repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n 10._o provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v then_o be_v resident_n shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy_n lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v 11._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n headborough_z tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n headborough_z tything-man_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o aid_n of_o the_o constable_n headborough_z or_o tything-man_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o be_v levy_v upon_o his_o good_n and_o chattel_n and_o dispose_v in_o manner_n aforesaid_a 2._o and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o one_o
hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v lie_v 12._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n 2._o and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o full_a treble_n cost_v 13._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o this_o act_n and_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o 2._o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n 3._o and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_n to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o 4._o which_o say_v justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o full_o as_o the_o say_v other_o justice_n of_o peace_n may_v have_v do_v in_o case_n he_o or_o they_o have_v be_v inhabitant_n in_o the_o place_n where_o the_o offence_n be_v commit_v 14._o provide_v also_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v 2._o and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o 15._o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberty_n thereof_o for_o the_o examine_v convict_v and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberty_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n 16._o provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o person_n offend_a and_o convict_a as_o aforesaid_a be_v a_o feme-covert_n cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o aforesaid_a incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o the_o husband_n of_o each_o feme-covert_n 17._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o virtue_n or_o force_n of_o this_o act_n any_o thing_n matter_n or_o clause_n therein_o to_o the_o contrary_a notwithstanding_o 18._o provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o invalidate_v or_o avoid_v his_o majesty_n supremacy_n in_o ecclesiastical_a affair_n 2._o but_o that_o his_o majesty_n and_o his_o heir_n and_o successor_n from_o time_n to_o time_n and_o at_o all_o time_n hereafter_o exercise_n and_o enjoy_v all_o power_n and_o authority_n in_o ecclesiastical_a affair_n as_o full_o and_o as_o ample_o as_o himself_o or_o any_o of_o his_o predecessor_n have_v or_o may_v have_v do_v the_o same_o any_o thing_n in_o this_o act_n notwithstanding_o note_n upon_o the_o forego_n act._n 1._o by_o the_o title_n preamble_n and_o scope_n of_o the_o act_n it_o appear_v that_o the_o same_o be_v intend_v for_o suppress_v seditious_a conventicle_n under_o pretence_n of_o religious_a worship_n that_o be_v where_o the_o conventicler_n meet_v together_o under_o a_o pretence_n of_o worship_n not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o indeed_o to_o carry_v on_o ill_a design_n against_o the_o state_n 2._o if_o any_o such_o conventicle_n be_v the_o justices_z know_v it_o by_o the_o oath_n of_o two_o witness_n may_v make_v a_o record_n thereof_o and_o then_o the_o person_n so_o offend_v shall_v forfeit_v so_o as_o in_o the_o act_n you_o have_v hear_v 3._o it_o must_v appear_v upon_o oath_n before_o the_o justice_n or_o confession_n of_o the_o party_n 1._o that_o it_o be_v a_o seditious_a conventicle_n meet_v together_o to_o disturb_v the_o peace_n under_o pretence_n of_o religion_n 2._o that_o the_o worship_n there_o practise_v be_v not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n so_o that_o the_o informer_n must_v be_v present_a the_o whole_a time_n of_o the_o meeting_n for_o if_o they_o only_o hear_v a_o man_n pray_v or_o preach_v that_o be_v not_o contrary_a to_o the_o practice_n of_o the_o church_n of_o england_n and_o how_o do_v it_o appear_v that_o they_o do_v not_o read_v the_o liturgy_n 3._o it_o must_v be_v prove_v that_o there_o be_v assemble_v five_o person_n or_o more_o beside_o the_o inhabitant_n in_o the_o house_n 4._o if_o a_o party_n be_v fine_v above_o ten_o shilling_n if_o he_o pay_v down_o the_o money_n or_o it_o be_v levy_v within_o one_o week_n after_o such_o payment_n or_o levy_n he_o may_v appeal_v from_o the_o justice_n convict_v to_o the_o next_o quarter-session_n