a_o worse_a condition_n on_o these_o account_n then_o in_o their_o civil_a interest_n and_o that_o upon_o a_o threefold_a account_n 1._o the_o secular_a law_n and_o statute_n make_v in_o behalf_n of_o the_o subject_n be_v often_o upon_o further_a deliberation_n and_o experience_n of_o inconvenience_n alter_v and_o repeal_v whereby_o the_o subject_n have_v ease_v it_o be_v ordinary_o see_v in_o our_o civil_a concern_v that_o some_o act_n of_o parliament_n that_o partly_o for_o their_o severity_n or_o upon_o some_o other_o account_n pass_v as_o doubtful_a whether_o fit_a to_o remain_v as_o stand_a law_n be_v therefore_o limit_v to_o a_o certain_a time_n and_o after_o which_o to_o expire_v and_o cease_v the_o severe_a act_n of_o 35_o eliz._n which_o in_o the_o process_n of_o it_o reach_v man_n life_n when_o first_o pass_v be_v to_o remain_v a_o law_n but_o to_o the_o end_n of_o the_o next_o session_n of_o parliament_n which_o in_o regard_n of_o some_o doubt_n it_o seem_v whether_o in_o force_n or_o not_o be_v declare_v by_o this_o present_a parliament_n to_o be_v so_o and_o that_o it_o ought_v to_o be_v put_v in_o due_a execution_n and_o now_o at_o this_o time_n there_o be_v a_o minister_n of_o the_o gospel_n under_o the_o sentence_n of_o that_o act_n and_o for_o transgress_v that_o law_n have_v lose_v his_o life_n have_v not_o his_o majesty_n interpose_v by_o his_o prerogative_n a_o wise_a statesman_n once_o advise_v and_o express_v himself_o thus_o i_o ask_v why_o the_o civil_a state_n shall_v be_v purge_v and_o restore_v with_o good_a and_o wholesome_a law_n make_v in_o every_o 30_o or_o 40_o year_n in_o parliament_n provide_v remedy_n as_o fast_o as_o time_n breed_v mischief_n and_o comrariwise_o the_o ecclesiastical_a state_n shall_v still_o continue_v upon_o the_o dregs_n of_o time_n and_o receive_v no_o alteration_n now_o for_o these_o many_o year_n we_o have_v hear_v of_o no_o offer_n of_o bill_n in_o parliament_n be_v it_o because_o there_o be_v nothing_o amiss_o sir_n fr._n bacon_n 2._o in_o that_o all_o proceed_n in_o ecclesiastical_a court_n be_v ever_o to_o the_o utmost_a rigour_n and_o letter_n of_o their_o canon_n and_o order_n there_o be_v no_o chancery_n or_o court_n of_o equity_n to_o appeal_v to_o for_o redress_v but_o in_o some_o few_o case_n as_o in_o cause_n testamentary_a matrimony_n divorce_n etc._n etc._n specify_v 24_o h._n 8._o matter_n wherein_o our_o estate_n be_v touch_v but_o in_o matter_n of_o conformity_n and_o such_o case_n wherein_o our_o conscience_n be_v concern_v we_o be_v leave_v destitute_a 3._o man_n be_v upon_o this_o peculiar_a disadvantage_n in_o these_o spiritual_a court_n who_o be_v impeach_v for_o nonconformity_n to_o their_o canon_n and_o order_n in_o that_o their_o adversary_n and_o those_o that_o be_v party_n for_o the_o most_o part_n be_v their_o judge_n this_o sir_n fr._n bacon_n in_o his_o consideration_n condemn_v as_o a_o great_a injustice_n so_o that_o it_o be_v evident_a consider_v the_o nature_n of_o ecclesiastical_a constitution_n and_o how_o manage_v with_o we_o in_o this_o nation_n how_o necessary_a it_o be_v that_o some_o power_n be_v place_v somewhere_o by_o which_o we_o may_v be_v relieve_v when_o expose_v more_o than_o other_o to_o such_o extremity_n of_o rigour_n for_o otherwise_o as_o conscientious_a man_n be_v more_o dispose_v to_o doubt_n and_o scruple_n in_o the_o way_n of_o duty_n in_o this_o kind_n so_o to_o less_o mercy_n and_o indulgence_n from_o our_o superior_n chap._n iii_o that_o our_o relief_n be_v from_o the_o jurisdiction_n and_o power_n in_o his_o majesty_n to_o dispense_v and_o exempt_a for_o in_o his_o hand_n this_o balance_n be_v place_v which_o be_v that_o we_o shall_v insist_v upon_o in_o the_o next_o place_n 1._o this_o prerogative_n and_o power_n to_o exempt_v from_o ecclesiastical_a law_n be_v in_o the_o sovereign_n for_o the_o confirm_v whereof_o not_o to_o insist_v upon_o what_o be_v acknowledge_v by_o urge_v from_o antiquity_n but_o to_o come_v near_a home_n i_o bring_v the_o testimony_n of_o the_o clergy_n in_o convocation_n or_o the_o representative_a church_n of_o england_n who_o make_v it_o so_o great_a a_o duty_n to_o acknowledge_v this_o as_o they_o have_v express_v their_o severity_n thus_o whosoever_o shall_v affirm_v