the_o people_n and_o for_o the_o better_a preserve_n of_o order_n in_o the_o exercise_n of_o ecclesiastical_a jurisdiction_n we_o ordain_v and_o appoint_v that_o the_o probate_n of_o all_o will_n and_o grant_v administration_n of_o the_o good_n of_o any_o defunct_a shall_v be_v have_v before_o the_o bishop_n of_o the_o diocese_n where_o he_o dwell_v unless_o it_o do_v appear_v that_o the_o say_v defunct_a have_v good_n to_o the_o value_n of_o five_o pound_n sterling_a in_o any_o other_o diocese_n in_o which_o case_n the_o say_v probate_a and_o grant_v administration_n shall_v be_v refer_v to_o the_o prerogative_n court_n provide_v that_o if_o any_o dye_n in_o itinere_fw-la the_o good_n that_o he_o have_v about_o he_o at_o that_o prefent_n shall_v not_o cause_v his_o testament_n or_o the_o administration_n to_o be_v liable_a to_o the_o prerogative_n court_n and_o the_o same_o order_n shall_v be_v hold_v in_o appeal_n without_o pass_v by_o the_o intermediate_v jurisdiction_n upon_o pain_n of_o nullity_n in_o all_o act_n contrary_a to_o this_o canon_n and_o if_o any_o judge_n of_o the_o prerogative_n court_n or_o any_o his_o surrogate_v or_o his_o register_n or_o apparitor_n shall_v cite_v or_o cause_n to_o be_v cite_v exit_fw-la officio_fw-la any_o man_n to_o the_o intent_n aforesaid_a contrary_a to_o this_o canon_n not_o have_v knowledge_n that_o the_o probate_n of_o a_o will_n or_o grant_v administration_n or_o devolution_n of_o the_o cause_n do_v appertain_v to_o his_o cognisance_n he_o shall_v restore_v to_o the_o party_n so_o cite_v all_o his_o cost_n and_o charge_n and_o the_o act_n and_o proceed_n in_o that_o behalf_n shall_v be_v hold_v void_a and_o frustrate_v which_o expense_n if_o the_o say_a judge_n or_o register_n or_o apparitor_n shall_v refuse_v according_o to_o pay_n he_o shall_v be_v suspend_v from_o the_o exercise_n of_o his_o offiee_n until_o he_o yield_v to_o the_o performance_n thereof_o lvii_o the_o restraint_n of_o double_a quarrel_n upon_o respite_n of_o institution_n we_o do_v ordain_v and_o appoint_v that_o no_o double_a quarrel_n shall_v be_v hereafter_o grant_v out_o of_o any_o the_o archbishop_n or_o prerogative_n court_n at_o the_o suit_n of_o any_o clerk_n present_v to_o any_o benefice_n except_o he_o shall_v first_o take_v his_o personal_a oath_n that_o the_o space_n of_o two_o month_n at_o the_o least_o be_v expire_v since_o he_o first_o tender_v his_o presentation_n to_o the_o bishop_n and_o that_o he_o refuse_v to_o grant_v he_o institution_n thereupon_o under_o pain_n of_o suspension_n of_o the_o grant_a thereof_o from_o the_o execution_n of_o his_o office_n for_o half_a a_o year_n and_o nullity_n of_o the_o say_v double_a quarrel_n so_o undue_o procure_v to_o all_o intent_n and_o purpose_n lviii_o inhibition_n not_o to_o be_v grant_v without_o the_o subscription_n of_o a_o advocate_n that_o the_o jurisdiction_n of_o bishop_n may_v be_v preserve_v as_o near_o as_o may_v be_v entire_a and_o free_a from_o prejudice_n and_o that_o for_o the_o behoof_n of_o the_o subject_n of_o this_o land_n better_a provision_n be_v make_v that_o henceforward_o they_o be_v not_o grieve_v with_o frivolous_a and_o wrongful_a suit_n and_o molestation_n it_o be_v ordain_v and_o provide_v that_o no_o inhibition_n shall_v be_v grant_v out_o of_o any_o court_n belong_v to_o the_o archbishop_n of_o the_o province_n or_o the_o supreme_a prerogative_n at_o the_o instance_n of_o any_o party_n unless_o it_o be_v subscribe_v by_o a_o advocate_n practise_v in_o the_o say_a court_n which_o the_o say_a advocate_n shall_v do_v free_o not_o take_v any_o fee_n for_o the_o same_o except_o the_o party_n prosecute_a the_o suit_n do_v voluntary_o bestow_v some_o gratuity_n upon_o he_o for_o his_o counsel_n and_o advise_v in_o the_o say_a case_n the_o like_a course_n shall_v be_v take_v in_o grant_v forth_o any_o inhibition_n at_o the_o instance_n of_o any_o party_n by_o the_o bishop_n or_o his_o chancellor_n against_o the_o archdeacon_n or_o any_o other_o person_n exercise_v ecclesiastical_a jurisdiction_n and_o if_o in_o the_o court_n or_o consistory_n of_o any_o bishop_n there_o be_v no_o advocate_n at_o all_o then_o shall_v the_o subscription_n of_o a_o proctor_n practise_v in_o the_o same_o court_n be_v hold_v sufficient_a lix_n inhibition_n not_o to_o be_v grant_v until_o the_o appeal_n be_v exhibit_v to_o the_o judge_n it_o be_v further_a order_v and_o decree_v that_o henceforward_o no_o inhibition_n be_v grant_v by_o occasion_n of_o any_o interlocutory_a decree_n or_o in_o cause_n of_o correction_n whatsoever_o except_o under_o the_o form_n aforesaid_a and_o moreover_o that_o before_o the_o go_v out_o of_o any_o such_o inhibition_n the_o appeal_n itself_o or_o a_o copy_n thereof_o avouch_v by_o oath_n to_o be_v just_a and_o true_a be_v exhibit_v to_o the_o judge_n or_o his_o lawful_a surrogate_v whereby_o he_o may_v be_v full_o inform_v both_o of_o the_o quality_n of_o the_o crime_n and_o the_o cause_n of_o the_o grievance_n before_o the_o grant_v forth_o of_o the_o say_a inhibition_n and_o every_o appellant_n or_o his_o lawful_a proctor_n shall_v before_o the_o obtain_n of_o any_o such_o inhibition_n show_v and_o exhibit_v to_o the_o judge_n or_o his_o surrogate_v in_o writing_n a_o true_a copy_n of_o those_o act_n wherewith_o he_o complain_v himself_o to_o be_v aggrieve_v and_o from_o which_o he_o appeal_v or_o shall_v take_v a_o corporal_a oath_n that_o he_o have_v perform_v his_o diligence_n and_o true_a endeavour_n for_o the_o obtain_n of_o the_o same_o and_o can_v not_o obtain_v it_o at_o the_o hand_n of_o the_o register_n in_o the_o country_n or_o his_o deputy_n tender_v he_o his_o fee_n and_o if_o any_o judge_n or_o register_n shall_v either_o procure_v or_o permit_v any_o inhibition_n to_o be_v seal_v so_o as_o be_v say_v contrary_a
