great_a question_n still_o remain_v whether_o subject_n may_v lawful_o take_v commission_n from_o the_o dispossess_v prince_n to_o fight_v against_o the_o prince_n who_o be_v settle_v in_o the_o possession_n of_o the_o throne_n this_o dr._n jackson_n do_v not_o say_v and_o therefore_o he_o can_v do_v our_o author_n no_o service_n his_o next_o citation_n from_o dr._n jackson_n be_v the_o case_n of_o jehoiada_n '_o s_z depose_v of_o athaliah_n urge_v by_o the_o papist_n for_o the_o power_n of_o the_o pope_n to_o depose_v king_n but_o this_o he_o have_v so_o shameful_o mangle_v that_o a_o little_a discretion_n will_v have_v teach_v he_o rather_o to_o have_v leave_v it_o out_o than_o to_o have_v betray_v so_o much_o dishonest_o in_o his_o quotation_n i_o shall_v give_v the_o reader_n the_o entire_a passage_n first_o jehoiada_n in_o that_o he_o be_v highpriest_n be_v a_o prime_a peer_n in_o the_o realm_n of_o judah_n and_o invest_v with_o the_o power_n of_o jurisdiction_n next_o in_o order_n and_o dignity_n to_o the_o high_a power_n this_o our_o author_n leave_v out_o though_o very_o material_a because_o it_o show_v by_o what_o authority_n he_o do_v it_o as_o the_o ordinary_a supreme_a magistrate_n in_o the_o vacancy_n of_o the_o throne_n that_o be_v not_o mere_o in_o right_a of_o his_o priesthood_n as_o the_o papist_n pretend_v nor_o mere_o as_o a_o subject_a but_o as_o be_v the_o high_a power_n and_o authority_n to_o who_o the_o judgement_n of_o such_o matter_n belong_v as_o he_o have_v observe_v before_o and_o this_o be_v the_o very_a account_n the_o convocation_n give_v of_o it_o 41._o that_o jehoiada_n do_v this_o be_v the_o king_n uncle_n and_o the_o chief_a head_n and_o prince_n of_o his_o tribe_n that_o be_v not_o a_o private_a subject_n but_o a_o chief_a prince_n in_o the_o kingdom_n of_o judah_n the_o doctor_n proceed_v second_o the_o power_n royal_a or_o supreme_a be_v by_o right_a by_o the_o express_a ordinance_n and_o positive_a the_o right_n of_o this_o prince_n and_o for_o the_o actual_a annexion_n of_o the_o supreme_a power_n to_o his_o person_n unto_o who_o it_o be_v de_fw-fr jure_v annex_v jehoiada_n be_v the_o chief_a magistrate_n in_o the_o vacancy_n do_v by_o force_n and_o violence_n depose_v she_o who_o have_v usurp_v the_o royal_a sceptre_n by_o violence_n and_o cruel_a murder_n of_o her_o seed_n royal._n all_o these_o word_n in_o a_o different_a character_n be_v leave_v out_o by_o our_o author_n and_o some_o of_o they_o very_o material_a one_o especial_o those_o by_o the_o express_a ordinance_n and_o positive_a law_n of_o god_n and_o the_o next_o heir_n now_o alive_a to_o david_n which_o plain_o refer_v to_o the_o divine_a entail_n on_o david_n family_n and_o distinguish_v this_o from_o the_o case_n of_o other_o usurper_n which_o be_v the_o very_a account_n the_o convocation_n give_v of_o it_o as_o i_o show_v before_o and_o overthrow_v all_o that_o our_o author_n have_v say_v about_o the_o case_n of_o athaliah_n and_o for_o that_o reason_n he_o suppress_v they_o as_o any_o one_o will_v easy_o guess_v thus_o he_o leave_v out_o jehoiada_n be_v the_o chief_a magistrate_n in_o the_o vacancy_n which_o show_v this_o be_v a_o act_n of_o authority_n and_o jurisdiction_n which_o private_a subject_n must_v not_o pretend_v to_o and_o therefore_o will_v not_o serve_v his_o purpose_n and_o i_o believe_v by_o this_o time_n he_o think_v he_o have_v better_o have_v let_v it_o all_o alone_a he_o conclude_v his_o postscript_n with_o rage_n and_o venom_n and_o i_o have_v no_o answer_n to_o that_o i_o have_v indeed_o change_v my_o opinion_n about_o the_o authority_n of_o usurper_n who_o be_v settle_v in_o the_o throne_n by_o the_o general_a consent_n and_o submission_n of_o the_o people_n and_o of_o the_o estate_n of_o the_o realm_n and_o i_o have_v scripture_n and_o reason_n the_o authority_n of_o the_o church_n of_o england_n and_o the_o law_n of_o the_o land_n for_o any_o thing_n our_o author_n have_v say_v to_o the_o contrary_a to_o justify_v this_o change_n and_o i_o assure_v he_o i_o will_v change_v my_o opinion_n in_o any_o thing_n else_o upon_o the_o same_o term_n and_o despise_v his_o censure_n of_o my_o honesty_n for_o do_v so_o and_o as_o for_o authority_n i_o never_o pretend_v to_o any_o myself_o and_o will_v never_o own_o any_o man_n authority_n much_o less_o my_o own_o opinion_n in_o opposition_n to_o scripture_n and_o reason_n the_o church_n of_o england_n and_o the_o law_n of_o the_o land_n but_o what_o a_o charitable_a opinion_n our_o author_n have_v of_o the_o present_a government_n and_o of_o all_o that_o comply_v with_o it_o we_o may_v see_v in_o the_o parallel_n he_o make_v between_o my_o case_n and_o that_o of_o hazael_n as_o if_o swear_v allegiance_n to_o king_n william_n and_o queen_n mary_n be_v as_o great_a as_o notorious_a as_o self_n evident_a a_o impiety_n and_o wickedness_n as_o all_o the_o villainy_n which_o the_o prophet_n elisha_n foretell_v hazael_n that_o he_o will_v be_v guilty_a of_o i_o know_v the_o evil_a that_o thou_o will_v do_v unto_o the_o child_n of_o israel_n 12._o their_o strong_a hold_n will_v thou_o set_v on_o fire_n and_o their_o young_a man_n will_v thou_o slay_v with_o the_o sword_n and_o will_v dash_v their_o child_n and_o rip_v up_o their_o woman_n woth_n child_n but_o let_v our_o author_n consider_v who_o be_v