speech_n to_o the_o parliament_n that_o he_o wish_v he_o have_v such_o a_o power_n which_o his_o declaration_n before_o seem_v to_o assume_v the_o parliament_n be_v so_o jealous_a of_o this_o that_o they_o immediate_o make_v their_o application_n to_o his_o majesty_n by_o a_o address_n against_o the_o declaration_n and_o they_o give_v reason_n against_o it_o in_o their_o address_n one_o in_o particular_a be_v that_o the_o king_n can_v not_o dispense_v with_o those_o law_n without_o a_o act_n of_o parliament_n there_o be_v another_o attempt_n in_o 1672._o and_o then_o after_o his_o majesty_n have_v in_o his_o speech_n mention_v his_o declaration_n to_o they_o the_o parliament_n there_o again_o particular_o the_o house_n of_o commons_o do_v humble_o address_v to_o his_o majesty_n set_v forth_o that_o this_o can_v not_o be_v do_v by_o law_n without_o a_o act_n of_o parliament_n and_o your_o lordship_n by_o and_o by_o upon_o read_v the_o record_n will_v be_v satisfy_v what_o be_v the_o event_n of_o all_o this_o his_o majesty_n himself_o be_v so_o far_o please_v to_o concur_v with_o they_o in_o that_o opinion_n that_o he_o cancel_v his_o declaration_n tear_v off_o the_o seal_n and_o cause_v it_o to_o be_v make_v know_v to_o the_o house_n of_o lord_n by_o the_o lord_n chancellor_n who_o by_o his_o majesty_n command_n satisfy_v the_o house_n of_o it_o that_o his_o majesty_n have_v break_v the_o seal_n and_o cancel_v the_o declaration_n with_o this_o further_a declaration_n which_o be_v enter_v in_o the_o record_n of_o the_o house_n that_o it_o shall_v never_o be_v draw_v into_o example_n or_o consequence_n my_o lord_n the_o matter_n stand_v thus_o in_o respect_n to_o the_o king_n prerogative_n and_o the_o declaration_n that_o have_v be_v make_v in_o parliament_n consider_v next_o i_o beseech_v you_o how_o far_o my_o lord_n the_o bishop_n be_v concern_v in_o this_o question_n humble_o to_o make_v their_o application_n to_o the_o king._n my_o lord_n the_o bishop_n lie_v under_o a_o command_n to_o publish_v this_o declaration_n it_o be_v their_o duty_n as_o peer_n of_o the_o realm_n and_o bishop_n of_o the_o church_n of_o england_n humble_o to_o apply_v themselves_o to_o his_o majesty_n to_o make_v know_v their_o reason_n why_o they_o can_v not_o obey_v that_o command_n and_o they_o do_v it_o with_o all_o submission_n and_o all_o humility_n represent_v to_o his_o majesty_n what_o have_v be_v declare_v in_o parliament_n and_o it_o have_v be_v so_o declare_v they_o can_v not_o comply_v with_o his_o order_n as_o apprehend_v that_o this_o declaration_n be_v found_v upon_o that_o which_o the_o parliament_n declare_v to_o be_v illegal_a and_o so_o his_o majesty_n command_n to_o publish_v this_o declaration_n will_v not_o warrant_v they_o so_o to_o do_v this_o they_o do_v as_o peer_n and_o this_o they_o have_v a_o right_a to_o do_v as_o bishop_n humble_o to_o advise_v the_o king._n for_o suppose_v my_o lord_n which_o be_v not_o to_o be_v suppose_v in_o every_o case_n nor_o do_v i_o suppose_v it_o in_o this_o but_o suppose_v that_o there_o may_v be_v a_o king_n of_o england_n that_o shall_v be_v mislead_v i_o do_v not_o suppose_v that_o to_o be_v the_o case_n now_o i_o say_v but_o