before_o and_o thereupon_o conclude_v as_o for_o the_o true_a meaning_n of_o that_o act_n that_o the_o provision_n intend_v to_o be_v make_v be_v only_o against_o the_o excess_n of_o the_o commissioner_n which_o rather_o justify_v than_o any_o way_n disprove_v the_o lawfulness_n of_o such_o commission_n and_o so_o the_o sense_n of_o the_o act_n appliable_a to_o the_o complaint_n will_v be_v that_o whereas_o the_o commissioner_n have_v over-high_o tax_v the_o subject_n the_o act_n provide_v that_o they_o shall_v not_o be_v otherwise_o charge_v then_o as_o they_o have_v be_v in_o the_o time_n of_o former_a king_n and_o according_a to_o our_o commission_n moderate_o and_o so_o as_o they_o may_v live_v still_o according_a to_o their_o former_a condition_n as_o in_o like_o case_n of_o other_o statute_n against_o outrageous_a distress_n and_o amerciament_n and_o although_o we_o take_v this_o to_o be_v the_o sense_n of_o that_o statute_n yet_o if_o any_o man_n shall_v think_v this_o part_n of_o the_o statute_n of_o 1._o e._n 3._o concerning_o arm_v a_o man_n self_n to_o be_v the_o same_o with_o the_o word_n of_o the_o statute_n of_o 25._o e._n 3._o against_o constrain_v any_o man_n to_o find_v man_n of_o arm_n etc._n etc._n which_o be_v the_o sense_n of_o this_o declaration_n which_o make_v both_o statute_n to_o be_v to_o the_o same_o effect_n and_o make_v the_o inference_n against_o our_o power_n of_o impose_v arm_n upon_o they_o both_o we_o shall_v not_o contradict_v he_o therein_o be_v confident_a to_o make_v it_o evident_a that_o this_o commission_n be_v obtain_v as_o they_o thereupon_o do_v a_o confirmation_n of_o former_a act_n to_o the_o contrary_a do_v recite_v the_o statute_n of_o 25._o e._n 3._o 18._o e._n 3_o c._n 8._o and_o that_o part_n of_o the_o statute_n of_o 1._o e._n 3._o which_o be_v against_o carry_v of_o man_n out_o of_o their_o county_n and_o yet_o nevertheless_o they_o whole_o omit_v this_o statute_n of_o 13._o e._n 1._o and_o this_o first_o part_n of_o the_o statute_n of_o 1._o e._n 3._o concerning_o the_o arm_v whereas_o it_o be_v to_o be_v presume_v they_o will_v have_v also_o recite_v this_o statute_n of_o 13._o e._n 1._o if_o they_o have_v conceive_v the_o same_o to_o be_v as_o this_o declaration_n set_v it_o forth_o the_o certain_a assize_n for_o arm_n and_o such_o a_o statute_n whereto_o all_o the_o rest_n the_o opinion_n of_o sir_n edward_n cook_n who_o great_a learning_n and_o affection_n to_o the_o right_n and_o liberty_n of_o the_o subject_n be_v not_o unknown_a who_o in_o his_o treatise_n of_o the_o jurisdiction_n of_o court_n be_v one_o of_o those_o book_n since_o this_o parliament_n desire_v or_o direct_v by_o the_o house_n of_o commons_o to_o be_v publish_v express_o declare_v that_o this_o act_n touch_v a_o commission_n for_o array_v and_o muster_v of_o man_n be_v at_o this_o day_n of_o force_n but_o if_o any_o man_n be_v yet_o unsatisfied_a with_o so_o clear_a reason_n on_o h._n 4._o be_v so_o bind_v as_o unto_o all_o the_o power_n of_o execution_n over_o the_o person_n to_o be_v command_v that_o the_o clergy_n who_o in_o former_a time_n have_v use_v to_o be_v array_v among_o themselves_o by_o writ_n or_o commission_n to_o the_o bishop_n or_o archbishop_n be_v bind_v as_o within_o the_o body_n of_o that_o commission_n so_o settle_v by_o parliament_n and_o they_o question_n there_o be_v no_o more_o in_o this_o preamble_n than_o be_v after_o contain_v in_o the_o prayer_n so_o if_o our_o commission_n be_v not_o against_o the_o prayer_n there_o can_v be_v no_o their_o advantage_n be_v void_a in_o law_n notwithstanding_o it_o do_v