who_o be_v so_o assemble_v be_v require_v to_o choose_v one_o of_o their_o freeholders_n to_z be_v a_o commissioner_n for_o say_a town_n which_o commissioner_n together_o with_o the_o select-man_n within_o the_o month_n of_o august_n follow_v shall_v make_v a_o true_a list_n of_o all_o the_o male_a person_n in_o the_o say_a town_n from_o sixteen_o year_n old_a and_o upward_o and_o a_o true_a the_o council_n settle_a minister_n and_o grammar_n schoolmaster_n and_o other_o devote_v to_o the_o ministry_n and_o student_n or_o the_o college_n and_o all_o house_n land_n stock_n good_n and_o commissioner_n of_o the_o several_a town_n shall_v meet_v together_o to_o peruse_v examine_v correct_v and_o perfect_a the_o say_a list_n which_o list_n so_o examine_v perfect_v and_o sign_v by_o the_o major_a part_n of_o the_o say_a commissioner_n so_o meet_v shall_v by_o one_o of_o the_o say_a commissioner_n who_o the_o rest_n shall_v appoint_v thereto_o be_v forthwith_o transmit_v unto_o the_o treasurer_n with_o upon_o the_o recipe_n thereof_o shall_v issue_v forth_o his_o warrant_n to_o the_o constable_n of_o the_o respective_a town_n to_o collect_v the_o sum_n total_a of_o each_o list_n upon_o the_o inhabitant_n of_o such_o town_n according_a to_o their_o respective_a proportion_n and_o in_o case_n any_o person_n or_o person_n shall_v neglect_v or_o refuse_v to_o make_v return_v the_o overplus_a if_o any_o be_v and_o the_o constable_n be_v to_o pay_v in_o unto_o the_o treasurer_n the_o one_o half_a of_o the_o say_a tax_n at_o or_o before_o the_o twenty_o five_o of_o december_n next_o and_o the_o other_o half_n at_o or_o before_o the_o first_o day_n of_o may_n follow_v and_o make_v up_o their_o account_n with_o the_o say_a preasurer_n by_o the_o first_o of_o june_n next_o on_o pain_n of_o forfeit_v ten_o pound_n in_o money_n unto_o their_o majesty_n for_o the_o support_n of_o the_o government_n as_o also_o to_o pay_v all_o arrear_n of_o say_a assessment_n the_o say_a ten_o pound_v forfeiture_n and_o arrear_n to_o be_v sue_v for_o and_o recover_v by_o the_o treasurer_n in_o the_o inferior_a court_n of_o plea_n in_o the_o county_n where_o such_o constable_n live_v by_o bill_n plaint_n action_n or_o information_n provide_v also_o that_o where_o person_n who_o be_v not_o settle_a inhabitant_n and_o their_o estate_n be_v rate_v yet_o be_v and_o after_o the_o twenty_o nine_o day_n of_o this_o instant_a june_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o ninety_o and_o two_o there_o shall_v be_v pay_v by_o the_o importer_n for_o all_o wine_n or_o liquor_n and_o good_n hereafter_o specify_v that_o shall_v be_v import_v into_o this_o province_n the_o rate_n hereafter_o mention_v that_o be_v to_o say_v for_o every_o pipe_n of_o common_a fyall_n wine_n the_o sum_n of_o one_o pound_n every_o pipe_n of_o passada_fw-es wine_n one_o pound_n fifteen_o shilling_n every_o pipe_n of_o madera_n wine_n one_o pound_n ten_o shilling_n every_o pipe_n of_o canary_n mallage_n &_o sherry_n wine_n two_o pound_n every_o pipe_n of_o port_n wine_n one_o pound_n five_o shilling_n and_o so_o proportionable_o for_o great_a or_o lesser_a quantity_n and_o for_o every_o galen_n of_o rum_o or_o other_o spirit_n import_v as_o aforesaid_a six_o penny_n all_o which_o impost_n as_o aforesaid_a shall_v be_v pay_v in_o currant_n money_n of_o this_o province_n the_o one_o half_a at_o or_o before_o the_o land_n thereof_o the_o other_o half_o to_o be_v allow_v three_o month_n for_o payment_n provide_v there_o be_v bond_n and_o security_n give_v to_o the_o commissioner_n appoint_v by_o this_o act_n or_o such_o as_o they_o shall_v appoint_v for_o the_o payment_n thereof_o at_o time_n as_o aforesaid_a and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o merchant_n or_o other_o person_n