most_o likely_a to_o be_v guilty_a of_o these_o villainy_n those_o who_o quiet_o submit_v to_o the_o government_n which_o be_v now_o settle_a among_o we_o or_o those_o who_o be_v for_o overturning_a all_o by_o bring_v in_o a_o french_a power_n to_o devour_v and_o consume_v with_o fire_n and_o sword_n and_o to_o enslave_v their_o native_a country_n if_o this_o be_v allegiance_n and_o passive_a obedience_n i_o be_o sure_a what_o our_o author_n call_v perjury_n and_o rebellion_n be_v the_o great_a virtue_n as_o for_o his_o part_a request_n i_o do_v affirm_v it_o again_o that_o i_o never_o be_v factious_a against_o take_v the_o oath_n nor_o make_v it_o my_o business_n to_o dissuade_v man_n from_o it_o when_o my_o opinion_n be_v ask_v i_o declare_v my_o own_o thought_n but_o never_o seek_v out_o man_n to_o make_v proselyte_n and_o in_o this_o profession_n i_o be_o not_o afraid_a of_o his_o or_o any_o other_o man_n memory_n so_o much_o as_o of_o their_o invention_n for_o there_o be_v some_o great_a wit_n among_o they_o let_v they_o produce_v the_o man_n if_o they_o can_v who_o i_o endeavour_v to_o dissuade_v by_o word_n or_o writing_n from_o take_v the_o oath_n where_o my_o opinion_n be_v not_o first_o ask_v and_o if_o my_o opinion_n have_v any_o authority_n with_o they_o then_o our_o author_n know_v it_o be_v more_o than_o it_o ought_v to_o have_v have_v and_o that_o be_v none_o of_o my_o fault_n unless_o he_o mean_v that_o my_o authority_n be_v considerable_a against_o take_v the_o oath_n but_o none_o for_o it_o which_o be_v the_o way_n that_o all_o party_n and_o faction_n judge_v of_o man_n authority_n but_o though_o our_o author_n seem_v very_o well_o acquaint_v with_o the_o thing_n call_v faction_n yet_o he_o be_v not_o willing_a to_o understand_v the_o word_n and_o therefore_o i_o must_v tell_v he_o that_o when_o i_o say_v i_o be_v never_o factious_a against_o the_o oath_n i_o do_v not_o mean_v that_o i_o be_v never_o hearty_a and_o zealous_a against_o take_v the_o oath_n for_o i_o hope_v there_o may_v be_v zeal_n without_o faction_n or_o that_o when_o i_o be_v press_v to_o discourse_v the_o matter_n i_o do_v not_o talk_v with_o as_o much_o warmth_n and_o concernment_n as_o other_o men._n but_o faction_n be_v quite_o another_o thing_n it_o show_v itself_o in_o separation_n and_o schism_n in_o rancour_n and_o bitterness_n envy_n and_o emulation_n in_o violent_a opposition_n to_o government_n in_o change_v and_o confine_v friendship_n with_o a_o party_n in_o censure_n and_o reproach_n in_o stigmatise_v all_o person_n of_o another_o persuasion_n as_o perjure_a knave_n whereas_o though_o there_o have_v be_v a_o material_a perjury_n a_o different_a opinion_n may_v excuse_v from_o formal_a perjury_n for_o no_o man_n be_v formal_o perjure_v who_o do_v not_o know_v it_o i_o shall_v not_o explain_v this_o by_o instance_n for_o if_o our_o author_n be_v for_o write_v secret_a history_n i_o be_o not_o so_o at_o present_a and_o now_o i_o be_o at_o leisure_n to_o attend_v his_o motion_n and_o to_o consider_v his_o threaten_a examination_n of_o all_o my_o argument_n whenever_o his_o due_a time_n for_o it_o come_v and_o if_o he_o will_v promise_v to_o examine_v they_o well_o before_o he_o answer_v i_o shall_v
of_o that_o tyrant_n antiochus_n be_v not_o then_o either_o general_o receive_v by_o submission_n nor_o settle_v by_o continuance_n though_o i_o can_v blame_v he_o for_o this_o because_o the_o author_n who_o he_o answer_v take_v no_o notice_n of_o it_o but_o i_o must_v blame_v he_o for_o affirm_v that_o the_o convocation_n say_v that_o when_o athaliah_n be_v full_o possess_v of_o the_o throne_n she_o ought_v not_o to_o be_v obey_v but_o to_o be_v resist_v and_o slay_v for_o they_o say_v no_o such_o thing_n and_o though_o he_o may_v imagine_v this_o to_o be_v the_o consequence_n of_o what_o they_o say_v he_o ought_v not_o therefore_o to_o affirm_v that_o they_o say_v it_o because_o he_o may_v mistake_v in_o his_o consequence_n and_o that_o he_o have_v do_v so_o shall_v present_o appear_v the_o convocation_n say_v not_o one_o word_n of_o the_o through_o settlement_n of_o athaliah_n in_o the_o throne_n but_o if_o we_o may_v learn_v the_o sense_n of_o the_o convocation_n as_o this_o author_n conclude_v we_o may_v from_o what_o bishop_n buckridge_n 27._o a_o member_n of_o that_o convocation_n have_v write_v in_o his_o defence_n of_o barclay_n they_o do_v not_o think_v she_o settle_v in_o the_o throne_n for_o when_o bellarmin_n have_v object_v the_o quiet_a possession_n of_o athaliah_n for_o six_o year_n the_o bishop_n as_o this_o author_n cite_v he_o answers_z how_o quiet_a soever_o it_o be_v it_o be_v violent_a for_o she_o be_v guard_v with_o soldier_n and_o affirm_v that_o athaliah_n have_v not_o acquire_v a_o right_n to_o the_o crown_n i_o suppose_v he_o mean_v only_o such_o a_o right_a as_o a_o thorough_a settlement_n give_v neither_o by_o the_o consent_n of_o the_o people_n nor_o by_o the_o prescription_n of_o six_o year_n six_o year_n be_v not_o long_a enough_o for_o a_o prescription_n which_o he_o say_v must_v be_v a_o hundred_o year_n and_o the_o consent_n of_o the_o people_n it_o seem_v she_o have_v not_o and_o therefore_o be_v a_o mere_a usurper_n and_o no_o queen_n she_o may_v be_v depose_v and_o thus_o his_o whole_a argument_n be_v lose_v and_o here_o i_o must_v observe_v