i_o know_v it_o have_v be_v the_o case_n former_o that_o the_o king_n shall_v be_v environ_v with_o counsellor_n that_o have_v give_v he_o evil_a advice_n it_o have_v be_v object_v as_o a_o crime_n against_o such_o evil_a counsellor_n that_o they_o will_v not_o permit_v and_o suffer_v the_o great_a man_n of_o the_o kingdom_n to_o offer_v the_o king_n their_o advice_n how_o often_o do_v we_o say_v in_o westminster-hall_n that_o the_o king_n be_v deceive_v in_o his_o grant_n there_o be_v scarce_o a_o day_n in_o the_o term_n but_o it_o be_v say_v in_o one_o court_n or_o other_o but_o it_o be_v never_o yet_o think_v a_o offence_n to_o say_v so_o and_o what_o more_o be_v there_o in_o this_o case_n my_o lord_n if_o the_o king_n be_v misinform_v or_o under_o a_o misapprehension_n of_o the_o law_n my_o lord_n as_o they_o be_v peer_n and_o as_o they_o be_v bishop_n be_v concern_v in_o it_o and_o if_o they_o humble_o apply_v themselves_o to_o the_o king_n and_o offer_v he_o their_o advice_n where_o be_v the_o crime_n my_o lord_n these_o noble_a lord_n the_o defendant_n have_v more_o than_o a_o ordinary_a call_v to_o this_o for_o beside_o the_o duty_n of_o their_o office_n and_o the_o care_n of_o the_o church_n that_o be_v incumbent_a on_o they_o as_o bishop_n they_o be_v here_o to_o become_v actor_n for_o they_o be_v by_o that_o order_n of_o council_n command_v themselves_o to_o publish_v it_o and_o to_o distribute_v it_o to_o the_o several_a minister_n in_o their_o several_a diocese_n with_o their_o command_n to_o read_v it_o therefore_o they_o have_v more_o than_o ordinary_a reason_n to_o concern_v themselves_o in_o the_o matter_n next_o we_o be_v to_o consider_v my_o lord_n in_o what_o manner_n this_o be_v do_v they_o make_v their_o application_n to_o the_o king_n by_o a_o humble_a petition_n with_o all_o the_o decency_n and_o respect_n that_o can_v be_v show_v ask_v leave_n first_o to_o approach_v his_o person_n and_o have_v leave_n they_o offer_v my_o lord_n precedent_n the_o matter_n of_o their_o petition_n that_o nothing_o may_v seem_v hard_a or_o disrespectful_a or_o as_o if_o they_o intend_v any_o thing_n that_o be_v unfit_a to_o be_v avow_v when_o they_o have_v take_v all_o this_o care_n in_o their_o approach_n and_o beg_a leave_n for_o it_o they_o come_v secret_o to_o the_o king_n in_o private_a when_o he_o be_v all_o alone_a and_o there_o they_o humble_o present_v this_o petition_n to_o his_o majesty_n now_o how_o this_o can_v be_v call_v the_o publication_n of_o a_o malicious_a and_o seditious_a libel_n when_o it_o be_v but_o the_o present_v of_o a_o petition_n to_o the_o king_n alone_o and_o how_o it_o can_v be_v say_v to_o be_v with_o a_o intent_n to_o stir_v up_o sedition_n in_o the_o people_n against_o his_o majesty_n and_o to_o alienate_v the_o heart_n of_o his_o people_n from_o he_o when_o it_o be_v in_o this_o private_a manner_n deliver_v to_o he_o himself_o only_o true_o i_o can_v apprehend_v my_o lord_n i_o hope_v nothing_o of_o this_o can_v be_v think_v a_o offence_n if_o the_o jury_n shall_v think_v that_o there_o have_v be_v evidence_n sufficient_a give_v to_o prove_v that_o my_o lord_n the_o bishop_n do_v deliver_v this_o paper_n to_o the_o king_n yet_o