aforesaid_a according_a to_o the_o purport_n of_o this_o act._n and_o the_o say_a verdict_n of_o the_o jury_n and_o judgement_n of_o the_o commissioner_n in_o the_o case_n aforesaid_a shall_v be_v sufficient_a and_o conclusive_a in_o law_n to_o all_o intent_n and_o purpose_n against_o the_o say_a owner_n and_o occupier_n their_o heir_n executor_n administrator_n and_o assign_v act._n every_o that_o have_v distinct_a parochial_a officer_n so_o as_o the_o say_v additional_a sum_n excee_v not_o the_o sum_n of_o two_o shilling_n and_o six_o penny_n nor_o be_v under_o the_o sum_n of_o three_o penny_n each_o wéek_v for_o each_o such_o parish_n or_o chappelry_n the_o same_o to_o be_v levy_v in_o manner_n and_o form_n by_o such_o person_n and_o under_o such_o penalty_n as_o by_o the_o say_a statute_n of_o queen_n elizabeth_n be_v enact_v and_o declare_v and_o to_o be_v pay_v to_o the_o treasurer_n for_o the_o maim_a soldier_n soldier_n treasurer_n for_o maim_a soldier_n appoint_v by_o the_o justice_n of_o the_o county_n or_o liberty_n by_o virtue_n of_o this_o act_n and_o the_o statute_n of_o queen_n elizabeth_n aforesaid_a which_o say_v treasurer_n shall_v be_v order_v to_o issue_v out_o and_o account_v for_o the_o same_o in_o such_o manner_n and_o under_o such_o penalty_n as_o by_o the_o say_a statute_n be_v further_o enact_v and_o declare_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a relieve_v officer_n â—â—â—ldiers_n or_o â—â—â—triners_n maim_a or_o indigent_a how_o to_o be_v relieve_v that_o every_o officer_n soldier_n or_o mariner_n maim_v indigent_a age_a or_o disable_v in_o body_n for_o work_v in_o the_o service_n of_o his_o say_a late_a majesty_n or_o his_o majesty_n that_o now_o be_v during_o the_o late_a war_n or_o which_o be_v so_o impoverish_v by_o their_o suffering_n under_o any_o of_o the_o late_o usurp_v power_n as_o that_o they_o be_v destitute_a of_o any_o competent_a subsistence_n or_o livelihood_n and_o have_v continue_v faithful_a to_o his_o trust_n and_o not_o desert_v the_o same_o by_o take_v up_o arm_n against_o his_o say_a late_a majesty_n or_o his_o majesty_n that_o now_o be_v or_o otherwise_o shall_v forthwith_o repair_v to_o the_o place_n where_o he_o be_v last_o settle_v before_o he_o take_v up_o arm_n with_o a_o certificate_n of_o his_o service_n and_o hurt_v receive_v under_o the_o hand_n of_o his_o captain_n or_o other_o commissionated_a officer_n and_o shall_v also_o repair_v unto_o the_o two_o next_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o his_o settle_v be_v and_o the_o say_v two_o justice_n upon_o the_o examination_n of_o the_o truth_n of_o such_o certificate_n which_o the_o say_v two_o justice_n be_v hereby_o empower_v to_o take_v upon_o oath_n of_o such_o certificate_n be_v dead_a the_o say_v two_o justice_n shall_v have_v power_n upon_o request_n make_v to_o they_o in_o behalf_n of_o the_o party_n maim_v or_o age_a indigent_a or_o disable_v as_o aforesaid_a by_o person_n of_o credit_n to_o give_v such_o relief_n as_o in_o case_n of_o examination_n as_o aforesaid_a soldier_n widow_n and_o orphan_n of_o soldier_n and_o as_o touch_v the_o widow_n and_o orphan_n of_o such_o as_o have_v die_v or_o suffer_v death_n in_o the_o say_a service_n it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o over_z and_z beside_o such_o relief_n as_o they_o shall_v gain_v by_o their_o work_n and_o labour_n and_o shall_v be_v allow_v by_o the_o charity_n and_o benevolence_n of_o the_o parish_n town_n or_o hamlet_n where_o they_o be_v settle_v who_o be_v hereby_o require_v to_o have_v they_o in_o special_a regard_n the_o treasurer_n for_o the_o maim_a soldier_n for_o such_o county_n shall_v allow_v such_o further_a relief_n from_o time_n to_o time_n as_o shall_v be_v adjudge_v meet_a by_o the_o two_o next_o justice_n of_o the_o peace_n of_o such_o county_n and_o the_o say_a relief_n shall_v be_v pay_v out_o of_o the_o surplusage_n of_o such_o stock_n of_o maintenance_n as_o shall_v remain_v in_o the_o hand_n of_o the_o say_a treasurer_n after_o such_o pension_n and_o payment_n of_o they_o make_v and_o of_o which_o surplusage_n and_o allowance_n make_v unto_o such_o widow_n and_o orphan_n the_o say_a treasurer_n shall_v give_v account_n from_o time_n to_o time_n and_o the_o same_o distribute_v in_o such_o manner_n as_o by_o the_o justice_n shall_v be_v direct_v and_o according_a to_o the_o statute_n aforesaid_a receive_v treasurer_n high-constable_n etc._n etc._n to_o be_v call_v to_o account_n for_o money_n receive_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n of_o peace_n in_o every_o county_n or_o liberty_n or_o any_o
act_n to_o the_o contrary_a notwithstanding_o and_o the_o say_a sheriff_n shall_v deduct_v out_o of_o their_o payment_n four_o penny_n in_o the_o pound_n whereof_o three_o penny_n to_o be_v for_o themselves_o and_o one_o penny_n for_o the_o clerk_n of_o the_o peace_n to_o be_v recover_v as_o aforesaid_a fee_n officer_n of_o the_o exchequer_n shall_v discharge_v person_n who_o pay_v the_o duty_n without_o any_o fee_n and_o that_o his_o majesty_n officer_n in_o his_o say_a court_n of_o exchequer_n shall_v discharge_v all_o such_o person_n who_o pay_v their_o respective_a duty_n without_o take_v any_o fee_n for_o the_o same_o and_o shall_v also_o issue_v out_o process_n to_o levy_v the_o say_a duty_n upon_o such_o person_n who_o shall_v fail_v in_o payment_n thereof_o where_o no_o distress_n can_v be_v find_v to_o be_v take_v according_a to_o this_o act._n pension_n the_o say_a revenue_n shall_v be_v pay_v into_o the_o exchequer_n and_o not_o charge_v with_o any_o grant_n or_o pension_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o revenue_n and_o sum_n of_o money_n arise_v by_o virtue_n of_o this_o act_n except_o what_o shall_v be_v allow_v to_o the_o aforesaid_a officer_n and_o minister_n for_o collect_v the_o same_o shall_v be_v due_o and_o constant_o pay_v and_o answer_v into_o his_o majesty_n court_n of_o exchequer_n and_o shall_v not_o be_v particular_o charge_v or_o chargeable_a either_o before_o it_o be_v pay_v into_o the_o exchequer_n or_o after_o with_o any_o gift_n grant_n or_o pension_n whatsoever_o and_o that_o all_o and_o every_o grant_n of_o any_o such_o pension_n and_o all_o and_o every_o clause_n of_o non_fw-la obstante_fw-la therein_o contain_v shall_v be_v