of_o such_o as_o be_v find_v to_o be_v common_a drunkard_n in_o this_o government_n shall_v be_v set_v up_o in_o some_o public_a place_n in_o the_o town_n and_o they_o shall_v be_v account_v such_o when_o they_o have_v be_v convict_v four_o time_n for_o the_o same_o and_o after_o they_o have_v be_v so_o public_o declare_v whosoever_o ordinary_a keeper_n or_o other_o shall_v sell_v give_v or_o lend_v direct_o or_o indirect_o any_o strong_a liquor_n drink_n &_o of_o such_o as_o furnish_v they_o with_o drink_n wine_n ale_z cider_n or_o strong_a beer_n unto_o any_o such_o person_n or_o and_o prejudice_v the_o peaceable_a inhabitant_n of_o the_o several_a town_n for_o prevention_n whereof_o nightwalker_n of_o nightwalker_n it_o be_v order_v by_o this_o court_n and_o the_o authority_n thereof_o that_o all_o person_n walk_v in_o the_o field_n or_o street_n after_o nine_o or_o ten_o a_o clock_n at_o night_n unless_o know_v peaceable_a and_o orderly_a inhabitant_n shall_v be_v three_o part_n of_o all_o such_o house_n and_o land_n as_o her_o husband_n be_v at_o any_o time_n seize_v of_o during_o the_o coverture_n other_o than_o what_o land_n she_o free_o resign_v up_o her_o interest_n in_o etc._n to_o be_v setout_a to_o they_o by_o met_n and_o bound_n but_o shall_v not_o make_v strip_v or_o waste_v etc._n etc._n and_o acknowledge_v the_o same_o before_o a_o magistrate_n such_o delinquent_n shall_v be_v return_v by_o any_o of_o the_o surveior_n all_o allow_a inhabitant_n and_o person_n rateable_a to_o be_v warn_v and_o such_o householder_n that_o have_v not_o team_n and_o several_a in_o their_o family_n capable_a to_o work_v though_o not_o rateable_a highway_n how_o to_o work_v at_o highway_n such_o by_o approbation_n of_o the_o selectmen_n may_v be_v warn_v to_o send_v two_o ordered_n that_o the_o surveior_n if_o he_o see_v cause_n shall_v hire_v either_o man_n or_o team_n as_o occasion_n require_v for_o the_o say_a work_n and_o to_o be_v pay_v out_o of_o the_o fine_n aforesaid_a and_o that_o the_o surveior_n warn_v not_o any_o man_n or_o team_n twice_o to_o work_v on_o the_o highway_n before_o they_o have_v first_o go_v over_o all_o the_o person_n and_o team_n in_o the_o town_n once_o none_o to_o be_v warn_v to_o work_v twice_o till_o all_o have_v go_v over_o once_o as_o aforesaid_a and_o that_o each_o surveior_n give_v a_o account_n thereof_o to_o the_o surveior_n which_o shall_v succeed_v he_o for_o the_o next_o year_n who_o shall_v begin_v to_o warn_v where_o the_o other_o leave_v off_o neglect_n penalty_n of_o surveyor_n neglect_n 5._o ordered_n that_o every_o surveior_n that_o neglect_v his_o duty_n in_o repair_v the_o highway_n shall_v forfeit_v five_o pound_n to_o the_o county_n use_v work_v those_o warn_v when_o to_o appear_v and_o what_o time_n to_o work_v 6._o ordered_n that_o those_o warn_v to_o work_v on_o the_o highway_n as_o aforesaid_a shall_v appear_v at_o the_o place_n appoint_v according_a to_o the_o surveiors_n order_n with_o their_o cart_n and_o themselves_o fit_v with_o tool_n and_o instrument_n suitable_a to_o the_o work_n by_o the_o hour_n of_o nine_o in_o the_o morning_n and_o work_v till_o four_o at_o evening_n allow_v the_o space_n of_o one_o hour_n at_o noon_n for_o refreshment_n man_n surveior_n to_o give_v a_o account_n to_o the_o select_a man_n 7._o ordered_n that_o the_o surveior_n