the_o excise_n or_o custom_n respective_o other_o than_o such_o arrearage_n of_o rent_n or_o mean_a profit_n as_o be_v or_o shall_v be_v otherwise_o dispose_v by_o any_o act_n or_o act_n of_o this_o present_a parliament_n and_o of_o and_o from_o all_o arrearage_n of_o ten_o and_o first-fruit_n fine_n post-fine_n issue_n and_o amerciament_n and_o all_o recognizance_n bond_n or_o other_o security_n give_v for_o payment_n of_o they_o or_o any_o of_o they_o concealment_n of_o custom_n and_o excise_n arrearage_n of_o purveyance_n and_o of_o composition_n for_o the_o same_o and_o of_o and_o from_o the_o authority_n aforesaid_a that_o all_o grant_n and_o patent_n since_o the_o twenty_o five_o of_o march_n one_o thousand_o six_o hundred_o forty_o one_o touch_v the_o wardship_n and_o custody_n of_o the_o body_n and_o land_n or_o touch_v the_o marriage_n of_o any_o heir_n within_o age_n and_o all_o mean_a profit_n yet_o unreceive_v name_v all_o thing_n not_o except_v shall_v be_v by_o the_o general_a word_n of_o this_o act_n as_o well_o as_o it_o particular_o name_v and_o demandable_a by_o reason_n thereof_o shall_v be_v
on_o the_o one_o part_n and_o the_o person_n or_o person_n farm_v on_o the_o other_o part_n shall_v be_v good_a and_o effectual_a in_o law_n to_o all_o intent_n and_o purpose_n provide_v always_o to_o the_o end_n the_o aforesaid_a duty_n may_v be_v pay_v with_o most_o ease_n to_o the_o people_n it_o be_v hereby_o further_o enact_v farm_n person_n contract_v that_o be_v nominate_v by_o the_o justice_n of_o the_o peace_n in_o every_o county_n shall_v have_v the_o refusal_n of_o any_o farm_n that_o the_o lord_n treasurer_n commissioner_n of_o the_o treasury_n or_o other_o person_n aforesaid_a shall_v not_o within_o six_o month_n after_o the_o commencement_n of_o this_o act_n treat_v conclude_v or_o agree_v with_o any_o person_n or_o person_n touch_v the_o farm_n of_o this_o duty_n upon_o béer_n and_o ale_n in_o any_o the_o respective_a county_n or_o place_n of_o this_o realm_n or_o dominion_n thereof_o other_o then_o with_o such_o person_n or_o person_n as_o by_o the_o justice_n of_o peace_n of_o the_o say_a county_n or_o place_n or_o the_o major_a part_n of_o they_o at_o their_o public_a quarter_n session_n shall_v be_v nominate_v and_o appoint_v in_o that_o behalf_n which_o person_n or_o person_n be_v to_o have_v the_o first_o refusal_n of_o any_o such_o farm_n respective_o and_o may_v take_v the_o same_o any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o provide_v that_o the_o say_a duty_n shall_v not_o be_v let_v to_o any_o other_o person_n or_o person_n then_o to_o the_o person_n or_o person_n recommend_v by_o the_o justice_n under_o the_o rate_n that_o it_o shall_v be_v tender_v to_o and_o refuse_v by_o such_o person_n or_o person_n so_o recommend_v determine_v forfeiture_n &_o offence_n within_o this_o act_n where_o determine_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o forfeiture_n and_o offence_n make_v do_v and_o commit_v against_o this_o act_n or_o any_o clause_n or_o article_n therein_o contain_v shall_v be_v hear_v adjudge_v and_o determine_v by_o such_o person_n or_o person_n and_o in_o such_o manner_n and_o form_n as_o hereafter_o in_o and_o by_o this_o act_n be_v direct_v and_o appoint_v that_o be_v to_o say_v all_o such_o forfeiture_n and_o offence_n make_v and_o commit_v within_o the_o immediate_a limit_n of_o the_o chief_a office_n in_o london_n shall_v be_v hear_v adjudge_v and_o determine_v by_o the_o say_v chief_a commissioner_n and_o governor_n of_o excise_n appoint_v by_o his_o majesty_n or_o the_o major_a part_n of_o they_o or_o by_o the_o commissioner_n for_o appeal_n and_o regulate_v of_o this_o duty_n or_o the_o major_a part_n of_o they_o in_o case_n of_o appeal_n and_o not_o otherwise_o and_o all_o such_o forfeiture_n and_o offence_n make_v and_o commit_v within_o all_o or_o any_o other_o the_o county_n city_n town_n or_o place_n within_o this_o kingdom_n or_o dominion_n thereof_o shall_v be_v hear_v and_o determine_v by_o any_o two_o or_o more_o of_o the_o justice_n of_o the_o peace_n reside_v near_o to_o the_o place_n where_o such_o forfeiture_n shall_v be_v make_v or_o offence_n