and_o be_v hereby_o declare_v to_o be_v utter_o void_a and_o all_o and_o every_o the_o person_n to_o who_o such_o grant_n be_v pass_v shall_v be_v and_o be_v hereby_o make_v accomptant_n unto_o his_o majesty_n accomptane_n grantee_n of_o the_o same_o shall_v be_v accomptane_n his_o heir_n and_o successor_n and_o shall_v pay_v back_o all_o sum_n of_o money_n receive_v by_o pretence_n of_o such_o grant_n and_o the_o court_n of_o exchequer_n shall_v be_v and_o be_v hereby_o enjoin_v to_o issue_n out_o process_n according_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n suit_n issue_n person_n act_v upon_o this_o statute_n be_v sue_v therefore_o may_v plead_v the_o general_a issue_n or_o information_n shall_v be_v commence_v or_o prosecute_v against_o any_o person_n or_o person_n for_o what_o he_o or_o they_o shall_v do_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o upon_o issue_n join_v may_v give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v become_v nonsuit_n or_o suffer_v discontinuance_n or_o if_o a_o verdict_n pass_v against_o he_o or_o if_o upon_o a_o demurrer_n judgement_n pass_v against_o he_o defendant_n treble_a cost_v to_o the_o defendant_n the_o defendant_n shall_v recover_v treble_a cost_v for_o which_o there_o shall_v be_v like_o remedy_n as_o in_o any_o case_n where_o cost_v by_o law_n be_v give_v to_o the_o defendant_n hearth_n or_o stove_n shall_v hereafter_o happen_v that_o a_o account_n in_o write_v of_o the_o same_o shall_v be_v have_v and_o make_v in_o like_a manner_n as_o the_o same_o be_v direct_v to_o be_v first_o take_v return_v and_o enrol_v by_o this_o act_n and_o a_o duplicate_v thereof_o send_v into_o the_o exchequer_n in_o such_o sort_n as_o be_v before_o direct_v discharge_v decrease_v how_o discharge_v and_o from_o thenceforth_o the_o owner_n or_o occupier_n of_o such_o house_n where_o such_o decrease_v be_v shall_v be_v discharge_v proportionable_o without_o any_o further_a plead_n in_o the_o exchequer_n provide_v always_o that_o no_o person_n or_o person_n shall_v be_v charge_v prosecute_v due_a arrearage_n not_o to_o be_v charge_v or_o sue_v for_o but_o within_o 2_o year_n next_o after_o they_o become_v due_a or_o bring_v to_o account_v for_o the_o arrearage_n of_o any_o duty_n or_o arrearage_n of_o revenue_n raise_v by_o this_o act_n unless_o the_o say_a suit_n shall_v commence_v within_o two_o year_n and_o be_v bring_v to_o a_o judgement_n within_o four_o year_n and_o the_o duty_n levy_v within_o five_o year_n next_o after_o the_o same_o shall_v grow_v due_a provide_v always_o that_o no_o person_n who_o by_o reason_n of_o his_o poverty_n exempt_v poor_a people_n exempt_v or_o the_o smallness_n of_o his_o estate_n be_v exempt_v from_o the_o usual_a tare_n payment_n and_o contribution_n towards_o the_o church_n and_o poor_a shall_v be_v charge_v or_o chargeable_a with_o any_o the_o duty_n by_o this_o act_n impose_v any_o thing_n herein_o before_o to_o the_o contrary_a notwithstanding_o provide_v always_o and_o be_v it_o hereby_o enact_v that_o if_o the_o churchwarden_n and_o overséer_v of_o the_o poor_a of_o the_o parish_n together_o with_o the_o minister_n of_o the_o same_o or_o any_o two_o of_o they_o whereof_o the_o minister_n to_o be_v one_o shall_v in_o write_v under_o their_o hand_n yearly_o certify_v their_o belief_n that_o the_o house_n wherein_o any_o person_n do_v inhabit_v be_v not_o of_o great_a value_n than_o of_o twenty_o shilling_n per_fw-la annum_fw-la upon_o the_o full_a improve_a rent_n and_o that_o neither_o the_o person_n so_o inhabit_v nor_o any_o other_o use_v the_o same_o message_n have_v use_v or_o occupi_v any_o land_n or_o tenement_n of_o their_o own_o or_o other_o of_o the_o yearly_a value_n of_o twenty_o shilling_n per_fw-la annum_fw-la nor_o have_v any_o land_n tenement_n good_n or_o chattel_n of_o the_o value_n of_o ten_o pound_n in_o their_o own_o possession_n or_o in_o the_o possession_n of_o any_o other_o in_o trust_n for_o they_o that_o then_o in_o such_o case_n upon_o such_o certificate_n make_v to_o the_o two_o next_o justice_n of_o peace_n and_o allow_v for_o which_o certificate_n and_o allowance_n no_o fee_n shall_v be_v pay_v the_o person_n on_o who_o behalf_n such_o certificate_n be_v make_v shall_v not_o be_v return_v by_o the_o constable_n or_o other_o officer_n and_o the_o say_a house_n be_v hereby_o for_o that_o year_n discharge_v of_o and_o from_o all_o the_o duty_n by_o this_o act_n impose_v any_o thing_n herein_o to_o the_o contrary_a notwithstanding_o provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n etc._n further_a penalty_n upon_o any_o person_n that_o shall_v accept_v or_o procure_v any_o pension_n gift_n or_o grant_v for_o year_n etc._n etc._n body_n politic_a or_o corporate_a shall_v at_o any_o time_n hereafter_o procure_v or_o accept_v of_o from_o the_o king_n majesty_n his_o heir_n or_o successor_n any_o pension_n gift_n or_o grant_v for_o year_n life_n or_o any_o other_o estate_n or_o any_o sum_n or_o sum_n of_o money_n out_o of_o the_o revenue_n arise_v by_o virtue_n of_o this_o act_n that_o then_o such_o person_n or_o body_n politic_a or_o corporate_a procure_v or_o accept_v the_o same_o shall_v forfeit_v double_a the_o value_n of_o such_o pension_n gift_n or_o grant_v the_o one_o moiety_n of_o which_o forfeiture_n shall_v be_v to_o the_o use_n of_o the_o poor_a of_o the_o parish_n or_o parish_n where_o the_o say_v offender_n be_v or_o inhabit_v to_o be_v recover_v by_o the_o churchwarden_n the_o other_o moiety_n to_o he_o that_o will_v sue_v for_o the_o same_o by_o action_n of_o debt_n bill_n plaint_n or_o information_n provide_v that_o this_o act_n hospital_n blow_v house_n stamp_n furnace_n kiln_n oven_n hospital_n or_o any_o thing_n herein_o contain_v shall_v not_o extend_v to_o charge_v any_o blowing-house_n and_o stamp_v furnace_n or_o kiln_n or_o any_o private_a oven_n within_o any_o of_o the_o house_n hereby_o charge_v nor_o any_o hearth_n or_o stove_n within_o the_o scite_fw-la of_o any_o hospital_n or_o alms-house_n for_o the_o relief_n of_o poor_a people_n who_o endowment_n and_o revenue_n do_v not_o excee_v in_o true_a value_n the_o sum_n of_o one_o hundred_o pound_n by_o the_o year_n provide_v act_n &_o shall_v according_o upon_o like_a pain_n &_o penalty_n observe_v and_o keep_v all_o the_o respective_a