my_o lord_n coke_n assertion_n be_v that_o these_o act_n be_v treason_n when_o they_o be_v commit_v against_o a_o king_n in_o possession_n whether_o he_o be_v king_n de_fw-fr jure_fw-la or_o no_o and_o not_o treason_n when_o they_o be_v commit_v against_o a_o king_n out_o of_o possession_n though_o he_o be_v king_n de_fw-fr jure_fw-la before_o i_o examine_v the_o ground_n of_o his_o assertion_n i_o shall_v first_o state_n the_o point_n of_o controversy_n the_o question_n therefore_o be_v not_o whether_o some_o of_o these_o act_n may_v not_o be_v punish_v as_o treason_n under_o a_o usurper_n if_o they_o be_v commit_v against_o the_o necessary_a order_n of_o government_n and_o not_o do_v for_o the_o restore_n of_o the_o king_n de_fw-fr jure_fw-la to_o his_o crown_n or_o as_o well_o as_o robbery_n murder_n and_o the_o like_a as_o offence_n not_o against_o the_o usurper_n but_o the_o lawful_a king_n second_o to_o levy_v war_n against_o he_o or_o to_o be_v adherent_a to_o his_o enemy_n or_o to_o compass_v his_o death_n out_o of_o a_o private_a seditious_a principle_n and_o not_o out_o of_o any_o regard_n to_o the_o right_n and_o interest_n of_o the_o lawful_a king_n as_o suppose_v any_o man_n shall_v practise_v with_o a_o foreign_a prince_n to_o invade_v the_o nation_n not_o in_o the_o lawful_a king_n behalf_n or_o shall_v betray_v any_o fort_n or_o castle_n or_o any_o part_n of_o the_o country_n to_o he_o or_o the_o like_a for_o these_o also_o be_v offence_n not_o so_o much_o against_o the_o person_n and_o interest_n of_o the_o usurper_n as_o against_o the_o course_n of_o the_o government_n and_o strike_v through_o the_o person_n of_o the_o usurper_n at_o the_o person_n and_o authority_n of_o the_o lawful_a king_n and_o in_o that_o regard_n may_v be_v just_o look_v upon_o and_o punish_v as_o treason_n so_o the_o swear_v false_o though_o by_o a_o idol_n may_v be_v look_v upon_o and_o punish_v as_o perjury_n because_o it_o terminate_v upon_o the_o majesty_n of_o the_o true_a god_n but_o all_o this_o may_v be_v grant_v and_o yet_o it_o do_v not_o follow_v that_o the_o allegiance_n of_o the_o subject_n ought_v or_o may_v assert_v that_o treason_n lie_v only_o against_o the_o king_n in_o possession_n i_o shall_v proceed_v therefore_o to_o consider_v the_o ground_n of_o his_o assertion_n it_o be_v indeed_o true_a in_o fact_n that_o the_o act_n declare_v to_o be_v treason_n in_o the_o statute_n 25_o edw._n 3._o will_v be_v adjuge_v and_o punish_v as_o treason_n under_o every_o king_n in_o possession_n whether_o he_o be_v king_n de_fw-fr jure_fw-la or_o no_o for_o though_o he_o be_v a_o usurper_n yet_o while_o he_o be_v in_o the_o throne_n the_o law_n court_n of_o judicature_n and_o every_o thing_n else_o be_v make_v to_o favour_v his_o side_n as_o much_o as_o if_o he_o be_v the_o most_o lawful_a and_o rightful_a king_n his_o party_n be_v hold_v to_o be_v the_o loyal_a subject_n in_o the_o eye_n of_o the_o law_n and_o the_o adverse_a party_n rebel_n and_o traitor_n so_o the_o law_n may_v be_v fit_o compare_v to_o the_o bank_n cast_v up_o against_o the_o sea_n which_o be_v make_v to_o keep_v out_o a_o inundation_n but_o when_o once_o the_o water_n be_v get_v over_o they_o they_o keep_v it_o in_o in_o like_a manner_n the_o law_n be_v make_v to_o prevent_v a_o usurpation_n but_o when_o once_o a_o usurper_n be_v get_v into_o the_o throne_n than_o they_o be_v make_v to_o become_v a_o fence_n to_o he_o to_o keep_v in_o possession_n