that_o the_o bishop_n allow_v as_o the_o convocation_n do_v that_o either_o the_o consent_n of_o the_o people_n or_o a_o long_a prescription_n give_v a_o right_a that_o be_v such_o a_o right_a as_o make_v obedience_n due_a to_o prince_n thus_o settle_v without_o a_o legal_a title_n and_o therefore_o our_o author_n great_o prevaricate_v when_o he_o pretend_v to_o give_v the_o bishop_n sense_n of_o a_o thorough_a settlement_n that_o be_v when_o a_o right_a to_o the_o government_n be_v acquire_v by_o a_o prescription_n and_o that_o be_v a_o long_a and_o uninterrupted_a possession_n join_v with_o the_o consent_n of_o the_o people_n the_o bishop_n distinguish_v between_o the_o consent_n of_o the_o people_n and_o a_o long_a prescription_n and_o say_v that_o either_o of_o they_o will_v give_v a_o right_n and_o our_o author_n though_o he_o pretend_v to_o give_v the_o bishop_n sense_n make_v both_o of_o they_o together_o necessary_a to_o give_v a_o right_n a_o long_a and_o uninterrupted_a possession_n which_o be_v what_o the_o bishop_n call_v prescription_n join_v with_o the_o consent_n of_o the_o people_n so_o that_o he_o leave_v out_o neither_o and_o nor_o as_o insignificant_a particle_n and_o like_v with_o better_a as_o more_o agreeable_a to_o his_o design_n and_o at_o this_o rate_n he_o may_v make_v convocation_n and_o bishop_n speak_v his_o sense_n when_o he_o please_v but_o to_o gratify_v our_o author_n let_v we_o suppose_v the_o convocation_n do_v own_o athaliah_n to_o have_v be_v as_o thorough_o settle_v on_o the_o throne_n as_o any_o usurper_n can_v be_v while_o the_o right_a heir_n be_v live_v and_o then_o the_o consequence_n be_v that_o the_o convocation_n teach_v that_o king_n and_o queen_n de_fw-mi facto_fw-la who_o have_v all_o the_o settlement_n that_o can_v be_v have_v without_o right_o may_v be_v depose_v and_o murder_v by_o their_o subject_n and_o will_v this_o author_n say_v that_o this_o be_v the_o doctrine_n of_o the_o convocation_n do_v they_o not_o express_o warn_v we_o against_o believe_v any_o person_n who_o shall_v affirm_v by_o all_o the_o argument_n which_o wit_n or_o learning_n can_v devise_v 55._o that_o god_n have_v call_v he_o to_o murder_n the_o king_n de_fw-fr facto_fw-la under_o who_o he_o live_v it_o seem_v then_o the_o convocation_n make_v a_o great_a difference_n between_o the_o case_n of_o athaliah_n and_o other_o king_n de_fw-la facto_fw-la who_o have_v no_o better_a title_n nor_o more_o through_o settlement_n than_o she_o have_v if_o they_o think_v she_o settle_v in_o the_o throne_n without_o which_o supposition_n our_o author_n argument_n be_v lose_v for_o they_o justify_v the_o kill_a athaliah_n 35._o and_o condemn_v the_o murder_n of_o a_o king_n de_fw-fr facto_fw-la and_o this_o i_o give_v two_o account_n of_o in_o my_o case_n of_o allegiance_n 1._o all_o that_o this_o story_n amount_v to_o be_v no_o more_o than_o this_o that_o when_o the_o legal_a and_o rightful_a heir_n be_v actual_o possess_v of_o his_o throne_n subject_n may_v return_v to_o their_o allegiance_n and_o by_o the_o authority_n of_o their_o king_n prosecute_v the_o usurper_n for_o joash_n be_v first_o anoint_v and_o proclaim_v before_o any_o one_o stir_v a_o finger_n against_o athaliah_n now_o this_o be_v a_o very_a different_a case_n from_o raise_v a_o rebellion_n against_o a_o prince_n who_o be_v in_o possession_n of_o the_o throne_n to_o restore_v a_o eject_v prince_n 2._o but_o this_o be_v a_o peculiar_a case_n for_o god_n himself_o have_v entail_v the_o kingdom_n of_o judah_n on_o the_o posterity_n of_o david_n and_o therefore_o nothing_o can_v justify_v their_o submission_n to_o a_o usurper_n when_o the_o king_n son_n be_v find_v to_o who_o the_o kingdom_n do_v belong_v by_o a_o divine_a entail_v 5._o and_o by_o this_o jehoiada_n justify_v what_o he_o do_v behold_v the_o king_n son_n shall_v reign_v as_o the_o lord_n have_v say_v of_o the_o son_n of_o david_n now_o when_o god_n have_v entail_v the_o crown_n by_o a_o express_a declaration_n of_o his_o will_n and_o nomination_n of_o the_o person_n or_o family_n that_o shall_v reign_v as_o it_o be_v in_o the_o kingdom_n of_o judah_n subject_n be_v bind_v to_o adhere_v to_o their_o prince_n of_o god_n choose_n when_o he_o be_v know_v and_o to_o persecute_v all_o usurper_n to_o the_o utmost_a and_o never_o submit_v to_o their_o government_n but_o in_o other_o kingdom_n where_o god_n make_v king_n and_o entail_v the_o crown_n not_o by_o express_a nomination_n but_o by_o his_o providence_n the_o place_v a_o prince_n in_o the_o throne_n and_o settle_v he_o there_o in_o the_o full_a administration_n of_o the_o government_n be_v a_o reason_n to_o submit_v to_o he_o as_o to_o god_n ordinance_n this_o our_o author_n answer_v with_o great_a triumph_n in_o his_o postscript_n p._n 4_o 5._o but_o with_o how_o much_o reason_n i_o shall_v now_o examine_v and_o i_o must_v begin_v with_o his_o answer_n to_o the_o second_o this_o distinction_n that_o god_n himself_o have_v entail_v the_o kingdom_n of_o judah_n upon_o david_n posterity_n he_o say_v be_v not_o in_o the_o convocation_n book_n and_o so_o do_v not_o affect_v their_o sense_n i_o grant_v it_o and_o therefore_o do_v not_o concern_v the_o convocation-book_n in_o the_o story_n nor_o make_v any_o mention_n of_o it_o but_o only_o raise_v this_o objection_n from_o the_o