_o town_n already_o build_v or_o which_o hereafter_o shall_v be_v build_v within_o this_o island_n that_o two_o or_o three_o of_o the_o chief_a military_a or_o civil_a officer_n of_o the_o same_o town_n or_o parish_n shall_v or_o may_v and_o hereby_o be_v empower_v to_o give_v all_o such_o direction_n for_o the_o pull_v down_o or_o blow_v up_o any_o such_o house_n or_o house_n that_o shall_v be_v by_o they_o adjudge_v meet_a to_o be_v pull_v down_o or_o blow_v up_o for_o the_o stop_n and_o prevent_v the_o further_o spread_v of_o the_o same_o and_o if_o it_o shall_v happen_v that_o the_o pull_v down_o or_o blow_v up_o any_o such_o house_n or_o house_n by_o the_o direction_n aforesaid_a shall_v be_v the_o occasion_n of_o stop_v the_o say_a fire_n or_o the_o fire_n stop_v before_o it_o come_v to_o the_o same_o than_o all_o and_o every_o owner_n of_o such_o house_n and_o house_n shall_v receive_v satisfaction_n and_o be_v pay_v for_o the_o same_o by_o the_o rest_n of_o the_o inhabitant_n who_o house_n shall_v not_o be_v burn_v who_o be_v hereby_o empower_v to_o make_v spread_v and_o increase_n of_o the_o same_o that_o then_o the_o owner_n of_o such_o house_n shall_v receive_v no_o manner_n of_o satisfaction_n for_o the_o same_o any_o thing_n in_o this_o act_n or_o any_o other_o act_n to_o the_o contrary_a notwithstanding_o and_o whereas_o it_o may_v be_v doubt_v that_o the_o sea_n may_v encroach_v upon_o the_o southward_n part_n of_o the_o town_n of_o port-royal_a for_o the_o prevention_n whereof_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o all_o proprietor_n or_o owner_n of_o land_n or_o house_n their_o factor_n agent_n attorney_n and_o guardian_n of_o child_n or_o any_o person_n employ_v by_o they_o or_o any_o of_o they_o that_o be_v interest_v on_o the_o southermost_a part_n of_o port-royal_a from_o fort_n rupert_n to_o the_o house_n and_o land_n now_o inhabit_a by_o one_o edward_n watkins_n and_o know_v by_o the_o sign_n of_o the_o blue_a bell_n be_v hereby_o enjoin_v and_o oblige_v by_o this_o act_n within_o twelve_o month_n after_o publication_n hereof_o substantial_o to_o wharf_n out_o and_o secure_a and_o keep_v secure_v their_o respective_a proportion_n of_o land_n join_v on_o the_o sea_n with_o substantial_a wharf_n of_o last_a timber_n at_o least_o one_o foot_n into_o the_o sea_n under_o the_o penalty_n of_o ten_o pound_n currant_n money_n of_o this_o island_n for_o every_o year_n any_o such_o person_n or_o person_n shall_v neglect_v the_o same_o one_o three_o part_n thereof_o to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o use_n of_o the_o poor_a and_o the_o other_o three_o part_n to_o the_o informer_n or_o he_o that_o shall_v sue_v for_o the_o same_o in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v be_v allow_v and_o that_o the_o owner_n or_o proprietor_n of_o such_o land_n or_o house_n as_o aforesaid_a may_v be_v the_o better_o encourage_v to_o wharf_n out_o as_o be_v before_o appoint_v the_o street_n now_o call_v the_o church_n street_n shall_v be_v no_o more_o deem_v account_v or_o take_v for_o a_o street_n but_o shall_v be_v add_v or_o annex_v to_o each_o propriety_n and_o freehold_a in_o proportion_n to_o their_o respective_a interest_n bound_v upon_o the_o same_o for_o which_o consideration_n they_o be_v hereby_o oblige_v to_o leave_v a_o passage_n at_o least_o eighteen_o foot_n open_a to_o the_o sea_n provide_v that_o nothing_o in_o any_o clause_n of_o this_o act_n shall_v permit_v and_o suffer_v any_o person_n or_o person_n whatsoever_o to_o build_v any_o house_n near_o to_o the_o church_n on_o the_o southside_n than_o what_o be_v