do_v at_o the_o end_n of_o their_o year_n give_v a_o account_n of_o their_o act_n and_o what_o money_n of_o the_o town_n may_v be_v in_o their_o hand_n unto_o the_o selectmen_n of_o the_o respective_a town_n or_o such_o other_o as_o the_o town_n shall_v appoint_v for_o that_o affair_n or_o be_v liable_a to_o a_o suit_n to_o be_v prosecute_v against_o they_o by_o the_o selectmen_n on_o the_o town_n account_v 8._o the_o court_n take_v into_o consideration_n the_o inconvenience_n likely_a to_o ensure_v jury_n country-high_a way_n to_o be_v lay_v out_o by_o a_o jury_n by_o person_n erect_v fence_n gate_n or_o bar_n athwart_o county_n highway_n to_o the_o annoyance_n of_o traveller_n do_v therefore_o enact_v and_o be_v it_o hereby_o enact_v that_o all_o necessary_a county_n highway_n within_o this_o colony_n shall_v between_o this_o time_n and_o the_o next_o october_n court_n be_v lay_v out_o by_o a_o jury_n where_o it_o be_v not_o already_o so_o do_v penalty_n and_o a_o account_n shall_v procure_v or_o abett_v he_o therein_o 2._o and_o that_o no_o indian_a shall_v resort_v to_o any_o english_a house_n on_o the_o lord_n day_n especial_o when_o any_o of_o the_o people_n thereof_o be_v go_v to_o meet_v sabbath_n not_o to_o resort_v to_o english_a house_n â—n_v lord_n day_n nor_o to_o profane_v the_o sabbath_n unless_o upon_o extraordinary_a occasion_n under_o the_o penalty_n of_o ten_o shilling_n or_o corporal_a punishmerit_n by_o whip_v as_o the_o matter_n may_v be_v circumstance_v and_o that_o no_o indian_a under_o the_o like_a penalty_n profane_v the_o lord_n day_n by_o hunt_v fish_v fowl_a travel_v with_o burden_n or_o do_v any_o servile_a work_n thereon_o 3._o and_o forasmuch_o at_o sundry_a burglary_n theft_n and_o other_o mischief_n and_o injury_n have_v be_v by_o sundry_a indian_n in_o the_o night_n for_o prevention_n whereof_o walker_n nor_o to_o be_v night_n walker_n it_o be_v order_v by_o this_o court_n etc._n etc._n that_o no_o indian_a or_o indian_n shall_v walk_v about_o in_o the_o night_n without_o necessary_a occasion_n especial_o at_o unseasonable_a time_n thereof_o under_o the_o pain_n of_o be_v convict_v thereby_o at_o least_o shall_v claim_v any_o swine_n in_o custody_n of_o the_o indian_n but_o by_o their_o ear-mark_a indian_n government_n of_o the_o indian_n 5._o for_o the_o better_a government_n of_o the_o indian_n and_o to_o help_v they_o forward_o in_o civility_n and_o christianity_n it_o be_v further_a order_v that_o some_o one_o of_o the_o magistrate_n be_v appoint_v from_o time_n to_o time_n to_o have_v the_o general_n oversight_n and_o inspection_n of_o the_o whole_a affair_n of_o their_o government_n they_o take_v care_n of_o the_o preach_v the_o gospel_n to_o they_o as_o by_o law_n be_v or_o shall_v be_v order_v concern_v they_o &_o more_o particular_o to_o take_v care_n of_o the_o preach_a of_o the_o gospel_n among_o they_o and_o of_o the_o admission_n and_o approve_v of_o such_o of_o the_o indian_n to_o preach_v unto_o they_o in_o the_o several_a place_n or_o plantation_n where_o they_o reside_v as_o he_o shall_v judge_v most_o blameless_a able_a and_o fit_a for_o that_o service_n to_o the_o best_a satisfaction_n of_o the_o indian_n especial_o of_o the_o most_o sober_a and_o discreet_a among_o they_o preacher_n and_o of_o the_o admission_n of_o indian_n preacher_n and_o to_o