story_n and_o give_v that_o answer_n to_o it_o by_o which_o jehoiada_n the_o highpriest_n justify_v what_o he_o do_v for_o though_o the_o convocation_n take_v notice_n of_o this_o story_n yet_o they_o neither_o make_v nor_o answer_v this_o objection_n in_o direct_a term_n they_o have_v another_o design_n in_o mention_v it_o and_o fit_v their_o answer_n whole_o to_o that_o viz._n to_o prove_v against_o the_o papist_n 41._o that_o no_o priest_n in_o the_o old_a testament_n do_v ever_o depose_v from_o their_o crown_n any_o of_o their_o king_n how_o wicked_a soever_o or_o have_v any_o authority_n so_o to_o do_v and_o because_o this_o example_n of_o jehoiada_n use_v to_o be_v urge_v by_o they_o to_o this_o purpose_n they_o show_v that_o no_o such_o thing_n can_v be_v prove_v from_o it_o but_o though_o the_o convocation_n do_v not_o answer_v a_o question_n which_o they_o never_o propose_v yet_o this_o be_v a_o good_a answer_n to_o it_o and_o agreeable_a to_o the_o sense_n of_o the_o convocation_n in_o that_o place_n for_o they_o take_v notice_n that_o jehoiada_n when_o he_o have_v send_v to_o the_o levite_n and_o chief_a father_n both_o of_o judah_n and_o benjamin_n acquaint_v they_o with_o the_o preservation_n of_o their_o prince_n and_o that_o it_o be_v the_o lord_n will_n that_o he_o shall_v reign_v over_o they_o which_o plain_o refer_v to_o that_o divine_a entail_v of_o the_o
from_o ruin_n this_o objection_n have_v be_v answer_v more_o than_o once_o in_o my_o case_n of_o allegiance_n but_o because_o i_o find_v some_o man_n very_o unwilling_a to_o understand_v it_o i_o will_v try_v whether_o i_o can_v set_v it_o in_o a_o clear_a light_n now_o here_o be_v two_o thing_n to_o be_v consider_v 1._o the_o right_n to_o the_o crown_n 2._o the_o right_n to_o allegiance_n as_o for_o the_o first_o the_o fundamental_a prejudice_n and_o mistake_n seem_v to_o be_v this_o that_o man_n make_v no_o difference_n between_o a_o legal_a right_n to_o the_o crown_n and_o the_o legal_a right_n of_o subject_n to_o their_o estate_n and_o therefore_o think_v it_o as_o wicked_a and_o unjust_a for_o subject_n whatever_o their_o circumstance_n be_v to_o own_o any_o other_o prince_n but_o the_o legal_a heir_n as_o it_o will_v be_v for_o tenant_n to_o pay_v their_o rent_n to_o any_o but_o their_o true_a legal_a lord_n but_o i_o apprehend_v a_o great_a difference_n between_o these_o two_o case_n and_o it_o be_v this_o that_o in_o settle_v a_o estate_n there_o be_v nothing_o more_o require_v but_o a_o mere_a humane_a right_n but_o to_o make_v a_o legal_a king_n beside_o a_o humane_a right_n to_o the_o crown_n he_o must_v have_v god_n authority_n there_o be_v nothing_o but_o a_o legal_a descent_n and_o a_o legal_a possession_n that_o give_v right_o to_o a_o legal_a estate_n and_o therefore_o the_o law_n must_v have_v its_o effect_n and_o be_v the_o only_a adequate_a rule_n of_o right_n and_o wrong_n in_o such_o case_n and_o though_o the_o providence_n of_o god_n allot_v man_n private_a fortune_n though_o he_o make_v rich_a and_o make_v poor_a yet_o he_o give_v no_o man_n a_o right_n to_o a_o estate_n which_o he_o have_v get_v by_o fraud_n injustice_n and_o violence_n nor_o exempt_v they_o from_o legal_a punishment_n and_o prosecution_n but_o leave_v all_o such_o mere_a legal_a right_n under_o the_o general_a influence_n of_o his_o providence_n to_o the_o care_n of_o public_a government_n but_o now_o if_o a_o mere_a humane_a right_n can_v make_v a_o king_n but_o it_o be_v god_n authority_n which_o make_v a_o king_n if_o god_n reserve_v this_o authority_n in_o his_o own_o hand_n to_o the_o free_a disposal_n of_o his_o own_o sovereign_n will_v and_o counsel_n and_o do_v not_o inseparable_o annex_v it_o to_o humane_a entail_v of_o the_o crown_n if_o god_n authority_n without_o a_o humane_a right_n can_v make_v a_o king_n but_o humane_a law_n can_v make_v a_o king_n without_o god_n authority_n this_o may_v satisfy_v we_o that_o when_o god_n think_v fit_a to_o interpose_v his_o authority_n a_o mere_a legal_a right_n be_v not_o a_o sufficient_a reason_n to_o adhere_v to_o a_o prince_n who_o god_n have_v remove_v from_o the_o throne_n nor_o the_o mere_a want_n of_o a_o legal_a right_n a_o sufficient_a reason_n to_o disow_v a_o prince_n who_o god_n have_v set_v upon_o the_o throne_n if_o mere_a law_n make_v a_o king_n as_o it_o make_v a_o heir_n to_o a_o estate_n it_o be_v very_o unjust_a in_o subject_n to_o own_o any_o but_o a_o legal_a king_n but_o if_o the_o sovereign_a authority_n of_o god_n can_v remove_v a_o king_n who_o have_v the_o legal_a right_n and_o set_v up_o a_o king_n who_o have_v no_o legal_a right_n then_o mere_a humane_a law_n be_v not_o the_o only_a rule_n of_o right_n and_o wrong_n in_o this_o matter_n and_o there_o be_v no_o reason_n to_o charge_v any_o man_n who_o upon_o these_o term_n submit_v to_o a_o new_a prince_n with_o the_o least_o injustice_n either_o in_o disow_v his_o old_a legal_a prince_n or_o in_o submit_v to_o a_o new_a one_o second_o as_o for_o the_o right_n to_o allegiance_n it_o be_v the_o great_a design_n of_o my_o book_n to_o prove_v that_o allegiance_n be_v not_o immediate_o due_a to_o a_o legal_a right_n to_o the_o crown_n but_o to_o government_n and_o therefore_o a_o prince_n who_o have_v a_o legal_a right_n to_o the_o throne_n but_o have_v it_o not_o can_v have_v