the_o church_n have_v any_o spark_n of_o it_o but_o from_o he_o it_o be_v there_o say_v how_o the_o legate_n be_v of_o opinion_n that_o the_o question_n of_o the_o divine_a right_n of_o bishop_n be_v set_v on_o foot_n to_o gratify_v the_o authority_n of_o bishop_n and_o that_o the_o importance_n of_o that_o may_v be_v to_o infer_v that_o the_o key_n be_v not_o give_v to_o peter_n only_o that_o the_o council_n be_v above_o the_o pope_n and_o the_o bishop_n equal_a to_o he_o they_o see_v that_o the_o dignity_n of_o cardinal_n superior_a to_o bishop_n be_v quite_o take_v away_o and_o the_o court_n bring_v to_o nothing_o that_o the_o prevention_n and_o reservation_n be_v remove_v and_o the_o collation_n of_o benefice_n draw_v to_o the_o bishop_n thus_o we_o see_v how_o apt_a man_n be_v to_o make_v use_n of_o divine_a right_n as_o fire_n and_o to_o count_v it_o a_o good_a servant_n but_o a_o bad_a master_n nor_o be_v some_o without_o their_o fear_n that_o if_o bishop_n be_v here_o public_o own_a as_o by_o divine_a right_n that_o the_o king_n will_v quick_o lose_v his_o power_n of_o nominate_v they_o and_o subject_n the_o benefit_n of_o appeal_n from_o their_o court_n to_o the_o king_n in_o chancery_n i_o acknowledge_v that_o a_o moderate_a episcopacy_n be_v general_o repute_v of_o church-government_n the_o best_a but_o the_o believer_n of_o the_o divine_a right_n of_o it_o be_v of_o late_a year_n grow_v very_o few_o for_o the_o skirmish_n in_o the_o press_n and_o pulpit_n concern_v it_o between_o the_o divine_n of_o several_a party_n have_v occasion_v two_o popular_a reason_n to_o be_v bring_v against_o it_o which_o how_o valid_a they_o be_v be_v not_o my_o task_n to_o determine_v the_o first_o be_v this_o that_o be_v not_o likely_a to_o be_v of_o divine_a positive_a right_n which_o be_v the_o right_n here_o mean_v about_o which_o christian_n equal_o considerable_a for_o strength_n of_o part_n both_o natural_a and_o acquire_v and_o for_o time_n spend_v in_o that_o part_n of_o controversiall_a divinity_n that_o concern_v church-discipline_n and_o withal_o for_o holiness_n in_o their_o life_n do_v at_o last_o disagree_v the_o second_o reason_n draw_v from_o the_o eager_a dispute_n of_o churchman_n about_o their_o several_a divine_a right_n be_v this_o nothing_o real_o oppressive_a of_o civil_a society_n or_o destructive_a of_o their_o welfare_n be_v of_o divine_a right_n but_o so_o these_o form_n of_o church-government_n have_v be_v by_o the_o opposite_a divine_n of_o each_o persuasion_n accuse_v to_o be_v and_o likewise_o by_o other_o person_n it_o have_v be_v further_o observe_v by_o many_o that_o though_o several_a thing_n be_v once_o confirm_v in_o the_o church_n by_o a_o apostolical_a precept_n or_o practice_n they_o be_v like_o law_n abolish_v by_o desuetude_n and_o do_v not_o now_o oblige_v the_o christian_a world_n according_a to_o the_o vogue_n of_o all_o our_o churchman_n as_o namely_o the_o diaconissae_n the_o anoint_v the_o sick_a with_o oil_n the_o people_n saying_n amen_o after_o the_o minister_n prayer_n and_o preach_v with_o the_o head_n uncover_v etc._n etc._n to_o conclude_v the_o examination_n then_o of_o this_o particular_a a_o considerable_a number_n of_o the_o laity_n who_o fortune_n and_o part_n do_v keep_v they_o from_o stand_v up_o and_o draw_v their_o sword_n to_o maintain_v other_o man_n creed_n in_o every_o circumstance_n of_o they_o have_v by_o the_o contest_v of_o the_o