aforesaid_a but_o be_v make_v incapable_a of_o any_o office_n or_o employment_n under_o their_o majesty_n and_o forfeit_v the_o penalty_n of_o their_o bond_n for_o true_a performance_n of_o their_o trust_n xiii_o any_o person_n by_o writ_n of_o assistance_n under_o the_o seal_n of_o the_o exchequer_n may_v take_v a_o constable_n or_o other_o public_a officer_n and_o in_o the_o daytime_n enter_v into_o any_o house_n shop_n cellar_n warehouse_n etc._n etc._n and_o in_o case_n of_o resistance_n may_v break_v open_a door_n trunk_n or_o other_o package_n to_o seize_v and_o bring_v to_o their_o course_n of_o proceed_v as_o may_v be_v use_v about_o the_o seize_v try_v and_o prosecute_n any_o good_n or_o commodity_n for_o nonpayment_n of_o custom_n or_o other_o duty_n or_o any_o person_n for_o offend_v against_o the_o law_n relate_v to_o custom_n and_o person_n prosecute_v for_o any_o thing_n do_v about_o the_o put_v
such_o penalty_n and_o forfeiture_n as_o in_o the_o act_v make_v in_o the_o 12_o year_n of_o king_n charles_n ii_o and_o the_o 15_o of_o the_o same_o king_n be_v mention_v or_o by_o another_o law_n in_o force_n relate_v to_o the_o say_a revenue_n of_o excise_n and_o the_o clause_n in_o the_o say_a act_n to_o be_v of_o force_n for_o and_o concern_v the_o duty_n hereby_o grant_v as_o if_o particular_o recite_v in_o the_o body_n of_o this_o act._n ix_o the_o commissioner_n of_o the_o excise_n apart_o money_n arise_v by_o these_o duty_n to_o be_v keep_v apart_o and_o the_o commissioner_n and_o other_o officer_n of_o the_o custom_n at_o the_o head-office_n in_o london_n shall_v separate_v and_o keep_v apart_o all_o the_o money_n arise_v by_o these_o duty_n as_o the_o same_o shall_v from_o time_n to_o time_n arise_v or_o be_v pay_v into_o the_o say_a office_n of_o excise_n or_o unto_o the_o receiver-general_n of_o the_o custom_n and_o the_o comptroller_n of_o the_o excise_n and_o of_o the_o custom_n or_o their_o respective_a deputy_n shall_v keep_v a_o distinct_a account_n in_o book_n fair_o write_v of_o all_o those_o rate_n and_o duty_n to_o which_o all_o person_n shall_v have_v free_a access_n at_o all_o reasonable_a time_n gratis_o pay-day_n holiday_n not_o pay-day_n and_o the_o commissioner_n of_o the_o excise_n and_o custom_n be_v to_o pay_v weekly_o upon_o every_o week_n if_o it_o be_v not_o a_o holiday_n and_o then_o the_o next_o day_n after_o that_o be_v not_o a_o holiday_n pay_v monies_n how_o to_o be_v pay_v these_o money_n into_o the_o receipt_n of_o the_o the_o same_o or_o if_o such_o comptroller_n shall_v neglect_v his_o duty_n in_o keep_v such_o account_n than_o he_o or_o they_o shall_v forfeit_v their_o respective_a place_n and_o be_v incapable_a of_o any_o place_n of_o trust_n or_o office_n whatsoever_o and_o such_o commissioner_n shall_v be_v liable_a to_o pay_v the_o full_a value_n of_o any_o sum_n divert_v or_o misapply_v to_o any_o person_n that_o shall_v sue_v for_o the_o same_o in_o any_o of_o their_o majesty_n court_n of_o record_n at_o westminster_n deduct_v necessary_a charge_n to_o be_v deduct_v their_o majesty_n out_o of_o the_o duty_n may_v allow_v salary_n and_o incident_a charge_n as_o shall_v be_v necessary_a for_o receive_v collect_v and_o manage_v the_o same_o duty_n mile_n head-office_n to_o continue_v in_o london_n or_o within_o ten_o mile_n the_o head-office_n of_o excise_n now_o in_o london_n shall_v be_v continue_v there_o for_o ever_o or_o within_o ten_o mile_n thereof_o and_o likewise_o for_o ever_o shall_v be_v continue_v there_o or_o within_o the_o same_o distance_n a_o comptroller_n of_o the_o excise_n the_o commissioner_n of_o excise_n and_o