any_o town_n or_o county_n within_o this_o province_n be_v hereby_o full_o impower_v and_o authorize_v to_o have_v cognizance_n of_o all_o cause_n case_n of_o debt_n and_o trespass_n to_o the_o value_n of_o forty_o shilling_n or_o under_o which_o cause_n and_o case_n shall_v he_o hear_v try_v and_o final_o determine_v without_o a_o jury_n by_o every_o justice_n of_o the_o peace_n that_o reside_v within_o any_o town_n or_o county_n within_o this_o province_n he_o take_v to_o his_o assistance_n at_o the_o time_n of_o his_o hear_n and_o determine_v such_o cause_n or_o case_n of_o debt_n and_o trespass_n to_o the_o value_n of_o forty_o shilling_n and_o under_o one_o of_o the_o freeholders_n of_o the_o town_n and_o place_n where_o the_o cause_n of_o action_n do_v arise_v the_o first_o tuesday_n in_o august_n the_o first_o tuesday_n in_o november_n and_o the_o first_o tuesday_n in_o february_n for_o the_o city_n and_o county_n of_o albany_n at_o the_o city_n hall_n of_o the_o say_a city_n the_o first_o tuesday_n in_o june_n the_o first_o tuesday_n in_o october_n and_o the_o first_o tuesday_n in_o february_n for_o westchester_n at_o westobester_n the_o first_o tuesday_n in_o june_n and_o the_o first_o tuesday_n in_o december_n for_o ulster_n at_o kingston_n the_o first_o tuesday_n in_o september_n and_o the_o first_o tuesday_n in_o march_n for_o the_o county_n of_o richmond_n at_o the_o court-house_n the_o first_o tuesday_n in_o september_n and_o the_o first_o tuesday_n in_o march_n for_o king_n county_n at_o flatbush_n alias_o midwout_n the_o second_o tuesday_n in_o may_n and_o the_o second_o tuesday_n in_o november_n for_o queen_n county_n at_o jamaica_n the_o three_o tuesday_n in_o may_n and_o the_o three_o tuesday_n in_o september_n for_o suffolk_n county_n at_o southold_n the_o last_o tuesday_n in_o september_n and_o the_o last_o tuesday_n in_o march_n at_o southampton_n orange_n county_n to_o be_v annix_v to_o the_o county_n of_o new-york_n and_o duchess_n county_n to_o the_o county_n of_o ulster_n which_o session_n of_o the_o peace_n shall_v only_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n and_o no_o long_o and_o for_o the_o more_o regular_a and_o beneficial_a distribution_n of_o justice_n to_o the_o inhabitant_n of_o each_o respective_a city_n and_o county_n within_o this_o province_n be_v it_o further_o enact_v by_o the_o authority_n a_o foresay_a that_o there_o be_v keep_v and_o hold_v a_o court_n of_o common_a plea_n in_o each_o respective_a city_n and_o county_n within_o this_o province_n at_o the_o time_n and_o place_n hereafter_o name_v and_o express_v that_o be_v to_o say_v at_o such_o place_n in_o each_o respective_a county_n as_o the_o say_a court_n of_o session_n be_v to_o be_v keep_v and_o to_o begin_v the_o next_o day_n after_o the_o session_n terminate_v and_o only_o to_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n and_o no_o long_o and_o that_o there_o be_v one_o judge_n with_o three_o justice_n in_o each_o county_n appoint_v and_o commissionated_a to_o hold_v the_o same_o court_n of_o plea_n three_o whereof_o to_o be_v a_o quorum_fw-la and_o that_o the_o several_a and_o respective_a court_n hereby_o establish_v shall_v have_v jurisdiction_n to_o hear_v try_v and_o final_o to_o determine_v all_o action_n or_o cause_n always_o and_o it_o be_v hereby_o enact_v that_o the_o court_n of_o mayor_n and_o alderman_n of_o the_o respective_a city_n of_o new_a york_n and_o albany_n shall_v have_v in_o each_o of_o their_o respective_a city_n the_o power_n and_o authority_n to_o hear_v try_v and_o final_o to_o determine_v all_o such_o action_n and_o suit_n as_o be_v common_o cognizable_a before_o they_o from_o which_o final_a determination_n there_o shall_v not_o be_v any_o appeal_n or_o removal_n by_o habeas_fw-la corpus_fw-la of_o any_o person_n or_o of_o any_o action_n or_o suit_n or_o of_o any_o judgement_n or_o execution_n to_o the_o value_n of_o twenty_o pound_n or_o under_o any_o thing_n contain_v herein_o to_o the_o contrary_a in_o any_o way_n notwithstanding_o to_o which_o respective_a court_n of_o common_a plea_n there_o shall_v belong_v and_o be_v appoint_v and_o commissionated_a