import_v any_o wine_n or_o other_o liquor_n into_o this_o province_n shall_v be_v allow_v twelve_o per_fw-la cent_z for_o leakage_n provide_v say_v wine_n have_v not_o be_v fill_v up_o aboard_o and_o that_o every_o hogshead_n of_o wine_n or_o other_o liquor_n that_o shall_v not_o have_v full_a seven_o inch_n leave_v therein_o and_o every_o butt_n or_o pipe_n of_o wine_n or_o other_o liquor_n that_o have_v not_o nine_o inch_n leave_v therein_o shall_v be_v accomr_v for_o out_o his_o and_o the_o merchant_n or_o importer_n to_o pay_v no_o impost_n or_o duty_n for_o the_o same_o and_o it_o be_v hereby_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o all_o or_o any_o wine_n or_o liquor_n as_o aforesaid_a be_v land_a and_o afterward_o be_v export_v out_o of_o the_o province_n within_o nine_o month_n after_o importation_n thereof_o there_o shall_v be_v repay_v or_o discount_v by_o say_a commissioner_n or_o their_o order_n unto_o the_o importer_n or_o their_o assign_v two_o three_o part_n of_o what_o they_o pay_v or_o secure_v to_o be_v pay_v for_o so_o much_o as_o they_o export_v he_o or_o they_o make_v oath_n that_o it_o be_v the_o same_o wine_n or_o liquor_n for_o which_o the_o whole_a duty_n have_v be_v due_o pay_v or_o secure_v to_o be_v pay_v and_o that_o it_o be_v export_v within_o the_o time_n limit_v as_o aforesaid_a by_o this_o act._n and_o it_o be_v also_o enact_v by_o the_o authority_n aforesaid_a that_o for_o all_o good_n ware_n and_o merchandize_n that_o shall_v be_v import_v to_o any_o part_n of_o this_o province_n after_o the_o twenty_o nine_o day_n of_o this_o instant_a june_n sale_n cotton-wool_n provision_n and_o every_o other_o thing_n of_o the_o growth_n and_o product_n of_o new-england_n only_o except_v there_o shall_v be_v pay_v by_o the_o importer_n the_o several_a impost_n and_o duty_n follow_v that_o be_v to_o say_v for_o every_o hundred_o pound_v sterling_n in_o english_a merchandize_n at_o the_o prime_a cost_n in_o england_n the_o invoice_n thereof_o to_o be_v produce_v and_o show_v the_o sum_n of_o ten_o shilling_n for_o every_o hogshead_n of_o sugar_n one_o shilling_n for_o every_o hogshead_n of_o molass_n sixpence_n for_o every_o hogshead_n of_o tobacco_n sixpence_n for_o every_o tun_n of_o loggwood_n one_o shilling_n and_o for_o all_o other_o commodity_n good_n ware_n and_o merchandize_n except_o as_o before_o except_v one_o penny_n for_o every_o twenty_o shilling_n value_v here_o all_o entry_n where_o the_o impost_n or_o duty_n to_o be_v pay_v do_v not_o exceed_v four_o shilling_n to_o be_v make_v without_o charge_n to_o the_o importer_n and_o not_o more_o than_o sixpence_n to_o be_v pay_v for_o any_o other_o single_a entry_n to_o what_o value_n soever_o and_o the_o better_a to_o prevent_v fraud_n it_o be_v further_a enact_v by_o the_o authority_n aforesaid_a that_o all_o merchant_n factor_n or_o other_o person_n or_o person_n importer_n be_v owner_n of_o or_o have_v any_o of_o the_o wine_n liquor_n good_n ware_n and_o merchandize_v consign_v to_o they_o that_o by_o this_o act_n be_v liable_a to_o pay_v impost_n or_o duty_n such_o person_n or_o person_n shall_v by_o themselves_o or_o order_z cause_v the_o same_o to_o be_v enter_v with_o say_a commissioner_n or_o such_o as_o they_o shall_v appoint_v and_o pay_v their_o duty_n or_o secure_v the_o same_o to_o be_v pay_v as_o by_o this_o act_n be_v provide_v before_o such_o wine_n liquor_n good_n or_o merchandise_n be_v land_a or_o put_v into_o any_o boat_n or_o vessel_n in_o order_n to_o be_v land_a on_o the_o forfeiture_n of_o such_o wine_n liquor_n good_n ware_n and_o merchandise_n so_o land_a or_o put_v into_o any_o boat_n or_o vessel_n in_o order_n to_o be_v land_a one_o three_o part_n to_o their_o majesty_n one_o three_o part_n to_o the_o governor_n one_o three_o part_n to_o the_o informer_n