comptroller_n to_o be_v appoint_v by_o their_o majesty_n their_o heir_n and_o successor_n x._o fond._n what_o shall_v be_v the_o yearly_a fond._n that_o yearly_a and_o every_o year_n reckon_v the_o first_o year_n to_o begin_v from_o the_o one_a of_o june_n 1694._o the_o full_a sum_n of_o 140000_o l._n out_o of_o these_o money_n by_o the_o say_a duty_n of_o tonnage_n and_o excise_n and_o to_o be_v bring_v into_o the_o receipt_n of_o the_o exchequer_n by_o weekly_a payment_n in_o case_n the_o weekly_a payment_n shall_v extend_v thereunto_o shall_v be_v the_o whole_a and_o entire_a yearly_a fond._n supply_v in_o case_n of_o deficiency_n how_o to_o be_v supply_v and_o in_o case_n the_o say_v weekly_a payment_n shall_v not_o amount_v to_o so_o much_o then_o as_o far_o as_o they_o will_v extend_v shall_v be_v part_n of_o the_o yearly_a fond_a for_o and_o towards_o the_o answer_n and_o pay_v of_o the_o annuity_n and_o other_o purpose_n in_o this_o act_n after_o mention_v and_o in_o case_n of_o deficiency_n by_o the_o say_a duty_n of_o tonnage_n and_o excise_n to_o discharge_v and_o satisfy_v the_o annuity_n and_o other_o benefit_n and_o advantage_n by_o this_o act_n appoint_v or_o intend_v to_o be_v pay_v within_o any_o one_o year_n to_o be_v reckon_v as_o aforesaid_a or_o if_o they_o shall_v not_o amount_v in_o their_o weekly_a payment_n to_o so_o much_o as_o 140000_o l._n within_o such_o time_n than_o the_o deficiency_n shall_v be_v make_v good_a out_o of_o any_o treasure_n or_o revenue_n belong_v to_o their_o majesty_n their_o heir_n or_o successor_n not_o be_v appropriate_v to_o any_o particular_a uses_n by_o any_o act_n of_o parliament_n and_o that_o to_o be_v issue_v and_o pay_v without_o any_o far_a or_o other_o warrant_n but_o to_o be_v do_v by_o virtue_n of_o this_o act_n towards_o the_o discharge_n and_o pay_v of_o the_o say_a annuity_n and_o benefit_n as_o together_o with_o the_o money_n bring_v into_o the_o say_a receipt_n for_o the_o duty_n hereby_o grant_v shall_v complete_o pay_v off_o the_o same_o within_o the_o year_n respective_o grow_v due_a and_o the_o yearly_a sum_n of_o 140000_o l._n arise_v by_o and_o out_o of_o the_o say_a imposition_n and_o duty_n hereby_o grant_v shall_v be_v keep_v separate_a and_o apart_o in_o the_o receipt_n of_o the_o exchequer_n to_o be_v pay_v from_o time_n to_o time_n unto_o such_o person_n or_o person_n and_o in_o such_o manner_n proportion_n and_o form_n as_o be_v herein_o after_o direct_v xi_o subscription_n their_o majesty_n to_o appoint_v commissioner_n to_o take_v subscription_n their_o majesty_n by_o commission_n under_o the_o great_a seal_n of_o england_n may_v authorise_v and_o appoint_v any_o number_n of_o person_n to_o take_v and_o receive_v all_o such_o voluntary_a subscription_n as_o shall_v be_v make_v on_o or_o before_o the_o first_o day_n of_o august_n 1694._o by_o any_o person_n or_o person_n native_n or_o foreigner_n body_n politic_a or_o corporate_a for_o and_o towards_o the_o by_o this_o act_n grant_v shall_v by_o the_o auditor_n of_o the_o receipt_n of_o exchequer_n from_o time_n to_o time_n as_o the_o same_o shall_v be_v pay_v in_o be_v separate_v and_o divide_v into_o five_o seven_o part_n and_o two_o seven_o part_n which_o be_v according_a to_o the_o proportion_n of_o the_o say_v yearly_a sum_n of_o 100000_o l._n to_o the_o say_v yearly_a sum_n of_o 140000_o l._n which_o five_a seven_o part_n of_o the_o say_v several_a payment_n arise_v by_o the_o duty_n of_o this_o act_n and_o so_o set_v apart_o be_v appropriate_v towards_o the_o payment_n of_o the_o say_v yearly_a sum_n of_o 100000_o l._n and_o shall_v from_o time_n to_o