they_o but_o it_o do_v not_o therefore_o follow_v that_o god_n require_v the_o performance_n of_o no_o other_o oath_n to_o he_o but_o such_o as_o be_v immediate_o make_v to_o he_o for_o we_o find_v in_o scripture_n that_o god_n own_v oath_n that_o be_v make_v between_o man_n and_o man_n to_o be_v his_o oath_n and_o require_v the_o performance_n thereof_o as_o well_o as_o it_o they_o have_v be_v immediate_o make_v to_o he_o as_o we_o may_v see_v in_o ezek._n 17.19_o therefore_o thus_o say_v the_o lord_n god_n as_o i_o live_v sure_o my_o oath_n that_o he_o have_v despise_v and_o my_o covenant_n that_o he_o have_v break_v even_o it_o will_v i_o recompense_v upon_o his_o own_o head_n so_o likewise_o the_o 2d_o of_o samuel_n 21.7_o and_o 1_o king_n 2.43_o now_o therefore_o though_o as_o he_o say_v the_o end_n of_o oath_n make_v immediate_o to_o god_n be_v to_o bind_v they_o to_o the_o performance_n of_o those_o voluntary_a service_n which_o they_o be_v not_o bind_v to_o by_o whether_o those_o two_o text_n mat._n 5._o and_o jam._n 5._o do_v forbid_v all_o manner_n of_o swear_v in_o gospel_n time_n and_o here_o i_o shall_v grant_v with_o he_o that_o christ_n do_v not_o forbid_v the_o use_n of_o such_o swear_n as_o be_v in_o the_o law_n command_v only_o let_v i_o revive_v the_o forementioned_a distinction_n namely_o between_o oath_n command_v and_o oath_n that_o be_v voluntary_a and_o that_o because_o oath_n that_o be_v command_v be_v only_a assertory_n as_o i_o have_v already_o show_v now_o therefore_o i_o shall_v pass_v over_o those_o reason_n that_o he_o have_v give_v to_o prove_v that_o christ_n do_v not_o take_v away_o the_o use_n of_o all_o such_o swear_n as_o be_v command_v under_o the_o law_n only_o by_o the_o way_n give_v i_o leave_v to_o except_v against_o some_o particular_n that_o he_o have_v instance_a in_o for_o proof_n in_o this_o case_n and_o first_o i_o take_v notice_n of_o his_o first_o reason_n viz._n that_o christ_n use_v some_o such_o swear_v himself_o in_o mat._n 26.63_o when_o he_o be_v adjure_v by_o the_o highpriest_n to_o which_o i_o answer_v if_o i_o shall_v grant_v that_o christ_n in_o this_o swear_v yet_o it_o make_v nothing_o to_o our_o question_n because_o in_o this_o text_n there_o be_v nothing_o promissory_n but_o however_o i_o can_v but_o wonder_n that_o be_v shall_v so_o much_o contradict_v himself_o as_o to_o say_v that_o christ_n swear_v and_o yet_o make_v no_o answer_n to_o the_o oath_n when_o he_o himself_o say_v in_o the_o three_o page_n of_o his_o book_n speak_v of_o mr._n ainsworth_n writing_n in_o show_v that_o when_o a_o man_n be_v adjure_v or_o charge_v to_o swear_v he_o be_v not_o swear_v except_o he_o take_v the_o oath_n upon_o he_o by_o express_v some_o word_n to_o signify_v the_o same_o which_o christ_n do_v not_o i_o now_o come_v to_o his_o second_o reason_n viz._n that_o christ_n in_o mat._n 5._o can_v not_o take_v away_o the_o use_n of_o all_o such_o swear_n as_o be_v command_v under_o the_o law_n because_o those_o commandment_n contain_v in_o ordinance_n be_v not_o take_v away_o till_o the_o death_n of_o the_o testator_n ephes_n 2.15_o and_o those_o ordinance_n that_o be_v contrary_a to_o we_o be_v not_o take_v away_o till_o christ_n nail_v they_o to_o his_o cross_n col._n 2.14_o therefore_o those_o commandment_n of_o the_o law_n which_o accommodate_v humane_a affair_n and_o respect_a moral_n of_o which_o this_o of_o swear_v to_o end_v strife_n be_v none_o of_o the_o least_o can_v not_o be_v take_v away_o before_o christ_n die_v and_o that_o therefore_o all_o such_o oath_n as_o be_v command_v under_o the_o law_n be_v not_o forbid_v by_o that_o text_n mat._n 5.34_o i_o confess_v