that_o be_v not_o enough_o to_o make_v they_o guilty_a of_o this_o information_n unless_o this_o paper_n be_v likewise_o find_v to_o be_v in_o diminution_n of_o the_o king_n be_v royal_a prerogative_n and_o regal_a authority_n in_o dispense_n with_o and_o suspend_v of_o all_o law_n without_o act_n of_o parliament_n unless_o it_o be_v find_v to_o be_v a_o libel_n against_o the_o king_n to_o tell_v he_o that_o in_o parliament_n it_o be_v so_o and_o so_o declare_v and_o unless_o the_o present_v this_o by_o way_n of_o petition_n which_o be_v the_o right_n of_o all_o people_n that_o apprehend_v themselves_o aggrieve_v to_o approach_v his_o majesty_n by_o petition_n be_v a_o libel_v of_o the_o king_n and_o unless_o this_o humble_a petition_n in_o this_o manner_n present_v to_o the_o king_n in_o private_a may_v be_v say_v to_o be_v a_o malicious_a and_o seditious_a libel_n with_o a_o intent_n to_o stir_v up_o the_o people_n to_o sedition_n unless_o all_o this_o can_v be_v find_v there_o be_v no_o man_n live_a can_v ever_o find_v my_o lord_n the_o bishop_n guilty_a upon_o this_o information_n therefore_o my_o lord_n we_o will_v go_v on_o and_o make_v out_o this_o matter_n that_o we_o have_v open_v to_o your_o lordship_n if_o mr._n attorney_n and_o mr._n solicitor_n think_v fit_a to_o argue_v the_o point_n that_o we_o have_v open_v mr._n pollixfen_n pray_v my_o lord_n spare_v i_o a_o word_n on_o the_o same_o side_n for_o the_o first_o point_n it_o be_v a_o point_n of_o law_n whether_o the_o matter_n contain_v in_o this_o petition_n be_v a_o libel_n the_o king_n council_n pretend_v it_o be_v so_o because_o it_o say_v the_o declaration_n be_v found_v upon_o a_o power_n the_o parliament_n have_v declare_v to_o be_v illegal_a but_o we_o say_v that_o whatsoever_o the_o king_n be_v please_v to_o say_v in_o any_o declaration_n of_o he_o it_o be_v not_o the_o king_n be_v say_v of_o it_o that_o make_v
religion_n that_o be_v intend_v to_o be_v prohibit_v and_o so_o much_o care_n be_v take_v and_o so_o many_o statute_n make_v to_o prohibit_v it_o will_v come_v in_o and_o all_o this_o care_n and_o all_o those_o statute_n go_v for_o nothing_o this_o one_o declaration_n set_v they_o all_o out_o of_o door_n and_o then_o that_o religion_n stand_v upon_o equal_a term_n with_o the_o establish_a religion_n my_o lord_n we_o say_v this_o far_o that_o my_o lord_n the_o bishop_n have_v the_o care_n of_o the_o church_n by_o their_o very_a function_n and_o office_n and_o be_v bind_v to_o take_v care_n to_o keep_v out_o all_o those_o false_a religion_n that_o be_v prohibit_v and_o design_v to_o be_v keep_v out_o by_o the_o law._n my_o lord_n the_o bishop_n find_v this_o declaration_n found_v upon_o a_o mere_a pretend_a power_n that_o have_v be_v continual_o oppose_v and_o reject_v in_o parliament_n can_v not_o comply_v with_o the_o king_n command_n to_o read_v it_o my_o lord_n such_o a_o power_n to_o dispense_v with_o or_o suspend_v the_o law_n of_o a_o nation_n can_v with_o any_o shadow_n of_o reason_n be_v it_o be_v not_o long_o since_o that_o such_o a_o power_n be_v ever_o pretend_v to_o by_o any_o but_o such_o as_o have_v the_o legislative_a too_o for_o it_o be_v plain_a that_o such_o a_o power_n