the_o king_n majesty_n have_v not_o the_o same_o authority_n in_o but_o by_o the_o archbishop_n of_o canterbury_n canon_n of_o the_o convocation_n 1603._o i_o shall_v join_v with_o this_o testimony_n that_o of_o another_o council_n namely_o that_o meet_v in_o the_o star-chamber_n 2_o jac._n make_v up_o of_o all_o the_o judge_n and_o person_n learn_v in_o the_o law_n summon_v by_o king_n james_n for_o resolution_n in_o some_o ecclesiastical_a case_n whereof_o this_o of_o his_o majesty_n prerogative_n be_v one_o their_o resolution_n you_o have_v in_o these_o word_n the_o king_n without_o the_o parliament_n may_v make_v order_n and_o constitution_n for_o the_o several_a court_n of_o justice_n 3._o and_o from_o time_n to_o time_n the_o king_n and_o queen_n of_o england_n have_v assume_v and_o exercise_v this_o power_n 1._o in_o general_n the_o whole_a body_n and_o system_v of_o ecelesiastical_a law_n and_o canon_n be_v publish_v by_o the_o synod_n of_o the_o clergy_n from_o time_n to_o time_n without_o any_o particular_a parliamentary_a sanction_n and_o yet_o have_v not_o these_o canon_n their_o authority_n from_o the_o synod_n or_o clergy_n meet_v in_o convocation_n for_o canon_n conclude_v by_o the_o province_n of_o canterbury_n only_o can_v as_o such_o oblige_v the_o clergy_n of_o the_o province_n of_o york_n who_o have_v no_o representative_n or_o clerk_n sit_v in_o that_o synod_n or_o convocation_n that_o meet_v anno_fw-la 1584._o 1597._o and_o 1603._o and_o yet_o its_o canon_n oblige_v to_o subjection_n the_o archbishop_n and_o clergy_n of_o york_n as_o well_o as_o those_o of_o 1640._o where_o be_v the_o representative_n of_o both_o province_n it_o be_v therefore_o the_o royal_a authority_n express_v in_o the_o letter_n patent_n affix_v to_o these_o canon_n that_o give_v they_o power_n and_o they_o be_v therefore_o term_v james_n likewise_o give_v faculty_n confirm_v a_o new_a body_n of_o lecturer_n throughout_o england_n preacher_n that_o be_v neither_o vicar_n parson_n nor_o curate_n these_o instance_n although_o not_o express_v of_o what_o these_o power_n have_v dispense_v with_o or_o indulge_v yet_o be_v pertinent_a upon_o this_o account_n what_o sovereign_a power_n be_v thus_o put_v forth_o in_o constitution_n injunction_n and_o direction_n etc._n etc._n in_o ecclesiastical_a matter_n may_v in_o like_a proportion_n be_v exemplify_v in_o exemption_n dispensation_n etc._n etc._n as_o with_o parliament_n and_o other_o counsel_n vest_v with_o authority_n the_o power_n to_o repeal_v law_n and_o statute_n be_v as_o large_a as_o that_o power_n by_o which_o they_o enact_v and_o establish_v they_o for_o example_n king_n james_n may_v by_o his_o prerogative_n confirm_v and_o establish_v a_o new_a order_n of_o the_o clergy_n which_o be_v our_o last_o instance_n he_o may_v by_o the_o same_o
declaration_n when_o be_v it_o know_v that_o a_o bishop_n dean_n or_o double_v benefice_v parson_n leave_v his_o promotion_n and_o become_v nonconformi_v and_o that_o other_o that_o have_v be_v breed_v up_o to_o literature_n at_o great_a charge_n have_v gift_n and_o part_n will_v be_v so_o peevish_a as_o to_o refuse_v they_o and_o be_v thereupon_o force_v to_o divert_v from_o the_o way_n of_o a_o more_o free_a education_n to_o some_o mean_a employment_n to_o get_v a_o livelihood_n or_o live_v upon_o the_o charity_n of_o other_o it_o be_v the_o condition_n of_o hundred_o this_o day_n in_o england_n i_o say_v can_v we_o imagine_v any_o man_n have_v such_o encouragement_n in_o their_o eye_n and_o the_o more_o desirable_a from_o sense_n of_o their_o present_a indigency_n will_v keep_v off_o but_o from_o integrity_n of_o heart_n his_o majesty_n as_o a_o common_a father_n have_v the_o same_o affection_n for_o all_o his_o good_a subject_n and_o never_o more_o prudence_n and_o tenderness_n manifest_v by_o any_o prince_n than_o he_o have_v do_v by_o this_o gracious_a declaration_n one_o party_n such_o as_o conform_v enjoy_v their_o conscience_n with_o special_a advantage_n in_o temporal_a thing_n the_o other_o they_o also_o enjoy_v their_o conscience_n with_o freedom_n from_o those_o severe_a proceed_n and_o those_o be_v satisfy_v also_o and_o now_o let_v not_o any_o man_n eye_n be_v evil_a because_o his_o majesty_n have_v be_v so_o