commit_v and_o in_o case_n of_o neglect_n or_o refusal_n of_o such_o justice_n of_o the_o peace_n by_o the_o space_n of_o 14_o day_n next_o after_o complaint_n make_v and_o notice_n thereof_o give_v to_o the_o offender_n than_o the_o sub-commissioner_n or_o the_o major_a part_n of_o they_o appoint_v for_o any_o such_o city_n county_n town_n or_o place_n shall_v and_o be_v hereby_o impower_v to_o hear_v and_o determine_v the_o same_o and_o if_o the_o party_n find_v himself_o aggrieve_v by_o the_o judgement_n give_v by_o the_o say_a sub-commissioner_n grieve_v appeal_v by_o party_n grieve_v he_o shall_v and_o may_v appeal_v to_o the_o justice_n of_o the_o peace_n at_o the_o next_o quarter_n session_n who_o be_v hereby_o impower_v and_o authorise_v to_o hear_v and_o determine_v the_o same_o who_o judgement_n therein_o shall_v be_v final_a which_o say_v commissioner_n for_o appeal_n and_o regulate_v of_o this_o duty_n and_o the_o chief_a commissioner_n for_o excise_n and_o all_o justice_n of_o peace_n and_o sub-commissioner_n aforesaid_a respective_o be_v hereby_o authorise_v and_o strict_o enjoin_v and_o require_v upon_o any_o complaint_n or_o information_n exhibit_v and_o bring_v of_o any_o such_o forfeiture_n make_v or_o offence_n commit_v contrary_a to_o this_o act_n to_o summon_v the_o party_n accuse_v and_o upon_o his_o appearance_n or_o contempt_n to_o procee_v to_o the_o examination_n of_o the_o matter_n of_o fact_n and_o upon_o due_a proof_n make_v thereof_o either_o by_o the_o voluntary_a confession_n of_o the_o party_n or_o by_o the_o oath_n of_o one_o or_o more_o credible_a witness_n which_o oath_n they_o or_o any_o two_o or_o more_o of_o they_o have_v hereby_o power_n to_o administer_v to_o give_v judgement_n or_o sentence_n according_a as_o in_o and_o by_o this_o act_n be_v before_o ordain_v and_o direct_v and_o to_o award_v and_o issue_n out_o warrant_v under_o their_o hand_n for_o the_o levy_n of_o such_o forfeiture_n penalty_n and_o fine_n as_o by_o this_o act_n be_v impose_v for_o any_o such_o offence_n commit_v upon_o the_o good_n and_o chattel_n of_o the_o offender_n and_o to_o cause_n sale_n to_o be_v make_v of_o the_o say_a good_n and_o chattel_n if_o they_o shall_v not_o be_v redeem_v within_o fourtéen_a day_n render_v to_o the_o party_n the_o overplus_n if_o any_o be_v and_o for_o want_v of_o sufficient_a distress_n to_o imprison_v the_o party_n offend_v till_o satisfaction_n be_v make_v provide_v nevertheless_o that_o it_o shall_v and_o may_v be_v lawful_a mitigate_v fine_n and_o forfeiture_n may_v be_v mitigate_v to_o and_o for_o the_o say_v respective_a justice_n of_o peace_n commissioner_n for_o excise_n or_o any_o two_o of_o they_o or_o their_o sub-commissioner_n respective_o from_o time_n to_o time_n where_o they_o shall_v see_v cause_n to_o mitigate_v compound_n or_o lessen_v such_o forfeiture_n penalty_n or_o fine_a as_o in_o their_o discretion_n they_o shall_v think_v fit_a and_o that_o every_o such_o mitigation_n and_o payment_n thereupon_o according_o make_v shall_v be_v a_o sufficient_a discharge_n of_o the_o say_a penalty_n and_o forfeiture_n to_o the_o person_n so_o offend_v so_o as_o by_o such_o mitigation_n the_o same_o be_v not_o make_v less_o than_o double_a the_o value_n of_o the_o duty_n of_o excise_n which_o shall_v or_o ought_v to_o have_v be_v pay_v beside_o the_o reasonable_a cost_n and_o charge_n of_o such_o officer_n or_o officer_n or_o other_o as_o be_v employ_v therein_o to_o be_v to_o they_o allow_v by_o the_o say_a justice_n any_o thing_n in_o this_o act_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o it_o be_v hereby_o further_o enact_v and_o ordain_v that_o all_o fine_n employ_v how_o the_o fine_n and_o forfeiture_n shall_v be_v employ_v forfeiture_n and_o penalty_n mention_v in_o this_o act_n all_o necessary_a charge_n for_o the_o recovery_n thereof_o be_v first_o deduct_v shall_v be_v employ_v three_o four_o part_n thereof_o to_o and_o for_o the_o use_n of_o the_o king_n majesty_n and_o the_o other_o four_o part_n to_o the_o discoverer_n or_o informer_n of_o the_o same_o and_o for_o the_o better_a manage_n collect_v secure_v levy_v and_o recover_v of_o all_o and_o