clergy_n find_v out_o as_o they_o think_v the_o vanity_n of_o all_o their_o pretending_n to_o divine_a right_n will_v not_o encourage_v immoderate_a and_o high_a behaviour_n in_o any_o one_o party_n of_o they_o but_o upon_o this_o their_o imagine_a detection_n adhere_v to_o that_o form_n of_o church-government_n that_o shall_v seem_v to_o they_o most_o consistent_a with_o the_o nation_n good_a just_a as_o the_o roman_a emperor_n be_v sometime_o choose_v in_o the_o camp_n euulgato_fw-la as_o tacitus_n say_v imperiarcano_fw-mi principem_fw-la alibi_fw-la quam_fw-la romae_fw-la fieri_fw-la posse_fw-la three_o it_o be_v natural_a to_o parliament_n to_o check_v any_o power_n that_o in_o the_o late_a assembly_n of_o divine_n that_o party_n which_o join_v against_o the_o independent_o do_v want_v liberty_n of_o conscience_n about_o no_o mean_a point_n in_o religion_n some_o of_o those_o presbyterian_a divine_n as_o they_o be_v call_v be_v of_o calvin_n and_o other_o of_o bishop_n davenant_n opinion_n concern_v election_n and_o reprobation_n and_o moreover_o the_o parliament_n that_o call_v that_o synod_n be_v in_o matter_n of_o religion_n much_o more_o divide_v but_o i_o shall_v choose_v to_o look_v further_o back_o on_o the_o nature_n of_o our_o parliament_n in_o reference_n to_o religion_n it_o can_v be_v expect_v that_o while_n popery_n be_v prevalent_a in_o england_n much_o liberty_n of_o conscience_n shall_v be_v grant_v the_o pope_n be_v then_o repute_v the_o vicar_n of_o christ_n in_o spiritual_a thing_n be_v necessary_o to_o be_v obey_v therein_o and_o yet_o notwithstanding_o the_o authority_n he_o have_v here_o no_o man_n suffer_v death_n for_o oppose_v his_o dictate_v in_o religion_n till_o the_o second_o of_o henry_n the_o four_o nor_o be_v there_o want_v lawyer_n and_o those_o both_o learned_a in_o their_o profession_n and_o in_o this_o case_n uninteress_v who_o deny_v that_o this_o statute_n be_v ever_o more_o than_o a_o pretend_a one_o and_o say_v that_o it_o be_v never_o assent_v to_o by_o the_o commons_o and_o that_o whereas_o but_o that_o de_fw-fr facto_fw-la this_o statute_n go_v currant_n for_o law_n the_o cruel_a effect_n of_o it_o do_v too_o clear_o show_v yet_o as_o high_a as_o the_o popish_a clergy_n than_o be_v with_o who_o that_o usurp_a king_n comply_v the_o commons_o petition_v the_o king_n to_o take_v away_o their_o temporal_a possession_n and_o that_o the_o statute_n make_v against_o lollard_n in_o the_o second_o year_n of_o the_o king_n may_v be_v repeal_v and_o by_o the_o complaint_n of_o the_o commons_o as_o appear_v by_o the_o statute_n of_o 25._o henry_n the_o viii_o it_o be_v then_o in_o part_n repeal_v afterwards_o in_o a_o parliament_n hold_v vicesimo_fw-la octavo_fw-la of_o the_o queen_n the_o commons_o quarrel_v with_o the_o excessive_a power_n of_o the_o clergy_n desire_v to_o be_v build_v upon_o the_o statute_n of_o the_o first_o of_o queen_n elizabeth_n but_o the_o design_n of_o that_o be_v chief_o to_o destroy_v the_o interest_n of_o the_o popish_a clergy_n than_o not_o exterminate_v in_o the_o reign_v of_o follow_a prince_n a_o party_n know_v by_o the_o name_n of_o puritan_n have_v obtain_v a_o large_a vogue_n in_o parliament_n insomuch_o that_o that_o party_n and_o another_o call_v the_o patriot_n a_o sort_n of_o man_n who_o be_v zealot_n for_o the_o welfare_n of_o the_o nation_n though_o not_o for_o any_o religion_n be_v frequent_o in_o conjunction_n be_v