further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o be_v or_o they_o shall_v make_v fine_a or_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and-levied_n shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o safe_a of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n aldermanor_n justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o clause_n therein_o bedue_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o imprisonment_n as_o by_o the_o discretion_n of_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n cause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v be_v nonsuit_v or_o forbear_v further_a prosecution_n or_o suffer_v discontinuance_n or_o verdict_n to_o pass_v against_o he_o the_o defendant_n or_o defendor_n shall_v have_v trible_a cost_v for_o which_o they_o shall_v have_v like_o liberty_n as_o in_o case_n where_o cost_v by_o law_n be_v give_v to_o defendant_n provide_v always_o that_o no_o mayor_n aldermen_z or_o justice_n of_o the_o peace_n shall_v be_v trouble_v sue_v prosecute_v or_o molest_v for_o any_o omission_n offence_n or_o neglect_v by_o virtue_n of_o this_o act_n but_o within_o the_o space_n of_o one_o year_n after_o such_o omission_n offence_n or_o neglect_n and_o not_o at_o any_o time_n thereafter_o any_o thing_n herein_o contain_v to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o always_o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a collector_n of_o each_o respective_a city_n and_o county_n as_o aforesaid_a shall_v have_v the_o liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforemention_v in_o silver_n money_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o currant_n market_n price_n in_o silver_n money_n at_o new-york_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o regulate_v the_o building_n street_n lane_n wharff_n dock_n and_o ally_n of_o the_o city_n of_o new-york_n whereas_o the_o city_n of_o new-york_n and_o metropolis_n of_o this_o province_n be_v chief_o erect_v by_o the_o inhabitant_n thereof_o for_o the_o propagate_a and_o encouragement_n of_o trade_n and_o commerce_n and_o for_o the_o good_a benefit_n
keep_v a_o perfect_a and_o distinct_a account_n as_o the_o same_o shall_v come_v in_o which_o sum_n or_o sum_n of_o money_n so_o by_o he_o receive_v as_o aforesaid_a shall_v not_o be_v separate_v or_o pay_v unto_o any_o other_o person_n or_o person_n whatsoever_o but_o unto_o such_o as_o shall_v lend_v any_o money_n to_o the_o commander_n in_o chief_a etc._n etc._n upon_o the_o credit_n of_o this_o act_n who_o shall_v immediate_o have_v a_o warrant_n and_o a_o order_n for_o the_o repayment_n bear_v the_o same_o date_n in_o which_o he_o pay_v his_o money_n wherein_o shall_v likewise_o be_v contain_v the_o interest_n for_o forbearance_n and_o that_o all_o order_n for_o re-payment_n shall_v be_v register_v in_o course_n according_a to_o the_o date_n of_o the_o warrant_n respective_o without_o preference_n of_o one_o before_o another_o and_o that_o all_o and_o every_o person_n or_o person_n shall_v be_v pay_v in_o course_n according_a as_o their_o order_n shall_v stand_v register_v or_o enter_v and_o that_o the_o money_n to_o come_v in_o by_o this_o act_n shall_v be_v in_o the_o same_o order_n liable_a to_o the_o satisfaction_n of_o the_o say_v respective_a party_n their_o executor_n administrator_n or_o assign_v successive_o without_o preference_n of_o one_o before_o another_o and_o not_o otherwise_o and_o not_o to_o be_v divertible_a to_o any_o oâ—her_a use_n intent_n or_o purpose_n whatsoever_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n cause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o aforemention_v in_o silver_n money_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o currant_n market_n price_n in_o silver_n money_n at_o new-york_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o destroy_n of_o wolf_n be_v it_o enact_v by_o the_o commander_n in_o chief_a and_o council_n and_o representative_n couven_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o for_o the_o destroy_n of_o wolf_n who_o have_v late_o increase_v very_o much_o to_o the_o great_a discouragement_n of_o pasturage_n and_o increase_v of_o sheep_n and_o cattle_n that_o whatsoever_o christian_n shall_v kill_v a_o grow_v wolf_n upon_o long-island_n or_o staten-island_n