may_v lawful_o have_v go_v out_o of_o the_o compass_n of_o five_o mile_n the_o like_a he_o may_v do_v at_o this_o day_n upon_o any_o other_o proclamation_n command_v he_o to_o render_v his_o body_n to_o the_o sheriff_n vide_fw-la stat._n 3_o jac._n cap._n 5._o sect._n 7._o and_o furthermore_o be_v it_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n discharge_v stat._n sect_n 12._o a_o offender_n upon_o open_a submission_n shall_v be_v discharge_v that_o if_o any_o person_n or_o person_n that_o shall_v at_o any_o time_n hereafter_o offend_v against_o this_o act_n shall_v common_a plea_n or_o exchequer_n and_o so_o be_v it_o resolve_v in_o point_n in_o that_o case_n of_o pie_n and_o lovel_n hobart_n 204_o 205._o where_o the_o opinion_n of_o sir_n edward_n coke_n report_v by_o roll_n touch_v what_o sort_n of_o conviction_n be_v mean_v here_o be_v confirm_v and_o allow_v for_o law_n this_o statute_n be_v make_v only_o for_o the_o benefit_n of_o the_o queen_n those_o negative_a word_n in_o this_o act_n and_o the_o hear_n and_o determine_v of_o those_o offence_n commit_v only_o to_o the_o justice_n of_o the_o king_n bench_n assizes_n and_o general_a goal_n delivery_n but_o for_o information_n by_o a_o common_a informer_n they_o be_v never_o intend_v here_o and_o the_o justice_n of_o assize_n and_o goal_n delivery_n can_v hold_v plea_n of_o such_o information_n as_o be_v resolve_v by_o the_o judge_n mich._n 4_o car._n 1._o jones_n 193._o and_o yet_o this_o statute_n do_v not_o whole_o abrogate_v the_o power_n of_o the_o justice_n of_o peace_n 1_o justice_n of_o p._n may_v take_v indictment_n for_o some_o offence_n against_o 23_o el._n 1_o or_o of_o any_o other_o justice_n to_o who_o authority_n be_v give_v by_o the_o statute_n of_o 23_o case_n cite_v in_o dr._n foster_n case_n co._n 11._o 63._o and_o now_o by_o the_o statute_n of_o 3_o jac._n cap._n 4._o 4._o and_o hear_v and_o determine_v the_o offence_n of_o not_o come_v to_o church_n stat._n 3_o jac._n 4._o the_o power_n of_o justice_n of_o peace_n to_o hear_v and_o determine_v the_o offence_n of_o not_o come_v to_o church_n be_v again_o restore_v to_o they_o vide_fw-la that_o statute_n sect._n 5._o and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a pay_v stat._n sect._n 3_o at_o what_o time_n the_o money_n forfeit_v for_o not_o go_v to_o the_o church_n shall_v be_v pay_v that_o every_o such_o offender_n in_o not_o repair_v to_o divine_a service_n but_o forbear_v the_o same_o contrary_n to_o the_o say_a estatute_n as_o have_v be_v heretofore_o convict_v for_o such_o offence_n and_o have_v not_o make_v submission_n and_o be_v conformable_a according_a to_o the_o true_a meaning_n of_o the_o say_a statute_n shall_v without_o any_o with_o no_o other_o so_o that_o if_o the_o twenty_o pound_n per_fw-la month_n be_v recover_v in_o a_o popular_a suit_n by_o the_o informer_n qui_fw-fr tam_fw-la etc._n etc._n one_o three_o part_n allurement_n of_o any_o other_o willing_o join_v in_o or_o be_v present_a at_o any_o such_o assembly_n conventicle_n or_o meeting_n under_o colour_n or_o pretence_n of_o any_o such_o exercise_n of_o etc._n by_o print_v etc._n etc._n wingate_n in_o abridge_n of_o this_o statute_n tit_n crown_n numb_a 70._o say_v that_o if_o any_o person_n above_o sixteen_o year_n of_o age_n obstinate_o refuse_v to_o come_v to_o church_n for_o a_o month_n or_o impugn_v the_o queen_n authority_n in_o cause_n ecclesiastical_a he_o shall_v be_v commit_v to_o prison_n which_o be_v a_o great_a mistake_n for_o