every_o the_o say_a rate_n and_o charge_n of_o excise_n hereby_o impose_v and_o set_v upon_o all_o or_o any_o of_o the_o commodity_n before_o mention_v to_o the_o end_n the_o same_o may_v be_v pay_v and_o dispose_v of_o according_a to_o the_o intent_n of_o this_o present_a act_n be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v that_o one_o principal_a head-office_n shall_v be_v erect_v and_o continue_v in_o the_o city_n of_o london_n or_o within_o ten_o mile_n thereof_o from_o time_n to_o time_n as_o long_o as_o his_o majesty_n shall_v think_v fit_a for_o this_o duty_n unto_o which_o all_o other_o office_n for_o the_o same_o within_o england_n and_o wales_n and_o the_o town_n and_o port_n of_o berwick_n shall_v be_v subordinate_a and_o accountable_a which_o say_v office_n shall_v be_v manage_v by_o such_o officer_n as_o shall_v be_v appoint_v by_o the_o king_n majesty_n as_o aforesaid_a who_o or_o any_o two_o of_o they_o excise_n commissioner_n and_o governor_n for_o manage_v the_o receipt_n of_o excise_n be_v hereby_o appoint_v and_o constitute_v commissioner_n and_o governor_n for_o the_o management_n of_o his_o majesty_n receipt_n of_o the_o excise_n and_o to_o sit_v in_o some_o convenient_a place_n in_o the_o city_n of_o london_n or_o within_o ten_o mile_n thereof_o from_o time_n to_o time_n as_o long_o as_o his_o majesty_n shall_v think_v fit_a and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n shall_v be_v capable_a of_o
of_o this_o duty_n be_v first_o pay_v and_o satisfy_v by_o the_o say_a victualler_n or_o retailer_n to_o the_o brewer_n or_o maker_n thereof_o provide_v always_o that_o if_o any_o person_n or_o person_n shall_v brew_v and_o sell_v by_o retail_v any_o small_a quantity_n of_o béer_n or_o ale_n in_o any_o fair_a within_o this_o realm_n fair_n proviso_n for_o beer_n and_o ale_n sell_v in_o fair_n or_o dominion_n aforesaid_a who_o be_v not_o otherwise_o any_o common_a or_o usual_a brewer_n or_o retailer_n thereof_o and_o shall_v before_o any_o such_o sell_v and_o retail_v thereof_o well_o and_o true_o pay_v and_o satisfy_v the_o duty_n due_a for_o the_o same_o to_o the_o commissioner_n or_o sub-commissioner_n within_o who_o limit_n or_o division_n the_o say_v fair_a shall_v be_v hold_v or_o to_o their_o officer_n thereunto_o appoint_v then_o such_o person_n or_o person_n so_o brew_v or_o retail_v the_o same_o and_o for_o so_o much_o and_o no_o more_o nor_o otherwise_o shall_v be_v free_v and_o discharge_v from_o all_o penalty_n and_o forfeiture_n in_o and_o by_o this_o act_n before_o mention_v and_o impose_v any_o thing_n therein_o contain_v to_o the_o contrary_a notwithstanding_o provide_v nevertheless_o that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a commissioner_n division_n the_o commissioner_n may_v compound_v for_o the_o excise_n in_o their_o division_n and_o sub-commissioner_n respective_o to_o compound_v for_o this_o duty_n with_o any_o inn-kéepe_a victualler_n alehouse-kéepe_a or_o retailer_n of_o béer_n ale_n and_o other_o the_o liquor_n aforesaid_a within_o their_o respective_a division_n from_o time_n to_o time_n and_o in_o such_o manner_n and_o form_n as_o may_v be_v most_o for_o the_o advantage_n and_o improvement_n of_o the_o receipt_n thereof_o any_o thing_n in_o this_o act_n before_o contain_v to_o the_o contrary_a notwithstanding_o and_o it_o be_v further_o ordain_v and_o enact_v by_o the_o authority_n aforesaid_a that_o the_o lord_n treasurer_n act._n the_o power_n of_o the_o lord_n treasurer_n etc._n etc._n to_o contract_n for_o farm_v any_o the_o rate_n or_o duty_n in_o this_o act._n or_o commissioner_n of_o the_o treasury_n for_o the_o time_n be_v or_o such_o other_o person_n or_o person_n as_o his_o majesty_n his_o heir_n and_o successor_n shall_v appoint_v shall_v have_v power_n and_o be_v hereby_o authorise_v and_o impower_v from_o time_n to_o time_n to_o treat_v contract_n conclude_v and_o agree_v with_o any_o person_n or_o person_n for_o or_o concern_v the_o farm_n of_o all_o or_o any_o the_o rate_n duty_n and_o charge_n in_o this_o act_n mention_v upon_o béer_o ale_n perry_n cider_n or_o other_o the_o liquor_n aforesaid_a in_o any_o the_o respective_a county_n