for_o that_o purpose_n one_o clerk_n of_o the_o court_n to_o draw_v enter_z and_o keep_v the_o record_n say_a court_n shall_v issue_v out_o of_o the_o office_n of_o the_o clerk_n of_o the_o court_n in_o each_o city_n and_o county_n respective_o sign_v per_fw-la curiam_fw-la and_o that_o their_o majesty_n subject_n inhabit_v within_o this_o province_n may_v have_v all_o the_o good_a proper_a and_o just_a way_n and_o mean_n for_o the_o secure_n and_o recover_v their_o just_a right_n and_o demand_n within_o the_o same_o be_v it_o further_o enact_v and_o it_o be_v hereby_o enact_v and_o ordain_v by_o authority_n aforesaid_a that_o there_o shall_v be_v hold_v and_o keep_v a_o supreme_a court_n of_o judicature_n which_o shall_v be_v due_o and_o constant_o keep_v at_o the_o city_n of_o new-york_n and_o not_o elsewhere_o at_o the_o several_a and_o respective_a time_n hereafter_o mention_v and_o that_o there_o be_v five_o justice_n at_o least_o appoint_a and_o commissionated_a to_o hold_v the_o same_o court_n two_o whereof_o together_o with_o one_o chief_a justice_n to_o be_v a_o quorum_fw-la which_o supreme_a court_n be_v hereby_o full_o impower_v and_o authorize_v to_o have_v cognizance_n of_o all_o plea_n civil_a criminal_a and_o mix_v as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n whatsoever_o as_o the_o court_n of_o king_n bench_n common_a plea_n and_o exchequer_n within_o their_o majesty_n kingdom_n of_o england_n have_v or_o aught_o to_o have_v in_o and_o to_o which_o supreme_a court_n all_o and_o every_o person_n and_o person_n
the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n aldermen_z and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n or_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a say_v that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o and_o true_o equal_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respestive_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o be_v or_o they_o shall_v make_v fine_a or_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o imprisonment_n as_o by_o the_o discretion_n of_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o whereas_o there_o have_v be_v great_a neglect_n in_o the_o justice_n of_o the_o peace_n collector_n and_o assessor_n who_o have_v delay_v execute_v their_o respective_a duty_n according_a to_o the_o true_a intent_n and_o meaning_n of_o the_o former_a act_n make_v in_o several_a session_n of_o this_o present_a assembly_n for_o the_o prevention_n of_o the_o like_a for_o the_o future_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o respective_a city_n and_o county_n aforesaid_a shall_v refuse_v neglect_n or_o delay_n to_o have_v their_o respective_a quota_fw-la or_o proportion_n of_o man_n at_o the_o city_n of_o new-york_n or_o at_o the_o city_n of_o albany_n on_z or_o before_o the_o 20_o day_n of_o may_n now_o next_o ensue_v pursuant_n to_o the_o warrant_v direct_v to_o they_o from_o the_o commander_n in_o chief_a as_o aforesaid_a and_o also_o if_o any_o of_o the_o respective_a city_n and_o county_n aforesaid_a shall_v refuse_v delay_n or_o neglect_v to_o make_v payment_n of_o the_o several_a respective_a sum_n or_o proportion_n of_o money_n by_o they_o respective_o to_o be_v pay_v as_o aforesaid_a at_o the_o time_n and_o place_n above_o mention_v and_o appoint_v that_o then_o and_o for_o every_o day_n after_o the_o say_a day_n aforementioned_a and_o appoint_v for_o the_o payment_n thereof_o or_o until_o the_o whole_a sum_n and_o proportion_n of_o each_o respective_a city_n and_o county_n shall_v be_v full_o pay_v and_o satisfy_v such_o city_n and_o county_n or_o county_n that_o shall_v be_v defective_a therein_o shall_v each_o and_o every_o of_o they_o forfeit_v and_o pay_v for_o the_o intent_n aforesaid_a the_o far_a sum_n of_o five_o pound_n â—urrant_n money_n aforesaid_a for_o each_o day_n default_n or_o neglect_v of_o have_v their_o quota_fw-la of_o man_n or_o payment_n of_o their_o respective_a proportion_n at_o the_o time_n appoint_v and_o for_o the_o enable_v the_o commander_n in_o chief_a to_o borrow_v money_n or_o to_o agree_v for_o provision_n for_o the_o maintain_n of_o the_o two_o company_n