of_o it_o now_o there_o be_v hardly_o any_o monarchy_n wherein_o there_o have_v be_v more_o usurpation_n than_o there_o have_v be_v in_o we_o and_o it_o ought_v not_o to_o be_v strange_a if_o in_o all_o these_o the_o usurper_n take_v upon_o they_o to_o act_v as_o lawful_a king_n and_o obedience_n be_v pay_v to_o they_o as_o such_o by_o the_o major_a part_n of_o the_o nation_n at_o least_o while_o they_o continue_v in_o the_o throne_n and_o those_o that_o stand_v by_o they_o against_o the_o king_n de_fw-fr jure_v who_o right_n they_o have_v usurp_v be_v look_v upon_o as_o faithful_a and_o loyal_a subject_n and_o reward_v according_o and_o those_o that_o rise_v up_o against_o they_o in_o behalf_n of_o their_o rightful_a king_n be_v declare_v traitor_n and_o rebel_n and_o punish_v as_o such_o and_o so_o the_o whole_a course_n of_o the_o government_n run_v on_o their_o side_n they_o call_v parliament_n and_o then_o the_o law_n be_v make_v in_o favour_n of_o their_o title_n they_o make_v the_o judge_n and_o no_o wonder_n then_o if_o all_o the_o law_n as_o well_o as_o the_o sat._n 25._o edw._n 3._o be_v interpret_v in_o their_o favour_n and_o treason_n lie_v in_o their_o own_o court_n against_o they_o only_o but_o it_o be_v be_v always_o thus_o in_o fact_n be_v no_o just_a ground_n for_o any_o man_n to_o declare_v it_o to_o be_v so_o in_o point_n of_o right_n and_o to_o give_v it_o for_o law_n that_o treason_n be_v only_o against_o the_o king_n in_o possession_n whether_o he_o be_v the_o king_n de_fw-fr jure_fw-la or_o a_o usurper_n we_o may_v therefore_o take_v leave_n to_o examine_v whether_o there_o be_v any_o better_a ground_n for_o this_o assertion_n it_o will_v seem_v a_o very_a odd_a question_n for_o any_o to_o ask_v touch_v the_o law_n which_o be_v make_v in_o any_o settle_a monarchy_n for_o the_o desence_n of_o the_o king_n person_n crown_n and_o dignity_n who_o be_v mean_v by_o the_o king_n in_o those_o law_n the_o lawful_a and_o rightful_a king_n of_o that_o realm_n or_o any_o one_o that_o get_v into_o the_o possession_n of_o the_o throne_n though_o he_o be_v not_o the_o rightful_a king_n but_o a_o usurper_n common_a sense_n will_v hardly_o allow_v such_o a_o question_n to_o be_v put_v for_o the_o king_n de_fw-fr jure_fw-la and_o not_o a_o usurper_n be_v true_o and_o proper_o king_n and_o therefore_o if_o the_o word_n of_o a_o law_n be_v to_o be_v understand_v in_o their_o natural_a and_o proper_a sense_n the_o word_n king_n can_v be_v understand_v to_o
to_o have_v be_v look_v upon_o as_o invalid_a without_o this_o confirmation_n but_o though_o they_o may_v have_v stand_v good_a without_o it_o yet_o that_o will_v not_o have_v be_v by_o virtue_n of_o any_o authority_n in_o these_o king_n but_o upon_o account_n of_o the_o necessity_n of_o government_n and_o the_o presume_a consent_n of_o the_o king_n de_fw-fr jure_fw-la exclude_v from_o their_o right_n it_o may_v be_v object_v that_o the_o act_n of_o parliament_n make_v by_o hen._n 4._o 5._o 6._o be_v not_o confirm_v by_o the_o parliament_n 1._o ed._n 4._o therefore_o it_o may_v be_v conclude_v that_o that_o parliament_n look_v upon_o the_o statute_n make_v by_o a_o usurper_n and_o his_o parliament_n as_o good_a and_o effectual_a without_o the_o confirmation_n of_o a_o king_n de_fw-fr jure_fw-la i_o answer_v there_o be_v some_o of_o their_o act_n of_o parliament_n confirm_v there_o viz._n any_o act_n make_v by_o they_o for_o the_o sound_n any_o abbey_n religious_a