take_v care_n to_o obtain_v relieve_v and_o distribute_v among_o they_o in_o such_o manner_n as_o he_o shall_v see_v meet_v such_o contribution_n or_o part_n of_o the_o indian_n stock_n send_v from_o constitute_v court_n civil_a ruler_n &_o other_o officer_n to_o punish_v misdemeanour_n &c_n &c_n by_o the_o gentleman_n be_v trust_v with_o the_o management_n of_o that_o affair_n by_o the_o honourable_a corporation_n for_o the_o propagation_n of_o the_o gospel_n in_o new-england_n and_o it_o be_v further_o empower_v with_o the_o concurrence_n of_o the_o chief_a or_o principal_n indian_n provide_v for_o the_o english_a and_o it_o be_v further_o order_v that_o in_o the_o absence_n of_o such_o magistrate_n any_o other_o magistrate_n and_o in_o such_o place_n or_o town_n where_o there_o be_v no_o magistrate_n there_o the_o select-man_n or_o such_o other_o as_o man_n be_v appoint_v thereunto_o in_o the_o place_n and_o town_n where_o the_o indian_n dwell_v shall_v have_v the_o inspection_n of_o indian_n and_o cause_v they_o to_o observe_v the_o order_n aforesaid_a or_o such_o other_o order_n as_o by_o they_o with_o the_o consent_n of_o the_o chief_a indian_n as_o aforesaid_a shall_v be_v make_v or_o by_o the_o court_n order_n and_o direction_n and_o to_o punish_v the_o offender_n they_o have_v their_o liberty_n of_o appeal_n as_o aforesaid_a and_o it_o be_v order_v that_o our_o capital_a law_n and_o the_o law_n make_v against_o drunkenness_n burglary_n and_o steal_v shall_v be_v execute_v on_o the_o indian_n as_o on_o the_o english_a improve_v fine_n on_o indian_n how_o to_o be_v improve_v and_o it_o be_v further_o order_v that_o all_o fine_n as_o arise_v by_o reason_n of_o any_o misdemeanour_n or_o transgression_n of_o the_o indian_n shall_v be_v improve_v by_o such_o magistrate_n or_o other_o inspector_n where_o it_o shall_v fall_v to_o defray_v the_o charge_n of_o the_o govern_n or_o inspect_v of_o they_o licence_n no_o arm_n to_o be_v sell_v to_o the_o indian_n without_o licence_n 6._o it_o be_v order_v by_o this_o court_n that_o whosoever_o shall_v sell_v or_o give_v direct_o or_o indirect_o any_o arm_n as_o gun_n sword_n pistol_n etc._n etc._n unto_o any_o indian_n without_o licence_n first_o obtain_v from_o the_o general_n court_n shall_v forfeit_v five_o time_n the_o value_n thereof_o and_o whosoever_o shall_v lend_v any_o gun_n to_o a_o indian_a or_o sell_v any_o powder_n shoot_v or_o lead_n to_o they_o sell_v nor_o lend_v nor_o ammunition_n sell_v shall_v forfeit_v twice_o the_o value_n thereof_o if_o such_o person_n have_v not_o first_o obtain_v licence_n of_o some_o one_o of_o the_o magistrate_n who_o be_v hereby_o impower_v to_o give_v licence_n to_o any_o english_a to_o lend_v a_o gun_n for_o a_o month_n or_o two_o in_o a_o year_n and_o to_o sell_v some_o small_a quantity_n of_o powder_n and_o shot_n not_o exceed_v half_o a_o pound_n of_o powder_n and_o proportionable_a shot_n at_o one_o time_n to_o such_o of_o our_o friendly_a indian_n as_o he_o shall_v give_v a_o certificate_n under_o his_o hand_n licence_n nor_o in_o case_n have_v or_o carry_v arm_n without_o licence_n 7._o it_o be_v also_o order_v