no_o man_n shall_v be_v punish_v by_o this_o act_n for_o either_o of_o those_o cause_n only_o the_o not_o come_v to_o church_n be_v only_o a_o precedent_a qualification_n require_v in_o the_o person_n who_o the_o act_n make_v liable_a to_o the_o penalty_n thereof_o for_o the_o other_o offence_n therein_o mention_v not_o who_o may_v be_v a_o offender_n within_o this_o act_n and_o who_o not_o and_o therefore_o if_o a_o man_n never_o come_v to_o church_n yet_o he_o be_v no_o offender_n within_o this_o act_n unless_o he_o advise_o or_o purposely_o move_v or_o persuade_v another_o to_o deny_v or_o case_n than_o the_o queen_n for_o he_o may_v charge_v the_o husband_n and_o wife_n both_o for_o the_o recusancy_n of_o the_o wife_n and_o shall_v recover_v the_o forfeiture_n of_o he_o by_o force_n town_n parish_n or_o chappel_n be_v or_o shall_v be_v or_o one_o of_o they_o as_o well_o in_o place_n exempt_a as_o not_o exempt_a shall_v once_o in_o every_o year_n present_v the_o monthly_a absence_n from_o church_n of_o all_o and_o all_o manner_n of_o popish_a recusant_n within_o such_o town_n and_o parish_n and_o shall_v present_v the_o name_n of_o every_o of_o the_o child_n of_o the_o say_a recusant_n be_v of_o the_o age_n of_o nine_o year_n and_o upward_o abide_v with_o their_o say_a parent_n and_o as_o near_o as_o they_o can_v the_o age_n of_o every_o of_o the_o say_a child_n servant_n a_o recusants_n child_n and_o servant_n as_o also_o the_o name_n of_o the_o servant_n of_o such_o recusant_n at_o the_o general_a or_o quarter_n session_n of_o that_o shire_n limit_n division_n or_o liberty_n of_o all_o and_o all_o manner_n of_o popish_a recusant_n not_o who_o monthly_a absence_n from_o church_n must_v be_v present_v and_o who_o not_o as_o this_o act_n be_v pen_v it_o seem_v that_o the_o churchwarden_n and_o constable_n be_v not_o bind_v thereby_o to_o present_v the_o monthly_a absence_n from_o church_n of_o any_o of_o the_o child_n or_o servant_n of_o a_o popish_a recusant_n although_o such_o child_n or_o servant_n be_v recusant_n unless_o they_o be_v popish_a recusant_n and_o that_o it_o be_v sufficient_a to_o satisfy_v the_o statute_n to_o present_v their_o name_n without_o take_v any_o notice_n of_o their_o absence_n from_o church_n but_o if_o they_o be_v popish_a recusant_n they_o fall_v within_o the_o general_a word_n of_o the_o act_n and_o their_o monthly_a absence_n ought_v to_o be_v present_v as_o well_o as_o that_o of_o their_o parent_n or_o master_n wingate_n in_o his_o abridgement_n of_o this_o statute_n tit_n crown_n numb_a 100_o have_v clear_o mistake_v the_o meaning_n thereof_o in_o this_o particular_a for_o he_o tell_v we_o that_o the_o monthly_a absence_n of_o all_o the_o child_n and_o servant_n of_o a_o popish_a recusant_n ought_v to_o be_v present_v at_o the_o general_a or_o quarter_n session_n 1_o general_n or_o quarter_n session_n stat._n 23_o eliz._n 1_o what_o be_v mean_v by_o those_o word_n vide_fw-la stat._n 23_o eliz._n cap._n 1._o sect._n 7._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a record_v stat._n sect._n 4._o the_o presentment_n record_v that_o all_o such_o and_o form_n as_o the_o say_a justice_n of_o assize_n and_o goal_n delivery_n do_v or_o may_v now_o do_v by_o former_a law_n in_o the_o case_n of_o recusancy_n for_o not_o repair_v to_o church_n and_o also_o shall_v have_v power_n at_o their_o assize_n and_o goal_n delivery_n and_o at_o the_o session_n in_o which_o any_o indictment_n against_o any_o person_n either_o for_o not_o repair_v to_o church_n according_a to_o former_a law_n or_o not_o receive_v the_o say_a sacrament_n according_a to_o this_o law_n proclamation_n the_o effect_n of_o the_o proclamation_n shall_v be_v take_v to_o make_v proclamation_n by_o