he_o shall_v have_v for_o each_o wolf_n that_o shall_v be_v kill_v twenty_o shilling_n to_o be_v pay_v out_o of_o the_o public_a treasury_n of_o each_o respective_a county_n where_o the_o wolf_n shall_v be_v kill_v and_o for_o a_o wolf_n whelp_n above_o half_a a_o year_n old_a there_o shall_v be_v pay_v as_o aforesaid_a ten_o shilling_n and_o whatsoever_o indian_a shall_v in_o like_a manner_n kill_v any_o wolf_n shall_v have_v for_o his_o reward_n one_o matchcoat_n or_o twelve_o shilling_n and_o for_o a_o wolf_n whelp_n five_o shilling_n to_o be_v pay_v he_o as_o aforesaid_a and_o if_o any_o other_o county_n in_o the_o province_n have_v a_o mind_n to_o encourage_v the_o destroy_n of_o wolf_n they_o shall_v do_v it_o in_o such_o manner_n and_o way_n as_o to_o and_o every_o clause_n therein_o due_o execute_v according_o act_n pass_v in_o the_o four_o session_n of_o the_o general_n assembly_n begin_v in_o the_o city_n of_o new-york_n the_o 14_o day_n of_o august_n annoque_fw-la dom._n 1692._o in_o the_o four_o year_n of_o their_o majesty_n reign_n king_n william_n and_o queen_n mary_n under_o the_o government_n of_o his_o excellency_n benjamin_n eletcher_n esq_n captain_n general_n and_o governor_n in_o chief_a in_o and_o over_o their_o majesty_n province_n of_o new-york_n and_o territory_n thereon_o depend_v in_o america_n a_o act_n for_o the_o raise_n and_o pay_v two_o hundred_o and_o twenty_o man_n with_o their_o proper_a officer_n together_o with_o the_o incidental_a charge_n that_o shall_v arise_v thereon_o for_o the_o by_o the_o governor_n council_n and_o representative_n convene_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o his_o excellency_n the_o captain_n general_n do_v immediate_o upon_o the_o publication_n hereof_o issue_n out_o his_o warrant_n under_o his_o hand_n and_o seal_n to_o the_o several_a and_o respective_a military_a officer_n of_o the_o several_a and_o respective_a county_n hereafter_o name_v for_o the_o raise_n of_o 220_o man_n well_o provide_v with_o arm_n to_o be_v peremptory_o at_o albany_n on_o the_o first_o day_n of_o october_n next_o ensue_v be_v hereafter_o specify_v and_o express_v to_o wit_n for_o the_o city_n and_o county_n of_o new-york_n sixty_o effective_a man_n for_o the_o county_n of_o westchester_n twenty_o five_o effective_a man_n for_o the_o county_n of_o richmond_n ten_o effective_a man_n for_o king_n county_n thirty_o four_o effective_a man_n for_o queen_n county_n forty_o four_o effective_a man_n for_o the_o county_n of_o suffolk_n forty_o five_o effective_a man_n for_o the_o county_n of_o orange_n two_o effective_a man_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o respective_a military_a officer_n in_o the_o respective_a county_n aforesaid_a shall_v after_o the_o receipt_n of_o the_o warrant_n from_o the_o captain_n general_n in_o manner_n aforesaid_a fail_v neglect_n refuse_v or_o delay_n to_o execute_v the_o say_a warrant_n according_a to_o the_o true_a intent_n and_o meaning_n thereof_o shall_v for_o such_o their_o failure_n or_o neglect_v refusal_n or_o delay_n answer_v the_o same_o before_o the_o captain_n general_n or_o such_o other_o officer_n as_o he_o shall_v appoint_v and_o there_o suffer_v such_o mulet_n pain_n and_o pork_n at_o the_o rate_n of_o fifty_o shilling_n per_fw-la barrel_n the_o barrel_n well_o repacked_n by_o the_o swear_a packer_n of_o new-york_n and_o the_o barrel_n contain_v thirty_o one_o gallon_n and_o half_a winchester_n measure_v at_o least_o beef_n at_o the_o rate_n of_o thirty_o two_o shilling_n and_o six_o penny_n per_fw-la barrel_n well_o repacked_n by_o the_o swear_a packer_n of_o new-york_n aforesaid_a the_o barrel_n to_o contain_v thirty_o one_o gallon_n and_o half_a winchester_n measure_v at_o least_o good_a merchantable_a winter_n wheat_n at_o four_o shilling_n per_fw-la busâ—el_n try_v tallow_n at_o four_o penny_n half_a penny_n per_fw-la pound_n a_o act_n for_o the_o raise_n and_o pay_v of_o eighty_o man_n in_o ulster_n and_o duchess_n county_n to_o be_v employ_v for_o the_o reinforce_a and_o security_n of_o albany_n from_o the_o 15_o day_n of_o december_n next_o to_o the_o first_o of_o march_n than_o next_o ensue_v whereas_o it_o be_v convenient_a that_o the_o county_n of_o ulster_n and_o duchess_n county_n shall_v be_v excuse_v from_o their_o quota_n