order_n and_o direction_n of_o the_o say_a act_n and_o of_o this_o present_a act_n of_o arm_n or_o search_v of_o house_n for_o arm_n or_o for_o suspect_a person_n shall_v be_v construe_v to_o commence_v and_o take_v effect_n and_o shall_v be_v good_a and_o effectual_a in_o law_n for_o the_o indempnify_n of_o all_o person_n whatsoever_o act_v in_o the_o militia_n of_o this_o kingdom_n for_o any_o the_o matter_n aforesaid_a betwixt_o the_o second_o day_n of_o february_n one_o pay_v at_o a_o certain_a place_n in_o every_o of_o the_o say_v several_a and_o respective_a county_n and_o for_o hertfordshire_n at_o wades-mill_n in_o the_o say_a county_n which_o say_v toll_n so_o set_v be_v by_o the_o say_a act_n to_o continue_v the_o space_n of_o eleven_o year_n and_o no_o long_o with_o this_o provision_n that_o if_o the_o justice_n of_o the_o peace_n at_o their_o quarter_n session_n in_o the_o respective_a county_n shall_v before_o the_o expiration_n of_o eleven_o year_n adjudge_v the_o say_v repair_v to_o be_v sufficient_o do_v that_o from_o thenceforth_o it_o shall_v cease_v and_o whereas_o divers_a gentleman_n within_o the_o county_n of_o hertford_n have_v hearty_o set_v themselves_o to_o take_v care_n for_o the_o repair_n of_o the_o say_a way_n within_o their_o county_n and_o in_o order_n thereunto_o find_v that_o money_n can_v not_o be_v advance_v by_o the_o toll_n in_o so_o speedy_a a_o manner_n as_o to_o repair_v those_o ruinous_a way_n and_o that_o say_a act_n which_o sum_v according_o be_v lay_v out_o together_o with_o such_o money_n as_o have_v proceed_v from_o the_o toll_n before_o mention_v in_o the_o repair_n of_o the_o say_a highway_n by_o which_o mean_n they_o have_v so_o amend_v the_o say_a road_n lie_v in_o that_o county_n lead_v from_o london_n to_o york_n that_o they_o have_v make_v the_o same_o from_o a_o road_n impassable_a to_o be_v to_o the_o satisfaction_n of_o all_o that_o travel_v that_o way_n very_o passable_a and_o convenient_a but_o by_o reason_n of_o the_o great_a sum_n expend_v and_o lay_v out_o so_o borrow_v as_o aforesaid_a the_o toll_n will_v not_o be_v sufficient_a to_o repay_v the_o same_o within_o the_o year_n mention_v in_o the_o former_a act_n with_o interest_n for_o the_o same_o and_o to_o finish_v the_o say_a work_n barley_n hertford_n cambridg_n norfolk_n newmarket_n puckridge_n barley_n and_o whereas_o there_o be_v a_o road_n in_o the_o say_a county_n of_o hertford_n that_o lead_v from_o london_n to_o cambridg_v and_o so_o into_o norfolk_n and_o likewise_o to_o newmarket_n and_o so_o into_o suffolk_n and_o other_o part_n which_o go_v out_o of_o the_o forementioned_a road_n at_o the_o end_n of_o the_o town_n of_o puckridge_n and_o so_o lead_v to_o barley_n in_o the_o say_a county_n of_o hertford_n which_o be_v very_o ruinous_a and_o require_v as_o much_o the_o help_n of_o the_o toll_n in_o many_o place_n as_o the_o forementioned_a road_n do_v may_v it_o therefore_o please_v your_o majesty_n that_o it_o be_v enact_v and_o be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o authority_n of_o the_o same_o that_o the_o toll_n aforementioned_a to_o be_v take_v at_o wades-mill_n for_o the_o county_n of_o hertford_n continue_v ii_o the_o full_a take_v at_o wades-mill_n continue_v that_o that_o the_o person_n empower_v in_o the_o forementioned_a act_n for_o the_o repair_n of_o the_o highway_n within_o the_o county_n of_o hertford_n shall_v have_v the_o same_o power_n to_o repair_v the_o say_a highway_n lead_v from_o puckridge_n to_o barley_n in_o the_o say_a county_n barley_n for_o repair_v the_o highway_n from_o puckeridg_n to_o barley_n as_o they_o have_v to_o repair_v the_o highway_n in_o the_o say_a county_n lead_v from_o london_n to_o york_n and_o that_o they_o shall_v and_o may_v apply_v such_o part_n of_o the_o toll_n thereunto_o have_v a_o equal_a care_n of_o both_o highway_n as_o they_o in_o their_o judgement_n shall_v find_v needful_a any_o thing_n in_o the_o say_v former_a act_n to_o the_o contrary_a notwithstanding_o caxton_n caxton_n and_o whereas_o by_o the_o former_a recite_v act_n a_o toll_n be_v erect_v and_o set_v to_o be_v take_v at_o the_o town_n of_o caxton_n in_o the_o county_n of_o cambridge_n for_o and_o towards_o the_o repair_n the_o highway_n in_o the_o say_a county_n the_o say_a toll_n do_v prove_v useless_a and_o will_v not_o answer_v the_o end_n for_o which_o the_o same_o be_v intend_v by_o reason_n of_o the_o inconveniency_n of_o the_o place_n where_o the_o same_o be_v set_v arrington-bridg_n arrington-bridg_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a toll_n be_v and_o be_v hereby_o remove_v from_o the_o say_a town_n of_o caxton_n unto_o arrington-bridg_n or_o the_o town_n of_o arrington_n as_o shall_v seem_v most_o convenient_a by_o the_o justice_n of_o the_o peace_n of_o the_o say_a county_n at_o their_o next_o easter_n general-quarter-session_n of_o the_o peace_n in_o the_o county_n aforesaid_a and_o that_o the_o same_o toll_n shall_v be_v take_v and_o receive_v at_o arrington-bridg_n or_o arrington-town_n aforesaid_a according_a to_o the_o rate_n and_o by_o the_o same_o way_n and_o mean_v as_o in_o the_o former_a act_n be_v appoint_v and_o declare_v and_o to_o be_v employ_v to_o the_o use_n purpose_n and_o intent_n therein_o also_o declare_v any_o thing_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o highway_n a_o charge_n of_o six_o penny_n in_o the_o pound_n for_o repair_v the_o say_a highway_n provide_v always_o that_o all_o and_o every_o person_n and_o person_n who_o by_o law_n be_v chargeable_a towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a shall_v still_o remain_v so_o chargeable_a and_o pay_v six_o penny_n in_o the_o pound_n yearly_a according_a to_o the_o true_a value_n of_o their_o estate_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n during_o the_o time_n of_o the_o continuance_n of_o this_o toll_n any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o weekly_o iii_o the_o collector_n of_o the_o toll_n how_o to_o account_v weekly_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o collector_n of_o this_o toll_n shall_v wéek_o account_v to_o the_o receiver-general_n for_o the_o whole_a money_n receive_v by_o virtue_n of_o this_o or_o the_o say_v former_a act_n and_o the_o next_o justice_n of_o the_o peace_n for_o the_o say_a