city_n or_o place_n of_o this_o realm_n or_o dominion_n thereof_o as_o may_v be_v for_o the_o great_a benefit_n and_o advantage_n of_o the_o say_a receipt_n so_o as_o the_o same_o excee_v not_o the_o term_n of_o three_o year_n and_o be_v it_o further_o enact_v that_o every_o such_o contract_n bargain_n and_o agreement_n of_o the_o lord_n treasurer_n or_o commissioner_n of_o the_o treasury_n or_o other_o person_n aforesaid_a on_o behalf_n of_o his_o majesty_n on_o the_o one_o part_n and_o the_o person_n or_o person_n farm_v on_o the_o other_o part_n shall_v be_v good_a and_o effectual_a in_o law_n to_o all_o intent_n and_o purpose_n provide_v always_o to_o the_o end_n the_o aforesaid_a duty_n may_v be_v pay_v with_o most_o ease_n to_o the_o people_n county_n person_n to_o be_v approve_v by_o the_o justice_n of_o the_o peace_n etc._n etc._n within_o six_o month_n to_o have_v the_o refusal_n of_o contract_n for_o the_o excise_n in_o these_o respective_a county_n it_o be_v hereby_o further_o enact_v that_o the_o lord_n treasurer_n commissioner_n of_o the_o treasury_n or_o other_o person_n aforesaid_a shall_v not_o within_o six_o month_n after_o the_o commencement_n of_o this_o act_n treat_v conclude_v or_o agree_v with_o any_o person_n or_o person_n touch_v the_o farm_n of_o this_o duty_n upon_o béer_n and_o ale_n in_o any_o the_o respective_a county_n or_o place_n of_o this_o realm_n or_o dominion_n thereof_o other_o then_o with_o such_o person_n or_o person_n as_o by_o the_o justice_n of_o peace_n of_o the_o say_a county_n or_o place_n or_o the_o major_a part_n of_o they_o at_o their_o public_a quarter_n session_n shall_v be_v nominate_v and_o appoint_v in_o that_o behalf_n which_o person_n or_o person_n be_v to_o have_v the_o first_o refusal_n of_o any_o such_o farm_n respective_o and_o may_v take_v the_o same_o any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o provide_v that_o the_o say_a duty_n shall_v not_o be_v let_v to_o any_o person_n or_o person_n then_o to_o the_o person_n or_o person_n recommend_v by_o the_o justice_n under_o the_o rate_n that_o it_o shall_v be_v tender_v to_o and_o refuse_v by_o such_o person_n or_o person_n so_o recommend_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a determine_v forfeiture_n and_o offence_n within_o this_o act_n how_o to_o be_v determine_v that_o all_o forfeiture_n and_o offence_n make_v do_v and_o commit_v against_o this_o act_n or_o any_o clause_n or_o article_n therein_o contain_v shall_v be_v hear_v adjudge_v and_o determine_v by_o such_o person_n or_o person_n and_o in_o such_o manner_n and_o form_n as_o hereafter_o in_o and_o by_o this_o act_n be_v direct_v and_o appoint_v that_o be_v to_o say_v all_o such_o forfeiture_n and_o offence_n make_v and_o commit_v within_o the_o immediate_a limit_n of_o the_o chief_a office_n in_o london_n shall_v be_v hear_v london_n london_n adjudge_v and_o determine_v by_o the_o say_v chief_a commissioner_n and_o governor_n of_o excise_n appoint_v by_o his_o majesty_n or_o the_o major_a part_n of_o they_o or_o by_o the_o commissioner_n for_o appeal_n and_o regulate_v of_o this_o duty_n or_o the_o major_a part_n of_o they_o in_o case_n of_o appeal_n and_o not_o otherwise_o kingdom_n county_n city_n etc._n etc._n within_o this_o kingdom_n and_o all_o such_o forfeiture_n and_o offence_n make_v and_o commit_v within_o all_o or_o any_o other_o the_o county_n city_n town_n or_o place_n within_o this_o kingdom_n or_o dominion_n thereof_o shall_v be_v hear_v and_o determine_v by_o any_o two_o or_o more_o of_o the_o justice_n of_o the_o peace_n reside_v near_o to_o the_o place_n where_o such_o forfeiture_n shall_v be_v make_v or_o offence_n commit_v justice_n neglect_v of_o the_o justice_n and_o in_o case_n of_o neglect_n or_o refusal_n of_o such_o justice_n of_o the_o peace_n by_o the_o space_n of_o fourtéen_a day_n next_o say_a office_n of_o all_o order_n and_o warrant_n to_o be_v make_v by_o the_o lord_n treasurer_n and_o vnder-treasurer_n or_o by_o the_o commissioner_n of_o the_o treasury_n for_o the_o time_n be_v for_o payment_n of_o all_o and_o every_o sum_n and_o sum_n of_o money_n to_o all_o person_n for_o money_n lend_v ware_n or_o