of_o 300_o man_n since_o they_o be_v to_o provide_v eighty_o man_n for_o the_o re-inforcement_n of_o albany_n in_o the_o time_n of_o the_o most_o eminent_a danger_n be_v it_o enact_v by_o the_o governor_n and_o council_n and_o representative_n convene_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o the_o governor_n do_v issue_n out_o his_o warrant_n under_o his_o seal_n to_o the_o military_a officer_n of_o ulster_n and_o duchess_n county_n to_o levy_v eighty_o effective_a man_n with_o their_o arm_n to_o be_v peremptory_o at_o albany_n on_o the_o 15_o day_n of_o december_n next_o and_o there_o to_o continue_v and_o remain_v for_o the_o re-inforcement_n security_n and_o defence_n of_o the_o fronteer_n there_o until_o the_o first_o day_n of_o march_n than_o next_o follow_v and_o also_o that_o the_o say_a captain_n general_n will_v form_v the_o say_a number_n of_o eighty_o effective_a man_n into_o such_o company_n as_o he_o shall_v think_v convenient_a and_o to_o commissionate_a and_o appoint_v so_o many_o officer_n over_o they_o as_o he_o shall_v think_v needful_a in_o the_o say_a county_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a county_n of_o ulster_n and_o duchess_n county_n shall_v at_o their_o own_o proper_a cost_n and_o charge_v well_o and_o sufficient_o provide_v that_o the_o say_v eighty_o effective_a man_n be_v well_o supply_v with_o good_a and_o wholesome_a provision_n of_o beer_n bread_n and_o meat_n and_o ammunition_n during_o the_o time_n that_o they_o shall_v be_v employ_v in_o the_o service_n aforesaid_a and_o also_o take_v effectual_a care_n that_o all_o and_o every_o of_o the_o say_v effective_a man_n be_v well_o pay_v according_a to_o the_o king_n establishment_n after_o the_o expiration_n of_o the_o say_a service_n and_o likewise_o that_o they_o shall_v pay_v and_o satisfy_v such_o officer_n as_o shall_v be_v commissionated_a and_o appoint_v over_o they_o according_a to_o the_o king_n establishment_n aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o officer_n civil_a or_o military_a within_o the_o say_a county_n shall_v delay_v neglect_n or_o refuse_v to_o perform_v and_o execute_v the_o several_a and_o respective_a article_n and_o clause_n of_o this_o act_n according_a to_o the_o true_a intent_n and_o meaning_n thereof_o he_o or_o they_o so_o neglect_v refuse_v or_o delay_v shall_v be_v liable_a to_o such_o penalty_n respective_o as_o be_v in_o case_n of_o such_o refusal_n neglect_n or_o delay_v provide_v in_o the_o other_o act_n of_o this_o present_a session_n entitle_v a_o act_n for_o raise_v and_o pay_v two_o hundred_o and_o twenty_o man_n etc._n etc._n act_n pass_v in_o the_o five_o session_n of_o general_a assembly_n begin_v in_o the_o city_n of_o new-york_n the_o 24_o of_o octorber_n 1692._o act_n for_o establish_v a_o revenue_n upon_o their_o majesty_n and_o for_o defray_v the_o public_a and_o necessary_a charge_n of_o the_o government_n expense_n for_o the_o defence_n of_o this_o their_o province_n and_o dominion_n against_o the_o design_n and_o invasion_n of_o the_o common_a enemy_n and_o find_v it_o also_o necessary_a that_o in_o city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a and_o respective_a city_n town_n manor_n and_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_n of_o the_o public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v and_o receive_v the_o rate_n of_o â—ne_a penny_n per_fw-la pound_n as_o aforesaid_a as_o to_o the_o say_a mayor_n and_o aldermâ—n_n and_o justice_n of_o the_o peace_n shall_v seâ—m_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n and_o do_v not_o elect_v annual_o or_o once_o respective_a manor_n and_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o the_o assess_v their_o respective_a manor_n and_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n of_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o impartial_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n and_o collector_n shall_v deny_v neglect_n or_o unequal_o or_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n aforementioned_a asse_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o the_o and_o determine_v the_o same_o in_o the_o defendant_n absence_n and_o to_o grant_v execution_n thereon_o against_o the_o defendant_n person_n or_o for_o want_v thereof_o his_o estate_n