which_o the_o king_n have_v already_o do_v or_o in_o respect_n of_o what_o the_o recusant_n after_o his_o conviction_n have_v omit_v to_o do_v and_o therefore_o if_o a_o man_n be_v convict_v of_o recusancy_n upon_o a_o popular_a suit_n or_o a_o action_n of_o debt_n at_o the_o king_n suit_n alone_o in_o which_o case_n the_o penalty_n of_o twenty_o pound_n per_fw-la month_n be_v not_o otherwise_o then_o in_o some_o open_a church_n or_o chappel_n and_o otherwise_o then_o according_a to_o the_o order_n of_o the_o church_n of_o england_n by_o a_o minister_n lawful_o authorize_v or_o reside_v when_o he_o or_o they_o be_v or_o be_v so_o admit_v or_o place_v within_o the_o city_n of_o london_n or_o westminster_n or_o within_o thirty_o mile_n of_o the_o same_o shall_v take_v the_o say_a oath_n aforesaid_a in_o the_o say_v respective_a court_n or_o court_n aforesaid_a in_o the_o next_o term_n after_o such_o he_o or_o their_o admittance_n or_o admittance_n into_o the_o convocation_n any_o thing_n in_o this_o act_n contain_v to_o the_o contrary_a notwithstanding_o witness_n none_o shall_v be_v indict_v or_o arraign_v but_o by_o witness_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n shall_v be_v hereafter_o indict_v or_o arraign_v for_o any_o of_o the_o offence_n make_v ordain_v revive_v or_o adjudge_v by_o this_o act_n unless_o there_o be_v two_o sufficient_a witness_n or_o more_o to_o testify_v and_o declare_v the_o say_v offence_n whereof_o he_o shall_v be_v indict_v or_o arraign_v and_o that_o the_o say_v witness_n or_o so_o many_o of_o they_o as_o shall_v be_v live_v and_o within_o this_o realm_n at_o the_o time_n of_o arraignment_n of_o such_o person_n so_o indict_v shall_v be_v bring_v esq_n and_o agnes_n his_o wife_n rome_n chetwoods_n appeal_n to_o the_o court_n of_o rome_n by_o the_o name_n of_o agnes_n woodhull_n at_o the_o suit_n of_o charles_n tyrrel_n gent._n in_o a_o cause_n of_o matrimony_n solemnize_v betweén_n the_o say_v richard_n and_o agnes_n as_o by_o the_o same_o pretend_a sentence_n more_o plain_o do_v appear_v from_o which_o sentence_n the_o say_a richard_n session_n of_o this_o present_a parliament_n that_o then_o the_o same_o shall_v be_v judge_v and_o take_v to_o be_v good_a and_o effectual_a in_o the_o law_n and_o shall_v and_o may_v be_v use_v plead_v and_o allow_v in_o any_o court_n or_o place_n within_o this_o realm_n any_o thing_n in_o this_o act_n or_o in_o any_o other_o act_n or_o statute_n contain_v to_o the_o contrary_a same_o as_o they_o may_v do_v against_o any_o person_n be_v indict_v before_o they_o of_o trespass_n or_o lawful_o convict_v thereof_o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a offender_n a_o bishop_n may_v join_v with_o the_o justice_n to_o inquire_v of_o offender_n that_o all_o and_o every_o archbishop_n and_o bishop_n shall_v or_o may_v at_o all_o time_n and_o time_n at_o his_o liberty_n and_o pleasure_n join_v and_o associate_v himself_o by_o virtue_n of_o this_o act_n to_o the_o say_a justice_n of_o oyer_n and_o determiner_n or_o to_o the_o say_a justice_n of_o assize_n at_o every_o of_o the_o say_v open_a and_o general_a session_n to_o be_v hold_v in_o any_o place_n within_o his_o diocese_n for_o and_o to_o the_o enquiry_n hear_v and_o determine_v of_o the_o offence_n aforesaid_a provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a