immediate_a satisfaction_n to_o the_o party_n from_o who_o they_o shall_v make_v such_o seizure_n or_o otherways_o that_o he_o be_v allow_v to_o take_v his_o overplus_a tobacco_n out_o of_o the_o hogshead_n so_o seize_v and_o that_o no_o sheriff_n or_o other_o public_a collector_n shall_v or_o may_v from_o or_o after_o the_o publication_n of_o this_o act_n presume_v to_o make_v seizure_n of_o the_o master_n of_o such_o ship_n or_o vessel_n shall_v deliver_v his_o boats-swain_n book_n to_o the_o perusal_n of_o the_o collector_n and_o make_v oath_n of_o the_o truth_n of_o the_o same_o so_o far_o as_o he_o know_v and_o that_o the_o mate_n boats-swain_n or_o any_o other_o sea_n man_n be_v swear_v if_o the_o collector_n see_v cause_n to_o discover_v the_o truth_n of_o the_o say_v freight_n and_o if_o any_o master_n of_o ship_n or_o vessel_n shall_v witting_o or_o willing_o conceal_v any_o part_n of_o his_o freight_n from_o the_o collector_n sterling_n master_n of_o ship_n conceal_v say_a imposition_n be_v it_o therefore_o enact_v that_o every_o planter_n in_o the_o county_n of_o northumberland_n and_o westmoreland_n shall_v certify_v into_o the_o collector_n office_n or_o unto_o his_o deputy_n the_o number_n of_o hogshead_n of_o tobacco_n make_v by_o he_o and_o his_o family_n and_o to_o who_o they_o be_v sell_v and_o shall_v not_o suffer_v any_o of_o the_o say_a hogshead_n of_o tobacco_n to_o be_v carry_v out_o of_o his_o house_n until_o he_o receive_v certificate_n from_o the_o say_a collector_n that_o the_o imposition_n of_o the_o say_a tobacco_n be_v pay_v and_o if_o payment_n of_o those_o duty_n in_o potomack_n river_n extend_v and_o be_v in_o force_n in_o the_o say_a county_n of_o lower_n norfolk_n and_o northampton_n and_o that_o the_o collector_n appoint_v make_v payment_n of_o three_o penny_n per_fw-la hogshead_n for_o fort_n duty_n of_o the_o say_a tobacco_n as_o for_o the_o payment_n of_o the_o 2_o s._n per_fw-la hogshead_n cxxxi_o ten_o shilling_n per_fw-la hogshead_n whereas_o the_o prudence_n of_o all_o nation_n have_v provide_v for_o the_o defray_v the_o public_a necessary_a charge_n of_o the_o country_n rather_o by_o lay_v a_o imposition_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o enact_v and_o ordain_v that_o it_o shall_v not_o be_v lawful_a for_o any_o person_n whatsoever_o to_o take_v up_o any_o marsh_n swamp_n or_o sink_a land_n adjoin_v to_o any_o man_n land_n land_n who_o may_v take_v up_o swamp_n marsh_n or_o sink_a land_n but_o shall_v first_o give_v notice_n to_o the_o owner_n or_o public_a and_o county-leavies_a who_o often_o take_v advantageous_a time_n to_o demand_v and_o receive_v the_o public_a due_n and_o other_o collection_n for_o which_o they_o may_v in_o several_a case_n make_v seizure_n and_o distress_n for_o prevention_n whereof_o for_o the_o future_a be_v it_o enact_v by_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o the_o 80th_o act_n of_o assembly_n in_o the_o print_a book_n of_o act_n limit_v a_o certain_a time_n when_o creditor_n shall_v demand_v their_o debt_n shall_v be_v interpret_v and_o hold_v to_o extend_v to_o sheriff_n &_o other_o collector_n of_o the_o public_a &_o countie-leavies_a and_o of_o all_o other_o sheriff_n and_o clerk_n fee_n and_o also_o that_o all_o public_a countie-debtor_n and_o all_o debtor_n of_o or_o for_o sheriff_n or_o clerk_n fee_n may_v have_v the_o benefit_n and_o liberty_n of_o the_o second_o act_n of_o assembly_n make_v in_o the_o year_n 1666._o which_o admit_v of_o tender_v of_o tobacco_n to_o the_o creditor_n according_a to_o the_o full_a intent_n meaning_n or_o purport_n thereof_o and_o be_v it_o further_o enact_v by_o this_o attendance_n on_o the_o general_n court_n for_o every_o general_a court_n