which_o the_o constable_n of_o the_o town_n or_o precinct_n or_o his_o deputy_n shall_v and_o may_v serve_v always_o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o that_o be_v to_o say_v for_o the_o city_n and_o county_n of_o new-york_n at_o the_o city_n hall_n of_o the_o say_a city_n four_o time_n every_o year_n viz._n the_o first_o tuesday_n in_o may_n the_o first_o tuesday_n in_o august_n the_o first_o tuesday_n in_o november_n and_o the_o first_o tuesday_n in_o february_n for_o the_o city_n and_o county_n of_o albany_n at_o the_o city_n hall_n of_o the_o say_a city_n the_o first_o tuesday_n in_o june_n the_o first_o tuesday_n in_o october_n and_o the_o first_o tuesday_n in_o february_n for_o westchester_n at_o westobester_n the_o first_o tuesday_n in_o june_n and_o the_o first_o tuesday_n in_o december_n for_o ulster_n at_o kingston_n the_o first_o tuesday_n in_o september_n and_o the_o first_o tuesday_n in_o march_n for_o the_o county_n of_o richmond_n at_o the_o court-house_n the_o first_o tuesday_n in_o september_n and_o the_o first_o tuesday_n in_o march_n for_o king_n county_n at_o flatbush_n alias_o midwout_n the_o second_o tuesday_n in_o may_n and_o the_o second_o tuesday_n in_o november_n for_o queen_n county_n at_o jamaica_n the_o three_o tuesday_n in_o may_n and_o the_o three_o tuesday_n in_o september_n for_o suffolk_n county_n at_o southold_n the_o last_o tuesday_n in_o september_n and_o the_o last_o tuesday_n in_o march_n at_o southampton_n orange_n county_n to_o be_v annix_v to_o the_o county_n of_o new-york_n and_o duchess_n county_n to_o the_o county_n of_o ulster_n which_o session_n of_o the_o peace_n shall_v only_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n and_o no_o long_o and_o for_o the_o more_o regular_a and_o beneficial_a distribution_n of_o justice_n to_o the_o inhabitant_n of_o each_o respective_a city_n and_o county_n within_o this_o province_n be_v it_o further_o enact_v by_o the_o authority_n a_o foresay_a that_o there_o be_v keep_v and_o hold_v a_o court_n of_o common_a plea_n in_o each_o respective_a city_n and_o county_n within_o this_o province_n at_o the_o time_n and_o place_n hereafter_o name_v and_o express_v that_o be_v to_o say_v at_o such_o place_n in_o each_o respective_a county_n as_o the_o say_a court_n of_o session_n be_v to_o be_v keep_v and_o to_o begin_v the_o next_o day_n after_o the_o session_n terminate_v and_o only_o to_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n and_o no_o long_o and_o that_o there_o be_v one_o judge_n with_o three_o justice_n in_o each_o county_n appoint_v and_o commissionated_a to_o hold_v the_o same_o court_n of_o plea_n three_o whereof_o to_o be_v a_o quorum_fw-la and_o that_o the_o several_a and_o respective_a court_n hereby_o establish_v shall_v have_v jurisdiction_n to_o hear_v try_v and_o final_o to_o determine_v all_o action_n or_o cause_n of_o action_n and_o all_o matter_n and_o thing_n and_o cause_n tryable_a at_o the_o common_a law_n of_o what_o nature_n or_o kind_a soever_o provide_v always_o and_o it_o be_v hereby_o enact_v that_o always_o and_o it_o be_v hereby_o enact_v that_o the_o court_n of_o mayor_n and_o alderman_n of_o the_o respective_a city_n of_o new_a york_n and_o albany_n shall_v have_v in_o each_o of_o their_o respective_a city_n the_o power_n and_o authority_n to_o hear_v try_v and_o final_o to_o determine_v all_o such_o action_n and_o suit_n as_o be_v common_o cognizable_a before_o they_o from_o which_o final_a determination_n there_o shall_v not_o be_v any_o appeal_n or_o removal_n by_o habeas_fw-la corpus_fw-la of_o any_o person_n or_o of_o any_o action_n or_o suit_n or_o of_o any_o judgement_n or_o execution_n to_o the_o value_n of_o twenty_o pound_n or_o under_o any_o thing_n contain_v herein_o to_o the_o contrary_a in_o any_o way_n notwithstanding_o to_o which_o respective_a court_n of_o common_a plea_n there_o shall_v belong_v and_o be_v appoint_v and_o commissionated_a for_o that_o purpose_n one_o clerk_n of_o the_o court_n to_o draw_v enter_z and_o keep_v the_o record_n declaration_n plea_n and_o judgement_n there_o to_o be_v have_v and_o make_v and_o one_o marshal_n or_o cryer_n of_o the_o court_n to_o call_v the_o juror_n and_o proclaim_v the_o command_n and_o say_a court_n shall_v issue_v out_o of_o the_o office_n of_o