upon_o the_o two_o and_o twenty_o day_n of_o october_n one_o thousand_o six_o hundred_o forty_o one_o or_o at_o any_o time_n since_o such_o person_n or_o person_n who_o purchase_v the_o same_o of_o and_o from_o susanna_n bastwick_n or_o her_o child_n or_o their_o assign_n be_v first_o satisfy_v out_o of_o the_o forfeit_a land_n undisposed_a by_o this_o act_n by_o a_o allotment_n of_o so_o many_o profitable_a acre_n as_o may_v be_v equal_a in_o value_n worth_a and_o purchase_n to_o the_o land_n so_o to_o be_v restore_v and_o after_o such_o restitution_n so_o make_v as_o aforesaid_a the_o say_a john_n talbot_n shall_v hold_v and_o enjoy_v to_o he_o and_o his_o heir_n all_o and_o singular_a the_o land_n tenement_n and_o hereditament_n so_o restore_v but_o subject_a to_o quit_v rent_n any_o thing_n in_o this_o or_o the_o say_v former_a act_n contain_v to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o sir_n george_n harbert_n of_o dorrow_n in_o the_o king_n county_n knight_n and_o baronet_n shall_v by_o the_o commissioner_n for_o execution_n of_o this_o act_n be_v forthwith_o restore_v unto_o and_o place_v in_o proviso_n or_o clause_n in_o the_o say_a act_n contain_v or_o any_o other_o legal_a proceed_n in_o which_o word_n legal_a proceed_n custodiams_n or_o any_o other_o grant_v or_o patent_n not_o the_o portion_n allot_v to_o each_o adventurer_n or_o soldier_n or_o the_o heir_n executor_n assignee_n or_o assign_v of_o such_o adventurer_n or_o soldier_n for_o and_o towards_o he_o and_o their_o two_o full_a three_o part_n and_o the_o several_a augmentation_n of_o any_o archbishopric_n or_o bishopric_n the_o allotment_n of_o glebe_n and_o the_o provision_n make_v for_o the_o college_n of_o dublin_n the_o maintenance_n of_o the_o fort_n at_o duncannon_n and_o the_o corporation_n of_o bandonbridge_n shall_v be_v particular_o and_o fair_o set_v down_o and_o enter_v and_o shall_v cause_v a_o duplicate_v thereof_o to_o be_v make_v and_o return_v into_o the_o exchequer_n there_o to_o remain_v of_o record_n and_o that_o upon_o a_o certificate_n under_o the_o hand_n and_o seal_n of_o the_o commissioner_n or_o the_o major_a part_n of_o they_o contain_v the_o land_n allot_v to_o any_o the_o person_n or_o purpose_n aforesaid_a or_o to_o any_o adventurer_n or_o soldier_n or_o to_o the_o heir_n executor_n assignee_n or_o assign_v of_o any_o adventurer_n or_o soldier_n for_o his_o or_o their_o two_o three_o part_n and_o express_v the_o name_n or_o name_n of_o such_o person_n with_o convenient_a description_n and_o denomination_n thereof_o as_o to_o the_o number_n of_o acre_n the_o barony_n county_n and_o province_n wherein_o the_o same_o do_v lie_v and_o the_o rent_n reservable_a as_o also_o the_o tenure_n and_o service_n and_o present_v unto_o the_o lord_n lieutenant_n or_o other_o chief_a governor_n or_o governor_n of_o this_o kingdom_n for_o the_o time_n be_v he_o the_o say_a lord_n lieutenant_n and_o other_o chief_a governor_n or_o governor_n of_o this_o kingdom_n for_o the_o time_n be_v shall_v be_v and_o be_v hereby_o authorize_v and_o require_v upon_o request_n of_o the_o person_n or_o person_n so_o produce_v and_o present_v the_o certificate_n aforesaid_a to_o cause_v effectual_a letter_n patent_n under_o the_o great_a seal_n of_o ireland_n to_o discharge_v of_o all_o demand_n other_o than_o what_o be_v intend_v to_o be_v preserve_v by_o this_o act_n and_o shall_v be_v reserve_v in_o the_o same_o letter_n patent_n nevertheless_o it_o be_v hereby_o declare_v to_o be_v except_v and_o be_v further_o enact_v that_o no_o letter_n patent_n