or_o assembly_n they_o shall_v attend_v and_o that_o no_o person_n or_o person_n heretofore_o tythable_a by_o any_o law_n custom_n or_o usuage_v be_v from_o henceforth_o exempt_v from_o pay_v public_a or_o county-levy_n the_o right_a honourable_a the_o governor_n and_o his_o servant_n except_v county-levy_n who_o only_o be_v exempt_v from_o the_o payment_n of_o public_a or_o county-levy_n the_o single_a person_n of_o every_o one_o of_o the_o council_n and_o also_o all_o minister_n benefice_v in_o this_o country_n and_o such_o lame_a or_o impotent_a person_n as_o either_o already_o be_v or_o shall_v from_o time_n to_o time_n be_v order_v to_o be_v exempt_v out_o of_o the_o list_n by_o the_o county-courts_a where_o they_o dwell_v x._o a_o act_n regulate_v ordinary_n and_o the_o price_n of_o liquor_n whereas_o the_o multiplicity_n of_o ordinary_n in_o this_o colony_n be_v find_v to_o be_v pernicious_a and_o hurtful_a to_o the_o inhabitant_n be_v it_o therefore_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o hold_v not_o more_o than_o two_o ordinary_n in_o any_o one_o county_n except_o in_o that_o where_o the_o general_a court_n be_v hold_v and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o the_o publication_n of_o this_o act_n there_o shall_v not_o be_v admit_v suffer_v or_o licence_v above_o two_o ordinary_n in_o any_o one_o county_n of_o this_o colony_n at_o one_o time_n except_o in_o that_o county_n where_o the_o general_a court_n shall_v be_v hold_v and_o that_o the_o power_n of_o grant_v licence_n be_v in_o the_o respective_a county_n court_v the_o right_a honourable_a the_o governor_n be_v pay_v for_o such_o licence_n according_a to_o former_a law_n in_o such_o case_n and_o that_o no_o person_n be_v license_v to_o keep_v ordinary_n but_o such_o as_o be_v accountable_a and_o will_v enter_v into_o sufficient_a bond_n to_o find_v and_o provide_v constant_o for_o traveller_n good_a diet_n lodging_n and_o horsmeat_n and_o will_v rate_v and_o sell_v their_o provision_n and_o liquor_n according_a to_o the_o rate_n and_o price_n hereafter_o set_v down_o and_o allow_v by_o this_o law_n upon_o such_o penalty_n and_o forfeiture_n as_o shall_v be_v therein_o provide_v and_o inflict_v which_o penalty_n shall_v be_v and_o belong_v the_o one_o half_a to_o the_o person_n or_o person_n who_o shall_v inform_v of_o and_o sue_v for_o the_o same_o and_o the_o other_o half_a to_o the_o county_n wherein_o the_o same_o shall_v be_v forfeit_v and_o be_v it_o enact_v by_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o all_o ordinary_n sell_v liquor_n do_v demand_n or_o take_v no_o more_o for_o virginia_n dram_fw-la strong_a beer_n or_o ale_n then_o be_v set_v down_o in_o the_o act_n of_o assembly_n lodging_n what_o price_n shall_v be_v pay_v at_o ordinary_n for_o liquor_n diet_n and_o lodging_n make_v in_o september_n 1671._o that_o the_o rate_n for_o cider_n and_o perry_n if_o boil_a be_v twenty_o pound_n of_o tobacco_n for_o one_o gallon_n and_o if_o raw_a eighteen_o pound_n of_o tobacco_n per_fw-la gallon_n that_o the_o price_n of_o lodging_n be_v three_o pound_n of_o tobacco_n for_o one_o night_n that_o the_o price_n of_o diet_n for_o indian_a corn_n after_o the_o rate_n of_o forty_o pound_n of_o tobacco_n per_fw-la bushel_n and_o for_o oat_n after_o the_o rate_n of_o sixty_o pound_n of_o tobacco_n per_fw-la bushel_n and_o that_o all_o ordinary-keeper_n be_v and_o be_v hereby_o enjoin_v to_o secure_v all_o horse_n that_o they_o have_v charge_n of_o year_n justice_n to_o appoint_v the_o price_n of_o liquor_n twice_o in_o the_o year_n from_o run_v away_o and_o be_v steal_v upon_o the_o penalty_n of_o pay_v the_o charge_n of_o find_v the_o horse_n or_o horse_n or_o pay_v for_o they_o if_o