this_o be_v the_o sound_a argument_n i_o have_v meet_v with_o be_v well_o for_o he_o if_o he_o according_a to_o the_o text_n never_o have_v occasion_n to_o remember_v they_o any_o more_o but_o i_o humble_o conceive_v that_o few_o man_n in_o england_n will_v say_v that_o the_o time_n be_v yet_o come_v that_o the_o prophet_n speak_v of_o and_o although_o mr._n ives_n cit_v the_o apostle_n peter_n word_n 2_o pet._n 3._o to_o prove_v that_o the_o prophet_n do_v respect_v the_o new_a testament_n time_n yet_o i_o suppose_v that_o after_o the_o heaven_n and_o the_o earth_n be_v burn_v up_o than_o mr._n ives_n will_v have_v do_v write_v of_o book_n but_o to_o come_v unto_o the_o text_n if_o it_o do_v respect_v our_o time_n as_o doubtless_o it_o do_v not_o yet_o it_o do_v not_o reach_v our_o case_n because_o it_o mention_n nothing_o promissory_n again_o whereas_o he_o cit_v psalm_n 15.4_o to_o prove_v promissory_n swear_v under_o the_o new_a testament_n to_o this_o i_o answer_v that_o if_o this_o text_n must_v of_o necessity_n be_v understand_v to_o have_v respect_n to_o the_o time_n of_o the_o gospel_n than_o it_o be_v either_o because_o some_o text_n of_o scripture_n tell_v we_o so_o or_o else_o because_o that_o swear_n be_v in_o all_o age_n a_o duty_n so_o incumbent_a upon_o saint_n that_o none_o can_v dwell_v in_o god_n holy_a hilâ—_n that_o have_v not_o be_v find_v act_v therein_o but_o there_o be_v no_o text_n of_o scripture_n that_o tell_v we_o that_o this_o prophet_n in_o this_o text_n have_v respect_n to_o gospel_n time_n and_o i_o be_o persuade_v that_o none_o will_v be_v so_o ridiculous_a as_o to_o say_v that_o swear_v be_v in_o all_o age_n a_o duty_n so_o incumbent_a upon_o saint_n that_o none_o can_v dwell_v in_o god_n holy_a hill_n that_o have_v not_o be_v find_v act_v therein_o and_o whereas_o he_o cit_v isa_n 45.23_o i_o must_v say_v it_o do_v not_o respect_v our_o time_n because_o then_o every_o tongue_n shall_v confess_v god_n but_o at_o this_o present_a they_o do_v not_o but_o however_o it_o do_v not_o respect_v our_o case_n and_o therefore_o i_o shall_v leave_v it_o i_o come_v now_o to_o his_o four_o reason_n which_o be_v that_o those_o two_o text_n mat._n 5._o and_o jam._n 5._o god_n as_o if_o he_o have_v pronounce_v the_o oath_n with_o his_o own_o lip_n i_o much_o wonder_n that_o he_o shall_v so_o much_o wrong_v the_o prophet_n for_o if_o every_o time_n the_o king_n abjure_v he_o he_o be_v swear_v than_o he_o be_v sometime_o forswear_v for_o it_o be_v plain_a from_o the_o word_n how_o many_o time_n that_o the_o king_n have_v sometime_o abjure_v he_o before_o and_o yet_o we_o do_v not_o find_v that_o he_o give_v the_o king_n any_o direct_a answer_n before_o and_o therefore_o i_o conclude_v as_o before_o that_o except_o the_o prophet_n have_v first_o own_v the_o oath_n and_o then_o answer_v he_o be_v not_o swear_v i_o confess_v i_o can_v but_o much_o wonder_n that_o he_o shall_v so_o earnest_o desire_v other_o to_o consider_v of_o this_o and_o yet_o so_o little_o consider_v of_o it_o himself_o for_o he_o first_o tell_v we_o that_o a_o man_n be_v swear_v if_o he_o do_v but_o speak_v the_o truth_n when_o he_o be_v abjure_v by_o the_o live_a god_n and_o yet_o he_o tell_v we_o afterward_o that_o a_o oath_n like_o this_o we_o have_v in_o our_o common_a law_n now_o i_o will_v appeal_v to_o any_o man_n that_o know_v but_o any_o thing_n of_o the_o law_n whether_o or_o not_o when_o the_o witness_n be_v charge_v by_o the_o help_n of_o god_n to_o speak_v the_o truth_n the_o whole_a truth_n and_o nothing_o but_o the_o truth_n between_o party_n and_o party_n now_o if_o the_o witness_n shall_v speak_v the_o truth_n without_o