hereafter_o to_o be_v grant_v shall_v any_o way_n extend_v to_o discharge_v or_o acquit_v any_o arrearage_n of_o quitrent_n reserve_v by_o the_o say_v former_a act_n and_o still_o behind_o and_o receive_v of_o land_n set_v out_o for_o english_a arrear_n or_o in_o satisfaction_n of_o any_o adventure_n upon_o the_o double_a ordinance_n above_o what_o the_o original_a money_n do_v deserve_v or_o in_o satisfaction_n of_o any_o other_o title_n or_o interest_n not_o satisfiable_a by_o this_o or_o the_o say_v former_a act_n nor_o to_o discharge_v any_o sum_n or_o sum_n of_o money_n which_o person_n transplant_v into_o conaught_n receive_v upon_o sale_n of_o their_o estate_n in_o conaught_n and_o yet_o have_v since_o be_v restore_v to_o their_o former_a estate_n or_o some_o part_n hereby_o make_v due_a and_o payable_a unto_o his_o majesty_n his_o heir_n and_o successor_n and_o shall_v be_v leviable_a and_o recoverable_a against_o every_o person_n and_o person_n who_o shall_v be_v liable_a thereunto_o his_o and_o their_o heir_n executor_n and_o administrator_n and_o all_o and_o every_o their_o land_n tenement_n good_n and_o chattel_n whatsoever_o any_o grant_n patent_n settlement_n or_o other_o disposition_n make_v in_o pursuance_n of_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o for_o the_o prevention_n of_o all_o unnecessary_a delay_n and_o unjust_a charge_n which_o can_n or_o may_v happen_v to_o the_o subject_n of_o this_o realm_n before_o their_o full_a and_o final_a settlement_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o where_o the_o commissioner_n for_o execution_n of_o this_o act_n or_o the_o major_a part_n of_o they_o shall_v give_v any_o certificate_n under_o he_o and_o their_o hand_n and_o seal_n to_o any_o person_n or_o person_n body_n politic_a or_o corporate_a in_o order_n to_o the_o pass_v of_o any_o letter_n patent_n according_a to_o this_o act_n and_o shall_v likewise_o return_v a_o duplicate_v of_o such_o certificate_n into_o his_o majesty_n court_n of_o exchequer_n at_o dublin_n to_o be_v there_o enrol_v and_o the_o person_n or_o person_n body_n politic_a or_o corporate_a to_o who_o such_o certificate_n shall_v be_v give_v shall_v immediate_o upon_o the_o obtain_n of_o such_o certificate_n and_o from_o time_n to_o time_n during_o the_o space_n of_o six_o month_n next_o ensue_v the_o date_n thereof_o diligent_o and_o without_o intermission_n pursue_v and_o prosecute_v the_o have_v and_o obtain_v of_o letter_n patent_n according_o and_o in_o order_n thereunto_o thereof_o delay_v or_o hinder_v by_o the_o neglect_n of_o any_o officer_n or_o minister_n as_o aforesaid_a that_o there_o and_o in_o such_o case_n the_o several_a and_o respective_a person_n body_n politic_a and_o corporate_a to_o who_o or_o in_o who_o behalf_n such_o certificate_n shall_v be_v give_v or_o grant_v shall_v hold_v and_o enjoy_v the_o several_a message_n manor_n land_n tenement_n and_o hereditament_n in_o the_o several_a and_o respective_a certificate_n mention_v and_o allot_v according_a to_o such_o