house_n etc._n etc._n and_o any_o make_v for_o the_o town_n of_o shrewsbury_n and_o though_o the_o rest_n of_o their_o act_n of_o parliament_n may_v be_v look_v upon_o as_o valid_a without_o confirmation_n of_o ed._n 4._o yet_o their_o be_v look_v upon_o as_o valid_a be_v not_o to_o be_v ascribe_v to_o any_o authority_n in_o a_o king_n de_fw-fr facto_fw-la sufficient_a to_o make_v they_o so_o for_o then_o that_o authority_n must_v have_v have_v the_o same_o effect_n in_o all_o their_o other_o act_n of_o government_n their_o judicial_a act_n grant_n letter_n patent_n etc._n etc._n as_o it_o have_v in_o the_o statute_n make_v in_o the_o parliament_n hold_v by_o they_o these_o instance_n from_o our_o statute_n and_o record_n of_o purliament_n may_v be_v sufficient_a to_o prove_v the_o contrary_a to_o what_o my_o lord_n coke_n give_v for_o law_n viz._n that_o treason_n do_v not_o lie_v only_o against_o the_o king_n in_o possession_n whether_o king_n de_fw-fr jure_fw-la or_o no_o i_o come_v therefore_o now_o to_o consider_v his_o proof_n of_o his_o assertion_n we_o have_v in_o his_o note_n upon_o the_o word_n signior_n le_fw-fr roy_fw-fr in_o the_o statute_n of_o treason_n first_o his_o main_a assertion_n that_o by_o those_o word_n be_v mean_v the_o king_n in_o possession_n only_o though_o he_o be_v de_fw-fr facto_fw-la and_o not_o the_o jure_fw-la and_o not_o the_o king_n out_o of_o possession_n though_o de_fw-fr jure_fw-la and_o for_o the_o proof_n of_o this_o he_o refer_v we_o in_o the_o margin_n to_o the_o stat._n 11._o h._n 7._o c._n 1._o second_o we_o have_v some_o other_o point_n of_o law_n which_o he_o bring_v to_o illustrate_v and_o confirm_v his_o main_a position_n viz._n that_o treason_n against_o a_o king_n de_fw-fr facto_fw-la be_v punishable_a by_o the_o king_n de_fw-fr jure_fw-la when_o he_o come_v to_o the_o crown_n and_o that_o a_o pardon_v grant_v by_o a_o king_n de_fw-fr jure_fw-la that_o be_v not_o also_o the_o facto_fw-la be_v void_a and_o for_o the_o proof_n of_o these_o he_o refer_v to_o the_o year-book_n of_o law_n case_n 4_o ed._n 4._o 1._o and_o 9_o ed._n 4._o 1._o 2._o the_o stat._n 11_o h._n 7._o c._n 1._o which_o he_o refer_v to_o for_o his_o main_a position_n i_o have_v set_v down_o before_o as_o a_o distinct_a argument_n from_o whence_o it_o be_v infer_v that_o allegiance_n be_v due_a to_o the_o king_n in_o possession_n and_o therefore_o i_o shall_v consider_v it_o apart_o in_o its_o proper_a place_n and_o consider_v here_o my_o lord_n coke_n secondary_a point_n that_o treason_n against_o a_o king_n de_fw-fr facto_fw-la be_v punishable_a by_o the_o king_n de_fw-fr jure_fw-la when_o he_o come_v to_o the_o crown_n and_o a_o pardon_v grant_v by_o a_o king_n de_fw-fr jure_fw-la out_o of_o possession_n be_v void_a and_o they_o be_v rather_o to_o be_v consider_v first_o because_o if_o they_o be_v sufficient_a to_o prove_v that_o trason_n lie_v against_o a_o king_n in_o possession_n only_o they_o prove_v that_o it_o do_v so_o by_o the_o common_a law_n before_o the_o statute_n of_o hen._n 7._o and_o so_o overthrow_v all_o that_o have_v be_v allege_v above_o to_o the_o contrary_n 29._o 9_o e._n 4._o 6._o disseize_v of_o the_o place_n of_o clerk_n of_o the_o crown_n by_o one_o have_v and_o thereupon_o sue_v he_o ive_n plea_n against_o bagott_n be_v that_o he_o be_v a_o alien_n hold_v good_a not_o by_o virtue_n of_o any_o write_a law_n but_o because_o as_o bagott_n council_n plead_v the_o reason_n