county_n shall_v hereby_o have_v power_n to_o give_v a_o oath_n to_o the_o say_a collector_n for_o the_o make_n of_o a_o true_a and_o perfect_a account_n of_o the_o money_n so_o receive_v which_o say_v account_v so_o make_v shall_v be_v return_v into_o the_o next_o general-quarter-session_n to_o be_v hold_v for_o the_o say_a county_n by_o the_o justice_n of_o peace_n before_o who_o such_o oath_n be_v take_v toll_n proviso_n touch_v the_o continuance_n or_o determine_v the_o say_a toll_n provide_v also_o that_o if_o at_o amendment_n of_o the_o say_a highway_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n the_o highway_n within_o the_o say_a county_n of_o hertford_n shall_v money_n upon_o his_o or_o their_o entry_n or_o entry_n make_v and_o before_o the_o land_n thereof_o aforesaid_a the_o penalty_n for_o not_o account_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o common_a brewer_n of_o béer_n and_o ale_n shall_v once_o in_o every_o wéek_v and_o all_o inn-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a aforesaid_a the_o penalty_n for_o not_o account_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v five_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a and_o particular_a entry_n shall_v forfeit_v twenty_o shilling_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o common_a brewer_n who_o shall_v not_o pay_v and_o clear_v off_o within_o a_o wéek_v after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n and_o that_o every_o inn-kéepe_a alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o shall_v not_o pay_v and_o clear_v off_o within_o a_o month_n after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n the_o say_v respective_a forfeiture_n to_o be_v levy_v upon_o their_o good_n and_o chattel_n in_o such_o manner_n and_o form_n as_o hereafter_o in_o this_o act_n be_v ordain_v and_o direct_v provide_v that_o no_o such_o person_n as_o aforesaid_a shall_v be_v compel_v by_o the_o commissioner_n or_o sub-commissioner_n of_o excise_n gager_n no_o person_n to_o be_v compel_v by_o the_o commissioner_n of_o excise_n to_o go_v further_o for_o make_v their_o entry_n then_o the_o next_o market-town_n the_o commissioner_n for_o execution_n of_o this_o act_n empower_v to_o appoint_v gager_n the_o power_n of_o the_o gager_n to_o travel_v for_o the_o make_n of_o the_o say_a entry_n or_o payment_n of_o the_o say_a duty_n or_o other_o cause_n whatsoever_o touch_v or_o concern_v the_o same_o if_o he_o live_v in_o a_o market-town_n out_o of_o the_o say_a town_n if_o he_o live_v out_o of_o a_o market-town_n then_o to_o no_o other_o place_n then_o to_o the_o next_o market-town_n to_o his_o habitation_n in_o the_o same_o county_n on_o the_o market-day_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n who_o shall_v be_v appoint_v by_o his_o majesty_n for_o put_v this_o act_n in_o execution_n and_o their_o sub-commissioner_n in_o their_o respective_a circuit_n and_o division_n shall_v hereby_o have_v power_n to_o constitute_v under_o their_o hand_n and_o seal_n such_o and_o so_o many_o gager_n as_o they_o shall_v find_v needful_a which_o gager_n and_o every_o of_o they_o shall_v at_o all_o time_n as_o well_o by_o night_n as_o by_o day_n and_o if_o by_o night_n then_o in_o the_o presence_n of_o a_o constable_n or_o other_o lawful_a officer_n be_v permit_v upon_o their_o request_n to_o enter_v the_o house_n brewhouse_n distilling-house_n and_o all_o other_o house_n and_o place_n whatsoever_o belong_v to_o or_o use_v by_o any_o brewer_n inn-kéepe_a victualler_n or_o other_o retailer_n of_o béer_n brew_v or_o make_v the_o same_o as_o aforesaid_a or_o by_o any_o distiller_n of_o strong-water_n or_o retailer_n of_o other_o the_o liquor_n aforesaid_a and_o to_o gage_n all_o copper_n fat_n be_v and_o vessel_n in_o the_o same_o and_o to_o take_v a_o account_n of_o béer_o ale_n word_n perry_n cider_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a in_o the_o say_a house_n place_n and_o vessel_n from_o time_n to_o time_n brew_v or_o make_v and_o distil_v and_o thereof_o to_o make_v return_n or_o report_v in_o write_v to_o the_o say_a commissioner_n or_o sub-commissioner_n of_o excise_n
under_o who_o office_n and_o limit_n such_o brewer_n retailer_n distiller_n or_o maker_n of_o the_o liquor_n aforesaid_a do_v dwell_v and_o inhabit_v gager_n return_v make_v by_o the_o gager_n leave_v a_o true_a copy_n of_o such_o return_n in_o write_v under_o his_o hand_n with_o such_o brewer_n retailer_n distiller_n or_o maker_n of_o the_o liquor_n aforesaid_a and_o such_o report_n or_o return_v of_o the_o say_a gager_n shall_v be_v a_o charge_n upon_o the_o say_a brewer_n maker_n and_o retailer_n respective_o and_o if_o any_o such_o common_a brewer_n or_o retailer_n shall_v refuse_v to_o permit_v any_o such_o gager_n or_o gagers_n to_o enter_v his_o brewhouse_n or_o any_o other_o place_n aforemention_v or_o to_o gage_n or_o take_v account_n of_o his_o brew_v vessel_n or_o of_o any_o such_o béer_n ale_n word_n perry_n cider_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a such_o brewer_n retailer_n or_o distiller_n shall_v be_v forthwith_o forbid_v by_o the_o say_v gager_n or_o gagers_n to_o sell_v carry_v out_o or_o deliver_v to_o any_o of_o his_o customer_n any_o béer_n ale_n strong-water_n aquavite_n or_o other_o the_o liquor_n aforesaid_a and_o if_o any_o such_o brewer_n retailer_n or_o distiller_n of_o any_o the_o liquor_n aforesaid_a after_o such_o warning_n give_v shall_v sell_v carry_v or_o deliver_v out_o the_o same_o or_o any_o part_n thereof_o not_o have_v pay_v and_o clear_v the_o duty_n of_o excise_n such_o person_n and_o person_n shall_v beside_o the_o forfeiture_n of_o double_a the_o value_n forfeit_v and_o lose_v the_o sum_n of_o five_o pound_n as_o aforesaid_a for_o every_o offence_n to_o be_v levy_v and_o recover_v upon_o his_o or_o their_o good_n and_o chattel_n in_o manner_n and_o form_n as_o hereafter_o in_o this_o act_n be_v provide_v and_o for_o the_o avoid_n of_o all_o incertainty_n and_o dispute_v beer_n what_o shall_v be_v reckon_v a_o barrel_n of_o beer_n touch_v the_o return_n make_v or_o to_o be_v make_v by_o the_o gager_n of_o any_o béer_n or_o ale_n so_o brew_v as_o aforesaid_a be_v it_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o every_o six_o and_o thirty_o gallon_n of_o béer_o take_v