estate_n and_o under_o such_o rent_n as_o be_v therein_o mention_v as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n as_o if_o letter_n patent_n thereof_o have_v be_v grant_v and_o perfect_v according_a to_o the_o direction_n of_o this_o act_n any_o thing_n in_o this_o or_o the_o say_v former_a act_n and_o any_o other_o law_n statute_n or_o usage_n to_o the_o contrary_a notwithstanding_o provide_v always_o and_o be_v it_o enact_v that_o where_o any_o soldier_n or_o soldier_n adventurer_n or_o adventurer_n his_o or_o their_o heir_n executor_n assignee_n or_o assign_n have_v have_v any_o land_n tenement_n or_o hereditament_n former_o set_v out_o to_o he_o or_o they_o as_o well_o in_o satisfaction_n of_o arrear_n due_a for_o service_n do_v in_o england_n as_o of_o arrear_n due_a for_o service_n do_v in_o ireland_n or_o in_o satisfaction_n of_o adventure_n upon_o the_o double_a ordinance_n or_o in_o satisfaction_n of_o any_o other_o title_n and_o interest_n not_o provide_v for_o by_o this_o act_n together_o with_o other_o adventure_n and_o such_o set_n forth_o of_o land_n have_v be_v promiscuous_o and_o indefinite_o as_o in_o the_o gross_a without_o any_o particular_a application_n or_o distinction_n of_o the_o land_n show_v which_o part_n of_o the_o say_a land_n be_v intend_v as_o a_o satisfaction_n of_o the_o english_a arrear_n and_o which_o part_n as_o a_o satisfaction_n of_o the_o irish_a arrear_n or_o which_o part_n be_v set_v out_o in_o satisfaction_n of_o adventure_n upon_o the_o double_a ordinance_n or_o of_o other_o title_n or_o interest_n not_o provide_v for_o by_o this_o act_n and_o which_o part_n for_o other_o adventure_n and_o the_o whole_a or_o part_n of_o the_o say_a land_n so_o promiscuous_o set_v out_o as_o aforesaid_a have_v be_v evict_v or_o decree_v away_o by_o virtue_n of_o some_o proceed_n of_o the_o commissioner_n appoint_v for_o execution_n of_o the_o say_v former_a act_n that_o then_o and_o in_o such_o case_n the_o land_n so_o evict_v or_o decree_v as_o aforesaid_a shall_v be_v account_v in_o law_n to_o be_v such_o land_n only_o as_o be_v intend_v for_o the_o satisfaction_n of_o english_a arrear_n or_o adventure_n upon_o the_o double_a ordinance_n or_o of_o other_o title_n and_o interest_n not_o provide_v for_o by_o this_o act_n so_o far_o as_o the_o same_o will_v extend_v and_o all_o account_n and_o payment_n of_o the_o measn_a profit_n of_o the_o land_n so_o evict_v be_v to_o cease_v for_o so_o much_o from_o the_o time_n of_o such_o eviction_n or_o decree_n as_o aforesaid_a nevertheless_o it_o be_v declare_v that_o nothing_o herein_o contain_v shall_v exclude_v such_o person_n or_o person_n from_o have_v their_o full_a two_o three_o part_n which_o be_v satisfiable_a by_o the_o rule_n of_o this_o act_n and_o from_o retain_v so_o much_o whereof_o they_o remain_v possess_v for_o and_o towards_o such_o satisfaction_n and_o to_o the_o end_n the_o subject_n of_o this_o kingdom_n may_v be_v in_o some_o measure_n ease_v of_o those_o charge_n which_o be_v usual_a and_o ordinary_a in_o pass_v of_o letter_n patent_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o so_o many_o of_o his_o all_o other_o case_n touch_v patent_n to_o be_v grant_v by_o virtue_n of_o this_o act_n to_o regulate_v and_o moderate_v the_o fee_n of_o officer_n as_o they_o shall_v think_v fit_a according_a to_o circumstance_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o where_o any_o land_n shall_v be_v allot_v unto_o or_o detain_v by_o any_o adventurer_n or_o soldier_n or_o the_o heir_n executor_n assignee_n or_o assign_v of_o any_o adventurer_n or_o soldier_n for_o and_o towards_o he_o and_o their_o full_a two_o three_o part_n or_o for_o any_o part_n thereof_o which_o land_n so_o allot_v or_o detain_v as_o aforesaid_a shall_v be_v