a_o right_n to_o my_o allegiance_n till_o he_o gain_v the_o throne_n and_o i_o deny_v he_o no_o right_n which_o he_o can_v just_o claim_v though_o i_o deny_v my_o allegiance_n to_o he_o while_o he_o be_v out_o of_o the_o throne_n and_o methinks_v our_o author_n shall_v have_v answer_v all_o that_o i_o say_v upon_o this_o argument_n before_o he_o have_v so_o dogmatical_o tell_v we_o that_o the_o general_a rule_n about_o right_a and_o wrong_n which_o extend_v to_o all_o person_n and_o case_n make_v it_o needless_a for_o st._n paul_n to_o have_v tell_v we_o that_o by_o the_o high_a power_n and_o the_o power_n that_o be_v he_o mean_v only_o legal_a power_n for_o if_o illegal_a power_n in_o his_o sense_n may_v be_v the_o hight_a power_n and_o the_o power_n that_o at_o present_a be_v who_o have_v the_o actual_a administration_n of_o government_n and_o allegiance_n be_v immediate_o due_a only_o to_o the_o govern_v power_n then_o notwithstanding_o the_o general_n rule_v of_o right_n and_o wrong_n the_o apostle_n may_v mean_v our_o author_n be_v illegal_a power_n i_o be_o sure_a the_o reason_n of_o thing_n do_v not_o prove_v the_o contrary_a for_o when_o the_o allegiance_n and_o obedience_n of_o subject_n be_v a_o duty_n only_o for_o the_o sake_n of_o government_n for_o the_o ease_n and_o safety_n of_o it_o it_o be_v very_o strange_a that_o it_o shall_v not_o be_v due_a to_o a_o settle_a government_n but_o due_a to_o a_o prince_n who_o do_v not_o and_o can_v govern._n and_o if_o i_o may_v have_v liberty_n to_o dispute_v with_o this_o author_n upon_o his_o own_o principle_n i_o desire_v to_o know_v of_o he_o whether_o allegiance_n be_v due_a to_o any_o prince_n upon_o any_o other_o account_n than_o his_o be_v invest_v with_o god_n authority_n let_v he_o say_v it_o be_v at_o the_o utmost_a peril_n of_o his_o cause_n how_o then_o do_v god_n invest_v any_o prince_n with_o his_o authority_n of_o government_n who_o he_o do_v not_o immediate_o nominate_v as_o he_o do_v in_o the_o kingdom_n of_o judah_n it_o must_v be_v either_o by_o annex_v his_o authority_n to_o the_o legal_a office_n or_o by_o place_v such_o a_o person_n on_o the_o throne_n by_o what_o mean_v soever_o he_o do_v it_o or_o by_o both_o and_o then_o it_o be_v certain_a no_o prince_n can_v have_v god_n authority_n who_o be_v not_o in_o possession_n of_o the_o throne_n and_o then_o no_o allegiance_n can_v be_v due_a to_o he_o if_o god_n authority_n be_v annex_v to_o the_o regal_a office_n a_o prince_n must_v be_v in_o the_o actual_a administration_n of_o the_o regal_a office_n and_o power_n before_o he_o can_v have_v god_n authority_n as_o a_o man_n must_v be_v actual_o marry_v before_o he_o can_v have_v the_o authority_n which_o the_o divine_a law_n give_v to_o a_o husband_n if_o god_n settle_v a_o prince_n in_o the_o throne_n give_v he_o this_o authority_n than_o no_o prince_n who_o be_v remove_v from_o the_o throne_n can_v have_v god_n authority_n and_o this_o be_v agreeable_a to_o the_o language_n of_o scripture_n when_o god_n be_v say_v to_o remove_v king_n and_o set_v up_o king_n which_o when_o it_o do_v not_o signify_v the_o express_a revelation_n of_o his_o will_n but_o the_o act_n of_o his_o providence_n can_v mean_v no_o more_o than_o the_o remove_n one_o king_n from_o the_o throne_n and_o place_v another_o in_o it_o as_o it_o be_v elsewhere_o express_v he_o pull_v down_o the_o mighty_a from_o their_o seat_n and_o exalt_v the_o humble_a and_o meek_a the_o truth_n be_v the_o authority_n of_o government_n be_v always_o god_n authority_n and_o that_o be_v the_o reason_n bishop_n overal_n convocation_n book_n give_v why_o any_o degenerate_a form_n of_o government_n when_o thorough_o settle_v must_v be_v reverence_v and_o obey_v because_o the_o authority_n so_o unjust_o get_v 57_o or_o wring_v by_o force_n from_o the_o true_a and_o lawful_a possessor_n be_v always_o god_n authority_n which_o they_o offer_v no_o proof_n at_o all_o of_o but_o what_o be_v suppose_v in_o their_o reason_n that_o the_o authority_n of_o government_n when_o it_o be_v once_o settle_a be_v god_n authority_n and_o then_o how_o those_o prince_n who_o whatever_o their_o right_n be_v have_v no_o authority_n of_o government_n shall_v have_v god_n authority_n i_o can_v guess_v for_o to_o call_v a_o right_n to_o the_o crown_n the_o authority_n of_o government_n be_v contrary_a to_o the_o sense_n of_o mankind_n when_o they_o speak_v of_o sovereign_a prince_n for_o he_o have_v the_o actual_a authority_n who_o actual_o administer_v the_o government_n and_o it_o be_v actual_a authority_n which_o be_v god_n authority_n not_o authority_n in_o fancy_n and_o idea_n for_o god_n do_v not_o give_v authority_n to_o govern_v without_o the_o power_n of_o government_n which_o be_v a_o very_a