the_o overbalancing_a party_n in_o the_o house_n of_o commons_o and_o in_o the_o last_o parliament_n on_o the_o fifteen_o of_o december_n 1640._o it_o be_v resolve_v nemine_fw-la contradicen●e_fw-la that_o the_o clergy_n of_o england_n convent_v in_o any_o convocation_n or_o synod_n or_o otherwise_o have_v no_o power_n to_o make_v any_o constitution_n canon_n or_o act_n whatsoever_o in_o matter_n of_o ecclesiastical_a treat_v upon_o by_o the_o arch-bishop_n of_o canterbury_n and_o york_n and_o the_o rest_n of_o the_o bishop_n and_o clergy_n of_o those_o province_n and_o agree_v upon_o by_o the_o keep_v of_o court_n as_o they_o do_v be_v not_o according_a to_o law_n may_v be_v have_v from_o those_o word_n of_o the_o archbishop_n of_o canterbury_n in_o his_o epistle_n dedicatory_a to_o the_o king_n before_o his_o speech_n in_o the_o star-chamber_n i_o do_v humble_o in_o the_o church_n name_n desire_n of_o your_o majesty_n that_o it_o may_v be_v resolve_v by_o all_o the_o reverend_a judge_n of_o england_n and_o then_o publish_v d_o by_o your_o majesty_n that_o our_o keep_a court_n and_o issuing_n process_n in_o our_o own_o name_n and_o the_o like_a exception_n former_o take_v and_o now_o renew_v be_v not_o against_o the_o law_n of_o the_o realm_n etc._n etc._n and_o how_o ready_a the_o lawyer_n have_v be_v to_o check_v the_o severity_n of_o ecclesiastical_a court_n their_o innumerable_a prohibition_n show_v in_o the_o day_n of_o popery_n the_o prelate_n can_v awe_v the_o judge_n with_o excommunication_n for_o such_o crime_n as_o the_o church_n call_v so_o but_o how_o little_a of_o terror_n the_o application_n of_o that_o censure_n have_v have_v since_o appear_v from_o the_o frequent_a denounce_v of_o it_o against_o the_o same_o man_n and_o therefore_o that_o learned_a lawyer_n judge_n jenkins_n in_o the_o second_o part_n of_o his_o work_n say_v that_o for_o oppose_v the_o excess_n of_o one_o of_o the_o bishop_n he_o lay_v under_o three_o excommunication_n second_o the_o substantial_a body_n of_o the_o gentry_n heretofore_o be_v and_o be_v still_o likely_a to_o be_v for_o the_o moderate_v the_o exercise_n of_o episcopal_a power_n and_o for_o the_o oppose_a its_o extravagance_n the_o oath_n ex_fw-la officio_fw-la and_o commute_v for_o penance_n and_o other_o such_o kind_n of_o thing_n can_v but_o be_v think_v troublesome_a to_o they_o but_o that_o which_o i_o shall_v here_o chief_o take_v notice_n of_o be_v how_o a_o considerable_a part_n of_o the_o gentry_n of_o england_n be_v grow_v more_o inquisitive_a in_o matter_n of_o religion_n within_o these_o late_a year_n then_o former_o where_o this_o inquire_a temper_n be_v not_o no_o opinion_n so_o horrid_a but_o may_v be_v universal_o believe_v thus_o the_o turk_n may_v be_v induce_v to_o think_v that_o there_o be_v a_o devil_n in_o the_o juice_n of_o grape_n and_o the_o papist_n that_o there_o may_v be_v a_o god_n therein_o but_o when_o man_n be_v neither_o by_o religion_n or_o temper_n restrain_v from_o search_v into_o the_o cause_n of_o thing_n they_o will_v not_o in_o civility_n to_o other_o man_n understanding_n believe_v proposition_n to_o be_v true_a or_o false_a and_o that_o which_o make_v i_o beside_o my_o own_o observation_n to_o conclude_v that_o many_o of_o the_o gentry_n of_o late_o be_v grow_v more_o inquisitive_a in_o religious_a thing_n then_o former_o and_o be_v likely_a so_o to_o continue_v be_v because_o they_o be_v more_o than_o heretofore_o