time_n be_v issue_v and_o pay_v to_o the_o use_n of_o the_o subscriber_n and_o contributor_n towards_o the_o raise_n and_o pay_v into_o the_o receipt_n of_o exchequer_n the_o sum_n of_o 1200000_o l._n xii_o transfer_v the_o 200000_o l._n and_o 100000_o l._n to_o be_v assign_v or_o transfer_v their_o majesty_n by_o letter_n patent_n under_o the_o great_a seal_n may_v limit_v direct_v and_o appoint_v in_o what_o manner_n and_o proportion_n and_o under_o what_o rule_n and_o direction_n the_o say_a sum_n of_o 200000_o l._n every_o act_n of_o parliament_n as_o require_v the_o levy_v the_o duty_n arise_v by_o those_o act_n by_o way_n of_o excise_n upon_o coffee_n chocolate_a and_o tea_n shall_v cease_v and_o determine_v and_o be_v hereby_o repeal_v ii_o and_o be_v it_o far_o enact_v that_o after_o the_o 25_o day_n of_o december_n 1689._o the_o duty_n and_o charge_n hereafter_o mention_v shall_v be_v collect_v and_o pound_n 5_o l._n 12_o s._n upon_o every_o 100_o weight_n of_o cacao_n nut_n contain_v as_o aforesaid_a 8_o l._n 8_o s._n upon_o every_o pound_n weight_n of_o tea_n 5_o s._n and_o upon_o every_o pound_n weight_n of_o chocolate_a 5_o s._n and_o so_o proportionable_o iii_o if_o any_o of_o the_o say_a commodity_n shall_v be_v unshipt_v or_o lay_v on_o land_n the_o duty_n not_o pay_v or_o lawful_o tender_v to_o the_o collector_n or_o his_o deputy_n with_o the_o consent_n and_o agreement_n of_o the_o comtroller_n and_o surveyor_n there_o nor_o agree_v with_o for_o the_o same_o in_o the_o custom-house_n they_o shall_v be_v forfeit_v the_o one_o moiety_n to_o their_o majesty_n the_o other_o to_o the_o informer_n this_o act_n to_o continue_v for_o five_o year_n and_o no_o long_o pay_v double_a the_o sum_n the_o same_o be_v charge_v with_o in_o the_o book_n of_o rate_n so_o as_o notice_n be_v first_o give_v to_o the_o commissioner_n or_o farmer_n of_o the_o custom_n of_o the_o receipt_n one_o book_n in_o which_o such_o money_n shall_v be_v enter_v apart_o and_o all_o person_n lend_v money_n upon_o the_o credit_n of_o this_o act_n shall_v have_v a_o tally_n of_o loan_n strike_v and_o a_o order_n for_o repayment_n bear_v date_n with_o the_o tally_n in_o which_o shall_v be_v a_o warrant_n for_o payment_n of_o interest_n according_a to_o the_o rate_n aforesaid_a to_o be_v pay_v every_o three_o month_n such_o order_n to_o be_v register_v in_o course_n without_o preference_n and_o all_o person_n shall_v be_v pay_v in_o course_n as_o their_o order_n stand_v enter_v money_n as_o aforesaid_a or_o misapply_v any_o part_n thereof_o they_o shall_v forfeit_v their_o office_n and_o be_v uncapable_a of_o any_o office_n or_o place_n of_o trust_n and_o pay_v the_o full_a value_n of_o the_o sum_n misapply_v to_o he_o that_o will_v sue_v for_o the_o same_o no_o fee_n reward_n or_o gratuity_n shall_v be_v demand_v or_o take_v for_o provide_v or_o make_v any_o such_o register_n entry_n view_v or_o search_v in_o or_o for_o payment_n of_o money_n lend_v or_o the_o interest_n by_o any_o of_o their_o majesty_n officer_n their_o clerk_n or_o deputy_n on_o pain_n of_o material_n the_o gauger_n shall_v charge_v the_o