not_o follow_v that_o they_o be_v void_a as_o against_o this_o petition_n for_o the_o petition_n of_o right_n as_o against_o the_o charge_n therein_o mention_v be_v only_o to_o be_v intend_v of_o money_n or_o other_o thing_n valuable_a and_o to_o be_v part_v with_o to_o or_o for_o we_o or_o our_o advantage_n such_o as_o be_v all_o the_o charge_n more_o special_o mention_v in_o the_o preamble_n and_o prayer_n as_o that_o of_o gift_n loan_n and_o benevolence_n and_o such_o as_o be_v those_o charge_n intend_v in_o the_o preamble_n under_o the_o general_a expression_n of_o divers_a other_o charge_n impose_v by_o lord_n lieutenant_n etc._n etc._n which_o we_o think_v be_v very_o well_o know_v to_o most_o county_n to_o have_v be_v mere_a pecuniary_a payment_n and_o which_o we_o ought_v to_o have_v bear_v and_o for_o the_o other_o charge_n that_o be_v of_o tax_n tallage_n aid_n likewise_o mention_v which_o as_o to_o this_o purpose_n be_v but_o synonoma_n and_o of_o one_o signification_n they_o be_v mean_v of_o money_n or_o other_o thing_n valuable_a and_o for_o the_o king_n and_o so_o use_v in_o the_o old_a statute_n and_o have_v be_v in_o former_a time_n impose_v upon_o the_o people_n without_o act_n of_o parliament_n and_o according_o all_o of_o they_o be_v so_o to_o be_v expound_v in_o the_o preamble_n and_o the_o prayer_n of_o the_o petition_n say_v nothing_o express_o against_o the_o command_v the_o subject_a to_o do_v a_o thing_n which_o may_v be_v necessary_o of_o expense_n or_o charge_n wherein_o the_o act_n be_v only_o intend_v and_o the_o charge_n but_o a_o necessary_a incident_a but_o the_o prayer_n be_v only_o against_o the_o compel_n of_o the_o subject_a to_o yield_v or_o make_v those_o kind_n of_o charge_n so_o as_o the_o clear_a sense_n of_o the_o petition_n both_o according_a to_o the_o occasion_n of_o complaint_n therein_o mention_v and_o the_o law_n whereupon_o it_o be_v frame_v as_o well_o as_o the_o propriety_n of_o the_o word_n be_v only_o against_o draw_v from_o the_o subject_a either_o money_n or_o money-worth_n by_o any_o of_o those_o particular_a charge_n therein_o mention_v or_o any_o other_o charge_n of_o like_a nature_n under_o what_o specious_a title_n soever_o for_o the_o king_n advantage_n which_o the_o more_o plain_o appear_v for_o that_o the_o charge_n must_v be_v yield_v or_o make_v as_o upon_o gift_n loan_n etc._n etc._n which_o must_v necessary_o be_v intend_v unto_o some_o person_n and_o no_o other_o person_n can_v be_v here_o colourable_o intend_v but_o the_o king_n and_o if_o the_o petition_n by_o any_o construction_n may_v extend_v against_o the_o command_n of_o any_o act_n which_o in_o the_o execution_n may_v induce_v charge_n yet_o such_o charge_n must_v according_a to_o the_o very_a word_n of_o the_o petition_n be_v such_o like_a charge_n that_o be_v for_o we_o or_o our_o advantage_n as_o the_o particular_a charge_n therein_o mention_v of_o gift_n loan_n etc._n etc._n but_o this_o charge_n of_o the_o subject_a with_o arm_n for_o the_o necessary_a defence_n of_o the_o kingdom_n can_v be_v say_v for_o our_o particular_a advantage_n all_o our_o subject_n have_v therein_o a_o common_a interest_n as_o for_o the_o meaning_n of_o the_o petition_n enforce_v in_o the_o objection_n from_o the_o charge_n by_o lord_n lieutenant_n and_o other_o complain_v against_o in_o the_o preamble_n sure_o we_o be_v that_o those_o must_v be_v such_o in_o the_o particular_a as_o be_v after_o contain_v in_o the_o general_a word_n of_o the_o prayer_n to_o which_o we_o have_v answer_v before_o and_o though_o it_o be_v to_o this_o purpose_n say_v in_o the_o declaration_n that_o those_o charge_n by_o lord_n lieutenant_n and_o other_o be_v mean_v of_o charge_v of_o the_o subject_a with_o arm_n certain_o no_o such_o thing_n can_v appear_v in_o the_o petition_n which_o speak_v but_o only_o of_o divers_a charge_n but_o name_v none_o in_o particular_a nor_o can_v there_o be_v any_o other_o assurance_n that_o the_o house_n do_v intend_v any_o such_o thing_n but_o by_o vote_n wherein_o they_o only_o speak_v