lose_v and_o that_o the_o tenfold_o such_o exaction_n and_o over_o rate_n by_o they_o demand_v or_o take_v and_o that_o all_o such_o person_n buy_v and_o expend_v at_o ordinary_n who_o shall_v at_o any_o time_n pay_v great_a rate_n then_o be_v hereby_o allow_v and_o set_v down_o forfeit_a and_o pay_v for_o every_o such_o payment_n or_o obligation_n for_o payment_n five_o fold_n the_o sum_n so_o overpay_v and_o that_o cast_v at_o law_n repeal_v and_o amerciament_n be_v pay_v and_o dispose_v to_o the_o use_n of_o the_o county_n where_o the_o same_o become_v due_a towards_o the_o defray_n of_o that_o countys-charge_n and_o that_o the_o several_a respective_a county-court_n inquire_v into_o the_o same_o and_o dispose_v of_o they_o according_o xii_o a_o act_n concern_v servant_n who_o be_v out_o in_o rebellion_n repeal_v by_o his_o excellency_n proclamation_n anno_fw-la 1680._o xiii_o a_o act_n for_o the_o lay_n of_o parish_n levy_n for_o the_o better_a and_o more_o equal_a lay_n of_o parish_n levy_n and_o the_o english_a as_o shall_v be_v set_v appoint_a and_o allow_v they_o by_o order_n and_o appointment_n of_o the_o respective_a county-courts_a in_o each_o county_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o provide_v also_o that_o it_o shall_v not_o be_v lawful_a or_o permit_v to_o any_o indian_a or_o indian_n resort_v to_o or_o meeting_n at_o any_o those_o shall_v be_v draw_v into_o one_o new_a patent_n and_o no_o new_a land_n not_o patent_v before_o add_v thereunto_o in_o such_o case_n the_o fee_n for_o such_o patent_n shall_v not_o exceed_v eighty_o pound_n of_o tobacco_n vi_o a_o act_n for_o the_o imposition_n of_o two_o shilling_n on_o every_o five_o hundred_o pound_n of_o bulk_n tobacco_n vide_fw-la act_n the_o three_o anno_fw-la 1680._o vii_o the_o act_n in_o force_n shall_v harbour_v or_o entertain_v any_o such_o runaway_n servant_n shall_v be_v fine_v and_o pay_v sixty_o pound_n of_o tobacco_n for_o each_o day_n and_o night_n he_o shall_v so_o harbour_v they_o to_o be_v recover_v by_o the_o master_n or_o owner_n of_o the_o say_a servant_n by_o action_n of_o debt_n in_o any_o court_n of_o judicature_n in_o this_o country_n act_n in_o force_n prescribe_v how_o long_a servant_n come_v in_o without_o indenture_n shall_v serve_v enjoin_v all_o servant_n adjudge_v by_o the_o court_n to_o be_v sixteen_o year_n of_o age_n to_o use_n of_o the_o garrison_n and_o the_o payment_n thereof_o such_o captain_n draw_v a_o note_n upon_o the_o next_o collector_n of_o two_o shilling_n per_fw-la hogshead_n to_o be_v by_o he_o pay_v for_o every_o such_o chapel_n to_o sit_v and_o vote_n with_o the_o justice_n in_o make_v such_o by-law_n as_o aforesaid_a the_o time_n and_o place_n for_o such_o election_n to_o be_v also_o appoint_v enact_v that_o the_o say_v 129th_o act_n of_o assembly_n be_v and_o from_o henceforth_o stand_v repeal_v repeal_v the_o act_n prohibit_v the_o inhabitant_n on_o potomach_n river_n and_o on_o the_o estern_a shoar_n to_o ship_v their_o tobacco_n without_o certificate_n repeal_v and_o that_o the_o inhabitant_n on_o potomack_n river_n and_o on_o the_o eastern_a shore_n have_v like_a and_o equal_a liberty_n and_o privilege_n with_o the_o rest_n his_o majesty_n subject_n in_o this_o colony_n to_o sell_v dispose_n pay_v and_o make_v delivery_n of_o their_o tobacco_n to_o their_o best_a advantage_n and_o convenience_n vi_o a_o act_n ascertain_v collector_n fee_n for_o entry_n and_o clear_n ship_n etc._n etc._n whereas_o several_a complaint_n have_v be_v make_v to_o this_o present_a grand_a assembly_n that_o several_a collector_n in_o this_o colony_n have_v exact_v and_o take_v great_a and_o unreasonable_a fee_n for_o enter_v and_o clear_v ship_n and_o small_a vessel_n trade_v
