in_o the_o county_n of_o rappahanack_n stafford_n westmorland_z and_z northumberland_z who_o by_o the_o newness_n of_o their_o ground_n pretend_v themselves_o uncapable_a of_o make_v provision_n for_o the_o soon_o employment_n of_o a_o weaver_n be_v respite_v for_o four_o year_n after_o the_o date_n hereof_o xi_o a_o act_n impose_v a_o fine_a for_o entertain_v runaway_n whereas_o divers_a ill_n dispose_v person_n not_o value_v the_o fine_a impose_v by_o act_n which_o by_o the_o inconsiderableness_n thereof_o they_o think_v not_o worth_a the_o pain_n or_o charge_n of_o recovery_n do_v harbour_n and_o give_v entertainment_n to_o loiter_v runaway_n servant_n for_o two_o or_o three_o day_n or_o more_o thereby_o encourage_v the_o say_a servant_n in_o such_o lewd_a course_n for_o prevention_n whereof_o be_v it_o enact_v by_o the_o authority_n of_o this_o present_a grand_a assembly_n fine_v such_o as_o entertain_v runaway_n fine_v that_o what_o person-soev_a contrary_a to_o the_o act_n in_o force_n shall_v harbour_v or_o entertain_v any_o such_o runaway_n servant_n shall_v be_v fine_v and_o pay_v sixty_o pound_n of_o tobacco_n for_o each_o day_n and_o night_n he_o shall_v so_o harbour_v they_o to_o be_v recover_v by_o the_o master_n or_o owner_n of_o the_o say_a servant_n by_o action_n of_o debt_n in_o any_o court_n of_o judicature_n in_o this_o country_n this_o act_n extend_v only_o to_o those_o servant_n that_o serve_v by_o their_o first_o indenture_n xii_o a_o act_n concern_v servant_n come_v in_o without_o indenture_n whereas_o the_o present_a act_n in_o force_n prescribe_v how_o long_a servant_n come_v in_o without_o indenture_n shall_v serve_v enjoin_v all_o servant_n adjudge_v by_o the_o court_n to_o be_v sixteen_o year_n of_o age_n to_o serve_v but_o five_o year_n and_o all_o under_o to_o serve_v until_o they_o be_v twenty_o four_o year_n old_a by_o which_o inequality_n a_o servant_n if_o adjudge_v never_o so_o little_a under_o year_n if_o under_o that_o age_n then_o to_o serve_v so_o many_o year_n as_o he_o want_v of_o twenty_o four_o when_o his_o age_n be_v adjudge_v by_o the_o court_n and_o that_o every_o master_n to_o bear_v their_o own_o charge_n whereas_o the_o charge_n of_o prosecute_a criminal_a person_n have_v be_v hitherto_o usual_o defray_v part_n by_o the_o public_a county_n criminal_n have_v estate_n shall_v defray_v the_o charge_n of_o their_o own_o prosecution_n otherwise_o to_o be_v
public_a or_o countie-dues_a or_o other_o fee_n as_o aforesaid_a any_o sheriff_n or_o collector_n shall_v at_o any_o time_n make_v seizure_n or_o distress_n of_o more_o tobacco_n than_o be_v at_o that_o time_n due_a from_o the_o debtor_n that_o in_o all_o such_o case_n public_a a_o regulation_n of_o seizure_n make_v of_o tobacco_n due_a to_o the_o public_a the_o person_n seize_v shall_v make_v immediate_a satisfaction_n to_o the_o party_n from_o who_o they_o shall_v make_v such_o seizure_n or_o otherways_o that_o he_o be_v allow_v to_o take_v his_o overplus_a tobacco_n out_o of_o the_o hogshead_n so_o seize_v and_o that_o no_o sheriff_n or_o other_o public_a collector_n shall_v or_o may_v from_o or_o after_o the_o publication_n of_o this_o act_n presume_v to_o make_v seizure_n of_o any_o hogshead_n of_o tobacco_n before_o that_o time_n pay_v away_o and_o mark_v and_o if_o there_o be_v at_o that_o time_n other_o merchantable_a tobacco_n ready_a in_o such_o plantation_n where_o such_o seizure_n be_v make_v and_o which_o shall_v be_v offer_v and_o tender_v by_o the_o debtor_n and_o be_v it_o further_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o the_o justice_n hold_v court_n be_v by_o virtue_n of_o this_o act_n for_o the_o time_n to_o come_v full_o impower_v right_n honourable_a the_o governor_n administration_n any_o two_o justice_n of_o the_o quorum_fw-la may_v sign_v probates_n of_o will_n and_o letter_n of_o administration_n which_o be_v not_o only_o burdensome_a to_o his_o honour_n but_o inconvenient_a to_o the_o inhabitant_n be_v it_o enact_v that_o from_o &_o after_o publication_n hereof_o it_o shall_v and_o may_v be_v lawful_a for_o any_o deem_v good_a in_o law_n provide_v always_o that_o certificate_n thereof_o be_v send_v to_o mr._n secretataries_n office_n as_o be_v provide_v by_o the_o aforesaid_a act_n of_o assembly_n ix_o a_o act_n repeal_n the_o act_n allow_v free_a tythable_n to_o divers_a person_n whereas_o by_o several_a act_n of_o assembly_n it_o be_v