aforesaid_a that_o the_o purpose_n of_o this_o act_n may_v be_v true_o attend_v and_o execute_v be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o person_n or_o person_n to_o advance_v &_o lend_v to_o the_o commander_n in_o chief_a etc._n etc._n upon_o the_o credit_n of_o this_o act_n any_o sum_n or_o sum_n of_o money_n not_o exceed_v the_o sum_n of_o 700_o l._n and_o to_o have_v and_o receive_v for_o the_o forbearance_n of_o all_o such_o money_n as_o shall_v be_v lend_v interest_n not_o exceed_v the_o rate_n of_o ten_o per_fw-la cent._n per_fw-la annum_fw-la and_o to_o the_o end_n that_o all_o money_n and_o provision_n which_o shall_v be_v so_o lend_v unto_o the_o commander_n in_o chief_a etc._n etc._n may_v be_v well_o and_o sufficient_o secure_v out_o of_o the_o money_n arise_v and_o payable_a by_o this_o act_n with_o the_o interest_n for_o the_o same_o not_o exceed_v ten_o per_n cent._n per_fw-la annum_fw-la as_o aforesaid_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o their_o majesty_n collector_n and_o receiver_n general_n for_o the_o time_n be_v shall_v separate_v and_o keep_v apart_o all_o the_o money_n arise_v by_o the_o rate_n &_o proportion_n hereby_o grant_v as_o the_o same_o shall_v arise_v and_o be_v pay_v unto_o he_o by_o the_o receiver_n or_o collector_n of_o the_o same_o or_o by_o any_o other_o person_n whatsoever_o
of_o the_o town_n or_o precinct_n or_o any_o depute_a by_o he_o where_o the_o the_o parry_n complain_v against_o do_v live_v which_o summon_v be_v personal_o serve_v or_o leave_v at_o the_o november_n and_o the_o first_o tuesday_n in_o february_n for_o the_o city_n and_o county_n of_o albany_n three_o general_a session_n of_o the_o peace_n at_o the_o city_n hall_n of_o the_o say_a city_n annual_o and_o every_o year_n on_o the_o first_o tuesday_n in_o june_n on_o the_o first_o tuesday_n in_o october_n and_o on_o the_o first_o tuesday_n of_o february_n and_o for_o the_o county_n of_o westchester_n two_o general_a session_n of_o the_o peace_n annual_o and_o every_o year_n at_o westchester_n on_o the_o first_o tuesday_n of_o june_n and_o on_o the_o first_o tuesday_n of_o december_n and_o for_o the_o county_n of_o ulster_n and_o duchess_n county_n two_o general_a session_n of_o the_o peace_n annual_o and_o every_o year_n at_o kingston_n on_o the_o first_o tuesday_n of_o march_n aforesaid_a that_o there_o shall_v be_v keep_v and_o hold_v a_o court_n of_o common_a plea_n in_o each_o respective_a county_n aforesaid_a at_o the_o time_n and_o place_n hereafter_o name_v and_o mention_v that_o be_v to_o say_v at_o such_o place_n in_o each_o respective_a county_n as_o the_o say_a general_n session_n of_o the_o peace_n be_v to_o be_v keep_v and_o to_o begin_v the_o next_o day_n after_o the_o session_n terminate_v and_o then_o only_o to_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n after_o and_o no_o long_o and_o that_o there_o be_v a_o judge_n assist_v with_o three_o justice_n of_o the_o peace_n in_o each_o respective_a county_n appoint_v and_o commissionated_a to_o hold_v the_o same_o court_n of_o plea_n three_o whereof_o to_o be_v a_o quorum_fw-la and_o that_o the_o several_a and_o respective_a court_n of_o plea_n hereby_o establish_v shall_v have_v power_n and_o jurisdiction_n to_o hear_v try_v and_o final_o determine_v all_o action_n or_o cause_n of_o action_n and_o all_o matter_n and_o thing_n and_o cause_n tryable_a at_o the_o common_a law_n of_o what_o nature_n of_o kind_a whatsoever_o so_o that_o the_o action_n or_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o court_n of_o mayor_n and_o alderman_n of_o the_o respective_a city_n of_o new-york_n and_o albany_n shall_v have_v in_o each_o of_o their_o respective_a city_n the_o power_n and_o authority_n to_o hear_v try_v and_o final_o to_o determine_v all_o such_o suit_n and_o action_n of_o their_o corporation_n as_o be_v common_o cognizable_a before_o they_o from_o which_o final_a determination_n there_o shall_v not_o be_v any_o appeal_n or_o removal_n by_o habeas_fw-la corpus_fw-la of_o any_o person_n or_o of_o any_o action_n or_o suit_n or_o of_o any_o judgement_n or_o execution_n to_o the_o value_n of_o twenty_o