by_o the_o gage_n according_a to_o the_o standard_n of_o the_o ale-quart_n four_o whereof_o shall_v make_v the_o gallon_n remain_v in_o the_o custody_n of_o the_o chamberlain_n of_o his_o majesty_n exchequer_n shall_v be_v reckon_v account_v and_o return_v by_o the_o gager_n for_o a_o barrel_n of_o béer_o and_o every_o two_o and_o thirty_o gallon_n of_o ale_n ale_n the_o barrel_n of_o ale_n take_v by_o the_o gage_n according_a to_o the_o same_o standard_n shall_v be_v in_o like_a manner_n reckon_v account_v and_o return_v for_o a_o barrel_n of_o ale_n and_o all_o other_o the_o liquor_n aforesaid_a according_a to_o the_o wine-gallon_n provide_v always_o and_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o brewer_n or_o retailer_n of_o béer_n and_o ale_n shall_v take_v any_o more_o in_o the_o price_n thereof_o upon_o sale_n of_o the_o same_o then_o according_a to_o the_o usual_a rate_n and_o prize_n save_v that_o every_o common_a brewer_n shall_v and_o may_v take_v and_o receive_v of_o all_o and_o every_o person_n and_o person_n to_o who_o he_o shall_v sell_v and_o deliver_v any_o ale_n or_o béer_o the_o excise_n thereupon_o due_a as_o aforesaid_a over_o and_o above_o the_o usual_a rate_n and_o prize_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o better_a encouragement_n of_o all_o common_a brewer_n and_o maker_n of_o béer_n or_o ale_n to_o make_v due_a entry_n and_o payment_n thereof_o according_a as_o by_o this_o act_n be_v appoint_v the_o say_v common_a brewer_n not_o sell_v the_o same_o by_o retail_n for_o and_o in_o consideration_n of_o waste_n by_o filling_n and_o leakage_n of_o their_o béer_n and_o ale_n shall_v have_v and_o be_v allow_v out_o of_o the_o say_v return_v make_v by_o the_o gager_n the_o several_a allowance_n and_o abatement_n hereafter_o mention_v leakage_n abatement_n and_o allowance_n to_o be_v make_v for_o waste_n and_o leakage_n that_o be_v to_o say_v upon_o every_o three_o and_o twenty_o barrel_n of_o béer_n whether_o strong_a or_o small_a return_v by_o the_o say_a gager_n three_o barrel_n and_o upon_o every_o two_o and_o twenty_o barrel_n of_o ale_n whether_o strong_a or_o small_a return_v by_o the_o gager_n two_o barrel_n which_o say_v allowance_n and_o abatement_n the_o say_v commissioner_n to_o be_v appoint_v as_o aforesaid_a and_o their_o sub-commissioner_n be_v hereby_o authorize_v to_o allow_v and_o make_v according_o provide_v always_o entry_n forfeiture_n for_o false_a entry_n that_o where_o any_o common_a brewer_n shall_v witting_o or_o willing_o make_v a_o false_a entry_n and_o be_v convict_v for_o the_o same_o before_o the_o commissioner_n to_o be_v appoint_v as_o aforesaid_a or_o any_o two_o of_o they_o or_o before_o such_o other_o person_n or_o person_n as_o be_v hereafter_o by_o this_o act_n appoint_v in_o that_o case_n such_o brewer_n or_o brewer_n shall_v forfeit_v and_o lose_v over_o and_o beside_o the_o penalty_n before_o mention_v the_o say_a allowance_n so_o to_o be_v make_v for_o six_o month_n then_o next_o ensue_v and_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a pay_v no_o ale_n or_o breâ—_n to_o be_v deliver_v to_o the_o retayler_n before_o the_o rate_n be_v pay_v that_o no_o béer_n or_o ale_n shall_v be_v deliver_v in_o by_o such_o brewer_n or_o maker_n thereof_o to_o any_o victualler_n or_o other_o retailer_n thereof_o until_o the_o rate_n which_o by_o such_o victualler_n or_o retayler_n be_v to_o be_v pay_v over_o and_o above_o the_o price_n of_o the_o say_v béer_o or_o ale_n for_o or_o in_o respect_n of_o this_o duty_n be_v first_o pay_v and_o satisfy_v by_o the_o say_a victualler_n or_o retayler_n to_o the_o brewer_n or_o maker_n thereof_o provide_v always_o fairâ—_n beer_n and_o ale_n sell_v in_o fairâ—_n that_o if_o any_o person_n or_o person_n shall_v brew_v and_o sell_v by_o retail_v any_o small_a quantity_n of_o béer_n or_o ale_n in_o any_o fair_a within_o this_o realm_n or_o dominion_n aforesaid_a who_o be_v not_o otherwise_o any_o common_a or_o usual_a brewer_n or_o retayler_n thereof_o and_o shall_v before_o any_o such_o sell_v and_o retail_v thereof_o well_o and_o true_o pay_v and_o satisfy_v the_o duty_n due_a for_o the_o same_o to_o the_o commissioner_n or_o sub-commissioner_n within_o who_o limit_n or_o division_n the_o say_v fair_a shall_v be_v hold_v or_o to_o their_o officer_n thereunto_o appoint_v then_o such_o person_n or_o person_n so_o brew_v or_o retail_v the_o same_o and_o for_o so_o much_o and_o no_o more_o nor_o otherwise_o shall_v be_v free_v and_o discharge_v from_o all_o penalty_n and_o forfeiture_n in_o and_o by_o this_o act_n before_o mention_v and_o impose_v any_o thing_n therein_o contain_v to_o the_o contrary_a notwithstanding_o provide_v nevertheless_o that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a commissioner_n and_o sub-commissioner_n respective_o victualler_n the_o commissioner_n may_v compound_v with_o any_o innkeeper_n retailer_n or_o victualler_n to_o compound_v for_o this_o duty_n with_o any_o inn-kéepe_a victualler_n alehouse-kéepe_a or_o retailer_n of_o béer_n ale_n and_o other_o the_o liquor_n aforesaid_a within_o their_o respective_a division_n from_o time_n to_o time_n and_o in_o such_o manner_n and_o form_n as_o may_v be_v most_o for_o the_o advantage_n and_o improvement_n of_o the_o receipt_n thereof_o any_o thing_n in_o this_o act_n before_o contain_v to_o the_o contrary_a notwithstanding_o year_n any_o the_o rate_n in_o this_o act_n may_v be_v farm_a for_o three_o year_n and_o it_o be_v further_o ordain_v and_o enact_v by_o the_o authority_n aforesaid_a that_o the_o lord_n treasurer_n or_o commissioner_n of_o the_o treasury_n for_o the_o time_n be_v or_o such_o other_o person_n or_o person_n as_o his_o majesty_n shall_v appoint_v shall_v have_v power_n and_o be_v hereby_o authorise_v and_o impower_v from_o time_n to_o time_n to_o treat_v contract_n conclude_v and_o agree_v with_o any_o person_n or_o person_n for_o or_o concern_v the_o farm_n of_o all_o or_o any_o the_o rate_n duty_n and_o charge_n in_o this_o act_n mention_v upon_o béer_o ale_n perry_n cider_n or_o other_o the_o liquor_n aforesaid_a in_o any_o the_o respective_a county_n city_n or_o place_n of_o this_o realm_n or_o dominion_n thereof_o as_o may_v be_v for_o the_o great_a benefit_n and_o advantage_n of_o the_o say_a receipt_n so_o as_o the_o same_o excee_v not_o the_o term_n of_o three_o year_n and_o be_v it_o further_o enact_v that_o every_o such_o contract_n bargain_n and_o agreement_n of_o the_o lord_n treasurer_n or_o commissioner_n of_o the_o treasury_n or_o other_o person_n aforesaid_a on_o behalf_n of_o his_o majesty_n