get_v at_o who_o charge_n the_o book_n of_o common_a prayer_n shall_v be_v get_v that_o the_o book_n concern_v the_o say_a service_n shall_v at_o the_o cost_v and_o charge_n of_o the_o parishioner_n of_o every_o parish_n and_o cathedral_n church_n be_v attain_v and_o get_v before_o the_o say_a feast_n of_o the_o nativity_n of_o st._n john_n baptist_n next_o follow_v and_o that_o all_o such_o parish_n and_o cathedral_n church_n or_o other_o place_n where_o the_o say_v book_n shall_v be_v attain_v and_o get_v before_o the_o say_a feast_n of_o the_o nativity_n of_o st._n john_n baptist_n shall_v within_o three_o week_n next_o after_o the_o say_v book_n so_o attain_v and_o get_v use_v the_o say_a service_n and_o put_v the_o same_o in_o ure_n according_a to_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a impeach_v within_o what_o time_n the_o offender_n shall_v be_v impeach_v that_o no_o person_n or_o person_n shall_v be_v at_o any_o time_n hereafter_o impeach_v or_o otherwise_o molest_v of_o or_o for_o any_o the_o offence_n abovementioned_a hereafter_o to_o be_v commit_v or_o do_v contrary_a to_o this_o act_n unless_o he_o or_o they_o so_o offend_v be_v thereof_o indict_v at_o the_o next_o general_a session_n to_o be_v hold_v before_o any_o such_o justice_n of_o oyer_n and_o determiner_n or_o justice_n of_o assize_n next_o after_o any_o offence_n commit_v or_o do_v contrary_a to_o the_o tenor_n of_o this_o act._n provide_v always_o peer_n trial_n of_o peer_n and_o be_v it_o ordain_v and_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o singular_a lord_n of_o the_o parliament_n for_o the_o three_o offence_n abovementioned_a shall_v be_v try_v by_o their_o peer_n provide_v also_o offender_n stat._n sect._n 11._o chief_z officer_n of_o city_n and_o borough_n shall_v inquire_v of_o offender_n and_o be_v it_o ordain_v and_o enact_v by_o the_o authority_n aforesaid_a that_o the_o mayor_n of_o london_n and_o all_o other_o mayor_n bailiff_n and_o other_o head_n officer_n of_o all_o and_o singular_a city_n borough_n and_o town_n corporate_a within_o this_o realm_n wales_n and_o the_o march_n of_o the_o same_o to_o the_o which_o justice_n of_o assize_n do_v not_o common_o repair_v shall_v have_v full_a power_n and_o authority_n by_o virtue_n of_o this_o act_n to_o inquire_v hear_v and_o determine_v the_o offence_n aforesaid_a and_o every_o of_o they_o yearly_o within_o fifteen_o day_n after_o the_o feast_n of_o easter_n and_o st._n michael_n the_o archangel_n in_o like_a manner_n and_o form_n as_o justice_n of_o assize_n and_o oyer_n and_o determiner_n may_v do_v these_o word_n in_o like_v manner_n and_o form_n appoint_v in_o what_o manner_n the_o offence_n shall_v be_v inquire_v of_o corporation_n mayor_n and_o head_n officer_n of_o corporation_n hear_v and_o determine_v by_o mayor_n and_o head_n officer_n of_o corporation_n etc._n etc._n by_o indictment_n for_o so_o much_o inquire_v import_v and_o trial_n and_o verdict_n of_o twelve_o man_n or_o such_o nor_o be_v mayor_n and_o head_n officer_n tie_v to_o their_o next_o session_n as_o the_o justice_n of_o oyer_n and_o determiner_n and_o of_o assize_n be_v as_o wingate_n tit_n service_n and_o sacrament_n numb_a 26._o mistake_v the_o meaning_n of_o the_o statute_n for_o in_o like_a manner_n and_o form_n be_v intend_v in_o such_o respect_n only_o where_o it_o