that_o shall_v sue_v for_o the_o same_o by_o bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n within_o this_o province_n any_o thing_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a notwithstanding_o and_o all_o manner_n of_o person_n be_v hereby_o require_v to_o be_v aid_v and_o assist_v the_o say_a commissioner_n their_o agent_n the_o informer_n discoverer_n or_o seizor_n of_o such_o wine_n liquor_n or_o good_n so_o land_a or_o unload_v contrary_a to_o the_o true_a intent_n and_o mean_v of_o this_o act._n and_o it_o be_v further_o enact_v that_o it_o shall_v and_o may_v be_v lawful_a for_o such_o as_o be_v empower_v or_o improve_v by_o the_o commissioner_n or_o for_o the_o informer_n or_o discoverer_n by_o warrant_n from_o the_o lieutenant_n governor_n or_o any_o justice_n of_o the_o peace_n within_o this_o province_n to_o that_o purpose_n first_o obtain_v with_o one_o constable_n or_o more_o to_o search_v according_a to_o law_n all_o manner_n of_o house_n cellar_n &_o warehouse_n for_o such_o wine_n &_o liquor_n as_o they_o or_o any_o of_o they_o shall_v be_v inform_v be_v carry_v there_o to_o be_v conceal_v in_o prejudice_n to_o the_o true_a meaning_n of_o this_o act_n and_o with_o intent_n to_o defraud_v their_o majesty_n of_o their_o say_a duty_n and_o such_o wine_n and_o liquor_n so_o find_v shall_v be_v forfeit_v and_o condemn_v in_o manner_n and_o form_n before_o mention_v always_o provide_v that_o such_o search_v be_v make_v in_o the_o day_n time_n and_o within_o the_o space_n of_o one_o month_n after_o the_o offence_n suppose_v to_o be_v commit_v provide_v also_o that_o if_o the_o information_n whereupon_o any_o house_n shall_v come_v to_o be_v search_v shall_v prove_v to_o be_v false_a that_o then_o and_o in_o such_o case_n the_o party_n injure_v shall_v recover_v his_o full_a damage_n and_o cost_v against_o the_o informer_n by_o action_n of_o trespass_n to_o be_v therefore_o bring_v against_o such_o informer_n and_o it_o be_v further_o enact_v and_o ordain_v by_o the_o authority_n those_o that_o shall_v retail_n the_o same_o in_o manner_n and_o form_n as_o be_v herereafter_o express_v and_o declare_v that_o be_v to_o say_v for_o every_o gallon_n of_o common_a fyal-wine_n the_o sum_n of_o sixpence_n every_o gallon_n of_o passado_n malago_n canary_n and_o sherry_n the_o sum_n of_o twelvepence_n every_o gallon_n of_o madera_n the_o sum_n of_o eightpence_n every_o gallon_n of_o rhum_n and_o all_o other_o sort_n of_o distil_v spirit_n the_o sum_n of_o one_o shilling_n every_o barril_n of_o perry_n beer_n ale_n and_o cider_n the_o sum_n of_o one_o shilling_n and_o sixpence_n and_o every_o gallon_n of_o metheglin_n the_o sum_n of_o fourpence_n all_o currant_n money_n of_o this_o province_n and_o after_o that_o rate_n for_o any_o great_a or_o lesser_a quantity_n and_o for_o the_o due_a and_o orderly_o collect_v and_o receive_v of_o the_o excise_n aforesaid_a it_o be_v hereby_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o all_o retailer_n of_o wine_n brandy_n rhum_n and_o other_o distil_v liquor_n perry_n beer_n ale_n cider_n and_o metheglin_n within_o this_o province_n have_v any_o of_o the_o say_a liquor_n in_o their_o respective_a house_n or_o elsewhere_o belong_v unto_o they_o at_o the_o time_n of_o the_o publish_v of_o this_o act_n shall_v make_v due_a entry_n and_o pay_v the_o duty_n and_o excise_n aforesaid_a for_o the_o same_o as_o be_v herein_o beforementioned_a and_o upon_o their_o further_a receipt_n or_o purchase_n of_o all_o or_o any_o of_o the_o liquor_n beforementioned_a shall_v within_o twenty_o four_o hour_n after_o the_o receipt_n or_o purchase_n thereof_o make_v entry_n with_o the_o say_a commissioner_n or_o such_o person_n or_o person_n that_o shall_v be_v appoint_v to_o receive_v and_o collect_v the_o