lay_v his_o hand_n upon_o the_o book_n and_o kiss_v it_o or_o give_v his_o consent_n to_o or_o own_v of_o the_o oath_n i_o will_v fain_o know_v whether_o any_o rational_a man_n will_v say_v that_o this_o man_n be_v swear_v therefore_o i_o will_v desire_v you_o for_o to_o consider_v that_o it_o be_v one_o thing_n for_o a_o man_n to_o relate_v a_o matter_n when_o he_o be_v charge_v or_o abjure_v to_o swear_v to_o it_o and_o another_o thing_n for_o a_o man_n first_o to_o own_o or_o take_v the_o oath_n upon_o he_o and_o then_o to_o relate_v it_o upon_o his_o oath_n now_o the_o three_o way_n by_o which_o a_o man_n bind_v his_o soul_n by_o a_o oath_n i_o do_v grant_n be_v no_o less_o sacred_a though_o somewhat_o different_a from_o the_o former_a and_o that_o be_v call_v a_o oath_n of_o curse_v num._n 5.21_o but_o this_o oath_n be_v not_o otherways_o take_v then_o the_o former_a for_o either_o the_o party_n take_v it_o must_v utter_v the_o curse_n with_o his_o own_o mouth_n 2_o sam._n 3.35_o or_o else_o when_o the_o oath_n be_v pronounce_v by_o another_o the_o party_n must_v say_v amen_o or_o a_o word_n of_o like_a import_n to_o signify_v that_o they_o own_v the_o oath_n or_o else_o they_o be_v not_o bind_v as_o appear_v num._n 5.22_o nehe._n 5_o 12_o 13._o and_o all_o the_o congregation_n say_v amen_o and_o therefore_o i_o shall_v now_o come_v unto_o the_o second_o qustion_n viz._n what_o be_v the_o end_n of_o sacred_a oath_n and_o here_o i_o can_v but_o take_v notice_n of_o his_o distinction_n between_o oath_n command_v and_o voluntary_a because_o he_o say_v that_o oath_n that_o be_v command_v be_v ordinary_o such_o as_o be_v make_v by_o god_n to_o man_n and_o oath_n that_o be_v voluntary_a be_v make_v to_o god_n i_o confess_v if_o this_o distinction_n be_v true_a it_o will_v somewhat_o clear_v the_o matter_n and_o therefore_o let_v we_o take_v good_a notice_n of_o the_o way_n he_o take_v to_o prove_v it_o for_o faith_n he_o this_o distinction_n appear_v plain_o if_o we_o consider_v the_o example_n of_o abraham_n swear_v his_o servant_n to_o he_o by_o the_o loid_v gon._n 23.4_o and_o abraham_n swear_v by_o the_o lord_n abimeleoh_o gen_n 21.23_o and_o the_o spy_n swear_v by_o the_o lord_n to_o rahab_n jos_n 2_o 12._o i_o confess_v if_o these_o text_n prove_v that_o god_n command_v man_n to_o swear_v one_o to_o another_o they_o will_v make_v something_o to_o his_o purpose_n but_o if_o every_o practice_n or_o example_n of_o the_o servant_n of_o god_n of_o every_o thing_n that_o be_v practise_v by_o the_o servant_n of_o god_n of_o old_a be_v command_v by_o god_n for_o all_o man_n that_o know_v any_o thing_n do_v know_v that_o they_o practise_v many_o thing_n as_o liberty_n and_o not_o as_o command_v now_o therefore_o except_o i_o can_v find_v one_o text_n of_o scripture_n either_o in_o old_a or_o new_a testament_n to_o prove_v that_o promissory_n swear_v be_v command_v i_o conclude_v that_o it_o be_v never_o command_v now_o say_v he_o the_o end_n of_o such_o oath_n as_o man_n swear_v by_o god_n to_o one_o another_o be_v as_o the_o author_n to_o the_o hebrew_n tell_v we_o heb._n 6_o 1â—_n to_o end_v all_o strife_n and_o to_o confirm_v the_o truth_n of_o a_o matter_n in_o question_n a_o example_n we_o have_v of_o this_o exod._n 22.11_o then_o shall_v a_o oath_n of_o the_o lord_n be_v between_o they_o both_o that_o he_o have_v not_o put_v his_o hand_n unto_o his_o neighbour_n good_n and_o the_o owner_n thereof_o shall_v accept_v it_o and_o he_o shall_v not_o make_v it_o good_a now_o i_o grant_v that_o one_o end_n of_o man_n swear_n one_o to_o another_o be_v as_o the_o author_n to_o the_o hebrew_n say_v to_o end_v all_o strife_n