be_v not_o otherwise_o provide_v for_o by_o the_o statute_n but_o it_o be_v express_o provide_v here_o that_o mayor_n and_o head_n officer_n of_o corporation_n shall_v inquire_v of_o these_o offence_n only_o twice_o in_o the_o year_n officer_n of_o a_o corporation_n as_o wingate_n tit_n service_n and_o sacrament_n number_n 25._o mistake_n case_n stat._n sect._n 12._o the_o ordinary_n jurisdiction_n in_o these_o case_n provide_v always_o and_o be_v it_o ordain_v and_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o singular_a archbishop_n and_o bishop_n and_o every_o of_o their_o chancellor_n commissary_n c._n 41._o the_o same_o case_n so_o that_o a_o conviction_n upon_o a_o information_n against_o the_o recusant_n upon_o 23._o or_o any_o other_o way_n save_v by_o indictment_n do_v not_o appropriate_v the_o penalty_n of_o twenty_o pound_n per_fw-la month_n to_o the_o king_n for_o the_o time_n to_o come_v by_o force_n of_o this_o statute_n hobart_n 205._o pie_n and_o lovell_n case_n nor_o for_o the_o same_o reason_n by_o force_n of_o that_o 3_o jac._n cap._n 4._o where_o the_o same_o word_n be_v use_v and_o a_o conviction_n by_o indictment_n only_o intend_v as_o here_o in_o that_o case_n of_o pie_n and_o lovel_n be_v say_v that_o if_o a_o man_n at_o the_o make_n of_o this_o statute_n have_v be_v convict_v of_o recusancy_n by_o any_o other_o mean_v then_o by_o indictment_n he_o have_v not_o be_v bind_v by_o this_o law_n to_o pay_v the_o twenty_o shilling_n it_o shall_v be_v twenty_o pound_n a_o month_n from_o the_o conviction_n and_o if_o a_o man_n be_v now_o convict_v in_o the_o king_n bench_n by_o indictment_n or_o otherwise_o he_o can_v be_v proclaim_v nor_o otherwise_o his_o penalty_n run_v on_o which_o last_o word_n infer_v that_o the_o conviction_n here_o intend_v be_v only_o a_o conviction_n according_a to_o this_o statute_n by_o proclamation_n upon_o default_n but_o if_o we_o compare_v together_o this_o clause_n which_o speak_v of_o a_o conviction_n after_o the_o make_n of_o this_o statute_n and_o the_o former_a clause_n which_o speak_v of_o a_o conviction_n before_o this_o statute_n the_o contrary_a will_n evident_o appear_v for_o the_o former_a clause_n touch_v conviction_n before_o this_o statute_n must_v necessary_o be_v intend_v of_o conviction_n according_a to_o 23_o eliz._n cap._n 1._o without_o any_o proclamation_n for_o the_o proclamation_n in_o the_o case_n of_o recusancy_n be_v not_o give_v until_o 29._o and_o if_o a_o man_n have_v be_v convict_v of_o recusancy_n upon_o indictment_n in_o the_o king_n bench_n or_o elsewhere_o before_o this_o act_n the_o forfeiture_n of_o 20_o l._n per_fw-la month_n shall_v by_o force_n of_o this_o act_n have_v run_v on_o from_o the_o time_n of_o such_o conviction_n that_o be_v clear_a by_o the_o express_a word_n of_o the_o former_a clause_n then_o come_v this_o clause_n which_o provide_v what_o shall_v be_v do_v upon_o conviction_n for_o the_o future_a and_o appoint_v in_o that_o case_n likewise_o the_o forfeiture_n of_o 26_o l._n per_fw-la month_n to_o run_v on_o from_o the_o time_n of_o conviction_n both_o which_o conviction_n as_o well_o before_o as_o after_o this_o statute_n be_v grant_v to_o be_v mean_v only_o of_o conviction_n upon_o indictment_n and_o there_o be_v no_o difference_n between_o the_o pen_n of_o these_o two_o clause_n but_o that_o