same_o and_o pay_v the_o duty_n and_o excise_n aforesaid_a under_o the_o penalty_n of_o forfeiture_n of_o all_o such_o liquor_n as_o shall_v be_v find_v in_o any_o retailers_n house_n not_o be_v due_o enter_v and_o the_o excise_n pay_v as_o aforesaid_a and_o every_o retailer_n who_o shall_v make_v his_o own_o cider_n and_o metheglin_n brew_n his_o own_o beer_n or_o ale_n or_o distil_v strong_a liquor_n shall_v from_o time_n to_o time_n and_o at_o all_o time_n when_o he_o or_o they_o shall_v make_v brew_v or_o distil_v the_o same_o make_v entry_n with_o say_a commissioner_n or_o such_o other_o person_n or_o person_n as_o for_o that_o purpose_n shall_v be_v appoint_v of_o all_o such_o cider_n metheglin_n ale_n beer_n or_o distil_v liquor_n by_o they_o

officer_n as_o by_o the_o commissioner_n shall_v be_v appoint_v and_o empower_v when_o and_o so_o often_o as_o he_o or_o they_o shall_v think_v fit_a in_o the_o day_n time_n to_o enter_v into_o any_o retailers_n house_n cellar_n or_o warehouse_n to_o search_v for_o such_o wine_n or_o liquor_n etc._n etc._n as_o be_v not_o due_o enter_v nor_o the_o excise_n pay_v for_o the_o same_o and_o such_o wine_n or_o liquor_n etc._n etc._n so_o find_v to_o seize_v and_o secure_v in_o order_n to_o the_o trial_n &_o conviction_n thereof_o &_o to_o gage_v any_o cask_n or_o cask_n for_o that_o end_n &_o harbour_n entertain_v keep_v or_o conceal_v in_o his_o or_o their_o dwelling-house_n cellar_n or_o warehouse_n any_o quantity_n or_o parcel_n of_o wine_n or_o other_o liquor_n belong_v to_o any_o may_n in_o the_o year_n one_o thousand_o six_o hundred_o eighty_o and_o nine_o and_o in_o many_o place_n remain_v uncollected_a and_o unpaid_a in_o whole_a or_o in_o part_n be_v it_o therefore_o order_v and_o enact_v by_o his_o excellency_n the_o governor_n council_n and_o representative_n in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o it_o be_v enact_v that_o all_o such_o constable_n and_o collector_n be_v authorize_v and_o require_v and_o be_v hereby_o authorize_v and_o require_v to_o collect_v all_o such_o rate_n or_o assessment_n so_o commit_v to_o he_o or_o they_o that_o remain_v yet_o uncollected_a and_o to_o pay_v the_o same_o unto_o the_o county_n treasurer_n in_o each_o county_n respective_o or_o select_a man_n in_o be_v in_o each_o town_n respective_o where_o they_o be_v make_v and_o to_o be_v improve_v to_o the_o use_n or_o use_n for_o the_o which_o they_o be_v grant_v and_o to_o finish_v their_o account_n with_o they_o at_z or_o before_o the_o ten_o day_n of_o december_n next_o ensue_v on_o penalty_n of_o forty_o shilling_n per_fw-la month_n for_o every_o month_n default_n after_o the_o say_v ten_o day_n of_o december_n to_o be_v recover_v by_o the_o county_n treasurer_n or_o select_a man_n respective_o of_o any_o such_o defective_a constable_n or_o collector_n at_o any_o court_n of_o plea_n in_o the_o same_o county_n and_o where_o any_o constable_n or_o collector_n be_v dead_a or_o remove_v and_o the_o assessment_n commit_v to_o they_o remain_z uncollected_a or_o any_o part_n thereof_o the_o select_a man_n be_v empower_v &_o require_v to_o depute_v meet_a person_n to_o collect_v the_o same_o and_o the_o person_n so_o depute_v be_v require_v to_o collect_v what_o so_o remain_v and_o to_o pay_v the_o same_o according_o and_o it_o be_v further_o order_v that_o in_o any_o county_n town_n or_o town_n where_o such_o tax_n or_o tax_n have_v be_v agree_v on_o since_o the_o say_v first_o day_n of_o may_n and_o not_o assess_v upon_o the_o inhabitant_n the_o select_a man_n of_o the_o several_a town_n be_v hereby_o require_v forthwith_o to_o make_v such_o rate_n or_o assessment_n and_o commit_v they_o with_o warrant_n to_o their_o constable_n on_o the_o like_a penalty_n of_o forty_o shilling_n money_n for_o every_o month_n