must_v at_o least_o be_v equal_a to_o the_o power_n that_o make_v the_o law_n to_o dispense_v with_o a_o law_n must_v argue_v a_o power_n great_a or_o at_o least_o as_o great_a as_o that_o which_o make_v the_o law._n my_o lord_n it_o have_v be_v often_o say_v in_o our_o book_n that_o where_o the_o king_n subject_n be_v concern_v in_o interest_n the_o king_n can_v suspend_v or_o dispense_v with_o a_o particular_a law._n but_o my_o lord_n how_o can_v the_o king_n subject_n be_v more_o concern_v in_o interest_n than_o when_o their_o religion_n lie_v at_o stake_n it_o have_v be_v resolve_v upon_o the_o statute_n of_o simony_n that_o where_o the_o statute_n have_v disable_v the_o party_n to_o take_v there_o the_o king_n can_v not_o enable_v he_o against_o that_o act_n of_o parliament_n and_o shall_v it_o be_v say_v that_o by_o his_o dispensation_n he_o shall_v enable_v one_o to_o hold_v a_o office_n who_o be_v disable_v by_o the_o test-act_n my_o lord_n we_o say_v the_o course_n of_o our_o law_n allow_v no_o such_o dispensation_n as_o this_o declaration_n pretend_v to_o and_o he_o that_o be_v but_o mean_o read_v in_o our_o law_n must_v needs_o understand_v this_o that_o the_o king_n of_o england_n can_v suspend_v our_o law_n for_o that_o will_v be_v to_o set_v aside_o the_o law_n of_o the_o kingdom_n and_o then_o we_o may_v be_v clear_o without_o any_o law_n if_o the_o king_n shall_v please_v to_o suspend_v they_o it_o be_v true_a we_o say_v the_o last_o king_n charles_n be_v prevail_v upon_o by_o misinformation_n to_o make_v a_o dispensation_n somewhat_o of_o the_o nature_n of_o this_o though_o not_o so_o full_a a_o one_o for_o that_o dispense_v only_o with_o some_o few_o ceremony_n and_o thing_n of_o that_o nature_n but_o the_o house_n of_o commons_o this_o take_a air_n in_o 1662._o represent_v this_o to_o the_o king_n by_o a_o petition_n and_o what_o be_v it_o that_o they_o do_v represent_v that_o he_o by_o his_o dispensation_n have_v undertake_v to_o do_v that_o which_o nothing_o but_o a_o act_n of_o parliament_n can_v do_v that_o be_v the_o dispense_n with_o penal_a law_n which_o be_v only_o to_o be_v do_v by_o act_n of_o parliament_n and_o thereupon_o it_o be_v think_v fit_a upon_o the_o king_n account_n to_o bring_v in_o a_o act_n for_o it_o in_o some_o case_n my_o lord_n the_o king_n do_v then_o in_o his_o speech_n to_o the_o parliament_n which_o we_o use_v as_o a_o great_a argument_n against_o this_o dispense_v power_n say_v this_o that_o consider_v the_o circumstance_n of_o the_o nation_n he_o can_v wish_v with_o all_o his_o heart_n that_o he_o have_v such_o a_o power_n to_o dispense_v with_o some_o law_n in_o some_o particular_n and_o thereupon_o there_o be_v a_o bill_n in_o order_n to_o a_o act_n of_o parliament_n bring_v in_o giving_z the_o king_n a_o power_n to_o dispense_v but_o my_o lord_n with_o a_o great_a many_o qualification_n which_o show_v plain_o that_o it_o be_v take_v by_o the_o parliament_n that_o he_o have_v no_o power_n to_o dispense_v with_o the_o law_n of_o himself_o my_o lord_n afterward_o in_o 1672._o the_o king_n be_v prevail_v upon_o again_o to_o grant_v another_o dispensation_n somewhat_o large_a l._n c._n i._n brother_n pemberton_n