pound_n or_o under_o any_o thing_n the_o city_n of_o albany_n with_o the_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n of_o albany_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v forthwith_o upon_o the_o publication_n hereof_o assemble_v and_o meet_v together_o at_o the_o court-house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freehold_n of_o the_o respective_a place_n for_o the_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o refuse_v to_o take_v oath_n as_o aforesaid_a or_o shall_v in_o any_o way_n deny_v neglect_n or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v refuse_v or_o neglect_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v or_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_v of_o any_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v alderman_n within_o the_o city_n of_o albany_n with_o the_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n of_o albany_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v within_o forty_o day_n after_o the_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a respective_a city_n town_n manor_n or_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o detray_n of_o the_o public_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v or_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n or_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o and_o true_o equal_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o safe_a of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o therein_o bedue_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a and_o respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v and_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o beforementioned_a according_a to_o the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n and_o alder-man_n and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n and_o do_v not_o elect_v annual_o or_o once_o respective_a manor_n and_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n &_o collector_n for_o the_o assess_n of_o their_o respective_a manor_n and_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n of_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n and_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n &_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o or_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n aforementioned_a asse_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v &_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o make_v fine_a and_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satify_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o justice_n of_o the_o peace_n for_o the_o city_n or_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattle_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o that_o where_o any_o of_o the_o good_n and_o chattel_n shall_v be_v distrain_v for_o any_o of_o the_o assessment_n and_o rate_n aforesaid_a and_o the_o owner_n of_o the_o say_a good_n shall_v not_o within_o five_o day_n next_o after_o such_o distress_n take_v and_o notice_n thereof_o with_o the_o cause_n of_o such_o take_v leave_v at_o the_o house_n or_o other_o most_o know_a place_n where_o the_o distress_n be_v make_v come_v and_o pay_v to_o the_o collector_n and_o receiver_n of_o the_o assessment_n aforesaid_a that_o then_o after_o such_o distress_n and_o notice_n as_o aforesaid_a and_o expiration_n of_o the_o say_v five_o day_n the_o collector_n or_o person_n distrain_v shall_v and_o may_v cause_v the_o good_n and_o chattel_n so_o distrain_v to_o be_v appraise_v by_o two_o swear_a appraiser_n to_o appraise_v the_o same_o true_o according_a to_o the_o best_a of_o their_o understanding_n and_o after_o such_o appraisement_n shall_v and_o may_v lawful_o carry_v and_o drive_v the_o say_v good_n and_o chattel_n so_o distrain_v into_o any_o county_n or_o town_n throughout_o the_o province_n and_o the_o say_v good_n and_o chattel_n shall_v and_o may_v there_o lawful_o sell_v for_o the_o best_a price_n can_v be_v get_v for_o the_o same_o towards_o satisfaction_n of_o the_o rate_n aforesaid_a and_o of_o the_o charge_n of_o such_o distress_n appraisement_n and_o sale_n give_v the_o