that_o whatsoever_o indian_n who_o have_v or_o shall_v have_v gun_n or_o other_o arm_n that_o have_v or_o shall_v manifest_o appear_v to_o be_v unfaithful_a and_o treacherous_a to_o we_o shall_v forfeit_v their_o arm_n and_o not_o suffer_v to_o have_v or_o carry_v any_o arm_n until_o they_o shall_v have_v licence_n from_o the_o county_n court_n etc._n none_o to_o sell_v hire_n or_o give_v to_o any_o indian_a any_o boat_n etc._n etc._n 8._o it_o be_v also_o order_v that_o whosoever_o shall_v any_o way_n sell_v hire_n or_o give_v to_o any_o indian_a or_o indian_n any_o kind_n of_o boat_n bark_n or_o other_o vessel_n of_o burden_n or_o sail_n or_o tackle_n to_o fit_v up_o any_o such_o like_a vessel_n shall_v forfeit_v twice_o the_o value_n of_o it_o 9_o it_o be_v also_o order_v by_o this_o court_n and_o the_o authority_n thereof_o that_o no_o person_n whither_o inhabitant_n of_o this_o government_n or_o other_o shall_v purchase_v 1643_o anno._n 1643_o hire_v or_o receive_v of_o that_o equal_a justice_n may_v be_v do_v in_o such_o controversy_n as_o may_v arise_v between_o the_o english_a and_o the_o indian_n the_o indian_n not_o hither_o have_v be_v admit_v to_o give_v testimony_n upon_o their_o oath_n will_v be_v great_o disadvantage_v and_o may_v be_v much_o wrong_v if_o no_o testimony_n shall_v in_o such_o case_n be_v accept_v but_o on_o oath_n this_o court_n into_o many_o people_n debt_n where_o they_o can_v be_v trust_v and_o there_o pawn_v or_o sell_v the_o thing_n they_o be_v trust_v for_o at_o a_o most_o inconsiderable_a price_n for_o money_n to_o get_v liquor_n whereby_o themselves_o &_o family_n be_v without_o any_o benefit_n thereby_o and_o the_o english_a frustrate_v of_o their_o pay_n for_o the_o same_o it_o be_v therefore_o order_v that_o no_o english_a person_n shall_v trust_v any_o indian_a before_o hand_n for_o any_o thing_n or_o thing_n at_o any_o one_o time_n which_o exceed_v the_o value_n of_o twenty_o four_o shilling_n or_o at_o any_o time_n after_o for_o any_o such_o or_o lesser_a sum_n until_o say_v indian_a have_v first_o pay_v for_o that_o he_o first_o have_v on_o trust_n on_o penalty_n of_o such_o english_a be_v debar_v his_o approbation_n 15._o it_o be_v also_o order_v that_o if_o any_o indian_a who_o be_v a_o servant_n to_o the_o english_a shall_v run_v away_o among_o any_o indian_n such_o indian_n to_o who_o such_o servant_n shall_v come_v shall_v not_o entertain_v such_o servant_n on_o penalty_n of_o ten_o shilling_n but_o forthwith_o either_o carry_v such_o servant_n himself_o or_o charge_v the_o drunkenness_n if_o they_o can_v obtain_v it_o and_o through_o the_o covetous_a evil_a principle_n of_o some_o english_a in_o help_v they_o unto_o it_o not_o regard_v the_o guilt_n they_o thereby_o contract_v to_o themselves_o of_o the_o murder_n out_o rage_v and_o other_o mischief_n which_o have_v be_v the_o frequient_a horrid_a effect_n thereof_o to_o the_o great_a dishonour_n of_o god_n for_o magistrate_n or_o one_o of_o the_o select-man_n of_o the_o town_n and_o it_o shall_v be_v lawful_a for_o the_o constable_n or_o any_o other_o person_n to_o stop_v and_o bring_v before_o authority_n any_o person_n suspect_v for_o the_o breach_n of_o this_o law_n and_o if_o any_o person_n have_v obtain_v a_o licence_n to_o travail_n by_o a_o false_a pretence_n he_o shall_v any_o time_n in_o a_o twelve_o month_n be_v liable_a to_o be_v apprehend_v and_o punish_v for_o his_o breach_n of_o sabbath_n and_o ten_o shilling_n beside_o as_o a_o fine_a to_o the_o town_n ordered_n that_o in_o town_n