provide_v that_o every_o respective_a councillor_n and_o ten_o of_o his_o family_n shall_v be_v free_a from_o pay_v any_o public_a or_o county-levy_n and_o also_o that_o every_o minister_n and_o six_o tythable_n for_o their_o attendance_n at_o james_n city_n in_o attend_v at_o general_n court_v shall_v be_v distribute_v and_o proportion_v among_o the_o several_a councillor_n attend_v at_o general_n court_n and_o assembly_n according_a to_o their_o attendance_n at_o the_o same_o proportionable_o which_o distribution_n and_o proportion_v shall_v be_v annual_o make_v by_o the_o right_n honourable_a the_o governor_n and_o the_o several_a councillor_n according_a to_o their_o attendance_n more_o or_o less_o at_o general_a court_n or_o assembly_n and_o be_v it_o further_o enact_v by_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o there_o be_v annual_o pay_v out_o of_o the_o say_a impost_n money_n to_o such_o minister_n or_o minister_n as_o by_o the_o right_n honourable_a the_o governor_n shall_v be_v appoint_v and_o if_o after_o the_o proportion_v the_o tythable_n of_o each_o or_o any_o county_n into_o forty_n and_o less_o number_n shall_v remain_v such_o tythable_n shall_v be_v assess_v by_o the_o justice_n proportionable_o to_o the_o rest_n to_o help_v to_o defray_v the_o whole_a charge_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v that_o that_o for_o the_o future_a two_o man_n be_v make_v choice_n of_o by-law_n two_o man_n shall_v be_v choose_v in_o each_o parish_n by_o the_o freeholder_n and_o housekeeper_n to_o sit_v with_o the_o justice_n in_o county-court_n for_o make_v of_o by-law_n in_o each_o parish_n by_o the_o major_a vote_n of_o the_o freeholder_n and_o housekeeper_n in_o the_o say_a parish_n at_o such_o time_n and_o place_n as_o by_o the_o county-courts_a shall_v be_v appoint_v which_o then_o so_o choose_v as_o aforesaid_a shall_v be_v return_v by_o the_o church_n warden_n and_o shall_v sit_v in_o the_o several_a estern_a shoar_n to_o ship_v their_o tobacco_n without_o certificate_n repeal_v and_o that_o the_o inhabitant_n on_o potomack_n river_n and_o on_o the_o eastern_a shore_n have_v like_a and_o equal_a liberty_n and_o privilege_n with_o the_o rest_n his_o majesty_n subject_n in_o this_o colony_n to_o sell_v dispose_n pay_v and_o make_v delivery_n of_o their_o tobacco_n to_o their_o best_a advantage_n and_o convenience_n vi_o a_o act_n ascertain_v collector_n fee_n for_o entry_n and_o clear_n ship_n etc._n etc._n whereas_o several_a complaint_n have_v be_v make_v to_o this_o present_a grand_a assembly_n that_o several_a collector_n in_o this_o colony_n have_v exact_v and_o take_v great_a and_o unreasonable_a fee_n for_o enter_v and_o clear_v ship_n and_o small_a vessel_n trade_v into_o this_o country_n which_o if_o permit_v and_o continue_v may_v prove_v prejudicial_a to_o trade_n for_o prevention_n whereof_o for_o the_o future_a be_v it_o enact_v by_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o from_o hence_o forward_o no_o collector_n or_o collector_n shall_v or_o may_v demand_v or_o take_v other_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o all_o justice_n sit_v in_o court_n security_n administrator_n of_o orphan_n estate_n shall_v give_v good_a security_n whensoever_o administration_n be_v sue_v for_o and_o grant_v and_o shall_v upon_o grant_v order_n or_o order_n of_o administration_n neglect_v to_o make_v order_n for_o security_n as_o be_v before_o enjoin_v to_o be_v take_v shall_v thereby_o and_o for_o such_o their_o neglect_n become_v liable_a to_o make_v good_a such_o estate_n in_o case_n the_o same_o shall_v be_v imbezelled_a by_o such_o administrator_n country_n and_o the_o inhabitant_n thereof_o for_o prevention_n of_o like_a mischief_n and_o inconvenience_n for_o the_o future_a be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o the_o ten_o day_n of_o october_n next_o after_o this_o present_a session_n no_o tobacco_n pack_v in_o cask_n or_o otherways_o shall_v be_v bring_v from_o