shall_v be_v charge_v upon_o the_o credit_n of_o the_o exchequer_n in_o general_n and_o tally_n of_o loan_n and_o order_n of_o repayment_n levy_v which_o order_n shall_v be_v assignable_a lxxxv_o all_o sum_n of_o money_n so_o to_o be_v borrow_v with_o interest_n for_o the_o same_o not_o exceed_v 7_o l._n per_fw-la cent._n or_o so_o much_o thereof_o as_o shall_v not_o be_v repay_v out_o of_o any_o person_n after_o that_o day_n and_o before_o the_o 29_o of_o september_n next_o follow_v may_v advance_v any_o sum_n not_o exceed_v in_o the_o whole_a with_o what_o shall_v have_v be_v advance_v have_v for_o every_o 100_o l._n a_o yearly_a annuity_n of_o 14_o l._n for_o his_o own_o or_o any_o other_o life_n to_o be_v by_o he_o nominate_v as_o aforesaid_a within_o 6_o day_n after_o payment_n which_o annuity_n shall_v commence_v from_o the_o 29_o of_o september_n 1693._o and_o be_v pay_v at_o the_o four_o most_o usual_a feast_n in_o the_o year_n and_o upon_o payment_n of_o any_o such_o sum_n the_o person_n pay_v the_o same_o shall_v have_v one_o or_o more_o tally_n import_v the_o receipt_n thereof_o and_o order_n for_o payment_n etc._n etc._n to_o be_v sign_v as_o aforesaid_a and_o not_o to_o be_v revocable_a and_o to_o be_v assignable_a and_o the_o money_n arise_v by_o the_o duty_n hereby_o grant_v beside_o so_o much_o as_o shall_v bear_v proportion_n as_o aforesaid_a to_o the_o sum_n which_o shall_v be_v advance_v before_o the_o one_a day_n of_o may_n 1693._o shall_v be_v appropriate_v to_o the_o payment_n of_o the_o say_a annuity_n and_o not_o be_v divert_v under_o the_o port_n or_o place_n where_o they_o be_v seize_v or_o to_o the_o warehouse_n of_o the_o next_o port_n member_n or_o creek_n to_o the_o place_n of_o seizure_n and_o person_n claim_v the_o same_o shall_v tender_v good_a security_n to_o answer_v the_o penalty_n of_o this_o act_n and_o to_o make_v their_o claim_n within_o twenty_o day_n after_o seizure_n to_o the_o collector_n or_o customer_n by_o delivery_n of_o a_o bill_n to_o such_o officer_n subscribe_v with_o his_o name_n addition_n and_o place_n of_o abide_v with_o the_o particular_n of_o the_o good_n claim_v and_o the_o date_n of_o the_o claim_n and_o the_o name_n of_o his_o surety_n they_o be_v worth_a 500_o l._n apiece_o at_o least_o and_o to_o give_v bond_n to_o their_o majesty_n in_o double_a the_o value_n of_o the_o good_n and_o the_o penalty_n in_o this_o act_n to_o answer_v the_o value_n of_o the_o good_n and_o other_o the_o say_a penalty_n and_o after_o such_o security_n give_v the_o claim_n and_o surety_n name_n and_o the_o sum_n and_o date_n of_o the_o bond_n to_o be_v register_v and_o subscribe_v by_o the_o claimer_n collector_n or_o customer_n to_o who_o such_o bill_n shall_v be_v deliver_v and_o for_o destruction_n thereof_o in_o a_o certificate_n to_o be_v enter_v in_o the_o say_a book_n of_o the_o day_n of_o the_o destruction_n thereof_o no_o person_n to_o take_v away_o or_o save_v any_o of_o to_o the_o custom_n or_o any_o part_n of_o the_o revenue_n or_o any_o other_o office_n whatsoever_o and_o if_o any_o such_o commodity_n import_v contrary_a to_o this_o act_n shall_v within_o the_o time_n aforesaid_a upon_o any_o pretence_n be_v sell_v retail_v or_o utter_v or_o be_v find_v within_o england_n ireland_n etc._n etc._n any_o person_n may_v seize_v they_o and_o like_o information_n and_o judgement_n for_o destruction_n thereof_o shall_v be_v have_v and_o give_v as_o aforesaid_a iii_o they_o in_o who_o custody_n such_o good_n shall_v be_v find_v shall_v incur_v the_o forfeiture_n and_o in_o case_n they_o be_v not_o sufficient_a than_o the_o loan_n which_o shall_v remain_v unsatisfied_a and_o their_o interest_n shall_v be_v repay_v out_o of_o the_o next_o aid_n or_o supply_n grant_v in_o parliament_n and_o shall_v be_v transfer_v thereunto_o as_o soon_o as_o any_o such_o aid_n or_o supply_n shall_v be_v grant_v to_o their_o majesty_n treasury_n for_o want_v of_o such_o aid_n to_o be_v supply_v out_o of_o the_o treasury_n and_o if_o no_o such_o aid_n or_o supply_n be_v grant_v before_o the_o 2d_o of_o february_n 1694._o then_o the_o sum_n so_o borrow_v and_o their_o