of_o government_n and_o common_a equity_n require_v that_o such_o act_n of_o a_o usurper_n shall_v stand_v good_a as_o tend_v not_o to_o the_o diminution_n of_o the_o crown_n but_o then_o this_o be_v no_o proof_n that_o all_o other_o judicial_a act_n and_o grant_n whatsoever_o though_o tend_v direct_o to_o the_o prejudice_n of_o the_o lawful_a king_n shall_v be_v look_v upon_o to_o oblige_v he_o at_o his_o return_n or_o to_o bind_v the_o conscience_n of_o his_o subject_n statute_n give_v away_o the_o right_n of_o the_o lawful_a king_n to_o the_o usurper_n that_o one_o king_n with_o his_o parliament_n may_v make_v a_o statute_n to_o alienate_v and_o transfer_v the_o right_n to_o the_o crown_n from_o those_o that_o be_v the_o lawful_a king_n by_o the_o fundamental_a constitution_n of_o the_o realm_n to_o such_o as_o by_o the_o fundamental_a constitution_n be_v not_o the_o lawful_a king_n but_o usurper_n now_o this_o i_o conceive_v be_v not_o in_o the_o power_n of_o any_o king_n and_o parliament_n however_o legal_a much_o less_o of_o such_o as_o henry_n 7_o realm_n whether_o this_o person_n be_v he_o next_o in_o blood_n to_o the_o former_a king_n or_o another_o of_o the_o royal_a line_n to_o who_o the_o crown_n descend_v by_o virtue_n of_o a_o limitation_n of_o the_o succession_n from_o the_o next_o in_o blood_n to_o he_o for_o whether_o the_o one_o or_o the_o other_o of_o these_o be_v the_o rightful_a king_n he_o be_v so_o by_o virtue_n will_v not_o allow_v any_o such_o statute_n to_o have_v any_o force_n but_o protest_v against_o it_o as_o illegal_a and_o of_o no_o authority_n and_o yet_o all_o this_o may_v be_v do_v according_a to_o law_n if_o the_o king_n and_o parliament_n have_v a_o power_n to_o alienate_v and_o transfer_v the_o right_n of_o all_o the_o subsequent_a lawful_a king_n to_o any_o usurper_n that_o shall_v be_v strong_a enough_o to_o depose_v or_o exclude_v they_o but_o i_o need_v not_o to_o have_v prove_v this_o which_o be_v suppose_v in_o the_o question_n viz._n that_o this_o statute_n do_v not_o give_v away_o the_o right_n of_o the_o lawful_a king_n depose_v or_o exclude_v but_o still_o leave_v he_o king_n de_fw-fr jure_fw-la and_o reserve_v to_o he_o a_o right_a to_o claim_v and_o recover_v his_o crown_n only_o it_o oblige_v the_o subject_n notwithstanding_o to_o stand_v by_o the_o king_n in_o possession_n though_o a_o usurper_n i_o shall_v therefore_o proceed_v upon_o this_o supposition_n and_o show_v that_o this_o statute_n as_o it_o require_v the_o subject_n to_o stand_v by_o the_o usurper_n in_o possession_n against_o their_o rightful_a and_o

king_n de_fw-fr facto_fw-la have_v the_o life_n and_o fortune_n of_o the_o subject_n at_o his_o mercy_n and_o therefore_o it_o be_v at_o least_o lawful_a for_o they_o when_o their_o rightful_a king_n can_v rescue_v they_o out_o of_o his_o hand_n to_o swear_v a_o new_a allegiance_n to_o he_o 1._o the_o subject_n enjoy_v all_o the_o common_a benefit_n of_o civil_a government_n from_o this_o protect_v they_o be_v not_o his_o own_o but_o the_o lawful_a king_n and_o he_o first_o deprive_v the_o subject_n of_o the_o lawful_a king_n protection_n before_o he_o tender_v they_o his_o own_o and_o therefore_o in_o effect_n take_v away_o from_o they_o as_o much_o as_o he_o give_v and_o beside_o invade_v the_o subject_n right_n who_o be_v not_o oblige_v to_o be_v subject_a to_o any_o but_o their_o lawful_a prince_n and_o his_o not_o deprive_v they_o of_o protection_n be_v