inquisitive_a in_o civil_a thing_n as_o when_o the_o polish_a knowledge_n of_o philologie_n have_v obtain_v a_o conquest_n over_o the_o insignificant_a learning_n of_o the_o schoolman_n no_o man_n be_v think_v worthy_a the_o name_n of_o a_o scholar_n but_o he_o who_o understand_v the_o greek_a tongue_n so_o since_o the_o late_a introduction_n of_o real_a learning_n into_o the_o world_n by_o galilaus_n tycho_n brahe_n my_o lord_n bacon_n gassendus_fw-la &_o des_n cartes_n neither_o the_o knowledge_n of_o elegant_a word_n or_o nice_a speculation_n will_v yield_v any_o man_n the_o reputation_n of_o be_v learned_a that_o be_v altogether_o rude_a in_o mathematics_n which_o as_o they_o be_v former_o count_v the_o black_a art_n and_o their_o professor_n such_o as_o roger_n bacon_n conjurer_n so_o may_v possible_o school-divinity_n and_o school-divines_a hereafter_o be_v have_v thus_o assert_v the_o present_a search_a disposition_n of_o a_o great_a part_n of_o our_o ingenious_a gentry_n it_o may_v well_o be_v hence_o infer_v that_o liberty_n of_o conscience_n may_v be_v of_o high_a use_n to_o they_o and_o that_o if_o any_o ecclesiastical_a person_n determine_v any_o thing_n contrary_a to_o their_o reason_n they_o will_v not_o believe_v they_o or_o if_o against_o their_o safety_n not_o obey_v they_o i_o think_v therefore_o by_o the_o way_n it_o be_v very_o politic_o do_v of_o the_o consistory_n of_o cardinal_n to_o imprison_v galilaeus_fw-la for_o affirm_v the_o motion_n of_o the_o earth_n since_o that_o notion_n of_o he_o may_v fill_v the_o world_n with_o several_a new_a debate_n and_o inquiry_n and_o so_o ignorance_n the_o mother_n of_o devotion_n be_v destroy_v to_o prevent_v which_o effectual_a care_n be_v take_v by_o the_o jesuit_n as_o appear_v by_o the_o instruction_n give_v they_o in_o the_o directory_n of_o their_o order_n call_v directorium_fw-la administer_a thing_n in_o the_o church_n to_o be_v as_o much_o in_o the_o affection_n of_o the_o people_n here_o or_o above_o danger_n from_o their_o hatred_n as_o in_o other_o country_n it_o be_v where_o the_o nobless_a be_v many_o of_o they_o churchman_n now_o than_o the_o reverend_a father_n the_o bishop_n may_v compass_v the_o affection_n of_o the_o people_n by_o liberty_n of_o conscience_n and_o security_n from_o the_o danger_n of_o their_o hatred_n by_o a_o inquisition_n but_o as_o i_o say_v before_o that_o can_v itself_o be_v compass_v here_o indeed_o our_o ecclesiastical_a ruler_n have_v reason_n to_o steer_v we_o cautious_o since_o they_o sit_v at_o helm_n in_o such_o a_o ship_n as_o have_v throw_v very_o many_o pilot_n overboard_o and_o it_o may_v well_o become_v those_o worthy_a divine_n that_o have_v be_v of_o late_o release_v through_o god_n good_a providence_n from_o the_o extremity_n of_o their_o suffering_n to_o be_v of_o most_o calm_a quiet_a and_o sedate_v spirit_n just_a as_o person_n take_v from_o the_o rack_n do_v present_o fall_v asleep_a the_o great_a alteration_n in_o the_o body_n of_o the_o people_n since_o these_o last_o twenty_o year_n require_v that_o our_o old_a end_n of_o promote_a the_o welfare_n of_o the_o church_n of_o england_n shall_v be_v attain_v by_o the_o conduct_n of_o new_a mean_n for_o the_o great_a part_n of_o the_o old_a assertor_n of_o all_o the_o ceremony_n of_o the_o church_n be_v lodge_v in_o grave_n many_o of_o the_o zealous_a lover_n of_o they_o be_v now_o in_o heaven_n where_o calvinist_n and_o