one_o respect_v the_o time_n past_a and_o the_o other_o the_o time_n to_o come_v but_o both_o appoint_v the_o penalty_n to_o run_v on_o now_o there_o be_v no_o reason_n to_o suppose_v that_o the_o maker_n of_o the_o law_n intend_v the_o word_n convict_v in_o a_o more_o restrain_a sense_n in_o this_o clause_n then_o in_o the_o former_a clause_n where_o the_o penalty_n shall_v have_v run_v on_o upon_o any_o conviction_n whatsoever_o upon_o indictment_n or_o that_o the_o conviction_n in_o the_o former_a clause_n by_o indictment_n upon_o 23._o without_o proclamation_n shall_v be_v whole_o shut_v out_o of_o the_o late_a clause_n by_o conviction_n therefore_o in_o these_o two_o clause_n seem_v to_o be_v mean_v such_o conviction_n upon_o indictment_n as_o be_v warrant_v by_o the_o statute_n in_o force_n at_o the_o several_a and_o respective_a time_n here_o mention_v that_o be_v in_o the_o former_a which_o speak_v of_o the_o time_n forego_v a_o conviction_n upon_o 23_o eliz._n without_o proclamation_n and_o in_o this_o late_a which_o speak_v of_o the_o time_n to_o come_v a_o conviction_n either_o with_o or_o without_o a_o proclamation_n in_o either_o of_o which_o case_n the_o penalty_n of_o 20_o l._n per_fw-la month_n shall_v run_v on_o by_o force_n of_o this_o act_n and_o consequent_o it_o shall_v run_v on_o if_o the_o recusant_n be_v indict_v convict_a and_o adjudge_v in_o the_o king_n bench_n although_o he_o can_v be_v proclaim_v there_o and_o according_o it_o be_v agree_v in_o dr._n foster_n case_n that_o where_o the_o recusant_n be_v convict_v upon_o indictment_n the_o penalty_n shall_v ever_o after_o run_v on_o and_o be_v appropriate_v to_o the_o king_n roile_n 1._o 93._o c._n 41._o and_o it_o be_v not_o restrain_v there_o to_o a_o conviction_n upon_o proclamation_n only_o but_o avoid_v or_o discharge_v for_o some_o defect_n in_o the_o indictment_n proclamation_n or_o other_o proceed_n and_o then_o the_o testator_n die_v in_o such_o case_n the_o recusant_n be_v not_o by_o this_o act_n disable_v to_o be_v executor_n for_o although_o the_o name_n of_o a_o executor_n be_v in_o law_n a_o grant_n of_o administration_n and_o if_o a_o man_n by_o his_o last_o will_n grant_v the_o administration_n of_o his_o good_n and_o chattel_n to_o j._n s._n without_o more_o say_n thereby_o j._n s._n be_v make_v his_o executor_n dyer_n 290._o so_o that_o the_o name_n of_o a_o executor_n and_o the_o grant_n of_o administration_n seem_v to_o be_v the_o same_o thing_n yet_o this_o be_v not_o a_o grant_n of_o administration_n within_o the_o meaning_n of_o this_o act_n administration_n here_o relate_v only_o to_o a_o administrator_n and_o not_o to_o a_o executor_n beside_o the_o name_n of_o a_o executor_n amount_v not_o to_o a_o complete_a grant_n of_o administration_n until_o the_o testator_n death_n for_o then_o and_o not_o before_o the_o will_n become_v in_o force_n and_o if_o the_o party_n stand_v not_o then_o convict_v he_o be_v not_o disable_v much_o less_o shall_v he_o be_v disable_v to_o be_v executor_n who_o be_v not_o convict_v at_o the_o time_n of_o the_o testator_n death_n although_o he_o be_v convict_v at_o the_o time_n of_o the_o probate_n of_o the_o will_n for_o if_o these_o word_n grant_v of_o administration_n shall_v relate_v to_o a_o executor_n as_o well_o as_o to_o a_o administrator_n which_o in_o truth_n they_o do_v