that_o it_o be_v evident_a that_o this_o commission_n be_v not_o contrary_a to_o this_o recital_n and_o sure_o we_o think_v that_o what_o we_o have_v already_o open_v be_v apply_v to_o this_o objection_n will_v warrant_v that_o answer_n but_o that_o we_o may_v leave_v nothing_o undo_v that_o may_v tend_v towards_o the_o full_a satisfaction_n of_o our_o good_a people_n we_o shall_v also_o give_v this_o a_o particular_a answer_n first_o we_o say_v that_o if_o this_o recital_n have_v be_v a_o act_n yet_o there_o be_v nothing_o in_o our_o commission_n contrary_a to_o the_o letter_n of_o it_o for_o that_o by_o this_o commission_n no_o man_n be_v compellable_a by_o any_o special_a word_n to_o go_v out_o of_o his_o county_n and_o the_o general_a word_n give_v power_n to_o the_o commissioner_n for_o lead_v they_o to_o the_o sea-coast_n or_o elsewhere_o as_o we_o have_v often_o repeat_v be_v with_o these_o limitation_n they_o be_v to_o lead_v they_o but_o when_o there_o be_v imminent_a danger_n of_o enemy_n for_o defence_n of_o the_o kingdom_n and_o then_o only_o they_o be_v to_o be_v lead_v to_o such_o place_n as_o shall_v be_v necessary_a for_o the_o expulsion_n vanquish_a and_o destruction_n of_o the_o say_a enemy_n and_o this_o be_v a_o case_n of_o necessity_n both_o within_o the_o word_n of_o this_o recital_n and_o according_a to_o the_o sense_n of_o the_o same_o word_n in_o the_o statute_n of_o 1._o e._n 3._o and_o 4._o h._n 4._o therein_o mean_v as_o we_o have_v before_o show_v and_o thus_o we_o may_v leave_v this_o objection_n but_o that_o it_o imply_v a_o matter_n of_o a_o great_a consequence_n then_o plain_o appear_v that_o recital_n of_o the_o law_n in_o preamble_n of_o statute_n be_v bind_v for_o in_o this_o objection_n this_o recital_n be_v call_v a_o declaration_n of_o the_o law_n and_o our_o commission_n sard_n to_o be_v contrary_a to_o that_o statute_n and_o it_o further_o imply_v that_o even_o in_o the_o great_a and_o most_o horrid_a rebellion_n the_o subject_n can_v be_v compel_v out_o of_o the_o county_n for_o the_o suppression_n thereof_o but_o to_o this_o we_o answor_n that_o the_o difference_n be_v apparent_a between_o a_o act_n of_o parliament_n declarative_a and_o a_o recital_n in_o a_o preamble_n for_o such_o a_o act_n in_o any_o matter_n though_o mistake_v be_v assent_v unto_o by_o we_o and_o our_o two_o house_n be_v equal_o bind_v as_o have_v equal_a authority_n with_o a_o act_n introductive_a of_o a_o new_a law_n but_o the_o recital_n in_o a_o preamble_n be_v no_o part_n of_o the_o act_n the_o royal_a assent_n be_v only_o to_o that_o which_o be_v express_o or_o tacit_o pray_v to_o be_v enact_v nor_o can_v it_o any_o way_n so_o much_o as_o imply_v our_o opinion_n for_o otherwise_o king_n must_v be_v enforce_v oftentimes_o to_o deny_v a_o good_a law_n for_o a_o ill_a preamble_n the_o consequence_n whereof_o be_v great_a in_o such_o a_o act_n as_o require_v expedition_n where_o a_o bill_n once_o deny_v be_v not_o regular_o to_o be_v offer_v again_o in_o that_o session_n of_o parliament_n and_o if_o it_o be_v needful_a divers_a mistake_n of_o the_o law_n in_o preamble_n may_v be_v produce_v