episcopal_n man_n agree_v and_o the_o present_a major_a part_n of_o this_o land_n consist_v of_o those_o to_o who_o the_o introduce_v the_o old_a church-government_n will_v seem_v a_o innovation_n i_o grant_v the_o inconvenience_n which_o we_o suffer_v for_o want_v of_o church-government_n in_o general_n have_v be_v many_o and_o those_o which_o we_o shall_v have_v suffer_v from_o a_o scotch_a presbytery_n will_v have_v be_v more_o but_o yet_o it_o must_v likewise_o be_v grant_v that_o the_o undistinguish_a vulgar_a will_v be_v but_o too_o ready_a to_o endeavour_v the_o removal_n of_o any_o church-government_n which_o do_v at_o present_a inconvenience_n they_o without_o consider_v that_o the_o misery_n they_o former_o feel_v will_v thereby_o recur_v upon_o they_o just_o as_o a_o horse_n will_v strive_v to_o fling_v any_o rider_n that_o do_v at_o present_a gall_n and_o spur_v he_o too_o much_o without_o consider_v that_o the_o next_o rider_n may_v possible_o gall_v he_o worse_o or_o as_o a_o man_n will_v try_v to_o repel_v the_o hand_n of_o one_o who_o hold_v a_o burn_a coal_n to_o his_o flesh_n though_o he_o shall_v tell_v he_o that_o if_o that_o coal_n be_v remove_v he_o will_v apply_v a_o hot_a they_o therefore_o that_o will_v endear_v any_o form_n of_o church-government_n to_o the_o majority_n of_o the_o people_n be_v concern_v to_o make_v it_o large_o diffusive_a of_o advantage_n to_o they_o it_o be_v very_o apparent_a how_o many_o party_n among_o we_o have_v be_v ruin_v by_o narrow_a their_o interest_n and_o not_o make_v it_o national_a and_o god_n grant_v that_o after_o all_o our_o inquiry_n about_o church-discipline_n the_o gentry_n of_o england_n be_v not_o by_o any_o division_n the_o present_a clergy_n may_v cause_v tempt_v to_o cry_v up_o the_o divine_a right_n of_o erastianisme_n and_o say_v no_o erastian_n no_o king_n which_o opinion_n do_v as_o much_o exceed_v the_o episcopal_a in_o give_v power_n to_o the_o king_n as_o the_o episcopal_a do_v the_o presbyterian_a or_o that_o the_o independent_a persuasion_n it_o be_v therefore_o the_o true_a interest_n of_o the_o clergy_n here_o so_o to_o temper_v the_o government_n of_o the_o church_n that_o it_o may_v be_v accommodate_v to_o the_o content_a and_o satisfaction_n of_o the_o gentry_n or_o other_o lay-person_n and_o of_o its_o own_o member_n and_o it_o be_v very_o irrational_a to_o think_v that_o any_o church-government_n in_o a_o protestant_a country_n can_v be_v so_o which_o do_v restrain_v a_o large_a and_o almost_o absolute_a power_n to_o the_o hand_n of_o a_o few_o nor_o be_v it_o more_o prudent_a for_o france_n to_o own_v no_o distinction_n between_o a_o gentry_n and_o a_o nobility_n but_o to_o allow_v equal_a privilege_n to_o such_o as_o we_o reduce_v to_o two_o order_n here_o that_o it_o may_v effectual_o curb_v the_o insolence_n of_o the_o peasant_n then_o for_o the_o whole_a clergy_n here_o to_o grow_v into_o one_o body_n or_o form_n of_o government_n and_o all_o the_o part_n thereof_o to_o be_v influence_v with_o a_o convenient_a power_n that_o so_o it_o may_v be_v in_o no_o danger_n from_o the_o enemy_n of_o a_o ministry_n in_o general_n nor_o be_v there_o ever_o any_o thing_n propound_v as_o a_o mean_n to_o make_v the_o clergy_n of_o england_n very_o considerable_a that_o can_v be_v think_v comparable_a to_o the_o form_n of_o episcopacy_n describe_v by_o the_o bishop_n of_o armagh_n and_o therefore_o i_o do_v not_o wonder_v