good_n buy_v or_o other_o payment_n direct_v by_o his_o majesty_n relate_v book_n or_o register_n provide_v and_o keep_v by_o the_o say_a auditor_n of_o all_o money_n pay_v out_o or_o issue_v by_o virtue_n of_o such_o order_n and_o warrant_n that_o it_o shall_v be_v lawful_a for_o any_o person_n or_o person_n willing_a to_o lend_v any_o money_n or_o to_o furnish_v any_o ware_n victual_n necessary_n or_o good_n on_o the_o credit_n of_o this_o act_n at_o the_o usual_a or_o person_n as_o shall_v be_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n division_n head-collectors_a to_o be_v appoint_v in_o the_o several_a division_n and_o be_v it_o enact_v that_o the_o say_a commissioner_n or_o any_o three_o or_o more_o of_o they_o in_o their_o respective_a division_n or_o hundred_o shall_v and_o be_v hereby_o empower_v to_o nominate_v and_o appoint_v under_o their_o hand_n and_o seal_n a_o honest_a able_a and_o responsible_a person_n to_o be_v head-collector_n unto_o who_o the_o money_n receive_v by_o the_o sub-collector_n shall_v be_v due_o pay_v as_o aforesaid_a who_o receipt_n shall_v be_v a_o sufficient_a discharge_n unto_o every_o such_o sub-collector_n which_o sub-collector_n for_o gather_v the_o say_v particular_a sum_n say_a warrant_n estreat_n and_o duplicate_v in_o due_a time_n be_v it_o further_o enact_v that_o the_o commissioner_n clerk_n who_o shall_v respective_o perform_v the_o same_o shall_v by_o warrant_n under_o two_o or_o more_o of_o the_o commissioner_n hand_n have_v and_o receive_v from_o the_o respective_a head-collectors_a two_o penny_n in_o the_o pound_n of_o all_o such_o money_n as_o he_o shall_v have_v receive_v by_o virtue_n of_o such_o warrant_n and_o estreat_v who_o be_v hereby_o appoint_v and_o allow_v to_o pay_v the_o same_o according_o general_a payment_n by_o the_o head-collectors_a to_o the_o receiver_n general_a and_o be_v it_o further_o enact_v that_o if_o any_o head-collector_n shall_v not_o pay_v in_o to_o the_o receiver-general_a within_o the_o time_n limit_v by_o this_o act_n all_o sum_n of_o money_n by_o he_o receive_v by_o virtue_n of_o this_o act_n that_o then_o the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o be_v inform_v thereof_o be_v hereby_o empower_v and_o require_v to_o imprison_v every_o such_o head-collector_n and_o also_o to_o seize_v and_o secure_v the_o estate_n both_o real_a and_o personal_a of_o such_o head-collector_n or_o which_o shall_v from_o he_o descend_v or_o come_v into_o the_o hand_n or_o possession_n of_o his_o heir_n executor_n or_o administrator_n wherever_o the_o same_o can_v be_v discover_v or_o find_v and_o the_o say_a commissioner_n who_o shall_v so_o seize_v and_o secure_v the_o estate_n of_o any_o head-collector_n shall_v be_v and_o be_v hereby_o empower_v to_o appoint_v a_o time_n for_o the_o general_a meeting_n of_o the_o commissioner_n of_o such_o county_n city_n or_o town_n and_o there_o to_o cause_v public_a notice_n to_o be_v give_v at_o the_o place_n where_o such_o meeting_n shall_v be_v appoint_v ten_o day_n at_o least_o before_o such_o general_a meeting_n and_o the_o commissioner_n present_v at_o such_o general_a meeting_n or_o the_o major_a part_n of_o they_o in_o case_n the_o money_n detain_v by_o such_o head-collector_n be_v not_o pay_v or_o satisfy_v as_o aught_o to_o be_v according_a to_o the_o direction_n of_o this_o act_n shall_v and_o be_v hereby_o empower_v and_o require_v to_o sell_v and_o dispose_v of_o all_o such_o estate_n or_o any_o part_n of_o they_o which_o shall_v be_v for_o the_o cause_n aforesaid_a seize_v and_o thereby_o to_o secure_v and_o pay_v all_o the_o money_n in_o arrear_n in_o such_o head-collector_n hand_n for_o his_o majesty_n use_n and_o return_v the_o overplus_n deduct_v necessary_a charge_n to_o such_o head-collector_n his_o executor_n and_o administrator_n respective_o â—enalty_n â—enalty_n and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o pay_v the_o several_a sum_n and_o sum_n and_o proportion_n appoint_v by_o this_o act_n for_o such_o person_n to_o pay_v upon_o demand_n make_v by_o the_o officer_n or_o collector_n of_o the_o place_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v by_o the_o say_a