the_o clerk_n of_o the_o court_n in_o each_o city_n and_o county_n respective_o sign_v per_fw-la curiam_fw-la and_o that_o their_o majesty_n subject_n inhabit_v within_o this_o province_n may_v have_v all_o the_o good_a proper_a and_o just_a way_n and_o mean_n for_o the_o secure_n and_o recover_v their_o just_a right_n and_o demand_n within_o the_o same_o be_v it_o further_o enact_v and_o it_o be_v hereby_o enact_v and_o ordain_v by_o authority_n aforesaid_a that_o there_o shall_v be_v hold_v and_o keep_v a_o supreme_a court_n of_o judicature_n which_o shall_v be_v due_o and_o constant_o keep_v at_o the_o city_n of_o new-york_n and_o not_o elsewhere_o at_o the_o several_a and_o respective_a time_n hereafter_o mention_v and_o that_o there_o be_v five_o justice_n at_o least_o appoint_a and_o commissionated_a to_o hold_v the_o same_o court_n two_o whereof_o together_o with_o one_o chief_a justice_n to_o be_v a_o quorum_fw-la which_o supreme_a court_n be_v hereby_o full_o impower_v and_o authorize_v to_o have_v cognizance_n of_o all_o plea_n civil_a criminal_a and_o mix_v as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n whatsoever_o as_o the_o court_n of_o king_n bench_n common_a plea_n and_o exchequer_n within_o their_o majesty_n kingdom_n of_o england_n have_v or_o aught_o to_o have_v in_o and_o to_o which_o supreme_a court_n all_o and_o every_o person_n and_o person_n
craft_n or_o occupation_n may_v at_o all_o time_n come_v and_o inhabit_v in_o any_o place_n within_o this_o province_n and_o be_v always_o admit_v provide_v he_o make_v application_n within_o eight_o day_n after_o his_o arrival_n in_o any_o city_n town_n or_o county_n as_o aforesaid_a unto_o such_o person_n or_o person_n as_o be_v appoint_v for_o govern_v the_o respective_a part_n and_o also_o all_o vessel_n that_o shall_v bring_v any_o passenger_n into_o this_o province_n the_o master_n of_o such_o vessel_n shall_v within_o four_o and_o twenty_o hour_n after_o arrival_n bring_v a_o list_n of_o such_o passenger_n he_o bring_v into_o the_o province_n with_o their_o quality_n and_o condition_n unto_o the_o chief_a magistrate_n of_o each_o respective_a city_n town_n or_o county_n as_o aforesaid_a under_o the_o penalty_n of_o ten_o pound_n currant_n money_n of_o this_o province_n always_o provide_v that_o if_o any_o vessel_n bring_v in_o any_o person_n as_o aforesaid_a not_o able_a to_o give_v surety_n for_o their_o well_o demeanour_n that_o then_o and_o in_o such_o case_n that_o the_o master_n of_o such_o vessel_n or_o vessel_n shall_v be_v oblige_v to_o transport_v all_o such_o to_o the_o place_n from_o whence_o they_o come_v or_o at_o least_o out_o of_o this_o province_n and_o dependency_n and_o also_o if_o any_o vagabond_n beggar_n or_o other_o remove_v from_o one_o town_n to_o another_o and_o can_v give_v security_n as_o aforesaid_a it_o shall_v be_v lawful_a to_o the_o constable_n to_o return_v such_o person_n to_o the_o town_n from_o whence_o they_o come_v a_o act_n for_o settle_v the_o militia_n whereas_o the_o present_a state_n and_o condition_n of_o this_o province_n do_v of_o necessity_n require_v that_o the_o inhabitant_n thereof_o shall_v be_v well_o arm_v and_o train_v up_o in_o art_n military_a as_o well_o for_o the_o honour_n and_o service_n of_o their_o most_o excellent_a majesty_n as_o the_o preservation_n of_o their_o own_o life_n and_o authority_n of_o the_o same_o that_o no_o person_n whatsoever_o from_o fifteen_o to_o sixty_o year_n of_o age_n remain_v unli_v by_o themselves_o or_o master_n mistress_n or_o employer_n under_o the_o captain_n in_o their_o respective_a place_n of_o abode_n in_o foot_n or_o horse_n the_o space_n of_o one_o kalander_n month_n after_o their_o arrival_n or_o come_v to_o reside_v or_o sojourn_v in_o any_o place_n within_o this_o province_n on_o penalty_n of_o twenty_o shilling_n and_o so_o for_o every_o month_n such_o person_n shall_v remain_v unli_v and_o that_o every_o foot_n soldier_n be_v provide_v with_o a_o well_o fix_a musket_n or_o fusee_fw-fr or_o if_o the_o officer_n so_o appoint_v with_o a_o good_a pike_n or_o sword_n or_o lance_n and_o pistol_n each_o musquetcer_n six_o charge_n of_o powder_n and_o one_o cartouch_n box_n and_o so_o shall_v appear_v when_o and_o where_o appoint_v upon_o penalty_n of_o five_o shilling_n for_o his_o default_n