only_o forbear_v do_v they_o a_o far_a injury_n so_o that_o though_o they_o reap_v some_o benefit_n from_o his_o can_v be_v exert_v for_o his_o service_n 2._o but_o second_o the_o king_n de_fw-fr facto_fw-la have_v their_o life_n and_o fortune_n at_o his_o mercy_n and_o therefore_o it_o be_v at_o least_o lawful_a for_o they_o when_o the_o king_n de_fw-fr jure_fw-la can_v rescue_v they_o out_o of_o his_o hand_n to_o save_v their_o life_n and_o mean_n of_o subsistence_n by_o swear_v allegiance_n to_o that_o person_n who_o have_v they_o in_o his_o power_n to_o this_o i_o answer_v that_o swear_v allegiance_n '_o imply_v two_o thing_n 1._o a_o full_a and_o entire_a submission_n so_o as_o never_o to_o attempt_v any_o thing_n against_o the_o king_n de_fw-fr facto_fw-la for_o the_o king_n de_fw-fr jure_fw-la and_o this_o when_o they_o must_v do_v it_o or_o die_v may_v seem_v to_o be_v lawful_a because_o their_o death_n deprive_v the_o king_n of_o so_o many_o of_o his_o subject_n and_o their_o engage_v never_o to_o act_n for_o he_o do_v no_o more_o and_o be_v but_o the_o same_o as_o if_o they_o shall_v take_v quarter_n of_o a_o enemy_n in_o war_n that_o have_v they_o at_o his_o mercy_n and_o this_o may_v be_v true_a where_o there_o be_v so_o service_n to_o be_v do_v to_o their_o king_n cause_n and_o the_o true_a profession_n of_o the_o principle_n of_o loyalty_n by_o their_o suffer_a death_n and_o sacrifice_v their_o own_o life_n towards_o the_o recovery_n of_o a_o nation_n from_o a_o principle_n of_o rebellion_n to_o a_o true_a sense_n of_o their_o allegiance_n but_o in_o most_o usurpation_n there_o be_v first_o a_o rebellion_n of_o the_o subject_n and_o a_o apostasy_n from_o he_o principle_n of_o loyalty_n and_o in_o this_o case_n it_o may_v be_v consider_v whether_o any_o who_o example_n may_v have_v influence_n upon_o the_o 〈◊〉_d of_o the_o nation_n may_v not_o be_v oblige_v even_o to_o loose_v their_o life_n for_o the_o king_n de_fw-fr jure_fw-la because_o here_o their_o death_n may_v do_v some_o service_n to_o religion_n and_o the_o king_n cause_n whereas_o in_o war_n their_o die_v rather_o then_o to_o take_v quarter_n and_o make_v themselves_o captive_n to_o a_o enemy_n that_o have_v their_o life_n at_o his_o mercy_n will_v do_v their_o king_n so_o service_n at_o all_o 2._o allegiance_n import_v a_o engagement_n of_o the_o subject_n to_o stand_v by_o and_o maintain_v the_o king_n in_o possession_n against_o the_o king_n de_fw-fr jure_fw-la and_o this_o if_o any_o of_o they_o engage_v to_o do_v the_o king_n de_fw-fr jure_fw-la do_v more_o than_o than_o lose_v a_o subject_a for_o he_o get_v a_o enemy_n who_o if_o he_o act_n according_a to_o his_o new_a engagement_n be_v oblige_v even_o to_o oppose_v he_o to_o the_o death_n if_o he_o endeavour_v to_o recover_v his_o crown_n but_o why_o may_v not_o this_o be_v do_v since_o the_o end_n for_o which_o man_n be_v place_v under_o a_o government_n be_v the_o preservation_n of_o their_o life_n and_o property_n and_o therefore_o when_o that_o protection_n fail_v they_o whereby_o they_o the_o court_n one_o whereof_o be_v he_o be_v dr._n burnet_n '_o s_o hist_n reform_v p._n 2._o p._n 248._o l_n reflection_n on_o the_o 3_o d._n and_o 4_o the_o tome_n of_o mr._n varillas_n as_o p._n 126._o though_o this_o be_v a_o point_n in_o law_n that_o may_v have_v some_o colour_n in_o it_o yet_o it_o be_v far_o from_o confound_v any_o for_o a_o council_n or_o a_o great_a seal_n flow_v from_o