overplus_a to_o the_o owner_n and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o article_n and_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a intent_n and_o meaning_n thereof_o shall_v deny_v neglect_n refuse_v or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o and_o every_o or_o any_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v convict_v before_o the_o governor_n and_o council_n or_o before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a and_o imprisonment_n as_o by_o the_o discretion_n of_o the_o say_a governor_n and_o council_n and_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o prosecute_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n clause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v be_v nonsuited_a or_o forbear_v further_a prosecution_n or_o suffer_v discontinuance_n or_o verdict_n to_o pass_v against_o he_o the_o defendant_n or_o defendant_n shall_v recover_v treble_a cost_v for_o which_o they_o shall_v have_v the_o like_a remedy_n as_o in_o case_n where_o cost_v by_o the_o law_n be_v give_v to_o defendant_n provide_v always_o that_o no_o major_n alderman_n or_o justice_n of_o the_o peace_n shall_v be_v trouble_v sue_v prosecute_v authority_n aforesaid_a that_o the_o several_a collector_n of_o each_o respective_a city_n and_o county_n as_o aforesaid_a shall_v have_v liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforesaid_a in_o currant_n money_n at_o new-york_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o rate_n and_o price_n hereafter_o specify_v and_o express_v to_o wit_n good_a merchantable_a pork_n at_o the_o rate_n of_o fifty_o shilling_n per_fw-la barrel_n the_o barrel_n well_o repacked_a by_o the_o swear_a packer_n at_o new-york_n and_o the_o barrel_n contain_v thirty_o one_o gallon_n and_o half_a winchester_z measure_n at_o least_o beef_n at_o the_o rate_n of_o thirty_o two_o shilling_n and_o six_o penny_n per_fw-la barrel_n well_o repackt_v by_o the_o swear_a packer_n of_o new-york_n aforesaid_a the_o barrel_n to_o contain_v thirty_o one_o gallon_n and_o a_o half_a winchester-measure_n at_o least_o good_a merchantable_a winter_n wheat_n at_o four_o shilling_n per_fw-la bushel_n try_v tallow_n at_o four_o penny_n half_a penny_n per_fw-la pound_n provide_v always_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o it_o shall_v so_o happen_v that_o his_o excellency_n pursuant_n to_o the_o limitation_n aforesaid_a can_v not_o effect_v to_o raise_v so_o many_o volunteer_n in_o manner_n aforesaid_a but_o that_o for_o the_o intent_n aforesaid_a his_o excellency_n shall_v be_v constrain_v to_o make_v proportionable_a detachment_n in_o the_o respective_a city_n and_o county_n within_o this_o province_n to_o complete_a the_o number_n of_o the_o force_n as_o aforesaid_a than_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o there_o shall_v only_o be_v allow_v &_o pay_v unto_o such_o person_n or_o person_n so_o detach_v as_o aforesaid_a for_o the_o service_n aforesaid_a the_o sum_n of_o eight_o penny_n per_fw-la diem_fw-la for_o each_o person_n so_o employ_v as_o aforesaid_a and_o no_o
shall_v forever_o be_v bar_v their_o claim_n and_o upon_o any_o future_a peosecution_n the_o defendant_n may_v plead_v the_o general_a issue_n and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n shall_v become_v nonsuit_n or_o forbear_v further_a prosecution_n or_o suffer_v discontinuance_n or_o if_o verdict_n pass_v against_o he_o the_o say_a not_o appear_v to_o make_v their_o defence_n or_o show_v some_o lawful_a cause_n why_o they_o can_v not_o appear_v shall_v be_v deem_v and_o esteem_v as_o defaulter_n and_o sentence_n and_o decree_n in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o the_o rate_n duty_n and_o excise_n make_v payable_a upon_o merchandize_n fur_n and_o liquor_n shall_v be_v levy_v collect_v and_o pay_v unto_o their_o most_o excellent_a majesty_n for_o the_o term_n and_o space_n of_o five_o year_n next_o and_o after_o the_o expiration_n of_o the_o term_n limit_v in_o the_o say_a it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n cause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o aforesaid_a shall_v