where_o he_o shall_v have_v a_o trial_n by_o jury_n thereupon_o and_o undoubted_o if_o it_o do_v not_o appear_v to_o the_o say_a jury_n that_o it_o be_v a_o seditious_a meeting_n they_o ought_v to_o find_v for_o the_o appealer_n 5._o a_o general_n warrant_v from_o any_o justice_n or_o justice_n to_o constable_n to_o inquire_v after_o seize_v etc._n etc._n all_o conventicle_n in_o their_o precinct_n be_v not_o good_a it_o ought_v to_o particularize_v the_o house_n and_o place_n house_n and_o place_n where_o the_o conventicle_n be_v or_o conventicle_n be_v hold_v and_o then_o the_o constable_n ought_v forthwith_o to_o go_v and_o if_o he_o find_v it_o so_o to_o suppress_v it_o but_o otherwise_o the_o constable_n may_v be_v put_v to_o endless_a vexation_n in_o hunt_v after_o meeting_n to_o no_o purpose_n whereas_o the_o act_n enjoin_v he_o no_o such_o trouble_n and_o if_o you_o go_v once_o and_o find_v no_o conventicle_n you_o be_v not_o oblige_v to_o go_v a_o second_o time_n on_o the_o same_o warrant_n but_o aught_o to_o have_v a_o new_a one_o nor_o be_v the_o constable_n oblige_v to_o turn_v informer_n 6._o as_o to_o break_v open_a door_n you_o see_v the_o act_n direct_v that_o it_o may_v be_v do_v first_o only_a in_o a_o house_n where_o it_o be_v inform_v there_o be_v actual_o a_o conventicle_n as_o aforesaid_a that_o be_v upon_o the_o oath_n of_o two_o person_n 2._o the_o constable_n &c._n &c._n can_v do_v this_o without_o first_o there_o be_v a_o demand_n and_o denial_n to_o enter_v 3._o nor_o then_o neither_o without_o a_o warrant_n from_o the_o justice_n to_o that_o purpose_n if_o a_o constable_n upon_o a_o light_n vain_a tale_n without_o two_o person_n swear_v it_o that_o there_o be_v at_o such_o a_o house_n a_o meeting_n and_o without_o warrant_n shall_v venture_v to_o break_v open_a the_o door_n and_o there_o be_v find_v no_o conventicle_n he_o make_v himself_o liable_a to_o
and_o order_n as_o be_v agreeable_a to_o martial_a law_n and_o as_o be_v use_v in_o army_n in_o time_n of_o war_n to_o proceed_v to_o the_o trial_n and_o condemnation_n of_o such_o offeuder_n and_o they_o to_o cause_n to_o be_v execute_v and_o put_v to_o death_n according_a to_o the_o law_n martial_n 8._o by_o pretext_n whereof_o some_o of_o your_o majesty_n subject_n have_v be_v by_o some_o of_o the_o say_a commissioner_n put_v to_o death_n when_o and_o where_o if_o by_o the_o law_n and_o statute_n of_o the_o land_n they_o have_v deserve_v death_n by_o the_o same_o law_n and_o statute_n also_o they_o may_v and_o by_o no_o other_o ought_v to_o have_v be_v judge_v and_o execute_v 9_o and_o also_o sundry_a grievous_a offender_n by_o colour_n thereof_o claim_v a_o exemption_n have_v escape_v the_o punishment_n due_a to_o they_o by_o the_o law_n and_o statute_n of_o this_o your_o realm_n by_o reason_n that_o divers_a of_o your_o officer_n and_o minister_n of_o justice_n have_v unjust_o refuse_v or_o forbear_v to_o proceed_v against_o such_o offender_n according_a to_o the_o same_o law_n and_o statute_n upon_o pretence_n that_o the_o say_v offender_n be_v punishable_a only_o please_v you_o and_o then_o cause_v the_o petition_n to_o be_v read_v distinct_o by_o the_o clerk_n of_o the_o crown_n the_o clerk_n of_o the_o parliament_n read_v the_o king_n answer_v thereto_o in_o these_o word_n soit_fw-fr droit_n fait_z come_z est_z desire_n which_o be_v let_v right_o be_v do_v as_o be_v desire_v this_o answer_n and_o the_o manner_n of_o confirm_v this_o law_n i_o have_v the_o rather_o recite_v because_o the_o king_n answer_n and_o circumstance_n relate_v thereunto_o be_v whole_o leave_v out_o in_o our_o last_o print_a book_n of_o statute_n the_o petition_n itself_o be_v so_o plain_a that_o there_o need_v no_o comment_n thereon_o only_o the_o reader_n may_v observe_v that_o the_o thing_n therein_o mention_v be_v the_o ancient_a right_n of_o the_o people_n and_o therefore_o they_o express_o demand_v they_o of_o the_o king_n as_o their_o right_n and_o liberties_n in_o the_o next_o place_n we_o shall_v add_v the_o late_a excellent_a habeas_fw-la corpus_fw-la act_n because_o relate_v to_o the_o same_o subject_a viz._n the_o free_n of_o the_o subject_a from_o causeless_a tedious_a and_o arbitrary_a imprisonment_n anno_fw-la tricesimo_fw-la primo_fw-la caroli_n secundi_fw-la regis_fw-la chap._n ii_o a_o act_n for_o the_o better_a secure_v the_o liberty_n of_o the_o subject_a and_o for_o prevention_n of_o imprisonment_n beyond_o sea_n common_o call_v the_o habeas_fw-la corpus_fw-la act._n i._o whereas_o great_a delay_n have_v be_v use_v by_o sheriff_n gaoler_n and_o other_o officer_n to_o who_o custody_n any_o of_o the_o king_n subject_n have_v be_v commit_v