the_o new_a survey_n if_o the_o same_o exceed_v not_o one_o ten_o part_n of_o what_o be_v due_a to_o the_o defendant_n or_o defendant_n no_o retrenchment_n shall_v be_v make_v seven_o if_o the_o overplus_n exceed_v a_o ten_o it_o shall_v be_v lawful_a to_o and_o for_o such_o defendant_n or_o defendant_n possess_v of_o the_o overplus_n to_o retrench_v the_o same_o where_o they_o think_v fit_a profit_n of_o the_o land_n so_o retrench_v eight_o if_o the_o information_n of_o false_a admeasurement_n be_v against_o a_o soldier_n or_o his_o heir_n or_o assign_v there_o the_o lot_n of_o the_o and_o to_o their_o and_o every_o of_o their_o respective_a successor_n for_o ever_o such_o augmentation_n and_o allowance_n and_o out_o of_o such_o land_n as_o be_v former_o hold_v or_o repute_v to_o be_v hold_v in_o fee_n farm_n of_o any_o archbishop_n bishop_n dean_n dean_n and_o chapter_n or_o other_o ecclesiastical_a person_n in_o he_o or_o their_o politic_a capacity_n under_o the_o value_v and_o if_o upon_o the_o return_n of_o such_o survey_n it_o shall_v appear_v that_o the_o land_n so_o grant_v as_o aforesaid_a do_v not_o exceed_v the_o value_n of_o such_o augmentation_n and_o allowance_n as_o by_o the_o say_v former_a act_n be_v intend_v to_o be_v settle_v upon_o the_o respective_a archbishop_n and_o bishop_n to_o who_o such_o letter_n patent_n be_v grant_v than_o the_o land_n so_o grant_v as_o aforesaid_a shall_v be_v hold_v and_o enjoy_v by_o the_o several_a and_o respective_a archbishop_n bishop_n and_o their_o successor_n according_a to_o the_o tenor_n of_o their_o respective_a letter_n patent_n and_o that_o the_o
say_v letter_n patent_n shall_v be_v of_o like_a force_n and_o effect_n as_o any_o other_o letter_n patent_n grant_v to_o adventurer_n or_o soldier_n by_o virtue_n of_o this_o act_n be_v or_o aught_o to_o be_v but_o if_o the_o land_n so_o grant_v as_o aforesaid_a shall_v exceed_v the_o value_n of_o such_o augmentation_n as_o by_o the_o say_v former_a act_n be_v intend_v to_o be_v settle_v on_o the_o archbishop_n or_o bishop_n to_o who_o the_o say_v land_n be_v grant_v than_o the_o commissioner_n for_o execution_n of_o this_o act_n shall_v cause_v such_o retrenchment_n of_o the_o overplus_n to_o be_v make_v as_o may_v leave_v unto_o the_o respective_a archbishop_n and_o bishop_n his_o and_o their_o due_a augmentation_n and_o allowance_n with_o as_o much_o conveniency_n and_o contiguity_n as_o may_v be_v and_o the_o land_n and_o tenement_n so_o leave_v unto_o the_o say_a archbishop_n and_o bishop_n shall_v be_v hold_v and_o enjoy_v by_o they_o and_o their_o successor_n respective_o as_o full_o and_o ample_o as_o the_o same_o may_v have_v be_v enjoy_v in_o case_n the_o land_n grant_v by_o the_o say_a letter_n patent_n have_v not_o exceed_v the_o value_n intend_v by_o the_o say_v former_a act_n