in_o not_o appear_v and_o three_o shilling_n for_o want_n of_o each_o charge_n of_o powder_n gun_n pike_n sword_n pistol_n or_o cartouch_n box_n so_o as_o the_o whole_a penalty_n for_o any_o person_n at_o one_o time_n exceed_v not_o ten_o shilling_n and_o that_o every_o soldier_n belong_v to_o the_o horse_n shall_v when_o and_o where_o command_v appear_v and_o be_v provide_v with_o a_o good_a serviceable_a horse_n of_o his_o own_o cover_v with_o a_o good_a saddle_n with_o holster_n breastplate_n and_o crupper_n and_o a_o case_n of_o good_a pistol_n hanger_n sword_n or_o rapier_n and_o half_a a_o pound_n of_o powder_n with_o twelve_o serviceable_a bullet_n on_o penalty_n of_o ten_o shilling_n for_o each_o time_n absence_n and_o five_o shilling_n for_o default_n of_o each_o of_o the_o particular_n above_o mention_v so_o as_o the_o whole_a penalty_n for_o one_o time_n exceed_v not_o fifteen_o shilling_n and_o that_o every_o foot_n soldier_n shall_v have_v at_o his_o habitation_n and_o abide_v one_o pound_n of_o good_a powder_n and_o three_o pound_n of_o sizeable_a bullet_n and_o every_o trooper_n have_v at_o his_o usual_a place_n of_o abide_v a_o well_o fix_v carbine_n with_o belt_n and_o swivel_n and_o two_o pound_n of_o fine_a powder_n with_o six_o pound_n of_o sizeable_a bullet_n on_o penalty_n of_o ten_o shilling_n for_o each_o default_n and_o that_o each_o of_o they_o shall_v bring_v the_o same_o into_o the_o field_n when_o command_v upon_o penalty_n of_o answer_v the_o same_o at_o a_o court_n martial_a and_o for_o the_o supply_n of_o the_o troop_n of_o horse_n in_o the_o city_n of_o new-york_n and_o albany_n and_o county_n of_o ulster_n it_o shall_v be_v in_o the_o power_n of_o the_o collonol_n or_o chief_a officer_n of_o the_o militia_n of_o the_o city_n of_o new-york_n county_n of_o albany_n and_o county_n of_o ulster_n for_o the_o time_n be_v whensoever_o any_o of_o the_o say_a troop_n shall_v not_o complete_a the_o number_n of_o fifty_o to_o present_v double_a the_o number_n instead_o of_o such_o as_o be_v dead_a removed_z or_o want_v out_o of_o the_o principal_a inhabitant_n and_o gentleman_n of_o the_o respective_a city_n and_o county_n aforesaid_a unto_o the_o governor_n for_o the_o time_n be_v who_o from_o time_n to_o time_n may_v listen_v and_o order_n so_o many_o of_o they_o to_o be_v of_o the_o say_v respective_a troop_n as_o may_v complete_a the_o number_n of_o fifty_o for_o their_o majesty_n service_n and_o the_o security_n of_o this_o province_n and_o every_o person_n so_o present_v to_o the_o governor_n for_o the_o time_n be_v and_o by_o he_o list_v and_o order_v to_o be_v of_o the_o say_v respective_a troop_n shall_v be_v and_o be_v hereby_o oblige_v to_o serve_v in_o the_o say_v respective_a troop_n upon_o the_o penalty_n of_o five_o pound_n provide_v nevertheless_o that_o nothing_o herein_o be_v construe_v to_o extend_v to_o force_v or_o compel_v any_o person_n that_o have_v or_o shall_v be_v in_o commission_n in_o this_o province_n to_o listen_v themselves_o in_o any_o company_n or_o troop_n or_o to_o serve_v in_o any_o capacity_n beneath_o their_o former_a commission_n unless_o such_o person_n have_v be_v degrade_v by_o a_o court_n martial_a and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n so_o list_v as_o aforesaid_a shall_v depart_v thence_o without_o a_o discharge_v from_o the_o commander_n of_o the_o company_n or_o troop_n where_o list_v on_o pènalty_n of_o twenty_o shilling_n and_o that_o no_o commander_n of_o any_o company_n or_o troop_n shall_v refuse_v when_o desire_v to_o give_v a_o discharge_n in_o write_v to_o any_o that_o be_v remove_v his_o abide_v out_o of_o the_o precinct_n or_o province_n under_o the_o penalty_n of_o five_o pound_n and_o whereas_o at_o the_o city_n of_o new-york_n guard_n and_o watch_n be_v every_o night_n set_v and_o appoint_v be_v it_o therefore_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o person_n or_o person_n list_v in_o the_o reigment_n of_o the_o city_n and_o county_n of_o new-york_n except_o on_o extraordinary_a occasion_n to_o put_v a_o well_o arm_a man_n in_o their_o room_n who_o if_o approve_v of_o by_o the_o captain_n of_o the_o guard_n shall_v excuse_v he_o or_o their_o absence_n provide_v always_o that_o the_o commission_n officer_n and_o sergeant_n of_o the_o respective_a