principal_o and_o indeed_o only_o intend_v to_o be_v consider_v in_o the_o case_n of_o st._n james_n but_o some_o of_o the_o now_o plaintiff_n council_n stir_v the_o two_o first_o point_n again_o of_o the_o whole_a court_n with_o great_a clearness_n first_o as_o to_o the_o first_o point_n this_o prerogative_n and_o right_n of_o present_v by_o the_o crown_n upon_o the_o promotion_n of_o the_o incumbent_n of_o a_o subject_n live_v to_o a_o bishopric_n be_v a_o ancient_n right_o settle_v and_o establish_v by_o divers_a solemn_a judgement_n in_o the_o reign_v of_o king_n henry_n viii_o no_o dispute_n nor_o be_v it_o any_o objection_n against_o this_o right_n of_o the_o crown_n that_o it_o have_v not_o be_v put_v in_o execution_n in_o some_o case_n ancient_o where_o the_o crown_n have_v another_o title_n by_o reason_n of_o wardship_n or_o of_o the_o temporality_n of_o a_o bishopric_n be_v in_o the_o king_n hand_n for_o beside_o what_o be_v say_v before_o as_o to_o the_o pope_n claim_n and_o usurpation_n the_o crown_n without_o prejudice_n to_o the_o prerogative_n may_v make_v use_n of_o that_o other_o title_n not_o claim_v by_o the_o pope_n upon_o which_o to_o bring_v quare_fw-la impedit_n wherein_o one_o single_a title_n must_v be_v rely_v on_o rather_o than_o to_o make_v use_n of_o that_o which_o the_o pope_n then_o challenge_v and_o usurp_v it_o be_v improper_a for_o the_o king_n to_o set_v up_o his_o own_o prerogative_n against_o himself_o when_o he_o have_v another_o title_n in_o he_o by_o way_n of_o interest_n and_o it_o seem_v a_o strange_a attempt_n after_o so_o many_o age_n and_o such_o settle_a judicial_a determination_n to_o question_v that_o point_n of_o prerogative_n whereunto_o till_o this_o case_n a_o entire_a submission_n have_v be_v by_o some_o book_n of_o presentation_n to_o live_n in_o and_o since_o the_o reign_n of_o queen_n elizabeth_n still_o extant_a the_o former_a be_v lose_v or_o destroy_v that_o the_o crown_n have_v present_v several_a hundred_o of_o time_n upon_o such_o promotion_n and_o enjoyment_n be_v have_v according_o ii_o as_o to_o the_o second_o point_n about_o the_o dispensation_n that_o can_v in_o no_o any_o commenda_fw-la but_o come_v before_o the_o consecration_n be_v lawful_a and_o effectual_a and_o the_o now_o plaintiff_n by_o their_o plead_n in_o the_o cause_n have_v own_v and_o admit_v it_o to_o be_v so_o and_o then_o thereby_o the_o avoidance_n be_v suspend_v and_o no_o vacancy_n happen_v by_o the_o consecration_n nor_o till_o the_o dispensation_n expire_v which_o be_v the_o first_o of_o july_n 1692._o so_o that_o to_o affirm_v this_o dispensation_n or_o confirmation_n do_v serve_v or_o execute_v the_o king_n turn_n be_v to_o say_v the_o king_n use_v his_o turn_n before_o he_o have_v it_o or_o fill_v a_o vacancy_n before_o it_o be_v and_o that_o not_o by_o his_o own_o but_o by_o the_o act_n or_o instrument_n of_o the_o archbishop_n the_o confirmation_n which_o be_v the_o king_n act_n be_v bare_o a_o formality_n require_v by_o the_o statute_n hen._n 8._o to_o the_o dispensation_n of_o the_o archbishop_n iii_o as_o to_o the_o three_o point_n upon_o the_o act_n of_o parliament_n there_o have_v be_v two_o thing_n object_v by_o the_o now_o plaintiff_n council_n 1._o that_o st._n james_n be_v a_o new_a rectory_n create_v by_o act_n of_o parliament_n and_o that_o dr._n tennison_n come_v not_o into_o it_o by_o presentation_n but_o donation_n and_o that_o the_o prerogative_n operate_v only_o upon_o presentative_a live_n 2._o that_o by_o the_o express_a word_n of_o the_o act_n it_o be_v provide_v that_o the_o first_o rector_n after_o the_o decease_n of_o dr._n tennison_n or_o next_o avoidance_n shall_v be_v present_v or_o collate_v by_o the_o bishop_n of_o london_n as_o to_o the_o first_o there_o be_v no_o doubt_n but_o that_o st._n james_n be_v by_o the_o act_n make_v a_o presentative_a rectory_n participate_v of_o the_o nature_n of_o other_o presentative_a live_n and_o dr._n tennison_n be_v continue_v in_o his_o former_a cure_n though_o under_o another_o name_n and_o there_o be_v no_o reason_n in_o law_n to_o make_v it_o a_o donative_n or_o otherwise_o than_o of_o the_o nature_n of_o a_o presentative_a live_n in_o dr._n tennison_n nor_o for_o a_o distinction_n between_o old_a and_o new_a rectory_n but_o the_o right_n of_o the_o prerogative_n be_v found_v upon_o the_o promotion_n of_o the_o incumbent_n that_o hold_v equal_o both_o in_o old_a and_o new_a rectory_n where_o such_o promotion_n happen_v to_o be_v and_o when_o this_o new_a rectory_n void_v by_o promotion_n then_o and_o not_o till_o then_o the_o crown_n be_v prerogative_n to_o present_n arise_v as_o much_o as_o it_o will_v or_o can_v have_v do_v in_o the_o case_n of_o a_o old_a presentative_a live_n as_o to_o the_o second_o there_o can_v be_v no_o reason_n to_o think_v the_o act_n intend_v to_o take_v away_o the_o prerogative_n of_o the_o crown_n which_o general_o speak_v be_v not_o bind_v unless_o special_o name_v but_o the_o end_n of_o this_o act_n be_v to_o erect_v a_o new_a parish_n and_o rectory_n and_o to_o make_v they_o of_o the_o same_o nature_n with_o other_o parish_n and_o rectory_n and_o to_o settle_v the_o right_n of_o each_o as_o between_o the_o patron_n and_o parishioner_n but_o in_o no_o sort_n to_o meddle_v with_o much_o less_o to_o take_v away_o the_o right_n of_o the_o crown_n nor_o be_v there_o any_o need_n of_o a_o save_n of_o the_o king_n be_v right_o which_o arise_v by_o the_o act_n by_o make_v the_o rectory_n presentative_a and_o it_o be_v not_o of_o any_o weight_n to_o say_v the_o express_a word_n be_v for_o the_o bishop_n present_v the_o intent_n of_o the_o act_n be_v satisfy_v by_o settle_v be_v the_o prerogative_n and_o it_o have_v be_v resolve_v that_o the_o grantee_n of_o the_o next_o presentation_n must_v give_v way_n to_o the_o prerogative_n though_o he_o lose_v his_o turn_n by_o it_o and_o if_o this_o act_n shall_v be_v take_v literal_o then_o there_o will_v be_v no_o right_a to_o present_v by_o lapse_n nor_o presentation_n by_o the_o crown_n in_o case_n of_o any_o forfeiture_n or_o of_o the_o temporality_n be_v in_o the_o king_n hand_n which_o will_v be_v absurd_a to_o maintain_v and_o such_o a_o literal_a construction_n be_v against_o the_o rule_n and_o