and_o the_o say_a letter_n patent_n as_o to_o so_o much_o of_o the_o land_n therein_o contain_v which_o shall_v be_v retrench_v by_o the_o commissioner_n as_o aforesaid_a be_v hereby_o declare_v to_o be_v null_n and_o void_a and_o the_o land_n so_o retrench_v shall_v remain_v and_o be_v vest_v in_o his_o majesty_n to_o the_o use_n of_o this_o present_a act_n and_o if_o the_o land_n so_o grant_v as_o aforesaid_a shall_v fall_v short_a of_o the_o value_n of_o such_o augmentation_n as_o in_o and_o by_o the_o say_v former_a act_n be_v intend_v to_o be_v settle_v the_o commissioner_n for_o execution_n of_o this_o act_n shall_v cause_v the_o same_o to_o be_v supply_v and_o make_v up_o by_o a_o further_a allotment_n out_o of_o such_o land_n and_o in_o such_o way_n and_o manner_n as_o by_o the_o say_v former_a act_n be_v direct_v and_o it_o be_v further_o enact_v that_o in_o lieu_n of_o such_o provision_n for_o glebe_n as_o by_o the_o say_v former_a act_n be_v intend_v the_o say_a commissioner_n shall_v likewise_o set_v out_o so_o many_o acre_n of_o land_n more_o as_o may_v be_v sufficient_a to_o endow_v or_o supply_v all_o and_o every_o the_o parochial_a church_n in_o and_o exchange_n be_v to_o be_v understand_v but_o as_o one_o parish_n and_o parish_n within_o great_a city_n and_o wall_a town_n be_v not_o at_o all_o intend_a to_o be_v comprehend_v and_o the_o like_a care_n both_o for_o contiguity_n and_o conveniency_n be_v to_o be_v have_v in_o the_o set_n out_o of_o the_o augmentation_n of_o the_o several_a archbishopric_n and_o bishopric_n not_o already_o provide_v for_o as_o aforesaid_a as_o far_o as_o may_v be_v without_o the_o too_o great_a prejudice_n of_o the_o present_a possessor_n who_o be_v to_o be_v remove_v and_o after_o the_o land_n set_v out_o for_o the_o several_a augmentation_n and_o glebe_n as_o aforesaid_a the_o commissioner_n shall_v certify_v their_o proceed_n to_o the_o lord_n lieutenant_n or_o other_o chief_a governor_n and_o council_n for_o the_o time_n be_v and_o in_o case_n the_o proceed_n of_o the_o commissioner_n shall_v be_v there_o approve_v and_o allow_v than_o the_o land_n set_v out_o for_o augmentation_n and_o glebe_n as_o aforesaid_a shall_v be_v and_o be_v hereby_o vest_v and_o settle_v respective_o in_o the_o several_a and_o respective_a archbishop_n and_o bishop_n and_o incumbent_n of_o parochial_a church_n and_o their_o successor_n for_o ever_o and_o letter_n patent_n thereof_o be_v to_o be_v pass_v to_o they_o and_o their_o respective_a successor_n in_o like_a manner_n as_o be_v direct_v in_o the_o case_n of_o adventurer_n and_o soldier_n and_o to_o be_v of_o like_a effect_n subject_n nevertheless_o to_o the_o quit_v rent_n hereafter_o mention_v and_o no_o other_o and_o to_o the_o end_n the_o revenue_n of_o the_o church_n may_v be_v more_o speedy_o settle_v be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o land_n hold_v or_o repute_v to_o be_v hold_v in_o fee_n farm_n of_o any_o archbishop_n or_o bishop_n dean_n dean_n and_o chapter_n or_o other_o ecclesiastical_a person_n in_o he_o or_o their_o politic_a capacity_n and_o by_o this_o act_n vest_v in_o his_o majesty_n and_o the_o several_a impropriation_n forfeit_v to_o and_o by_o these_o present_v vest_v in_o his_o majesty_n shall_v be_v permit_v to_o remain_v and_o continue_v