that_o its_o public_o own_a by_o the_o divine_n former_o call_v presbyterian_a who_o now_o deserve_v a_o name_n less_o odious_a and_o to_o be_v call_v the_o divine_n that_o be_v for_o moderate_a episcopacy_n as_o i_o say_v before_o but_o rather_o that_o it_o be_v not_o as_o general_o contend_v for_o by_o all_o their_o brethren_n of_o the_o church_n except_v a_o few_o that_o be_v actual_o invest_v with_o the_o high_a dignity_n therein_o now_o if_o we_o divide_v the_o clergy_n here_o into_o 〈◊〉_d part_n not_o one_o in_o three_o have_v these_o great_a dignity_n or_o be_v likely_a in_o any_o time_n to_o attain_v to_o they_o but_o that_o which_o the_o bishop_n of_o armaghs_n model_n of_o episcopacy_n offer_v to_o more_o than_o three_o part_n of_o four_o be_v a_o accession_n of_o power_n or_o a_o gain_n of_o that_o authority_n in_o ecclesiastical_a matter_n as_o namely_o in_o ordination_n and_o church-censure_n which_o before_o they_o have_v not_o and_o certain_o the_o grasp_a of_o present_a power_n must_v needs_o to_o any_o ingenious_a man_n of_o the_o clergy_n seem_v more_o delightful_a than_o the_o tedious_a expectation_n of_o distant_a preferment_n and_o the_o servile_a lick_v up_o of_o any_o man_n spittle_n that_o other_o hereafter_o may_v do_v so_o with_o they_o by_o the_o practice_n of_o this_o model_n the_o spirit_n of_o the_o clergy_n will_v be_v keep_v from_o be_v embase_v and_o the_o ordinary_a sort_n of_o vicar_n will_v be_v cure_v of_o affect_a servility_n laziness_n and_o ignorance_n industry_n part_n learning_n will_v be_v likewise_o thereby_o encourage_v for_o the_o power_n of_o the_o key_n be_v thus_o give_v to_o the_o bishop_n and_o all_o the_o presbyter_n in_o any_o precinct_n or_o diocese_n those_o man_n that_o can_v offer_v the_o best_a reason_n for_o thing_n and_o show_v the_o great_a strength_n of_o part_n will_v be_v most_o sway_v in_o ecclesiastical_a convention_n nor_o be_v it_o likely_a that_o the_o gentry_n will_v be_v aggrieve_v at_o the_o practice_n of_o this_o way_n of_o episcopacy_n or_o every_o church-censure's_a pass_v through_o a_o consistory_n of_o divine_n for_o it_o be_v not_o probable_a that_o in_o such_o a_o assembly_n there_o shall_v be_v a_o combination_n to_o execute_v any_o censure_n on_o any_o man_n to_o gratify_v the_o lust_n or_o private_a pique_n of_o another_o beside_o there_o be_v no_o such_o way_n that_o a_o divine_a can_v use_v to_o make_v himself_o considerable_a with_o the_o laiety_n as_o his_o be_v eminent_a for_o power_n in_o the_o sphere_n of_o his_o own_o profession_n just_a as_o a_o mercer_n that_o will_v by_o any_o sway_n influence_n the_o company_n of_o draper_n must_v first_o obtain_v a_o large_a interest_n in_o his_o own_o company_n in_o short_a the_o clergy_n by_o this_o fair_a distribution_n of_o ecclesiastical_a power_n among_o they_o will_v not_o be_v in_o danger_n of_o ruin_n by_o the_o discontent_n of_o any_o of_o its_o member_n or_o of_o any_o of_o the_o laiety_n while_o liberty_n of_o conscience_n be_v secure_v to_o they_o and_o ceremony_n be_v not_o impose_v nor_o be_v there_o any_o way_n by_o which_o the_o incovenience_n of_o the_o presbyterian_a government_n can_v again_o invade_v we_o but_o by_o the_o engross_n of_o ecclesiastical_a power_n in_o the_o hand_n but_o of_o few_o person_n and_o by_o their_o use_v rigour_n and_o violence_n i_o know_v it_o be_v ridiculous_a to_o imagine_v that_o a_o presbyterian_a government_n can_v