already_o build_v for_o the_o whole_a length_n of_o the_o church_n aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n do_v fetch_v or_o cause_n to_o be_v fetch_v in_o any_o boat_n vessel_n or_o canoa_n from_o the_o riff_n or_o shoal_n or_o dig_v up_o any_o stone_n below_o high-water_n mark_v from_o the_o eastermost_a and_o southermost_a part_n of_o any_o of_o the_o cay_v lie_v off_o port-royal_a and_o that_o no_o stone_n simall_n or_o great_a be_v fetch_v or_o take_v up_o for_o ballast_n or_o any_o other_o use_n from_o the_o eastermost_a side_n of_o the_o point_n on_o port-royal_a so_o far_o as_o plum-point_n on_o penalty_n of_o ten_o pound_n for_o every_o such_o offence_n and_o that_o no_o commander_n and_o master_n of_o any_o ship_n or_o vessel_n cast_v or_o hoist_v out_o any_o within_o this_o island_n from_o and_o after_o the_o first_o day_n of_o august_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o eighty_o and_o one_o shall_v work_v sell_v exchange_n or_o cause_n to_o be_v wrought_v sell_v or_o exchange_v any_o plate_n or_o other_o goldsmith_n ware_n of_o gold_n less_o in_o fineness_n than_o twenty_o two_o carrat_n and_o that_o from_o put_v to_o sale_n exchange_n or_o sell_v any_o plate_n of_o goldsmith_n work_n of_o gold_n or_o silver_n before_o he_o have_v set_v his_o own_o mark_n to_o so_o much_o thereof_o as_o may_v convenient_o bear_v the_o same_o upon_o pain_n of_o forfeit_v the_o value_n of_o the_o thing_n so_o sell_v or_o exchange_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o whatsoever_o goldsmith_n or_o worker_n in_o gold_n or_o silver_n as_o aforesaid_a from_o and_o after_o the_o say_v first_o day_n of_o august_n shall_v presume_v to_o sell_v or_o no_o negro_n horse_n or_o any_o manner_n of_o utensil_n belong_v to_o a_o plantation_n brick_n or_o pot-work_n nor_o any_o other_o negro_n whatsoever_o from_o and_o after_o the_o make_n hereof_o shall_v be_v take_v in_o execution_n where_o the_o party_n against_o who_o the_o execution_n be_v obtain_v shall_v offer_v good_n for_o satisfaction_n of_o the_o debt_n and_o cost_v of_o suit_n and_o it_o be_v further_o enact_v that_o the_o say_a defendant_n who_o have_v his_o good_n take_v upon_o execution_n shall_v have_v free_a liberty_n to_o convey_v and_o carry_v off_o the_o good_n so_o take_v at_o his_o own_o proper_a cost_v and_o charge_n to_o the_o next_o and_o most_o convenient_a place_n and_o market_n for_o disposal_n of_o the_o say_a good_n and_o there_o shall_v have_v free_a power_n and_o liberty_n to_o make_v contract_n bargain_n for_o and_o sell_v the_o good_n so_o take_v in_o execution_n the_o defendant_n first_o acquaint_v the_o marshal_n who_o levy_v the_o execution_n upon_o the_o good_n with_o such_o bargain_n or_o contract_n to_o the_o end_n the_o marshal_n may_v deliver_v the_o same_o and_o receive_v the_o produce_v thereof_o according_a to_o his_o precept_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o defendant_n after_o his_o good_n shall_v be_v so_o take_v in_o execution_n as_o aforesaid_a shall_v delay_v or_o neglect_v sell_v or_o dispose_n of_o the_o good_n until_o ten_o day_n before_o the_o next_o ensue_a court_n that_o then_o and_o in_o all_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o the_o marshal_n to_o take_v the_o say_v good_n and_o chattel_n of_o the_o defendant_n and_o the_o same_o to_o sell_v by_o public_a outcry_n and_o it_o be_v further_o enact_v by_o tho_o authority_n aforesaid_a that_o where_o no_o such_o good_n as_o aforesaid_a shall_v be_v show_v and_o offer_v to_o the_o provost-marshal_n so_o that_o the_o negro_n working-cattel_n or_o necessary_a