one_o as_o conceal_v his_o true_a name_n or_o quality_n or_o can_v give_v a_o good_a account_n what_o he_o be_v for_o so_o it_o must_v be_v reasonable_o intend_v and_o not_o of_o all_o traveller_n through_o the_o country_n as_o wingate_n tit_n crown_n numb_a 106._o mistake_n for_o it_o appear_v by_o the_o other_o qualification_n here_o enumerate_v that_o the_o intent_n of_o the_o act_n be_v that_o it_o shall_v be_v offer_v by_o the_o bishop_n or_o two_o justice_n to_o such_o only_a of_o who_o there_o be_v any_o just_a cause_n of_o suspicion_n oath_n stat._n sect._n 11._o refusal_n of_o any_o other_o person_n whatsoever_o &c_n &c_n shall_v refuse_v these_o word_n any_o other_o person_n whatsoever_o be_v exclusive_a of_o the_o say_a person_n or_o person_n who_o be_v commit_v for_o refusal_n for_o it_o be_v here_o in_o the_o disjunctive_a tender_v to_o who_o the_o oath_n may_v be_v tender_v so_o that_o it_o seem_v that_o if_o any_o person_n whatsoever_o of_o the_o age_n of_o eighteen_o year_n or_o above_o and_o under_o the_o degree_n of_o a_o nobleman_n or_o noblewoman_n be_v at_o the_o assize_n or_o general_a quarter_n session_n of_o the_o peace_n whether_o voluntary_o if_o he_o want_v sufficient_a maintenance_n to_o keep_v he_o in_o that_o habitation_n although_o he_o refuse_v to_o come_v to_o church_n the_o child_n shall_v forfeit_v nothing_o for_o receive_v he_o into_o his_o house_n for_o the_o word_n here_o be_v in_o the_o disjunctive_a and_o if_o the_o parent_n want_v either_o other_o habitation_n in_o the_o sense_n of_o the_o act_n or_o sufficient_a maintenance_n the_o child_n may_v receive_v he_o that_o shall_v be_v commit_v by_o authority_n to_o the_o custody_n etc._n etc._n punishable_a master_n where_o not_o punishable_a the_o former_a case_n prisoner_n in_o his_o house_n or_o a_o gaoler_n if_o he_o keep_v his_o prisoner_n in_o his_o own_o house_n which_o be_v no_o part_n of_o the_o prison_n shall_v not_o forfeit_v any_o thing_n by_o force_n of_o this_o act_n although_o he_o suffer_v he_o to_o go_v abroad_o in_o the_o day_n time_n at_o his_o pleasure_n and_o he_o forbear_v to_o come_v to_o church_n for_o that_o such_o prisoner_n the_o offence_n shall_v be_v hear_v and_o determine_v hear_v and_o determine_v before_o the_o justice_n of_o the_o king_n bench_n justice_n of_o assize_n and_o gaol_n delivery_n in_o their_o several_a assize_n and_o gaol_n delivery_n and_o all_o offence_n other_o than_o treason_n shall_v be_v inquire_v hear_v and_o determine_v before_o the_o justice_n of_o peace_n in_o their_o general_n or_o quarter_n session_n to_o be_v hold_v within_o the_o shire_n division_n limit_v or_o liberty_n wherein_o such_o offence_n shall_v happen_v happen_v general_n or_o quarter_n session_n stat._n 23_o parliament_n woman_n stat._n sect._n 31._o who_o may_v take_v the_o oath_n of_o a_o nobleman_n or_o woman_n that_o in_o

or_o reside_v when_o he_o or_o they_o be_v or_o be_v so_o admit_v or_o place_v within_o the_o city_n of_o london_n or_o westminster_n or_o within_o thirty_o mile_n of_o the_o same_o shall_v take_v the_o say_a oath_n aforesaid_a in_o the_o say_v respective_a court_n or_o court_n aforesaid_a in_o the_o next_o term_n after_o such_o he_o or_o their_o admittance_n or_o admittance_n into_o the_o