for_o criminal_a or_o suppose_a criminal_a matter_n in_o make_v return_v of_o writ_n of_o habeas_fw-la corpus_fw-la to_o they_o direct_v by_o stand_v out_o a_o alias_o and_o plury_n habeas_fw-la corpus_fw-la and_o sometime_o more_o and_o by_o other_o shift_n to_o avoid_v their_o yield_a obedience_n to_o such_o writ_n contrary_a to_o their_o duty_n and_o the_o know_a law_n of_o the_o land_n whereby_o many_o of_o the_o king_n subject_n have_v be_v and_o hereafter_o may_v be_v long_o detain_v in_o prison_n in_o such_o case_n where_o by_o law_n they_o be_v bailable_a to_o their_o great_a charge_n and_o vexation_n ii_o for_o the_o prevention_n whereof_o and_o the_o more_o speedy_a relief_n of_o all_o person_n imprison_v for_o any_o such_o criminal_a or_o suppose_a criminal_a matter_n 2_o be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n thereof_o that_o whensoever_o any_o person_n or_o person_n shall_v bring_v any_o habeas_fw-la corpus_fw-la direct_v unto_o any_o sheriff_n or_o sheriff_n goaler_n minister_n or_o other_o person_n whatsoever_o for_o any_o person_n in_o he_o or_o their_o custody_n and_o the_o say_a writ_n shall_v be_v serve_v upon_o the_o say_a officer_n or_o leave_v at_o the_o goal_n or_o prison_n with_o any_o of_o the_o under_o officer_n under_o keeper_n or_o deputy_n of_o the_o say_a officer_n or_o keeper_n that_o the_o say_a officer_n or_o officer_n his_o or_o their_z under_z officer_n or_o keeper_n or_o deputy_n shall_v within_o three_o day_n after_o the_o service_n thereof_o as_o aforesaid_a unless_o the_o commitment_n aforesaid_a be_v for_o treason_n or_o felony_n plain_o and_o special_o express_v in_o the_o warrant_n of_o commitment_n upon_o payment_n or_o tender_a of_o the_o charge_n of_o bring_v the_o say_a prisoner_n to_o be_v ascertain_v be_v the_o judge_n or_o court_n that_o award_v the_o same_o and_o endorsed_n upon_o the_o say_v write_v not_o exceed_v twelve_o penny_n per_fw-la mile_n and_o upon_o many_o great_a crime_n and_o offence_n appertain_v mere_o to_o the_o jurisdiction_n and_o determination_n of_o the_o ecclesiastical_a court_n and_o judge_n of_o this_o realm_n be_v many_o time_n unpunished_a for_o lack_v and_o want_v of_o the_o good_a and_o due_a execution_n of_o the_o writ_n de_fw-fr excommunicato_fw-la capiendo_fw-la direct_v to_o the_o sheriff_n of_o any_o county_n for_o the_o take_n and_o apprehend_v of_o any_o such_o offender_n 2._o the_o great_a abuse_n whereof_o as_o it_o shall_v seem_v have_v grow_v for_o that_o the_o say_v write_v be_v not_o returnable_a in_o any_o court_n that_o may_v have_v the_o judgement_n of_o the_o well_o execute_v and_o serve_v of_o the_o say_v write_v according_a to_o the_o content_n thereof_o 3_o but_o hitherto_o have_v be_v leave_v only_o to_o the_o discretion_n of_o the_o sheriff_n and_o their_o deputy_n by_o who_o negligence_n and_o default_n for_o the_o most_o part_n the_o say_a writ_n be_v not_o execute_v upon_o displeasure_n of_o almighty_n god_n and_o to_o the_o great_a contempt_n of_o the_o ecclesiastical_a law_n of_o this_o realm_n 2._o wherefore_o for_o the_o redress_n thereof_o be_v it_o enact_v by_o the_o queen_n most_o excellent_a majesty_n with_o the_o assent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o from_o and_o after_o the_o first_o day_n of_o may_n next_o come_v every_o writ_n of_o excommunicato_fw-la capiendo_fw-la that_o shall_v be_v grant_v and_o award_v out_o of_o the_o high_a court_n of_o chancery_n against_o any_o person_n or_o person_n within_o the_o realm_n of_o england_n shall_v be_v make_v in_o the_o time_n of_o the_o term_n 2._o and_o returnable_a before_o the_o queen_n highness_n her_o heir_n and_o successor_n in_o the_o court_n common_o call_v the_o king_n bench_n in_o the_o term_n next_o after_o the_o testae_fw-la of_o the_o same_o writ_n 3_o and_o the_o same_o writ_n shall_v be_v make_v to_o contain_v at_o the_o least_o twenty_o day_n between_o the_o testae_fw-la and_o the_o return_v thereof_o 4._o and_o after_o the_o same_o writ_n shall_v be_v so_o make_v and_o seal_v that_o then_o the_o say_a writ_n shall_v be_v forthwith_o bring_v into_o the_o say_a court_n of_o king_n bench_n and_o there_o in_o the_o presence_n this_o act_n shall_v be_v direct_v shall_v not_o in_o any_o wise_a be_v compel_v to_o bring_v the_o
body_n of_o such_o person_n or_o person_n as_o shall_v be_v name_v in_o the_o say_v write_v or_o process_n into_o the_o say_a court_n of_o the_o king_n be_v beneh_n at_o the_o day_n of_o the_o return_v thereof_o 2._o but_o shall_v only_o return_v the_o same_o writ_n and_o process_n thither_o with_o declaration_n brief_o how_o and_o in_o what_o manner_n he_o have_v serve_v and_o execute_v