have_v the_o liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforemention_v in_o currant_n silver_n money_n at_o new-york_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o rate_n and_o price_n hereafter_o specify_v and_o express_v to_o wit_n good_a and_o merchantable_a re-inforcement_n security_n and_o defence_n of_o the_o fronteer_n there_o until_o the_o first_o day_n of_o march_n than_o next_o follow_v and_o also_o that_o the_o say_a captain_n general_n will_v wholesome_a provision_n of_o beer_n bread_n and_o meat_n and_o ammunition_n during_o the_o time_n that_o they_o shall_v be_v employ_v in_o the_o service_n aforesaid_a and_o also_o take_v effectual_a care_n that_o all_o and_o every_o of_o the_o say_v effective_a man_n be_v well_o pay_v according_a to_o the_o king_n establishment_n after_o the_o expiration_n of_o the_o say_a service_n and_o likewise_o that_o they_o shall_v pay_v and_o satisfy_v such_o officer_n as_o shall_v be_v commissionated_a and_o appoint_v over_o they_o according_a to_o the_o king_n establishment_n aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o officer_n civil_a or_o military_a within_o the_o say_a county_n shall_v delay_v neglect_n or_o refuse_v to_o perform_v and_o execute_v the_o several_a and_o respective_a article_n and_o clause_n of_o this_o act_n according_a to_o the_o true_a intent_n and_o meaning_n thereof_o he_o or_o they_o so_o neglect_v refuse_v or_o delay_v shall_v be_v liable_a to_o such_o penalty_n respective_o as_o be_v in_o case_n of_o such_o refusal_n neglect_n or_o delay_v provide_v in_o the_o other_o act_n of_o this_o present_a expense_n for_o the_o defence_n of_o this_o their_o province_n and_o dominion_n against_o the_o design_n and_o invasion_n of_o the_o common_a enemy_n and_o find_v it_o also_o necessary_a that_o in_o this_o time_n of_o so_o great_a and_o eminent_a danger_n that_o their_o majesty_n government_n over_o this_o province_n shall_v be_v honourable_o support_v and_o maintain_v they_o in_o most_o thankful_a acknowledgement_n of_o their_o majesty_n tender_a care_n of_o the_o welfare_n of_o their_o subject_n in_o this_o province_n have_v cheerful_o and_o unanimous_o for_o the_o purpose_n plaint_n or_o information_n wherein_o no_o essoyn_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v and_o also_o all_o such_o good_n as_o shall_v be_v land_a without_o entry_n make_v as_o and_o enter_v into_o bond_n to_o the_o value_n of_o one_o thousand_o pound_n currant_n money_n of_o new_a york_n with_o sufficient_a surety_n that_o they_o shall_v not_o take_v on_o board_n direct_o or_o indirect_o any_o good_n or_o merchandise_n afore_o recite_v and_o express_v without_o such_o permit_v or_o certificate_n from_o the_o collector_n or_o any_o have_a authority_n under_o he_o for_o from_o liquor_n within_o this_o province_n or_o dependency_n shall_v upon_o their_o purchase_n and_o receipt_n of_o all_o such_o liquor_n or_o liquor_n before_o express_v and_o exciseable_a come_v to_o the_o office_n or_o office_n of_o the_o excise_n and_o there_o or_o with_o he_o make_v entry_n of_o all_o such_o liquor_n or_o liquor_n as_o they_o shall_v buy_v or_o receive_v and_o pay_v such_o duty_n as_o be_v hereby_o appoint_v within_o twenty_o four_o hour_n or_o at_o such_o convenient_a time_n as_o the_o officer_n of_o the_o excise_n shall_v appoint_v and_o on_o default_n thereof_o all_o such_o liquor_n as_o shall_v be_v find_v in_o any_o retailers_n house_n or_o warehouse_n cellar_n or_o other_o place_n belong_v unto_o he_o within_o this_o province_n or_o dependency_n and_o have_v not_o be_v due_o enter_v and_o pay_v the_o duty_n and_o excise_n as_o aforesaid_a then_o and_o in_o such_o case_n upon_o the_o testimony_n of_o two_o evidence_n before_o any_o justice_n of_o the_o peace_n within_o this_o province_n and_o dependency_n the_o say_a retailer_n or_o retailer_n so_o offend_v in_o the_o premise_n shall_v forfeit_v all_o such_o liquor_n and_o three_o time_n the_o value_n thereof_o one_o three_o to_o their_o majesty_n one_o three_o to_o the_o governor_n and_o one_o three_o to_o the_o informer_n who_o shall_v prosecute_v the_o same_o before_o any_o justice_n of_o