no_o mean_n allow_v that_o the_o providence_n of_o god_n can_v make_v a_o king_n against_o the_o law_n of_o the_o land_n can_v remove_v a_o rightful_a king_n and_o set_v up_o a_o king_n without_o a_o legal_a title_n at_o least_o not_o without_o the_o death_n or_o session_n of_o the_o rightful_a king_n or_o a_o hundred_o year_n prescription_n but_o to_o say_v that_o the_o providence_n of_o god_n give_v his_o authority_n to_o a_o king_n de_fw-fr facto_fw-la who_o be_v settle_v in_o the_o throne_n this_o be_v a_o impious_a doctrine_n so_o that_o have_v i_o leave_v out_o providence_n i_o may_v have_v have_v fair_a quarter_n on_o all_o hand_n though_o in_o effect_n the_o thing_n have_v be_v the_o same_o and_o i_o have_v teach_v the_o same_o thing_n viz._n that_o when_o a_o rightful_a king_n be_v dispossess_v subject_n may_v own_v and_o submit_v to_o the_o king_n who_o be_v settle_v in_o the_o possession_n of_o the_o throne_n which_o be_v all_o i_o undertake_v to_o prove_v have_v i_o only_o say_v that_o conquest_n in_o a_o just_a war_n by_o the_o law_n of_o nation_n give_v a_o right_a to_o the_o conqueror_n though_o the_o former_a king_n be_v alive_a and_o have_v make_v his_o escape_n have_v i_o only_o say_v that_o unjust_a force_n and_o violence_n make_v it_o lawful_a for_o subject_n to_o submit_v when_o the_o prince_n can_v protect_v they_o and_o such_o submission_n and_o consent_n of_o the_o people_n settle_v a_o prince_n in_o the_o kingdom_n i_o may_v have_v escape_v very_o well_o as_o other_o have_v do_v or_o have_v i_o only_o say_v that_o the_o law_n of_o the_o land_n allow_v and_o require_v subject_n to_o pay_v allegiance_n to_o a_o king_n de_fw-fr facto_fw-la in_o possession_n of_o the_o crown_n most_o of_o our_o non-swearer_n themselves_o will_v have_v allow_v this_o a_o good_a plea_n can_v i_o have_v persuade_v they_o it_o be_v true_a for_o the_o law_n of_o the_o land_n they_o must_v allow_v to_o be_v the_o rule_n and_o measure_n of_o our_o spoil_v all_o and_o be_v a_o impious_a doctrine_n that_o be_v any_o of_o these_o way_n will_v make_v very_o good_a king_n without_o god_n but_o it_o be_v a_o very_a wicked_a thing_n to_o say_v that_o god_n make_v they_o king_n or_o give_v his_o authority_n to_o they_o for_o it_o be_v a_o dangerous_a thing_n to_o allow_v that_o god_n make_v king_n or_o that_o king_n have_v his_o authority_n or_o that_o the_o providence_n of_o god_n do_v not_o bare_o permit_v but_o govern_v all_o the_o change_n and_o revolution_n of_o the_o world_n but_o i_o have_v learn_v from_o scripture_n and_o b._n overal_n '_o s_o convocation_n book_n prove_v that_o those_o learned_a man_n be_v of_o the_o same_o mind_n that_o king_n be_v make_v only_o by_o god_n and_o that_o it_o be_v god_n authority_n which_o make_v they_o king_n and_o therefore_o i_o can_v not_o think_v it_o enough_o to_o say_v by_o what_o visible_a mean_n prince_n be_v advance_v to_o the_o throne_n without_o add_v that_o the_o such_o revolution_n and_o if_o this_o be_v my_o only_a fault_n that_o i_o assert_v the_o right_n and_o prerogative_n of_o god_n in_o make_v king_n and_o the_o wisdom_n and_o government_n of_o providence_n in_o all_o the_o revolution_n of_o state_n and_o empire_n i_o be_o content_v to_o suffer_v obloquy_n and_o reproach_n for_o maintain_v such_o impious_a doctrine_n our_o author_n in_o his_o answer_n have_v another_o argument_n to_o prove_v that_o we_o misrepresent_v the_o sense_n of_o the_o convocation_n which_o he_o have_v think_v fit_a to_o leave_v out_o in_o his_o postscript_n 22._o viz._n that_o the_o interpretation_n we_o give_v of_o it_o be_v inconsistent_a with_o the_o main_a and_o fundamental_a doctrine_n of_o the_o convocation_n book_n viz._n passive_a obedience_n and_o nonresistance_n but_o if_o the_o convocation_n teach_v both_o as_o they_o certain_o do_v it_o be_v a_o sign_n that_o whatever_o our_o author_n think_v or_o whatever_o he_o can_v prove_v the_o convocation_n do_v not_o apprehend_v any_o inconsistency_n between_o they_o i_o observe_v in_o the_o case_n that_o the_o doctrine_n of_o obedience_n and_o allegiance_n to_o the_o present_a power_n 36._o be_v found_v on_o the_o same_o principle_n with_o the_o doctrine_n of_o nonresistance_n and_o passive_a obedience_n viz._n that_o god_n make_v king_n and_o invest_n they_o with_o his_o authority_n which_o equal_o prove_v that_o all_o king_n who_o have_v receive_v a_o sovereign_a authority_n from_o god_n must_v be_v obey_v and_o must_v not_o be_v resist_v and_o therefore_o all_o settle_a government_n as_o the_o convocation_n assert_n have_v their_o authority_n from_o god_n must_v be_v obey_v for_o the_o same_o reason_n for_o which_o we_o must_v not_o resist_v sovereign_a prince_n viz._n because_o they_o have_v their_o authority_n from_o god_n but_o this_o our_o author_n think_v fit_a to_o pass_v over_o for_o it_o be_v a_o plain_a case_n that_o nonresistance_n and_o passive_a obedience_n can_v be_v due_a only_o to_o he_o who_o be_v our_o king_n and_o if_o god_n can_v remove_v one_o king_n and_o set_v up_o another_o nonresistance_n must_v be_v due_a not_o to_o the_o king_n who_o god_n have_v pull_v down_o but_o to_o the_o king_n who_o god_n have_v set_v up_o and_o therefore_o he_o may_v harangue_n as_o long_o as_o he_o please_v upon_o this_o argument_n to_o no_o purpose_n unless_o he_o can_v prove_v that_o god_n have_v not_o pull_v down_o one_o king_n and_o set_v up_o another_o his_o next_o argument_n against_o this_o interpretation_n of_o the_o convocation_n book_n be_v this_o that_o it_o reproach_n the_o virtue_n and_o loyalty_n of_o those_o admirable_a man_n who_o suffer_v between_o the_o year_n 42._o and_o 60._o and_o therefore_o this_o can_v be_v the_o sense_n of_o the_o convocation_n for_o no_o doubt_n the_o convocation_n in_o 603._o have_v great_a regard_n to_o the_o loyalty_n of_o those_o who_o suffer_v between_o 42._o and_o 60_o by_o a_o spirit_n of_o prophecy_n