within_o a_o wéek_v after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n and_o that_o every_o inn-kéepe_a alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o shall_v not_o pay_v and_o clear_v off_o within_o a_o month_n after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n the_o say_v respective_a forfeiture_n to_o be_v levy_v upon_o their_o good_n and_o chattel_n in_o such_o manner_n and_o form_n as_o hereafter_o in_o this_o act_n be_v ordain_v and_o direct_v provide_v that_o no_o such_o person_n as_o aforesaid_a shall_v be_v compel_v by_o the_o commissioner_n or_o sub-commissioner_n of_o excise_n make_v in_o what_o place_n entry_n shall_v be_v make_v to_o travel_v for_o the_o make_n of_o the_o say_a entry_n or_o payment_n of_o the_o say_a duty_n or_o other_o cause_n whatsoever_o touch_v or_o concern_v the_o same_o if_o he_o live_v in_o a_o market_n town_n out_o of_o the_o say_a town_n if_o he_o live_v out_o of_o a_o market_n town_n then_o to_o no_o other_o place_n then_o to_o the_o next_o market_n town_n to_o his_o habitation_n in_o the_o same_o county_n on_o the_o market_n day_n gager_n the_o power_n of_o the_o commiss_n oner_n to_o appoint_v gager_n the_o power_n of_o the_o gager_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n who_o shall_v be_v appoint_v by_o his_o majesty_n for_o put_v this_o act_n in_o execution_n and_o their_o sub-commissioner_n in_o their_o respective_a circuit_n and_o division_n shall_v hereby_o have_v power_n to_o constitute_v under_o the_o same_o as_o aforesaid_a or_o by_o any_o distiller_n of_o strong-water_n or_o retailer_n of_o other_o the_o liquor_n aforesaid_a and_o to_o gage_n all_o copper_n fat_n be_v and_o vessel_n in_o the_o same_o and_o to_o take_v a_o account_n of_o béer_o ale_n word_n perry_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a in_o the_o say_a house_n place_n and_o vessel_n from_o time_n to_o time_n brew_v or_o make_v and_o distil_v and_o thereof_o to_o make_v return_n or_o report_n in_o write_v to_o the_o say_a commissioner_n or_o sub-commissioner_n of_o excise_n under_o who_o office_n and_o limit_n such_o brewer_n retailer_n distiller_n or_o maker_n of_o the_o liquor_n aforesaid_a do_v dwell_v and_o inhabit_v leave_v a_o true_a copy_n of_o such_o return_n in_o write_v under_o his_o hand_n with_o such_o brewer_n retailer_n distiller_n or_o maker_n of_o the_o liquor_n aforesaid_a and_o such_o report_n or_o return_v of_o the_o say_a gager_n shall_v be_v a_o charge_n upon_o the_o say_a brewer_n maker_n and_o retailer_n respective_o and_o if_o any_o such_o common_a brewer_n maker_n or_o retailer_n shall_v refuse_v to_o permit_v any_o such_o gager_n or_o gagers_n to_o enter_v his_o brewhouse_n or_o any_o other_o place_n aforemention_v or_o to_o gage_n or_o take_v account_n of_o his_o brewing-vessel_n or_o any_o such_o béer_n ale_n word_n perry_n cider_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a such_o brewer_n retailer_n or_o distiller_n shall_v be_v forthwith_o forbid_v by_o the_o say_v gager_n or_o gagers_n to_o sell_v carry_v out_o or_o deliver_v to_o any_o of_o his_o customer_n any_o béer_n ale_n strong-water_n aquavite_n or_o other_o the_o liquor_n aforesaid_a and_o if_o any_o such_o brewer_n excise_n penalty_n for_o sell_v etc._n etc._n not_o have_v clear_v the_o excise_n retailer_n or_o distiller_n of_o any_o the_o liquor_n aforesaid_a after_o such_o warning_n give_v shall_v sell_v carry_v or_o deliver_v out_o the_o same_o or_o any_o part_n thereof_o not_o have_v pay_v and_o clear_v the_o duty_n of_o excise_n such_o person_n and_o person_n shall_v beside_o the_o forfeiture_n of_o double_a the_o value_n forfeit_v and_o lose_v the_o sum_n of_o ten_o pound_n as_o aforesaid_a for_o every_o offence_n to_o be_v levy_v and_o recover_v upon_o his_o or_o their_o good_n and_o chattel_n in_o manner_n and_o form_n as_o hereafter_o in_o this_o act_n be_v provide_v gager_n proportion_n to_o be_v observe_v in_o return_n of_o gager_n and_o for_o the_o avoid_n of_o all_o incertainty_n and_o dispute_v touch_v the_o return_n make_v or_o to_o be_v make_v by_o the_o gager_n of_o any_o béer_n or_o ale_n so_o brew_v as_o aforesaid_a be_v it_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o every_o six_o and_o thirty_o gallon_n of_o béer_o take_v by_o the_o gage_n according_a to_o the_o standard_n of_o the_o ale-quart_n four_o whereof_o shall_v provide_v always_o and_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o brewer_n or_o retailer_n of_o béer_n and_o ale_n shall_v take_v any_o more_o in_o the_o price_n thereof_o upon_o sale_n of_o the_o same_o then_o according_a to_o the_o usual_a rate_n and_o price_n save_v that_o every_o common_a brewer_n shall_v and_o may_v take_v and_o receive_v of_o all_o and_o every_o person_n and_o person_n to_o who_o he_o shall_v sell_v and_o deliver_v any_o béer_n or_o ale_n the_o excise_n thereupon_o due_a as_o aforesaid_a over_o and_o above_o the_o usual_a rate_n and_o prize_n entry_n encouragement_n to_o brewer_n to_o make_v true_a entry_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o better_a encouragement_n of_o all_o common_a brewer_n or_o maker_n of_o béer_n or_o ale_n to_o make_v due_a entry_n and_o payment_n thereof_o according_a as_o by_o this_o act_n be_v appoint_v the_o say_v common_a brewer_n not_o sell_v the_o same_o by_o retail_n for_o and_o in_o consideration_n of_o waste_n by_o filling_n and_o leakage_n of_o their_o béer_n and_o ale_n shall_v have_v and_o be_v allow_v out_o of_o the_o say_v return_v shall_v also_o forfeit_v and_o lose_v the_o sum_n of_o fifty_o pound_n to_o be_v levy_v and_o recover_v in_o manner_n and_o form_n as_o in_o by_o this_o present_a act_n be_v hereafter_o direct_v and_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o five_o 23._o commissioner_n for_o regulate_a may_v not_o farm_n the_o excise_n 12_o car._n 2._o cap._n 23._o no_o person_n or_o person_n whatsoever_o nominate_v by_o his_o majesty_n to_o be_v in_o commission_n for_o the_o regulate_v of_o his_o majesty_n revenue_n