commissioner_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o officer_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v for_o nonpayment_n thereof_o to_o distrain_v the_o person_n or_o person_n so_o refuse_v by_o his_o or_o their_o good_n or_o chattel_n and_o the_o distress_n so_o take_v to_o keep_v within_o the_o say_v four_o day_n than_o the_o say_a distress_n to_o be_v apprize_v by_o three_o or_o two_o of_o the_o inhabitant_n where_o the_o say_a distress_n be_v take_v and_o there_o to_o be_v sell_v by_o the_o say_a officer_n for_o payment_n of_o the_o say_a money_n and_o the_o overplus_n come_v by_o the_o say_a sale_n if_o any_o be_v over_o and_o above_o the_o charge_n of_o take_v and_o keep_v the_o say_a distress_n to_o be_v immediate_o restore_v to_o the_o owner_n thereof_o and_o if_o any_o person_n or_o person_n assess_v by_o this_o act_n shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o twenty_o day_n after_o demand_n as_o aforesaid_a where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o same_o may_v be_v levy_v in_o every_o such_o case_n three_o or_o more_o of_o the_o commissioner_n by_o this_o act_n appoint_v for_o any_o such_o city_n county_n or_o place_n be_v hereby_o authorize_v by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o person_n or_o person_n to_o the_o common_a goal_n there_o to_o be_v keep_v without_o bail_n or_o mainprize_n until_o payment_n mention_v act_n be_v give_v to_o the_o say_a commissioner_n touch_v the_o better_a assess_n collect_v receive_v and_o pay_v the_o threescore_o and_o eight_o thousand_o eight_o hundred_o and_o repeat_v and_o enact_v to_o the_o end_n that_o the_o say_v eleven_o monthly_a assessment_n grant_v by_o virtue_n of_o this_o present_a act_n may_v be_v due_o answer_v and_o pay_v in_o as_o aforesaid_a be_v it_o further_o enact_v that_o the_o several_a commissioner_n shall_v meet_v together_o at_o the_o most_o usual_a and_o common_a place_n of_o meet_v as_o in_o the_o say_v first_o recite_v act_n be_v direct_v commissioner_n the_o meeting_n of_o the_o commissioner_n on_o or_o before_o the_o second_o tuesday_n in_o february_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n one_o and_o regiment_n and_o in_o case_n of_o insurrection_n rebellion_n or_o invasion_n they_o to_o lead_v conduct_v and_o employ_v or_o cause_n to_o be_v lead_v conduct_v and_o employ_v as_o well_o within_o the_o say_v several_a county_n city_n and_o place_n for_o which_o they_o shall_v be_v commissionated_a respective_o as_o also_o into_o any_o other_o the_o county_n and_o place_n aforesaid_a give_v they_o deputation_n according_o always_o understand_v that_o his_o majesty_n his_o heir_n and_o successor_n have_v power_n and_o authority_n to_o direct_v and_o order_v otherwise_o and_o according_o at_o his_o and_o their_o pleasure_n may_v appoint_v and_o commissionate_v or_o displace_v such_o officer_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o the_o arm_v and_o weapon_v the_o person_n aforesaid_a and_o also_o for_o the_o defray_n and_o pay_v the_o necessary_a charge_n thereunto_o belong_v in_o manner_n as_o hereafter_o follow_v be_v it_o further_o enact_v etc._n the_o manner_n of_o charge_v and_o provide_v horse_n and_o arm_n etc._n etc._n that_o the_o say_v respective_a lieutenant_n within_o the_o several_a county_n city_n and_o power_n and_o authority_n to_o charge_v any_o person_n with_o horse_n horseman_n and_o arm_n or_o with_o foot-souldier_n and_o arm_n in_o the_o same_o county_n shire_n city_n burrough_n or_o town-corporate_a where_o his_o she_o or_o their_o estate_n lie_v have_v respect_n unto_o and_o not_o exceed_a the_o limitation_n and_o proportion_n hereafter_o mention_v that_o be_v to_o say_v no_o person_n shall_v be_v charge_v with_o find_v a_o horse_n horseman_n and_o arm_n unless_o such_o person_n or_o person_n have_v a_o revenue_n of_o five_o hundred_o pound_n by_o the_o year_n in_o possession_n or_o have_v a_o estate_n of_o six_o thousand_o pound_n in_o good_n or_o money_n beside_o the_o furniture_n of_o he_o or_o their_o house_n and_o so_o proportionable_o for_o a_o great_a estate_n in_o land_n in_o possession_n or_o good_n as_o the_o respective_a