in_o the_o possession_n of_o the_o several_a archbishop_n bishop_n and_o other_o incumbent_n until_o the_o several_a and_o respective_a augmentation_n endowment_n and_o glebe_n set_v out_o and_o satisfy_v as_o aforesaid_a and_o from_o and_o after_o the_o augmentation_n satisfy_v the_o residue_n of_o the_o land_n hold_v in_o fee_n farm_n as_o aforesaid_a shall_v remain_v subject_a to_o the_o use_n of_o the_o former_a act_n not_o change_v by_o this_o act_n and_o to_o such_o other_o use_v as_o in_o this_o act_n be_v limit_v and_o appoint_v and_o all_o and_o every_o the_o impropriation_n or_o appropriate_a tithe_n vest_v in_o his_o majesty_n by_o these_o present_n or_o otherwise_o escheat_v to_o his_o majesty_n in_o right_n of_o his_o crown_n and_o by_o the_o say_v former_a act_n for_o the_o better_a execution_n of_o his_o majesty_n gracious_a declaration_n for_o the_o settlement_n of_o his_o kingdom_n of_o ireland_n and_o satisfaction_n of_o the_o several_a interest_n of_o say_a earl_n of_o kildares_n estate_n be_v give_v to_o the_o say_v wentworth_n late_a earl_n of_o kildare_n his_o heir_n and_o assign_n and_o further_o the_o arrear_n due_a to_o george_n earl_n of_o kildare_n for_o service_n before_o the_o five_o of_o june_n one_o thousand_o six_o hundred_o forty_o nine_o be_v appoint_v to_o be_v satisfy_v in_o the_o county_n of_o kildare_n and_o else_o where_o benefit_n of_o the_o say_v former_a proviso_n or_o touch_v the_o benefit_n of_o any_o part_n thereof_o have_v be_v pay_v unto_o the_o say_v late_a earl_n or_o shall_v be_v pay_v hereafter_o to_o such_o contractor_n during_o the_o minority_n of_o the_o the_o say_v john_n earl_n of_o kildare_n and_o liable_a also_o to_o such_o other_o charge_n and_o payment_n as_o shall_v be_v necessary_o make_v and_o disburse_v in_o and_o for_o the_o settle_n and_o secure_v the_o premise_n and_o that_o the_o letter_n patent_n so_o as_o aforesaid_a to_o be_v grant_v shall_v be_v of_o like_a force_n and_o effect_n as_o any_o other_o letter_n patent_n herein_o before_o appoint_v to_o be_v grant_v be_v or_o aught_o to_o be_v provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o out_o of_o the_o estate_n of_o john_n fitz_n gerald_n john_n magill_n and_o jeoffrey_n fane_v before_o by_o this_o act_n vest_v in_o his_o majesty_n his_o heir_n and_o successor_n that_o sir_n john_n stephen_n knight_n governor_n of_o his_o majesty_n castle_n of_o dublin_n shall_v and_o may_v have_v hold_v and_o enjoy_v to_o he_o his_o executor_n and_o assign_n all_o and_o every_o the_o land_n tenement_n and_o hereditament_n in_o the_o county_n of_o cork_n which_o at_o any_o time_n be_v repute_v to_o belong_v to_o sir_n brice_n coghran_n by_o colour_n of_o any_o grant_n or_o gift_n of_o the_o late_o usurp_v power_n and_o which_o be_v or_o have_v be_v possess_v by_o the_o say_a sir_n john_n stephens_n by_o virtue_n of_o letter_n patent_n under_o the_o great_a seal_n that_o if_o the_o several_a payment_n in_o and_o by_o the_o say_a letter_n patent_n intend_v to_o be_v secure_v shall_v be_v make_v and_o determine_v within_o the_o time_n hereby_o enlarge_v the_o same_o shall_v be_v as_o good_a and_o effectual_a in_o law_n as_o if_o they_o have_v be_v make_v within_o the_o say_v five_o year_n and_o that_o in_o all_o other_o use_n limitation_n matter_n and_o