of_o excise_n or_o for_o the_o exercise_n of_o any_o the_o power_n or_o authority_n mention_v in_o a_o act_n entitle_v a_o grant_n of_o certain_a imposition_n upon_o beer_n ale_n and_o other_o liquor_n for_o the_o increase_n of_o his_o majesty_n revenue_n during_o his_o life_n or_o one_o other_o act_n entitle_v a_o act_n for_o take_v away_o the_o court_n of_o ward_n and_o livery_n and_o tenor_n in_o capite_fw-la by_o knight_n service_n and_o purveyance_n and_o for_o settle_v a_o revenue_n upon_o his_o majesty_n in_o lieu_n thereof_o or_o in_o this_o present_a act_n 24._o 12_o car._n 2._o cap._n 24._o shall_v presume_v to_o farm_n the_o say_a revenue_n of_o his_o majesty_n either_o direct_o or_o indirect_o by_o obtain_v letter_n patent_n to_o he_o or_o themselves_o thereof_o or_o any_o person_n or_o person_n whatsoever_o entrust_v for_o he_o or_o they_o or_o to_o or_o for_o his_o or_o their_o use_n benefit_n or_o behoof_n nor_o that_o any_o person_n or_o person_n whatsoever_o be_v a_o farmer_n of_o the_o say_a revenue_n shall_v be_v any_o way_n capable_a to_o be_v nominate_v a_o commissioner_n for_o the_o regulate_v his_o majesty_n say_a revenue_n of_o excise_n or_o exercise_v any_o power_n or_o authority_n concern_v the_o same_o but_o if_o any_o person_n or_o person_n who_o stand_v thus_o disable_v as_o aforesaid_a to_o be_v nominate_v a_o commissioner_n shall_v become_v a_o farmer_n and_o shall_v in_o either_o of_o the_o say_a case_n nevertheless_o presume_v direct_o or_o indirect_o to_o act_v as_o a_o commissioner_n farmer_n or_o sub-commissioner_n to_o execute_v the_o power_n and_o authority_n aforesaid_a either_o alone_a or_o joint_o with_o other_o person_n that_o be_v farmer_n or_o else_o with_o any_o other_o who_o be_v not_o farmer_n shall_v from_o and_o after_o such_o his_o act_n lose_v the_o benefit_n of_o his_o say_a farm_n penalty_n the_o penalty_n and_o be_v thenceforth_o total_o for_o ever_o disable_v to_o be_v either_o farmer_n of_o the_o say_a revenue_n or_o commissioner_n for_o the_o regulate_v thereof_o and_o exercise_v the_o power_n aforesaid_a and_o that_o all_o and_o every_o act_n and_o act_n do_v by_o any_o commissioner_n or_o commissioner_n or_o sub-commissioner_n be_v farmer_n or_o farmer_n by_o he_o or_o themselves_o or_o joint_o with_o other_o who_o be_v not_o farmer_n shall_v be_v void_a in_o law_n and_o of_o none_o effect_n and_o that_o all_o and_o every_o person_n or_o person_n any_o way_n molest_v or_o trouble_v by_o the_o command_n and_o authority_n of_o such_o commissioner_n or_o commissioner_n act_v by_o he_o or_o themselves_o or_o together_o with_o other_o who_o be_v not_o farmer_n or_o commissioner_n may_v bring_v his_o action_n at_o law_n for_o the_o same_o in_o any_o of_o his_o majesty_n court_n at_o westminster_n and_o thereby_o recover_v his_o damage_n against_o any_o such_o commissioner_n or_o commissioner_n any_o law_n or_o statute_n to_o the_o contrary_a notwithstanding_o and_o that_o all_o and_o every_o letter_n patent_n to_o be_v make_v from_o and_o after_o the_o ten_o day_n of_o april_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o three_o enable_v any_o farmer_n or_o farmer_n of_o the_o excise_n to_o be_v commissioner_n or_o commissioner_n or_o sub-commissioner_n shall_v be_v utter_o void_a and_o of_o none_o effect_n any_o thing_n in_o any_o of_o the_o say_a act_n to_o the_o contrary_a notwithstanding_o and_o that_o if_o any_o commissioner_n or_o sub-commissioner_n commissioner_n or_o sub-commissioner_n who_o by_o colour_n or_o virtue_n of_o any_o letter_n patent_n be_v now_o both_o commissioner_n or_o sub-commissioner_n for_o regulate_v the_o say_a revenue_n and_o likewise_o farmer_n of_o the_o say_a revenue_n damage_n the_o penalty_n for_o give_v any_o false_a and_o corrupt_a judgement_n to_o the_o brewer_n damage_n shall_v give_v any_o false_a and_o corrupt_a judgement_n in_o advancement_n of_o the_o benefit_n of_o he_o or_o their_o say_a farm_n to_o the_o brewer_n damage_n contrary_a to_o law_n he_o or_o they_o shall_v forfeit_v for_o every_o such_o judgement_n so_o false_o and_o corrupt_o give_v double_a cost_v to_o the_o party_n so_o injure_v by_o the_o say_v corrupt_a and_o false_a judgement_n and_o in_o case_n any_o person_n shall_v unjust_o complain_v of_o any_o judgement_n of_o the_o commissioner_n or_o sub-missioners_a as_o aforesaid_a and_o so_o shall_v be_v find_v upon_o his_o appeal_n the_o say_a party_n shall_v forfeit_v double_a cost_v to_o the_o say_a commissioner_n for_o such_o unjust_a vexation_n to_o be_v recover_v by_o information_n bill_n or_o plaint_n in_o any_o court_n of_o record_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o from_o and_o after_o the_o first_o day_n of_o september_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o three_o entry_n the_o duty_n of_o gager_n in_o make_v entry_n all_o and_o every_o gager_n or_o gagers_n of_o the_o excise_n who_o shall_v take_v a_o account_n of_o any_o béer_n or_o ale_n brew_v or_o make_v by_o any_o common_a brewer_n shall_v wéek_o after_o such_o common_a brewer_n have_v make_v or_o aught_o to_o have_v make_v his_o entry_n at_o the_o office_n of_o excise_n and_o not_o otherwise_o make_v and_o deliver_v to_o such_o common_a brewer_n at_o his_o house_n or_o to_o some_o of_o his_o servant_n in_o his_o behalf_n a_o true_a copy_n under_o he_o or_o their_o hand_n of_o such_o return_n or_o report_n as_o he_o or_o they_o have_v make_v thereof_o to_o the_o commissioner_n or_o sub-commissioner_n of_o excise_n respective_o upon_o pain_n to_o forfeit_v for_o every_o neglect_n or_o refusal_n the_o sum_n of_o forty_o shilling_n provide_v nevertheless_o that_o no_o such_o common_a brewer_n or_o