good_a to_o their_o brethren_n let_v i_o say_v again_o that_o his_o majesty_n have_v in_o tenderness_n and_o prudence_n do_v a_o great_a work_n and_o that_o which_o have_v lie_v undo_v to_o the_o disturbance_n of_o his_o good_a subject_n more_o or_o less_o ever_o since_o the_o reformation_n that_o be_v in_o satisfy_v or_o lay_v a_o sufficient_a ground_n for_o satisfaction_n to_o the_o two_o great_a party_n which_o divide_v the_o kingdom_n in_o matter_n appertain_v to_o religion_n that_o be_v in_o the_o form_n and_o ceremony_n of_o worship_n in_o the_o profession_n of_o faith_n and_o article_n of_o religion_n according_a to_o the_o establishment_n 13_o eliz._n there_o be_v a_o union_n in_o the_o acknowledgement_n of_o both_o party_n and_o this_o without_o the_o least_o detriment_n or_o just_a prejudice_n of_o either_o party_n those_o that_o conform_v enjoy_v their_o conscience_n employ_v their_o talent_n and_o reap_v the_o encouragement_n of_o the_o establish_a government_n without_o any_o loss_n or_o detriment_n to_o those_o that_o conform_v not_o and_o this_o party_n enjoy_v their_o conscience_n freedom_n from_o suffer_v and_o a_o liberty_n to_o follow_v their_o calling_n without_o the_o least_o damage_n to_o the_o conformist_n quest_n be_v there_o any_o necessity_n his_o majesty_n shall_v exert_v a_o sole_a power_n in_o affair_n of_o religion_n when_o the_o peace_n and_o unity_n of_o the_o nation_n be_v herein_o undertake_v by_o his_o parliament_n and_o many_o thing_n endeavour_v that_o way_n by_o they_o and_o purpose_n its_o likely_a of_o a_o further_a progress_n therein_o answ_n for_o answer_v it_o will_v be_v necessary_a to_o insert_v here_o brief_o a_o narrative_a of_o some_o passage_n of_o his_o majesty_n and_o his_o parliament_n in_o these_o proceed_n his_o majesty_n observe_v how_o affair_n stand_v here_o in_o this_o kingdom_n and_o the_o distraction_n that_o be_v upon_o man_n mind_n about_o religion_n and_o form_n of_o worship_n and_o consider_v there_o be_v but_o two_o way_n suppose_v ordinary_o to_o reduce_v a_o people_n again_o to_o peace_n and_o unity_n in_o religion_n 1._o either_o by_o severity_n to_o discourage_v or_o extirpate_v or_o 2._o by_o lenity_n and_o indulgence_n to_o bear_v with_o dissenter_n his_o majesty_n consider_v those_o form_n and_o way_n of_o worship_n to_o which_o conformity_n be_v now_o require_v have_v not_o only_o be_v much_o scruple_v and_o contend_v against_o by_o learned_a and_o sober_a man_n from_o the_o begin_n ever_o since_o the_o first_o reformation_n but_o of_o late_a utter_o disfavour_v by_o a_o representative_a of_o the_o nation_n and_o a_o synod_n of_o learned_a man_n and_o that_o different_a practice_n in_o the_o service_n and_o worship_n of_o god_n have_v be_v former_o patronise_v and_o encourage_v and_o such_o that_o be_v no_o other_o but_o what_o be_v receive_v and_o observe_v in_o the_o best_a reform_a church_n abroad_o and_o by_o the_o dutch_a and_o french_a church_n here_o at_o home_n upon_o these_o and_o the_o like_a consideration_n his_o majesty_n choose_v upon_o great_a deliberation_n the_o way_n of_o indulgence_n it_o be_v also_o most_o suitable_a to_o his_o conscience_n and_o sweetness_n of_o his_o nature_n this_o his_o resolution_n he_o profess_v to_o all_o the_o world_n and_o engage_v himself_o by_o promise_n to_o his_o people_n he_o will_v endeavour_v the_o effect_v thereof_o which_o be_v more_o than_o evident_a in_o the_o many_o declaration_n he_o make_v hereof_o and_o repeat_v again_o upon_o all_o occasion_n he_o be_v please_v in_o a_o declaration_n from_o breda_n to_o assure_v a_o liberty_n to_o tender_a conscience_n and_o that_o no_o man_n shall_v be_v disquiet_v or_o call_v in_o question_n for_o difference_n of_o opinion_n in_o matter_n of_o religion_n which_o do_v not_o disturb_v the_o peace_n of_o the_o kingdom_n and_o in_o his_o speech_n july_n 17._o 1660._o he_o profess_v that_o he_o owe_v his_o be_v here_o to_o god_n blessing_n upon_o the_o intention_n and_o resolution_n he_o have_v and_o express_v in_o that_o declaration_n this_o declaration_n his_o majesty_n afterward_o term_v a_o promise_n solemn_o make_v this_o solemn_a declaration_n or_o promise_n be_v so_o much_o upon_o his_o royal_a heart_n that_o he_o tell_v both_o house_n july_n