company_n be_v oblige_v in_o their_o respective_a turn_v to_o mount_v the_o guard_n in_o their_o proper_a person_n and_o that_o no_o person_n shall_v refuse_v to_o be_v a_o sergeant_n corporal_n or_o drummer_n in_o the_o company_n wherein_o he_o be_v list_v under_o the_o penalty_n of_o forty_o shilling_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o captain_n of_o company_n of_o foot_n or_o troop_n of_o horse_n shall_v within_o twelve_o month_n from_o and_o after_o the_o publication_n of_o this_o act_n pet_n trumpeter_n and_o banner_n at_o the_o proper_a charge_n of_o the_o respective_a officer_n troop_n and_o company_n under_o the_o penalty_n of_o ten_o pound_n and_o so_o for_o every_o four_o month_n such_o commander_n shall_v remain_v unprovided_a and_o that_o all_o the_o colonel_n of_o the_o respective_a regiment_n or_o next_o chief_a officer_n in_o their_o absence_n shall_v once_o every_o year_n at_o least_o issue_n out_o their_o warrant_n to_o their_o inferior_a officer_n command_v they_o to_o make_v diligent_a search_n and_o inquiry_n in_o their_o several_a precinct_n that_o all_o be_v due_o list_a arm_a and_o equip_v and_o to_o return_v to_o they_o such_o defect_n as_o shall_v be_v find_v to_o the_o end_n the_o same_o may_v be_v reform_v on_o penalty_n of_o twenty_o pound_n and_o
to_o be_v sue_v for_o in_o any_o court_n of_o record_n within_o each_o county_n where_o any_o such_o action_n or_o action_n shall_v arise_v wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v be_v allow_v and_o be_v it_o further_o enact_v that_o if_o any_o person_n or_o person_n within_o this_o province_n and_o dependency_n not_o be_v thereunto_o due_o liseâ—ced_v shall_v at_o any_o time_n hereafter_o presume_v to_o sell_v by_o retail_n the_o liquor_n aforesaid_a that_o be_v to_o say_v less_o quantity_n at_o one_o time_n than_o fifteen_o gallon_n the_o person_n so_o offend_v shall_v forfeit_v and_o pay_v the_o sum_n of_o five_o pound_n for_o every_o such_o offence_n be_v thereof_o convict_v by_o the_o oath_n of_o two_o or_o more_o substantial_a evidence_n to_o be_v sue_v and_o employ_v for_o in_o such_o manner_n and_o proportion_n as_o be_v last_o aforesaid_a and_o be_v it_o further_o enact_v that_o all_o master_n and_o commander_n of_o ship_n sloop_n boat_n or_o any_o other_o vessel_n belong_v to_o this_o province_n and_o its_o dependency_n shall_v repair_v to_o the_o say_a customhouse_n or_o other_o place_n or_o place_n that_o shall_v be_v appoint_v for_o that_o purpose_n and_o there_o enter_v into_o bond_n of_o one_o hundred_o pound_n that_o they_o shall_v not_o direct_o or_o indirect_o take_v on_o board_n or_o carry_v away_o out_o of_o this_o province_n and_o dependency_n any_o of_o the_o aforesaid_a good_n or_o merchandize_n without_o pay_v such_o custom_n and_o duty_n as_o be_v before_o express_v provide_v also_o that_o all_o indian_a trader_n throughout_o the_o whole_a province_n and_o dependency_n do_v pay_v for_o the_o value_n of_o each_o hundred_o pound_n prime_a cost_n they_o so_o traffic_n with_o the_o indian_n the_o sum_n of_o ten_o pound_n money_n aforesaid_a always_o provide_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o good_n merchandise_n wine_n rum_o brandy_n and_o other_o distil_a liquor_n for_o which_o the_o duty_n in_o this_o act_n mention_v be_v pay_v or_o secure_v to_o be_v pay_v at_o the_o importation_n be_v export_v out_o of_o this_o province_n within_o six_o month_n after_o their_o importation_n than_o the_o moiety_n or_o one_o half_a of_o the_o aforesaid_a duty_n in_o this_o act_n mention_v shall_v be_v return_v for_o as_o much_o as_o shall_v be_v so_o export_v the_o exporter_n make_v oath_n in_o the_o custom_n house_n that_o the_o whole_a duty_n have_v be_v whole_o pay_v for_o the_o say_a wine_n and_o liquor_n at_o the_o importation_n and_o that_o there_o have_v be_v no_o fraud_n or_o mixture_n use_v to_o increase_v the_o say_a liquor_n to_o be_v export_v and_o that_o thereupon_o he_o bring_v a_o certificate_n from_o the_o surveyor_n or_o searcher_n that_o the_o say_a wine_n or_o liquor_n be_v according_o ship_v any_o thing_n contain_v here_o unto_o the_o contrary_a in_o any_o way_n notwithstanding_o provide_v always_o that_o this_o act_n and_o all_o thing_n therein_o contain_v shall_v only_o continue_v and_o remain_v in_o force_n