money_n as_o shall_v be_v pay_v by_o they_o in_o pursuance_n of_o this_o act_n which_o acquittance_n shall_v be_v a_o full_a discharge_v to_o the_o say_v head-collectors_a and_o subcollector_n respective_o acquittance_n acquittance_n and_o the_o say_v subcollector_n shall_v make_v and_o deliver_v to_o the_o say_v head-collectors_a a_o perfect_a schedule_n fair_o write_v in_o parchment_n under_o their_o hand_n and_o seal_n sign_v and_o allow_v by_o any_o two_o or_o more_o of_o the_o respective_a commissioner_n contain_v the_o name_n surname_n and_o place_n of_o abode_n of_o every_o person_n within_o their_o respective_a collection_n that_o shall_v make_v default_n of_o payment_n of_o any_o of_o the_o sum_n that_o shall_v be_v rate_v or_o assess_v on_o such_o person_n by_o virtue_n of_o this_o act_n and_o the_o sum_n and_o sum_n charge_v on_o every_o such_o person_n the_o same_o schedule_n to_o be_v deliver_v by_o the_o head-collector_n to_o the_o receiver-general_a of_o that_o county_n city_n town_n or_o liberty_n respective_o to_o be_v by_o he_o return_v into_o his_o majesty_n exchequer_n whereupon_o every_o person_n so_o make_v default_n of_o payment_n may_v be_v charge_v by_o process_n of_o the_o court_n according_a to_o the_o course_n thereof_o in_o that_o behalf_n degree_n none_o shall_v be_v double_o charge_v for_o his_o title_n or_o degree_n of_o exemption_n allowable_a against_o this_o tax_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o letter_n patent_n grant_v by_o the_o king_n majesty_n or_o any_o of_o his_o royal_a progenitor_n or_o to_o be_v grant_v by_o his_o majesty_n to_o any_o person_n or_o person_n city_n borough_n or_o town_n corporate_a within_o this_o realm_n of_o any_o manner_n of_o liberty_n privilege_n or_o exemption_n from_o subsidy_n toll_n tax_n assessment_n or_o aid_n shall_v be_v construe_v or_o take_v to_o exempt_v any_o person_n or_o person_n city_n borough_n or_o town-corporate_a or_o any_o the_o inhabitant_n of_o the_o same_o from_o the_o burden_n and_o charge_n of_o any_o sum_n or_o sum_n of_o money_n grant_v by_o this_o act_n or_o any_o other_o act_n of_o this_o parliament_n now_o in_o force_n to_o the_o aid_n and_o supply_v of_o his_o majesty_n in_o the_o present_a war_n and_o all_o non-obstantes_a in_o any_o such_o letter_n patent_n make_v or_o to_o be_v make_v in_o bar_n of_o any_o act_n or_o act_n of_o parliament_n for_o the_o supply_n or_o assistance_n of_o his_o majesty_n be_v hereby_o declare_v to_o be_v void_a and_o of_o none_o effect_n obstante_fw-la non_fw-la obstante_fw-la any_o such_o letter_n patent_n grant_n or_o chatter_v or_o any_o clause_n of_o non_fw-la obstante_fw-la or_o other_o matter_n or_o thing_n therein_o contain_v account_v for_o all_o the_o money_n by_o he_o receive_v and_o to_o be_v account_v for_o upon_o such_o act_n or_o act_n before_o michaelmas_n one_o thousand_o six_o hundred_o sixty_o six_o shall_v be_v appoint_v receiver_n for_o any_o the_o money_n due_a by_o this_o act_n and_o shall_v intermeddle_v therein_o every_o such_o person_n shall_v forfeit_v the_o sum_n of_o five_o hundred_o pound_n to_o be_v recover_v by_o any_o person_n or_o person_n that_o will_v sue_v for_o the_o same_o in_o any_o of_o his_o majesty_n court_n of_o record_n by_o action_n of_o debt_n bill_n plaint_n or_o other_o all_o and_o every_o sum_n and_o sum_n of_o money_n to_o all_o person_n for_o money_n lend_v wares_n good_n or_o victual_n or_o other_o necessary_n buy_v or_o ship_n hire_v or_o other_o payment_n order_n according_a to_o the_o tenor_n thereof_o shall_v be_v obey_v by_o all_o person_n concern_v therein_o respective_o and_o shall_v conclude_v and_o bind_v they_o their_o heir_n successor_n executor_n administrator_n and_o assign_v respective_o notwithstanding_o any_o disability_n in_o respect_n of_o coverture_n infancy_n nonsanity_n of_o memory_n estate_n tail_n or_o in_o right_n of_o the_o church_n or_o otherwise_o and_o that_o infant_n feme_v covert_a idiot_n person_n of_o non-sane_a memory_n or_o beyond_o the_o sea_n tenant_n in_o tail_n bishop_n dean_n and_o chapter_n and_o other_o ecclesiastical_a person_n and_o their_o successor_n corporation_n and_o all_o other_o person_n or_o person_n body_n natural_a and_o politic_a their_o heir_n and_o successor_n and_o their_o respective_a interest_n shall_v be_v bind_v and_o conclude_v by_o such_o respective_a order_n or_o order_n according_a to_o the_o tenor_n or_o purport_n thereof_o any_o law_n statute_n or_o custom_n or_o other_o matter_n or_o thing_n to_o the_o contrary_a notwithstanding_o and_o for_o the_o better_a enable_v the_o say_a justice_n and_o baron_n to_o procee_v with_o effect_n in_o the_o say_a cause_n complaint_n how_o to_o proceed_v upon_o complaint_n be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a justice_n and_o baron_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a upon_o the_o complaint_n or_o request_n of_o any_o person_n or_o person_n concern_v in_o any_o of_o the_o say_a house_n or_o building_n and_o other_o the_o premise_n shall_v issue_v out_o note_n or_o warrant_n under_o their_o hand_n or_o the_o hand_n of_o any_o such_o three_o of_o they_o thereby_o warn_v the_o person_n or_o person_n body_n politic_a and_o corporate_a therein_o name_v and_o concern_v in_o the_o say_v late_a house_n or_o building_n and_o other_o the_o premise_n in_o such_o complaint_n mention_v to_o appear_v before_o they_o at_o such_o time_n and_o place_n as_o in_o such_o note_n or_o note_n shall_v in_o that_o behalf_n be_v specify_v and_o upon_o appearance_n of_o the_o say_a person_n or_o person_n summon_v or_o upon_o default_n of_o appearance_n and_o oath_n make_v of_o due_a notice_n give_v to_o he_o or_o they_o which_o oath_n and_o all_o other_o oath_n necessary_a to_o the_o execution_n of_o the_o power_n give_v by_o this_o of_o subpoena_n shall_v be_v account_v to_o be_v a_o good_a service_n in_o the_o case_n aforesaid_a record_n the_o say_a indicature_n shall_v be_v a_o court_n of_o record_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a justice_n and_o baron_n or_o any_o three_o of_o they_o for_o the_o matter_n and_o according_a to_o the_o power_n herein_o before_o mention_v shall_v be_v and_o shall_v be_v take_v to_o be_v a_o court_n of_o record_n and_o that_o the_o judgement_n and_o determination_n that_o shall_v be_v make_v betwixt_o party_n and_o party_n by_o authority_n of_o this_o act_n shall_v be_v record_v in_o a_o book_n or_o book_n of_o parchment_n to_o be_v provide_v for_o that_o purpose_n and_o that_o every_o such_o judgement_n and_o determination_n shall_v be_v sign_v by_o three_o or_o more_o of_o the_o say_a justice_n or_o baron_n which_o say_v book_n or_o book_n of_o record_n shall_v be_v place_v and_o entrust_v in_o the_o custody_n of_o the_o lord_n mayor_n and_o alderman_n of_o the_o city_n of_o london_n for_o the_o time_n be_v to_o be_v keep_v with_o the_o record_n of_o the_o say_a city_n and_o to_o remain_v as_o a_o
