breach_n or_o non-performance_n of_o what_o be_v or_o be_v on_o their_o part_n to_o be_v perform_v since_o their_o article_n be_v grant_v now_o the_o parliament_n have_v declare_v if_o not_o adjudge_v sir_n john_n stawell_n not_o to_o be_v admit_v to_o compound_v have_v adjudge_v or_o declare_v that_o sir_n john_n have_v forfeit_v his_o article_n either_o by_o breach_n or_o non-performance_n faith_n of_o the_o army_n and_o honour_n and_o justice_n of_o the_o nation_n be_v so_o high_o concern_v but_o it_o shall_v and_o aught_o to_o be_v presume_v that_o sir_n john_n by_o some_o or_o all_o of_o the_o misdemeanour_n and_o neglect_v aforesaid_a or_o by_o other_o act_n of_o his_o best_a know_v to_o that_o parliament_n have_v in_o the_o judgement_n thereof_o forfeit_v and_o lose_v the_o benefit_n of_o his_o article_n sir_n john_n by_o way_n of_o objection_n remonstrance_n p._n 74._o recite_v a_o clause_n in_o that_o act_n of_o sale_n in_o these_o word_n viz._n nevertheless_o upon_o trust_n and_o confidence_n that_o the_o say_v william_n skinner_n and_o other_o the_o person_n abovenamed_a or_o any_o five_o or_o more_o of_o they_o shall_v have_v hold_v and_o enjoy_v all_o and_o sollicitor-generall_n of_o high_a treason_n for_o prosecute_a against_o he_o in_o the_o name_n of_o the_o parliament_n as_o be_v by_o several_a witness_n prove_v before_o the_o high_a court_n of_o justice_n and_o as_o mr._n john_n ash_n affirm_v utter_v word_n to_o this_o effect_n viz._n my_o offence_n be_v not_o treason_n for_o which_o i_o be_o here_o arraign_v but_o because_o i_o will_v not_o ship_n have_v renegade_v the_o parliament-service_n and_o in_o one_o of_o the_o high_a judicature_n whither_o multitude_n resort_v to_o observe_v his_o deportment_n become_v not_o a_o compounder_n much_o aggravate_v his_o former_a offence_n must_v prove_v prejudicial_a to_o the_o parliament_n affair_n and_o contrary_a to_o the_o 21_o of_o exeter_n article_n and_o to_o sir_n johns_n engagement_n of_o a_o inferior_a or_o ordinary_a judicature_n yet_o may_v the_o parliament_n adjudge_v they_o so_o which_o they_o have_v do_v for_o in_o their_o act_n of_o sale_n they_o have_v mention_v treason_n commit_v by_o he_o which_o must_v be_v his_o miscarriage_n since_o his_o article_n for_o his_o former_a be_v pardon_v and_o although_o it_o be_v grant_v they_o do_v not_o amount_v unto_o treason_n yet_o they_o may_v be_v a_o breach_n of_o article_n for_o it_o be_v not_o treason_n only_o that_o do_v break_v they_o inferior_a offence_n may_v prove_v a_o breach_n the_o breach_n of_o good_a behaviour_n and_o certain_o his_o miscarriage_n be_v of_o no_o less_o nature_n be_v a_o forfeiture_n of_o a_o pardon_n and_o why_o not_o of_o article_n true_o much_o more_o for_o pardon_n though_o of_o grace_n be_v ground_v upon_o the_o compact_n and_o agreement_n of_o the_o whole_a nation_n but_o these_o article_n be_v but_o the_o agreement_n of_o certain_a person_n thereof_o of_o the_o army_n with_o traitor_n and_o although_o by_o the_o three_o article_n of_o exon_n certain_a enumerated_a act_n be_v make_v a_o breach_n of_o those_o article_n yet_o questionless_a other_o matter_n not_o enumerate_v may_v be_v a_o breach_n whereof_o these_o of_o sir_n john_n be_v some_o and_o it_o seem_v have_v be_v so_o adjudge_v by_o the_o parliament_n for_o in_o the_o debate_n of_o all_o act_n and_o resolution_n of_o they_o against_o sir_n john_n they_o still_o have_v a_o consideration_n of_o his_o article_n and_o adjudge_v these_o his_o miscarriage_n a_o breach_n of_o they_o and_o therefore_o declare_v he_o not_o to_o be_v admit_v to_o composition_n have_v forfeit_v the_o benefit_n thereof_o and_o although_o the_o article_n bound_v not_o sir_n john_n in_o point_n of_o his_o judgement_n yet_o they_o restrain_v he_o from_o all_o open_a and_o overt_a expression_n thereof_o to_o the_o prejudice_n of_o the_o commonwealth_n a_o man_n in_o private_a thought_n deem_v another_o man_n to_o be_v a_o thief_n perhaps_o know_v he_o to_o be_v one_o this_o judgement_n this_o knowledge_n the_o law_n take_v no_o notice_n of_o but_o let_v he_o declare_v such_o his_o thought_n with_o the_o parliament_n when_o he_o may_v and_o be_v earnest_o invite_v thereunto_o which_o aim_n of_o he_o be_v apparent_a for_o mr._n john_n ash_n do_v tell_v we_o that_o he_o send_v unto_o the_o action_n amount_v to_o the_o total_a of_o 7000_o l._n as_o himself_o affirm_v and_o to_o which_o action_n he_o never_o plead_v those_o article_n although_o he_o may_v but_o either_o the_o general_a issue_n of_o not_o guilty_a or_o suffer_v judgement_n to_o pass_v against_o he_o by_o confession_n or_o default_n when_o he_o be_v arraign_v at_o the_o upper-bench-bar_n for_o his_o life_n he_o do_v