i_o suppose_v and_o here_o our_o author_n grow_v very_o angry_a both_o in_o his_o answer_n and_o postscript_n and_o give_v many_o hard_a and_o spiteful_a word_n to_o his_o adversary_n but_o be_v that_o to_o himself_o i_o be_o resolve_v not_o to_o be_v angry_a this_o i_o answer_v at_o large_a in_o the_o case_n of_o allegiance_n p._n 46._o etc._n etc._n and_o shall_v now_o take_v a_o brief_a review_n of_o it_o i_o say_v it_o be_v a_o great_a prejudice_n but_o no_o argument_n for_o if_o these_o principle_n be_v true_a and_o according_a to_o these_o principle_n they_o may_v have_v comply_v with_o those_o usurpation_n that_o they_o do_v not_o be_v no_o confutation_n of_o the_o principle_n he_o answer_v 14._o i_o think_v a_o argument_n from_o example_n have_v be_v a_o argument_n though_o not_o always_o a_o very_a good_a one_o right_a but_o example_n be_v only_o a_o prejudice_n not_o a_o argument_n against_o plain_a reason_n which_o can_v otherwise_o be_v answer_v let_v reason_n be_v first_o answer_v and_o then_o when_o there_o be_v no_o reason_n against_o a_o thing_n the_o example_n of_o great_a and_o wise_a man_n without_o any_o thus_o the_o example_n of_o jaddus_n may_v be_v a_o argument_n when_o other_o example_n be_v none_o though_o he_o know_v the_o example_n of_o jaddus_n be_v allege_v by_o i_o only_o to_o prove_v the_o sense_n of_o the_o convocation_n and_o how_o jaddus_n himself_o understand_v his_o oath_n of_o allegiance_n to_o darius_n which_o be_v a_o very_a different_a case_n from_o what_o he_o urge_v but_o to_o let_v pass_v his_o transport_n of_o zeal_n and_o to_o forgive_v the_o froth_n and_o folly_n of_o it_o when_o he_o urge_v the_o example_n of_o these_o great_a man_n there_o be_v many_o thing_n he_o ought_v to_o have_v consider_v as_o 1._o he_o shall_v have_v consider_v who_o he_o reproach_v in_o all_o this_o as_o well_o as_o who_o he_o commend_v he_o reproach_n all_o those_o who_o in_o those_o time_n of_o confusion_n submit_v to_o the_o usurp_v power_n and_o live_v quiet_o and_o peaceable_o under_o they_o and_o yet_o the_o king_n find_v a_o great_a many_o true_a friend_n and_o loyal_a person_n at_o his_o return_n among_o those_o man_n he_o reproach_n all_o those_o loyal_a person_n both_o of_o the_o nobility_n gentry_n and_o clergy_n
law_n of_o the_o land_n whenever_o he_o will_v command_v thing_n against_o law_n and_o have_v power_n to_o crush_v we_o if_o we_o will_v not_o obey_v i_o will_v ready_o grant_v and_o so_o must_v he_o that_o it_o be_v our_o duty_n to_o do_v it_o but_o till_o he_o prove_v this_o he_o must_v not_o take_v it_o for_o grant_v there_o be_v such_o a_o law_n and_o then_o we_o need_v dispute_v this_o good_a earnest_n to_o prove_v that_o we_o must_v submit_v to_o the_o arbitrary_a will_n of_o our_o prince_n against_o law_n and_o to_o condemn_v the_o opposition_n that_o be_v make_v in_o the_o late_a arbitrary_a will_n and_o power_n against_o law_n because_o when_o the_o law_n of_o the_o land_n contradict_v the_o law_n of_o god_n they_o be_v no_o rule_n to_o we_o i_o shall_v only_o observe_v far_a that_o our_o author_n charge_v i_o with_o say_v in_o the_o case_n of_o resistance_n that_o this_o may_v easy_o be_v that_o a_o prince_n in_o a_o limit_a monarchy_n shall_v resolve_v to_o be_v arbitrary_a when_o he_o have_v all_o the_o power_n of_o the_o kingdom_n in_o his_o hand_n and_o must_v not_o be_v resist_v whereas_o i_o bring_v this_o in_o by_o way_n of_o objection_n against_o nonresistance_n and_o only_o say_v it_o be_v possible_a but_o show_v by_o several_a argument_n how_o difficult_a it_o be_v and_o that_o the_o doctrine_n of_o nonresistance_n do_v not_o destroy_v the_o distinction_n between_o a_o limit_a and_o absolute_a monarchy_n but_o at_o this_o rate_n he_o use_v to_o cite_v author_n that_o unwary_a reader_n will_v easy_o be_v impose_v on_o if_o they_o give_v too_o much_o credit_n to_o he_o thus_o i_o have_v particular_o answer_v all_o the_o little_a appearance_n of_o reason_n and_o argument_n in_o the_o postscript_n and_o make_v it_o appear_v that_o according_a to_o the_o sense_n of_o the_o convocation_n those_o prince_n who_o have_v no_o legal_a right_n may_v yet_o have_v god_n authority_n and_o have_v so_o when_o their_o government_n be_v thorough_o settle_v and_o now_o have_v be_v the_o proper_a time_n to_o inquire_v what_o the_o convocation_n mean_v by_o a_o thorough_a settlement_n but_o he_o do_v not_o like_o this_o order_n and_o therefore_o choose_v to_o begin_v with_o the_o notion_n of_o thorough_a settlement_n for_o when_o once_o it_o have_v appear_v that_o the_o convocation_n speak_v of_o the_o settlement_n of_o illegal_a power_n he_o must_v have_v be_v ashamed_a to_o have_v pretend_v that_o they_o mean_v a_o legal_a settlement_n by_o acquire_v a_o new_a legal_a title_n either_o by_o the_o death_n or_o session_n of_o the_o right_a heir_n or_o by_o a_o long_a prescription_n i_o shall_v only_o add_v that_o when_o the_o convocation_n speak_v of_o a_o settlement_n they_o mean_v the_o settlement_n of_o the_o government_n within_o itself_o not_o with_o respect_n to_o foreign_a force_n and_o power_n for_o so_o they_o express_v it_o when_o they_o have_v establish_v any_o of_o the_o say_v degenerate_a form_n of_o government_n among_o their_o own_o people_n and_o then_o the_o government_n may_v be_v thorough_o settle_v within_o