lieutenant_n and_o their_o deputy_n as_o aforesaid_a in_o their_o discretion_n shall_v see_v cause_n and_o think_v reasonable_a and_o they_o be_v not_o to_o charge_v any_o person_n with_o find_v a_o foot-souldier_n and_o arm_n that_o have_v not_o a_o yearly_a revenue_n of_o fifty_o pound_n in_o possession_n or_o a_o personal_a estate_n of_o six_o hundred_o pound_n in_o good_n or_o money_n other_o than_o the_o stock_n upon_o the_o ground_n and_o after_o the_o aforesaid_a rate_n proportionable_o for_o a_o great_a or_o lesser_a revenue_n or_o estate_n nor_o shall_v they_o charge_v any_o person_n with_o the_o find_v both_o of_o horse_n and_o foot_n in_o the_o same_o county_n provide_v that_o no_o person_n chargeable_a by_o this_o act_n to_o find_v a_o horse_n and_o horseman_n with_o arm_n foot-arm_n no_o person_n charge_v with_o or_o towards_o a_o horse_n may_v be_v charge_v also_o towards_o foot-arm_n or_o to_o be_v contributory_a towards_o find_v a_o horse_n and_o horseman_n with_o arm_n shall_v for_o the_o same_o estate_n be_v chargeable_a towards_o find_v a_o foot-souldier_n with_o arm_n or_o contributory_a thereunto_o and_o it_o shall_v be_v lawful_a to_o and_o for_o the_o respective_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a to_o impose_v the_o find_n and_o provide_v of_o horse_n horseman_n and_o arm_n as_o aforesaid_a by_o join_v two_o or_o three_o or_o more_o person_n together_o in_o the_o charge_n as_o to_o their_o judgement_n shall_v appear_v most_o conducible_a to_o the_o service_n of_o this_o kingdom_n provide_v that_o no_o person_n that_o have_v not_o one_o hundred_o pound_n per_fw-la annum_fw-la in_o possession_n in_o land_n act._n what_o person_n and_o estate_n only_o chargeable_a towards_o find_v horse-arm_n lieutenant_n and_o deputy_n may_v hear_v and_o determine_v matter_n relate_v to_o this_o act._n tenement_n or_o hereditament_n lease-hold_a or_o copyhold_n or_o twelve_o hundred_o pound_n personal_a estate_n shall_v be_v compellable_n to_o contribute_v in_o find_v any_o horse_n and_o horseman_n with_o arm_n and_o the_o say_v respective_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o shall_v have_v power_n to_o hear_v complaint_n and_o examine_v witness_n upon_o oath_n which_o oath_n they_o have_v hereby_o power_n to_o administer_v and_o to_o give_v redress_n according_a to_o the_o merit_n of_o the_o cause_n in_o matter_n relate_v to_o the_o execution_n of_o this_o act._n be_v it_o further_o enact_v that_o the_o say_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o in_o their_o several_a county_n and_o place_n respective_o shall_v
build_v cottage_n and_o the_o most_o wood_n for_o they_o to_o burn_v and_o destroy_v and_o when_o they_o have_v consume_v it_o then_o to_o another_o parish_n and_o at_o last_o become_v rogue_n and_o vagabond_n to_o the_o great_a discouragement_n of_o parish_n to_o provide_v stock_n where_o it_o be_v liable_a to_o be_v devour_v by_o stranger_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a value_n how_o to_o be_v settle_v come_v to_o any_o tenement_n under_o ten_o pound_n yearly_a value_n upon_o complaint_n make_v by_o the_o churchwarden_n or_o overseer_n of_o the_o poor_a of_o any_o parish_n to_o any_o justice_n of_o peace_n within_o forty_o day_n after_o any_o such_o person_n or_o person_n come_v so_o to_o settle_v as_o aforesaid_a in_o any_o tenement_n under_o the_o yearly_a value_n of_o ten_o pound_n for_o any_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o division_n where_o any_o person_n or_o person_n that_o be_v likely_a to_o be_v chargeable_a to_o the_o parish_n shall_v come_v to_o inhabit_v by_o their_o warrant_n to_o remove_v and_o convey_v such_o person_n or_o person_n to_o such_o parish_n where_o he_o or_o they_o be_v last_o legal_o settle_v either_o as_o a_o native_a housholder_n sojourner_n apprentice_n or_o servant_n for_o the_o space_n of_o forty_o day_n at_o the_o least_o unless_o he_o or_o they_o give_v sufficient_a security_n for_o the_o discharge_n of_o the_o say_a parish_n to_o be_v allow_v by_o the_o say_a justice_n session_n person_n grieve_v may_v appeal_v to_o the_o quarter_n session_n provide_v always_o that_o all_o such_o