for_o the_o time_n and_o space_n of_o two_o year_n next_z and_o after_o the_o publication_n thereof_o and_o no_o long_o any_o thing_n contain_v herein_o to_o the_o contrary_a in_o any_o way_n notwithstanding_o a_o act_n to_o enable_v his_o excellency_n to_o defray_v his_o extraordinary_a expense_n and_o to_o indemnify_v the_o collector_n and_o receiver_n general_n for_o the_o receipt_n of_o several_a sum_n of_o money_n on_o pretence_n of_o custom_n and_o excellency_n arrival_n must_v needs_o occasion_n unto_o your_o excellency_n a_o extraordinary_a and_o great_a expense_n and_o they_o be_v likewise_o well_o assure_v of_o the_o good_a affection_n your_o excellency_n have_v for_o the_o inhabitant_n of_o this_o province_n and_o for_o the_o great_a care_n your_o excellency_n have_v take_v for_o the_o conserve_n the_o peace_n thereof_o and_o forasmuch_o as_o their_o majesty_n collector_n and_o receiver_n general_n have_v since_o the_o 29_o of_o january_n exclusive_a last_o pass_v receive_v from_o the_o inhabitant_n of_o this_o province_n several_a sum_n of_o money_n for_o duty_n custom_n and_o other_o imposition_n former_o accustom_v to_o be_v take_v but_o not_o warrantable_a by_o the_o law_n for_o the_o removal_n of_o the_o many_o the_o city_n of_o albany_n with_o the_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n of_o albany_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v forthwith_o upon_o the_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freehold_n of_o the_o respective_a place_n for_o the_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o refuse_v to_o take_v oath_n as_o aforesaid_a or_o shall_v in_o any_o way_n deny_v neglect_n or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v refuse_v or_o neglect_v to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o shall_v make_v fine_a and_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o abovesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v of_o within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v or_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_v of_o any_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o and_o every_o or_o any_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n of_o the_o town_n or_o precinct_n or_o any_o depute_a by_o he_o where_o the_o the_o parry_n complain_v against_o do_v live_v which_o summon_v be_v personal_o serve_v or_o leave_v at_o the_o defendant_n house_n two_o day_n before_o the_o day_n of_o hear_v of_o the_o plaint_n shall_v be_v sufficient_a authority_n to_o and_o for_o the_o say_a justice_n assist_v with_o one_o of_o the_o and_o dependency_n out_o of_o a_o tender_a conscience_n refuse_v to_o give_v their_o evidence_n on_o oath_n in_o any_o matter_n or_o thing_n depend_v in_o any_o of_o the_o court_n within_o the_o same_o be_v it_o therefore_o enact_v by_o the_o governor_n and_o council_n and_o representative_n now_o meet_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o in_o such_o case_n the_o person_n or_o person_n so_o refuse_v the_o same_o shall_v give_v in_o or_o deliver_v their_o evidence_n or_o testimony_n in_o manner_n &_o form_n follow_v that_o be_v to_o say_v i_o a._n b._n do_v solemn_o promise_v as_o in_o the_o presence_n of_o god_n to_o speak_v the_o truth_n the_o whole_a truth_n and_o nothing_o but_o the_o truth_n to_o the_o matter_n or_o thing_n in_o question_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o person_n or_o person_n so_o refuse_v as_o aforesaid_a shall_v be_v summon_v to_o serve_v upon_o any_o jury_n in_o any_o court_n within_o this_o province_n than_o such_o person_n or_o person_n shall_v make_v the_o engagement_n follow_v that_o be_v to_o say_v i_o a._n b._n do_v solemn_o promise_v their_o majesty_n subject_n be_v fall_v into_o danger_n of_o and_o lie_v open_a to_o great_a penalty_n and_o forfeiture_n and_o withal_o consider_v the_o ignorance_n of_o many_o and_o the_o dutiful_a affection_n of_o other_o of_o their_o majesty_n subject_n out_o of_o a_o earnest_a desire_n to_o deliver_v they_o from_o the_o penalty_n and_o forfeiture_n aforesaid_a and_o to_o the_o intent_n that_o their_o offence_n may_v not_o hereafter_o be_v bring_v in_o judgement_n question_n or_o remembrance_n to_o the_o least_o endamagement_n of_o they_o either_o in_o their_o life_n liberty_n estate_n or_o