itself_o before_o it_o have_v a_o peaceable_a possession_n and_o settlement_n so_o alexander_n authority_n be_v settle_v at_o jerusalem_n before_o darius_n be_v final_o conquer_v and_o so_o be_v k._n william_n and_o q._n mary_n settle_v on_o the_o throne_n notwithstanding_o all_o the_o expectation_n some_o have_v of_o a_o french_a invasion_n and_o conquest_n and_o since_o our_o author_n insist_o so_o much_o upon_o a_o legal_a settlement_n possession_n of_o the_o throne_n with_o the_o consent_n and_o submission_n of_o the_o estate_n of_o the_o realm_n give_v a_o legal_a settlement_n in_o england_n if_o we_o will_v believe_v our_o best_a judge_n and_o lawyer_n as_o i_o shall_v be_v incline_v to_o do_v till_o i_o see_v a_o fair_a answer_n to_o what_o i_o have_v say_v in_o this_o cause_n in_o the_o case_n of_o allelegiance_n and_o then_o we_o have_v the_o opinion_n of_o our_o lawyer_n for_o a_o settlement_n and_o of_o the_o convocation_n for_o obedience_n to_o a_o settle_a government_n for_o the_o conclusion_n of_o his_o answer_n he_o allege_v the_o authority_n of_o bishop_n andrews_n and_o bishop_n buckeridge_n two_o member_n of_o this_o convocation_n 27._o and_o of_o dr._n jackson_n a_o very_a learned_a divine_a against_o that_o sense_n we_o give_v of_o the_o convocation_n the_o thing_n than_o he_o be_v to_o prove_v from_o these_o reverend_a and_o learned_a man_n against_o our_o sense_n of_o the_o convocation_n be_v this_o that_o those_o who_o ascend_v the_o throne_n by_o usurpation_n without_o a_o legal_a right_n have_v not_o god_n authority_n and_o must_v not_o be_v obey_v and_o that_o such_o prince_n can_v never_o in_o the_o sense_n of_o the_o convocation_n be_v settle_v in_o their_o throne_n or_o have_v god_n authority_n till_o they_o gain_v some_o new_a legal_a right_n by_o the_o death_n or_o session_n of_o the_o rightful_a prince_n or_o by_o a_o long_a prescription_n let_v we_o see_v then_o how_o he_o prove_v this_o to_o be_v the_o judgement_n of_o these_o learned_a men._n now_o what_o he_o quote_v from_o b._n andrews_n have_v not_o one_o word_n of_o this_o matter_n the_o whole_a of_o it_o be_v no_o more_o but_o this_o that_o the_o bishop_n will_v not_o allow_v the_o name_n of_o king_n to_o any_o but_o king_n of_o lawful_a and_o true_a descent_n they_o be_v king_n the_o they_o reign_v not_o as_o joash_n be_v other_o be_v no_o king_n but_o usurper_n though_o they_o reign_v as_o athaliah_n do_v and_o what_o be_v this_o to_o the_o purpose_n do_v not_o the_o convocation_n allow_v joash_n to_o be_v the_o true_a heir_n while_o he_o be_v keep_v from_o the_o crown_n and_o athaliah_n a_o usurper_n though_o she_o reign_v six_o year_n do_v not_o the_o convocation_n call_v such_o king_n king_n de_fw-fr facto_fw-la which_o be_v a_o little_o soft_a name_n than_o usurper_n but_o signify_v much_o the_o same_o thing_n viz._n one_o who_o be_v possess_v of_o the_o throne_n without_o a_o legal_a right_n and_o yet_o what_o the_o convocation_n doctrine_n be_v about_o obedience_n to_o such_o king_n i_o have_v already_o prove_v and_o bishop_n andrews_n may_v be_v of_o the_o same_o mind_n though_o he_o will_v not_o allow_v they_o the_o name_n of_o king_n but_o the_o bishop_n will_v not_o allow_v that_o such_o king_n reign_v by_o god_n right_o but_o then_o he_o do_v not_o mean_a that_o such_o king_n do_v not_o exercise_v god_n authority_n but_o that_o god_n do_v not_o by_o his_o antecedent_n will_n and_o appointment_n place_v they_o on_o the_o throne_n thus_o s._n chrysostom_n on_o the_o 13._o rom._n allow_v all_o power_n and_o authority_n to_o be_v of_o god_n and_o to_o be_v ordain_v by_o god_n and_o therefore_o not_o to_o be_v resist_v whoever_o have_v it_o but_o yet_o will_v not_o say_v that_o all_o prince_n who_o exercise_n this_o power_n wicked_o and_o tyrannical_o whatever_o their_o title_n be_v be_v ordain_v of_o god_n he_o think_v it_o a_o reproach_n and_o blemish_v to_o the_o goodness_n and_o justice_n of_o providence_n to_o say_v that_o wicked_a impious_a tyrannical_a prince_n be_v ordain_v by_o god_n but_o yet_o grant_v that_o the_o authority_n they_o exercise_v be_v god_n and_o must_v be_v obey_v the_o bishop_n and_o other_o will_v allow_v what_o s._n chrysostom_n will_v not_o that_o the_o most_o wicked_a tyrant_n who_o have_v a_o legal_a title_n to_o their_o throne_n be_v ordain_v by_o god_n but_o be_v afraid_a to_o own_o that_o prince_n who_o ascend_v their_o throne_n by_o unjust_a and_o wicked_a mean_n be_v set_v up_o by_o god_n but_o it_o do_v not_o hence_o follow_v that_o they_o deny_v their_o power_n and_o authority_n to_o be_v god_n or_o that_o subject_n ought_v to_o obey_v it_o the_o convocation_n itself_o affirm_v no_o more_o in_o that_o mighty_a place_n as_o our_o author_n call_v it_o than_o that_o the_o authority_n which_o be_v exercise_v in_o those_o government_n which_o begin_v by_o the_o ambition_n of_o prince_n or_o the_o rebellion_n of_o subject_n be_v always_o god_n authority_n and_o therefore_o can_v receive_v no_o impeachment_n by_o the_o wickedness_n of_o those_o who_o have_v it_o and_o therefore_o must_v be_v obey_v so_o that_o learned_a man_n may_v differ_v in_o this_o point_n whether_o illegal_a usurper_n be_v place_v on_o the_o throne_n by_o the_o overrule_a counsel_n and_o appointment_n of_o god_n or_o only_o by_o his_o permissive_a providence_n