person_n who_o think_v themselves_o aggrieve_v by_o any_o such_o judgement_n of_o the_o say_v two_o justice_n may_v appeal_v to_o the_o justice_n of_o the_o peace_n of_o the_o say_a county_n at_o their_o next_o quarter-session_n who_o be_v hereby_o require_v to_o do_v they_o justice_n according_a to_o the_o merit_n of_o their_o cause_n harvest_n person_n go_v to_o work_v in_o harvest_n provide_v also_o that_o this_o act_n notwithstanding_o it_o shall_v and_o may_v be_v lawful_a for_o any_o person_n or_o person_n to_o go_v into_o any_o county_n parish_n or_o place_n to_o work_v in_o time_n of_o harvest_n or_o at_o any_o time_n to_o work_v at_o any_o other_o work_n so_o that_o he_o or_o they_o carry_v with_o he_o or_o they_o a_o certificate_n from_o the_o minister_n of_o the_o parish_n and_o one_o of_o the_o churchwarden_n and_o one_o of_o the_o overséer_v for_o the_o poor_a for_o the_o say_a year_n that_o he_o or_o they_o have_v a_o dwell_a house_n or_o place_n in_o which_o he_o or_o they_o inhabit_v and_o have_v leave_v wife_n and_o child_n or_o some_o of_o they_o there_o or_o otherwise_o as_o the_o condition_n of_o the_o person_n shall_v require_v and_o be_v declare_v a_o inhabitant_n or_o inhabitant_n there_o and_o in_o such_o case_n if_o the_o person_n or_o person_n shall_v not_o return_v to_o the_o place_n aforesaid_a when_o he_o or_o their_o work_n be_v finish_v or_o shall_v fall_v sick_a or_o impotent_a whilst_o he_o or_o they_o be_v in_o the_o say_a work_n it_o shall_v not_o be_v account_v a_o settlement_n in_o the_o case_n abovesaid_a but_o that_o it_o shall_v and_o may_v be_v lawful_a for_o two_o justice_n of_o the_o peace_n to_o convey_v the_o say_a person_n or_o person_n to_o the_o place_n of_o he_o or_o their_o habitation_n as_o aforesaid_a under_o the_o pain_n and_o penalty_n in_o this_o act_n prescribe_v and_o if_o such_o person_n or_o person_n shall_v refuse_v to_o go_v or_o shall_v not_o remain_v in_o such_o parish_n where_o they_o ought_v to_o be_v settle_v as_o aforesaid_a but_o shall_v return_v of_o his_o own_o accord_n to_o the_o parish_n from_o whence_o he_o be_v remove_v it_o shall_v and_o may_v be_v lawful_a for_o any_o justice_n of_o the_o peace_n of_o the_o city_n county_n or_o town-corporate_a where_o the_o say_a offence_n shall_v be_v commit_v to_o send_v such_o person_n or_o person_n offend_v to_o the_o house_n of_o correction_n there_o to_o be_v punish_v as_o a_o vagabond_n or_o to_o a_o public_a workhouse_n in_o this_o present_a act_n hereafter_o mention_v there_o to_o be_v employ_v in_o work_n or_o labour_n and_o if_o the_o churchwarden_n and_o overséer_v of_o the_o poor_a of_o the_o parish_n to_o which_o he_o or_o they_o shall_v be_v remove_v refuse_v to_o receive_v such_o person_n or_o person_n and_o to_o provide_v work_n for_o they_o as_o other_o inhabitant_n of_o the_o other_o ecclesiastical_a person_n and_o their_o successor_n corporation_n and_o all_o other_o person_n or_o person_n body_n natural_a and_o politic_a their_o heir_n and_o successor_n and_o their_o respective_a interest_n shall_v be_v bind_v and_o conclude_v by_o such_o respective_a order_n or_o order_n according_a to_o the_o tenor_n or_o purport_n thereof_o any_o law_n statute_n or_o custom_n or_o other_o matter_n or_o thing_n to_o the_o contrary_a notwithstanding_o and_o for_o the_o better_a enable_v the_o say_a justice_n and_o baron_n to_o procee_v with_o effect_n in_o the_o say_a cause_n complaint_n how_o to_o proceed_v upon_o complaint_n be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a justice_n and_o baron_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a upon_o the_o complaint_n or_o request_n of_o any_o person_n or_o person_n concern_v in_o any_o of_o the_o say_a house_n or_o building_n and_o other_o the_o premise_n shall_v issue_v out_o note_n or_o warrant_n under_o their_o hand_n or_o the_o hand_n of_o any_o such_o three_o of_o they_o thereby_o warn_v the_o person_n or_o person_n body_n politic_a and_o corporate_a therein_o name_v and_o concern_v in_o the_o say_v late_a house_n or_o building_n and_o other_o the_o premise_n in_o such_o complaint_n mention_v to_o appear_v before_o they_o at_o such_o time_n and_o