the_o peace_n throughout_o this_o province_n and_o dependency_n who_o be_v hereby_o authorize_v and_o impower_v to_o hear_v and_o determine_v the_o same_o and_o if_o need_v be_v to_o issue_v out_o their_o warrant_n for_o the_o seize_v and_o condemn_v of_o all_o such_o liquor_n forfeit_v as_o aforesaid_a and_o for_o commit_v to_o goal_n all_o such_o retailer_n of_o liquor_n who_o have_v not_o enter_v and_o pay_v the_o duty_n of_o excise_n in_o manner_n aforesaid_a there_o to_o remain_v without_o bail_n or_o mainprize_n until_o they_o shall_v satisfy_v and_o make_v payment_n of_o three_o time_n the_o value_n of_o such_o liquor_n seize_v and_o forfeit_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n within_o this_o province_n and_o dependency_n not_o be_v due_o lisence_v shall_v at_o any_o time_n hereafter_o presume_v to_o sell_v by_o retail_n any_o the_o liquor_n aforesaid_a that_o be_v to_o say_v a_o less_o quantity_n at_o one_o time_n than_o five_o gallon_n the_o person_n so_o offend_v shall_v forfeit_v and_o pay_v the_o sum_n of_o five_o pound_n currant_n money_n aforesaid_a for_o every_o such_o offence_n be_v thereof_o convict_v by_o the_o oath_n of_o two_o or_o more_o evidence_n to_o be_v sue_v as_o aforesaid_a before_o any_o justice_n of_o the_o peace_n throughout_o the_o province_n and_o to_o be_v employ_v in_o such_o manner_n and_o proportion_n as_o aforesaid_a always_o provide_v and_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o no_o retailer_n of_o liquor_n under_o five_o gallon_n or_o any_o other_o that_o sell_v any_o liquor_n or_o strong_a liquor_n shall_v take_v any_o such_o liquor_n into_o their_o house_n cellar_n or_o warehouse_n or_o into_o any_o other_o place_n belong_v unto_o they_o in_o new-york_n and_o albany_n but_o by_o the_o hand_n of_o the_o swear_a porter_n under_o the_o penalty_n aforesaid_a to_o be_v sue_v and_o recover_v for_o the_o use_v aforesaid_a in_o manner_n and_o form_n as_o aforesaid_a always_o provide_v and_o it_o be_v hereby_o understand_v that_o there_o shall_v no_o duty_n be_v pay_v nor_o forfeiture_n upon_o any_o good_n or_o merchandise_n that_o be_v not_o land_v within_o this_o province_n and_o dependency_n always_o provide_v that_o all_o merchant_n qualify_v to_o trade_n by_o the_o act_n of_o navigation_n and_o regulate_v the_o plantation_n trade_n come_v into_o this_o province_n or_o any_o part_n thereof_o be_v well_o and_o honest_o treat_v and_o demean_v for_o such_o thing_n as_o by_o this_o act_n be_v grant_v without_o oppression_n to_o be_v do_v to_o they_o pay_v the_o duty_n aforesaid_a a_o act_n for_o the_o establish_n court_n of_o judicature_n for_o the_o ease_n and_o benefit_n of_o each_o respective_a city_n town_n and_o county_n within_o this_o province_n whereas_o the_o act_n for_o settle_v court_n of_o judicature_n within_o this_o province_n do_v expire_v by_o its_o own_o limitation_n in_o april_n next_o and_o whereas_o the_o orderly_a regulation_n and_o the_o establishment_n of_o court_n of_o justice_n throughout_o this_o province_n as_o well_o in_o respect_n of_o time_n as_o place_n do_v tend_v very_o much_o to_o the_o honour_n and_o dignity_n of_o the_o crown_n as_o well_o as_o to_o the_o ease_n and_o benefit_n of_o the_o subject_a be_v it_o therefore_o enact_v by_o the_o governor_n and_o council_n and_o representative_n convene_v in_o general_a assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o every_o justice_n of_o the_o peace_n that_o reside_v within_o any_o town_n or_o county_n within_o this_o province_n be_v hereby_o full_o impower_v and_o authorize_v to_o have_v cognizance_n of_o all_o cause_n case_n of_o debt_n and_o trespass_n to_o the_o value_n of_o forty_o shilling_n or_o under_o which_o causos_n and_o case_n shall_v be_v hear_v try_v and_o final_o determine_v without_o a_o jury_n by_o every_o justice_n of_o the_o peace_n that_o reside_v within_o any_o town_n or_o county_n within_o this_o province_n etc._n etc._n he_o take_v unto_o his_o assistance_n at_o the_o time_n of_o his_o hear_n and_o determine_v such_o cause_n or_o case_n of_o debt_n and_o trespass_n to_o the_o value_n of_o forty_o shilling_n or_o under_o one_o of_o the_o