or_o attorney_n so_o license_v as_o aforesaid_a take_v demand_n or_o receive_v from_o any_o person_n for_o any_o cause_n in_o the_o general_a court_n county-courts_a five_o hundred_o pound_n of_o tobacco_n the_o attorney_n fee_fw-mi for_o plead_v a_o cause_n in_o the_o general_n court_n and_o 150_o for_o every_o cause_n in_o county-courts_a and_o bring_v the_o same_o to_o judgement_n more_o than_o five_o hundred_o pound_n of_o tobacco_n and_o cask_n and_o for_o any_o cause_n in_o the_o county-court_n and_o bring_v the_o same_o there_o to_o judgement_n more_o than_o one_o hundred_o and_o fifty_o pound_n of_o tobacco_n and_o cask_n and_o it_o be_v hereby_o declare_v and_o enact_v that_o every_o attorney_n or_o attorney_n shall_v have_v for_o every_o cause_n he_o undertake_v in_o the_o general_a court_n five_o hundred_o pound_n of_o tobacco_n and_o cask_n and_o for_o every_o cause_n he_o undertake_v in_o the_o county-court_n one_o hundred_o and_o fifty_o pound_n of_o tobacco_n and_o five_o hundred_o pound_n of_o tobacco_n and_o cask_n shall_v forfeit_v and_o pay_v to_o the_o person_n grieve_v five_o hundred_o pound_n of_o tobacco_n and_o cask_n after_o legal_a conviction_n on_o due_a proof_n thereof_o make_v to_o be_v recover_v by_o due_a process_n of_o law_n aforesaid_a fine_a lay_v on_o attorney_n refuse_v to_o plead_v for_o the_o fee_fw-mi aforesaid_a and_o upon_o refusal_n of_o any_o cause_n in_o the_o county-court_n shall_v pay_v to_o the_o party_n grieve_v one_o hundred_o and_o fifty_o pound_n of_o tobacco_n and_o cask_n after_o legal_a conviction_n as_o aforesaid_a to_o be_v recover_v by_o due_a process_n of_o law_n cause_n any_o person_n may_v notwithstanding_o plead_v his_o own_o cause_n provide_v always_o that_o this_o act_n or_o any_o clause_n therein_o shall_v not_o extend_v to_o debar_v any_o man_n that_o be_v capable_a of_o plead_v and_o manage_v his_o own_o cause_n in_o any_o the_o say_a general_n or_o county-courts_a but_o that_o he_o may_v be_v permit_v and_o allow_v to_o plead_v and_o manage_v his_o own_o business_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o vii_o a_o act_n ascertain_v the_o time_n before_o one_o single_a justice_n of_o the_o peace_n if_o the_o same_o exceed_v not_o two_o hundred_o pound_n of_o tobacco_n x_o a_o act_n for_o prevent_v negro_n insurrection_n whereas_o the_o frequent_a meeting_n of_o considerable_a number_n of_o negro-slave_n under_o pretence_n of_o feast_n and_o burial_n be_v judge_v and_o deem_v of_o dangerous_a consequence_n for_o prevention_n whereof_o for_o the_o future_a be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o from_o and_o after_o the_o publication_n of_o this_o law_n it_o shall_v not_o be_v lawful_a for_o any_o negro_n or_o other_o slave_n to_o carry_v or_o arm_v himself_o with_o any_o club_n staff_n gun_n sword_n or_o any_o other_o weapon_n of_o defence_n certificate_n negro_n shall_v not_o go_v arm_v nor_o depart_v from_o off_o their_o master_n ground_n without_o certificate_n or_o offence_n nor_o to_o go_v or_o depart_v from_o off_o his_o master_n ground_n without_o a_o certificate_n from_o his_o master_n mistress_z or_o overseer_n and_o such_o permission_n not_o to_o be_v grant_v but_o upon_o particular_a and_o necessary_a occasion_n and_o every_o negro_n or_o slave_n so_o offend_v not_o have_v certificate_n as_o aforesaid_a shall_v be_v send_v to_o the_o next_o constable_n who_o be_v hereby_o enjoin_v and_o require_v to_o give_v the_o say_a negro_n twenty_o lash_n on_o the_o bare_a back_n well_o lay_v on_o and_o so_o send_v home_o to_o his_o say_a master_n mistress_z or_o overseer_n punish_v resistance_n of_o negro_n or_o any_o other_o slave_n punish_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o negro_n or_o other_o slave_n shall_v presume_v to_o lift_v up_o his_o hand_n in_o opposition_n against_o any_o christian_a shall_v for_o every_o such_o offence_n upon_o due_a proof_n make_v thereof_o by_o the_o oath_n of_o the_o party_n before_o a_o magistrate_n have_v and_o receive_v thirty_o lash_n on_o the_o bare_a back_n well_o lay_v on_o and_o it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o negro_n or_o other_o slave_n shall_v absent_v himself_o from_o his_o master_n service_n and_o lie_v hide_v and_o lurk_v in_o obscure_a place_n commit_v injury_n to_o the_o inhabitant_n &_o shall_v resist_v any_o person_n or_o person_n that_o shall_v by_o any_o lawful_a authority_n be_v employ_v to_o apprehend_v &_o take_v the_o say_a negro_n that_o then_o in_o case_n of_o such_o resistance_n kill_v fugitive-negroe_n resist_v such_o as_o be_v employ_v to_o apprehend_v they_o may_v be_v kill_v it_o shall_v be_v lawful_a for_o such_o person_n or_o person_n to_o kill_v the_o say_a negro_n or_o slave_n so_o lie_v out_o and_o resist_a and_o that_o this_o law_n be_v once_o every_o six_o month_n publish_v at_o the_o respective_a
